February was so busy! H and E had an orchestra concert. DS had a band concert. H and E had weekly private orchestra lessons. Baby took a Lego “class” after school one day a week, and NB is now in dance one day a week too.
This weekend we are putting away Christmas decorations. They were packed up, but we are relocating them from our basement to the new storage closet upstairs so we needed to actually get the bins in there. Mission accomplished!
Last weekend, I went through clothes for Baby and NB to see what fit, and what needed to be handed down, stored for the next kid, or donated. That’s such a big job, but it’s done (for now).
I also attended DS’s junior conference. It was helpful and informative. He has ZERO idea what he wants to do with his life and I don’t know how to direct him/be helpful. He has great grades, but isn’t actually a great student. As a whole, he doesn’t love anything, and isn’t particularly motivated. I’m hoping he’ll find his way eventually. Let’s be honest, I’m hoping his exit from our home isn’t horrible and unexpected like it was with our two girls.
I talked with Ms. 6 this week. She’s feeling the pull of living with people that are open about how much they hate us. I feel bad for her in that respect. I told her that we are aware of her family’s feelings about us, and have zero intention of trying to change their minds. I encouraged her to try to just let it go as there is nothing that she could say or do to change their minds either.
She’s worried about high school graduation because she doesn’t want there to be fighting. I simultaneously offered to throw her a graduation party at our house that her mom would be welcome to attend, and also said we were be okay with not coming to graduation at all because it’s her day, and the most important thing is for her to enjoy it. She said she wants a party at our house, but a lot can change between now and June so we’ll see.
DD went to urgent care last week because her leg that has the blood clot was giving her issues. Once she got to urgent care she lied and said she was actually short of breath and needed an ambulance to take her three miles down the road to the emergency room. She lied to me about why she was in the ED. She had a CT of her heart and lungs and an ultrasound of her leg. Everything was fine. She blocked me from her phone for a few days when I asked her why she lied to me, but now she’s back to texting me. I keep telling myself it’s the bipolar.
DH is applying for a super intensive graduate program. The deadline is Monday and we just found out about the program, so he’s applying now and going to ask all of the questions later. The application is free, and he spoke with the director of the program yesterday who told him he’s an excellent candidate and he should apply.

the secret's out.
gif credit @/9116
A/N: We begin our regularly schedule posting of this series with more fluff and with something that is truly fiction: William Andrew Michael Junior Nylander Altelius having more than one (1) thought.
“So how’s your secret girlfriend?” William asked as he and Rasmus dressed for practice together. Rasmus was busy putting his elbow pads on while William was sitting in his gear, waiting to just put on his jersey.
Rasmus noticed William’s skates weren’t tied yet, and he wanted to tie them together so William would trip and fall. He loved William like a brother, and William was most definitely his mentor, but there was no way he was going to tell him just yet. “I don’t have a secret girlfriend, you idiot.”
***
“Is that your secret girlfriend?” William asked as he watched Rasmus type away on his phone during dinner. Rasmus was texting his brother, but as he was doing so a notification popped up that Lusine had sent him a text too, which led him to smile down at his screen.
“What secret girlfriend?” Jason Spezza barely waited two seconds before chiming in too. He looked between Rasmus and Willy, highly skeptical.
Rasmus rolled his eyes. “I don’t have a secret girlfriend!” he hissed at William.
Jason leaned back in his seat slightly, all of the sudden not so uptight. “Why are you teasing him about a secret girlfriend?” he asked Willy.
“Because he has a secret girlfriend.”
“So?” Jason eyed him. “You had—” he stopped dead in his tracks at the same moment William dropped his fork loudly into his plate of pasta below.
“He had what?” Rasmus asked.
Jason cleared his throat. “He had blue balls for Aberdeen for an entire year. He can’t make fun of anyone else’s love life.”
Rasmus laughed, grabbing William by the shoulder and shaking him. William, for his part, was making a face at Jason. “Best year of our lives being able to make fun of him like that,” he smiled.
“Yeah. It was hilarious,” Willy deadpanned.
***
***
Rasmus had never been intimidated by a building before – not any hockey arena, church, house, what have you – but he was intimidated by Robarts Library. It was just so…big. And ugly. And there was so much going on – so many students and books and workers and computers and just so many…things. That didn’t even take into account the energy of the place: if stress had an origin, it began at Robarts. The only thing was that he was lucky he blended in with most of the students, seeing as he was around their age, anyway. He saw the turnstiles, which were just one obstacle in Operation Find Lusine.
“Fuck it dude. I’m gonna fail anyway, what’s the fucking point?” a guy in a baseball cap and hoodie complained to his friend as they walked close towards Rasmus and the turnstiles.
