What happened to katherine?

Nothing’s happened to her; she got an instagram account, which is awesome, and she’s been using it just to promote a charity she’s working with called “SpareHand” that are providing food and supplies to those who need it during the pandemic. She was even out there volunteering with Jude Law at a primary school in London yesterday to sort through supplies. 

So basically Katherine is a lovely human being who’s actually doing good volunteer work during this quarantine and NOT just preaching at us while she’s all cosy and safe, and we should all stan her, thank you.

Basically, the problem is that there’s a seriously creepy and messed up fan harassing Katherine/Katherine’s fans and smearing her name.

Years ago, back before CoG came out, there used to be a fan called “Candy Working” on Twitter who was a HUGE fan of Katherine, like her whole twitter was just Katherine related and it was all she could talk about. She kept saying that she was going to meet her at the premiere, blah blah blah. Anyway, during the summer of 2018, a private account appeared that we believed to be Katherine’s - most of us followed it, which is a huge sign something was up because why would she have a private account only to accept fans as follower requests? But we wanted it to be Katherine so bad - myself included. I’m ashamed to admit I told that account stuff in confidence believing it was Katherine, which I’ll get back to in a minute. As it soon turned out, however, the account was a fake - photos posted were either extremely blurred or very generic, or they could be found online with some digging. One of Katherine’s friends, an up and coming filmmaker who regularly speaks with fans, confirmed it was not Katherine. A huge giveaway was that the captions/messages from the account were in broken English and sounded nothing like how she speaks, and Katherine’s brother wasn’t following it, neither were her friends like Henri and the Beasts cast. 

To cut to the chase, it was Candy. Candy made the account posing as Katherine. A dead giveaway is that “Katherine” went on a mass deleting followers spree and pretty much got rid of everyone BUT Candy. After that, a lot of us Waterstans got more savvy about things and we told Candy to stop. Candy denied it and for a long time we heard very little. Another thing Candy did in 2018, shortly after, however is editing Katherine and Callum Turner’s wikipedia pages to say that they were dating each other.

Over the past few years, more accounts have appeared posing as Katherine; using my fan accounts, and working with other fans, we’ve shut them all down. Until recently, Katherine has had no social media whatsoever because she’s a very private person, and we as fans should respect that.

Cut to very recently. Yet another troll account appeared on twitter - you see, someone (hint hint) has made account after account, tweeting things about Katherine and her father, saying vile and hurtful things about them. For example, they’re convinced on saying that Katherine is a horrible person, that her and her dad are involved in “child sacrifices” and the pedophile ring in Hollywood, and they’ve attacked Katherine’s fans regularly. Yes, we know it was Candy - all these accounts have the exact same writing style and way of speaking. It’s painfully obvious. Anyway, this account was posting shit, and I happened to click on it whilst on my laptop instead of my phone - and that’s when I noticed that they had posted a pic of me at my uni graduation because it was under their media section. I’ve posted the screenshot before, and I’m on my laptop right now so I’m not going to go digging for it since it’s slow, but it’s on my blog (this AND the Katherine fan blog I run). 

Here’s a rundown of what happened:

They used the pic of me at graduation, asked if anyone remembered my name, and then tweeted in on a public platform, saying I was from London (which I’m not exactly, I’m outside of London)

They made up lies about me, took a screenshot from my Katherine blog where I expressed my disappointment regarding a project I had done for her birthday, and said it was proof that Katherine hates her fans

When I blocked them on my fan/usual twitter, they tracked down three of my other ones and continued to tweet/harass me, even when friends of mine told them to stop.

I was truly upset about the graduation thing and asked them to take it down - they refused and said it was a google leak and I should delete all of my accounts because of it.

I just want to say that while the picture is indeed on my personal instagram and on one of my blogs, there’s a HUGE difference between ME posting it to share my excitement/joy, and some CREEP online reposting it WITHOUT my permission in order to smear both me AND someone I look up to.

