Case Closed 18
The week with Kym’s mom was going well, she was so sweet and genuine just like Kym. And she was getting along great with Robert. Robert was able to get some work done. He did need to run out a few times, to talk with someone, pick out the ring and then pick up the ring. He made sure Kym was ok and safe with her mom. Internal affairs was pissed because he wouldn’t leave Malibu to come down to LA to answer their questions. He talked with them on the phone. The days flew by and Kym was getting much better, her scars were healing and she was happy.

Saturday morning they drive to Kym’s. She invited everyone over around 2 pm. Robert and Barbara were getting everything ready, Kym was trying to help but they both kept telling her to relax and take it easy. People started arriving and Kym was nervous hoping people wouldn’t dwell on her shooting. She kept Robert right next to her. She introduced him and her mom to everyone. As more people arrived and her friends were just talking Robert could feel her starting to relax.

Robert excuses himself and returns a few minutes later. He grabs Kym’s hand and pulls her into the middle of her living room. He realizes he isn’t nervous, but bursting at the seams with excitement to take this next step. “Can I have everyone’s attention!?” Robert yells. Greg whistles to help him out. “Thank you. I wanted to say how wonderful it is that everyone is here. I have heard so many great stories about Kym. You can see that everyone here really cares about you,” he turns his attention to her. “When you were injured, I was so scared of losing you. I am so thankful that you are standing here. I know I don’t want to miss a minute of happiness with you and I really hope you want you want to join me on this journey.” He lets go of her hand, he opens the ring box and kneels down. “Kym will you please marry me?”

She was shocked. She knew she brought it up last week and he said he would, but she figured it was just the start of the conversation not that he was going to propose. But here he was kneeling before her; a huge smile bursts across her face. She steps forward bending down throwing her arms around his neck. Tears drip down her cheeks. He stands up wrapping his arms around her body. “Yes. I will marry you,” she whispers through tears with her face buried against his neck. They hold each other in the middle of her living room with everyone clapping around them. They let go, Robert takes the ring out of the box and slips it on her finger. He looks into her eyes, “I love you,” he whispers and leans forward kissing her.

Everyone is congratulating them. Robert’s friends come over, slapping Robert on the back, hugging Kym, but telling her she was crazy to accept just to tease Robert. All the women want to see Kym’s ring, which is a 2 ½ carat oval cut diamond set into a white gold band. Robert is standing with his friend Matt and he’s just watching her and how happy she looks.

Derek walks up to Robert and quietly says, “Can we talk, outside.” Robert makes eye contact with him and he starts to walk away. Robert turns to follow. Matt knows by Derek’s tone he isn’t a friend, he turns to watch Robert and sees 3 other guys waiting by the back door. He knows there’s going to be trouble so he follows Robert out.

Derek is standing in the middle of Kym’s back patio. Three other guys are behind him. Robert hears someone and sees Matt walk up behind him and stand next to him. Another guy walks out the door and is standing back there. These guys were definitely looking for a fight.

“What the fuck do you think you’re doing? Why would you ask Kym to marry you when you know she’s too good for you.”
“What is your problem?!”
“You!,” he steps closer. “You know I’m not going to let her marry you.”
“Well I think that’s going to be her choice not yours.”
“We’ll see.”
Robert just shakes his head, turns and walks away.
“Fucking walk away, what a copout.”
Robert turns back, “I’m about to knock a cop out!”
Derek charges up to him, grabbing his shirt, “Then do it!”
Robert looks around, “Really convenient, I bet if I throw the first punch you have a bunch of witnesses, and if you do I bet no one saw anything.”
“That sounds like your problem not mine.”
Robert leans into him, “You know I’m not going to let you upset her.”

“Hey! What’s going on,” Kym says walking out her back door and through the group of guys. Derek lets go of Robert’s shirt.
“Kym I think you’re making a mistake,” Derek says.
“You’re wrong. I don’t know why you’re saying that.”
“Listen I talked to his ex - wife and she told me what a piece of shit he is.” That really pissed Robert off and he steps towards Derek. Derek turns and puts his hands on Robert’s chest. “What, you upset that I found out the truth.”
Robert points his finger into Derek’s chest, “Don’t talk to anybody I know or about me.”
Kym breaks them up, “Hey! Ok Derek can you just leave.”
“Kym I want to talk with you.”
“Maybe later. Can you just go. I don’t want to deal with any of this right now.” Derek walks away. The other guys follow. Kym leans into Robert. He rests his palm against her cheek and his fingers curl behind her head and he pulls her into his chest. He holds her for a minute while she calms down. Then she moves back smiles at him, they kiss then go back inside.

