No spike in pot-impaired driving after legalization: police
No spike in pot-impaired driving after legalization: police No spike in pot-impaired driving after legalization: police https://ift.tt/eA8V8J
VANCOUVER — Canadian police have not seen a spike in cannabis-impaired driving one month since legalization, but there needs to be more awareness of laws around storing marijuana in vehicles and passengers smoking weed, law enforcement officials say.
The Canadian Press canvassed police forces and provincial and territorial Crowns across the country and while some said it was too early to provide data, others said initial numbers and anecdotal impressions suggest stoned driving isn’t on the rise.
“Even before the legislation we were catching a lot of high school kids because marijuana has seemed to be kind of mainstream forever,” said Sgt. Joe Cantelo of the Kennebecasis Regional Police Force in New Brunswick.
“In our department, there’s certainly no rise in impaired driving by (marijuana).”
Police forces in Vancouver, Regina, Newfoundland and Labrador, Yukon, Truro, N.S., and Kensington, P.E.I., all said they hadn’t noticed a significant change in driver behaviour since pot was legalized on Oct. 17.
ONE TOKE OVER THE LINE: Many Canadians are driving high, according to new StatCan cannabis data
CANNABIS 101: Bud basics for beginners
Cannabis legalization crunch time: Handling of high drivers, border crossers still being ironed out, feds say
Liberals approve first saliva screening roadside test for marijuana
Cantelo said there were three impaired driving charges in his community over the last few weeks and they were “strictly older adults with alcohol.”
Manitoba RCMP conducted three cannabis-impaired driving investigations in the three weeks since Oct. 17, compared with one such investigation in the three weeks prior to legalization. There were about 50 alcohol-impaired driving charges laid during each of the same periods.
Const. Jason Doucette said Vancouver police have issued 18 violation tickets under provincial cannabis laws since Oct. 17. The majority of traffic-related tickets were issued because pot was not properly stored or passengers were consuming weed in the vehicle.
During one roadblock campaign, he said Vancouver officers noted six events specific to cannabis impairment, which led to four 24-hour driving suspensions.
“As expected, we haven’t seen a dramatic increase in cannabis-related offences,” he added.
Provinces and territories established their own laws around cannabis storage in vehicles, but generally weed must be in closed packaging and out of reach of the driver. Manitoba took a step further and required pot to be in a secure compartment, such as the trunk.
In Newfoundland and Labrador, there have been at least six charges related to open or accessible cannabis in vehicles, RCMP said.
Obviously drivers can’t consume weed, but many provinces, including British Columbia and Ontario, have banned passengers from toking as well. A joint-smoking passenger in Saanich, B.C., was slapped with a $230 fine a day after legalization, police said.
As for cannabis-impaired driving, some police detachments and Crowns don’t track it separately from impairment caused by other drugs or alcohol.
The B.C. Public Prosecution Service said it doesn’t classify impaired-driving charges by intoxicant, but in the three weeks after legalization it approved 43 such charges, while in the three weeks before legalization it approved 52 charges.
Toronto police said they’d had 58 drug-impaired driving incidents in 2018 to date, including two after pot legalization, and 824 alcohol-impaired incidents. That’s compared to 60 incidents of drug impairment in drivers and 1,154 instances of alcohol impairment in all of 2017.

In Halifax and the Northwest Territories, there were no cannabis-impaired driving arrests in the three weeks before or after legalization, while in Nunavut, there were five general impaired-driving charges during both periods.
Sgt. Joyce Kemp said Quebec provincial police made 252 arrests for drug-related driving impairments between Jan. 1 and Sept. 17 of this year, compared to 319 for all of 2017 and 310 in 2016.
“A lot of people seem to think this is something new,” she said. “But the numbers speak (for themselves), we’ve been doing this for quite a few years now.”
Some police detachments, including Edmonton, Regina, Yukon and Nunavut, have purchased or are planning to purchase the federally approved roadside saliva test, the Drager DrugTest 5000, but have not used it in the field. Others have decided to rely on standardized field sobriety tests and drug recognition experts for now.
Kyla Lee, a Vancouver-based lawyer who wants to file a court challenge of the Drager test once it’s used on a driver who wishes to dispute it, said she hadn’t heard of it being used anywhere yet.
She said she’s impressed so far with the police approach to enforcement, particularly in B.C.’s Lower Mainland.

“I was worried when the law changed … that this sort of panic around cannabis-impaired driving was going to lead to a number of false arrests and bad investigations. That’s not what I’ve been seeing,” she said.
There still needs to be more awareness among Canadians, especially youth, of the dangers of cannabis-impaired driving, said Andrew Murie, CEO of Mothers Against Drunk Driving Canada.
“The problem we were having, especially with young people with cannabis, is they didn’t see cannabis as dangerous, (we) didn’t see them upholding the same type of behaviours they would around alcohol,” he said.
“We had a problem of perception that it’s less dangerous and that’s the biggest battle we’re fighting right now.”

