#discovery demands can request digital files

hey so how come lawyers like so much PAPER?
sincerely, the person in the copy center who has to print all these goddamn binders
Man, it is the worst. I grew up file clerking for my dad and it was so terrible that I decided I would never be a lawyer. SO much paperwork. Ugh. Horrible.
But also, if you're in trial, you want all of the information in the entire case at your fingertips, and you want to know exactly where every piece of info is--which means that you have it hard copy, because a laptop can glitch or lag or crash but paper abides.
Also, in a lot of circumstances, you need a physical item in order to admit something as evidence, because the court physically marks it with a sticker label. So you print photos, documents...even for video files, you have it on a disc or USB that the court can put its little evidence sticker on. And then, depending on the type of trial, all that evidence may go with a jury into a jury room to look over, and you don't really want to give them a wholeass laptop, because that's just asking for improper non-evidence information to be considered.
And if you're feeling like a jackass when complying with discovery demands, you can give the requested information on physical paper and that's fulfilling the demand (unless it was specifically for digital format) but it's not searchable in the way that a PDF would be--you can't control+F for the info you want, you have to read through reams of paper. Which you should do, for thoroughness, but...it's time consuming. So you can play petty little games and give people hardcopy to make their lives marginally more difficult.
Ultimately though, lawyers just really love deforestation. Fuck them trees.
#im joking lawyers love trees#tree law is great#discovery demands can request digital files#but if they dont then sometimes people play stupid games#personally i try to avoid pettyness because it usually backfires#but its a thing that happens#none of this is absolutes btw the law is different everywhere#we are a paperless office but we print entire casefiles for trial

Found: Page 25 of the CIAâs Gateway Report on Astral Projection
Page 25 of the CIAâs âAnalysis and Assessment of The Gateway Processâ hitched a ride with an email one evening and landed in my inbox. A digital attachment felt like an unceremonious entrance for a document that was produced 38 years ago and has been missing and highly sought after since it was declassified in 2003. For years, people had been filing FOIA requests and speculating about what was on this missing page in the middle of a mind-bending report about military research into astral projection and other dimensions. And then, there it was, just downloaded on to my desktop quietly looking back at me. My immediate reaction was frenetic; I couldnât chill out long enough to properly read the rogue text. I called a few friends to ensure my reality was synched properlyâa telephonic pinch to verify I was awake. All signs pointed to mostly. I double clicked the file.
Letâs get into it.
Screengrab: CIA
A Whirlwind BackstoryÂ
I published a breakdown of the CIAâs Gateway Report in February. The classified 1983 document was produced by US Army Lieutenant Colonel Wayne M. McDonnell, with a technical power-assist from mastermind Israeli-American biomedical engineer Itzhak Bentov. The report was declassified in 2003. It packs a tour-de-force investigation into the potential achievability of astral projection into 28 hyper-dense pages. A spectre has hung over the report since. The version released by the CIA was missing what seems to be an extremely crucial page.Â
IMAGE: SPECTRAL-DESIGN VIA GETTY IMAGES]
For the uninitiated, astral projection is mostly interchangeable with the psycho-physical phenomena of out-of-body experiences and remote viewing. With the right guidance and technologies, astral projectors believe, we can train our consciousness to move beyond the confines of the space-time dimension. This super-ability frees our human minds to travel through the universe, exploring an endless array of normally imperceptible realities and dimensions.Â
McDonnell states early in the report that his goal was to "construct a scientifically valid and reasonably lucid model of how consciousness functions" in order to put "out-of-body states into the language of physical science to remove the stigma of its occult connotations."
The Department of Defense's ambitions are made clear in the report's conclusion: McDonnell suggests that if the military were to experiment with astral projection, it could find "practical application," but also noted that it should "be intellectually prepared to react to possible encounters with intelligent, non-corporeal energy forms when time-space boundaries are exceeded." It kicked off years of attempts by the US Army to train psychic soldiers to conduct âremote viewingâ missions to regions across the world.Â

A Cosmic Mystery
The report is a vicious mind labyrinth. For 24 pages, it winds its way through the spiritual and scientific underpinnings, techniques to achieve and potential applications of space-time transcendence. It introduces methodological frames of reference like hypnosis, transcendental meditation, spiritual belief systems, biofeedback, quantum physics, and universal holograms only so that its intended audienceâCIA top brassâmight merely begin to grasp its (and our) bigger reason for being. By the bottom of page 24, McDonnell reaches a full existential crescendo, broaching the very nature of reality itself. Itâs a cliff-hanger:
Image: CIA
And then ⌠the report skips to page 26.Â
As if he hadnât just side-stepped revealing the secrets of the heavens, McDonnell is on to a set of pragmatic âMotivational Aspectsâ for why the CIA might employ the Gateway as opposed to other methods of achieving astral projection.
Image: CIA
Expediency Wayne? Really?
Since the report's declassification, countless FOIA requests have been filed demanding page 25âs release. In every instance, the CIA has denied they ever had it in the first place. Page 25, then, has been the holy grail not just for would-be astral projectors, but also for conspiracy theorists, government transparency activists, and people who have simply read the report and found themselves maddened by this missing information.
Image: CIA Foia response
One fantastic internet theory maintains that McDonnell omitted the page intentionally. If someone could successfully astral project theyâd be able to tell him whatâs on it.Â
Contact
The CIA did not invent the Gateway Report and the Gateway Experience on its own. It used teachings from a man named Robert Monroe, who later founded an organization called The Monroe Institute. Â
Four days after we published the first article about the Gateway Report, I received a note from The Monroe Institute. They had some ideas for a follow-up piece. Drowning in responses to the article though, I failed to return their email. They reached out again. This time their message was more concrete: Sitting buried in the Monroe Institute archives in Faber, Virginia, was page 25 of The Gateway Report. But it didn't come to us easily.
Our first scheduled phone call included The Monroe Instituteâs CEO, COO and marketing division. Motherboard Editor-in-Chief Jason Koebler and I got on a Google Hangout.Â
In that call, the Institute said that they had Page 25. People had been trying to obtain the report from the CIA and had repeatedly failed. But no one had bothered to ask them for the report; they'd had it all along. At one point, they described the report as having been "in a barn," unexamined, for all of these years. Otherwise, the call was uninspired. The CEO didnât show. After an hour run-around it became evident that The Institute wasnât going to part with Page 25 without some carefully orchestrated marketing plan. The words of COO Lori Jacobwith made their purpose clear, âWeâre attempting to capitalize on some of the enthusiasm by a market that isnât our normal age group.âÂ
The institute was hoping to tap into the popularity of our first article, as well as some viral TikToks about the report.
The call ended with âYouâve touched on some things we are not talking about right now.âÂ
The Institute then went quiet. Time passed.Â
One evening, the Monroe Instituteâs Director of Marketing & Communications Jenny Whedbee emailed again. She'd been silent on our last call. The email contained the full Gateway Report including the missing page. She wrote that theyâd just âwent through a major org change.â The CEO and COO were no longer with the company. She was now down to talk, after we had read page 25.
The Missing Page
In the true spirit of discovery, I am pleased to present the full uninterrupted report in all its glory. Â
The page opens with the word âAbsolute.â It sits there authoritatively, as if guarding the gate to the rest of the text. In the broader context of the report the term is applied to both spiritual belief systems and quantum physics alike. It's an important word.Â
Physicists define time as a measurement of energy in motion. In this way, time is really a measurement of change. In order for that motion to occur though, it must be limited inside a larger vibratory pattern. Inside this framework it is limited, contained at a specific location. That confinement then makes it distinguishable from other locations in space. Uncontained energy is force without limit. Imagine a formless entity speeding through the galaxy with no friction to hold it back from being everywhere. As McDonnell puts it âThere is no 'here' to differentiate it from 'there.'â And this, my friends, is an absolute state or âThe Absolute.âÂ
According to the report, the Absolute is essentially the governing energy of the Universe en masse. It powers the universal hologram that is all of entirety. The report makes multiple attempts to visualize this universal hologram or âcosmic eggâ as one big constantly flowing spiral.Â
Screengrab: CIA
Between the reality we know and The Absolute are countless intervening dimensions, McDonnell writes, which is pretty trippy stuff for a government report. Absolute is the ceiling (as far as we know it). End of the line, and a hell of a way to open a missing page.