This account - besides attacking Katherine fans and Katherine herself - was constantly tweeting that 5G caused Coronavirus, was a Trump and Boris supporter, and just in general a tinhatter. 

By the way, they claim to know Katherine very well and keep saying about “her son D”, her “rich millionaire husband”, how “katherine is going to post her memoirs and a documentary”. I don’t believe Candy knows anything at all, or if she does than it’s certainly not because she knows Katherine; but the fact that she’s supposedly giving out private information about Katherine’s private life (her baby, for example!) is HELLA creepy and nasty and rings a LOT of alarm bells.

Eventually, with a lot of fans reporting it, the account got terminated.

On Katherine’s instagram in the last week, an account on instagram has popped up and it’s so bizarre, to say the least; they constantly spam her with comments, firstly saying somewhat nice stuff before switching to harassing and being rude - saying she has no career, her fans are couch potatoes, that she’s brainwashed her fans, that the Beasts films are only successful because of Eddie, Jude and Johnny. We all know it’s Candy, we’ve all confirmed it. Again, same writing style, blah blah blah.You can see the comments on any of Katherine’s instagram posts to be honest, but I posted screenshots of some HERE.

Candy of course started to mention ME by name again. Because she’s fucking wacko. Calling me “No 1 London fan Megan” or some shit, saying I have a GoFundMe page to meet Katherine, which I don’t - I had one for my Tina Goldstein cosplay back in 2017, and the only reason I did was because I posted about being worried that I couldn’t afford it, and a bunch of people jumped in and said that they’d be more than happy to give some money in exchange for fics and as a “thank you” for the fics I had written. Frankly, it still stuns me that happened. But that’s not the point; they’ve spouted lies and shit that make me look bad, targeting me as well as a few fans specifically (namely the KW Russia account - who are very nice, by the way!). The spamming itself if unsettling, let alone what she’s actually saying. Candy also made an account called “Katherine Waterston Toronto” that she’s since made private after being called out, again spouting the same shit as she did before and on instagram. 

We’re all reporting the accounts as best we can, but Twitter and Instagram are...well, we know what it’s like when it comes to reporting accounts (side-eyeing @staff for NOT taking down the TWO blogs that were specifically created JUST to make call-out posts about ME and every bad thing I’ve done in the past 5 years - good job, guys! Adult content isn’t allowed but call-out blogs calling for someone to be fucking arrested and to be banned from the fandom are A-OKAY!!) I’m hoping that Katherine is either not reading the comments or that if she does, she’ll see it’s a troll and just block them.

What’s interesting, though, is that Candy is claiming that Katherine has “hurt” her in some way, and that Katherine or her family got the police involved...something like that. Very interesting. Again, could be more steaming shit from what is clearly the world’s biggest tinhatter, but it honestly would not shock me if Katherine/her family got freaked out and contacted cops.

(Roger Taylor x Reader x Ben Hardy One Shot)

Part 1

Summary: While helping Roger give out his flyers for the upcoming gig, Ben stumbled into you. Roger wasn’t enjoying the attention you were giving Ben and the lack of it that he was getting so he decided to be cheeky which only seemed to make the matters worse.

A/N: I’m sorry this took way too long to write but I was literally so stuck with this and couldn’t settle with a proper ending or a continuation so I have at least 3 different versions of part 2. I think at this point there’s going to be at least 4 parts to this so yeah. Anyway, I just really wanna take the time to thank everyone who have been nothing but supportive of this. It really warms my heart and i’m so grateful for y’all. Also, I realised how Roger is actually hella angsty in this series but I promise, he’ll soften up!

"They'll be playing tonight as well," you said, handing out the flyer to a passer-by who smiled upon seeing the flyer, "Same place and same time tonight."

"Really?" grumbled Roger to a distant girl around your age, "You had to throw it in front of me? You couldn't have tried the next bin?"

