Out of Sight
Summary: Y/N has an unexpected dash of inspiration. Arthur doesn't require much convincing.
Warnings: Swearing, Smut
Words: 4,221
A/N: This fun little request comes from @sweet-nothings04. You're wonderful and I hope this meets your expectations. Thanks for the request - I can't imagine ever writing this without it! 🙈 Special thanks to @jokerownsmysoul for agreeing to beta!
If you have any thoughts or questions, please comment, feel free to message me, or send me an ask. Requests for Arthur and WWH are open!
Tumblr media
Words didn't often fail Y/N, but the admission left her foggy, reminiscent of what she'd experienced after tipping over in a wheelbarrow race at a school fair. Her foot swung back and forth as she sat on the counter. Fiddled with the phone cord and twisted its beige, plastic curls around her fingers. Were there signs she'd missed? Was her gut right in insisting she was a terrible friend?
"Marriage counseling?" she repeated.
Arthur stopped filling his bowl with sandy, pecan cookies, alarm encroaching his features. She waved off his concern, mouthing "not us" before she spoke into the receiver. "I'm so sorry." With a grimace of understanding, he patted her knee and ducked out, sweets in hand. No doubt he'd ask her to elaborate. Not that she had anything to share. Not yet. "I had no idea you and Robert were having problems."
Patricia laughed lightly on the other end. "Neither of us have our bags packed." A whistle came from the background. Vague cheering. Then mild cursing about how terrible this season's Gotham Guardsmen's picks were. She sighed. "The little green monster's dropped-in since your wedding. Don't get me wrong. I couldn't be happier for you if you were my own sister."
Y/N wished Patricia was within arm's reach instead of all the way in Burnside.
"Next month we'll have been married thirty-five years," Patricia continued with a rare nostalgia. "We're a team, Robert and me. But we've both let things go, gotten old. I'd like the spark back before we lose the kindling."
Pursing her lips, Y/N bit back her qualms. Rebutting the steps Patricia had taken was uncalled for, and doubly so when she needed her support. Besides. Y/N understood them. She'd climbed them once, too.
When she'd begun to figure out the direction in which the weather vane of her life pointed, the comfort and confidence she'd shared with her ex-husband had started to wither. Transformed over the years into an awareness that her childish belief in love being enough was inaccurate. It was natural, she thought in hindsight. They'd wed at seventeen and twenty-one. But divorce had been uncommon back then, particularly in a small town in the Bible Belt. The night she'd moved in with a friend (a tactic to delay confessing defeat to her family), Jeff suggested they speak with a professional. Though her heart had known it was over, she cared for him. She couldn't deny them the chance to salvage their union, no matter how remote.
A solitary counselor was available, a disadvantage of rural living. The man claimed to be a pioneer in couples therapy, having begun his practice in the thirties. One forty-five-minute drive later and they'd found themselves squished into a leather loveseat in a smoky, cramped office. Diplomas and certificates covered the walls, the veracity of which she couldn't verify. Dr. Ellis's puffy pink cheeks and offer of sweet tea had been kinder than his approach.
Fountain pens and worksheets were provided with the mumbled instruction to answer honestly. But the questions had not fit her situation. They were for women who desired to be happy homemakers. To plan meals and do the weekly shopping. To nurse children and have dinner ready by six. Responsibilities and life stages that had given her mother purpose - a purpose that mostly eluded Y/N. Every comma and quotation mark inferred fault. And Dr. Ellis had read her responses like a disappointed teacher.
Somehow the filmstrips, accompanied by a crackling LP, were worse. Mr. Provider and Mrs. Housewife were featured. He consistently came home on time. She always wore an apron. The narrator's spiritless voice contrasted with the cheery soundtrack while matching Y/N's mood. A lively ping! cued them to advance to the next still, a duty switched between her and Jeff to practice teamwork. At least the sidelong looks they shared could still connect them.
The slides, the homework, the speeches. They all pointed to one problem: her. Her parents were a model couple. Didn't she know encouraging her husband in his livelihood was her job? That his main obligation was to invite her to share his success? She had to mend her ways. Make herself more attractive. Be grateful he displayed his affection by returning to her after a long day at the office; he could just as easily hang out at The Rusty Boot.
Not a little indignant, she'd stared at Jeff's profile. Downcast eyes betrayed his regret and assured she'd maintain composure, for his sake if nothing else. She fixed her focus on Dr. Ellis and gave the situation a good, long think. Jeff had never questioned her ambitions. Who the hell was this jackass to judge?
She'd covered Jeff's hand, rubbed his knuckle with her thumb. "You're the expert here, doctor. But isn't it possible neither party is at fault?"
"Mrs. Thompson, I've heard that misconception from many of my clients. It's never led anywhere positive. Now-"
"But what if they're both good people?" she interrupted, hanging onto diplomacy by a thread. Her resolve stayed, even as her volume lowered at the prospect of wounding the man she'd loved as a girl. "Good people who've grown apart?"
Dr. Ellis took what she'd learned was his usual position on the corner of his cherry desk. "You're mistaking natural sex differences for incompatibility. Not every husband allows his wife to work outside the home." His paternal smile hadn't diminished the sting of his words. "If you want your marriage to thrive, I'd advise a little more maturity. And I think I have just the book to help you."
Twenty tons of silence festered on the ride home, louder than the pulse beating her eardrum. Distress distracted her from noticing the run in her stockings. And it was drizzling. She cracked the passenger window of the Lincoln Continental, anyway. Closed her eyes at the bite of raw air against her overheated face.
"Look, I don't agree with what that guy says," Jeff started. He pulled at the gearshift and flicked the turn-signal. "Not when it comes to you."
As the car came to a stop, she swiped at her eyes. "I'm not going again." The press of a napkin to her palm prompted a mix of appreciation and annoyance. For his courtesy and that he'd detected her tears. "Do you even like being married to me?"
"Y/N-"
"Please." She flinched at his attempt to embrace her. "Don't spare my feelings."
Headlights from a passing car flashed in the cabin, revealing his stretched lips. He raked back his thinning hair. The quiet shake of his head when he moved to gaze at her was a relief. "I miss the girl I fell in love with."
She offered a slight shrug and pulled the corners of the tissue. "I don't like it, either."
His rapid blink softened her posture, along with the recognition that the dream they'd had was also out of reach for him. "I'm proud of the woman you've become," he said. "Even if she's not what I need."
"I don't want to be a lawyer's wife." A quiet laugh bubbled up. "The oral arguments are terrible."
He checked his blind spot and put the sedan back into drive. "I'll file the papers tomorrow. We can tell your parents and sister together. If you'd like." After some seconds, she'd slid across the bench seat and put her head on his shoulder, heartened by an affinity she'd nearly forgotten.
Counseling techniques must have evolved, Y/N considered. Perhaps Patricia would find help instead of blame. If not, tips in women's magazines were a tacky if economical alternative. She'd have to check the breakroom at work for forgotten issues.
She hopped off the counter and poured herself another cup of decaf. "Let me know if we can do anything. And how it goes."
"The first few sessions were great. I picked up a few booklets. 'Modern Marriage,' 'The Complete Woman...' Oh!" Paper shuffled as Y/N put back the milk. "'Enrichment & Exploration: Tips for Bedroom Fun.' I tried reading it with Robert the other night, but he left when I mentioned massagers and blindfolds."
"He's sixty," Y/N snorted. "Give him time."
Peeking around the corner, she spotted Arthur in his writing nook. He stood to stretch, then grab his lighter and pack of Stuttons. The low sit of his pajama bottoms was enough of a temptation for her to tuck her lip. An unexpected spasm tickled her abdomen. "Brief me on the blindfold chapter."
~~~~~
Nervous anticipation had kept her feverish for hours, ever since she'd bid farewell to Arthur with a "Save a smile for me" on her way out the door. His clumsy smooch lingered as she changed the date on her rubber stamp. While she cleaned the office refrigerator, she spent a good sixty seconds pressing a cup of expired yogurt to her flush cheeks. When the shoulder strap of her canvas bag gave out, she shrugged rather than cursed and settled the tote in her lap. With her plan in mind, the corners of her lips refused to relax .
After working the grand opening of the Gotham Mall, Arthur had the workshop she'd registered him for, a beginners' seminar for stand-ups. He'd be home right around six. That would give her thirty minutes to change into her mini nightdress with the ruffled hemline, dab musk oil behind her earlobes, and put on an LP. Dinner would be delayed - neither of them would be in the mood if they were too full. If she remembered correctly, they had a pizza in the freezer, the good kind with the real pepperoni and rising crust. She just had to figure out if she should wait in the bedroom or lounge on the sofa like a poor-man's Lauren Bacall.
As she unlocked the apartment, however, there came a muffled phomp-phomp-phomp. The unmistakable sound of a sink plunger. Fuck. This was the third time this month. Pushing through the door, she hoped the super had called a different plumber. It had taken ages to clean up the stray sediment left behind by the last one. Upon entering, Arthur's plaid bag came into view, next to his keys on the counter. A glance into the kitchen confirmed he was trying his hand at the repair.
"Hey." Y/N hung her coat, glad her consternation was hidden by the wall. "What happened to your class?" she asked with deliberate playfulness. "Did they decide you were too advanced?" She crossed her arms and moved to the doorway. Tried to hold onto the tendrils of fading arousal by taking him in.
A pleased chuckle. "The instructor left a message." Phomp-phomp-phomp."It'll be rescheduled."
"I know you were looking forward to it." The rolled-up sleeves of his shirt and flexing biceps were having the right effect. She ambled towards him. "Let me help."
"It's fine. I had to do this a lot at my old place." The set of his jaw tightened as it gave it another go.
They went through the litany of usual questions. Arthur contently reported the mall had gone well, except for a couple of teenagers who'd given him grief at the start. ("Nothing serious. They were just kids.") Her nine-to-five had been quite low-key, she explained, and had allowed her to catch-up on a backlog of paperwork. ("With the new judge, we keep having to file motions for correction.") But when he asked about this evening, she mused and tapped her fingertips on the counter. Horny, annoyed at her thwarted plan, yet nevertheless itching to seduce him
Water streamed as he turned the faucet's handle, followed by his satisfied hum. He tidied up, then washed to his elbows. Grabbed the nearby dish towel and pivoted on his heel to face her. "What is it?" he asked at her lack of response. He wiped his hands a little harder. "I thought you'd be glad I'm already here."
Seeking to allay his concern, she scooted next to him with a gentle nudge. "You know I am. You've been running through my head all day." She scrunched her nose. "I just had this idea for a romantic evening and wanted to surprise you."
"Oh." Pink colored his chiseled cheekbones and his eyes softened. "You still could. I'd like that." Ardor sparked anew in her belly. Unfurled as he leaned into her, grin cutting across his mouth and straight into her heart. "Would ten minutes be enough?"
Her toes curled. His enthusiasm for her, for them, had a habit of sending electricity up her spine. "Better make it eight," she pronounced.
A sharp nod and a pat to her bottom later, he dashed off. Once the bathroom door shut, Y/N rushed to rummage in his workbag, delighted when she found her prize. She scurried to the stereo and put on one of her soul records. Adjusted the volume to a suggestion instead of distraction. Though the genre wasn't his favorite, it never failed to induce the swivel of his hips. Unbuttoning, unzipping, she made her way to the bedroom. Yanked off her tan skirt and jacquard sweater before carelessly tossing them in the nearby chair.
She'd just gotten settled on the foot of the bed when Arthur sauntered in. Clad in his white briefs and wrinkled socks. "That was five," she said and wadded her pantyhose to hurl at him.
He dodged it easily, stepping forward to gaze at her with hooded eyes, their clear green darkened with need. He licked his lips. "I think it was four." Without further preamble, he knelt between her legs. Scrambling up the bed, she kicked subtly against his hold on her calves. Bit her lip on a giggle as he crawled over her lap to smother her with kisses. She rested on the headboard and nabbed his red and gold Carnival tie from under her pillow.
He quirked a dark brow. "What, you want me to wear it?"
