ENDSARS Warehouse Looting: The Legality and Morality of Public Parade of Suspects

It is no longer news that Nigeria, with a population of about 200 million people has been described as the poverty capital of the world. With people living on less than one dollar per day, life is extremely hard for most people inhabiting this most populous black country of the world. The nation just exceeded India with the largest rate of people living in extreme poverty. This is according to the August report of borgenmagazine.com.

With enormous abundance of mineral resources deposited in virtually all the states in the country, such as crude oil, bitumen, natural gas, gold, etc., we have no reason to be poor at all. In fact, Nigeria is the 8th largest exporter of crude oil in the world according to the 2019 report of worldstopexports.com. Apart from this, we have large expanse of arable land in all states of the federation where cultivation of crops is highly viable. The irony however is that many Nigerians are living like the proverbial son of a butcher who feeds on bones. 

Events leading to the lockdown since March this year has aggravated the level of lack and hunger consciousness among Nigerians. Many people can no longer afford decent meals anymore. The people have been pauperized by the outbreak of the Covid-19 pandemic. This is largely because most people were asked to stay indoor to prevent the spread of the virus because it is believed that the virus spreads fast when people have contacts with one another. Curfews were imposed in the different states in the country in a bid to curtail the transmission of this deadly virus.

There were rumours flying round about the plan of the government to send money into individual bank accounts of all Nigerians as a measure to reduce the level of hardship caused by the lockdown but I am yet to receive any credit alert on my phone and most Nigerians also testified that they got no reprieve whatsoever either monetarily or in food supply.

During the lockdown, many well to do Nigerians, corporate organizations and religious institutions made handsome donations of palliatives to help alleviate the suffering of the people but unfortunately, many of the palliatives were kept under lock and key in different warehouses. There were reports that some politicians hijacked the palliatives meant for the poor Nigerians for their selfish gain. Some of them plan to use those items to boost their political career by donating to people of their own constituency and political leaning so that they can obtain cheap popularity and perhaps garner substantial votes during the next general election.

There were politicians who also kept those palliatives meant for the people in their warehouses till the time of their birthday party! What a shame! How can you expect people who are poor and vulnerable to wait till your birthday celebration before they can get materials which rightfully belong to them? I am sure some of those food palliatives would have expired before the birthday party. Some state governors also gave unjustifiable reason for keeping the palliatives. They claimed that they were waiting for the second wave of the Corona virus before they start sharing them! Why are they expecting the second wave of the deadly virus when we are still dealing with the first and praying for the flattening of the statistical curve of the pandemic?

Another event later surfaced after the ease of the Covid-19 lockdown— the ENDSARS protests. The protest started in a peaceful manner with many Nigerian youths calling for the abolition of the Special Anti Robbery Squad (SARS) because of the harassment and embarrassment many of them face from this police department on a daily basis. Nigerians were treated like second class citizens in their own country by these power drunk police officers who find it a pleasurable thing to trample on the fundamental human rights of the average Nigerian.

The protest was spread across the country and it was very peaceful till hoodlums found a mischievious way to turn the protest to a riot thereby causing arson and anarchy in different places. Public and private properties were destroyed and many items stored in warehouses looted. One major factor that led to the truncation of the protest was the unfortunate attack of peaceful protesters at the Lekki toll gate in Lagos. It was reported that the army attacked peaceful protesters who were only carrying the Nigerian flag and singing the national anthem, killing some of the protesters in the process while some were also injured— https://www.amnesty.org/killing-of-endsars-protesters-by-the-military-must-be-investigated. 