McDonnell observes that a âstylized representationâ of this spiral is present in every religious system in history. He cites the specific examples of Christianityâs Holy Spirit, the Hellenic worldâs labyrinth, the Hebrew Tree of Life, its Hindu counterpart, and the Chinese Spiral Through the Four Powers. This thinking has found its way into each systemsâ teachings.Â
The crucial distinction between the breakthroughs in modern physics and the epiphanies of religious thinkers is the way they all found The Absolute. Whereas physics leans on quantitative research, religions relied on intuition. The Gateway then sort of showed up just in timeâa holistic mainline for âinterfacingâ with the universal hologram, freeing us from the limitations of a left brain logic-based culture.Â
The pageâs third section takes a slant which should feel familiar to adherents of modern psychology. The universe, the Absolute, the cosmic egg. All of it is irrelevant, and certainly unreachable, until we possess knowledge of ourselves. My eyes, upon first glance of page 25, picked up âThe Absoluteâ first, then darted swiftly to the aphorism McDonnell trots out hereâ âKnow Thyself.â What hits even harder than achieving a psychological self-understanding, according to McDonnell, is the sense of self-perception achieved when one can manage to alter their state of consciousness to the point where the universal hologram itself can be perceived.Â
And itâs The Gateway Experience, McDonnell says, that promises this possibility.Â

Achieving Hemi-Sync
Key to the report and technique for achieving astral projection is an audio technology developed by Robert Monroe, a radio broadcasting executive who, in the 1970s, built an R&D division inside his company solely to study the effects of sound on human consciousness.Â
In a series of self-experiments in which he exposed himself to carefully calibrated audio frequencies while sleeping, Monroe repeatedly achieved elevated mind-body states. His 1971 book Journeys Out of The Body documents those early investigations and officially coined the term âout-of-body experience.â
Books by Robert Monroe
Monroeâs corporate R&D division eventually became The Monroe Institute, which produces tapes containing audio techniques to stimulate brain functions and achieve âHemi-Sync.â Hemi-Sync is short for hemispheric synchronization, and is instrumental in achieving a state of consciousness in which the electrical brain patterns of both left and right hemispheres are equal in amplitude and frequency.Â
It does so by combining two techniques. The first is Frequency Following Responseâa recognized external frequency is introduced by headphones, which causes the brain âto try to mimic the same frequency by adjusting its brainwave output.â For instance, a resting brain that hears a Theta level will shift out of its Beta level. The second technique is beat frequency. Contrasting frequencies are introduced to each ear. The brain then âchooses to âhearâ the difference between them.â A brain receiving 100hz through the right ear and 104hz through the left, can then detect the delta, in this case a 4hz frequency. The technique then opens the brain to âa variety of frequencies which are played at a virtually subliminal, marginally audible level.â
With the left brain relaxed and the body in a virtual sleep state, according to the report, the conditions are ideal to promote brainwave outputs of higher and higher amplitude and frequency. When the wave pattern of a consciousness drops below an oscillation frequency of 10 to the power of -33 centimeters per second, for a brief instant it âclicks outâ of space-time and joins infinity. Monroeâs theories maintain that if that âclick-outâ can achieve continuity you can begin dialoguing with other dimensions.Â
Image: CIA
The Monroe Institutesâs chief engineer today is Bob Holbrook. A former events producer, Holbrook believes the Monroe Institute's audio offerings helped him rehab from head trauma sustained in a brutal car accident. The Hemi-Sync technology featured in The Gateway Report was sold to a company now called Hemi-SyncÂŽ. The audio technology stack The Institute now producesâcollectively called Monroe Audio Support (MAS)âis a hugely evolved version of the original binaural beats-based technique. As Bob puts it, âBinaural beats was just one technology, now we have 50.â This widens and populates the spectrum of experience for participants. âMAS takes the idea of binaural beats and utilizes many other âcolorsâ and technologies to create more intense experiences in different levels of consciousness.â A key MAS ingredient is gamma synchrony. âIt allows us to connect much more easily to 'all that is,'â he said. Two additional innovations play a central roleâPhase Modulation and Amplitude Modulation. Phase Modulation changes the direction from which a sound feels like itâs coming from. Bob shared an audio-visual animation illustrating sound source oscillation.Â
Amplitude Modulation gives technicians the capability to drop into the soundscape live and manipulate specific aspects of the volume.Â
The Institute shared a 30-minute sample of their newer programming for this article. Headphones are essential for full results.Â
The Monroe Instituteâs tapes combined these frequencies with subliminal suggestions from Monroe himself. An archive titled âThe Explorer Seriesâ contains recordings of the Monroe Institute Research Divisionâs experiments, in which subjects âreport from these non-physical environments.â
Up until COVID, all meditators physically travelled to The Monroe Instituteâs palatial headquarters in Faber, Virginia to work through a series of increasingly challenging levels. The 7-day course offers the possibility for oneâs consciousness to navigate space, time, and beyond. That is, if youâve got what it takes.Â
Itâs these tapes and their potential applications that caught the attention of the CIA and prompted the commission of the report.Â
The Monroe Institute Today
After I read page 25, I called Jenny Whedbee back up.
She said Monroe is an organization that was trying to find its way in an ever-shifting world. âThereâs a part of this organization that definitely needs to grow, but it needs to grow at a pace that keeps with the tenets of who we are,â she said. The importance of listening to where an organization comes from before deciding on a future was a theme. âIf you donât have the input from people who have been here a while, then youâre not really staying true to what the Institute is.â
Paramount to staying that course is the guiding light of its influential founder Robert Monroe. âWeâve had a lot of executives come and go. I know Robert Monroe is still here and still trying to run things,â she said.Â
Itâs this pioneering energy that powers her enthusiasm. In reference to their newer classes, she explained, âGateway Voyage is primarily the same exact program that Robert Monroe developed. And so is Lifeline, Exploration 27, Guidelines. Those core programs, he actually worked on and developed.âÂ
âIt puts you into direct experience with expanded states of consciousness where you can explore and ask questions and receive answers and visit past lives," she said. "You can astral travel.â
These programs are grueling. Participants go through five or six exercises a day for five straight days. âItâs like running a marathon,â she said.Â
Jenny joined the company without much experience in consciousness elevation but swiftly got the feel for things. âIt did exactly what the course said it was going to do," she said. "I experienced past lives. It gave me this 20,000-foot view of my life. Not just this one, but previous and future.âÂ
âIf you want the rocket ship where your life is forever enlightened, youâre not going to get that any other way than coming here,â she said.Â
The conversation with Jenny eventually turned to page 25.Â
âI have my own interpretation," she said. "Whether it was accidentally or intentionally left out I donât know. Like I said there are people that work in this place that are on another plane and not here in the physical.â
For Jenny, the page appeared at the right time and place. âI feel like 20 years ago the world wasnât ready to hear. But this generation is ready.â She says the institute changed her life.
âYou grow up, you go to school, you get married, you have kids, you go to church, you die," she said. "And your life lives on through your family. There is value there. But on a much deeper level itâs the relationships and the memories you create. Not all this stuff weâre collecting. So what if that page was released 20 years ago? Could it have backlashed? Cause it talks about religion and that all religions are equal. And what if people feel really powerfully that not all religions are equal. I feel like the generations nowadays, theyâre not so wrapped up in that anymore."