Before any reservation could resurface, she smoothed the broad neck of the tie over her eyes and secured it loosely at her temple. Hesitation floated through the air. Threatened to pierce the veil of desire that enveloped her. She wondered what he was waiting for. If he was wearing that wolfish grin he saved for the bedroom. Or if a modicum of anxiety had spawned. She had sprung this on him without prior discussion. The muffled music from the living room switched to the next song. She attempted to peek under the bottom of the makeshift blindfold, tried to make out more than a vague shadow in the muted light.
But then he sunk into her. Wrapped his arms around her shoulders and pressed her into the mattress. "If you're uncomfortable, tell me," he murmured into her mouth. "Please."
The implication of his request, albeit more loving than licentious, wracked her with want. She couldn't halt her shudder. Blindly, she reached to cup his face. "I trust you," she promised. To both him and herself.
His round nose dragged down the underside of her jaw. "Where'd you get this idea?"
The caress of his smile on the crook of her neck caused a delicious heaviness to settle in her center. "A pamphlet."
"On what?" He tugged at the knot between her ample breasts. Fondled her through the thin satin. "How to make your husband high-strung?"
She carefully skimmed the rigid bulge in his briefs with her knee. "It was actually on how to loosen him up," she retorted. He always loved it when she paraphrased one of his jokes.
Every hushed kiss, every whisper of him against her flesh was magnified. Forced her to concentrate solely on him, to pay attention to each move he made. His humid, hot breath teased her nipple, prompted it to pebble with a twinge. When she released an embarrassingly desperate whimper, he snorted lightly and slipped his palm to the middle of her back. Following his lead, she arched into him. His soft curls brushed her as he laved her areola, swirled his tongue around it, her skin coming alive at the contact. Weathered hands that had so eagerly learned how to touch her groped her neglected breast, rolled its peak between slender, nimble fingers. She fisted the pillow, tipped her head, and grasped his shoulder with a cry. "Arthur..."
Getting her going usually wasn't difficult. Especially when she'd been thinking about making love for an inappropriate number of office hours. But the suspense of not seeing where he'd next pet her, of every caress being a discovery, had her core already pulsing for him. The intrigue was a treat. The best case she'd ever worked on. His strokes walked a path to every clue.
His fingertips skimmed her inner thighs. Groaning, he hooked them under the waistband of her bikini, tugged until she lifted her rear. He pulled them off hastily. With a gentle pressure, he encouraged her to open herself to him. She did so gladly, splaying her legs without a hint of self-consciousness. The relatively cool temperature of the room hit her hot, swollen folds and she quivered.
Then there was an odd sensation at her clit. Scratchy. Rough like a canvas. And was that a corner? After a few seconds it was clear it wasn't doing it for her. And she didn't think Arthur was trying to wipe away her slick. Reaching down, she found a twisted bedsheet in his fist. She was relieved he hadn't run to the kitchen for ice.
"Not good?" he asked.
She softened the blow. "You feel better."
The pad of his thumb trailed over her patch of springy hair, a faint tease that sent a dizzying current racing through her limbs. She strove towards him but he didn't oblige. Rather, he took her hand and placed it on her labia. Guided her to dip within her inner lips. A short moan left her, at the sensation and the sound of his increasingly labored breathing, tinged by his deep voice. "You look like sex," he blurted.
Laughing, she halted. Whenever something brazen spilled from his mouth, however left-footed, she adored it. She clasped his sides. "What does that mean?"
"If I'd seen you in a magazine," he started, moving to settle over and straddle her. His hard-on grazed her abdomen, leaving a damp trail of his arousal in its wake. Even as she wondered when he'd taken off his underwear, her muscles tensed and she gasped. Playful pecks met her cleavage. "You'd be pasted on every page of my journal."
Her reply slipped out before discretion could take hold. "We better buy a Polaroid." A stitch of reluctance before she added, "Just keep them in your desk."
He uncurled her fingers and pressed her palm to his chest. "Touch me," he whispered, pleaded. Her pulse quickened. With an unhurried deliberation, he guided her over the peaks and valleys of his body. The lean pectorals she loved to nuzzle after a weary day. The freckled indent of his sternum. Downward, to the slightly loose skin around his navel, then the soft, toned curve of his abdomen.
Unable to resist, she stretched to chart the ridge of muscle leading to his groin. "You make me so wet."
He let out a bashful giggle, edged with excitement. The instant he rasped his next words against her forehead, she knew he was doing his damnedest to rival her. He pushed her hand to his erection. "You make me so hard."
She followed the bulging vein from base to tip, encircled him with a firm grip. The vibration of his harsh grunt rumbled through her and he jerked forward. Released her wrist to stroke her vulva and flick back and forth along her aching nub. Focusing on the satiny feel of his flesh, the heaviness of his length, she felt petite. Feminine. Powerful. Her hand glided between his legs, cupped the sensitive skin with care. His practiced rhythm faltered. The elbow beside her ear trembled.
While he was a captivating visual, one she missed, her imagination was determined to compensate for her lack of sight. Breathless moans spun her fantasies. Perspiration tickled her nose, woodsy and sweet, conjuring memories of his taste in her mouth. Then all at once he was inside her, going down on her, sucking at her while fucking into her. Impossible feats that nevertheless caused a fever in her brain. "Oh, god," she mewled. Her wanton writhing hastened. She ground against his thigh. "I want your cock in me."
He took hold of himself as she held herself open. The blunt tip of him slid just inside her entrance, a drop when she needed an ocean. She grabbed his hips and thrust upward, hissing as he stretched her completely. "You're fucking tight," he uttered through clenched teeth.
She smoothed her palms over his back, memorized each notch of his ribs. The odd angle of his distended shoulder. The strong tendons at the nape of his neck. He crushed her closer, until her mouth bumped his clavicle. She nibbled lightly, licked the salty sheen of sweat from its hollow, drawing her name from his lips and rapid bucks of his pelvis. "Fuck me," she said, a command and an appeal.
A creak came from above. She followed his taut arm to find he'd clutched the headboard. It occurred to her, then, that her inability to see had been liberating for him. Enough to let go of his inhibitions, to give voice to the bawdy, wonderful things he'd said, to not worry about his appearance.
She reached to swipe her clit steadily, relentlessly. Tears pricked her eyes as she became weightless. Her frame seized, and she came with a choked cry. She sniffled and laughed into his neck, overwhelmed by him. The way he made love to her as if he sought to erase her earlier trials and replace them with the present.
His throaty, punctuated groans, his fingernails digging into her ass divulged his approaching release. She ran her foot along his calf, relished in his body as its angles pressed into her. He balanced himself on his knees, snapping into her at an erratic pace. Then all at once he moaned sharply and went rigid, cock twitching. She cradled the back of his head while his essence marked her walls, closed her eyes when he sprawled on top of her.
Raking her hands through his loose waves, she swallowed thickly. Although she'd always enjoyed sex, exploring this way hadn't been conceivable with anyone else. Allowing that match to light, allowing herself to fan that flame had been unthinkable. She'd felt inadequate. Unable to live up to others' demands, especially her own. There'd been too many boxes to check. Revealing herself in that way would have been a demonstration of trust she wasn't quite ready for.
Being an established woman on equal footing with her partner wasn't something she'd believed possible. She'd been content to go without and find meaning through her work. Arthur had helped her augment that. She could be tough as old leather or delicate as gossamer without concern he'd see her differently. If expectations were left unmet, their easy discussions and compromises promised they'd never become resentments. They supported each other - authentically and as themselves.
For the first time, she knew she was loved for who she truly was. And she wouldn't have to change to keep it.
Choppy panting gradually ceased, replaced by leisurely, happy sighs. He skimmed her flank, then the curve of her hip. She tickled his midriff gently, only stopping when he reclaimed her lips and slid his tongue against hers. Tenderly, he loosened the knot at her temple. She blinked at the orange, evening light invading her eyes. When his came into focus, they were still dilated, a tad sleepy. And so full of affection her breath caught.
Cheek propped on the heel of his hand, he raised his eyebrows. "How was it?"
"You have to ask?" she chuckled, swatting his backside.
A stray lock tumbled towards her as he bent closer. "I wanna hear it."
"Wonderful." Her thighs tightened, keeping him within her. "What I've been craving all day."
His smile was a slow build, equal parts shy and deservedly smug. Then he stared at his tie. "I- I don't know if I'll ever be able to wear that again."
She snorted and looped it around his neck, secured it with a half-Windsor knot. "You're a professional, Mr. Fleck. You'll manage."
He rolled to her left and yanked open the nightstand drawer to riffle through its contents. "What else is in the pamphlet?"
"Hey!" She batted him half-heartedly, boosted herself on her elbow, and spooned him. "What if I had a surprise hidden in there?"
Undeterred, he huffed. "It wouldn't beat this."
"Patricia told me about it." He stilled and slanted his gaze her way. "I can get a copy."
At first, Y/N assumed he'd contradict her. That he wanted to keep their escapades private. But once a few seconds had passed, Arthur acquiesced with a smirk and snatched a nearby tissue. Wiped himself off and tossed it in the woven wastebasket. He reclined beside her, hands folded behind his head. "Okay. Just don't give away my whole act."
NINE STUDY TECHNIQUES FOR LAW STUDENTS
Tumblr media
Stephenie Meyer, Cornelia Funk, John Grisham, Stephen King, and many more authors whose work I enjoyed reading as early as I could remember learning how to pick up a book, I was level-headed that I can hurdle the amount of readings that law school would pour upon me, until I actually entered law school.
Whether or not we were a bookworm before entering law school, the text density, alien terms, and low-frequency words is enough to frustrate a law student who is also tasked to read a huge bulk of cases in a short period of time. Law students read annotations and cases not for leisure but to get work done and at the same time memorize and internalize the text. Authors of cases and law textbooks are not as straightforward as those authors in college. In law school, authors will not provide law students on the description or issues in a particular case or topic to have a broad understanding of the law. Rather, its goal is to make students or its readers to "think like a lawyer".
There is no uniform rule on how reading in law school should be done as different things work for different people. However, a person who intends to have an effective and efficient reading to ease up the burden of law school must learn the study techniques. The Art of Critical Reading by Peter Mather and Rita McCarthy provided nine study techniques that I found to be helpful in law school. Allow me to share some of my personal insights and those from a barista friend and a fresh graduate of UST Civil Law batch 2021, whom we shall call, GLS; and a blockmate, Julie.
1. Scanning
Scanning is the process of quickly searching through a reading material in order to locate specific bits of information, such as a specific name, date, fact or statistic.
As a law student, it has greatly helped me in reading cases. One Supreme Court decision may tackle issues covering several areas of the law such as Remedial Law, Civil Law, Criminal Law, Political Law, Labor Law, Taxation, Legal Ethics, and Mercantile Law. In order for me to save time and put my focus on a particular topic, I scan the texts and locate the areas that cover the subject in its fact, issues and ruling.
By using a pen as my pointer, scanning helps me improve my focus and regulate the speed of my reading. It allows me to remember in what area of the text must be given emphasis when I read it thoroughly after scanning.
Before I start reading a case, I usually scan the whole thing first. This is so I can filter out the irrelevant topics/discussions that aren't covered by the subject matter to which the case falls under. It not only saves time, it also helps me remember the case much better. -GLS
Scanning helps me in reading cases because not all parts of the case is relevant to the issue for a certain class. Scanning saves me time because I am able to pinpoint the relevant parts to read and the parts to disregard. In times when I am using multiple resources or books, what I do is to scan the reading material first to find the relevant portions of the reading material that is related to the topic of the class. -Julie
2. Skimming
Skimming is a means of familiarizing oneself with the content and organization of a reading material before one begins to read it carefully.
As a law student, we are tasked to read an average of 20 cases per subject in a day. Through skimming, I am able to gauge the length of the material, the number of main topics I should focus on and the weight of the vocabulary by locating highfalutin words in order for me to prepare myself to match that of the writer’s.