The criminal elements seized the moment of chaos to perpetrate their wanton destruction of lives and properties. Public and private properties worth billions of naira were destroyed and vandalized. It is worthy to note that some Nigerians who had been victims of the first lockdown and the second one got wind of the fact that the palliatives meant for them since March were kept in different warehouses in the country. They seized the moment to open the warehouses and took away many food palliatives and some other items. This singular act shows the level of poverty and hunger in the land. What would make people open a warehouse in broad daylight to go steal food palliatives if not hunger? As a matter of fact, the looting of the warehouses was just a physical and psychological reaction to the years of oppression and suppression of Nigerians as a result of poverty and bad governance. The ENDSARS protest was therefore not just about an end to that brutal police formation, but it is a call for end to bad governance and poverty in the land. It is a misnomer for Nigerians to be living in abject poverty in the midst of plenty. The Covid-19 palliatives should have been distributed to the people as at when due by the state governors. Does it mean that looting and plundering should be encouraged? That’s not the point.The fact is that the people “took“ what rightfully belong to them. Whatever the people must have taken from the Coalition Against COVID-19 (CACOVID) warehouse, I suggest they are pardoned and given a second chance. If corrupt politicians who looted billions of naira from our commonwealth get respite and a reprieve, these poor Nigerians accused of looting the warehouses for food palliatives deserves pardon. However, other properties stolen by the hoodlums can be recovered from them and they too can be pardoned and given civic orientation on how to become better citizens. In my opinion, if the members of terrorist groups gets a second chance, these poor Nigerians too should be pardoned.

Moreover, the act of parading the CACOVID palliatives looters before the public and the media is rather unfortunate. In my opinion, these people should have been given fair hearing in a court of competent jurisdiction and allowed access to a lawyer as Nigerian citizens. They are innocent till proven guilty —that’s the position of the law. According to Mr Olawale Apanisile, “lawyers say parading of suspects is unconstitutional and damaging to the person involved. In his submission, he further stated that parading suspects before the public and media as criminals before trial is a violation of Section 34(1) and 36(1) of the Constitution of the Federal Republic of Nigeria, 1999.

With the tripod stand of legal framework and the standpoint of morality and humanness, I hold the view that those warehouse looters should not be openly paraded before the public and the media since the amended Constitution of the Federal Republic of Nigeria of 1999 declares every person charged with criminal offence innocent until they are convicted by a court of competent jurisdiction.

