Prayer: The license for the liquor shop at the present location may not be issued/renewed for the year 2025-26.

Order: The Respondents are restrained from granting/renewing the license to the Liquor shop in question after the expiry of the present license on 31st of March, 2025 meaning thereby for the financial year 2025-26 onwards.

Fact:

1. Master Atharva, an LKG student at Seth, M. R. Jaipuria School, Azad Nagar, Kanpur, filed the present PIL stating that a country liquor shop licensed to respondent no. 5 is running adjacent to the school of the petitioner and the distance of the liquor shop from the school is less than 30meters.

2. The shop remains open throughout the day and is a meeting place for anti-social elements.

3. The father of the petitioner had made a complaint on the Integrated Grievance Redressal System (IGRS) portal of the Government and a report was prepared admitting that the location of the liquor shop is 20-30 meters away from the school but denied taking any action on the ground that the liquor shop is older than the school of the petitioner.

Submission of the Counsel of the State:

1. The shop in question is running for over 30 years and the school was established in the year 2019.

2. There is no violation of any of the provisions of the Uttar Pradesh Number and Location of Excise Shops Rules, 1968.

3. The shop is being operated in consonance with the provisions of the Rules of 1968 and the school came into existence much after.

4. The liquor shop has been running for the last 30 years and year by year license is granted and renewed.

5. The School came into existence afterwards.

Observation of the Court:

1. The license of a shop is issued for the financial year 2024-25 and the same would expire on 31st of March, 2025.

2. The mere fact that the shop was used as a liquor shop in a financial year before the school came into existence, is not sufficient for invoking proviso 5(4)a of the UP Number and Location of Excise Shop Rules 1968 for the purpose of granting license year after year in as much as the license is issued to the licensee on his fulfilling the eligibility under Rule 8 of the Rules of 2002 and not to the shop in question.

3. Any other interpretation of the said proviso, as projected by the counsel for the respondents, would render the provisions of Rule 5 (4) (a) nugatory and hence can not be sustained.

(I remember my elderly alcoholic co-worker begging the boss to sell her a bottle of wine from the restaurant on Sunday.) When you're used to this milieu, the rest of the country seems positively awash in booze.

Fast-forward to shopping in the Ohio Walmart, where they do have beer and wine: but no hard stuff. Weirdly, rather than not selling it, it's available in a diluted to 20% ABV or less version. (Surely there are other states in this bizarre diluted hooch zone...?) You have to go to a dedicated liquor store to get things like whiskey or rum not watered down.
