Page 14. ---- See Government as Interested Party Seeking Their Lands --- CLAIM ACT ULTRA VIRES ----- Federal Parliament Has No Right to Enact Bill, They Assert --- (Staff Correspondence of The Globe) Ottawa, March 31. - "Beware of the Greeks when they come bearing gifts." Such is the attitude of the Indians of Canada in objecting to compulsory enfranchisement and education. In two memorials placed before the special committee which this morning began to consider the amendments to the Indian Act giving the franchise to the Indians, the Six Nations of Brantford, the Mohawks of Tyendinaga, Stregis and Caughnawaga, near Montreal, the Iroquois Indians of Oka, and the allied Indian tribes of British Columbia, presented arguments to show that these fair gifts would destroy their tribes, throw their lands into the hands of outsiders, and scatter them through Canada without any of the economic rights secured to them by treaties in earlier days.
First of all, through their lawyer, Mr. W. D. Lighthall, K.C.. of Montreal, they claimed that such an act was ultra vires so far as the Parliament of Canada is concerned, and that at Confederation such sweeping powers ware granted the Dominion Government as those now assumed by the Federal authorities. Because of this no evidence was taken this morning, but arguments on the constitutional point will be heard next Wednesday. Mr. A. E. O'Meara appeared for the British Columbia Indians, and a number of Indians were present as well.
Treated as Serfs. Both the Eastern and the Western Indians contended that it was illogical to say that the Indians were so intelligent and advanced that they should have the franchise and then refuse to consult them about it. This was treating them as "serfs," and that such enfranchisement took the Indian from the community of his relatives as a member the band or troop by a simple report of an "officer or person" who might have a dislike to him.
"It is feared," says the Eastern memorial, "that the effect will be that if an agent finds an intelligent Indian asserting any right the agent will be able to get rid of him by encompassing his compulsory enfranchisement."
By the same arbitrary process the Indians fear the lands or moneys of a band or tribe can be broken into, and that custodians of lands or moneys of the minor children may be arbitrarily selected. They state that under the proposed act a whole community can do compulsorily enfranchised and its lands and property sold to outsiders without any of the owners being in any way consulted. The Indians of the East respectfully submit that they have made considerable advancement in education and in improving their condition until many of them are equal in this respect to white people, and they petition the committee and the members of Parliament to grant them the right of consultation and consent in regard to their property and affairs. They particularly ask that their personal liberty to choose enfranchisement or not be left to their own will and discretion.
Reject Educational Method. The Eastern Indians say that Indian opinion is divided as to the educational clauses of the act. They are all in favor of more and better education, and believe that the Superintendent-General has a desire to advance their welfare, but they feel compelled to reject the method.
The allied Indians of British Columbia relate a history of 50 years of injustice, during which time they fought a losing battle against those who wanted to shift them to less fertile portions of the Province, contract their reserves, eliminate their hunting and fishing privileges and deny the rights they claimed. They see in the new act an effort to "break up the tribes of British Columbla," destroying their status and preventing them obtaining recognition of the tribal rights guaranteed them by Imperial enactment.
Seeking to Take Rights. "In this bill we see no genuine attempt to build us up materially, intellectually and morally, thus placing us on our feet preparatory to our becoming citizens, but, instead, an unjust attempt to tear us down by a Government posing as our guardian, and taking advantage of our weakness. We now see more. cearly than ever that the real position of the Government of Canada is not that of a guardian protecting our rights, but that of an interested party owning greater tracts of land in British Columbia and controlling vast fisheries on that coast, and because of these interests seeking to take away our rights."
The memorial ends by pointing out that until 1911 the position had been that the Provincial Government was the aggressor, while Sir Wilfrid Laurier's Government was favorable to their contentions. But since then the position has been reverted. They therefore appeal pas the Government to the Parliament and people of Canada for Justice.
[The position taken by the First Nations representatives here against revision of the Indian Act was 100% correct in its analysis. The 'method' being rejected, barely commented on in this piece, is the residential school system.]

That's why EA is fine-tuning its relationship with Toronto-based TransGaming Technologies, a company that has developed a technology that makes it relatively easy for publishers like EA to develop Mac-or Linux-versions of a game side by side the PC versions.Īccording to David McCombe, director of technical design for EA's strategic platforms group, TransGaming's technology effectively creates a "wrapper" that goes around a piece of software developed for the PC, allowing it to run on a Mac. The company was not able to meet that standard with any of the games it released for the Mac last year each Mac version ended up missing the PC launch date by weeks or months-something EA would very much like to avoid in the future. The news that Spore will be one of those titles and that it will hit Macs at the same time as PCs is a big move for the company. In a joint announcement last year at Apple's developers conference, it was revealed that the video game giant would be bringing some of its biggest franchises to the Mac. At the convention, EA will show Spore running on Macs. The announcement is timed to coincide with the Macworld Expo, which begins Tuesday in San Francisco. In its early stages, Electronic Arts' forthcoming and much-anticipated game Spore was code-named Sim Everything, a play on its heritage as the newest game by The Sims creator Will Wright.īut now, "sim everything" has another meaning for the company: EA is set to announce Tuesday it will release Spore later this year simultaneously for PCs and Macs.