Cannabis is now legal in Canada! What’s still illegal? (Part III)
Things that are still criminal after the legalization of cannabis in Canada
As of October 17th, 2019, Bill C-45 (Also known as the Cannabis Act) came into effect, legalizing the recreation sale and use of cannabis products in Canada. Indeed, Canada is now the largest legal marketplace for cannabis in the world! That being said, there are still plenty of things surrounding cannabis use in Canada that are still illegal.
Continuing from our previous article, we explore several things related to cannabis that are still illegal in Canada:
Distribution of Cannabis to minors.
Careful who you pass that joint to! It is still illegal to provide cannabis products to those under the provincial/territorial age of majority (18 in Alberta and Quebec, 19 in all other provinces and territories. Note that this says ‘provide’ and not ‘sell’. If you’re of the minimum age of majority and share cannabis products with a younger friends, you could face criminal charges punishable by up to 14 years in prison! Minors found carrying less than 5 grams of dried cannabis will not be criminally charged, but will be subject to seizure of the cannabis, notification of their parents/guardians, and could face penalties similar to underage possession of alcohol or tobacco.
Driving with a blood THC content greater than 2ng/ml
You may have seen signs posted recently that read “drunk or, same rules apply” That’s because, much like restrictions on alcohol consumption while operating a vehicle in an effort to stop drunk driving, there are new laws specifically addressing blood THC content restrictions to curb those that might be driving while high. If you’re caught driving with a blood THC content greater than 2ng/ml, you could be charged with impaired driving – now considered a ‘serious criminal offense’ in Canada with the passing of Bill C-46. Click here to read more about these new laws regarding cannabis use and driving in one of our earlier series of articles.

Using cannabis and driving? Learn more about Bill C-46 (Part III)
Where there’s smoke there’s uncertainty: Details of Bill C-46
Today, as a continuation of our last article, we conclude our series on the legislation introduced by Bill C-46 with a discussion on the currently approved testing equipment.
The recently passed Bill C-46 amends laws in the Canadian Criminal Code pertaining to impaired driving offenses, in response to the upcoming legalization of Cannabis in a few weeks. The federal laws Bill C-46 amends will come into effect this December, but many lawyers have raised concerns that this overhaul of impaired driving laws may in fact be unconstitutional in that it opens up a real possibility of criminal charges being laid on sober drivers.
In this series of articles, we explored some of the issues Bill C-46 creates that you ought to be aware of.
Problems with actually measuring THC roadside.
Unlike testing for a driver’s blood alcohol content by using a breathalyzer roadside, driver’s blood THC levels will be measured with a saliva sample via a mouth swab. The most recent device for analyzing saliva samples that has been approved is the “Drager DrugTest 5000”. This equipment will be made available to local authorities all over the country, but local police forces will ultimately decide on what equipment they wish to use.
Although these saliva-screening devices have proven to be accurate and effective in the lab, they do have a fairly large problem when used roadside: they are likely to register false-positives when they get cold.
The optimal working temperature range for the Drager DrugTest 5000 is 4-40°C. While this isn’t a huge concern in more temperate parts of the country, this could prove to be an issue during our famously long and cold Canadian winters – especially in the prairie provinces and territories. This opens up the possibility that sober drivers who have never consumed cannabis products could face criminal charges if testing temperature conditions fall outside this range.
Furthermore, as we mentioned in our first article of this series, there is no scientifically agreed upon blood THC level to definitively indicate impairment. As such, these devices only quantify a certain metabolite produced by the body’s breakdown of THC to accurately estimate  blood THC levels – not actual impairment. In a statement released with the draft of the legislation Bill C-46 introduces, Ottawa indicated that the low level offense of having a THC blood concentration of 2-4ng/mL, was not created as a means to link a driver to impairment, but rather as a “precautionary or crime prevention approach”.