Jenny said that young people today are pushing for social justice and are more open to different perceptions of consciousness and different ways of living. "Thereâs this whole thing going on where people are awakening," she said. "People become more conscious, people become more awakenedâtearing down the monuments in Richmond. Enoughâs enough. This has come about at a time when your generation has questions and they want to know and theyâre ready to hear the answers without judgment.â
âTikTok happened, you happened, all this happened for a very important reason thatâs not of this physical plane,â she said.Â
Jenny concluded our hour-long conversation with a suggestion for how to handle page 25. âDo something with it. You know even if itâs you just saying what it means to you.â
[Hold my beer]
A Consciousness Feedback LoopÂ
The Gateway Report is so dense in parts, it compromises its own accessibility. The goal of my initial synthesis was to create a written and visual experience (including, ahem, some premium custom graphics) that might help folks without a PHD in quantum physics benefit from its huge thinking.Â
It struck a nerve.Â
Over the course of a 3-week period, millions of readers made their way through an admittedly arduous editorial obstacle course. Studios reached out.Â
Two days after the articleâs release, we inserted an invitation:Â
âHave you had an experience with The Monroe Institute, Hemi-Sync or had an out-of-body experience? Get in touch: [email protected]âÂ
Thousands of emails came in from folks all over the world who described their out-of-body experiences. To me, it signaled the possibility that many of us are searching for something more than what seems currently available. To describe my experience in telling this story and the search in many senses, I produced a visual reinterpretation of page 25.

'The Gateway' is a high-resolution digital image of a print of the missing page 25 of the CIA's Gateway Report. It contains 659 digital micro-inscriptions of out-of-body experience accounts, that only become visible at 300%+ magnification.
Just look closer.

The Benefits of Document Scanning for Your Business
If your company is like most, then you have sections of your office dedicated to storing records. It could be in dozens of filing cabinets, the basement, an entire records room, or stacks of drawings in long drawers. Maybe itâs in all of those. But thereâs something that can help with some serious benefits: Document Scanning Services.
By scanning your documents into digital files, you unlock some serious benefits for your organization. Read on as we cover some of the basic and extensive benefits.
Basic Benefits of Document Scanning
1. Cut Costs, Increase Productivity, and Improve Access to Key Information laptop document management systemThese are the three most common reasons that people consider scanning their documents. The decision is usually spurred by losing time to the filing cabinet or accidentally misplacing documents.
An AIIM (Association for Intelligent Information Management) survey found that on average, it takes 37 minutes to find a paper copy of a document in a filing cabinet. Those are 37 minutes that could be spent helping a customer, making a sale, or improving the company, but instead, theyâre being used to locate a single document.
Having your files scanned and located in a centralized document management system enables you to do this in under 25 seconds.
Not only can you get to key information faster, but you also donât have to spend money on storing records (onsite or offsite), you donât need to habitually purchase boxes or filing cabinets, and you wonât need to pay for the costs associated with printing and mailing records.
2. Faster Audits, Discoveries, and Compliance Organizations and departments that are subject to audits, discovery demands, and Freedom of Information Act (FOIA) inquiries would greatly benefit from scanning. If you deal with these requests, you know that they are often high-profile and extremely time sensitive.
So how do you cut back on information retrieval time? Text-searchable digital files. A scanning strategy should be a key part of your agencyâs risk assessment plan. Digital records are easy to store and search. They can help you quickly comply with requests and avoid fines and negative publicity.
Our clients have seen audit times reduced by 80% once their records have been scanned.
3. Better Data Preservation scan your old documentsAs great as rare books and old documents are for research purposes, you also donât want to handle them too much.
By scanning these historical items, along with any record that is important but getting fragile from age, youâll preserve this information digitally. No matter what kind of research you, an employee, a customer, or patron does, you wonât need to worry about them handling delicate materials.
Digital files also keep your information safe in the (hopefully unlikely) case of a fire, flood, or other natural disaster.
4. Disaster Recovery And speaking of natural disasters, paper records are vulnerable to several threats. Data on computer systems is backed up, but there are no backups for paper records. Because of the lack of backup, most small businesses hit by a natural disaster never recover. Scanning your files should be part of your business continuity plan.
By digitizing your files and storing them in a cloud-based document management system (or having a backup in an off-site server), you can bounce back from disaster with minimal disruption for your clients. Electronic documents allow you to get all the required files to your insurance company or the government quickly.
This is a good option even if you donât have a full-blown disaster. You should have a digital backup for your important financial documents, licenses, permits, tax information, and anything essential to run your business. Digital files mean that your information is safe even if you have some minor flooding or fire.
5. More Space in Your Office get back space with document scaningItâs a little obvious, but if you donât have boxes and filing cabinets all over your office, you can reclaim and reuse that square footage. With your paper documents scanned and stored on a server or the cloud, you will probably find that you have more room in your office than you thought. This may mean that if youâve been running out of room at your office, you donât need to move after all.
If you do want to move to a new office, why take all that paper with you? Over 30% of the scanning work we get is based on a move or relocation because storing paper records in prime real estate is expensive. (And if you are moving, make sure that you grab our free office moving checklist!)

Meet the Steve Jobs of the AC repair in Gilroy Industry
â˘Subject Upkeep Technician Jobs, Employment In Morgan Hill, Ca
As discussed above, plaintiffs' motion to compel is meritorious. They are entitled to production of ESI within the format they requested, with all metadata, and CDE has again failed to provide a proper privilege log. Plaintiffs are due to this fact entitled to their "affordable bills" incurred in making the movement to compel, "including lawyer's fees." Fed. P. 37; see Balla v. Idaho, 677 F.3d 910, 920 (9th Cir. 2012) ("Rule 37 requires the court to award attorneys fees in most circumstances where 'the disclosure or requested discovery is provided after the motion was filed'"). Despite this concession made during negotiations, the courtroom does not find that plaintiffs have thereby waived their right to hunt manufacturing of ESI in native format with all metadata connected. To the opposite, this concession seems to have been a "provisional" one made for negation functions only. At all different occasions, plaintiffs have constantly insisted upon native format, with metadata hooked up, and complained about CDE's failure to produce in that format.
Also, quite than proposing an alternative format to produce ESI, the letter merely declares that CDE has already produced ESI in "load file" format, and asserts that that's adequate. CDE was entitled to ignore plaintiffs' request that ESI be produced in native format with all metadata attached, since it produced it in a "fairly usable" type that didn't "take away or degrade the searchability of the information." ECF Nos. at 6, ECF 277 at 12. CDE timely objected to manufacturing in native format, knowledgeable plaintiffs that it will produce in "load" format, produced samples in that format, after which received no objection from plaintiffs until most of the manufacturing had been completed.
They did not indicate what was the topic of the communication, and instead merely reprinted the subject line of the email. Incredibly, the subject line itself was usually redacted, making it impossible to know what the e-mail was about. Indeed, the log appears to betray CDE's incorrect view that any e mail from or to any lawyer was privileged , no matter who else may have seen it, what it involved, whether or not it was intended to be confidential, and whether the privilege was waived. On August 29, 2016, the courtroom suggested CDE that the privilege log was inadequate. Plaintiffs argue that the privilege logs don't present sufficient info for it or the court to evaluate the assertion of privilege. To the contrary, they argue, the "descriptions" of the withheld documents are at most, simply conclusory statements, that are primarily simply the legal definition of the http://query.nytimes.com/search/sitesearch/?action=click&contentCollectionÂŽion=TopBar&WT.nav=searchWidget&module=SearchSubmit&pgtype=Homepage#/AC repair in Milpitas CA privilege or safety asserted. CDE initially objected to the production of almost any materials, on May 17, 2013, when it filed its initial objections.
