The broken idealist: Higuruma Hiromi
And how the world of JJK viciously punishes idealists.
Tumblr media
Before we start, let’s set some premises:
This is an essay based solely on my opinions and my own knowledge of criminal justice. I’m no professional writer/essayist.
JJK is a critique on unfair systems that reward selfishness and nurture individualistic (oftentimes destructive) behaviors.
One of the main motifs in JJK is (un)fairness.
Even when rewarded by these systems, individuals usually end up alienated (Gojo being the utmost example, but so is Sukuna to some extent).
The world of JJK punishes idealists very harshly.
I might've read waaaaay too deep into his character (apologies in advance).
I am ABSOLUTELY biased in analyzing this character because I kin Higuruma very hard and identify profoundly with many of his struggles.
[queue “Pigs” by Pink Floyd] Let's do this.
Tumblr media
The ideal of truth and Higuruma choosing to be a criminal defense attorney
Higuruma shows up in the manga as one of the top players of the Culling Games. Throughout a few chapters, Gege introduces him to us as a former criminal defense attorney that has lost it after one of his clients gets his innocence verdict overruled and is unfairly convicted for a crime he didn't commit, triggering Higuruma's cursed technique to awake, ending up in the deaths of the Judge and Prosecutor that contributed for the wrongful conviction.
Along those chapters, we get to see two very interesting things: Firstly, the fact that Higuruma actively chose to be a lawyer, instead of pursuing a career as a judge. Second, his stance and lines about truth, especially this one: "Even if no one else does, I want to keep my eyes open."
Higuruma, for me, is a prime example of how someone moved by truth and justice can become a self-righteous, cynical individual (I'll refrain from the word "villain" because he wasn't ever an actual "villain" in the story). From the get go, when we get more information on his past, we can see his mental state slowly declining as he gets progressively more overworked fighting an unwinnable fight.
Tumblr media
We have some very important pieces of information from chapter 158: Japan has a 99% conviction rate. The public opinion about defendants is that they're always guilty. Higuruma earns little, works a lot and his job is usually trying for a miracle, to be that 1%. And, finally, that Higuruma chose to fight an unfair system from within.
That not only has huge parallels with the world of cursed energy, but is one the most important messages I feel that JJK is building up to — you can't reform a broken system from within, because structurally and systematically unfair systems will always push things back into a state of unfairness / status quo. We see this when Gojo says, at the beginning of the manga, that even if he killed all the higher ups at that point in time, other assholes would just take their places. To a more fundamental level, we see it in Yuki's failed efforts to end curses from the perspective of a jujutsu sorcerer, and the way the story is progressing towards a complete rupture with the current state of cursed energy altogether to give place to something new.
The message is: To fight an unfair system from within and by its own rules is and always will be a losing game.
Now to Higuruma's fallout, we have a perfect storm for what happened to him — an unstoppable force meets an immovable object.
I'll dive a little into criminal law (and c.l. procedure) and make many oversimplifications to get a point across, so I apologize to any other criminal lawyers out there reading this and cringing at the oversimplifications.
In theory, the Criminal Justice System should be preoccupied with the truth. Criminal Law, in essence, is attributing a penalty (prison, fine, death, etc.) to an act (to kill, to rob) described by law as a crime. In that regard, then, one could only suffer said penalty if they actually committed the act that the law described as being a crime.
Where does truth come into place here?
To investigate if something happened in the world of facts (the real, concrete world) is essentially a search for truth, which to me is very telling of Higuruma's choice in becoming a criminal defense attorney.
In an unfair system in which 99% of people are convicted, it'd make no sense for this man to become a prosecutor. The prosecution is already benefiting from the system, considering the way the scales are tipped. That's a given.
But regarding the judgeship, things become more interesting. In a fair criminal justice system, the judge is forbidden to engage in probationary activity (which means, basically, that the judge cannot search for evidence, investigate or look for witnesses, he can solely analyze what the defense and prosecution bring to him in order to give a verdict — the judge does not engage in the most important activity in finding the truth).
Why can't the judge do that?
Because when the presumption of innocence is in place, anyone is presumed innocent until proven guilty, ergo, if there is not enough evidence to convict, the person must be acquitted. If the judge engages in that activity, they'd be taking on the prosecution's job — to prove the occurrence of a given criminal act. We have separate places for judging and prosecuting for a reason.
