Today, I got home from work and opened a google doc. Instead of filling the blank page with some hinny fluff or working on the jily professor AU I have tragically neglected over the last months, I wrote this.
Over the past few days (dare I say even longer), there have been accusations and side glances and “subtweets” about plagiarism and stealing content within the HP fandom in general.
First off, some tips to not seem like you’re targeting one person in particular...contact both authors of joint fics that are allegedly plagiarized. Otherwise all your arguments or accusations start to feel like a personal vendetta. @fightfortherightsofhouseelves and I wrote Torch together. If you have a problem with that fic, contact both creators. A second tip I would offer is hiding on anon is a bit weird and forces an author to address the note publicly or not at all. I understand being nervous to contact somebody, but honestly leveling this type of serious claim against someone is a thing you should be nervous about. It’s something that shouldn’t just be tossed around flippantly. It’s hurtful, it’s damaging, and it makes people not want to create.
That leads to my second thought, on fandom in general. I personally joined the HP fandom later than most after I read the books and wanted more. First it was edits, then I found Jily fics from a rec post, and finally I started creating myself. I think for a lot of people in fandom, it’s something of an escape. A fun outlet to make friends, interact over shared interests (namely the HP series), and even start to flex your creative muscles. Before fandom, aside from a creative writing class, I had never thought I was the type to write fiction in any form. I was a cite your sources, make your arguments, keep it real type writer. Since 2017 I have started to enjoy exploring a new side to writing and realized I do in fact love a good exploration of a fictitious universe. The point of that back story is that when we make fandom combative through things like ship wars, “who wrote the trope first” accusations, and other toxic behaviors, it takes away that fun escape from a lot of us. The world is difficult enough without us turning on each other for something so small and unfounded.
What do I mean by unfounded? Well first, fanfiction is made for tropes. In fact, most genres of fiction have their own classic “tropes.” The romcom “boy meets girl, boy gets girl, boy loses girl” etc formula, the fantasy “orphan discovers secret about their family and their own magical powers,” I could list so many but I won’t. The point is, most fiction when boiled down to basics is going to sound like at least one other work when that work is also boiled down. Legally, this type of similarity isn’t even going to get someone a successful case of plagiarism. In fact, there’s a case directly related to HP where JKR was accused of plagiarism because another author had already written a story about a boy wizard who went to a wizard school that had a special event similar in basics to the Triwizard. You might guess the case was unsuccessful given the fact that Goblet of Fire still floats around in the literary universe with no mention of any other owner. And that’s just it, concepts in art/fiction/writing aren’t “ownable” - you can’t copyright “boy wizard discovers powers.” It’s too broad, too vague, and honestly the most important one in my opinion: it stifles creators.
You might not care that your favorite author experiences stress relief and personal satisfaction from writing that Bed Share AU or Regency Era AU or whatever. But all of us would care if creators stopped creating. I wait for WIPs to update with just as much excitement as the next person, and I hope that people who read my fics still anticipate updates. But if accusations and mean anons keep flying around, those updates are going to slow down and maybe even stop if we don’t do something. This isn’t a threat, it’s just the truth. If every time someone uploads a Royal Jily AU they think they are going to unleash anons accusing them of stealing another person’s concept, how often are they going to post? Real life has enough of that kind of stress and eventually people are going to get tired of having more stress in the “fun” areas of their life.
Fanfiction, by virtue of its definition, is a work inspired by another original piece. Tropes are central to the creation of fanfiction. We all love a bedshare, or in the HP fandom a Muggle Coffee Shop AU or whatever your personal favorite is. Tropes are story concepts we all interpret in our own way. With the almost endless number of Hinny or Jily or HP in general fics created since the books were released, we are bound to find a similarity here and there. It’s not stealing, it’s not bad, and it’s just how fandom works. It’s part of the comfort in reading fanfiction - Harry and Ginny are usually going to get together, Harry has black hair, Ginny’s is red. Do you think she has freckles? Does Harry? Is Ginny short? We all love to throw a “fresh pickled toad” reference or another nod to canon. Does the first fic writer who ever incorporated any of those things into their fic have a monopoly on those things for all time? No, of course not. Because the familiarity of fic, of tropes, of characters, is part of why we love to write and read it. We are celebrating our shared love of characters, stories, and universes we all explored through reading.
