Salt Lake City media attorneys argue that access to the records and documents  promotes accountability and confidence in the judicial process – ideals that are integral to a working justice system in the US, especially in cases such as Lafferty’s, where the penalty is death. With such high stakes, it is imperative that these decisions and rulings not be held in a vacuum of closed courtrooms and secret meetings between privileged judges and lawyers in Utah.

The petition to open the records was filed last October on behalf of the Deseret News, KSL-TV, the Salt Lake Tribune and the Utah Headliners chapter of the Society of Professional Journalists. The records had been sealed in 2009 at Lafferty’s attorneys’ request when questions about their client’s mental competency began. The attorneys argued that they shouldn’t be forced to disclosed attorney-client information and that Lafferty’s privacy concerning his mental health should be respected. At the time, the judge agreed to seal the records. Salt Lake City media attorney Jeff Hunt didn’t necessarily agree with the move, noting that closing the court records as a default position runs contrary to the First Amendment, which assumes that court proceedings will be open to the public. Lawyers in Utah may claim attorney-client privilege, but the proceedings brought out in a courtroom don’t necessary fall under that designation.  In a case where the defendant’s life is at stake, Hunt saw opening the records as a way to promote responsible decision making. He also said that it would hold the judicial system accountable for its proceedings – a very American ideal, indeed.

Claiming that they were directed by God, Lafferty and his brother have been found to have been responsible for the deaths of their sister-in-law and her fifteen-month old daughter in 1984 by slashing their throats. Recently Reporter Jonathan Fahey gained attention from newspapers and online news sources around the country for his in-depth piece about marijuana business where he analyzed multiple perspectives – including that of entrepreneurs, consumers, and investors – and discussed the wacky world of making a profit of weed. Fahey drew attention to the fact that the dubious legal status of weed in some states, and its varying legal status in others, makes a successful business model somewhat difficult to implement. Utah business attorneys watching the climate of their own state agree, but will they be ready to handle the task at hand? Or will it fall to opportunistic consultants with little legal background who happen to be in the right place at the right time?

Part of the problem is that “it’s a gray market industry,” and the nation “hasn’t decided whether marijuana is a dangerous illegal drug or not much worse than tobacco or alcohol.” Federal law still classifies it as an illegal narcotic on par with heroin, while 23 states have legalized it for medical use, and two regulate and tax it for the general adult public. Even Utah, one of the most meticulously conservative states, allows that some studies have shown enough benefit of forms of cannabis for the substance to be legally used as an ointment for patients with seizure disorders—as long as they procure it from outside the state, a Utah business attorney would be wise to remind us.

But for individuals taking individual risks, some of the legal implications are less complicated than those of the entrepreneurs and investors getting their hands dirty with weedy opportunities. Investor money is just “sloshing around” right now, Fahey says. People are eager to get in on the weed business early, but a major issue is that because of the cash-based system and lack of transparency and clear regulation, opportunistic companies often surface and take the cash of investors without “a long-term business plan that coldly assess the market and the risks.” Most are in it for a quick buck, and few companies offer “legitimate opportunities” for investors.

Unlicensed, unexperienced consultants pose another hazard to the marijuana industry, a Utah business attorney should warn potential entrepreneurs in the Beehive State waiting for the substance to be legalized at home. “Some act as matchmakers, promising to connect investors with entrepreneurs… others sell help navigating the licensing process, tips on how best to grow marijuana, or advice about how to manage a startup that must operate outside the banking system,” Fahey says in the AP article. Which means having someone one your side who knows the law and is experienced in the intricacies of business legalities. Because it’s probably coming to Utah, though it may be coming slowly.

Spain's come a long way since the dark days of Gen Francisco Franco when a woman's role was firmly in the home and she needed permission from her husband to get a job, open a bank account, own property or even travel away from home.

But women still don't enjoy parity with men in Spain and there is a way to go to bridge the gender gap. 

1.   Inequality in the workplace

Spain’s female executives earn 16 percent less than their male counterparts, although this is better than the EU average salary gap of 23.4 percent acccording to the latest Eurostat data.

The percentage of women in managerial positions is 37 percent and by far the majority of Spain’s top earners are men. Although men represent 54 percent of all salary earners, they occupy the top jobs, with data from Spain’s finance ministry showing that 82 percent of positions where salaries are more than ten times the minimum wage are held by men.