"Roger," you called out in an attempt to calm him down.

It was a sunny noon graced with just enough clouds in the sky to make the weather pleasant and enjoyable enough to give out flyers for Queen's gig next week and promote the upcoming gig that same night.

"I spent hours on those-"

Your gaze shifted when you noticed a tall, buff figure from behind Roger walking towards you. It was Ben and he had a cigarette stuck between his lips which he shortly flicked away upon seeing you.

"Y/N!" He greeted, opening his arms to invite you into a hug, "What are you doing here?"

The scent of cigarettes and burnt bergamot greeted you as your head laid flat on his hard chest. It was intoxicating; his luring scent, his muscular frame but oh so gentle hug.

"I'm helping Queen give out flyers for their upcoming gig next week!" you explained, pulling away, "They've got one tonight as well."

"Fantastic!" Ben exclaimed, "My friends and I have been to their gigs and they play solid music. I'm a fan."

Roger was at a slight distance from all this, barely visible thanks to Ben's intimidating figure but nevertheless visible and there but it didn't seem like it to you anymore and he hated that. His heart wrenched with spite as his jaw clenched tighter before stepping in uninvited.

"Roger!" You greeted as your eyes shifted to Ben, "This is Ben, we take the same class for Linguistics."

Ben. Roger knew bloody well who Ben was. Ben was the twat whose number was written on his precious flyer, the git who had the audacity to call in looking for you and the idiot who was expecting to go on a date with you.

You turn to Roger who seemed to have a stiff smile plastered on his face and continued, "...and this is-"

"Roger Taylor," Roger huffed smugly before wrapping his arm around your shoulder, "Her boyfriend."

Your eyes widened as you feel your body tensed under Roger's firm arm embrace. Ben must have felt the same tension as you see his eyes squint in confusion and his brows drawn in some sort of frustration.

"I-I didn't know you had a boyfriend," he said, covering up his previous demeanour seamlessly with a gentle smile.

"Neither did I," you mumbled still at a loss for words.

"I best be off to class then," Ben coughed out and then turning to Roger, "Love your music by the way. I'm sorry if i've crossed any lines."

"Hardly," Roger chuckled, "We have another gig tonight if you'd like to come."

You watched with your mouth slightly agape as Ben walked away, reaching for his pack and then pulling out a cigarette to light up. Roger still had his arm around you and as seconds went by, the tension from whatever had happened was creeping in more and more into you.

"What the hell was that?" you yelled, breaking away from him, "You don't get to pull strings like that, Rog. That was out of line."

"He's not good for you-"

"You barely even know him," you argued back, making quite the commotion in public.

"He smokes," Roger pointed out sheepishly as he internally scolded himself for his weak rebuttal.

"And you dont?"

"I never said I wanted to be with you, did I?" he gushed out.

Roger often yelled out hurtful things out of anger and impulse but never had he wished to swallow them back in to let it rot in his organs just so he could turn back the time to just a few seconds back to right before he said it out. Never until that moment. Hurt was written in your eyes and he has seen the very same glassy look in your eyes before. Only then, he wasn't the reason behind them so they were much more bearable to look into. He knew that you'd come home to him and resort to his comfort and consoling but not this time - no. He was the reason behind the hurt and it killed him.

"Fuck you, Roger!" you yelled, stomping away from him, "Fuck you! Good luck making popcorn and juice on your own tonight."

Roger was notorious for his temper but you were never the victim of his spiteful impulse. Anger boiled inside you as you ran off to Ben. The thing was, whatever Roger had said shouldn't have affected you as much as it was affecting you and you hated that - your resentment became a clear sign that a part of you wanted to be with him.

"Ben!" you called out.

Ben turned swiftly, "Y/N?"

"I don't know what Roger was on about," you panted, "We're just-"

You paused, finding immense difficulty to continue the sentiment of your words, "We're just friends."