I think fandom and the creators and readers that make it up, are really special. It’s a little corner of the universe where we don’t have to pay, we don’t have to go somewhere, we just scroll through an app or an archive and share our mutual enjoyment. Infighting and accusing and quiet side eyeing of things like writing a fic of missing moments in HBP is silly and destructive. (note: Ao3 currently has 180 works tagged for Hinny & Book 6)
We can all do our part to keep the fandom a pleasant place to be, and it starts with remembering that everyone behind the username and the (probably) fan art icon is a real person. A person with a life and emotions and feelings that can be hurt. Even an anon that makes me mad - they’re a person. We need to respect each other and think how we would like to be treated. And even beyond that, think about what our actions will do to other fans, to creators. If we keep up with the unreasonable and illogical standards floating around recently, we’re going to falsely accuse ourselves out of new content.

Everyone is welcome to this event! First of all thank you very much for being here and being part of this event !!
Lately the fandom has grown and among many there are some who really like the character of Mikasa, including me. Now I know that the situation worldwide is very delicate due to the pandemic and that is why there is no better occasion than to take advantage of the free time that these improvised vacations give us to be able to do all together and get along as fandom they are from the country that be!
But hey, what is MultiKasa week?
Well, what it is, a week dedicated purely to Mikasa and the ships they like the most.
It is a period of time where everyone can share what they like about the character and with whom they often like to put it together.
Is it necessary to have only one ship to participate?
Not at all! You can share several ships if you want. Imagination and possibilities have no limits.
Is it just about getting Mikasa together with someone?
Not necessarily, you may be a neutral person and you may not like the pairings there very much, but you can always share your views on the character of Mikasa and why you like him.
How can I participate?
In many ways! From writing something to drawing, editing some images, creating videos or analyzing why you like a certain couple with Mikasa or even why they like her.
There are no parameters for what you can do no, the point of this is just to have a good time those of us who share a liking for Mikasa Ackerman.
Which are the rules?
No hate: This event is public so we want you to stay in peace, it's not about trashing other pairings or anything. Remember that for tastes there are colors and that is why everyone is free to match those who want to have a basis or not. It is only a matter of perspective and also of the inclinations of the user.
It is only for Mikasa: No problem if you want to include secondary pairings with Mikasa, the point is that she is the center of the circle, that is, of this event.
No spam: It is true that you can promote everything you want but as long as it has something to do with the event and with Mikasa. Meanwhile, other things do not.
Labels: When you participate always put a label to find out that you are supporting the event with your work, whatever the day or the activity you are going to do, make sure to put #MultiKasaWeek2020 so that people can see your work and share it.
Pairings: As we know, everyone is free to match whatever they want so there are no limits BUT remember that this is not a specific week for one ship with Mikasa but with several.
Genres: You can use any but if it is something that contains +18 please make sure to externalize it in your work.
No to plagiarism: remember that you are not allowed to steal the work of others or someone outside the event.
Now, the themes will be chosen through a roulette wheel so don't worry. It is also not necessary once you enter the event to participate every day, everyone has different abilities so it is up to each one to know how far to go while always keeping in mind the most important thing. Have fun!

So anyone using video footage from Teen Wolf (or any other source they personally didn't create) is committing plagiarism. The first person to gif it committed plagiarism. The second person committed plagiarism. The third and the fourth and so on down the line as well, but they are all committing it against the owner & creator of the original content, which in this case would be Teen Wolf and associated entities holding rights, trademarks, etc.
But what about Fair Use?!?!
Fair Use is a vague term falling into pretty Grey territory, but here's the gist: it doesn't matter if you put a disclaimer, it doesn't matter if you acknowledge rights holders and your use will be judged in several categories.
You can quote books for reviews or cite them after using direct wording if it is pertinent for you to do so and does not take away from the essence of original work. ** This means using a quote or lines from a book is probably okay, but if it is a spoiler than could cost sales you could get into trouble. Use for education is usually fine, but if you put 7 full pages verbatim into your thesis that could be an issue.
You can be judged on how much or how close your use of an image is to the original work. ** Taking an image or associative symbol, and framing it with your own hand-drawn art surrounding it may be okay in some cases and not at all in others, especially in regard to making money or adopting said image into a non-parody, non-educational creation especially if the intent is for you to receive gain or for the original to be harmed. So, using a silhouette of Han Solo as night sky while your own 3-D papercraft meteors & ships are made to "fly out" of that for your science classroom (educational) could be okay, but making the same into shadowboxes to sell on Etsy could be problematic (using copyrighted works for your own monetary gains).
If you make gifs of commercial images, you are guilty of plagiarism. It doesn't matter what coloring anyone changes or if a disclaimer is attached or any other thing you can think of. Usually legal action isn't sought-after for things like gifs or edits, but the fact is that you can't plagiarize from a source and then cry foul if someone else reposts it, changes your coloring to another coloring, makes it 71 frames instead of 73, whatever. If you put anything online it has a risk of being shared outside your control, so here's a thought: if a Repost or someone changing green from 9% to 12% gets your knickers in a twist, take a deep breath, remember those gifs/whatever are themselves plagiarized - NOT your original creations - and either let it go or stop putting shit online.
