Should I hire an attorney for this?, I purchased a policy online a few months ago within the first few days that i had this insurance I had a storm and damaged my vehicle (minor) with hail damaged I submitted out a claim, appraiser was sent they covered the loss sent a check to me, now i take it to the bodyshop and try to have it fixed but they need a supplement, they contact insurance co. but insurance co, makes many excuses over this they state I dont have full coverage which I do, and it was verfied with them that i do, the next few weeks pass and then I finally get a call from a manager at the insurance company stating that they mistakenly sent me out a check because I made a false claim report, they said that they can tell by my pictures before policy was bought that vehicle had damaged (which is an excuse of denying supplement) and stated the the adjuster overlooked everything point here is that insurance co, cancelled my policy by stating underwriting issues, so now Im without insurance coverage, the manager also stated she reported this to the texas state but mentioned she could not put a stop payment on the check and that I could still use it to fix the car or cashout the check... I am really dissapointed at how all this was handelled, Im thinking about getting an attorney, I already discussed and this issue with the Insurance company and Im basicly told that I lied about the claim and they end my call... Should I wait to get an attorney or should I just get one and go from there? I believe this is bad faith insurance coverage, What should I do? I mean I still have the check it is not cashed out, I cant really do much with this check everyone charges an arm and a leg, can they file insurance fraud charges and if so even though I know I did everything right should I get an attorney?""

Hi Have a question. My rear bumper was lightly tapped by 17 year old new driver. Damage is minor and cosmetic at $425. My car is only three years old and in perfect condition. The insured provided me all his insurance information and said to file a claim through his dad's insurance carrier. I called local police department 911 line to report minor collision. Officer responded and insured admitted to police officer that he tapped rear bumper. Police officer looked at my rear bumper and refused to make a police report as he said cannot issue a report unless damage is over $1500. I begged the officer repeatedly to please provide me even an incident report or something official like an affidavit as the teenager admitted to officer that he hit my rear bumper. Police Officer simply drove off and left me on the side of the road with a stranger. Of course now four weeks later, the insured and his father have simply ignored phone calls, emails and registered mail attempts by his insurance carrier to verify version. (not sure what version would be needed as my black paint is on his front bumper) I called the insured and his dad hung up on me twice. The insurance carrier told me they are denying and closing out the claim due to insured not responding. They said this is totally legal under Illinois State laws. (basically too bad, so sad) By the way this insurance company has unacceptable rating with state insurance board and BBB. I paid a body shop $425 in cash to fix car yesterday. One year ago my wife was taking our daughter to pre-school turning left out the end of our road in to traffic, this road has a speed limit of 35 mph. Traffic had to stop to let her cross the first lane since it was solid cars, vans and small trucks. As she approached half-way, before getting a good view of oncoming traffic, another car took off the front bumper. Note that the center line is interuppted at the cross-junction. The bumper was torn from the front of the car with damage more evident on the non-impact side of the car than where initially hit, hence my wife had not initiated a turn, just edging forward to see. The radiator was in-tact, but damaged, still mounted to the front of the car. I walked to the site with our other child and took my daughter home; she is fine and I took her to school but still talks of the incident today. My wife stayed at the incident, and was fine (no later issues) keeping real calm and cooperating with police. It took about 2 hrs with police debating which town the incident took place (middle of the road is the divide) and the other driver was concerned about getting home to take a pot off the stove, but seemed medically fine. The driver asked me and the police to drive them home to get the pot off the stove and used my wifes cell phone more than once. They also wanted to drive their car home and leave the scene with a flat tire at one point I presume to attend to the pot. No tickets were issued, no air bags deployed. The other car had a flat front left tire and side damage so the drivers door was stuck shut. Both cars were old, so written off. Over a year later we received a court summons from their attorney and we are being sued for $750,000. Our limit is $100,000 on insurance. The plaintiff is claiming herniated discs and loss of bowel control. We have a 2006 no money down mortgage, so total equity is very much in the red since our home value plummeted. I have no umbrella policy. I am sole income, but was owner of the car my wife was driving. My wife is stay-at-home mom. The remaining $650,000 would be a big problem. Interestingly, we heard that the other driver called our insurance and asked for a >100-fold lower amount of money to just go away! Our insurer recalls this very clearly and did not pay. Questions: Should I invest in an attorney to work with our insurers attorney to cover the $650K over our limit? Do we have any case given the car the other driver may have been in a rush (as all were aware of the pot on the stove), would have settled for far less, and in reported safety tests should avoid an obstacle at 55mph let alone at the speed limit of 35 mph? Their case, as I understand, is to actually prove my wife was negligent, she was just trying to see. Reality and the law are complicated I understand. Our insurer is looking in to the validity of their medical claims. I believe for spinal and neck injuries plaintiffs have to follow careful insurance approved treatment plans in NJ. I know that such a condition may not be permanent with curative surgery possible to release the nerves that may be causing the bowel issue. The plaintiff has claimed the injury as permanent, do they need to prove this? Should we ask experts? The plaintiff lives in our town and their house is on my running route every other day. So, why would my CHP (Capital Health Plan) health insurance company be contacting my primary? Especially about alcoholism counseling, this has NEVER been an issue in the past! I'm so upset! Insurance company wants to total my car/not insure it.?

So my dad rear ended someone really softly, but it was a truck that he rear ended with a hitch or something that damaged the grill and the bumper. Problem is, I put a total of $2700 to have transmission replaced and the engine repaired after the timing belt broke and caused damage over the last 2-3 months. It is a 2004 dodge neon and the body to these things are flimsy to begin with. I'm taking it in Monday to get it looked at better, but they said from what they could see it might be a total loss. Which means its only gonna be worth $2000. they said they have to replace the hood, the grill, and the bumper and other stuff which is **** because I know people who could fix these problems for less than $500. they aren't even visibly bad, a few dents in the places i mentioned but when i took it in they reacted like i had been in a head on collision going 50 mph. It runs perfectly, we wouldn't have even reported it except we were worried the guy might claim injury after the fact (which he did). What can I do? This is my only car, and I am already in debt from student loans. $2000 isn't gonna buy me a new car. How can I convince them not to total it when I take it in?""

I just had to bring my car to the shop for a repair. They ended up needing to keep it. Now a rental was covered under the warranty. So at least the rental was covered. But the guy had me signing off on insurance and what not. I guess the insurance on my car would cover the rental if I had an accident. But they would take from my cars deductible. So I basically signed off on a Collision Damage Waiver and also personal accident insurance. I did decline supplemental liability insurance though. Should the warranty be covering these fees or was this an extra that I got talked into? Because if the warranty covers the rental they aren't making anything. My understanding is it could be better because I am covered under their insurance if I have an accident and it wouldn't come off my own cars deductible? Kind of new to this and probably wouldn't have been worth trying to argue it after the fact that I signed off on stuff.So if I use this car for like 3 days I'm in it for like $60 in insurance. Also does anyone know how this buying the tank of gas works? I understood it as if I use so much then I pay there price of $5.60 a gallon. But I got told it was best to just buy the whole tank at $3.30 per gallon(best option seeing as gas is so much these days) And then to return it as close to empty as possible to get my moneys worth.