Tumblr media
The scales are already in favor of the prosecution (they literally have THE STATE’S aid ikn the form of police forces to investigate and taxpayer money to foot costs during criminal lawsuits), so anything that might end up harming or weakening the presumption of innocence is strictly forbidden, including having the judge engage in probationary activity. If the lack of evidence is enough to acquit someone, then having the judge searching for evidence automatically harms the presumption of innocence, because if there is not enough evidence to convict someone, the judge MUST acquit.
In that scenario, then, the best place for someone who wants to search and defend the truth against unfairness is the Defense stand, clearly.
Tumblr media Tumblr media
Everything said up until now about how the criminal justice system should work is just the theory, however. The reality of it is far sinister. The criminal justice system is a machine perfectly conceived to chew out those who fight for fairness, because fairness is not one of its main goals. It's main goal is serving as an instrument of power (in the most Foucaultian sense of the word) and control over citizens and, to some degree, appease collective concerns about crime rates and violence by making examples out of people, whether they're guilty or not (I could go on a tangent here for hours about the criminal justice system, capitalism and protection of private property by the state, but let's not do that, lol).
That's why Keita's trial is the perfect storm to break Higuruma's psyche so deeply. All the systematic unfairnesses that exist in the Japanese Criminal Justice System chomp away his ideals — one might say, what constitutes the very core of who he is — and unceremoniously spits it right back in his face.
Independent defense lawyers are systematically in a worse position regarding resources to gather evidence in their client's favor; it's easier to convict someone who's already under the gavel than to start a new investigation on somebody else and spend even more taxpayer money; to convict a person whom the people deem as guilty soothes the public opinion regarding how well the criminal justice system actually works to "keep society safe from these foul criminals" (not human beings); the appeal is a limited resource in most criminal justice systems, so after one gets their innocence verdict overturned, to get it back is extremely hard.
Everything worked perfectly to break every inch of Higuruma's ideals. It's no use for you to be the only one willing to stare truth in its eyes if everyone else looks away because it's more convenient to let the unfair gears keep turning the way they do. You'll give yourself to unnecessary suffering meanwhile nothing ever changes. This could even help draw a parallel between Higuruma's and Geto's fallouts: to realize how broken the system is, how you can't break a wall with the toy hammer the wall builders give you, and how lonely/depressing/infuriating of an experience it is to realize all this and still know there is absolutely nothing you can do.
The game is rigged, and if someone ever so chooses to not play by those rules, they're viciously punished.
Now that we've gotten to the breaking part, let's see how it manifests in Higuruma's own cursed technique and domain expansion.
The broken idealist and the cynicism
Someone had made an amazing post about how Higuruma's domain expansion was a perfect demonstration of his own cynicism at the moment his abilities were awakened, but I couldn't find it! So OP, if you by any chance end up reading this, HMU, because what you said will be featured here. (Edit: found it. Thanks, Eugie! The post can be accessed here, and @wolke17 made a deeper analysis after it, take a look at their profile)
In order to talk about Higuruma's cynicism stemming from his disappointment with the criminal justice system, we need to talk about his domain, so that's what we're gonna do now.
In his domain expansion, we meet his shikigami, Judgeman, who is an all-knowing creature responsible for giving off the verdict at the end of the debates between the two parties. According to Higuruma, Judgeman knows absolutely everything about someone's life the moment they enter his domain.
All is well up until now, isn't it? Hm, not so much. There are some very serious philosophical conundrums to having an all-knowing being bestowing judgment (skeptical catholics went crazy over this for many centuries).
Think about this: in a Courtroom, we have a judge who needs to get to know the facts, and is presented with two different hypotheses about the facts (prosecution and defense), for which the evidentiary activity (collecting evidence) is needed to support one hypothesis or the other. Given that we abide by the presumption of innocence, you don’t even have to prove the defense’s hypothesis to get an acquittal, as long as the prosecution one isn’t proven beyond a reasonable doubt.
What’s the issue with having a judge that is omniscient?
First off, why would two hypotheses need to be confronted if the judge already knows the answer — if the person did or did not commit the crime?