2.      Women are still officially described as "the weaker sex"

The definitive dictionary of the Spanish Language, as published by The Royal Spanish Academy (RAE), carries a definition for the phrase “sexo debil” – the weaker sex – as “women in general”.

While the term “the stronger sex”, is of course a definition of “men in general”.

But after a campaign launched by teenager Sara Flores Romerothat has garnered almost 100,000 signatures on change.org, the RAE has agreed to revise the definition in its next edition published in December.

3.    Spain taxes tampons

 Spain still has a tax of 10 percent on feminine hygiene products - which is the same rate for caviar - putting millions each year into government coffers.

Other products, like intimate gels and hygienic wipes, carry a 21 percent tax.

Last year a group of women began a campaign entitled “Tampons from Canada” – a protest  that involved importing tampons from the North American country where such items are not considered a luxury and are tax-free.

"Women of Spain, we already bleed enough, so let’s unite so that the government of Spain does not make us bleed more," the group says in a YouTube video.

4.    Women do most of the housework and childcare

This advert for Cillit Bang was banned because it reinforced the stereotype that only women do the housework.

Spanish women also take on the majority of the household chores and spend much more time on unpaid tasks such as childcare or caring for elderly relatives, even if they too hold down a job.

Working men spend on average two hours per day on household activities, while working women spend double that  – over 4 hours every day on household tasks, according to data collected by Spain’s National Statistics Institue (INE)

They also do around 70 percent of unpaid care within the home – either of children or elderly relatives -  according to data collected by Spanish think-tank Fedea.

5 Domestic Violence

Women in Spain are still being killed at the hands of their partners and ex-partners. In the first two months of 2017, 17 women were murdered by the men in their lives.

During 2016, a total of 44 women were killed as a result of “gender violence” and campaigners believe the Spanish government should be doing more to prevent and punish such crimes.

Things have certainly improved in leaps and bounds for women since Spain’s transition to democracy on the death of fascist dictator Francisco Franco in 1975.

In the last general elections in June 2016, more women than ever before were voted into the Spanish parliament when 138 women won seats in the 350-member congress.

That means women make up 39.42 percent of MPs in Spain’s national parliament above the EU average of 37 percent.

MADRID — Teresa Rodríguez, the leader of the far-left Podemos Party in the southern region of Andalusia, was visiting an exhibition in the Chamber of Commerce of Seville when she ran into a member of the group she had never met before.

In no time, the man, Manuel Muñoz Medina, pushed up against her and simulated kissing her on the mouth — before handing her his business card.

Ms. Rodríguez, 35, said she was too upset and shocked to react at the time, just before Christmas. But she then took to social media and started legal action this year. Mr. Muñoz Medina, 72, later apologized for his behavior, saying he had been drunk, and resigned from the chamber’s board.

Spanish women have made tremendous advances in recent years as the revolt against mainstream parties helped break down some old-boy networks. But that upheaval, the women say, has also laid bare the deeply entrenched sexism and machismo in Spain’s political establishment, which has at the very least been slow to adapt to changing times, intensifying a clash of both generations and genders.

It has been less than a year since voters elected a Parliament with a record number of women for Spain: 139 out of 350 lawmakers. Within Podemos, which has become Spain’s third-largest party, women make up almost half of lawmakers. In Spain’s regions, far-left women now serve as mayors in both Madrid and Barcelona, Spain’s two largest cities.

But women say they still face big obstacles as they try to make their way in Spanish politics, still predominantly a man’s world. Sexual harassment aside — and it is common — among the problems most commonly cited by women is that men expect their female colleagues to share their views, not have opinions of their own.

“It’s not just about having more women in politics, but also about allowing women to take whatever line they want in their politics,” said Anna Gabriel, a lawmaker from a Catalan far-left party known by its acronym, CUP.

Last year, Ms. Gabriel and female colleagues held a public meeting under the headline “We haven’t come to look good,” to denounce the sexist response to their electoral progress.

During the meeting, each woman in turn read out from a podium some of the choicer insults she had received on the job. They ranged from demeaning comments about their appearance to more aggressive insults.

Ms. Gabriel said that, despite her party’s efforts to denounce sexism in politics, she and her colleagues continued to be subjected to attacks that almost invariably mix political criticism with personal insults.

“What we hear has to do with our political stance, but the comments almost always include something about our bodies, sexuality, sexual lives and whether we’re beautiful or not,” she said.

