A bill currently [November 2023] before the British Columbia legislature seeks to define “reasonably available” alternative shelter when municipalities go to court to enforce bylaws against homeless encampments. If passed, Bill 45 will undermine the Charter rights of some of the most vulnerable members of Canadian society.

The bill is short and cryptic. It says that, if a local government goes to court for an injunction to enforce its bylaws against someone sheltering in a homeless encampment, alternative shelter is “reasonably available” [...]. Beyond leaving key terms like “homeless,” “encampment” and “near” undefined, the bill simply asserts that shelter spaces are reasonable options if they meet this bare-bones description, regardless of whether they are actually accessible to tent city residents. This would overturn a series of court decisions that insist shelter must be practically accessible to the individuals the government wants to evict from encampments.

In Greater Vancouver alone, more than 4,800 people are homeless, sleeping in shelters, cars or outdoors. That is up a staggering 32 per cent since 2020.

Encampments are a visible sign of this crisis. Yet, despite an overwhelming lack of affordable housing, governments have taken a largely punitive approach to them.

Courts have established that prohibiting unhoused people who lack adequate alternatives from sheltering overnight on public land violates their constitutional right to life and security of the person. Yet Canadian municipalities have gone to court repeatedly seeking injunctions to evict encampments from public land.

In new research, we show that courts have been remarkably eager to grant municipalities injunctions even though they are supposed to be drastic remedies for extraordinary situations. [...]

But instead of taking a human rights approach to homelessness, the B.C. government’s new bill makes it even easier to evict already vulnerable people.

The bill’s definition of “reasonably available” alternative shelter might seem to give encampment residents some protection against arbitrary eviction. But it actually weakens existing legal protections by ignoring the barriers that make many shelters inaccessible, the distinct situation of Indigenous people and the need for shelter and storage during the day.

Violence, theft, mold, vermin and lack of privacy make some shelter options inaccessible to many unhoused people. Inaccessibility is particularly stark for women and gender diverse people. Strict limits on how many belongings people can bring into shelters also present an impossible choice between sleeping indoors and safeguarding belongings. Bans on pets and couples are barriers for some. Curfews and abstinence rules limit accessibility for people dealing with substance use and addiction. Many unhoused people, including those with mental health challenges, are ejected under “one strike you’re out” policies. Limits on shelter stays are another barrier. On top of it all, housing waitlist processes are confusing and frustrating.

These barriers are well known to everyone concerned with homelessness, including the B.C. government. Courts say they must be considered when deciding whether to issue injunctions against encampments. By ignoring them, the bill perpetuates a false stereotype of unhoused people as “choosy beggars” who deliberately refuse adequate shelter. [...]

Finally, the claim that having somewhere to spend the night meets a person’s basic needs for shelter is simply untrue.

Having somewhere to shelter and store belongings during the day is a basic need that courts have recognized for years, and have begun to acknowledge as a constitutional right.

To deny unhoused people the ability to shelter throughout the day is to condemn them, in one judge’s words, to “constant disruption and a perpetuation of a relentless series of daily moves to the streets, doorways, and parks” of Canadian cities.

As our research confirms, packing up their homes, carrying all their belongings around all day — including tents, sleeping bags, clothing, toiletries and medicine — and lining up for somewhere to sleep every night is a hardship for all unhoused people and impossible for many. [...]

Bill 45 is aimed at excluding poor people from public spaces. Instead of addressing the province’s lack of housing and income inequality, the B.C. government is making it easier for municipalities to police poor and unhoused people. This bill attempts to roll back existing Charter protections and limit courts’ discretion regarding injunctions against encampments. It will be deeply harmful to unhoused people if enacted.

The Addiction Lingers Like a Painful Reminder

June 17, 2024

Happy 17th day of Pride, everyone. Today, I am writing about how Dean’s addiction continued to affect me and how it almost destroyed me.

I wrote yesterday that I had to get my lawyer to move things along. Since Dean was on title, it made it more complicated to get resolution. This meant that finding an end would take more than a year. During that time, my life became a nightmare.

Dean quickly kept the outside access doors barred. He also nailed boards against the door that I used to use to go downstairs. I had to basically have his permission to access my washer and dryer or any of my storage items. I’m not sure what Dean did, but my washer refused to work. It was broken. With resignation, I bought a new pair of washer and dryer. I had to make sure that I had access to have them installed, which happened, but I couldn’t use them often enough.