On another note, now going into more of a “well he’s just judging based on the allegations”, it gets deeper. We have a judge that knows what happened, but simply decides based on the parties arguments. This is a huge issue because firstly, it obliterates the value of truth in the justice system — if criminal law is attributing to a particularly reprehensible action a penalty, and judgeman knows if that action took place or not, yet doesn’t decide according to what happened, but according to who best defends their point of view, it annihilates the very own reason for collecting evidence, the reason that a judgment needs to take place and the reason for criminal law even existing.
In Higuruma's domain, then, truth becomes the least important thing. In there, who has the better argument wins the debate. The judgment that happens within Deadly Sentencing is not about truth, it’s about the game's rules (or, more specifically, his domain's rules) and who plays them better, which makes it all the more ironic that Higuruma sees so much “potential” in the Culling Games due to its rules and established mechanics.
Tumblr media
In a courtroom setting, having an omniscient judge is always, in any scenario, a cynical game of wits, and it fits perfectly with the philosophical fallout Higuruma experienced after Keita's conviction. His perspective got switched from "who deserves to win according to the truth" to "who plays the game better". He lost faith in the criminal justice system, and to a deeper degree, he lost faith in fairness in the world as a whole.
And that's why we can arrive at the conclusion that Higuruma is, in essence, a "broken idealist" character: he's not pandering to the idea that "the winner should be the one who plays the rules better” because he truly believes it; he's doing it out of resentment, because he got time and time again punished and was subjected to a hell of a lot of suffering for upholding his own ideals of truth and fairness. He's not acting, he is reacting to being unraveled and broken the way he was.
It also shows in his discourse regarding the weak, and the way he tries to place himself above what he dubs “the ugliness of people”, as the only one who sees the truth (“darkness is only darkness / people are ugly”). It’s a mirror: he experienced his own helplessness (or weakness) with Keita’s conviction, so in an effort to try and protect whatever is left from his own psyche, he’s actively denying how helpless he really feels by putting himself above the truly weak”.
In the end, however, Higuruma kept his idealistic essence alive instead of giving himself over to the story that he told himself as a defense mechanism, unlike Geto, which is why it was possible to bring him back.
Even broken, he remained an idealist at heart.

Eisteddfod Chairs: Pick Your Winner!
It's almost June! Nearly time to reveal the 2023 Chair! So come, gather round Tumblrs, let me tell you of the furniture-based customs of my people
So Wales has been celebrating Eisteddfodau (festivals of poetry, music, and disco dancing), in some form or another, since at least the 1100s, when Lord Rhys of Dinefwr had one all formal-like and made it into a big fun party and that. The word basically means 'sitting place', and probably refers to the way people in summer would gather round the twmpath in the village to listen to bards that passed through and drink mead and shout 'hurrah!' a lot. Amazingly, this is not where the Chair Thing comes from.
Part of Welsh history is the Bardic Age, and it was custom for bards to travel the country and visit the courts of assorted gentry types (also normal people's houses and taverns and twmpaths but let's stay on topic) and play for them. If the lord paid well, great; if not, the bard would write a Super Mean Song about them and sing it everywhere, so they were pretty well treated.
But if they were particularly good, rather than making them play for the WHOLE meal, the lord would offer them a chair at the table to join in the feast as a guest, rather than a worker, and THAT is where the Chair Thing comes from.
Anyway that's preamble to say that every year in the biggest Eisteddfod of all - the Eisteddfod Genedlaethol - the highest honour awarded goes to the Prifardd - the bard who writes the winning cywydd (super complex Welsh poetry WE DON'T HAVE TIME TO EXPLAIN ALL OF THIS). And the prize for writing the winning cywydd is that you are awarded, you guessed it, the Chair.
Now these Chairs (capital C, please, we like a bit of Fantasy Novel Capitalisation and for this cultural reason I will never understand people who complain about it) are unique. They are thrones. They are carved each year by one chosen carpenter, who crafts a one-of-a-kind Chair with symbolism and that, never to be replicated. They usually have the year carved on, but otherwise, they vary wildly in aesthetic and symbolism. In a No Award year (because Eisteddfod judges don't subscribe to the Western idea that there HAS to be a first, second and third place; if no one is good enough there is no award, and I have seen choir competitions for seven year olds where there was no first or third place but there were two choirs in joint second), the Chair is sent back to the carpenter who carved it, and they get to keep it. In a year where the bard died before the ceremony, it is draped in black, and given to next of kin.