Skimming helps me save time and estimate the cases I am able to read within a specific period and adjust my time whenever necessary. It also allows me to be familiarized with the vocabulary of the writer and condition my mind’s comprehensibility. By skimming, I am able to locate the formatting of the texts like its italics, bolding and underlining. I am then able to get an overview of what the Court intends to give emphasis that is related to the topic in our class.
I tend to jot down my notes either in a notebook or on the spaces of my codals. So an hour or so before class, I skim my notes/codal in order to go over what I studied for the whole day and refresh my memory. -GLS
What I do during summer break is that I skim the reviewers for the subjects for the next semester to have a general overview of all the topics. It helps me a lot because I tend to understand the concepts during class easier if I have a general overview to the subject before going into the particulars. -Julie
3. SQ3R (Survey, Question, Read, Recite, Review)
SQ3R stands for survey, question, read, recite, and review.
Surveying helps me to have an initial understanding of the material by looking at the prominent elements such as the format, headings, tables and charts, and pictures, if there are any. Annotations in law school have a heavy text density and by surveying, I can adjust my visual expectations to avoid disengagement before I even begin reading.
Questioning gives my mind a “wake up call” to start being active and spot possible questions such as the topic I’m reading, the parties, the material dates, and the benefits I could gain from the material. Cases in law school, especially in subjects which are easy to visualize like family and criminal cases, can make a law student be carried away and focus more on immaterial facts than those needed by the topic. Through questioning, it helps me be reminded of the dates, places, parties, manner, that should be focused on.
Reading is where I start to answer the questions I have in mind. It allows me to focus and spot the issues and topics that are material to my goal as a reader and eliminate those that are not necessary. Personally, if my time permits, I read the material twice to go over the notes I wrote on the margins and over the texts, the terms I have highlighted and underlined, and answer more questions I may have skipped during my first read.
Reciting allows me to be the author of the material I read and be in accord with my own understanding and use words I can comprehend. As an auditory learner, hearing myself helps me with information retention, alertness, and internal connection on that issues I understand and issues I need to look over again. When I travel to and from school during face to face classes, I listen to my own recording of reciting provisions because I find that hearing my own voice is more effective for information retention than silently reading.
Review helps me integrate the information I have and apply it to scenarios in my head. It is to ensure that the information retains not only after I’ve read it but even weeks later when my exams are approaching.
4. Summarizing Short Articles
In summarizing, there is presentation of the main idea, the supporting details and the main conclusion.
As a law student, it is advisable to make our own case digests because we are able to spot the ideas and details we find to be important in the case. It also gives as a second hard look on the case and omit those which are not substantial to the topic. Also, it gives us a thorough understanding on how the Court resolved an issue and how we would separate it from other issues.
To ascertain that I have adequately summarized a case, I ask myself whether it is simplified enough that even a grade-schooler can comprehend.
Normally, I just take note of the main topics and ideas in the article and try to explain it in my own words. -GLS
I usually use this method during my case digests. Summarizing long cases makes me retain better the relevant things mentioned in the case. It also saves time because once a case is summarized or digested, I do not have to read the whole case again in the future. Also, there is a practice in our class where we are assigned cases to summarize. This helps a lot specially during times when there is not enough time to read the cases in full text. -Julie
5. Underlining, Highlighting, and Annotating
It is the marking and writing over texts that are material and important to the topic at hand. Underlining and highlighting helps me as a visual learner, to remember words especially when I intend to memorize in verbatim. Aside from underlining, I encircle the “verbs” and underline its connecting words for easy memorization.
As to highlighting annotations, I use yellow for important words, blue for enumeration, and pink for exceptions. As to highlighting cases, I use pink for the petitioners, blue for the respondents, and yellow for the provisions or ruling of the Court. I enjoy annotating the most because it helps me connect with myself by simplifying the terms and customizing it according to my own level of understanding for easy review later on. It is helpful in memorizing enumerations by creating my own mnemonics for easy recall.
Very guilty. From my codals, notebooks, cases, books, reviewers, not one of them is left unhighlighted or annotated. Each color/shape has their specific significance. It makes it easier to remember them too. For example, blue is for exceptions. In a field of yellow and green, it's easier for me to just search for the blue when I need to check what the exceptions are. -GLS
6. Outlining
Outlining is the breaking down of the main and supporting ideas in an essay, topic, or speech. It is the separation of the main headings, the subheadings, and sub-sub-headings. It covers the topics, the connection of those topics, and importance of the ideas in the order in which they are covered.
Here is a sample of my outline on the three branches of the Philippine government:
Tumblr media
7. Mapping
Is a visual organization of the topics, sub-topics and main ideas. It shows the relation and hierarchy between each topic through connecting circles or rectangles. I find myself using maps in remedial law subjects in topics such as jurisdiction of the courts, legal steps, and the kinds of appeal.
For remedial law or subjects that involve any kind of procedure, mapping is one of my go-to methods to easier get the flow of things. -GLS
Below is a map showing the legal steps in case a person was arrested without warrant committing a crime in flagrante delicto: (Ferdinand Tan, Criminal Procedure, 2015)
8. Comparison-Contrast Chart
It shows the similarities and differences between two or more things. There are a number of terms in law school that are difficult to distinguish if there is no visualization that a comparison-contrast chart may provide.
Really helpful when it comes to distinguishing concepts that have thin lines of distinction. -GLS
Many concepts in law are similar, therefore, comparing them is a great way to understand the topics. Also, compare is a common question in law. Comparing the concepts before the actual exams saves a lot of time because it cuts my thinking time. -Julie
Below is a comparison-contrast chart of Usufruct and Voluntary Deposit: (Timoteo Aquino, Credit Transactions and Insolvency Law, 2021)
9. Timeline
Timeline is used when a concept needs to be organized chronologically by dates. The laws and jurisprudence are constantly changing to be able to adapt to the changing environment, customs and principles. However, it is important to take reference to past judicial decisions and amendments to ascertain how such changes came about. Dates are likewise material in cases decided by the courts especially in criminal law.
When I find a case confusing or where dates are material (especially in rem or cases where a lot of things happen), I scribble a timeline so I can see the flow of events. Easier recall and it's much less difficult to see if the required periods were complied with. -GLS
Below is the timeline I used in the case of People v Jabinal in solving the issue as to the prevailing doctrine and whether Jabinal should be acquitted under the Lucero and Macarandang doctrine or be convicted under the Mapa doctrine:
Tumblr media
Those are the nine study techniques that may help a law student or any student to have an efficient and effective absorption of information. Study techniques may be time consuming than just reading-on the materials but it plays a vital role in helping a student increase his or her confidence, competence, and self-esteem in and out of the classroom. It gives a student a sense of self-satisfaction given by the feeling of productivity and the instilled discipline that he or she will be determined to strengthen along the way. After attaining the sweet title, "Atty." that every aspiring lawyer has been aiming, they will look back at their study techniques and owe it to themselves for the discipline, patience, and hardships they have endured. For sure, such habits will not end in law school but shall continue on in their career in the legal profession.
Offering Free Tarot Readings // Serious Inquiries
Tumblr media Tumblr media
Hi all! I know there’s probably a lot of people already offering it, but I choose to jump on that bandwagon as well! I am open and offering Free Tarot Card Readings. However, if the reading resonates with you dearly, is conducive and enlightening, I always welcome donations. I’ll elaborate below. Keep reading, please! :)
First things first...
Guidelines for Free Tarot Readings
I will always happily volunteer my services to those in need; especially those who feel lost or astray, in need of light, love and support. I am in harmony with the purpose that I exist in this lifetime as a guide to those who seek direction. I am in harmony with the purpose of elevating and teaching those who seek me out or those I may cross paths with. That being said, I also have boundaries that I MUST set.
Please: Think thoroughly about your inquiries. Be sure that the question(s) you want answers for are readily receivable. One thing about the Universe I feel is when it is time for you to SEE something, you cannot unsee it. No matter how big or small the message is, it is just as important for you to be receptive because outcomes and answers can go either way. Do not shy away from it because you dislike the answer. The reality of life is there is duality EVERYWHERE. For every good, there is a bad. For every shadow cast, there is light present. One cannot exist without the other.
I promise confidentiality at all TIMES now and forever! I will not reveal any client’s details, inquiries, reading results or information WITHOUT consent. And even then, I still wouldn’t do it. I am a firm believer in being mindful of the energies you let into your space, growth process and discovery process. One bad apple spoils the bunch.
Honesty, Honesty, Honesty! I will interpret all readings to the best of my ability and intuition. I trust myself. I listen to my inner self. Sometimes, I may fish. I may ask questions, I may say ONE word. That is because that is what Spirit is telling me. It may be random to you or like I’m unsure. It is me talking us both through the process of information and spiritual download coming through to me. It starts like a ceiling leak and then the water breaks through. Go with the flow, with me. IF I have difficulties, interpreting, I will inform you. If I am unclear or unsure, I will tell you. I will also respect your boundaries. If you tell me you do not want to know, then I will not speak on it.
Expertise! I will not give advice in areas I am not qualified in. If it requires a physician, psychologist, lawyer, financial advisor, accountant or any other professional service and I am NOT qualified, I will encourage that the licensed and appropriate party be sought out for advisement and guidance.
Be respectful! I do NOT believe in SPYING on others psychically. Questions such as, “what does this person feel about me” or “what does xyz think of me” are not appropriate. You are violating another human being’s PRIVACY. Would you like if someone unknowingly peeped into your window everyday and watched your day to day activities? Instead: try asking questions that allow you to SHAPE and MANIFEST a new reality such as, “How can I positively impact xyz’s feelings or perception of me?” or “How can I grow and develop my relationship with this person?” I habitually change these questions into advisement questions when I read for someone asking me to spy.
Be independent. This simply means, I will not allow overdependence on my services. There is always a pending message waiting to be received, a lesson to be learned. However, readings are guidance and progressive. You check in over time. You want feedback on direction and growth. You have an unresolved issue, you had a confusing dream and need clarity. They are not something you do for every single moment of your life. Don’t become dependent. I say this from experience; I witnessed someone personally close to me, become so dependant on her cards that the very heavy energy she put into the meanings, she started to manifest them -- self-fulfilling prophecy. It is up to you to create your own reality. It is also up to you, to nourish and grow your own intuition! Do. The. Work!
Responsibility. My goal as a Tarot Reader is to allow my clients to take responsibility for their OWN decisions and actions which guide their lives and to act accordingly to their own conscience for the greater good of all who are concerned.
Empowerment, Healing and Uplifting. I try to let my clients know that the future is not set in stone. We are all Magicians. Power to create from resources available, drawing from the reservoir from within and manifesting our desires and reality. We all have the power to change our future. I strive to leave every person I cross paths with more empowered on their journey. I allow myself to be a conduit through which the Divine Spirit heals my clients and refreshes their mind, body and spirit and environment based on insights gained from the readings.
I reserve the rights to refuse to do a reading for a question that I feel I cannot answer or one that violates my ethics. All of my readings are non-judgmental, and I welcome all clients from different cultures, religions, spiritual paths, sexual orientations and gender identities. I constantly strive to improve and strengthen my connection with the self and oneness; my intuition.
Lastly, time frames for readings to be completed:
This is a schedule, for me, set for you. We all have lives, activities and things that we set time aside to do. This applies to me. IRL Me: A Pharmacy Technician and a Pharmacy Trainer. I work 8 to 13 hours a day. 5 days a week. I also work a Part Time Job in a Car shop for 8 hours 1 day a week. I work SIX DAYS A WEEK. Saturdays are my off days. But if you wish to donate anything at all, my cashapp is: $ZephyrX29. Again, feedback is highly recommended and accepted.
How Do I Submit a Reading Request?
Chapter 2: Into the City
Not the Only One
Chapter One - Outta this Town
The long awaited chapter 2. Now that this story is becoming a small ficlet, I have renamed it to “Not the Only One”. Enjoy!
Chapter Two Into the City MadaSaku/TobiSaku
This was not supposed to be happening.
That single thought had rolled through Sakura’s mind many times in recent weeks, but never as strongly as in this moment.