Edmonton police still undecided on marijuana roadside testing equipment
New Post has been published on https://cialiscom.org/edmonton-police-still-undecided-on-marijuana-roadside-testing-equipment.html
Edmonton police still undecided on marijuana roadside testing equipment
The Edmonton Police Support hasn’t resolved whether or not it will use a new roadside test to detect marijuana, once usage gets legal on Oct. 17.
Federal Justice Minister Jody Wilson-Raybould authorised the roadside exam to look at for drugs, named the “Drager DrugTest 5000” in August.  The saliva screening products will be utilised by police to exam for the major psychoactive agent in cannabis: THC.
The gear will be built offered to police forces across the state, while it will be up to law enforcement to make a decision what screening products they want to use.
Examine Extra: New roadside examination to detect cannabis coming to Canada
Edmonton’s Police Main Rod Knecht stated they have “very few” of the gadgets and officers will be testing them out. He extra there are a good deal of complications and there are considerations about its accuracy.
“This product does not work extremely very well in the chilly for a single detail,” Knecht explained Thursday. “It’s cumbersome. It’s complicated to use.”
“We know each individual time we use it we’re likely to get a not responsible plea,” he explained. “That’s going to plug up the courtroom method.”
Criminal protection lawyer Dale Fedorchuk also believes we are heading to see a backlog in the method, after drug-impaired driving prices are laid less than the new laws.
The precision of the exams and what they’re screening for will be central concerns in the courtroom method, according to Fedorchuk who thinks the first felony rates could be challenged all the way to the Supreme Court. He explained there is not more than enough scientific evidence out there to demonstrate how much THC will impair a human being.
“Because the regulation is new it’s likely to be analyzed,” he claimed. “That’s heading to choose a lengthy time.
“That could create a backlog of scenarios waiting for the enchantment choice to arrive down to decide what course judges should really go,” he extra.
Fedorchuk included right before a drug-impaired driving demand can be laid, blood or urine assessments may well be expected.
“Even the reality there is heading to be a blood desire or a bodily compound demand from customers could be problematic constitutionally,” he explained.

Edmonton’s law enforcement chief is hoping for much more possibilities for roadside testing products in the future. For now they will get ready with what they have.
“There will be some rising pains,” Knecht explained. “We’re about as geared up as we can be for Oct. 17.”
But Knecht will not have lengthy to assess the gadgets. His tenure as chief arrives to an close two months after legalization.
“I’ll be looking at from the sidelines,” he explained.

I know that there are many factors when car insurance is decided.. I understand the thing with age, sex, previous evidence that you are risk factor more accidents... however I was wondering because I have gotten into accidents when I had no insurance/the other person only had my name.. since this was all they had, was it till recorded somewhere, will this affect my future rates????...""
Can your health insurance company raise your rates after you get sick?
I've heard about pre-existing conditions and all, but what about getting seriously ill AFTER you have insurance? Let's say you're generally healthy, and already have heath insurance which you pay for yourself, at a reasonable rate. Then you get a long term illness, or get into a terrible accident, and need years of expensive care. Of course you keep your policy up to date... Can the company raise your rates by triple (or worse) if you get sick this way?""

It's not just some old beater, it's a car that I would definitely enjoy driving. It's a 1999 Chevy Cavalier with a bunch of modifications to it. I'm worried about what I will be paying monthly in insurance. The guy I'd be buying it from told me as long as your insurance company doesn't ask for pictures of the car, in order to keep my premium low I should just lie about what's in/on the car. He said tell them you bought it for the black book price without any mods ($1200 - $2100), and state the only addition being a body kit. MY QUESTION IS: Could I get in any trouble if they ever found out about all of the modifications to the car that I didn't list? What would happen?""