(That has only happened once. RIP Hedd Wyn, 1887-1917. Also the only reproduced Chair; the original, known as the Gadair Ddu (the Black Chair) is on display in his family home, but a 3D printed replica has been made for display by Amgueddfa Cymru)
BUT THEREFORE a big part of Eisteddfod fun is seeing what the Chair will look like this year. Traditional ones, see, we tend to think look like variants of this:
Tumblr media
(Apologies for the substandard attempts at alt-text; I have no clue how to describe these properly)
This one is from 1896. The phrase "Y gwir yn erbyn y byd" means "The truth against the world", and was included in a lot of old ones. Modern ones tend to incorporate the druidic symbol for awen ("poetic inspriation") instead. Some of these incidentally turn up in lil' chapels and that about the country.
But actually even the old ones were mad different, look; clockwise from top left, these are y Gadair Ddu (1917), 1876, 1926 (when the carpenter was Chinese and enjoyed the cultural fusion), and 1908.
Tumblr media Tumblr media Tumblr media Tumblr media
Still the same theme, though, but in the modern day the carpenters are all off the shits! They're all over the place! Fuck the rules! And I have Opinions.

This is, bar none, the funniest fucking completely unironic shit published by a legitimate news outlet:
In recent months, orcas in the waters off the Iberian Peninsula have taken to ramming boats. The animals have already sunk three this year and damaged several more. After one of the latest incidents, in which a catamaran lost both of its rudders, the boat’s captain suggested that the assailants have grown stealthier and more efficient: “Looks like they knew exactly what they are doing,” he said. Scientists have documented hundreds of orca-boat incidents off the Spanish-Portuguese coast since 2020, but news coverage of these attacks is blowing up right now, thanks in part to a creative new theory about why they’re happening: cetacean vengeance. Now that’s a story! “The orcas are doing this on purpose,” Alfredo López Fernandez, a biologist at the University of Aveiro in Portugal, told LiveScience last month. “Of course, we don’t know the origin or the motivation, but defensive behavior based on trauma, as the origin of all this, gains more strength for us every day.” López Fernandez, who co-authored a 2022 paper on human-orca interactions in the Strait of Gibraltar, speculates that a specific female, known to scientists as White Gladis, may have suffered a “critical moment of agony” at the hands of humans, attacked a boat in retaliation, and then taught other whales to do the same. Whatever the truth of this assertion, White Gladis and her kin have quickly ascended to folk-heroic status on the internet. “What the marine biologists are framing as revenge based on one traumatic experience may be a piece of a larger mobilization towards balance,” the poet Alexis Pauline Gumbs tweeted before referring to the killer whales as “revolutionary mother teachers.” Media figures and academics are expressing solidarity with their “orca comrades” and support for “orca saboteurs.” One widely circulating graphic shows a pod smashing a boat from below, above the words “JOIN THE ORCA UPRISING.” (You can even purchase it in sparkly sticker form.) Yet all of this fandom and projection tends to overlook important facts: First, these orcas are likely to be playing with the boats rather than attacking them, and second, if one insists on judging killer whales in human terms, it’s plain to see they aren’t heroes but sadistic jerks.
A shark wrote this.
