SC orders the construction of 514 flats of Unitech, from auctioned property funds, SAVI Developers
To the relief of aggrieved home buyers of Unitech Ltd, the Supreme Court, on September 11, 2018, directed the realty firm to construct 514 flats in its five projects, out of the funds generated from the auctioning of its Kolkata property. A bench of chief justice Dipak Misra and justice AM Khanwilkar and DY Chandrachud, was informed that the group’s property in Kolkata was auctioned under the supervision of the committee headed by justice SN Dhingra, a former judge of the Delhi High Court. The property was auctioned at Rs 116.95 crores and so far, around Rs 28.89 crores had been received.
The apex court directed that the demand draft of the amount be deposited before the registry of the court. The registry, in turn, would deposit it in a short-term fixed deposit at the UCO Bank, situated in the Supreme Court compound. Advocate Pawanshree Agarwal, appointed as amicus curiae by the court to assist it in the matter, said that the balance amount will be deposited within a week, as assured by the auction purchaser.
Agarwal drew the attention of the court, to its order of July 27, by which it was said that 514 flats can be constructed by keeping a certain amount for them and delivered to the home buyers. The expert committee has demarcated five projects of Unitech, which include Vista at Gurugram, Unihomes at Mohali, Horizon at Greater Noida, Verve at Greater Noida and Unihomes 117 at Noida, for which flats will be constructed.

The bench said that Rs 21 crores should be transferred by the registry of the apex court to a Unitech escrow account, opened by the chairman of the committee, who is a signatory. “The allocation of funds and construction in the projects should be monitored by the justice SN Dhingra Committee,” it said, adding that the construction should be made strictly within the timeline agreed to and mentioned by Unitech before the committee.
The court said justice Dhingra will oversee the allocation of funds and construction carried out by Unitech, on the instruction of the committee.
The bench posted the matter for further hearing on September 19, 2018. The apex court had, on September 10, 2018, in another case related to Unitech, asked a local authority in Uttar Pradesh to deposit Rs 66.82 crores received from the firm with its registry, to refund those who have opted out of one of its housing schemes in the Greater Noida area.

SC asks Greater Noida to deposit Rs 66 crores, for refunding money to Unitech’s buyers, SAVI Developers
The Supreme Court, on September 10, 2018, asked a local authority in Uttar Pradesh to deposit Rs 66.82 crores, received from realty firm Unitech Ltd, with its registry, to refund those who have opted out of one of its housing schemes in the Greater Noida area. A bench headed by chief justice Dipak Misra, however, made it clear that the aggrieved persons, who had booked plots in the project, Uniworld City-Uni Homes Plots, Sector-MU at Greater Noida, could approach the consumer court for redressal of their grievances. The bench, which also comprised justices AM Khanwilkar and DY Chandrachud, asked lawyer Pawan Shree Agrawal, assisting the court as an amicus curiae, to verify the names and other details of the plot applicants, who wanted refunds.
Earlier, the court had asked Agrawal to create a portal, for registering the names of the buyers of homes or plots of Unitech Ltd, who wanted refund by opting out of the realty firm’s housing schemes.

“In the meantime, Greater Noida shall deposit Rs 66.82 crores, along with accrued interest, inasmuch as the said amount belongs to the developer, before the registry of this court. Pawan Shree Agrawal shall verify the portal, in respect of the present project, viz., Uniworld City-Uni Homes Plots Sector-MU, Greater Noida, so that this court can direct for pro-rata disbursement of the said amount,” the bench said.
The bench said that “As far as other grievances are concerned, the consumers can approach the concerned consumer courts and the dispute between the developer and Greater Noida, shall be addressed in due course.” The court posted the batch of petitions, including the one filed by Unitech Ltd and the plot buyers’ association for hearing, on September 18, 2018.
Senior advocate Mukul Rohatgi, appearing for the Unitech Ltd, said that 100 acres of land was allotted to the developer, which was to deposit Rs 555 crores to the Greater Noida authority and as of now, Rs 325 crores, including the stamp duty, had been paid. He said that around Rs 67 crores of the plot buyers, was with the Greater Noida Authority. Around 350 people had applied for the plots in the housing scheme – Uniworld City-Uni Homes Plots Sector-MU – at Greater Noida.