Plaintiffs move to compel CDE to produce emails in "native" format with all metadata connected. Defendant additionally seeks a protective order stating that "the burden of producing the requested metadata outweighs any probative worth." Id. at 3. The services are provided ââŹĹas is,ââŹÂ with no warranties in any respect. All express, implied, and statutory warranties, including, without limitation, the warranties of merchantability, health for a particular objective, and non-infringement of proprietary rights, are expressly disclaimed to the fullest extent permitted by law.
1, ECF at 17 ; Joint Statement, ECF No. one hundred forty four at 55 ; Sagy Exh. 7, ECF at 79 (August 22, 2016 Sagy letter, complaining that email attachments are not of their "original" codecs), Exh. plaintiffs, in an August 26, 2016 letter, more than three years after the document request was served. While the letter doesn't even point out metadata, the courtroom construes it to be an objection to plaintiffs' request for manufacturing of ESI in native format with all metadata connected.
On August 26, 2016, CDE wrote to plaintiffs, and for the first time, specifically objected to producing ESI in native format. According to CDE, they have produced ESI "as load information, a standard format accredited by the Special Master on April 7, 2016." Id.; ECF No. at 2-3. CDE argues that " requesting celebration can not demand production in a single format versus one other simply because one would allegedly ease a party's review process." Id. at 89-ninety, citing United States ex rel. smart72 has diagnosed 1000's of residential properties. Their technicians have been trained and geared up with the most recent knowledge of heating, AC, and air flow technology.
From alternative, set up, maintenance, diagnostic, and restore providers, they're the most effective in their area. The staff is highly organized and timely of their services. They perceive the discomfort residents experience when they're facing issues with their air conditioners. However, the court is reluctant to sanction CDE by ordering the manufacturing of probably hundreds of documents containing confidential legal professional consumer, work product and deliberative process info. Accordingly, the court docket is not going to declare a waiver at this point. Instead, the court will grant the movement to produce the paperwork in CDE's privilege logs, and provides CDE 30 days to either produce the paperwork or produce proper privilege logs. This shall be CDE's final probability to supply adequate privilege logs, and any assertions of privilege that are incapable of dedication might be overruled once and for all.
To the fullest extent permitted by law, morganhilltimes.com disclaims any warranties for the security, reliability, timeliness, and performance of the services and products. morganhilltimes.com similarly disclaims, to the fullest extent permitted by regulation, any warranties for any data or advice obtained through the products and services. In June, July and August, 2016, CDE produced privilege logs for its e mail productions. https://acrsanjose.com In plain violation of Rule 26, the logs failed to offer even the minimal info plaintiffs and the court would want "to evaluate the declare" of privilege. For example, the logs didn't point out whether or not both the sender or recipient was an legal professional or a consumer.
These had been boilerplate objections, and contained no objection to plaintiffs' request that ESI be produced in native format with all metadata attached. CDE's next claimed objection was in the October 10, 2013 transmittal letter. CDE subsequent claimed objection was in its August 26, 2016 letter. Even if each of those were valid objections (and in fact, not a single certainly one of them incorporates a legitimate objection to format beneath Rule 34), CDE has engaged in an improper sample of piecemeal objections over the course of years.
Apart from the truth that there isn't a objection said within the October 10, 2013 letter, CDE's own subsequent conduct led plaintiffs to a reasonable perception that ESI would be produced in native format with all metadata attached. On March four, 2014, CDE's counsel wrote to plaintiffs' counsel to advise her that CDE is working with its vendor to make sure that requested digital paperwork can be produced "in an organized method." Sagy Exh. The letter goes on to assure plaintiffs' counsel that that effort "won't impede my shopper's ability to provide the documents with metadata intact and of their native format." Id. The following month, on April 30, 2014, the parties agreed, in writing, that "ll documents will be produced with all metadata, if it exists, on CD-ROM disks, through a cloud service, or via different mutually agreeable methods." ECF No. fifty eight at 16 ĂÂś 14.5. CDE argues now that the letter doesn't mean what it says and that the stipulated order "didn't order a particular format of manufacturing." ECF No. 277 at 9, 15. Even if the court docket had been to simply accept CDE's strained interpretations of those paperwork, plaintiffs would be forgiven for believing that CDE was agreeing to provide ESI in native format with all metadata hooked up.

The advent of information technology (IT) in healthcare has enabled physicians to maintain optimal workflow and meet the frequently changing patientâs preferences. Leica Biosystems introduced a software that can share digital pathology images and case data with experts outside the IT network. Computerization, robotic light microscopy, multiple fiber-optic communications, digital imagery, whole-slide imaging (WSI), LIS/LIMS interface, and high-speed networking are among the modern technologies assisting the pathologists.
People staying in remote regions need to travel to the urban areas for diagnosis, treatment, and follow-up. Digital pathology helps bridge the gap between patients from remote areas and diagnostic centers by providing an adequate access to healthcare organizations. A digital pathology setup is easy to install in rural labs and hospitals. It serves the remote telecommunication consultation, primarily for diagnosis and treatment. Several hospitals, primary care providers, private clinics, and other medical institutions offer remote telepathology services. Such systems reduce costs, benefit the organizations, and ensure patientâs satisfaction.
Periodic diagnosis is the first step of every cancer treatment. Traditional pathological methods can only detect tumors but find it gruesome to share the case for second review. This discrepancy is eliminated by digital pathology system that offers in-depth analysis and diagnosis of tumors. It involves the scanning of conventional glass slides and digitally unifying successive images into a single large image conveying the information. Benefits of Document Scanning
If your company is like most, then you have sections of your office dedicated to storing records. It could be in dozens of filing cabinets, the basement, an entire records room, or stacks of drawings in long drawers. Maybe itâs in all of those. But thereâs something that can help with some serious benefits: document scanning.
1. Cut Costs, Increase Productivity, and Improve Access to Key Information Document Management Inc These are the three most common reasons that people consider scanning their documents.
By digitizing your files and storing them in a cloud-based document management system , you can bounce back from disaster with minimal disruption for your clients.

ISTOCK, NIRODESIGN M ore than 1,000 individuals from worldwide have actually signed a petition contacting significant journal publishers not to censor their offerings within China in action to governmental pressure. The petition promises a peer-review boycott, mentioning, âwe will not consent to supply peer evaluation service till editors verify that their publications do not censor material in the [Peopleâs Republic of China], and we contact all others to do so also.â
The petition, introduced in October 2017, followed news last summer season that some publishers and databases based outside China had actually gotten demands from Chinese importers of their print and digital material to obstruct online access to specific scholastic posts within the nation, states the petitionâs developer, Charlene Makley, an anthropologist at Reed College in Portland, Oregon. Check Out âSpringer Nature Blocks Access to Delicate Articles Within Chinaâ
The Cambridge University Press discovery âwas sort of a watershed occasion in my mind ⌠it gave my attention that the reach of China had actually extended beyond its own borders,â Makley states. âI called some coworkers informally to speak about exactly what they believed folks need to do, and to me peer evaluation is the really structure of scholastic publishing ⌠If we begin there, then that is one manner in which specific scholars can have some take advantage of.â
The concept is not a lot to require modification by making it difficult for journals to discover ready peer customers, however more to trigger awareness of and discussions about the concern amongst journal editors. Makley states some editors might not understand their businessâ practices, and she hopes her effort will trigger handling editors and publishers to develop a position on censorship if they have not currently. Prior to she accepts a demand to peer evaluation a manuscript, Makley now asks the journal editor whether the journal or its owner censors material in China, and âin numerous cases they have actually returned with strong declarations stating that they do not censor,â she states.
James Millward, a historian at Georgetown University and fan of the petition, likewise sees withholding peer evaluation as an especially fitting method to react to censorship. âItâs not ideal, however [peer review] is the system that we have actually progressed over centuries, which is exactly what makes scholastic speech various,â he states. Considered that journals are curated by peer evaluation, for an outdoors entity âsimply to come in and decide on [which articles to make available] is really to break this procedure at a really basic level,â he states.