"Is that so?" he clarified, tucking a loose strand of hair behind your ear, "He seems awfully jealous for just friends, love."

"Yes," you said with all the confidence you could muster, "We've been friends since we were young, I guess he was just protective?"

"Sure," he said, "I just don't want to be crossing any lines. I don't quite see myself getting banned from Queen's future gigs."

"You're not, trust me," you said, not wanting to trust your own words, "What about we go for that dinner we've been planning for? Turns out my Wednesday night is free after all."

Roger growled as yet another orange squirted its pulps into his eyes. He had been bent over squeezing oranges and popping popcorn for the last hour or so and the amount of times he had orange juice squirted in his eyes were far too innumerable that it was beginning to get into his nerves.

The front door creaked open and Roger froze. His mouth fell and his eyes widened in hopes that he would see you walk in.

"Where's Y/N?" Brian asked walking in, "Wasn't this her idea?"

The heavy weight impending down on him once again; it was his guilt, "Out with some hunky twat on a date."

"Oh," Brian shrugged, walking past Roger, "Good for her-"

A pulped out orange flew above the table and landed with a heavy thud on Brian's head in courtesy of Roger and his temper.

"She's suppose to be here," Roger yelled, "With me! Not with some Ben guy she just met."

"So hunky twat does have a name," Brian stated simply, rubbing the back of his head where he had been hit, "I smell popcorn."

"Could you help me pour in the new batch to their containers?" Roger requested still in his quest to pulp out the few remaining oranges.

"Is this all necessary?" Brian grumbled but nevertheless complied heading to the kitchen to tend to the popcorn.

"Good for her," Roger mimicked Brian with malice, "Good for her?"

"What is it, Roger? Come on then, spit it out."

"Spit what out," Roger yelled back from the dining table.

"What are you on about?" Brian asked, "Why can't Y/N be on a date tonight, hmm?"

"Because we have a gig tonight and-"

"She saw us play two nights ago, surely she isn't missing out much if she misses tonight," Brian cut through his lies, "What is it, Roger?"

"I love her!"

Those three words errupted out of Roger like it had been hot magma boiling within him waiting for its release. Something about verbally saying it out loud made whatever it was that he was feeling for you concrete. It almost felt like he couldn't take it back, that this was it. He truly was in love with you.

"Then tell me this," Brian said, reappearing from the kitchen with popcorn in hand, "Why is it that she's out on a date with Ben and not ... you?"

"Because Ben is this hunky hot stuff and I'm a lanky-"

"You bloody well know that it's not that, Rog," Brian insisted, his eyebrows raised.

"Fine," Roger grunted, "I might have said that I didn't want to be with her?"

"God," Brian sighed, his head dropping low in disappointment.

"And she might have walked out on me yelling, 'fuck you'," Roger added, "A couple of times actually."

Brian took the seat opposite to him, "You know, for a relatively straight-A's student you can be quite daft sometimes."

Roger looked up with a firm glare, "You don't get it, Bri. There's too much at stakes here. We've been friends well before I even knew how to tie my shoe laces. We made sure to steer clear of ever dating each other, we even made a blood pact about all this when we were nine."

The thing was, you've dated before and evidently so has Roger but never had he felt any sort of resentment towards the idea of you out with a different guy so why now? What was so different now?

"How do you know it's love?" Brian asked.

"It's written in her eyes," Roger admitted, a smile creeping up on his lips, "I look into them and I feel limitless... powerful even, I always have. It's like as long as I've got her in my life then I've got everything. I never ever wanted to cross the line and actually try asking her out."

A stiff blanket of silence wrapped around them, Brian's eyes attentively at Roger's while Roger's was gazing hard on the table.

"Besides," Roger sighed, "I'm not good for her a-and whatever I don't want to ruin whatever we already have."

"Well it's not like your friendship is in a splendid state either is it?" Brian shrugged, "I don't know, Rog. Either be her friend and support her and who he chooses to date or if you're not happy with that then let her know how you feel - who knows maybe she feels the same way."