The recent incidents, none of which has resulted in any injuries to humans, are simply the result of curiosity, Monika Wieland Shields, the co-director of the Orca Behavior Institute in Washington, told me. A juvenile may have started interacting in this way with boats, she said, and then its habit spread through the local community of killer whales. Such cultural trends have been observed before: In the Pacific Northwest, orcas have been playing with buoys and crab pots for years; in the late 1980s, one group of orcas there famously took to wearing salmon hats. Is ramming boats the new donning fish? Shields believes that theory makes more sense than López Fernandez’s appeal to orca trauma. White Gladis shows no physical evidence of injury or trauma, Shields told me, so any “critical moment of agony” is purely speculative. Also, humans have given orcas ample reason to retaliate for hundreds of years. We’ve invaded their waters, kidnapped their young, and murdered them in droves. And yet, there is not a single documented instance of orcas killing humans in the wild. Why would they react only now? And though recent events may fit the story of these orcas’ being anti-colonial warriors, you can’t just anthropomorphize animals selectively. What about all the other “evidence” we have of orcas’ cruelty, or even wickedness? Scientists say they hunt and slaughter sharks by the dozen, picking out the liver from each one and leaving the rest of the carcasses to rot uneaten. Orcas kill for sport. They push, drag, and spin around live prey, including sea turtles, seabirds, and sea lions. Some go so far as to risk beaching themselves in order to snag a baby seal—not to consume, but simply to torture it to death. Once you start applying human ethical standards to apex predators, things turn dark fast.
Oh no, they gleefully torment other animals for sport!! Does this species deserve to have any redeeming qualities???
Perhaps #orcauprising was inevitable. Humanity does have, after all, a long history of freighting cetaceans with higher meaning. Moby Dick is, among other things, a symbol of the sublime. The biblical whale—or is it a large fish?—that swallows Jonah is an instrument of divine retribution, a means of punishing the wicked in much the same way some have framed the boat-wrecking orcas. The whale 52 Blue, known as the loneliest whale in the world because she speaks in a frequency inaudible, or at least incomprehensible, to her brethren, has become a canvas for all shades of human sorrow and angst. Orcas in particular have long been objects of both fear and sympathy, in some cases with an explicitly anti-capitalist tint. The 1993 classic Free Willy centers on a conniving park owner’s scheme to profit off of the bond between a child and a young killer whale. And more recently, the 2013 documentary Blackfish chronicles SeaWorld’s real-life exploitation of captive orcas. The “orca uprising” narrative fits neatly into this lineage. In our present era of environmental catastrophe, Shields told me, it’s appealing to think that nature might fight back, that the villains get their just deserts. But projection and anthropomorphization are only shortcuts to a shallow sympathy. Orcas really are capable of intense grief; they are also capable of tormenting seal pups as a hobby. They are intelligent, emotionally complex creatures. But they are not us.
Someone paid this dude actual money to conclude that Orcas aren't human.
In conclusion:

Welt Yang - teaches you!
This arrangement arose from the time you asked for fashion advice from the man. He was someone you went to regardless of topic for those easily digestible explanations, so why would this be any different?
Welt meets your expectations and exceeds them as per usual. The outfits he creates with you best compliments your form - seamlessly incorporating your preferred style and elevating it. Slowly but surely, your wardrobe is impacted by his influence. With the clothes he bought alongside you and various accessories that he personally teaches you how to properly wear, it's hard to find an article not linked to him in some manner.
It's important for him to be subtle with his ulterior motives. Teaching you the basics of cohesive and practical dressing is important, but the opportunity to dress you up with little resistance is unbelievably tempting. For that to occur, Welt ensures to spread his influence at a snail's pace, always course-correcting based on your responses. Slow and steady does win the race for a reason.
Ambiguity is imperative to him. Maintaining the image of the resident wise mentor figure as he carefully guides you into making the first move is key to avoiding any…unnecessary actions. Observant ones would simply raise an eyebrow at it all, having no concrete proof of any questionable behavior on his part, and the more oblivious would see him as nothing more than a doting mentor. The perverted would recognize their kin, but to judge would be hypocritical.
By the time he has you willingly modeling clothes that show more than they hide, you'd be firmly in his grasp. It'd be best for you to be ignorant of the depths of his emotions and simply accept the sanitized version. It's more romantic, you see; your long-time crush reciprocating your feelings is a more heart-warming story than one of a perverted man manipulating you.
Ignorance is bliss, just leave the burden of knowing the unsavory truth to him.

Kafka - infects you!
The Stellaron Hunter is notoriously elusive in a variety of manners. She is as mysterious as she is dangerous, unpredictable as she is fearless, confident as she is hypnotic - to be caught in her web is inevitable.
It's hard to pin-point when exactly your unconscious conceded self-expression into her hands. Maybe it was gradual, your control over your clothes slowly crumbling as her web tightened around you. Maybe various coats encroach upon your wardrobe the longer she trespasses upon your life. Maybe you gravitate towards clothes she'd approve the more she looks over you out of fear, validation, or a sickening mix.