Our Chinese coworkers in China are at danger of not having complete access to all research study thatâs readily available.â Charlene Makley, Reed College
A representative for Sage, which releases more than 1,000 journals in the lives sciences and other fields, composes in an e-mail that, âWe have actually not gotten a demand from the Chinese authorities or other entities to get rid of or obstruct access to specific files or material within China ⌠As a matter of basic concept, SAGE Publishing does not obstruct or get rid of material in action to such a demand.â
In action to an ask for remark, Elsevier representative Tom Reller reacted in part, âElsevier thinks in the liberty to release and check out academic material anywhere around the world.â However Reller did not state whether the publisher had actually gotten demands to censor remark, nor how it would react. The UK-based publisher Taylor & Francis decreased to comment, and Wiley (whose more than 2,000 journals consist of the Chinese Journal of Chemistry, released in cooperation with the government-affiliated Chinese Academy of Sciences) did not react to ask for remark.
Springer Nature safeguarded its transfer to make some material not available in China, mentioning in an e-mail to The Researcher, âwe are needed to appraise the regional guidelines and policies in the nations where we disperse our released material ⌠This action is deeply regrettable however has actually been required to avoid a much higher effect on our consumers and authors ⌠We do not think that it remains in the interests of our authors, consumers, or the larger clinical and scholastic neighborhood, or to the development of research study for us to be prohibited from dispersing our material in China.â Springer has workplaces in Beijing and Shanghai and releases more than 100 journals in collaboration with Chinese scholastic societies and organizations, inning accordance with its site.
For Millward, who concentrates on China and Central Asia, Springerâs argument does not hold water. âThey release Nature, they release Scientific American, they release amongst the most essential clinical journals. China is not going to obstruct gain access to for its scholars from all those journals,â he competes.
That stated, access to numerous other significant websites, varying from Google to Facebook to The New York City Times, has actually been obstructed by Chinaâs âGreat Firewall program.â For citizens ready to go to the problem, virtual personal networks (VPNs) have actually long been utilized to prevent these limitations, however the federal government has actually just recently punished those too, inning accordance with The Guardian and other outlets.
Since the due date for this short article, Chinaâs Foreign Ministry had actually not reacted to an ask for remark.
Makley states it is essential that scholastic publishers not accede to governmental pressure. âThis is not practically China or China-related research study,â however about the growth of state power, she states. âOur Chinese coworkers in China are at danger of not having complete access to all research study thatâs readily available.â

What happens to free-to-play mobile gaming during a recession?
As job losses continue to mount â 22 million people in the United States have filed for unemployment since the COVID pandemic began, and the relative numbers from some other countries are even more staggering â the broader context of how COVID will impact the global economy becomes more important than whatever short-term impacts the quarantine had on consumer spending in some verticals.
One industry that I think will make for a fascinating case study during the coming recession is mobile gaming. Gaming is often thought of as recession proof; as I wrote in How has the Coronavirus impacted the App Economy?, the performance of public video gaming companies during the global financial crisis of 2008-2010 was mixed, generating record revenues in 2008 followed by a sharp decrease in 2009 (overall, revenues were up in 2010 versus 2008). Interestingly, several public gaming company stocks saw steep price decreases over the course of the global financial crisis that persisted well into 2011:
Putting aside the question of whether gaming is recession-proof or not, itâs important to draw the distinction between console and handheld video gaming and mobile gaming. Mobile gaming is dominated by the freemium model, and as I pointed out in my last piece related to the COVID pandemic, neither mobile gaming nor the freemium business model were particularly popular in Western markets during the last global recession (the App Store was only launched in 2008, and its composition didnât begin to skew towards freemium apps until 2011). The App Economy is largely untested by economic downturns: no one really knows what happens to app engagement and monetization during a recession.
Many commentators point to recent spikes in downloads and engagement as indicators that the App Economy is set to benefit from recessionary stress: in mid-March, Verizon revealed that mobile game engagement had increased by 75% from pre-Covid levels, and video chat apps like Houseparty, Marco Polo, Bunch, etc. are experiencing massive waves of interest (Houseparty specifically saw 50MM installs over the course of March). But it seems misguided to take these signals as proof of the App Economyâs fundamental hardiness against a protracted economic downturn: the quarantine economy is structurally different than the recession that it created, even though those two things overlapped chronologically for a period of time.
So when people talk about mobile gamingâs perceived resiliency to recessions, they tend to conflate two ideas: that gaming is seen as recession proof and that the broader App Economy has seen engagement increases during the quarantine. In order to consider how the mobile gaming vertical will fare during a recession, I think itâs important to 1) parse apart differences in monetization within the App Economy between the quarantine and the recession and 2) parse apart the differences between the console / handheld gaming and mobile gaming verticals.
With respect to monetization, several data points imply a mild to severe retraction in consumer spending on mobile. One of these comes from a recent report published by MoPub which revealed nearly universal decreases in eCPMs across both Rewarded Video and Fullscreen ad placements:
As I pointed out in my Advertising during a recession presentation, ad spend decreased sharply during the global financial crisis, to a greater extent than consumer spend did. And while for some of the geographies above, requests per device increased more than eCPM decreased, that isnât true for the United States, which, according to App Annie, is the App Economyâs largest market in terms of app installs and its second largest in terms of revenue:
Ad spend is a leading indicator: engagement and organic installs might surge during a quarantine, but reduced ad spend indicates that consumer spend has decreased, is expected to decrease in the future, or both. And while massive hit games like Fortnite have seen revenue increase since the beginning of 2020, this is not universally true for all games or all apps. Per Sensor Towerâs revenue estimates, compare Fortniteâs COVID revenue trajectory to Candy Crush Sagaâs, which is down, and to Toon Blastâs, which is flat:
The broader App Economy outside of gaming has also seen varying performance during COVID: both Pandora and Headspace are seeing downward revenue trajectories from the beginning of the year:
And, of course, some other non-gaming apps, such as Twitch, have seen incredible revenue growth since the beginning of the year:
The point is, despite the sensational headlines, the App Economy at large clearly hasnât seen a broadly rising revenue tide as a result of COVID, and neither has mobile gaming as a category: some apps have benefited and some havenât. As advertising spend contracts, the apps that have deliberately slowed their marketing-driven growth will see revenues decline even further, and as the quarantine ends, the apps that have enjoyed revenue increases via organic discovery might likewise see revenues decrease.
Which leads to the distinction between mobile gaming and traditional console and handhold video games. Accepting the premise that traditional video gaming is recession resistant, is it safe to assume that mobile games are similarly safeguarded? I think some fundamental differences between the two categories make it hard to come to that conclusion.
Within the entertainment subset of consumer spending, video gaming is a substitute good: on a per-hour basis, video games are cheaper than other forms of entertainment like the cinema, theme parks, etc. A $60 video came could potentially provide entertainment for hundreds of hours; itâs a good substitute for other, more expensive forms of entertainment during a downturn. Video gaming also benefits during recessions because consumers tend to re-allocate their budgets to leisure spending so as to bolster their spirits.
Luxury goods â broadly defined as goods for which demand is driven by desire, not need, and thus increases with income â tend to see consumption decreases during recessions that are more extreme than that of general consumer spending. This paper by Ait-Sahalia et al explores the relationship between luxury goods sales and the equity premium, or the difference in performance between equities and risk-free bonds (basically: what happens to luxury goods consumption when equity markets are down, as in recessions):
These findings support the notion that luxury goods suffer disproportionately from recessions, and this explains why traditional console video games might be recession resistant: theyâre a cheaper alternative to other forms of entertainment on a per-hour basis.