"I hardly think so."

"Not with the way you've been treating her lately," Brian remarked and poured himself a glass of Roger's orange juice, "Too much pulp."

On the other side of the city was a rundown diner, surrounded with neon lights that would flicker out every hour or so and squeaking bar stools. It was charming enough with their ever so kind staff that it covered up the evident need for a renovation. This diner was home to nightly dinners with Brian and Roger when the three of you had just moved into the apartment but those were good days, back when you were all less pre-occupied and not to mention more loaded.

"American or not, Arthur Miller is brilliant," Ben acclaimed proudly and then taking a sip from his milkshake.

"I never claimed to disagree. All I'm saying is, how can one be in complete awe of a playwright whose play he hasn't even seen?" You pressed on with a challenging smirk, crossing your arms.

"Ah, see that's the added factor to what makes a celebratory playwright. A good playwright delivers award-winning plays while an exceptional playwright could do the very same but would also be celebrated for his the script on its own," he explains thoroughly, "Miller is so good in what he does that I wouldn't need to see the play - everything's in the book, my love."

My love. You gush at his words, breaking away from his entrancing eyes and staring at his copy of "Death of a Salesman" which was chucked with pieces of papers in almost every other page showing just how passionate he was for Arthur Miller. It was way past twilight and the sky has transitioned into an inky blue, glittered with stars. Your evening with Ben had been nothing but delightful, just as you had imagined it would be but occasionally when there would be momentary silence, Roger's voice echoes in your head prevalently, "I never said I wanted to be with you, did I?"

"Should we take off?" Ben asked, interrupting you from your thoughts of Roger, "We don't want to be late for your friend's gig, do we?"

"Gig?" You clarified right before it processed in your head, "Shit! Queen! Tonight!"

Your mind has been so preoccupied with Ben and your resentment towards Roger that you have forgotten about helping Roger with the confectionery for tonight's gig which, to add on, you two were already late for. You jumped up and rushed off with Ben back to the campus where their gig was going to be at.

"Liar, liar, they never ever let you win."

Queen echoed through the walls of the hall and it almost felt like your heart was thumping to the song. You were nervous to enter and perhaps you were over thinking it but you had never been late for any of their gigs and you knew just how much this would bother Roger.

"You okay, Y/N?" Ben asked, looking deep into your eyes and reaching for your hand.

"Yeah," you lied, swallowing hard, "Let's go?"

His thumb brushed the back of your hand and you could feel it calming your nerves, "Don't want to miss any more songs, do we?"

You nodded and he took his cue, opening the doors to the hall. The music roared louder and you could feel it getting into you, almost connecting to your soul. Perhaps it was you being bias but you really did love Queen's music. You could feel your worries slipping away to the music but that was before you looked up and found Roger's burning stare pouring into yours behind his drum set. He was angry. His glare never left yours and even though his lips were pouted as they normally were you could feel his jaw clenched as he drummed aggressively.

Roger was furious and he made sure you knew that.

It was such a nice, relaxing Thanksgiving weekend. Having five (!) days off from work was so delightful.

On Wednesday, I slept in a little bit, then walked Miles, walked to the Y, lifted and went to a spinning class. I haven't taken an actual spinning class in over a year, and it was with one of my favorite instructors, Lew. I really enjoyed it. He was very nervous having a six-months pregnant woman in his class though.

Post-spin, I ran a few errands, finished packing, walked Miles again and then headed off to teach noon spin. I didn't know if anyone would come, but I had two people, so I was happy to teach. Tim took a half day at work, so we were on the road by 1:30. We hit a little bit of traffic leaving, but it wasn't too bad. For lunch, I packed us PBJs, cheese and apple slices like the adults we are. Once at my parents, we relaxed for a while, then got pizza with my sister and BIL. We hung out for a bit, even saw a double rainbow!

