चैतन्य भारत न्यूज दिवाली का त्योहार दस्तक देने वाला है और ऐसे में कई लोग पटाखे फोड़ने की प्लानिंग कर रहे होंगे। लेकिन इस दिवाली आपको पटाखे फोड़ने पर जेल की हवा भी खानी पड़ सकती है। साथ ही भारी भरकम जुर्माना भरना पड़ सकता है। जानकारी के मुताबिक, पर्यावरण संरक्षण कानून के तहत प्रदूषण फैलाने वाले लोगों के लिए 5 से 7 साल तक की जेल की सजा का प्रावधान किया गया है। साथ ही ऐसे व्यक्ति पर जुर्माना भी लगाया जा सकता है। (adsbygoogle = window.adsbygoogle || ).push({}); सुप्रीम कोर्ट बार एसोसिएशन के उपाध्यक्ष और सीनियर एडवोकेट जितेंद्र मोहन शर्मा और एडवोकेट कालिका प्रसाद काला का कहना है कि, हवा को प्रदूषित करने वालों पर रोक लगाने के लिए पर्यावरण संरक्षण अधिनियम और वायु प्रदूषण नियंत्रण जैसे अधिनियम बनाए गए हैं। जिनके तहत वायु प्रदूषण रोकने के लिए आदेश देने और कार्रवाई करने का अधिकार दिया गया है। सुप्रीम कोर्ट के सीनियर एडवोकेट जितेंद्र मोहन शर्मा का कहना है कि, 'शुद्ध वायु जीवन से जुड़ी हुई है और किसी को वायु प्रदूषित करने का अधिकार नहीं है।' उन्होंने बताया कि 'संविधान के अनुच्छेद 21 के तहत जीवन जीने के मौलिक अधिकार के तहत स्वच्छ हवा पाने का अधिकार भी आता है। खास बात यह है कि सुप्रीम कोर्ट भी अपने फैसले में यह बात साफ कर चुका है।' शर्मा ने बताया कि, 'अगर वायु प्रदूषण होता है, तो इसका स्वास्थ्य पर बुरा असर होता है। सरकार की जिम्मेदारी है कि वह अपने नागरिकों को साफ और स्वच्छ पर्यावरण मुहैया कराए। सुप्रीम कोर्ट ने नागरिकों के जीवन जीने और स्वच्छ हवा पाने के मौलिक अधिकार की रक्षा के लिए ही दिल्ली-एनसीआर में पटाखों के फोड़ने और बिक्री पर रोक लगाई है।' Read the full article