But what about mobile games? Mobile games are mostly free: they are the ultimate discount entertainment. But my belief is that, while free-to-play games may also serve as a substitute good â to all forms of entertainment, including traditional console video games â the digital products purchased via IAPs in free-to-play games need to be classified independently from the games in which they exist. The decision a consumer makes to download a free game is totally separate from the decision they make to purchase a digital good in that game. Putting aside design factors (âpay to win,â etc.), itâs tautologically true that free-to-play games can be played for free, and so IAPs have to been as luxury goods: characterized by desire and convenience, with demand tracking income.
Connecting this line of thought to the broader App Economy: given a decrease in ad spend, if IAPs do behave like luxury goods, then it stands to reason that mobile games revenue across the board could decline (or see a slowdown in growth) even as engagement increases: more people playing mobile games but producing lower average revenue per user (ARPU) and potentially lower overall revenue.
The App Economy as a whole and mobile gaming as a category may be experiencing increased engagement, but increases in revenue are not universally distributed: some apps and games are suffering during COVID, and the resultant recession has only really just begun. It canât be taken for granted that mobile gaming performs as the traditional video games sector does during a recession. Despite the bravado and the eye-popping metrics being released to the press, some mobile games have already witnessed a revenue decline as a result of COVID; if mobile game IAPs fit the profile of luxury goods, there could be further declines to come.

The Ultimate Differential Theory of US Armed Forces (Snake Model)
I donât know the first thing about the military but this is made laugh my ass off.
Upon encountering a snake in the Area of Operations (AO)...
Airborne: Lands on and kills the snake.
USAF O-6 and above: "Get that damned snake off the fairway!"
Armor: Runs over snake. Never knows it,as well as where the tank and the snake is on the battlefield. Continues directly ahead wondering what all those new buttons in his turret do.
Army Aviation: Has GPS ten digit grid to snake. Stands off at a range greater than any other weapon system and destroys snake with precision fires at a cost equivalent of one Mercedes 350SEL. Returns to base for fighter management and a "cool one".
Army Shrink: Attempts to get snake to explain its sexual feelings about its mother. Â
Army Chaplain: Tries to get snake to attend services, mend its ways.
USAF Combat Controllers: Guides snake elsewhere.
Combat Engineer: Studies snake. Prepares in depth analysis based on obscure 5 series FM about how to defeat snake using counter mobility assets. Complains that maneuver forces don't understand how to properly conduct doctrinal counter-snake operations. (Engineer School tries to hide the fact that M9 ACE proves ineffective against snakes).
Field Artillery: Kills snake with massive Time On Target barrage with three Forward Artillery Brigades in support. Kills several hundred civilians as unavoidable collateral damage. Mission is considered a success and all participants (i.e., cooks, mechanics and clerks) are awarded Silver Stars.
Infantry: Snake smells them, leaves area.
Military Intelligence, G-2: Snake? What snake? Only four of 35 indicators of snake activity are currently active. We assess the potential for snake activity as LOW.
Judge Advocate General (JAG): Snake declines to bite, citing professional courtesy.
Force Recon: Follows snake, gets lost.
USMC Infantry: Kills snake by accident while looking for souvenirs. Local civilians demand removal of all US forces from Area of Operations.
Army Mech Infantry: Runs over snake, laughs, and looks for more snakes.
Military Intelligence, S-2: Reports to ground troops that snake is a non-combatant. Six Infantry wounded. MI states that if the ground forces would have read the nesting diagram provided in the 24 page enemy intel report, they would have known the snake was a possible threat.
Military Police, Criminal Investigation: Handcuffs snake's head to its tail, reads it its Miranda rights, then proceeds to beat snake to a pulp with night stick.
USAF Missileers: Lays in target coordinates to snake in 20 seconds, but can't receive authorization from National Command Authority to use nuclear weapons.
Military Police, Field: Snake safely infiltrates rear area of operations.
Navy SeaBees: Build snake elaborate rec room, complete with secret still.
Navy SEAL: Expends all ammunition and several grenades, then calls for naval gunfire in failed attempt to kill snake. Snake bites the SEAL, and dies of salt water poisoning. Hollywood makes film in which SEALS kill Muslim extremist snakes.
Navy, Surface Action Group: Fires off 50 cruise missiles fro several ships, kills snake and makes presentation to Senate Appropriations Committee on how Naval forces are the most cost-effective means of anti-snake force projection.
Ordnance: IDs snake as having improper scales. Deadline snake and order parts against snake. Parts come in 15 days later but the snake has been upgraded to FMC due to scrounging of parts through improper channels.
USAF Para-Rescue: Lands on snake upon descending, thereby injuring it, then feverishly works to save the snake's life.
USAF Pilot, A-10: Has Global Positioning Satellite coordinates to snake. Can't find snake. Returns to base for refuel, crew rest and manicure.
USAF Pilot, B-52: Pulls ARCLIGHT mission on snake, kills snake and every other living thing within two miles of target.
USAF Pilot, F-15: Misidentifies snake as enemy Mil-24 Hind helicopter and engages with missiles. Crew chief paints snake kill on aircraft.
USAF Pilot, F-16: Finds snake, drops two CBU-87 cluster bombs, and misses snake target, but gets direct hit on Embassy 100 KM East of snake due to weather (Too Hot also Too Cold, Was Clear but too overcast, Too dry with Rain, Unlimited ceiling with low cloud cover etc.) Claims that purchasing multimillion dollar, high-tech snake-killing device will enable it in the future to kill all snakes and achieve a revolution in military affairs.
USAF Pilot, Fighter, Generic: Mis-identifies the snake as a HIND and engages it with missiles. Crew Chief paints snake on airplane.
USAF Pilot, Transport: Receives call for anti-snake equipment, and delivers two weeks after due date.
Army Pilot, AH-64 Apache: Unable to locate snake, snakes don't show well on infrared. Infrared only operable in desert AO's without power lines or SAM's.
Army Pilot, HH-53 Jolly Green Giant: Finds snake on fourth pass after snake builds bonfire, pops smoke, lays out flares to mark Landing Zone. Rotor wash blows snake into fire.
Joint Security Area (JSA) Korea: Puts on Class B uniform and stares snake down for 40 years. Snake dies of old old age, but son of snake assumes staring contest.
Army Cavalry Troopers: Shoots near snake to prevent it from crossing FLOT because their mission is "Screen" and Not "Destroy." Put in for Silver Star, but is downgraded to ARCOM w/ "V" Device. Cav is successful in not becoming "Decisively Engaged"
NTC O/C: Shoots snake with Godgun, tells it to take off its fangs and wait for Medivac. Other Snakes berated in AAR for not knowing their 9-Line Medivac.
Military Intelligence (Tactical): Puts Rubber Snakes around Snake as "Battle Field Deception." Junior MI Soldier left near to make hissing noises because sound system is deadlined.
Retired SGM working at CIF: Gives snake a statement of charges for not having the same skin it was issued. Snake goes and kills other snake; Tries to turn in other snakes' skin. Spends 8 hours in CIF parking lot washing skin.
ROTC Cadet: Cadet dies of Snake Bite after asking Snake how he did at "Advance Camp"
SFOD-D: Deploys 2 man SR Team to maintain "eyes on" while squadron prepares for deployment. $2.1 M. worth of "Discretionary" funds are used to contract a company to produce a .50 cal subsonic round whose weapon effect closely resembles a mongoose bite. FBI's HRT is deployed to stand around while an Operator shoots the snake with the "Mongoose Round" while wearing an HRT Jacket. SFOD-D Cooks and Clerks expend a total of 1.7 Million Rounds of ammo back at Bragg so that it looks like SFOD-D was never deployed...
Army or Marine Quartermaster: Encounters snake, then loses contact. Can not identify who owns snake by hand receipts. Orders new snake through supply channels. Request is denied by higher authority; issuing the unit a snake will bring the manager to a zero balance; one snake must remain on hand at all times as per their boss' guidance.
Ranger: Plays with snake, then eats it.