That kind of discourse would be familiar to women the world over. The issue of sexism in politics or other pursuits is by no means limited to Spain.

Most prominently it surfaced in the United States last year, when Donald J. Trump was elected president despite a leaked tape in which he bragged about grabbing women.

Last week, a Polish member of the European Union Parliament, Janusz Korwin-Mikke, said during a debate,“Of course women must earn less than men because they are weaker, they are smaller, they are less intelligent.”

In Spain, a judge from the supreme court, Antonio Salas, caused outrage in January after he joined an online debate about gender violence to argue that “if women had the same physical strength as men, this would not happen.”

Many of the misogynistic attacks have been delivered through social media. Last April, Miguel Ángel Rodríguez, a former conservative government spokesman and secretary of state, used Twitter to contrast the looks of Inés Arrimadas, whom he described as “physically attractive as a young female,” with what he called her “political inconsistency.”

Since taking office as Barcelona’s mayor in 2015, Ada Colau has been subject to several sexist insults. Félix de Azúa, a member of the Royal Spanish Academy, the cultural body that is the guardian of the Spanish language, publicly urged Ms. Colau to sell fish in the market rather than run a major city.

Ms. Colau was also told by a local official of the conservative Popular Party, Óscar Bermán, that she was brainless and should be cleaning floors.

In September, the Popular Party suspended Mr. Bermán from office for two years for his comments. The Royal Academy, however, took no disciplinary action against Mr. de Azúa and said he was not available for further comment.

While deploring such insults, Ms. Colau said that she was proud to have given Barcelona its first City Hall administration with an openly feminist agenda, committed to fighting not only sexism but also domestic violence.

“The sad reality is that sexist comments remain absolutely normal, also in the Spanish media, but that such criticism of women is the most visible but least dangerous part of the problem,” Ms. Colau said in an interview last year. “Dozens of women are killed in Spain every year — and that is a fact and reality.”

Last year, 44 women were killed as a result of domestic violence in Spain, which was the lowest figure since such crimes were first recorded in 2003. Still, protests have recently been held in Madrid to denounce gender violence, as well as to support eight women from an association in northwestern Galicia, who started a hunger strike on Feb. 9 to protest the muted political response to such crimes.

To observe International Women’s Day on Wednesday, Spanish women, like those elsewhere, were urged to halt their work for 30 minutes. Feminist associations also planned protests in Madrid and other cities, during which participants were urged to dress in black as a symbolic act of mourning against domestic violence and inequality in Spanish society.

Ms. Colau entered politics after working as an activist fighting housing evictions. She said that she had suffered far worse attacks as an activist than as mayor, including sexual harassment.

She never reported them to the police because, she said, “like a lot of other women, I wasn’t confident that it could be resolved judicially — and also because of the social stigma.”

Ms. Rodríguez, the Podemos leader in Andalusia, said she hoped her lawsuit would break “the feeling of impunity” among a large section of the male corporate establishment.

“I felt treated like a source of amusement for people who somehow feel superior not only in terms of gender, but also because of their age and social class,” she said. “If somebody feels he can have such an attitude toward me, imagine how that person might behave with a woman who actually works and gets paid by him.”

At least 160,000 protesters have marched in Barcelona to demand that Spain's conservative-led government increase its efforts to take in refugees from war-torn countries like Syria.

Spain has accepted just 1,100 refugees of the over 17,000 it has pledged to take in.

Marchers held a large banner and signs in Catalan with the slogans 'Enough Excuses! Take Them In Now!' and 'No More Deaths, Open The Borders!' as they made their way through the city centre to its Mediterranean coast.

Barcelona police said 160,000 people took part in the march, while organisers said it reached 300,000 participants.

“There is an ample consensus in Catalonia to demand that the (government's) commitments are upheld,” said organiser Ruben Wagensberg.

In September 2015, Spain's government pledged to bring 17,337 refugees in within two years: 15,888 from camps in Italy and Greece and 1,449 from Turkey and Libya.

On Thursday, a group of 66 refugees – 65 Syrians and one Iraqi – who arrived in Madrid raised the total number of refugees that Spain has taken in to just 1,100.

Barcelona Mayor Ada Colau, a former anti-eviction activist who has pushed Spain's government to let her city accept more refugees, joined the march.