My evenings after work consisted of watching the stream of men coming and going from the basement. He also now had a “boyfriend” who was staying with him in the basement. This guy was nasty to me. There was no way I could convince Dean to leave - even though I told him that he hadn’t paid anything for almost a year. He and his boyfriend would sit there stoned and sneered at me until I broke down in tears or left in desperation.

One day, I went to the workshop side of the basement and knocked. Dean wasn’t there or in the other side so I tried the door and found it unlocked. When I walked in, I was dumbstruck. There was trash everywhere and needles strewn all over. There were tin foil spoons with burned crystal all over the place. There was a sleeping bag in the closet with some stranger’s clothes. The sling was hung where he had installed it as well. As I approached the sling area, I noticed that Dean had used a knife to tear open a heating vent to let heat in as there was no heat on that side. The workshop reeked of drugs, body odour and shit. There were also the beginnings of a crystal meth making kit. I took pictures of everything and left. That was the last time that I had access to the basement. I would never know what was going on down there.

Yes, I called the police and told them about the crystal meth lab, but no one cared. No policeman ever came to my door. I would sit up at nights worried that the house would blow up, killing me and my pets, along with Dean and who ever was down there. Men still came to my door so much that I stopped answering the door. There were even times when Dean would not leave the house. We used texting to communicate and the sound that my phone made when a text from Dean came in, made me literally sick to my stomach to hear. I had to change the sound for my own sanity. There were several times when there was not a sound in the basement for days one end, but I knew that Dean was there. Sometimes he wouldn’t answer my texts. I could hear the text coming in on his phone through the floor but no answer. At least three times in that year, I thought that Dean had died of an overdose in my basement. Just when I was about to break down the door, he would be there to confront me. The last time he mumbled about needing money so he could go to the Downtown East Side of Vancouver to get some heroin. It seemed he was now addicted to that as well. His friend who got him addicted disappeared so I never found out what happened to him. He most likely died of his cancer.

The day came when we had a Discovery Meeting between my lawyer and I on one side of the table and Dean and his lawyer on the other side. The judge sat at the end of the table. My lawyer presented my offer and a request that the house be put in my name. His counter offer was spousal support as we were common in law before the break up. He also wanted future profits to come in if I sold the house. The judge told Dean that he should take my offer and that the future profits were not valid. In the end I had to take a large chunk of my RRSP’s (retirement savings for my American friends) to pay off Dean. I then had to budget for spousal payments for the next year. I was in a real financial bind. Vancouver, even back in 2007-2008, was extremely expensive.

For me, the house was all that I had left. With the agreement signed and a date to move out, the whole process began, but it was even more hellish for me. With the house being signed over to me, the bank had to renegotiate the mortgage with me. The application came through and I had to wait for the bank’s agreement. One evening, my bank manager called and said that they couldn’t give me a mortgage on my own based on my teacher’s wages. I climbed into bed and cried myself to sleep.

The next morning, I dragged myself to school. Instead of going into my classroom, I went to the counsellor’s room and he was there. He welcomed me in as it was customary to hang out in his room. I sat down on the couch and stared straight ahead. I’ll call him “Harry” and he asked me what was wrong. I remember staring straight ahead and saying that I was leaving and not coming back. Harry asked me several times and I said the same thing. I broke down and sobbed for a long time. The bell rang, so Harry called the Vice Principal to cover my class until I was ready. Harry finally clued in to what I was saying about not coming back. I wasn’t going to come back to school because I wasn’t going to continue living. Harry was a professional and handled the situation well. He called up the Principal and explained what was going on as I continued to cry uncontrollably. She came to the room and said that she would call a substitute in to cover my class. Harry went down to my class with me to pick up my things. The students were quietly reading for the Vice Principal. I couldn’t even say goodbye to them. I just looked at the floor after picking up my belongings and headed back to the counsellor’s room.

Harry told me that he had called an ambulance and that they would come and take me to an emergency clinic. Twenty minutes later, the ambulance arrived at the front of the school and Harry led me out to the waiting attendants who put me in the back of the ambulance. I remember little of the ride, other than they seemed to be going all over the place. I don’t even know how long it took to get to the clinic where I was to see a doctor.