USAF Ground Crew: Â Runs back to truck after sighting snake, then after a half hour, sends lowest ranking airman out to beat snake to death with a set of wheel chocks.
USMC Band, "The President's Own": Oboe player charms snake into a saxophone case, which is then presented as a gift to former president Bill Clinton.
Army Band, "Pershing's Own": Snake's head crushed with a mallet by bass drum player. Snakeskin turned into cool sash for drum major.
Signal, Enlisted: Tries to communicate with snake . . . fails despite repeated attempts. Complains that the snake did not have the correct fill or did not know how to work equipment a child could operate.
Signal, Officer: Informs the commander that he could easily communicate with the snake using just his voice. Commander insists that he NEEDS to videoconference with the snake, with real-time streaming positional and logistical data on the snake displayed on video screens to either side. Gives Signal Corps $5 Billion to make this happen. SigO abuses the 2 smart people in the corps to make it happen, while everybody else stands around, bitches, and takes credit. In the end, GTE and several sub-contractors make a few billion dollars, the two smart people get out and go to work for them, and the commander gets what he asked for only in fiber-optic based simulations. The snake dies of old age.
Staff Judge Advocate (JAG): Swear they saw something like that on the Discovery Channel . . . spend weeks arguing if it was a snake or not.
Special Forces: Makes contact with snake, ignores all State Department directives and Theater Commander Rules of Engagement by building rapport with snake and winning its heart and mind. Trains it to kill other snakes. Files enormous travel settlement upon return.
Supply: (NOTICE: Your anti-snake equipment is on backorder.)
Transportation Corps: "Snake? What snake? We were sleeping in the truck."
US Congress Representative (D): Â After initially voting in favor of anti-snake military action, suddenly realizes that the snake can never be defeated. Goes on TV and describes current operations as 'failed' before they begin and the calls the leading herpetologist in the world 'incompetent'. Pleads with snake not to hurt us. Then introduces legislation to re-deploy all military forces to Okinawa where they can more effectively engage snakes, world-wide. Then heads overseas to attempt to negotiate our surrender to the snake. Takes intern for 'support'.
Embed Main-Stream-Media Reporter: Decides snake is patriotic nationalist agrarian reformer being molested by imperialist U.S. forces, asks snake for directions to nearest bar. If bitten by snake, charges U.S. troops with neglect of duty to protect freedom of the press.
Public Affairs Officer: "We cannot comment on any snake-related activities, and anyway that would be up to the snake's chain of command to provide comments, if any are applicable. Be sure to check out our website on 'How to handle snakes in your AO' for the current command guidelines on snakes."
Naval Aviator, Jets: Â Lobbies Congress for new funds to buy "Snake-seeking ordnance," while pressing the point that blue-water ops are the only effective way to display American might to the snake and have a psychological effect on it. Gets funds, then launches strike. Can't drop on Snake due to targeting pod being "bent." Has to jettison multi-million dollar Anti-Snake Bomb into ocean. Comes back to boat and traps on pitching deck in dead of night while bitching about how "Snake gets ten-thousand feet of solid runway to do this $%!T on." Proceeds to blame maintenance chief for bent pod. Chief goes out to jet, pulls tapes, finds that pod was never switched to "ON" position.

This service verifies entities that attempt to access a web service. For Example, the authentication service, the Entitlements Service ensures security in business operations. 14. What is Entrust Privacy Service? As its name implies, it deals with security and confidentiality. This service encrypts data to ensure that only concerned parties can access the data. 15. What do you mean by PKI? It means Public-Key Infrastructure. 16. What tools are used to test a web service? I have used SoapUI for SOAP WS and Firefox poster plugin for RESTFul Services. 17. Differentiate between a SOA and a Web service? SOA is a design and architecture to implement other services. SOA can be easily implemented using various protocols such as HTTP, HTTPS, JMS, SMTP, RMI, IIOP, RPC etc. While Web service, itself is an implemented technology. In fact one can implement SOA using the web service. 18. Discuss various approaches to develop SOAP based web service? We can develop SOAP based web service with two different types of approaches such as contract-first and contract-last. In the first approach, the contract is What isd first and then the classes are derived from the contract while in the later one, the classes are What isd first and then the contract is derived from these classes. 19. If you have to choose one approach, then what will be your choice? In my point of view, the first approach that is the contract-first approach is more feasible as compared to the second one but still it depends on other factors too. 20. Is there any special application required to access web service? No, you don't need to install any special application to access web service. You can access web service from any application that supports XML based object request and response. 21. Can you name few free and commercial implementations for web services? The implementations I know are Apache SOAP, JAX-WS Reference Implementation, JAX-RS Reference Implementation, Metro, Apache CXF, MS.NET and Java 6. 22. Name browser that allows access to web service? JavaScript XmlHttpRequest object is required to access web service via browsers. The browsers that support this object are Internet Explorer, Safari and Mozilla-based browsers like FireFox. 23. What is REST? REST stands for Representational State Transfer. REST itself is not a standard, while it uses various standards such as HTTP, URL, XML/HTML/GIF/JPEG (Resource Representations. and text/xml, text/html, image/gif, image/jpeg, etc (MIME Types). 24. How one can provide API to users? To provide an API to the users, one can easily do this with an "open table". All you need to do is to write open table which is basically an XML schema that point to a web service. 25. Name the various communication channels in web service? Web service is integrated with three protocols such as HTTP/POST, HTTP/GET, and SOAP. It provides three different communication channels to clients. Client can choose any communication method as per requirements. 26. How can you document web service? Web services are contemplated as self-documenting because they provide entire information regarding the available methods and parameters used for XML based standard, known as WSDL. One can also provide more information to explain web services via their own WebService and WebMethod attributes. 27. What are the situations, when we need ASP.NET web services? ASP.NET web services are used when one need to implement three tier architecture in a web service. It allows handy ways to use middle tier components through internet. The main advantage of .NET Web services is that they are capable enough to communicate across firewalls because they use SOAP as transport protocol. 28. What are distributed technologies? The increasing ratio of distributed applications has raised demand for distributed technologies. It allows segmenting of application units and transferring them to different computers on different networks. 29. Differentiate between web services, CORBA and DCOM? Web services transfer/receive messages to/from application respectively, via HTTP protocol. It uses XML to encode data. CORBA and DCOM transfer/receive messages to/from application respectively, via non-standard protocols such as IIOP and RPC. 30. Can you tell few benefits of web services? The biggest advantage of web service is that is supported by wide variety of platforms. Moreover, in near future, web services may spread its boundary and enhance new methods that will provide ease to clients. The enhancement will not affect the clients, even if they offer old methods and parameters. 31. Can you name some standards used in web services? The standards used in web services are WSDL (used to create interface definition), SOAP (used to structure data), HTTP (communication channels), DISCO (used to create discovery documents) and UDDI (used to create business registries). 32. Explain in brief, what DISCO is? DISCO means discovery. It groups the list of interrelated web services. The organization that provides web services, issues a DISCO file on its server and that file contains the links of all the provided web services. This standard is good when client knows the company already. Also it can be used within a local network as well. 33. Explain in brief, what UDDI is? UDDI (Universal Description, Discovery, and Integration. provides consolidated directory for web services on the internet. Clients use UDDI to find web services as per their business needs. It basically hosts the web services from various companies. In order to share web services, you need to publish it in UDDI. 34. Explain the .NET web services supported data types? .Net web services uses XML-based standards to transfer/receive information. Thus, .NET web services can only works with data types known by XML schema standard. Like FileSteam, Eventlog etc. are not recognized by the XML schema standards and hence, not supported in web services. 35. How a .NET web service is tested? ASP.NET uses a test page routinely, when one calls for the URL of .asmx file in any browser. This page shows complete information regarding web services. 