TL;DR : Making gifs is plagiarism, period, so don't bitch about someone stealing your work when you stole it first. Just STFU and either shrug it off or stop posting, but for sure don't toss around accusations of "plagiarism".

Sorry, but the post will not be taken down. This is not plagiarism. The gifs are completely different. Made by different members, with different captions and different colouring.

To the YOI fandom: Love on Ice controversy.
This is from the perspective of an tech/art student and someone who has to study film and do research.
Note: I dont normally get involved with this type of thing, even ship wars. But this is something I wanted to address because its popping up on FB, Instagram and Tumblr.
So… it has recently come to my attention that many people in the Yuri on Ice fandom are complaining and even attempting to boycott/petition to stop it/EVEN GOING SO FAR AS TO TELL KUBO TO SUE HALLMARK due to the announcement of a new direct to TV movie called Love On Ice.
My only answer to you is STOP.
Youre embarrassing yourselves.
Let me explain.
Yuri On Ice was in production for 4 years doing impressive amounts of research to truly appreciate ice skating in all its beauty. Their effort paid off with the beautiful series. With an anime that balanced both its romantic side and sports ice skating, gaining the praise of professional ice skaters like Johnny Weir.
THIS (love on ice) IS A FUCKING HALLMARK MOVIE. ITS NOT GOING TO BE ANYWHERE NEAR THE GREATNESS OF YURI ON ICE. IT IS A CHEESY CHICK FLICK THATS PROBABLY MORE FOCUSED ON THE ROMANCE THAN ICE SKATING.
DO YOU REALLY FEEL THREATENED BY LIKELY TO BE A FUCKING PIECE OF SHIT HALLMARK MOVIE?!? IT WONT EVEN COMPARE TO IT. IT WONT HAVE THE PRAISE OF ICE SKATERS INTERNATIONALLY NOR THE GIANT FANDOM YURI ON ICE HAS.
If youre still confused/angry or think it was stealing or need more than just a salty college student yelling, continue to read.
Movies take a long time to make. Brave took 3 years just to get her curly hair perfectly natural. Frozen was originally thought off back during WW2 but kept getting transfered and shelved because they couldnt make it work at the time. Studio Ghibli takes its time making movies and spending hard work and time to make its animated films. Even Steven Universe takes a year to make its episodes which are usually 11 minutes long. As does family guy and the simpsons. While the media entertainment seems like it can pop out whatever it wants, there are still layers of work that go into its production and the effort that team puts into it will show when the finished product is released (just look at straight to DVD sequels from Disney movies, theyre generally pretty bad. And this is from the power house known as Disney.)
I would believe it was stealing/plagiarism/violation of copyright if there was a bigger difference in time between the release of the movie and the anime but the actors and skaters still have to ice skate (if they even do that for more than 10 minutes). Movies take time (depending on budget, writing the script, storyboarding, designing, staff, actors, choreographers, editting, etc) and its going to be released soon (in january 2017). By the time YOI came out, this was more than likely in post production. After the script was finalized, after all the acting and shit was done and really all that needed to be finished was editting and special effects. So when would they have the time to find out about YOI and insidiously plot a revenge plan to take ice skating back from the homosexuals (as some believe). Its simple. They couldnt.
The people saying its copying the plot. No, its not. The coach student romantic relationship plot is nothing new. Like seriously. Its not revolutionary. YOI is special because executed the relationship in a natural fluid way while also providing a healthy LGBT relationship, something rarely portrayed in media, much less anime. Having someone get out of something they once loved only to find a renewed interest due to someone else’s interactions in their life isnt anything new either. Ice skating is also part of various others media enterment. So no, they arent stealing.
At this point. Its the execution that matters more that its basic premise.
If you think its bad, then dont fucking give it the time of day. Stop giving it your attention. This also means let it flop on its own. Dont go writing nasty reviews because youre butt hurt. Like i said above IT IS A FUCKING HALLMARK MOVIE. Let it fade into obscurity. I bet you couldnt even name 3 hallmark movies from memory without help.
Make your memes. Say something funny. But dont give your anger because then youre just giving it attention that youre arguing it doesnt deserve. Stop that pathetic petition. Not saying you cannot be mad, just that its not worth your anger.
Support Yuri on Ice, the studio responsible for the masterful series, its creators, animators, designers and their inspirations, and buy official merch. It being dubbed by funimation (regardless of you liking the dub or not) means it will be easier for the western fans to get their hands on some form of official merchandise. Make YOI art. Cosplay. And be glad we have a meaningful series rather than another queerbaiting show, anime no less.