“It is very important that in a Europe of uncertainty where xenophobia is on the rise for Barcelona to be a capital of hope,” Ms Colau said.

She also criticized the federal government's stance toward refugees in December at a Vatican conference on Europe's refugee crisis.

In contrast to Spain, fellow European Union member Germany took in 890,000 asylum-seekers in 2015 and another 280,000 in 2016.

Germany decided last year on more than 695,000 asylum applications. Nearly 60% of the applicants were granted either full refugee status or a lesser form of protection

Throughout reading and web suffering about Spain I’ve collected images, short videos, music, news, and blogs. Images of the bull fighting in Spain and the beautiful churches left me in awe. Also, I’ve collected shorts videos explaining how Spanish festivals are attended, the most romantic places, and the most popular sceneries throughout Spain. What has inspired me the most during my reading, was Spain’s unity. I admired their fashion, for there are different types of dresses women would wear for different occasions. For example, when women attend festivals they would wear their tradition dresses to present their style.  Aside from a woman’s woredrobe, I also learned that refugees have a high level acceptance to leave the country. I have become highly interested about Spain and I would love to know how their everyday life goes. I am also curious on what type of income citizens’ make in order to support their families and how they can afford to attend festivals and their night lives. Spain is on my bucket list, for I hope one day I would travel and experience the country on my own. Also, I would attend their cultural festivals and visit multiply churches, as well as their bull fighting shows.  While viewing their most romantic getaways I would love to go with my husband and enjoy they view. Lastly, I would try as many restaurants as possible and enjoy their traditions sweets.

Misdemeanor DUI

The act of operating a motor vehicle after having consumed alcohol (ethanol) or other drugs (including over the counter medications), to the degree that mental and motor skills are impaired is called a DUI or driving under the influence. Utah man accused of DUI-related death will stand trial

After an alleged domestic confrontation, a Utah man drove away from the situation. Allegedly, he sped up to nearly 60 mph as he approached an intersection. Police say that when he sped through the intersection against a red light, he hit another vehicle, which began a chain reaction accident that ultimately involved nine vehicles. That alleged DUI accident led the death of a 43-year-old mother and the critical injury of her 16-year-old daughter. Seven others in the other vehicles suffered minor injuries.

When police interviewed the man at the hospital, they smelled what was believed to be alcohol on his person and noted he had bloodshot eyes. At the scene, officers reportedly observed that he was slurring his speech. No further information regarding his claimed intoxication was provided.

The allegedly drunk driver faces a litany of charges relating to the accident. In an unusual move, Utah prosecutors decided to charge the man with felony murder in the first-degree. Ordinarily, an individual in his situation would be charged with vehicular homicide in either the third or second-degree. Additional charges include one felony count of DUI, seven misdemeanor counts of DUI and two counts of aggravated assault. One of two domestic violence charges was dropped.

The potential penalties associated with these DUI-related charges are significant. Under our system of law, however, he is presumed innocent until and unless proved guilty in a court of law. His criminal defense team will review all of the evidence the prosecution intends to present to the court. From this information, an independent investigation into the circumstances surrounding the day’s events can be conducted, which should reveal the best course of action in moving forward with his defense.

“Keep it secret. Keep it safe,” seems to have been the inspired motto of South Jordan City regarding a certain document that the public demanded access to. No, it wasn’t the One Ring to Rule Them All, it was a draft document for part of the finances of a mini golf and games business set to be developed in the city. And despite the best efforts in the courtroom, it looks like South Jordan City will be able to keep it secret and safe, after all, something which the Salt Lake City contract attorney for the “grass roots group trying to pry open the confidential ‘draft document’” says was not a great decision for the public, according to the Salt Lake Tribune article reporting on the story.

legal process to access information backfired and will result in more secretive measures

Here’s how it happened—starting back in 2011 when “Mitt Romney told an Iowa State fairgoer that ‘Corporations are people, my friend,’” setting off alarm bells for concerned citizen advocates across the country. But then the Supreme Court upheld that notion just recently with its decision that Hobby Lobby enjoys constitutionally protected rights. And now South Jordan City is invoking that same idea, defending its right to confidentiality regarding the planning document for Mulligans Golf and Games resort, which residents are hoping to block development for. Salt Lake City contract attorney would be hard pressed to dispute the legal reality that the city can claim personhood, and thus protection under confidentiality rules.