We then went to my uncle's for his annual Thanksgiving Eve party. I did not like all of the attention! Everyone kept asking to see my belly and telling me I am "sooooooooo tiny!" It made me so uncomfortable! Fortunately, my mom, Tim and I were ready to leave by 8:30 and we even talked my dad into coming home too, since we had the race in the morning. On Thursday, I walked Miles and then went for a three-mile run, which was meh. My calves were SO tight, but my foot felt OK. Tim and I headed over to the race, and met my parents and brother there. I peed THREE times before the race, but we finally lined up to go. It was high 30s, but very windy (we had a wind advisory!) so I opted for a light long sleeve and tank with gloves.

I told Tim I would start at 7:30 pace, but the gun went off and I settled into 7:15 pace. My splits were 7:13, 7:15, 7:19 (headwind), 7:20 (headwind) and 7:14. I was pretty impressed! Running hasn't felt super great lately, and this surpassed my expectations. I didn't get passed by any women, but two guys did outkick me to the finish. Oh well. I felt strong and controlled the whole race, and finished in 36:15 (I had 36:10 on my watch?). I was third in my age group and 10th woman. With nearly 500 people in the race, I was really happy with these stats. Tim came in shortly after me, followed by my brother and then my mom. My dad finished in just over an hour. I had no idea if I would be running at this point in pregnancy and I am so unbelievably grateful I was able to participate with my family. I am also proud to retain my crown of fastest in the family, although I only beat Tim by about 30 seconds.

They were quick with awards, so mom and I got our medals and then headed home to get ready. My mom won her age group! My sister's in-laws were coming and they arrived NINETY minutes early. I was in sweatpants with my hair in a towel. Sorry, not sorry.

The rest of the family started to trickle in around 1 and we ate around 2. Everything was so delicious! We then went to Thanksgiving dinner #2 at Tim's family's. We stayed there for a while before going back to my parents. This was the first Thanksgiving I have been stone sober in many, many years and it sure was interesting!

My poor uncle Patrick (with down syndrome) had ill-fitting pants on, he was SO uncomfortable and so cranky. I put him in a pair of my dad's old pj pants and he was a new man! It made me laugh, but also, I wish someone would have just let the man wear sweatpants. Anyway, I called it a night by 8:30. mostly everyone was leaving then so I didn't feel too bad. Miles was also over it. My sister's dog was TORMENTING him, so now Luna is banned from festivities if Miles is there.

Friday was cold and windy, I set out for a run. My calves were like bricks, it takes them so long to loosen up! I did average sub-9s though. Once home, Tim and I went to a coffee shop to meet up with Jill, Ray and Amy. I had a steamed cider and we spent TWO hours catching up with them. It was so nice! I was sad to say goodbye. My mom and I then continued our tradition of visiting the downtown Boscov's on Black Friday. It is like a relic in time - I LOVE going there; it is so fascinating to me. But I didn't find anything, except two teddy bears to donate at Sunday's hockey game. While we were doing that, Tim went to his mom's and then we left around 3 to go home. We were both pretty beat, so we just ate dinner and watched This Is Us. I think Miles knows there is a baby?!

Saturday's run was GARBAGE. Both my feet hurt SO badly, I was in tears by the time I called Tim to pick me up. I think I had the wrong combination of inserts and shoes. Or something. I pulled myself together, went to the grocery stores and then tried again with different shoes and inserts and felt much better! I still felt pregnant and slow and creaky, but my feet weren't in excruciating pain. There was a craft show nearby, so we walked over there and wandered a bit, but didn't buy anything except a beer (Tim) and a club soda (me - which they charged for!). Then, we came home and watched the Notre Dame game and just hunkered down. It was cold and I was tired.