Given an inaccurate insurance quote?
So, in the process of getting a new vehicle I took two VIN numbers to a man at the insurance agency I've used for the past three years. The two numbers were for an '08 and an '09 car (the '08 first just to get a reference). He tells me the approximate increase in my monthly bill will be around $47.50 (for the '09). I go ahead and buy the car, my monthly bill has gone up just right over $200 more. I have already bought the car, paid for the tax, title, licensing and registration... and there is no way I can pay that much more in insurance (college kid here), so I'm going to have to get rid of the car, pay insurance on it for a portion of a month, and pay all the necessary fees on another vehicle. I will easily have lost $1000 because of this guy's inability to do his job. Of course, I didn't get anything in writing (having gone there for three years and never having any other problems...). Refusing a Breathalyzer: Impaired Driving Lawyers, Edmonton
Learn what will happen after you've refused a breathalyzer test from some of the most experienced impaired driving lawyers Edmonton offers.
Breath testing can take one of two forms: roadside testing and evidentiary testing.
Roadside testing is used by the police when there are insufficient signs or indicia of impairment in the ability to drive to warrant an arrest. The driver is NOT entitled to speak with a lawyer at this stage. If the driver provides a sample of breath, it will analyze as either a ‘Pass’, which has no consequences, a ‘Warn’, which has no criminal consequences but consequences under provincial legislation, or a ‘Fail’, which allows the police to continue their investigation and obtain further breath samples at the police station after the driver has had a chance to call a lawyer. These further breath samples are designed to determine the blood alcohol concentration (BAC) or blood alcohol level of suspected drunk drivers.
A failure or refusal to blow at the roadside, or at the police station, is a criminal offence and has the same consequences as a failed breath test or being provably impaired. If a demand is made for you to give a sample of your breath, COMPLY.
If you refuse a breath test, in additional to the refusal charge, you could still be charged with driving under the influence (DUI) or while impaired. If this happens, you will need the assistance of an experienced DUI lawyer. Experienced lawyers are the only ones who can unravel the complicated nature of such a case. Furthermore, there are some facts about refusing a breathalyzer screening that you should know.
Penalties for Refusing Roadside Testing or Evidentiary Testing
Once again, if you fail to comply with breath testing, you will be charged with a criminal offence and subject to the same penalties as DUI. These penalties can include:
A permanent criminal record
Fines of at least $2,000
License suspension of at least one year
Conditional probation
Enrollment in a program for license reinstatement
Possible jail time of at least 30 days on a second offence and at least four months on a third or higher offence
High risk insurance rates for a three to five-year period
Permanent license revocation in extreme cases involving multiple related prior convictions
The type and severity of your penalties will depend on your past record and the experience of your lawyer. Thus, the more DUI offences you’ve committed and the less experienced your lawyer, the worse the penalty. Of course, one of the best impaired driving lawyers Edmonton has to offer, like those at our firm, will fight to ensure you receive the lowest sentence possible.
How an Experienced DUI Lawyer Can Help
No matter the crime you’re accused of, your rights as a resident of Canada are always protected. And these rights are best defended by an experienced lawyer. An experienced impaired driving lawyer will be well-versed on DUI laws and court proceedings and be the most capable of providing a prompt, organized, and thorough defence. He/she will know how to approach your case and find difficulties with the police investigation that could result in an acquittal or the charges being withdrawn. Also, lawyers at Haryett & Company may even be able to establish that your refusal was warranted in the circumstances.
They will also ensure that you’re treated fairly by law enforcement, including investigating if proper procedures were followed during the investigation. If any violations are found, the DUI and/or refusal charges may be withdrawn or reduced. Although these sorts of cases can be complicated, they’re more likely to have favorable outcomes with an experienced defence team at the helm. A team like Haryett & Company will leave no stone unturned and, where possible, will work to establish that your refusal was backed by sufficient reason.
Have you received an impaired driving charge? Contact our office today: (780) 426-5317.

Using cannabis and driving? Learn more about Bill C-46 (Part II)
Where there’s smoke there’s uncertainty: Details of Bill C-46
In our last article, we started exploring certain issues with the recently passed Bill C-46, which makes amendments to laws in the Canadian Criminal Code pertaining to impaired driving offenses, in response to the upcoming legalization of Cannabis in a few weeks.
The federal laws Bill C-46 outlines will come into effect this December, but many lawyers are now raising concerns that its amendments may be unconstitutional. Furthermore, many are worried that Bill C-46 opens up the real possibility of criminal charges being laid on sober drivers.
In this series of articles, we explore issues Bill C-46 creates that you ought to be aware of.
Increased powers for police.
Beyond just addressing specific concerns regarding cannabis use and impaired driving, amendments within Bill C-46 provide a blanket increase to police powers. As the law currently stands, police may stop any driver to ensure they are sober. If police have ‘reasonable suspicion’ that a driver is impaired, they may demand a driver submit to a roadside breathalyzer test to determine approximate blood alcohol content. The standard for ‘reasonable suspicion’ is fairly low and may be met with any of the following:
Erratic or unsafe driving
Open alcohol containers within the vehicle
Detection of the odour of alcohol on a driver’s breath
Bloodshot eyes
Slurring of speech and other altered behaviors
A driver’s admission to drinking alcohol
These indications are fairly easy to spot – even by a lay-person, let alone a trained and experienced police officer. Bill C-46 expands these police powers in that ‘reasonable suspicion’ is no longer required. As of December 18th, 2018, police officers across Canada will be able to stop any driver and demand they submit to roadside testing for impairment.
Lawyers are now questioning the implications of this increase in unrestricted police power. Many argue that the current ‘reasonable suspicion’ standard is flexible and effective. Allowing police to demand samples from anyone without any cause for suspicion opens doors for discrimination (such as racial profiling).
Furthermore, protection from ‘unreasonable search and seizure’ is outlined in the Canadian Charter of Rights and Freedoms. As such, some are now arguing that the amendments in Bill C-46 that remove this ‘reasonable suspicion’ standard (effectively granting police powers to compel a sample from anyone for no reason whatsoever) are outright unconstitutional. In essence, Bill C-46 removes the right to refuse to comply to a police demand that a person produce a sample of either their breath or saliva. Frustrated or rushed sober drivers ignorant of this could, as a result, face criminal charges.