Which is what the Records Committee in Salt Lake City hearing the case decided, eventually, despite the best arguments presented by the grass-roots group’s Salt Lake City contract attorney Jon Call. Call actually acknowledged that the argument that the city is a person is a valid one, legally: “we don’t dispute that,” he was heard to say in the courtroom. But was South Jordan City taking it a little too far when it “pressed the city’s legal status as a ‘person’ to argue” that the draft report “was confidential because it was created for ‘personal use” of an individual—namely, South Jordan City”? Probably. An “individual” is apparently defined as a human being, even when a “person” is not.

So South Jordan City couldn’t claim “personal use” of the document, even while being recognized as a “person.” This is where things can get hairy, Salt Lake City contract attorney Alger and other lawyers in Utah would remark. But hairy or not, the dispute was resolved in a 4-1 vote favoring South Jordan City’s right to keep the document private and confidential. Secret and safe.

That’s probably not the end of the story, however. Local legal organizer Verne Cotton finds the idea of corporations and cities as people as “atrocious” and a “legal fiction” that is “allowing corporations to hide behind the Constitution.” His advocacy group points to “last year’s nonbinding survey in Salt Lake City where 88 percent of voters agreed” that corporations are not people, and they want to see the law changed. Which would mean significant changes for Hobby Lobby, and Wall Street too, most likely.

Many relationships that begin online end in marriage. Things are blissful for some time and then here comes the dreaded divorce talk and threats of finding the best divorce lawyer. Types of Irrevocable Trusts

As an estate lawyer, I have explained that there are many types of irrevocable trusts that can help you secure your assets and reduce taxes.

They include the following:

Asset Protection Trust An asset protection trust is used as a fortress to keep creditors from seizing assets. There are asset protection trust laws in states such as Nevada, Wyoming, Delaware, Alaska and North Dakota. In practice, we have found that they can provide a fair level of protection, especially, for residents of those states. However, they have the disadvantage of being under US court jurisdiction. Judge’s do not always follow the law and there are ever-expanding legal theories of liability. So, we have seen assets in domestic trusts seized on numerous occasions. Offshore irrevocable trusts in jurisdictions such as the Cook Islands and Nevis have a perfect or near-perfect track record for protecting assets from judgment creditors. Because US judges do not have jurisdiction over foreign trustees, the trustee need not comply with US court orders.

Bypass Trust This type of trust that married people use. When one spouse dies, the property goes into the trust. The surviving spouse can use the property, but does not own it. This means that it is not part of the estate when the surviving spouse dies. This equates to tax savings.

QTIP Trust Another trust designed for married couples, a QTIP trust typically provides income to the surviving spouse when one spouse dies. When the second spouse dies, other named beneficiaries receive the assets. This is typically the settlor’s children. QTIP stands for Qualified Terminable Interest Property.

QDOT Trust A QDOT trust is similar to a QTIP trust. The difference is that noncitizens use it. QDOT stands for Qualified Domestic Trust.

Life Insurance Trust With this type of trust, the trust is both the owner and the beneficiary of the life insurance policy. Anyone, in turn, can be the beneficiary of the trust. The grantor must typically create the trust at least three years before death. It lets a person reduce or eliminate estate taxes so more of the proceeds go to the beneficiaries. The trustee, then, administers insurance proceeds for one or more beneficiaries.

Generation-Skipping TrustWealthy families often use this tool. As the name implies, the trust skips a generation. The final beneficiaries are the grandchildren instead of the children. The children are beneficiaries of the income, but do not own the property. This means that when the children die, their trust property is not subject to estate tax. However, a generation skipping transfer tax may apply.

Charitable Trust If you don’t have any family – or maybe you do have family but don’t want to give them an inheritance – you can opt for a charitable trust. If you are not married and have no children this may be a good choice. This type of irrevocable trust allows you to give gifts to charity as a way to lower income and estate taxes. The charity benefits from your donation as well, so it’s advantageous to both parties. There are three types of charitable trusts.

Types of Charitable Trusts

Pooled income trust:This trust allows you to pool your money with other grantors and receive income for a specified amount of time. For these trusts, the charity is the trustee and beneficiary.

Charitable lead trust:You put property into a trust. Next, you name a charity to receive income from the trust for a certain amount of time. However, you name someone else as the final beneficiary.

Charitable remainder trust:You put property into a trust. Then, you can receive a tax deduction for putting the asset into the trust. You name someone to receive income from the trust for a certain amount of time. The trust specifies a charity as the final beneficiary.