On Sunday, it was cold, windy and rainy. My first few miles were awful, running felt SO hard. But then I met Tim and Rebuck and I felt much better. I was still running slow, but I didn't feel all the aches and pains as much. At 25 weeks today, I know it's time to cut my mileage. Post-run, I had grand plans of doing things, but I was just so, so tired. So, I did a bunch of laundry, read a bit and napped and walked Miles but generally, took it easy.

Around 3, we headed out to Hershey to meet Matthew and Angela, we got pizza and then went to the hockey game. It was the teddy bear toss, which means when Hershey scores the first goal, you throw a teddy bear on the ice and they collect them and donate them. It was really, really neat to watch.

However, it did take them close to 45 minutes to clear the ice, so we left after two periods (about 7 p.m.) and I went RIGHT to bed.

Today, I felt OK. My feet hurt, but not as badly as Saturday, and I have new inserts arriving today, so I am hopeful they help me. And yes, I am cutting back the mileage.

Daniel leaves that entire thing SUPER vague and while Violets conception coincides w/ the time that Beatrice and Lemony broke things off, it is also still entirely possible that she is Bertrand’s. So why would the Baudelaire’s continue to have children? Well my theory is fairly simple. Beatrice was most likely already pregnant with Klaus at the time, and Sunny was an accident (sorry sunny, u were a happy accident i promise Violet loves u).

BACK TO THE KIDNAPPING. So now not only do the Baudelaire parents want to keep any knowledge of the VFD from their children, they also start concocting a plan (with the help of who I can only presume is the Quagmires), to get a blank slate – to start over somewhere far away from the VFD’s grasp. And how exactly do they do this?

With Olaf’s fortune that was split between themselves and the Snickets.

The plans are finally ready to come to fruition, the Baudelaire parents are ready to flee. However, upon finding that their friend and partner in crime Kit Snicket is pregnant, they offer to include her in the plan, assuming she would want her child to stay away from the VFD in the same manner they do. So B&B can meet with Kit, whom they were also keeping a secret from the children.)

Sometimes it is difficult to distinguish between “flight” and “fight.” From the perspective of his critics, President Trumpevidences guilt at every turn and in every tweet. For Trump, his moves are merely the result of being a “counter puncher” who attacks when he is threatened.

The question of perception goes directly to the heart of the obstruction allegations leveled against him. Indeed, for someone approaching these questions as a criminal defense lawyer, disputes over perception can be the death of a prosecution. Crimes must be proven beyond a reasonable doubt. They cannot be purely matters of perception. That has been the case regarding the obstruction allegations made against the president.

I recently explored the status of the public evidence of collusion based crimes. It is now time to look at the status of obstruction of justice from information revealed in court filings, congressional investigations and witness statements. While special counsel Robert Mueller could offer new incriminating evidence in his final report, the evidentiary record remains strikingly anemic as a basis for criminal obstruction charges.

The issue is not optics but intent. Trump could not have created worse optics in his various actions and comments. He also acted inappropriately i reportedly pressuring officials to intervene either with Comey or to push to clear his name publicly. One of the most inappropriate moments came when Trump reportedly pushed Comey to go easy on Trump’s former National Security Advisor Michael Flynn. However, that incident is an example of how the same conduct can have widely different explanations. Trump can easily defend his statements as showing compassion for someone who had already resigned in disgrace. He was not reportedly asking for an end of the investigation.

Thus far, obstruction remains the bomb that never went off. Mueller has not been fired, Acting Attorney General Matthew Whitaker did not move to limit the investigation, and Trump has not pardoned key witnesses or associates before they could cooperate or testify. More importantly, any obstruction case must meet the elements of an obstruction crime, which usually involves obstructing a grand jury or destroying evidence. As I previously discussed, there are significant problems in shoehorning these facts into the criminal code and serious implications of stretching such definitions for future cases. Here are the most cited obstruction theories.