From her place on the witness stand, she couldn’t hide from any eyes. Not the judge. Not the jury. Not the lawyers. Not Tobirama.
Not Madara.
He had always been a hard man to read. Even after nine years of marriage, there had still been moments when it was impossible to tell what was passing behind those black eyes. Like a statue sculpted from ice, Madara sat unmoving. The coldness he regarded her with was nothing she didn’t expect. Having disappeared on him nearly a year ago she hadn’t anticipated a warm welcome back. Even less so when her return had been prompted by a court subpoena.
“Answer the question, Miss Haruno,” the judge demanded.
Sakura didn’t blink. Her maiden name having become so familiar to her as the months passed since the divorce papers had been signed and mailed. Her identity returning to her.
“Miss Haruno, would you like me to repeat the question?” the prosecutor asked.
Even without looking at him, Sakura could feel Tobirama’s eyes on her. They had spoken a few times since that fateful day a year ago, but not about the reason she was here in court today. This had completely blindsided her.
“No, I heard you,” Sakura said, not quite coldly. But there was a bite of something in her tone. “You asked if I had even been aware of Madara embezzling funds from the Uchiha-Senju Corporate while married. My answer is no. Madara and I never discussed business when we were together.”
Calm and professional, Sakura answered the prosecutor’s questions. Her gaze never wavered from him as she spoke. Each question he asked attempted to chip away at her a little more. Break her down, destroy her testimony and her character. The demeaning questions, the lack of respect shown to her was obvious, even if he poised his questions in a seemingly innocent way.
“Let’s discuss your marriage, Miss Haruno,” he continued.
Sakura felt her spine stiffen defensively. “What about my marriage?”
“Was it happy? Were you happy?” he asked, his expression turning vaguely sympathetic.
She saw through his false sense of pity. “I fail to see what purpose that question serves,” she said, her gaze briefly flickering to the Judge.
The older man behind the high bench beside her looked ready to intervene, but the prosecutor stepped forward. “I promise my questioning has a reason, your Honor.”
The Judge looked doubtfully but he nodded nevertheless, silently granting his permission.
The prosecutor returned to her. “Miss Haruno?”
Sakura held his gaze for a long moment, weighing how much she could still conceal. How much of her dignity the courts would allow her to leave with. Her red lips twisted into an ironic smirk as she realized they intended to strip her down bare. Her eyes briefly dropped to her lap.
When she raised her gaze again, the look was gone. “Are you married, Mr…?”
“Tanaka,” the prosecutor provided. Then he smiled, “And yes, I am.”
“And is your wife happy?”
“She is. Very much so.”
Sakura simply eyed him. The prosecutor was in his late forties. He was dressed well in an expensive suit and a pair of shoes that gleamed in the bright courtroom lights. He obviously had a successful career with a hard-earned reputation. Tobirama and Hashirama wouldn’t have hired him otherwise.
“Are you certain?” Sakura asked, her voice soft, almost as if she were speaking to a lover. Still, it rang out clearly for everyone to hear. “You must spend plenty of late nights at the office. What time do you get home? Nine or ten? Maybe later? That gives her plenty of time to pay the bills, order the groceries, make dinner. Touch up her make-up after she realizes just how cold and lonely such a big house is. It only takes two hours for the swelling of her eyes to go down. After so much practice, a fake smile becomes her normal smile eventually.”
The following silence was echoing. The prosecutor eyed her for a long moment and she wondered if something she had said struck a nerve.
Then he swallowed and his expression cleared. “You left Mr. Uchiha quite suddenly, Miss Haruno. Why was that?”
That familiar feeling of betrayal rose within her as she recalled the night she realized Madara was having an affair. It burned within her, tearing open the old wound, but she kept her cool façade. Every eye rested on her. Their pressure almost physical as they all waited to hear what she would say.
None, however, was as penetrating as Madara. His stare was piercing. Like a physical weight, he held her in place.
Sakura purposely avoided his gaze. Some part of her still stung that he hadn’t come after her after she had left. She had sent the divorce papers and he had simply signed them. As if she had been nothing to him for last decade. That almost hurt more than the fact he had found another woman’s company more pleasurable than her own.
Still, Sakura held her strong guise. There wasn’t any question the lawyers could ask her that could make her feel small or insecure. She had felt plenty of that in the last year on her own. And she had worked hard enough to rebuild herself from nothing to fall back on those self-doubts.
“Because he was having an affair,” Sakura eventually answered, her voice threatening to waver.
Mr. Tanaka was either unmoved or unconcerned. “Not because Madara had asked you to move a large sum of money for him?”
“No,” she shook her head.
The questions turned less personal after that. The prosecutor wrapped up his questioning before the defense took their turn.
By the time the courts had let out nearly five hours later with the jury coming back with a guilty verdict against Madara on all counts, Sakura was exhausted. She had sat stone-faced through it all. Unmoving, she watched from the public benches behind the defense’s desk as Madara was escorted out of the courtroom. He was far too wealthy and held far too much power to be removed in handcuffs.
Still, Sakura’s heart felt like it was breaking all over again. For though they were divorced, Madara had been an important person to her for a big portion of her life. Someone she had planned on spending her life with, someone she had once thought would father her children. But that future no longer existed and that knowledge left a hollow ache in her heart.
“Sakura,” a voice called softly. She glanced at Shikamaru, her lawyer and longtime friend, as he squeezed her arm gently. “Are you ready?”
Pursing her lips, Sakura swallowed hard to keep her emotions from showing. She glanced back towards the courtroom doors as another attendee exited, allowing the loud chatter and flashes of photography from the press to slip through. The idea of having to push through another gauntlet of reporters made her stomach roll.
Automatically her gaze fell back to Madara, only he was already gone. She was alone. Just as she had been for these long months since leaving.
Inhaling a steady breath, she nodded. “Yeah.”
With Shikamaru at her side, Sakura pressed through the courtroom doors. Immediately, the press was on her, shoving microphones in her face and flashing her photograph. She kept her head held high, her mouth firmly pressed shut as she marched through the throngs until they reached the back of the courthouse where the reporters weren’t allowed.
Once the heavy doors had closed behind them, Shikamaru told her, “There will be a sentencing trial in a few weeks. The jury will decide Madara’s punishment then. You’re not required to be present, but if you want to go, let me know and I’ll accompany you.”
Sakura nodded numbly, her mind still reeling from everything that had happened that day. She didn’t know yet if she wanted to be there for that. To watch if Madara would not only lose everything he had worked for – and stolen – but potentially his freedom as well. It was all overwhelming.
However, before Sakura could begin to process everything, she heard the clack of expensive shoes echo on the tiles behind them. “Sakura,” someone called.
Both Sakura and Shikamaru glanced over their shoulders to find none other than Tobirama hurrying towards them. Hashirama and their lawyer, the asshole prosecutor, were a small distance behind him, their eyes tracking Tobirama’s movements as he descended the few steps that led to the courtyard and the private parking lot just beyond.
Upon sight of him, heartbreak and resentment swelled within her. She didn’t know if it was justified and frankly, it didn’t matter to her right now. He was one of the ones responsible for all of this. For Madara potentially going to prison, for tarnishing her name and leaving her feeling as if she had just run from home and her husband all over again. It left her with a strange conflict of emotions.
Without pause, Sakura continued on, pretending as if she hadn’t seen or heard him.
Tobirama’s pace increased. “Sakura, please wait.”
She was angry and hurt and upset, but even still, she found her pace slowing. If only because Tobirama had been the one to help her out nearly a year ago.
Beside her, Shikamaru’s hand slipped her to elbow. “I have to advise against you speaking to him,” he murmured in her ear.
She pursed her lips together before her gaze flickered up to meet his. “I know. Just give me two minutes.”
A frown crossed his face but he nodded minutely before he stepped away to a respectable distance. Sakura watched him go before she turned to meet Tobirama, her expression guarded and her shoulders stiff.
He stopped before her. He looked impeccable in a three-piece designer suit with gold cufflinks and a navy blue, silk tie. His white hair was pushed back away from his face, and though the trial had been in the headlines of the news for the last month, she couldn’t spot one line of stress on his handsome face.
“I’m sorry,” Tobirama said after he had caught up to her. “I didn’t want to drag you into this. This trial wasn’t supposed to involve you.”
“But I was involved,” Sakura retorted coolly. “My name has been dragged through the mud on every front page of every newspaper. My reputation has been shredded, my morals questioned and my career threatened.”
He shook his head. “I tried to talk my lawyer out of calling you to the stand. I never wanted any of this for you.”
Sakura laughed without humor. “But it still happened, didn’t it? After I left Madara, I had to work for everything. I built myself up and just when I thought I could move on, I get subpoenaed. The media has called me everything from a gold digger to a manipulative whore. I’ve been accused of marrying Madara for his money, using my body to steal tens of thousands from the corporation and then divorcing him once I got all the cash I needed. So tell me, what exactly did you think would happen to me when I get dragged into all of this?”
Tobirama didn’t immediately respond but the guilt was clearly visible in his face. It was enough that it looked like it physically pained him to hear everything she had gone through, but she didn’t feel any sympathy for him. In the end, she had suffered more than anyone. Even Madara hadn’t been slandered to nearly the same extent as her.
“I am so sorry, Sakura,” Tobirama murmured. He reached out towards her. “Please, tell me what I can do.”
As if he was poising to strike, Sakura flash-stepped back out of his reach, a threat and a warning apparent in her expression. “You can leave me alone,” she said, her words dripping with venom.
She didn’t miss the pained look in his expression before she turned her back and crossed the courtyard. Shikamaru followed behind, only briefly tossing a glance back at Tobirama before they headed towards their cars.
And as Sakura walked away, she pretended not to notice the pair of eyes that tracked her every movement until she was in her car and on the road, making her way back out of the city that had only ever chewed her up and spat her out.
I have had many questions about the tarot decks used here and how answers are divined. I thought a few posts with the decks used and some of how the Tarot is interpreted here. Also the websites Biddy Tarot, learn-tarot-cards.com the psychic library, angel paths, tarot forums, and learntarot.com are consulted on a regular basis. Since we are all extremely bored I thought I'd show you all the lovely decks I own and see if it tempted anyone to request a reading.
PLEASE REMEMBER,
Just send in ask and we will do a Tarot reading about anything G rated.
🔮🔮🔮🔮🔮🔮🔮🔮🔮🔮🔮🔮🔮
I borrowed this from another blog and changed it around to fit this blog. I know it was one of the Tarot Blogs on tumblr and I hope it is okay that I borrowed their words, Although I altered them in several ways.
Thank You @rose-tarot
Rules for Tarot Readings
Any ask that doesn’t follow ALL the rules will be deleted. It’s frankly exhausting having to repeat myself so many times in a day, and I don’t want tarot to become something of a chore especially when I’m doing this for free and as a genuine hobby.
General Rules:
Consider readings always open, but it may take time to get back to them. If you send it anonymous, I can't contact you when I post it. If you send it with your contact info, it will be removed and I will send something when it goes up. It will also be easier to contact you in case of delay. I have never had any issues with anonymous submits. All were fully redacted.
Please only send ONE question in each ask.
Don’t send another ask with a different question until your first one has been answered.
Leave initials of yourself and everyone involved. Emoticons do not really help me much.
Try to keep your ask as precise as possible. The more information you supply, the better your reading will be. Zodiac signs may or may not be helpful depending on which reading/deck is used.
I can’t give you astrological signs (ie. What is the sign of my next boyfriend) or expected dates (ie. What month will I meet him?).
For Relationship/Love Readings:
You must specify your relationship status (dating/single/married& dating*/in a relationship and looking to expand with permission from my partner*/ etc.) [*At the Tarot reader's discretion of course.]
It is helpful if you can mention the relationship between you and the person you’re asking about (just friends for now/ex/friends with benefits etc.)
Do not ask me about the same relationship/person too many times. Repeative questions tend to upset and aggravate who or whatever you believe answers you within the cards. The answers start focusing on the querrent, instead of the question.