Trusts for Special Needs

If your goal is to protect assets and income for loved ones, choose one of these trusts:

Special Needs Trust If you have a child or other loved one with special needs, a special needs trust can help provide financial support for this person in the event of your death. Property – particularly money – is placed into this irrevocable trust. You appoint a trustee to distribute the funds to buy necessities for the disabled person. The beneficiary never owns the property. This works to his or her advantage because the money is not considered as asset. The beneficiary does not make too much income and therefore can still qualify for government benefits.

Spendthrift Trust Maybe you don’t have a disabled relative, but maybe you have a sibling or child who is horrible with money. Some people are just irresponsible with money, but that doesn’t mean that you need to leave them out of your inheritance. With a spendthrift trust, you can protect and control the money that you gift to family members who have trouble managing their finances. The settlor places assets into a trust. A trustee doles them out based on the terms in the trust. For example, you may allow the beneficiary to receive only a certain amount per week or month. The beneficiary cannot access the trust property, so the assets are protected from creditors. However, once the beneficiary receives money or assets, they become fair game.

Irrevocable Trust – The Way to Go?

How Bankruptcy Works

You may have heard about the changes to the bankruptcy code. These can affect anyone considering filing for bankruptcy. It’s important to be well-informed and educated on the process, how it works, who is eligible and what the implications for filing bankruptcy are. If the listed expenses exceed the allowance stated by the IRS, another document called a “special circumstances” document must be submitted. Filing takes a few extra steps with all of the new necessary documents, but it shows the debtor’s financial struggles in much more detail, which is often used in their favor.

Required Credit Counseling

People who wish to file for bankruptcy are now required, by law, to meet with a credit counseling agency on two occasions. Debtors must receive counseling from an approved agency both before and after filing their bankruptcy case. Requiring counseling is the easiest way to know that the debtor is well-informed regarding their finances and options. Counseling also offers debtors alternatives to bankruptcy in the event they haven’t been well informed about their options.

The Means Test

With the new law came the “means test,” which determines whether a person is eligible to file for Chapter 7 bankruptcy. Before the new law, a debtor could choose whether he or she wanted to for a Chapter 7 or Chapter 13 case. There are now a series of requirements and calculations that determine what Chapter the debtor falls under. To qualify for Chapter 7 bankruptcy, a debtor must fit a the requirements after assessment of family size, household income, expenses and even inflation.

The Role of a Trustee in a Bankruptcy Case

Ok, you are getting a fresh start on your financial situation and have filed for bankruptcy. One of the major players that you are going to be interacting with is a bankruptcy trustee. A bankruptcy trustee is a lawyer assigned to oversee your bankruptcy case. Their role in the case differs as to whether your bankruptcy case is Chapter 7 or Chapter 13.

Chapter 7 Trustees

In a Chapter 7 liquidation case, a trustee is selected at random from a panel of lawyers. Their main goal is to sell property and distribute the proceeds to creditors. In this process, a trustee sits down with the debtor during a “341 meeting” and asks them questions about their assets and financial affairs. From there, trustees review bankruptcy documents and is entitled to ask questions to find out if any nonexempt property, assets, or items that can be seized by the trustee and sold to satisfy debts.

Chapter 13 Trustees

In a Chapter 13 reorganization, a trustee’s role differs somewhat from a Chapter 7 bankruptcy trustee. A debtor still meets with a trustee in a 341 meeting and is asked about assets and financial affairs, however the trustee cannot take any of their property or assets. Instead, they assess the bankruptcy plan to see if it fits technical requirements and if it seems like it has a reasonable chance of success in repayment. Additionally, many trustees in Chapter 13 offer financial counseling and management.  The Chapter 13 Trustee is also in charge of distributing payments from the debtor to qualified creditors.  The trustee will sometimes refuse to pay creditors if they cannot prove that debts are owed them.

It is important to to remember a couple things about a bankruptcy trustee in order for a case to run smoothly and carefully. First of all, they aren’t your enemy who is seeking to suck you dry of all of your money and picking through your possessions to sell them off. An fact, most are quite reasonable people who are simply trying to do their job. In relating to a trustee, a debtor first of all needs to be honest. That includes an accurate listing of your assets because inaccurate disclosure can lead to criminal prosecution and a loss of discharge.
