Handicap Parking isn’t for People with Handicaps Anymore

Everyone has their pet peeves. Personally, I can’t stand when people illegally park in handicap parking spaces. It is incredibly dismissive of the everyday adversity that people with disabilities have to face, and it’s inexcusable. This semester, I’ve been studying the Fair Housing Act and the Americans with Disabilities Act, both federal laws designed to protect those with different abilities. I’ve called the police over a dozen times to report the rampant abuse of handicap parking that happens in and around MSU’s campus. I have a friend who lives at an apartment complex near campus. I noticed that people at the complex constantly abuse the handicap parking spaces. After calling the parking authority on four separate cars over the course of about 5 days, I was told by the ELPD that unless a parking spot has a designated sign, it is not legally a handicap parking space, and they can’t ticket those who park there without proper credentials. Under the ADA, it is required that apartment complexes have at least one handicap spot for every twenty non-handicap spots. Since this apartment complex doesn’t legally have any (without the proper signs), they are legally noncompliant with the ADA. The penalties for this are stiff. Getting the federal government to enforce this law, however, is a different story. I brought this to the complex’s attention five times this semester. The first three were met with no response, or “We will take care of it”, and then no action. Next, I contacted the Department of Housing and Urban Development. HUD directed me to the Michigan Department of Health and Human Services. MDHHS directed me to a fair housing center for my area, which I contacted. They informed me that, in order to file a complaint, I had to be someone with a disability who was affected by the lack of handicap signs. While I do have a disability that requires me to have a handicap pass, I don’t need it at the apartment complex. I explained that I simply want to correct this situation before it becomes a serious problem for someone with a disability. They told me again that I had to either file as the complainant or drop the issue. I contacted the apartment complex once again and let them know that I would be filing a complaint with the fair housing agency and that they could face a lawsuit or stiff fines from the federal government. They replied and told me that they had ordered the signage and that I could expect to see it installed in the parking lot soon.

Three weeks later, they finally installed them!

While this is a personal victory for me, it made me (more) aware of a painful truth: those with disabilities are largely ignored by society as a whole. While there are literal federal laws in place to protect people with disabilities, those laws are meaningless if not enforceable. As someone who is mostly able-bodied and functionally neurotypical, it is my duty to do all that I can to help those who can’t help themselves.