I will not do:
Medical/Health/Legal Readings
I am far from a professional anything. Never disregard any professional advice because of any form of divination.
Third-Party Readings
I am uncomfortable reading into anyone that didn’t give me explicit permission to be read. So if you want me to read about how your crush feels about you, that’s fine, but be aware that your thoughts are directly tied into ⅔³this. But if you ask me to read about whether your crush and his girlfriend will break up soon, I will have to refuse.
Sidenote: Just don’t go for anyone who’s taken lol. It’s not worth getting involved in a three-party situation, especially if you’re the third party. If you are the married person looking for love, if you are in an open relationship, something like that, I will use my discretion.
Spirituality Readings
I can not answer to your religious beliefs. How I and Gianni work the tools are thus: We allow god/ the universe/whatever to flow through us, the deck, the room, the table/altar, and some times crystals while concentrating on a question to be answer. The answer will come or not as time passes. If it is not the one that is sought, you weren't asking the right questions.
If you want to ask whether you should do this thing by this weekend, chances are, I won’t be able to get to your reading in time. Murphy's Law.This rule also applies to specifics and repeats. Specifics(Will I run into Mr X on Day 3 On 4th St at 12:05 pm) will not get answered seriously and repeats are the same.
Please do not rush me. I try my best to reply as quickly as possible but once I stop, that's it for the day or two.
Occasionally, I will refuse readings that make me uncomfortable, because I realised that if I force myself to do a reading which I’m not comfortable with, it will likely produce inaccurate results anyways.
Please leave a feedback on your reading, it acts as a great tool for me to improve and get better. Have a wonderful day
Title: The Outsider Author: Stephen King
Commenced May 24 2020 Completed May 27 2020
Slowly pushing myself to immerse in the realm of Stephen King compositions. I’ve already done “Everything’s Eventual”; it was a collection of outrageous shortish narratives of horror. MAJOR SPOILERS ahead!
“The Outsider” didn’t disappoint. It gets a substantial satisfying solid 4/5 star rating, also my very first (except Everything’s Eventual) Stephen King lengthy novel. In this read, Stephen King captures the realistic rawness of an individual’s emotion. I even categorize this as a Drama, other than genre Supernatural Horror. There were scattered risible roasting dialogues in here, from beginning to the end. An example were some slightly harassing approaches of the stereotypical police characters whether during the arrest or the witness interviews. I however took delight in the chapters embodying their POVs, specifically of the private investigator. The baseball, football and basketball features gave this a spirit of locality like as if the Flint County residents were just typical neighbors you’d spot in one’s own community. Although I myself am not into novels showcasing any sport element. The present 20th century was boldly represented by the following modern references: Huffington Post, Harlan Coben, Slenderman, etc. There was also a sighting of my personal favorite, a Hercule Poirot trademark: vital information being considered unimportant.
There is a great quantity of characters one must keep informed of in this book. Frankie and Ollie Peterson were respectively the murder victim and his brother. I presumed Ollie has emotionally recovered and now clearheaded, turns out he was just suppressing his devastation. Ralph Anderson was primarily introduced as the assigned detective and interviewer. He was the protagonist out of all the abundant personas. He has this recurring and telling memory of a bra strap which terribly confused me about its relevance. The number of times Ralph mentions how brutal Frank’s gruesome death is irritating, as if he’s actually not bothered at all. Props to Jeannie, Ralph’s wife, for supportive gestures, providing wisdom and advises; not nagging or annoying. Initially assumed the accused Terry Maitland was contending with his doppelgänger. Terry’s wife, Marcy, is one heck of an emotionally strong woman; I admire how she handled every awful news that came. They have I infer a family lawyer, Howie Gold whom is too sympathetic for a defense attorney. Here included a prosecutor named Bill Samuels. I swear I could’ve smashed his face if I meet him in real life. He has this hostile boastful remarks which definitely got me rolling my eyes. At other times, I don’t even want to read his lines. A late addition, Holly, a peculiar, colorful almost-detective personality. Exceedingly pleaded for Holly, who founded the whole concept of an outsider, to maintain appearance until the finale. Come to think of it, the heinous manner Frankie was killed couldn’t really have accomplished by any sane human. The chapter transitions are fast-paced. In Sorry (July 14th-15th) Chapter 12, I imagined these scenes visually then thought of a sitcom type from the Peterson family entering the hospital building to the part of the physician’s declaration. It was amusing, particularly the aftermath reactions of other people in the emergency room. Arriving on the Footsteps and Cantaloupe (July 18th-20th) Chapter 5, I bumped with an undoubtedly brilliant and intense description of a felo-de-se.
Questions as I read on..and the answers that I discovered in the latter
1. Why didn’t Terry immediately supplied his alibi when he was arrested and first put in the police car?
Answer: My personal opinion was probably that his trust and confidence on his fellow townmates diminished because of the public shaming.
2. Wondering why Terry seems to be the focus of this book to the point which the victim’s immediate family all died?
Answer: his side could actually be the more emotionally and spiritually damaged, especially with his ruined immaculate reputation and injustice
3. Has Peter Maitland got anything to do with murder?
Answer: Nope, didn’t even get any exposure
I watched the movie “It” both the part one and part two. Was planning on reading the book but put off because it was just too long. I found similarities between “The Outsider” and the movie ”It”.
1. The protagonist had a team with him, about 5 to 6
2. The gang is diminished by 1 to 2 character involvements apparently they were skeptic; the remaining pursues the mission
3. The mission would be to stop the perpetrator from killing again
4. Villain (mostly supernatural) uses someone (a human) to help
5. The hiding place of the baddie was underground, for this read, a previous tourist attraction cave and for “It”, the sewers
6. Both featured culture, one were Mexican frightening folktales and the other was Native American tribes
7. Two words: Child disapperances
“Just promise me you’ll stop every once in a while and acknowledge the day, honey. It’s the only one you’ll have until tomorrow.”
——^ I find this quote, encouraging and substantive
Time had passed, and time probably did heal all wounds, but some of them healed so slowly.
——^ this was just too accurate to ignore
Statement
August, 2019.
 In February 2018, The Centre for Gender and Violence Research, at the University of Bristol, was mentioned in an anonymous petition calling for the (cancellation) no-platforming of a meeting being organised by Woman's Place UK [i].  That petition suggested that attaching the Centre’s name to the event was endorsing “hate speech” and called into question the integrity of the Centre.
In fact, the Centre was not involved in this event and had no part in organising or hosting it.   However, that petition also named one of the Centre’s PhD students who had been asked to Chair the event - and agreed to do so.
Following the event, which was targeted by activists, the University PVC issued a statement clarifying the University’s position on Free Speech[ii].  This statement makes clear that behaviours which have the effect of silencing the free speech of others are unacceptable.  A number of events have taken place since then which raise concerns about how the University of Bristol, and other educational establishments, intends to safeguard university members’ rights to free speech and protection from abuse on this basis.
Further information was added to the University PVC’s statement in May 2018, following a complaint by the student named in the original petition and accused of “hate speech” for chairing the event (Student A), against other students in the University.  That statement read:
 A University spokesperson said: ‘Concerns have been raised with us about the actions of one of our students in relation to their protesting of a talk by A Woman’s Place. This talk was not hosted by the University. A University of Bristol student chaired the event.
‘We strongly defend the right of students to protest. In this instance a complaint has been made that the form of these actions may have infringed on the freedom of speech of others in our community. The University has a duty to investigate such complaints, and secure free speech in the institution within the law. We have therefore initiated Student Disciplinary Regulations proceedings relating to the form of this student’s protest.
 Following the complaint being made, posts appeared on social media which were partial and therefore misleading.  These accused the University of deliberately targeting a trans student for writing a letter and made no mention of the intimidatory behaviour and content of social media posts which had constituted the essence of the original complaint.
As the date for the disciplinary hearing approached on June 15th, 2018, more social media posts appeared calling for demonstrations in support of the student against whom the complaint had been made.  Despite the University changing the time and date of the hearing several times to keep the complainant, staff members and Disciplinary Committee safe, each time, the new details appeared on-line (by and through student B) necessitating additional security, increased fears regarding the personal safety of participants, and creating delays in convening the meeting.
Nearly 12 months on from the initial complaint, in January 2019, the University of Bristol sought a review and requested impact statement from all parties involved.  As student A’s Supervisor (with a duty to support the student during the disciplinary process), I was not asked for a contribution or informed of this review.  When the student informed me the review was taking place, I contacted the University and submitted an impact statement. Once again, whilst those supporting student A made representations in ways intended not to interfere with the due process of the complaints procedure, more social media posts appeared on line:
To add insult to injury, the University continue to drag out this most bogus of disciplinary proceedings. The case was adjourned on 15 June 2018 and, 11 months on, <removed> will face the disciplinary board again. This comes after the University suggested dropping the case, only to deem <removed>'s considerable mental health difficulties insufficient cause to stop proceedings, showing disregard for students' mental health and wellbeing on top of transphobia[iii].
What this post does not mention is that many of the significant delays were caused by security concerns linked to the deliberate leaking of information (again, by and through student B)  about when and where the hearing was being held. It also fails to consider any mental health impacts on the student making the complaint who at the initial hearing was asked questions by the University lawyer, and cross examined by student B’s Barrister, in the presence of the student against whom the complaint of bullying and aggressive behaviour had been made. To date only student A (the complainant) has been asked to answer questions in front of the disciplinary committee.  The post also fails to mention the behavioural aspects of the initial complaint or consider the negative impact that this behaviour has had on other individuals, or the wider climate of academic debate.
The post does however mention that, following the review, the University made a decision to continue with the proceedings.  We can only assume that in balancing the submissions made, someone thought that it was appropriate for the process to continue. I do not know who made that decision and on what grounds.
It therefore came as a surprise to hear in June 2019 (18 months after the initial complaint for bullying behaviour by a student, against another student) that the University was ‘terminating’ the complaint. No reasons have been given and there is no transparency as to who made that decision, on what basis, and how it fits with the University’s own student complaint policies and procedures.
Throughout this case those of us who were involved in some way (which includes many members of academic and support staff from supervisors to wellbeing advisors to the media team who have had to respond to emails from those reacting to misleading social media posts) have remained silent in order to allow the University to follow and enact its own policies and procedures.  We have throughout advised student A to do the same and supported her in trying to continue with her studies whilst this has been on-going.
As student A’s supervisor, and at the time of the initial complaint Student B’s supervisor also, I do not feel that I can be silent any longer.  As I said in my submission to the review in January 2019, irrespective of the outcome of the complaints procedure it is crucial that it reached a decision.  As members of staff we cannot in good faith advise students to have confidence in the University’s own complaints procedures if they do not deal with complaints in a timely, safe, transparent and fair way.
I do not know what I can honestly say to a student in future who is making a complaint about being bullied and who is fearful of their safety.  Particularly in an era where student welfare is meant to be paramount, the University needs to ensure that supporting students goes beyond ‘signposting’ advice, to providing a justice process where complaints can be dealt with fairly – and acted upon.  Those who have written similar posts (during the process), calling for the same, have only ever focused on the issue of trans student welfare[iv] and not considered the duty of care owed to all students, who may themselves be vulnerable, who come forward to make complaints about the behaviour and actions of others against them.
Since the University terminated the case, further social media posts have appeared[v].  Again, these are partial and misleading.  The student who made the complaint has been targeted on several occasions over the past 18 months since the original complaint was made.  Organisations she is involved with have been threatened with boycott vi, and she has been threatened with legal action, faced masked demonstrators at events she is involved invii  viii, both on and off the University campus, and had to pass masked protestors to attend disciplinary proceedings.  This targeting has escalated since she originally filed her complaint. The impact on this student (one of our international students) has been thoroughly ignored in all the social media coverage to date, and - by not seeing the complaints process through - in my opinion, by the University too.