Inside, I met with a doctor and he asked me if I wanted to take my life. I said yes because I had no reason to live. My mind was a foggy mess and what little I remember seeing was through bloodshot eyes that constantly became blurry from the tears that wouldn’t stop. The doctor told me that the ambulance would take me to the hospital for processing. I asked him what would happen if I refused. He said that I could refuse, but the police would come for me. Harry was there with me and he convinced me to get into the ambulance - without even knowing who was going to take care of my pets - Dean couldn’t even if he wanted to.

I’m going to stop there as I realize that there is still so much to tell. I will continue the story tomorrow. For Pride, I am celebrating life itself. If you’ve ever considered taking your own life, then you must know how desperate and lost I was. If you know someone who might take their life, listen to them and take it seriously. It could save their life.

Moving home, and my friends' almost-successful attempt at making me stay

A box and three suitcases half-full of my belongings sit around, scattered in my apartment. The rest are still in the drawers of my dresser, on my desk, and in the laundry basket. The packed clothes are barely folded, and the books in the box are stacked like a bad game of Tetris. My cat, Shrimp, hates going into his carrier, despite the amount of treats I leave, the shiny toys that wait around, and how many droplets of catnip spray linger in there. My beloved subletter of three months made me pay for the first week of December, so I kept the heating up to the max in my room, even if I was out of the apartment for extended periods of time. I fly back home tomorrow.

Every time I fly back to Quebec from my hometown, Vancouver, it only ever really takes between less than a day or two to adjust back to the brittled concrete, the charming garbage day air, and the Bixis in my blind spots. September of this year was different. After a long West Coast summer of six weeks, I felt a leftwards tug that I tried to ignore. It lingered weeks after I landed and settled into my new apartment. I tried to journal, walk, exercise, and meditate the yearning away, but in turn these activities lead me to a plane ticket home—so here we are.

The other night, my friends threw a pyjama-karaoke-themed farewell party for me. I took care of the invites, and they took care of the rest. I knew I wanted to see all my friends before I left, and I could have easily planned something for myself. But between work, packing, and attempting to force Shrimp to get used to being lugged around in a container with wheels, I needed help–and as a Leo with crippling pride, it was nice to not have to admit it in the moment when they offered to plan it for me, and I am so grateful to them.

Around my friend Alex’s apartment, there were photos of me dispersed around her walls. In no particular order: there was one from when I went apple picking with my boyfriend, Will; Will and I posing next to the Barbie movie poster after seeing it in theatres when it came out this July; another of me behind the counter from when I was working as a barista at the hip Italian joint in Griffintown; me and my roommate’s cat, Pesto, who is shaped like an upside-down light bulb; a few of me in my friend Adela’s backyard—one of me, Maxine, and Alex celebrating her M&M-themed birthday as brown M&Ms, one during her Lunar New Year hot pot, and one of me reading; one of me drinking coffee in her kitchen; me, Derelyn and Alex at this year’s pie-themed Thanksgiving; Jiestine and me eating the menu’s special (fried pork, egg, veggies, and rice) at our favourite Chinese restaurant; me on Valentine’s day (my favourite holiday) offering flowers and Cheetos to Alex, Jiestine and Adela; me sitting next to the garbage can with my arms shaped like a “V” for victory, with a smile of relief after successfully moving all my things in a storage unit.

Between these walls, we gathered around the table of candy salad bowls, Cheetos, shrimp crackers, bread, cheese, and seltzers to talk about the highs and lows of our respective seasons. I introduced new friends to old ones. We shared our Spotify Wrapped playlists, and we danced and sang the night away. Towards the end of the night it felt more and more like a campaign to get me to stay, especially when Adela sang “Take Me Home, Country Roads” while my friends surprised me with a cake decorated with gingerbread cookies and a figurine of a little boy with a mushroom bowl-cut. It almost worked.

I have my doubts about moving back, and my friends are the biggest reasons why I stuck around on this island. I can only do what feels right to me, but only time will unravel and reveal as to whether or not this homecoming is what’s best. As a victim of the late adolescent/early adulthood Vancouver to Montreal pipeline and meme to “fill the void”, I am grateful that I fell into the trap. At my goodbye party, the friendships, the music, the food, the soul put into the planning of my send-off, and the memories on the walls of Alex’s apartment stitched the gap so perfectly. I’ll hold this city so tightly to my chest, and I’ll keep it in the inside pocket of my down coat, because of who I found here.