The firing of the FBI director

Before Trump fired FBI Director James Comey, some of us opposed the appointment of a special counsel absent a cognizable crime. The firing in May 2017 changed all of that. The result was predictable and catastrophic. Many of us, including some Republican congressional leaders, called for a special counsel to open an investigation. The president had supplied the very criminal allegation that had been missing in the collusion theories.

However, the obstruction theory tied to firing Comey has not improved with time. There were ample independent reasons to fire him. As the memorandum by Deputy Attorney General Rod Rosenstein had detailed, Comey was denounced by several former and current Justice Department officials for his poor judgment and violation of standard FBI procedures.

The political damage from firing Comey was magnified the next day when Trump met with Russian officials in the Oval Office. This was followed by perhaps the most disastrous press interview in our modern presidential history. The May 2017 interview with Lester Holt of NBC News would do little for an obstruction case. Yet, Trump began by giving his reason for firing Comey as a “grandstander” who left the FBI in “turmoil.” It was only later that Trump made the infamous statement, “I said to myself, I said, you know, this Russia thing with Trump and Russia is a made up story.”

However, Trump already said that he had made up his mind on Comey. He declared, “I was going to fire Comey knowing there was no good time to do it.” Indeed, he said he knew that the timing “will confuse people” and that he might “lengthen the time” of the investigation. These comments can be defended as obfuscation rather than obstruction. What Trump said to Russian Foreign Minister Sergei Lavrov and Russian Ambassador Sergey Kislyak present more of problem. He told the Russian diplomats the very next day after firing Comey, “I just fired the head of the FBI. He was crazy, a real nut job. I faced great pressure because of Russia. That is taken off.”

There is no question that Trump tied his firing of Comey to his desire to reduce pressure from the investigation. However, the statement would not be difficult for a defense attorney to address. Trump met with the Russians to restart relations between the United States and Russia. He can easily claim that he was trying to show that he would not be negotiating from a weak or vulnerable position. Trump will likely claim that he was assuring the Russians that he could cut any deal and was not in anyway hamstrung in going forward. Moreover, if Trump had sought to end the investigation, he failed to act along those lines in appointing the successor to Comey.

The Trump Tower statement

The Trump Tower meeting statement drafted by the president on Air Force One was yet another example of taking a hammer to his own head. He falsely suggested that the meeting was arranged to discuss the ban on Russian adoptions. It was, in fact, arranged for the express purpose of getting some promised evidence of criminal conduct by Hillary Clinton.

The statement, however, does very little to show obstruction. First, the question is, to obstruct what? The meeting took place in June 2016, long after the Russian email hacking operations were launched against the Democrats. It has no apparent connection to any collusion. Second, it does not constitute a crime to receive this kind of evidence from foreign sources or governments. No such evidence has been reported.

Finally, and most important, the obvious defense and likely truth is that Trump was “spinning” a negative story. He is not the first president to do so. The falsehood was the description of the purpose rather than the content of the meeting. Witnesses agreed that it ended shortly after it began when it became clear that the Russians only wanted to talk about adoptions. That is not worth much as evidence of obstruction of justice.

The tweets and attacks

The final evidence often cited is the litany of hostile and conflicting public statements made by Trump on Twitter and in interviews. Trump seems to encourage witnesses like Paul Manafort, Michael Cohen, and Roger Stonenot to cooperate with Mueller while attacking every negative disclosure. Trump has continued to make damaging comments despite the universal view among his lawyers that he only harms himself and his administration.

The problem is that these controversial statements are his political modus operandi, not just with the Russia investigation but on trade, immigration, foreign policy, and virtually every sensitive topic in the news. Trump also believes in a “deep state” conspiracy against him, a suspicion fueled by internal FBI emails showing open bias against him and his election. Trump proceeded to counter punch his way into an obstruction investigation, but these public comments would make for a poor prosecution against him.

For now, the obstruction theories against the president far outstrip the available evidence of the crime. Yes, Trump could not have worked harder to build a federal obstruction case against himself.