The irony of course is that the Centre for Gender and Violence Research has been at the forefront of championing the voices of abused women and other discriminated against groups for nearly 30 years, including the trans community.  We are recognised as a centre of excellence, researching for instance the minutiae of bullying behaviours which seek to limit the agency and personhood of discriminated against groups.  Moreover, during the past 20 months, whilst this complaint was ongoing, we were engaged in a large scale study looking at aspects of justice for victims and survivors of gender based violence and inequalities.  Even within the contexts of our research, student A cannot be said to have been treated in a ‘just’ manner. The bullying and intimidation she has experienced, and which formed part of the initial complaint, appear to have been ignored. She feels that the University of Bristol has treated her in an inhumane, reckless and cruel manner and ignored threats to her safety.
I would like to make a concluding statement and recommendations about how such processes could be better dealt with in future, but this process is not yet at its conclusion. Student A is still waiting for the information she needs to make any decisions about what options are now available to her.
 ·        Who made the decision to terminate the complaint?
·        On what basis was that decision made?
·        Did that decision take into account the impact on confidence in the complaints procedure more generally?
·        Why did the University review the case early in 2019 and decide to continue, only to terminate it in June 2019?
·        Why was Student A repeatedly advised that she did not need to seek independent legal representation?
·        Why was student A allowed to be cross-examined by student B’s barrister during the first hearing in 2018, yet student B was asked no questions?
·        Why are those members of the University who advised student A, now no longer willing to meet and discuss the case with her?
·        Why has the University yet to make any statements disputing the claims which have been freely circulated on social media whilst the complaint was on-going (for over 18 months)?
·        What has the University done to ensure this students safety and protection from additional bullying during the complaints procedure?
 It is in light of these on-going failures that I feel no option but to make a public statement on this matter.
This article is part of David Leonhardt’s newsletter. You can sign up here to receive it each weekday.
There’s a lot of discussion about what the Mueller report says. But almost none of it is based on the actual report. It’s based on the Barr letter. And the Barr letter is not an objective summary of the Mueller report.
Here are my three big takeaways:
1. Barr should release much more information.
William Barr, the attorney general, works for the president. By releasing just a short summary on a matter of such importance, he comes off as a cross between a law enforcement officer and a spin doctor.
It’s certainly conceivable that parts of Robert Mueller’s full report — the one that remains secret — would need to be redacted for national security or other reasons. But Barr’s four-page summary is unacceptable. So is his vague explanation that he will release as much of the report as he can.
Until we get more information, the most reasonable assumption is that Barr is trying to protect Trump by hiding the full report.
For more: Neal Katyal, a former Justice Department official who helped write the special counsel regulations, argues that Barr has left out crucial information, including justification for his claim Trump did not obstruct justice. Congress, Katyal writes in The Times, “must first demand the release of the Mueller report, so that Americans can see the evidence for themselves. Then, it must call Mr. Barr and Mr. Mueller to testify.”
2. Trump critics should keep an open mind on Russia.
I’m obviously not a fan of the president. And I think it’s important for all of Trump’s critics to accept the possibility — the likelihood, at this point — that his campaign did not work together with Russia in a meaningful way.
Yes, the Trump campaign seemed shockingly and unpatriotically open to doing so. But that’s not the same as following through. Progressives shouldn’t go down the Fox News road and start adopting their own factually weak or outright false conspiracy theories, like those involving Barack Obama’s birthplace, voter fraud, Uranium One, George Soros, Solyndra and on and on.
3. Trump is unfit for office.
He directed a criminal conspiracy to break campaign finance laws. He has used the presidency for personal enrichment. He has undermined democracy. He has damaged America’s global standing. He has lied repeatedly to the American people. He has obstructed justice. (Barr’s statement to the contrary is brief and unpersuasive.)
When I wrote a Sunday Review piece earlier this year arguing that Trump had violated his oath of office and should no longer be president, I listed four main reasons. None of them involved the idea that his campaign colluded with Russia.
The Mueller investigation led to criminal convictions of the president’s former campaign chairman, his longtime personal lawyer and his former national security adviser. It added an enormous amount of evidence to the case against Trump’s fitness for office. And that’s before the Trump administration has allowed the public to see the full results of the investigation.
The Mueller report could be full of good news for the president — or it could have found plenty of evidence of collusion that simply didn’t rise to the level of a prosecutable crime, Mikhaila Fogel, Quinta Jurecic, Susan Hennessey and their colleagues at Lawfare explain. “There is a huge range of conduct and findings that would be consistent with this top-line summary,” they write.
Barr’s summary doesn’t answer why Russia went to such lengths to help Trump win, writes The Atlantic’s David Frum: “Mueller hasn’t provided answers, so much as he has posed a question.”
The Politico Magazine editor Blake Hounshell asks a related question: What’s behind Trump’s unique affinity for Russian president Vladimir Putin? “It seems quite clear now that Trump did not collude with Putin to game the 2016 presidential election. Why he still seems to want to collude with Putin to reshape U.S. foreign policy remains a mystery.”
Writing in Slate, the legal expert Richard Hasen poses another unanswered question: Why did Mueller not charge Paul Manafort and Donald Trump Jr. for encouraging Russian officials to give them dirt on Hillary Clinton? “Mueller’s reasoning matters, and we need to see the full report,” Hasen writes.
Divorce in your future? Read about some lesser known issues that can impact your life
Tumblr media
If you have need a best suitable service your Child Law experience, Divorce in your future? Read about some lesser known issues that can impact your life with the great process!
Houston Divorce: Divorce in and of itself is not uncommon in our world today. What is uncommon, however, is a person entering into the divorce process with as much information as he or she needs to be successful. Many people wait until they have hired an attorney and actually filed for divorce before learning about divorce. Their lawyer will handle it, after all! Not so fast, would be my response.
If you are interested in succeeding in your divorce, achieving your goals and setting yourself and your children up for success in the next phase of your lives you really ought to learn the important lessons of a divorce before filing. It’s better to learn about divorce late rather than never, but it is far from ideal. In today’s blog post from the Law Office of Bryan Fagan, PLLC we will continue our discussion on this topic from the past few days.
Debt: Surprise! You may have debts you weren’t aware of
A popular radio show host is fond of saying that some people keep debt(s) around for so long that they start to treat them like pets- members of the family, in other words. Now, whether or not you treat debt this way or have debt at all is something I have no idea about. What I can tell you with some certainty is that you will not be happy to discover that you have previously unknown debts as a result of having filed for divorce. Let me explain to you how this could happen to you.
Even if you have been diligent about the loans you take on, your spouse may not have been as diligent. What’s more- he or she may have been deceitful and taken out debts in your name without your knowledge or permission. What results is either a debt that you learn about during your divorce that you and your spouse now need to figure out how it is going to be divided. Either way- the debt is in your name and you are having to rely upon your ex-spouse to pay it off while you are divorced.
Believe it or not, this is actually the best case scenario, as far as unknown debts are concerned. A worse fate could befall you if you learn about debt after your divorce has already wrapped up. What if you tried to take out a car note or open up a new credit card after your debt only to be denied? The reason for the denial could come back as your having taken out too many loans recently. To your surprise, you pull a copy of your credit report and there end up being loans listed that you knew nothing about.
What a helpless position to be in. To have had your ex-spouse commit financial infidelity against you and legal fraud in obtaining those loans. While you can always pursue criminal charges, that will not change the fact, most likely, that your credit has been harmed and your finances are in even more disarray now than they were before your divorce began. How could you have prevented this?
One thing that I always advise clients to do at the beginning of their divorce is to pull a copy of their credit report and to review what is listed. If there is a debt that you do not recognize it is wise to address that with your spouse during the divorce while something can actually done about it. After the divorce means that your options are very limited as far as seeking to have your spouse pay the loan under a court order. Now it is too late. Just to protect yourself, pull a copy of your credit report now and take a look at any active/open accounts. If something looks suspicious you can contact the credit bureau and discuss any issues with your attorney.
How debt is divided up in a divorce
Houston Family Lawyers: But, wait- there’s more! I think debt is such an important topic that I wanted to spend some more time discussing the ins and outs of how you can expect debt to be divided in your divorce. Often times (as I noted earlier in this blog post) debt is divided up between spouses where your spouse may be responsible for a credit account that bears both of your names. This puts you in an unenviable position to rely on your ex-spouse to pay a debt where you could be held responsible for it not having been paid.
This is due to the fact that just because your final decree of divorce orders your spouse to do something, does not mean the creditor is able to alter the legal relationship that you have with the debt. A decree is a contract between you and your spouse, essentially, not between you and Bank of America, VISA, etc. If the debt was taken out by each spouse then both of you bear legal responsibility in the future- even if your final decree of divorce says otherwise.
This is why a refinance of certain loans- home and auto come to mind- should be attempted in order to clear up any issues that could come back to be a problem for an innocent spouse in the future.
Filing for divorce does not take boatloads of money- but it helps
You may be in a position where since your spouse held the purse-strings in your family that you have no idea how much money you all have in the bank. You may also have a fixed amount of money that you live on as a result. Even if this describes your situation very well you should be aware that you can request temporary support from your spouse both in the form of spousal support and child support.
Basically, a court will want to maintain the status quo as much as possible in your life and that of your children as much as possible. If your spouse has been the breadwinner for the majority of your marriage it will not suddenly expect you to bear the same responsibility when it comes to paying bills just because a divorce has been filed. Your spouse will be ordered to continue to provide everything that he or she has been accustomed to leading up to the point of filing for divorce.
Now, that doesn’t mean that your spouse will be perpetually paying bills for you even after your divorce. You will likely need to re-enter the workforce at some point in order to provide for yourself and your children. But, the worry that you are unable to do so now and that this should hold you back from filing for a divorce is simply not necessary. Filing for divorce requires some degree of financial wherewithal, but not to the degree than many people believe is necessary.
Consider an attorney’s assistance when filing for divorce
If our blog posts from the past few days have shown you anything, it is that divorce is as varied, complex and intricate a process as you are likely to become involved with.
While there is nothing wrong with filing for divorce on your own the simple fact is that divorce is not something where it is advisable to attempt to begin the process without the assistance of an attorney. I can tell you without reservation that many of our current and former clients came to our office for help after attempting to represent themselves in their divorce.
The story of RBS, a missing bank statement and so my husband’s possible deportation.
A story for you folks - a day in the life of yours truly, wife of a Ghanaian Immigrant applying for my husband Adie's final UK Visa. We are seriously at risk of having Adie's application rejected because of one missing bank statement. RBS are unable to help us! Please read on……
I had a lovely reaffirming start to my day - Celia, a local accountant helped me by providing the necessary  evidence for Adie's final Visa application. After this Visa he can apply for a UK passport - so in 2 & 1/2 short years we will be able to go to Torremolinos together at last 😜. She turned out to be from Shetland, we know many people in common and her Uncle was a fiddle player. Fiddles duly brought out, tuned up and played, the lovely Celia refused payment for helping us with this 5 minute task - a massive gesture as other accountants were quoting us £400 + VAT.
I left her house with a warm glow, faith in humanity restored, it being the 1st of February and all. Self employed friends will no doubt be able to guess why 1st Feb is a day of lightness and joy…….for the uninitiated, tax returns submitted on time and tax paid by 31st January deadline.
Next task, for Adie's Visa the Home Office require original bank statements evidencing income. I have 6 years worth of statements filed for 3 separate accounts and only one missing statement. As luck would have it, the missing statement is required for the Visa Application. But that's ok, as I only need my local branch to stamp a downloaded printed PDF of the statement to meet Home Office requirements.
I enter RBS Dalkeith Branch full of the joys of new friendship, Shetland catch up and tunes - still happy. You'll be sensing the impending doom.....
It was a case of computer says no.
I'm going to spare you all the sordid details, but in brief, here is what happened.
The Cashier said he could not stamp my online printed PDF statement.
"Then can you give me a letter of confirmation on headed paper from the branch, confirming my printed online PDF statement?" I naively ask.
"Not possible, we can only certify statements issued within the last 6 months ".
I ask to speak to the manager. The manager is on the phone. The Cashier and I go round in circles. I ask to speak to the manager again. The manager sends a verbal message that I have to order a new statement.
