Dallas County Jail Too Close to Limit
Inadequate computer data obscures whether judges are moving cases or are part of the problem
Dallas County’s jail population surged to 96% of its capacity over the weekend.
The inmate total tipped 6,800 on Sunday, coming dangerously close to the jail’s 7,119 limit.
Officials are understandably focused this week on “moving people through the system as quickly as possible,” Dallas County Administrator Darryl Martin told us.
But even as they struggle to manage the swelling jail population, it’s still not at all clear how well an important cog in the system — the criminal courthouse — is functioning.
How fast are the courts moving cases?
Are they keeping up with the spike in book-ins the jail always sees this time of year?
How many inmates’ cases are going before judges for pleas?
How many are going to juries for trials?
Nobody knows because for 15 months the county hasn’t been able to provide good data on how its dozens of misdemeanor and felony trial courts are functioning.
That’s because in May 2023 the county botched its rollout of a new criminal case management system. Accurate data hasn’t been available since.
Criminal defense attorneys have said many defendants have been held behind bars far longer than necessary because the software problems have caused these people to be essentially lost in the system.
While many factors affect the jail population, including how quickly the state of Texas picks up inmates waiting for transfer to prison, court inefficiency can be a significant reason for jail backup.
We have no way of knowing if judges are moving cases at an appropriate pace or if they are contributing to the overpopulation in the jail.
In May, we sounded the alarm about a looming summer crisis at the jail. At the time, the population was approaching 6,400, or about 500 inmates more than the same time the year before.
Dallas County Commissioner Andrew Sommerman, chair of the county’s Continuous Improvement Steering Committee, told us then that if the fixes weren’t made by July, “I will be losing my mind.”
Reminded of that comment, Sommerman told us recently that the software fixes will probably be complete this month or in September. By then, the county should be able to comply with a new state law requiring it to send detailed reports on the performance of each of the county’s criminal courts to the state Office of Court Administration.
Alejandra Pena, director of data and research for the OCA, told us she expects that will happen.
We hope it does.
We must know whether our judges are doing all they can to help control the troubling spike in the county’s jail population.
And until the tech problems are completely solved, we won’t have any idea.

A fertilizer plant battered by Hurricane Ida belched highly toxic anhydrous ammonia into the air. Two damaged gas pipelines leaked isobutane and propylene, flammable chemicals that are hazardous to human health. And a plastic plant that lost power in the storm’s aftermath is emitting ethylene dichloride, yet another toxic substance.
Early incident reports filed with the federal authorities are starting to paint a clearer picture of the damage wrought by the hurricane to Louisiana’s industrial corridor, complicating relief efforts and adding to the conditions that make it perilous for residents to return.
An analysis of facility records and power outage data shows that at least 138 industrial sites that handle large amounts of hazardous substances are in and around parishes that have completely lost power, forcing facilities to rely on precarious backup power systems.
Local officials were still assessing the full extent of the damage. But adding to the uncertainty, the Louisiana Department of Environmental Quality warned that more than a third of its ambient monitoring sites had stopped working, primarily because of power outages. And some sites, like the Valero Refinery in St. Bernard Parish, said they had shut down their air monitors ahead of the storm to protect the equipment.
“Survival and recovery is what’s most important right now,” said Yudith Nieto, a longtime community organizer working in both Louisiana and Texas. But as residents start to return to their homes and size up the damage, facilities and the chemical runoff for emissions and pollution will be a big concern.”