Kangra Fort

Kangra is about 18 Km from Dharamshala. Kangra fort was built in the 4th Century BC and was a residence of the Katoch Dynasty. The Fort is constructed on a cliff and once closed was a very safe fort in historical times. The fort was formally known as Nagarkot Fort in historical times. The Fort was ruled by Maharaja Ranjit Singh and Gurkhas too. After the 1846 Sikh War, the British had control over the fort. The biggest earthquake of 1905, hit the Kangra valley and this is when the Kangra Fort was damaged. Still today you will get to see the ruins in this valley. The ruining Fort speaks of the fascinating glorious battles in history and is worth visiting. Do plan to visit religious places like Brajeshwari Devi temple and Kheerganga in Kangra.    It seems that the coronavirus, named Covid-19 has spooked the world. It has become the bogeyman of the 21st century. At first, it frightened the medical profession at the way it rapidly spread and killed people. They, in turn, spooked the governments all over the world to take drastic measures to go into various degrees of lockdown. It has been nothing but a socio-economic disaster for most countries. And the way the media continues to report this virus infection is causing further unnecessary panic, chaos and confusion among the public. In my previous article titled "Corona- The Making of the Bogeyman", I pointed out how a spooked mind is incapable of rational thinking. I also pointed out how a bureaucratic mind is also incapable of such thought. So it is clear to me that a frightened bureaucratic person would be doubly incapable of making any rational decision. This fact is evident from what we have seen in the bureaucratic action taken by governments all over the world. What dismays and disappoints me most is the medical profession and the role it is playing. It is supposed to look after the physical and mental health of people yet is helping the government to create people's life more miserable. They do not seem to appreciate the fact that saving lives at all cost is not the only thing that matters. One has to take into account the socio-economic costs into our decision making; otherwise, our actions become counterproductive and irresponsible. Millions of people have lost their jobs, and millions of businesses have gone out of business. How can we ignore the mental and physical side effects on the population of government bureaucratic action which creates poverty? Poverty becomes fertile ground for an increase in crime, violence, drug abuse and suicides etc. Please remember that the brunt of all these measures is born by private individuals, not government employees who are mostly financially unaffected. In my mind, I regard the lockdown as an inhumane action. To lockup people living in tall towers for six weeks is like sentencing them to solitary confinement in their cells. Also, how can we justify locking up people on a cruise ship for days for no fault of their own, just because they have a case of coronavirus on board? Lockdown can only be justified if the measures we take kills or eliminates the virus; otherwise we are only grabbing the tiger by the tail. If we examine all the measures we have taken so far, we will find that they are panic measures. They do not eliminate or kill the virus. The lockdown only slows down the spread of the virus. It is the nature of all virus infections to spread. So once we lift the lockdown, this virus is going to spread. The infection curve has to rise. We have to appreciate the fact that this coronavirus is here to stay, and we will have to learn to live with it in the same way as we are doing with the influenza virus. So what does the future hold for us? Do we go into lockdown every time the infection curve rises? Do we shut down our schools and workplaces whenever someone is tested positive? One can see that all this testing for the virus in the population may be academically desirable; however, the way the media reports it should be a matter of concern for all of us who are trying to improve our mental health. Perhaps we can learn from our animal friends how they manage to live peacefully with all the predators around them since the beginning of time. If we look at the buffalos and the lions, we see that the lions spook the buffaloes by chasing them. Once the lions catch the weakest one, the buffaloes stop running. They start grazing in a relaxed way, knowing that the lions will not be attacking them until they are hungry again. They do not remain spooked. I regard all the viruses lurking in our atmosphere as predators waiting to pounce on us like the hungry lions and tigers. Usually, a healthy individual will resist a virus infection depending on the strength of one's immune system. But once any mental or physical factors weaken our immune system, we can become prey to any such virus. Thus the onus is on every individual in society to maintain a level of fitness which will protect the person. However, we have do-gooders in society who want to save us from ourselves like the medical profession and the government. They want to show us and prove to us that they can save human lives, no matter what the cost. There is, of course, a political motive in all this. No one wants to die, so no one is going to object to someone who is going to protect us. How can anyone object to such a noble cause when one is saving lives? Politicians and the medical profession become our heroes, and they get our votes. Yes, it is relatively easy to save lives and become heroes if we think in a bureaucratic way and ignore the negative consequences of our action. But there are higher responsibilities attached to the jobs of our medical and political leaders than just trying to save human lives if they cared to think about Suppose you are in charge of a rescue boat overloaded with people. You know that if you take one more person aboard, the boat is going to tip over and sink. There are people in the sea still begging to be rescued. Do you have a choice? Please think. Will you feel like a hero? Do you still believe in saving life at whatever the cost? As I see it, we have to come to terms with the coronavirus and treat it in the same way as the influenza virus. The world cannot afford to remain spooked. In my mind, there is no such thing as the future. The future is what we create through the actions we take in the present. If we take no action now, our present becomes the future.

In early March, India's health minister Harsh Vardhan declared the country was "in the endgame" of the Covid-19 pandemic.

Mr Vardhan also lauded Prime Minister Narendra Modi's leadership as an "example to the world in international co-operation". From January onwards, India had begun shipping doses to foreign countries as part of its much-vaunted "vaccine diplomacy".

Mr Vardhan's unbridled optimism was based on a sharp drop in reported infections. Since a peak of more than 93,000 cases per day on average in mid-September, infections had steadily declined. By mid-February, India was counting an average of 11,000 cases a day. The seven-day rolling average of daily deaths from the disease had slid to below 100.

The euphoria at beating the virus had been building since late last year. Politicians, policy makers and parts of the media believed that India was truly out of the woods. In December, central bank officials announced that India was "bending the Covid infection curve". There was evidence, they said, in poetic terms, that the economy was "breaking out amidst winter's lengthening shadows towards a place in sunlight". Mr Modi was called a "vaccine guru".

My personal opinion:

I think it is a shame that corona has so much impact on life, not only in Belgium but also in India. As we have read in the article they have failed to avoid a second wave. Corona has caused many deaths all over the world. I really hope that the numbers in India will go down. India was in the grips of a devastating second wave of the virus and cities were facing fresh lockdowns. For one, India should learn not to declare victory over the virus prematurely, and it should put a lid on triumphalism. People should also learn to adapt to short, local lockdowns in the event of the inevitable future spikes of infection.