I accept this and the cashier orders it. "That will be posted to you within 5-7 working days" he says. This is no good to us. It's the 1st of February and we must submit by 7th of this month.
From that point on things deteriorated. There was an ever growing queue as the Cashier tried his poor best to help me whilst his colleague at the next desk tried and failed to keep up with demand. The queue extended out of the front door.... There were other staff around (doing not a lot as far as I could see, when and if dared look up toward the queue) but my problem, it seemed, was not within their remit.
I stood there for around 40 minutes, publicly humiliated. At no point was I offered an apology or a more private space to deal with this clearly very personal and distressing situation. We are genuinely facing the prospect that without the original Bank Statement or a verified copy, Adie's Visa application will not meet requirements and he will be deported. Home Office requirements are very clear and you simply must meet them. I was armed with a letter from my Immigration Lawyer explaining what was required, but to no avail. I did explain all of this to the cashier. Repeatedly. I asked him to tell the Manager. I have no way of knowing if he did or not, because at no point did anyone more senior come to talk to me.
After a 3rd attempt to speak to management and appeal for discretionary action, the Cashier returned saying that the Manager would not see me, would not verify a statement and that I could not book an appointment with the manager. So holding in a flood of tears, I left.
I was handed a complaints leaflet on my way out.
After a restorative bowl of soup (I am a Scot after all, there's nothing a hearty plate o soup'll no sort), I plucked up the courage to phone the complaints line. Would you believe it - it's just RBS's standard phone line. I thought they had given me a direct contact to Complaints. Aye Right.
I call and explain. A very pleasant soul tells me he can order me a replacement statement that will arrive in 3-5 working days.
"3-5 days", I exclaim! "My branch didn't tell me that."
I order. It's still risky, it doesn't guarantee delivery in time. But it's an improvement and I'll take it.
"Is there any way to pay for a faster service?" I am a fool to ask. Of course there isn't.
I ask to be put through to complaints. Another stupid question. I don't get to call them, they e-mail me back in the next 5 working days. I stand my ground - I am not available next week, it has to be now.
I WIN! He agrees to put me through. Amy 1 - RBS roughly  53,546748. Still, it feels good.
I am transferred to complaints. I speak to a kind human being. He did answer the phone as “Ben from Natwest”, which I wasn’t overly worried about, as I have no idea who owns RBS. I know they and Ulster Bank are as one, so why not Natwest? I told him the story.
I opened with “I went to my RBS Branch in Dalkeith today because……..” and told him the whole story.
He listened sympathetically, he apologised. Then he said “I work for Natwest, I’ll need to put you through to RBS”
Ah ha ha ha ha ha ha ha ha. I mentioned my opening statement about RBS. I can’t even remember what he said in reply.
After an hour on the phone I reach RBS complaints. I may as well be back in the Dalkeith Branch. I am asked if I am making one or two complaints - I explain that I haven’t made a complaint before, so I really don’t know how best to proceed, so please can the advise me. He advises two. I agree.
Complaint number 1 is that the RBS Dalkeith Branch won’t verify the statement. This complaint is rejected because statement verification is discretionary to the branch (now they tell me). I have a mini-meltdown when he asks me if I am “happy for the grounds on which this complaint is rejected”. I explain that I am not “HAPPY”. After some protracted discussion around semantics we revert to one complaint. Now I understand why he wanted me to go for two.
I recite the rest of my woes. At one point he says “we’ll credit your account with £30 compensation today”. I say he’d better not, that I am totally insulted that my married life with my husband when in jeopardy could possibly be compensated with £30. I started crying at that point.
My complaint is in the system. I will be allowed to take it to the financial ombudsman. I expect this is far too trivial a matter for them, but hey it’s worth a shot. I am leaving RBS, but before that I would love this story to be spread far and wide.
We still have no guarantee that we will receive the missing statement in time to submit with Adie’s Visa application. Please do a dance, say a prayer, keep us in your thoughts.
And share this post if you know anyone that could help us get a single original or verified bank statement from RBS by Wednesday next week. Or share it so that no-one else need go through this and RBS might just get the message and change their ways.
My day hasn't all been bad, thanks to the Celia’s of this world.
Hi, My name's Arran. I am husband to a wonderful wife and two beautiful children. In April 2019 we made an offer on a home in Crieff, Scotland, having been renting a small home for a couple of years that was full of damp and we had to fight all the way to the ombudsman to prove that the estate agents had rented a property without properly declaring it's condition. We were successful, but what we thought was going to be a new chapter in our life, where we could begin to build a future, turned out to be an even worse nightmare. The Situation: We completed the sale in July 2019, and we were so happy to be moving into our new home - somewhere that was ours, that we could fill with love and fun. We took advantage of the Scottish Government's LIFT Scheme (where the government puts 30% towards the house, to be repaid on sale) - they approved the property after assessing the home reports and documents provided by the sellers. My wife is a full-time mum, and I work in IT (from home now, of course!) and she wanted to contribute to our income. The property we bought had a good-sized garage - perfect for one of my wife's ideas - dog grooming! All it would take is a little bit of renovation and some learning. After taking out a £20k loan to get off the ground (materials, labour and training courses), we hired a joiner to get to work on putting up a partition wall and an electrician to start expanding the electrics that were in the garage. One afternoon in December 2019, the joiner informed me that the garage was completely rotten - to the core! Suddenly dog grooming was a lot further away. We had the garage assessed by a damp and timber specialist, who concluded that the structure was not fit for purpose and posed a danger to life. As he was drilling, one of the main joists in the structure crumbled away due to dry rot. During our viewing we asked about the water stains on the ceiling panels - the sellers told us there was a leak in the roof which they have fixed and that the whole structure was sound and dry. Given it was a also listed as a category 1 - we had felt confident that it was at least a usable structure. The joiner feels that the state of the garage is due to there being a leak in the roof for YEARS, then once the leak was fixed the owners then added new ceiling panels and vents in order to dry out the beams - this is what caused the rot and where the water staining has come from. Of course, we contacted the surveyors who had provided the Home Report (which claimed everything was a category 1, with only a category 2 for 'uneven cobbles' in the front garden). They came out, investigated, and concluded that - yes, they should have marked this as a category 2 - it was obvious (to a qualified surveyor) there had been leakage and damage through damp, and should be noted on the report so that potential buyers could assess. The surveyors offered to send a contractor to fix the structure of the garage - we advised that according to the joiner and the timber and damp specialist that this was NOT an option. We politely asked for a little bit of time to decide, as we'd been recommended to check out some of the other areas of the house given that the garage had been covered up. We organised our own independent home report and the differences between the first one and our subsequent report are devastating! Our surveyor advised that we cannot legally sell this home due to the state of disrepair and our home was devalued by £6000. Our home is also category 3 for damp, rot and infestation (we have woodworm, with no definitive of whether it’s active or not) - the original home report had this as a category 1. We were advised by our surveyor to have the roof, electrics & boiler checked by specialist as these were all recategorized as a 2 and not a 1 as originally reported. There is no way the Scottish Government would have granted permission for us to buy this home through the Lift Scheme. In all, our home report flagged up 14 category 2s and the category 3 for 'damp, rot and infestation' (the original report had ONE category 2 - for uneven stones). We would expect home reports to differ on some matters, but to see such obvious contradictions was soul destroying. It became clear to us that the original surveyors had not conducted an actual, realistic report on the house. As we have been told frequently "you were presented with one house but sold another". We also discovered that the surveyors have an existing 'business relationship' with the sellers, and there was multiple, similar complaints, outstanding against not only the surveyor company, but the SPECIFIC SURVEYOR that was supposed to have produced the report on our home. We had an electrician come to do a report on the house, and he found that not only were the electrics dangerous, none of them met any kind of standard and were highly illegal - he suggested that the electrics had not been done by a professional. Our electrics were subsequently condemned. None of this was declared or noted in the documents prior to sale. Our electrician said that if something were to go wrong with an appliance, we would likely be electrocuted. He also said that if he had the power do to so, he would have to shut the electrics off. Further, he noted that there was no earth wire to the boiler, and recommended we have someone check out the boiler as it looked extremely unsafe to him. The boiler engineer was unable to check anything as he discovered that at some point, someone had drilled a toilet screw into the boiler casing (having presumably lost the original) which had ruptured the case. He was concerned that any attempt to service the boiler would result in a CO2 leak, and cause our gas to be shut off immediately. In the meantime, we are entitled (through Warmer Homes Scotland) to a replacement heating system. We were successful in the application, and an engineer came out to run tests and draw up for plans for installation. On doing a safety check in the kitchen, he found that the electrics were at a dangerously unsafe level, and therefore he would be unable to conduct ANY work in the house. Our shower broke, and the technician found the same thing - the electrics were far to dangerous for anyone to attempt any repairs. What have we done? After our initial panic and anger subsided, we began looking at how we could fix this situation. We contacted the original surveyors again, who came out to reassess. We also contacted our insurance provider, alerting them to a possible legal claim against the surveyors and sellers for misrepresentation; our insurance legal team suggested the case would be for criminal negligence. The surveyors concluded that they had indeed 'fallen short' of their 'usual high standards'. They would not specify in which regard they had fallen short, and offered us £3000 for full and final settlement. They would not specify what areas the settlement was for. Throughout, the surveyor's attitude was belligerent, avoidant and patronising. They repeatedly refused to answer questions or provide documentation that I asked for (such as proof that a surveyor had even attended the property). Given that we were already £20k down on a loan, £129,000 down on a mortgage for a house we would never have bought, we had to refuse the settlement. We then went through The Royal Institute For Chartered Surveyors (RICS) who offered us £4000. Our insurance legal team indicated that we had a likely claim, and we needed to be compensated adequately, not fobbed off early. After months of waiting, refilling out forms, discussions, letters, our insurance finally informed us in February 2021 (having first contacted them just under a year earlier) that they would be unable to cover any legal costs, as we were not covered by their policy at the time of making an offer. We are currently going through a complaints process to find out why we could not have been informed, even indicatively, that this stipulation would apply. We then started frantically contacting lawyers (who would be able to provide legal aid as all our money not tied into repayments, all our potential for credit has been exhausted by living here). We have been waiting for months to have phone calls returned, for emails to be replied to, for ANYTHING to move. Every law firm we have spoken to has said that we have an extremely strong case - but they either don't have the capacity to take us on, or don't provide legal aid. Even the Scottish Law Society (who are supposed to help you find legal assistance in a situation like this) are not taking phone calls and have not replied to a single email. We have called and written to MPs, to the solicitors who acted for us during purchase, to the estate agents who advertised the property - and nobody is helping us. We have recently had the electrics fixed (we could not live in such dangerous circumstances any longer, every day worrying about our children touching something) - and have had to borrow the almost £5000 from my in-laws to pay for it. What Do We Need? We now have NOTHING. We are living out of an overdraft that keeps getting deeper (and we're about at the limit). We have no prospects. To add to our distress - our eldest was diagnosed with ASD and probable ADHD and was excluded from school during his first few weeks in Primary 1. It has since been determined that it was completely unlawful, that he should have been protected by the Child's Plan from nursery and that the school lied repeatedly to try to avoid scrutiny. However, despite all this, there has been no justice for our son. Just a shrug and 'sorry'. Further, I was offered a lucrative opportunity by someone I used to work for. If I could pass the interviews, I would have been on a career path with massive potential. Slowly over a period of a few months, this opportunity was taken from me, without any explanation or reason and then eventually, he has decided to ignore my messages. I imagine the budget it no longer there to hire - but instead of being open about that (which I can more than handle), the decision has been to pretend I don't exist. With hindsight, we should have realised that the reports and description of the home was too good to be true. Given that no work had been declared, and there was no indication on the home report that things were anything less than in great condition - we were really not in the position to get surveys done for a potential offer. We're now left with a house we would never have bought (especially coming from a rented home that was damp), with debts we cannot pay, with dreams crushed, and with no conceivable way out. No one will help. No one is being held accountable. We have all relevant documents, and I am happy to answer any questions We always considered ourselves good people - trying to help when we can, donating to causes, helping friends and family where they need it. Giving people the benefit of the doubt and never asking for more than what we felt was fair. I have asked for £75,000 - to help us pay back our debts, bring the house up to the standard we were presented with at sale, to help us bring this case to court and to give us some room to breathe after being under crushing stress, depression, and hopelessness for so long. It will also allow us to repay my in-laws for the recent electrical work. But any amount would be greatly beneficial to us. All donations have our sincerest gratitude. Arran & family