That evening they are lying in bed, Kym’s back against his chest, his right arm under and around her body, his left hand rubbing her side and thigh. Kym is staring at her ring; the reality still hasn’t set in that she’s engaged.
“Robert, you know as an officer you have to trust your partner. I don’t know if I can trust Derek anymore. I don’t know what to do. I might quit.”
“Baby, you can do whatever you want and I’ll support you. You can request a new partner, but you knew the stigma that comes with that. Or you can quit, or transfer precincts. If you do want to quit, I can make enough to support us both.” Robert wraps his arms around Kym his hands resting on her lower abdomen. “And you know if you do want to have kids right away, you might decide to quit anyway.”
Kym loved how protective he was of her. Just being wrapped in his arms made her feel like everything was perfect.

Transcript for Minutes before man’s scheduled execution, governor grants clemency: Part 6
Reporter: With father and son both back in Texas, jailhouse phone calls confirm Kent’s unwavering support of Bart as he awaits trial. Well, just hang in there. Keep calling. I love you. I love you too. I walk in this room with the bullet proof glass between us and there’s Bart. And he said, “Dad, I’m so sorry. This is all my fault.” And it was at that point I realized he was saying, “I did it, I’m sorry, I want to confess.” Reporter: He believes his son has truly changed and repented and now feels genuine remorse. He’s an amazing man. And, whether or not I’m a person incapable of love, I am a person capable of feeling a very deep respect for that man. I love him to death. Forgiveness is absolutely critical if you want to heal from your loss. If you don’t forgive, you’re basically shackling yourself to the event you want to grow past. Reporter: Bart, how do you feel about your mother? I wish I could talk to her now. I’d tell her I’m sorry. I’d like to redo that whole relationship from start to finish and be able to really appreciate what she was sending me. If we could all live twice. Reporter: Two years after his arrest. A jury convicts Bart Whitaker of the murders of his mother Tricia and his younger brother Kevin, and sentences him to death. If victims’ rights means anything at all it should mean something even when the victim is requesting mercy and not just when the victim is requesting vengeance. Reporter: Earlier this week, Kent took his fight to its final round, the Texas board of pardons and paroles. The prosecutor unmoved. The father didn’t want us to seek the death penalty. And he the victim. However, I don’t represent the victims per se. I represent the state of Texas. Reporter: Kent, who has now spent more than a decade making the weekly drive to death row, asked his son be given a life sentence with no chance of parole. The odds were stacked against him. Since 1982, there have only been three commutations so close to an execution. But then — Now to our top story tonight, a death row fight for life. Reporter: A phone call to Kent’s lawyer with news beyond his best hopes. A unanimous vote to recommend clemency. A recommendation for clemency. Oh, my god. It’s bizarre. It’s surreal. And we’re just so encouraged the system worked here. Reporter: But that controversial decision isn’t the final word. Would governor Greg Abbott accept the board’s recommendation? Kent goes to the governors office, but isn’t able to meet anyone in person. He is a very law and order kind of guy and believes in the death penalty. There’s a lot of speculation here and I don’t think anybody knows what the governor’s going to do. Reporter: For the longest time, governor Abbott did nothing. Bart is a dead man walking. He is taken to the death house. Prepped for the execution. Bart speaks to a chaplain. A last meal is served, chicken enchiladas. And then — This just coming into our ears. We understand governor Abbott has commuted the sentence of Bart. Reporter: And then, with barely 40 minutes to spare, for the first time in more than a decade, a condemned man gets clemency. It was overwhelming. I’m so grateful, so grateful. Thank you all so much. He will spend the rest of his life in prison with no possibility of parole. Reporter: For this father who’s endured so much, the long bittersweet journey has come to a close. I may have actually have the opportunity to be in the same room with him touch him, shake his hand, hug him. Reporter: The smallest gesture, promising to turn their past into a future together. Down the street.
