Reposted from @tainadeborikenpr - SAN ANTONIO - A #policeofficer who was previously fired following accusations he gave a feces sandwich to a #homeless person has won an appeal to get his job back. According to court documents, an indefinite suspension handed to #MatthewLuckhurst has been overturned by an arbitrator because of a rule that requires the #SanAntonio #PoliceDepartment to assess punishment within 180 days of an incident. It was in May of 2016 when Luckhurst was accused of placing feces on bread and into a styrofoam container before placing it next to a homeless person. SAPD's Internal Affairs department investigated the matter, and in November of the same year, Luckhurst was fired. The San Antonio Police Officers Association later argued that the incident didn't happen in May, but more likely in March or April. That would mean that a punishment in November would have been outside of the 180-day rule. The arbitrator that handled the case actually sided with SAPD that the indefinite suspension was appropriate, but because the 180-day rule was violated, the punishment cannot stand. San Antonio Police Chief of Police William McManus disputes the timeline that led to the decision. “Unfortunately the arbitrator’s decision was based on Luckhurst’s version of the incident even though testimony from officers who were present at the scene established a clear timeline of events. He is still facing a separate indefinite suspension and we will vigorously defend the decision to terminate him.” Because of that separate incident, he is not back on the job. Luckhurst will have to argue that before an arbitrator.