Catholic church abuse: Women from French order speak out (CNN) —   Lucie was just 16 when she became involved with a Catholic religious community after attending a holiday camp in Switzerland. At the time, she told CNN, she was “very, very, very alone” and looking for friends and affection. What she found at first was “really like a family,” she said. But two years later – by which time she was preparing to become an “oblate,” a lay person affiliated with a religious order – she says a pattern of sexual abuse by a charismatic priest who she considered her spiritual father began. It took 15 years for Lucie – a pseudonym used at her request to protect her family – to realize that what she says she experienced over several months in the 1990s was abuse. At the time, just 18 years old, she felt “disgusted” by the physical intimacy she says the priest forced on her but also wracked by guilt and powerless to stop him. “It was like automatic you know. He wanted to go to the end – to ejaculation – and I was just like an object for him and I had a feeling he did this a lot of times,” she said. Her story is not unique. Source Provided Lucie, pictured in 1994, says she was abused by a priest with the St. John community in Switzerland. CNN has spoken to several other women who say they are victims of the devastating sexual, psychological and spiritual abuse they suffered within the Community of St. John. For Liene Moreau, who says she was abused by a priest in France for 15 years, starting when she was a novice, or trainee nun, in her 20s, the breach of trust and of faith were the hardest part to deal with. “The psychological abuse was worse than the sexual abuse; it’s my inner life, he took my dignity, my femininity, all that I was. And still today it is very hard to have confidence in myself,” she said. The order to which the women belonged, the Contemplative Sisters of St. John, was founded at St. Jodard in the Loire region of France, in the early 1980s – one of three orders set up by Father Marie-Dominique Philippe. Laurence Poujade, a former nun who now heads a victims’ organization, says Philippe’s doctrine – and his crimes – are at the heart of the order’s problems today. “He believed that because he was involved in mysticism, everything was possible,” she told CNN. “But no, everything was not possible. Courtesy Laurence Poujade An undated image of former nun Laurence Poujade, who now helps abuse victims. “I think very often about the victims who will never be able to be heard,” she said. “We are talking about victims who don’t speak out, but what about those who went straight to psychiatric hospitals, what about those who mutilated themselves? I know of one case, her parents called me to tell she had cut out her own tongue. What can you say? What can have happened for a victim to do that?” In 2013, seven years after his death, the Brothers of St. John revealed that Philippe “had committed acts contrary to chastity with several adult women whom he accompanied at the time.” Nuns were among the victims of this abuse, the order later confirmed. For years, there were also rumors about other priests and other victims within the order. Herwig Reidlinger The late Father Marie-Dominique Philippe, founder of the Community of St. John, is seen in a file image. But the lid was fully lifted on the scandal earlier this month, when Pope Francis for the first time acknowledged the sexual abuse of nuns and other women by priests and bishops as a “problem” for the church. In one breakaway part of the Community of St. John, “corruption” had reached the point of “sexual slavery,” he told reporters, leading his predecessor, Pope Benedict XVI, to dissolve it in 2013. The Vatican subsequently sought to soften that characterization, saying that when Francis “spoke of ‘sexual slavery,’ he meant ‘manipulation,’ a form of abuse of power which is reflected also in sexual abuse.” But the genie was out of the bottle. And it’s clear the Catholic Church – already grappling with a global scandal over the sexual abuse of children by clergy – has questions to answer. Shortly after the Pope’s comments, the Community of St. John issued a statement recognizing that, beyond the allegations against its founder, “some sisters or former sisters have also testified that brothers and priests of the community were also responsible for abuse. Many of these brothers and priests have already been sanctioned and others are in the process of being sanctioned.” CNN contacted the Vatican for a response to this story; its spokesman would not comment on any specific allegations but did confirm that cases involving clerics belonging to the Congregation of St. John were being investigated by the Vatican. For Lucie, Francis’ words were a watershed moment. They brought huge relief – and a sense of justification after years spent struggling to be heard. “When I first read the article, it was incredible, it was like a bomb,” she told CNN, in her first interview about her experience with a branch of the St. John community in Switzerland. “I thought, like, okay, everything we tried to tell the Vatican, the Pope, the bishop, there is something happening… because sexual abuse, nobody ever say before.” Lucie told CNN her alleged abuser had misused his position of authority and the order’s central tenet of “loving friendship” to justify what he was doing. On the first occasion Lucie says the priest tried to kiss her on the mouth, she pushed him away. But she says he was not deterred. “I didn’t feel I had any power in front of him, I couldn’t say really something. When I was trying, he always had arguments to tell me that I’m wrong and he’s right. How can I not believe him?” she told CNN. “He was taking off his clothes and I saw everything – it was the first time of my life, and I was really disgusted. But I realize that on the moment I didn’t feel anything. Because I was not there anymore, it was a protection, to not feel.” Saskya Vandoorne/CNN Lucie keeps a prayer corner in the home she shares with her husband and children. Lucie has struggled to grasp why she didn’t realize what was happening at the time but now believes it was down to that disassociation and what she calls brainwashing. “It was absolutely 100% impossible for me to see him like a predator,” she said. In response to the allegations made by Lucie, a spokesman for the St. John community told CNN there had been “several accusations of sexual abuse” made towards this particular priest and that he had left the community 10 years ago. “It is now the Vatican’s responsibility to look into these complaints and a legal proceeding is ongoing,” the spokesman said. “All the measures at our disposal have been taken to remove him from the community.” The problem is not isolated to one rogue community. In recent months, CNN and several other news organizations have highlighted the abuse of nuns by male clergy elsewhere in Europe, as well as in Asia, South America and Africa. Bishops from around the world have been summoned by the Pope to an unprecedented summit this week in Rome to discuss the crisis over clerical sexual abuse. But the four-day meeting will likely focus on the shocking array of claims of abuse of children. All the women who spoke to CNN said their first struggle was simply to recognize the abuse for what it was. Only after many years did they seek justice, first within the church and then through the courts. Lucie, who is now married with five children, tried to take her alleged abuser to civil court, but a Swiss public prosecutor ruled that the statute of limitations had expired. A lawyer for the priest declined to comment to CNN on the allegations made by Lucie. Lucie, who eventually moved to Belgium and still attends church regularly in the small village where she lives, says that before attempting legal action, she had tried unsuccessfully to raise the issue with the St. John community. “After I don’t know, maybe two years, I was conscious that the community was not doing anything, I was talking about (it) with other victims, realizing that they know, that it’s been 15 years that they know, that there’s other victims. So they don’t want to do anything,” she said. Moreau, now 41 and married with three daughters, tried to take her alleged abuser to court in France, but the statute of limitations meant the case was dropped by the Tours prosecutor. Saskya Vandoorne/CNN Liene Moreau, from Lithuania, says the abuse began while she was a trainee nun with the St. John community in France. She sought a meeting in 2017 with the priest in question, to confront him, but was advised against it by the order. A brother from the St. John community sent an email in November 2017, seen by CNN, in which he acknowledged “the gravity of the abuse” Moreau suffered but said she must see a psychotherapist for her own sake before seeking contact with that priest. In letters shown by Moreau to CNN, dating from her time with the order, the priest suggests “discretion… in the future we will have to meet elsewhere … I pray that we can find clever ways of meeting.” He ends by saying that his “crazy love” for her comes from Jesus. Moreau, who is Lithuanian and at first spoke limited French, now thinks the priest may have targeted her in part because of that. “I was far from my family, in a foreign country, this is already something, and that might also be why he chose me, an easy prey in the end,” she said. The priest also made her believe that the fault was hers, as a “temptress,” she said, despite the fact she says she tried to distance herself from him. The priest in question is being investigated by the Vatican and has been removed from some of his duties, a St. John community spokesman said. In a February 7 statement, the leaders of the three orders within the Community of St. John said they condemned “every situation of sexual abuse and abuse of power” and reaffirmed “their clear resolve to eradicate any and all abusive situations.” They said the order dissolved by Benedict in 2013 – and referenced by Francis – was a small, Spain-based splinter group which separated from the St. John community in 2012 after church authorities tried to bring in reforms following Philippe’s death. The dissolution of the order has brought little closure for Moreau, who is still coming to terms with what she says happened to her. “It lasted for 15 years, and it’s now been two years since I was able to put the word ‘abuse’ on this, and still today it’s very complicated to admit that I might be a victim,” she said. “If only just for myself, I don’t want to be a victim. And yeah, I feel responsible because he made me responsible, he made me complicit in his acts.” CNN’s Melissa Bell and Saskya Vandoorne reported from St. Jodard, while Laura Smith-Spark wrote from London. Barbara Wojazer contributed to this report. Source link Orbem News #abuse #Catholic #church #French #Order #speak #Women
Ok about 3 weeks ago I was rear ended while my car was stopped on the freeway. The guy hit me doing about 30mph. I have had back and neck problems ever since. I have been seeing a chiroprator on a weekly basis. Also it was a hit and run but I was able to get his license plate number. I live in California. Ok so his insurance company called me trying to settle for 1000 plus my medical expenses. The problem is I don't now what my conditions will be like in the future. Also how many times will his insurance call me and change the offer?
How long have i had car insurance?
Can someone please tell me where I stand on the following: I have held a provisional UK license since 4/4/06 after a few months of driving lessons I took out insurance on my vehicle with Virgin so that I could drive accompanied by my parents. This policy was taken out on 31/7/06. On 9/11/06 I past my driving test. On 31/07/07 I renewed my car insurance with virgin and with the 31/07/08 soon approaching I must again renew my car insurance. The problem is I will in fact have had two year no claims on 31/07/08 which Virgin recognises, however when I go on their and any other online car insurers websites it says that my no claims (2 years) cannot exceed my full license period (1 year 9 months) So the question is, will my car insurance be recognised by other insurers as been held for two years?""
Car Insurance????
Hi does anyone know any cheap car insurance companies. Thankyou
Why quotes from Insurance advisers and comparison sites are significantly different in price?
Can health insurance companies request medical records from other health insurance companies?
When I was in college I was in a relationship that made me really depressed, and the psychologist on campus referred me to an outside therapist with a diagnosis of major depression --the outside therapist corrected it and said she believed i had circumstantially-related depression, but she told me she coded the claim with the referring guy's major depression label so the insurance company wouldn't hassle me about the paying the claim. I worked with her for a 6 months --no medication, just got out the relationship--and am happy and healthy :) Now I'm reading all kinds of scary stuff about MIB, retroactive declining of coverage, etc and I currently have new individual (underwritten) coverage--I can ask her to correct the claim with my old company, but it seems like any action might rock the boat and I'm scared--if they didn't notice it, should i leave it be? or is there a chance that if i (god forbid) get something serious down the road that my current insurer will dig up my records from my old insurer to look for a reason to not pay? she was trying to do something to make my life easier but this whole thing has turned into such a mess!""
What is a good car insurance company - value and a known company - not high risk?
We typically have the second car for 11-22 months. I mentioned to the insurance company that in the future I want to avoid this $5.00 fee since I always pay in full and I waving it this time wouldn't solve future issues b/c my husband is in the car business and we buy a third car to sell the second when he finds one he likes. Car Insurance and Credit Cards?
In less than a year I'll be getting my own credit card and I'll have to have car insurance. I am trying to find the best credit card and car insurance for me so that I won't have to spend money and time later to change it. I am unsure what kind of credit card is best. I am going to try and will most likely succeed in having the best credit. What credit card do you suggest to a high school student who will go to college and to the armed forces. Also I want to know which car insurance offers the cheapest car insurance, I want one that offers rewards for students, safe driving, clean driving records. Any help will be much appreciated.""
