Protection of trademark:
A trademark may be appropriated or usurped together with all its attendant rights, reputation and property for that brand for the market of any country. If owners of such reputed trademarks do not seek to register their trademarks in India, then a trader, who is on a look out for an appropriate trademark for Indian market, may sometimes be tempted to start using a popular trademark in foreign countries without any authorisation from their owner. However, India joining the Madrid protocol permitting foreigners to designate India for protection and also that all applications under section 18 in India would be scrutinized against international registration under Madrid protocol.
Legal Registration:
When a person uses a trademark which is not known in India, it can hardly be said to have done any wrong to an owner, whose market is reputed abroad but is not known at all in India, even though it might be known to a few travellers who may have visited the country where it is popular. At times such an Indian user, whom we refer as usurper, may obtain pre-emptive registration of the impugned trademark and may also advertise the same.
Such a person who starts using the mark and if he obtains registration of the trademark, he would normally be able to secure some advantages in his favour. The legal position as it emerges is the first user in India shall be proprietor of trademark in India. If the foreign owner of trademark for foreign territories having use or sales in foreign countries desires to enter Indian market, he will not be able to do so, as the local use and/or registration operates as legal barrier against the use of the impugned mark in Indian market. The concerned prior user in the other country would be able to operate with the trademark only after getting the mark expunged or in the meantime obtaining an injunction against the used or registered mark by the usurper.
Usurper:
If the Indian usurper desires to take some of the advantages and has been able to structure his affairs in a legal manner, then such user or registrant could take following course:
Forcing the overseas proprietor of similar mark to engage the local usurper who is registered proprietor for India into a licensee of the foreign party, or
When such a person has not obtained registration and wanted to make quick money by selling sub-standard goods under the reputed brand name, also referred as fly-by-night operator, such user may be willing to stop the operation when the foreign party comes or takes legal action.
To assign back the trademark in India (or some other country) to its overseas owner of similar mark at an exorbitant price when the trademark owner wants to enter the particular market himself.
Protection by registration or legal environment:
If the legal environment in India is such that the registration of trademark is not granted to the dishonest usurpers, the registration system may be said to operate as a protection to vulnerable trademarks. In the alternative if the injunction as stated above in favour of foreign party’s forthcoming, then it can be said that legal or registration environment is conducive to protection of trademarks. Our understanding is that the legal environment is extra favourable. We do not have objection to the foreign party getting his mark back, if it is due as per the laws laid down, but if the local usurper has structured his affairs in legal fashion, then the legal discourse should not be stressed by wrong interpretation.
FTM (Foreign Trademark):
Some FTMs could be and were used in India with underhand collaboration, between the foreign right holders and Indian users, as the government was not giving permission; or could be wholly unauthorised. Such use was in circumvention of the Indian government policy. The need or practice of using and seeking to register the reputed trademarks by locals, had received impetus because of government restrictions on the use of the FTMs for internal sales.