Or maybe, it happened overnight - either way, your wardrobe is now infested with coats.
Some come in pairs, intended to be worn as a matching set, and others have clear owners. Some are still warm, and others emanate a soft scent. All make you sick, and none you can avoid.
To free yourself now is nothing more than a far-gone dream. Every movement entangles you further into her intoxicating embrace.
She calls it beauty, you call it cruelty.
No matter what you did or said, nothing could possibly faze the woman. Even now, Kafka smiled softly, her plush lips glistening with the motion yet her eyes reflected that indescribable emotion. It’s too complicated and intense to simply be blank, yet too unfeeling and unnerving to be anything else.
“Go on,” she cooed, her words wrapping around your form akin to the coat hanging off your shoulders, “give me a twirl~”
Kafka’s ‘request’ was punctuated with a little handwave, her silver rings catching the dim lights. It was clear all her focus was on you - her little model wearing nothing but a custom-tailored coat - as she sipped her wine lazily.
So you twirled. You ignored how the cool night air caressed your clammy skin. You ignored how her scent permeated your skin and clogged your nose. You ignored how her coat brushed against your bare skin as if she was behind you, caressing your skin. You ignored the glimpses of your reflection and Kafka’s pleased expression. You ignored how she hummed in appreciation.
You ignored the burst of pride within you.
“Keep it,” she drawled as she swirled her wine like a sommelier, “you’re quite the sight.”
You ignored the gentle waves of gratefulness that washed over your taut body.
More coats now occupy your closet, and more emanate a familiar soft scent.

Himeko - dresses you!
Knowledgeable, confident, and elegant - these words might as well be synonyms for the navigator of the Astral Express. She inspires with her words and actions, a role-model for all.
It’s hard not to feel a bit underwhelming when you’re next to her. Like a shadow beneath the fire, it was simply nature - the laws of physics at work. Some were just meant to be more radiant than others and you’ve come to terms with it. Yet, you never considered the possibility that the light would shine above you, gently casting away your shadowy covers.
Your closet was restructured carefully in her vision for you. It was hard to disagree with her when she was simply so radiant, washing away every one of your concerns with her warm touch.
Whenever you got dressed for the day, you could feel her guidance surrounding you - her radiance casting away the dullness that perpetually surrounded you. Her approving smile and warm caresses only certified how right you were to trust her; she would never lead you astray.
But Himeko did.
Her vision for you was a caged bird, a sight only she could enjoy.
She’ll water you with compliments whenever you comply with her vision, and appreciate how you blossom under her care. She’ll prune any unwanted behavior with a little punishment, and cultivate you back onto her desired path.
Every outfit you now wear has a rose somewhere - whether it be an accessory or embedded within your clothes. The soft yet bitter aroma of coffee permeated your very being like a permanent fragrance. But for Himeko, this was far from enough.
What good was an invisible cage? A sign unreadable by most? A collar with no owner’s name?
It was cute when you didn’t understand her vision, yet imperative that others do. So she’d personally dress you in clothes that emulated the spirit of her own, occasionally giving you her own pieces to wear.
Your cute concerns would be washed away with a warm smile and an even warmer touch. Don’t you want to boost your confidence? What better way than to dress like her - to look like her?
One day, it’ll be her coat she helps you wear properly, even adjusting it throughout the day with a genial smile. Another day, it’ll be a matching golden rose choker she snaps onto your neck.
But her favorite look on you is a red toga dress with a white lining with the high slit on the right-side. Together, you’d match as perfect inverses of each other. Some days, she’d give you the accompanying black mini-skirt, gently forcing you to sit on her bed as she slipped it onto your legs. Yet, most of the time, your legs were exposed to Himeko’s delight. Her hands would rest against your thigh like another accessory, and caress your skin ever so gently until it was rubbed raw. There was no need to hide your beauty from her, she’d reason, it was just the two of you here.
Her vision was lost on you, but you were happy -  happy to finally shine as brightly as your beloved navigator. It didn’t matter - or perhaps register - that your only appreciator was Himeko.
