If approached with the question “What do these all have in common?” one would probably respond with something along the lines of “Well, they’re all card games.”
But how exactly is it possible for all these games to be played with the same deck of cards, produced by different manufacturers, with existing intellectual property (IP) regulations? The case of playing cards is incredibly interesting, but in order to discuss it, one must understand some key concepts about the various types of IP: Copyright, Trademarks, Patents, and Trade Secrets.
Copyright is one of many forms of intellectual property, and is created whenever an author of a work puts into a tangible medium, whether that be paintings, illustrations, writing, videos, or audio. It generally prohibits external users of copyrighted material from doing so unless they obtained permission [1].
Copyright also has both an exception and an end to make note of. The exception to copyright comes from the “fair use doctrine,” which allows for some copyrighted materials to be used without penalty, usually established on a case-by-case basis (works like parodies and criticisms, for example, may be allowed as fair-use) [2]. Copyright protections for a work typically end 70 years after their inventor passes away. Once this happens, the creation enters the public domain, a limbo where anyone can use a work, but no one can own it [3].
Trademark, another form of IP, is a word or image that is associated with a brand. In essence, they indicate the source of a product or service. For example, both the McDonald’s golden arches and using the term “Google” are both associated with companies. To see and hear both draws an automatic connection in a viewer’s mind about which brand a product or service belongs to [4].
Patents, unlike copyrights, must especially be deferred unto an applicant by the government. They allow an applicant the exclusive rights to produce their goods or service and offers legal protection, but only for 20 years after the patent is first filed [5].
Trade Secrets are yet another form of IP, but unlike the aforementioned types, trade secrets have no specific definition or jurisdiction of protection (except the Defend Trade Secrets Act of 2016, which allows owners of trade secrets to pursue legal action if their secrets are expropriated) [6]. For the most part, as long as an entity keeps a topic of commercial value a secret, it remains a trade secret [7].
So where do playing cards factor into intellectual property? There is evidence that card games have existed since the 9th century, but the playing cards used in America are and have been produced primarily by the United States Playing Card Company (USPCC), under famous monikers such as Bicycle, Bee, and Hoyle [8]. While the brand was recently acquired by Cartamundi [9], a report from the United States Patent and Trademark Office indicated that the USPCC has filed over 250 applications. Some of these trademarks cover the logos and box designs of all these brands, while others cover the designs for the backs of cards and most notably, the designs for the aces of spades found in these decks [10]. And because trademarks last as long as people can associate the symbol with the brand filing them, there is no end to these protections.
The trademarked card and ace of spades designs offer the perfect explanation as to why non-USPCC brands can continue to produce cards. Because only certain aspects of decks of cards are trademarked, other brands can produce their own cards so long as they do not violate those protections. This loophole allows companies like Gemaco [11] and Piatnik [12] to produce their own cards without legal persecution.
So the next time you sit down at a table for a card game, take a look at your deck’s manufacturer and designs. Who are they produced by, and if they aren’t from a USPCC brand, what differences do you see?