36. How a .NET web service is consumed? Since we know that web services are constructed on XML standards. Therefore, clients need to have complete understanding of XML-based messages to interchange messages. Clients can communicate with web services through .NET framework that offers proxy mechanisms. These proxy mechanisms have detailed information regarding data sharing within web services that can be easily used by the clients. 37. Can you name the two Microsoft solutions for distributed applications? The two Microsoft solutions for distributed applications are .NET Web Services and .NET Remoting. 38. Differentiate between .NET Web Services and .NET Remoting? As far as protocol is concerned, .NET Web Service uses HTTP, while, .NET Remoting uses any protocol i.e. TCP/HTTP/SMTP. When it comes to performance, .NET Remoting is comparatively, faster than.NET Web Service. Also, as .NET Web Services are hosted via IIS, therefore, it is far more reliable than the .NET Remoting. 39. Name the components to be published while deploying a Web Service? The components that need to be published during a web service deployment are Web Application Directory, Webservice.asmx File, Webservice.Disco File, Web.Config File and Bin Directory. 40. What are the steps performed by the client to access a web service? First of all a web reference to the web service is created by the client in his application. Then a proxy class is generated. After that an object of the proxy class is created and at last, the web service is accessed via that proxy object. 41. How web services are implemented in .NET? To implement web services in .NET, HTTP handlers are used that interrupt requests to .asmx files. 42. Explain few disadvantages of Response Caching? Response Caching is useless or incompetent when method accepts extensive amount of values because caching means to store lot of information. Also, if the method depends on external source of information, and that are not provided within the parameters then such methods are bypassed. 43. What is the alternate solution to Response Caching? One can use Data Caching (System.Web.Caching.Cach) instead of Response Caching. 44. Brief few drawbacks of using GET and POST methods to communicate with the web service? These methods are less secure and inhibit users to pass structures and objects as arguments. Also, it doesn't allow users to pass ByRef arguments. 45. How can one access a class as a web service? To access a class as a web service, one should inherit the class from the System.Web.Services.WebService class and qualify the class with the WebService attribute. 46. How can one access the web service class method via internet? To access web service class method via internet, one should qualify a method with the WebMethod attribute. 47. How a SOAP message is structured? A SOAP message is consists of SOAP Envelope, SOAP Headers, and SOAP Body. 48. Can you name different kinds of web services? There are two types of web services in total i.e. SOAP based web service and RESTful web service. This question is already mentioned earlier. 49. What's different in RESTful web services? The RESTful web services contains no contract or WSDL file. 50. Give me few reasons to use RESTful web service? The RESTFul web services are simple to implement and test. It supports various data formats such as XML, JSON etc. 51. What is JAVA web services? What are the methods to create web services? Java webservices is developed to build and deploy basic web service on JAVA platform. To create a web services, there are two approaches that are adopted Top-down approach Top-up approach 52. What is JAXP? JAXP is a JAVA API for XML processing that enables application to write, read, manipulate and transform XML data. Similarly, to perform other various function there are other Java API's as well like JAX-RPC, JAXM, JAXR, JAXB, etc. 53. Explain the JAXB binding framework? JAXB binding framework is available in three Java Packages xml.bind: This package What iss abstract classes and interfaces that are used directly with content classes xml.bind.util: This package contains utility classes that may be availed by client applications to manage marshalling, unmarshalling and validation events xml.bind.helper: This helper package gives partial implementations for some of the javax.xml.bind interfaces. These APIs are not to be directly used by applications using JAXB architecture 54. Give a simple example of how XML document can be Marshal and Unmarshal in JAVA framework? Marshalling is the process of converting XML document into Java readable form while UnMarshalling is the reverse process of Marshalling. Let see how Java unmarshals an XML document and then marshals it back JAXBContext jc= JAXBContext.newInstance ("com.acme.foo"); // unmarshal from foo.xml Unmarshaller u = jc.createUnmarshaller (. ; FooObject fooObj= (FooObject)u.unmarshal (new File ("foo.xml". ); // marshal to sytem.out Marshaller m = jc.createMarshaller (); m.marshal (fooObj, System.out); 55. What does Marshaller do if jaxb.encoding property is not declared? By default, the Marshaller will use "UTF-8" if jaxb.encoding property is not declared. 56. Mention what are the types of validation can a JAXB client can perform? There are two types of JAXB client validation that a JAXB can perform Unmarshal Time Validation On-Demand Validation 57. What are the three ways to handle the event encountered during the marshal, unmarshal and validate operations? Using the default event handler Register and Implement a custom event handler Use the ValidationEventCollector utility 58. Explain where does JAXB compiler is located? JAXB schema binding compiler is placed in the /jaxb/bin directory. In this directory, there are two scripts, xjc.sh (Solaris/Linux. and xjc.bat (Windows). 59. In what cases do you need to customize the default binding? In some cases, you are required to customize the default binding like Creating API documentation for the schema derived JAXB packages, classes, methods and constants Giving semantically meaningful customized names for cases that the default XML name-to-Java identifier mapping cannot handle automatically Overriding default binding- like specifying that a model group should be attached to a class rather than a list 60. What is Inline Customization? Customization to JAXB bindings made by means of inline binding declarations in an XML schema file that take the form of elements embedded in schema elements. 61. What is XML signature? XML can be used to sign any arbitrary data whether it is a binary or XML. The data is recognized via URIs in one or more reference elements. It is described in one or more forms, like detached, enveloping or enveloped. 62. What is Stax? Stax stands for Streaming API for XML; it is an API to read and write XML documents, originating from the JAVA programming language. 63. What are the usual XML APIs? The usual XML APIs includes DOM based or Tree based APIs: The whole document is read into memory as a tree structure for random availability by calling application Event based APIs: The application registers to get events as entities are encountered within the source document 64. What is Push parsing and Pull parsing? Pull Parsing: Streaming pull parsing is referred to a programming model in which a client application calls methods on an XML parsing library, when it needed to communicate with an XML infoset- which means the client will only gets XML data when it is asked for Push Parsing: In Push Parsing, the parser pushes parsing events or XML data to the application. In push model, the parser got the hold over the parsing process and the parser calls the implemented handler methods. 65. Explain on which technology does XWS security is based on? List out the options that XWS security provides for securing JAX-RPC applications? XWS security is based on securing web services build on JAX-RPC and on stand-alone application based on SAAJ. For securing JAX-RPC application, options that XWS security provides are XML digital signature XML encryption Username token verification XWS security framework APIs 66. List out the six packages available in XML Digital signature API? Digital signature API is : xml.crypto xml.crypto.dsig xml.crypto.dsig.keyinfo xml.crypto.dsig.spec xml.crypto.dom xml.crypto.dsig.dom 67. What is JAXR? JAXR is the JAVA programming APIs for Java platform application to access and programmatically interact with various kinds of meta-data registries. 68. What does the JAXR architecture consist of? JAXR architecture is consists of a JAXR client and JAXR provider. JAXR client: It is a client program which uses the JAXR API to use a registry through a JAXR provider JAXR provider: It is an implementation of the JAXR API that provide access to a particular registry provider or to a class of registry providers that are built on a common speicifications. 69. What is JAXM messaging models? There are two types of messaging models for JAXM synchronous and asynchronous Synchronous messaging model: In such type of model, client directly communicates with the source. In this, the client will send the request and waits. Asynchronous messaging model: In this model, client directs the message to the messaging provider and returns back. Messaging provider then executes the routing of the message to the end source. 70. What is UDDI, DISCO and WSDL? UDDI: It means Universal Description, Discovery and I It is the directory that is used to publish and discover public web services DISCO: It is commonly known as discovery. It clubs common services together and exposes schemas document of the web services WSDL: It stands for web service description language (WSDL). It is used to describe web services. The description includes URL of web services, properties and methods supported by web services, data type it supports and protocol detail it supports Web Services Questions and Answers Pdf Download Read the full article