“Hey bro,” Rasmus got their attention suddenly, not even knowing exactly what he was going to say. “I uh, I forgot my student card upstairs. You mind?”
The guy didn’t even blink twice. “Yeah bro, come on,” he motioned with his head, swiping the card and letting Rasmus through. Well that was easy enough. Rasmus followed them towards the elevators, and as they were waiting, looked up to see where the ‘history’ floor would be.
Only it wasn’t that simple. Of-fucking-course.
For some reason everything started at the 9th floor. And for some reason, things were organized into alphabetical order, not subject.
9th floor
AC–AZ | B–BX | C–CT | D | Oversize
10th floor
DA–DX | E | F–FC
11th floor
G–GV | H–HX | J–JZ | K–KZD
12th floor
L–LT | M–MT | N–NX | P–PM
13th floor
PN–PT | TR,TT | U–UH | V–VM | Z–ZA
Rasmus gulped.
“What floor you need, bro?” the kind young man who had offered his student card asked.
“Uh…9th,” Rasmus said, not quite knowing what exactly he was going to do. Should he work his way up? Down? How the fuck did people do this? He should have thought this through a hell of a lot more, but when it came to Lusine, he didn’t really think much because he was convinced he just knew.
The elevator brought him and the boys up to the 9th floor. They were going to the 12th. “Good luck bro,” one of them said as Rasmus exited, and he nodded back at them as if he was going on a secret mission and it was the last time he’d see them. Both those things were technically true. Once the elevator doors closed, Rasmus was greeted with an absolute behemoth. There were bookshelves everywhere. Desks everywhere. Stress everywhere. He looked towards the wall and saw the floor map, right next to the fire escape instructions.
He took a deep breath.
He looked at every face in every cubby he saw on the inner perimeters first before looking at every face sitting on the outer perimeters in the desks. He’d never seen so many desolate faces in his life. She wasn’t in any of them. So he went up a floor and did the same for all the cubbies and all the desks on the 10th floor. She wasn’t in any of them. So he went up a floor and did the same for all the cubbies and all the desks on the 11th floor.
And there she was. Huddled over, earphones in, a stack of books next to her, typing away furiously on her laptop. He stopped walking and just watched her for a few moments, watched her as she looked back and forth between an open book and her screen, typing out the words before turning the page. He smiled to himself. Rasmus didn’t want to cause a ruckus. He knew that if he did, he’d get nasty stares and probably get kicked out. So all he did was slip into the empty cubby next to her.
When she looked up to see who in God’s name was taking the seat right next to her while there were so many available, her jaw dropped onto the floor. Rasmus was smiling back at her. She pulled her headphones down. “Rasmus?!” she half-yelled, half-whispered, covering her mouth when she realized how relatively loud she was in the silence of the library. “What are you doing here?”
“Thought I’d keep you company,” he whispered, taking his phone out of his pocket and plopping it on the desk.
Lusine couldn’t believe what she was hearing. “How’d you find me?”
“Started on the 9th floor.”
Her heart melted.
***
Rasmus didn’t complain once throughout the four hours they stayed at Robarts. He had been on his phone the whole time, scrolling Instagram or watching hockey highlights. He held down their little two-desk fort when Lusine had to go back in the stacks to find another book, and he tried to give menacing stares at people who tried to sit relatively close to them. He wanted their own space. Lusine needed her own space.
It was just passed nine when Lusine was finished her essay and ready to go. Rasmus helped her put the books she took out on the restock cart. They stepped onto the elevator in silence. When the doors closed, Lusine looked up at Rasmus. “Were you planning to do that the entire time?” she asked.
“Of course,” Rasmus said. “When you texted. I had to see you.”
Lusine swooned. She never imagined a boy saying these sorts of things to her. For such a long time, she didn’t think it would have ever been a reality for her. But Rasmus was real. Somehow. He wasn’t a figment of her imagination. She knew so because she saw him on TV. That had to make him real, right? She would never have guessed a hockey player. “You’re something else.”
Lusine felt his hand cover hers. “You hungry?”
“I’m tired,” she chuckled. “I just wanna go to bed.”
“When’s the essay due?”
“In two weeks.”
“And you’re doing it now?”
“Why wouldn’t I do it now?”
“I don’t know, don’t university students, like, wait to get stuff done until the night before and pull all-nighters?”
Lusine couldn’t help but giggle. For someone who wasn’t going to university and never did, he got the stereotype pretty dead-on. “I’m trying not to be that irresponsible,” she said. “With work and now you, I have to make sure I make time for everything.”
***
Rasmus was with Willy and Aberdeen. They invited him over for a homemade brunch because they wanted to make sure he was getting his proper nutrients. He’d reminded the both of them that in his and Willy’s relationship, he was the cook. That didn’t matter. It was actually quite nice that they invited him over, if he was being honest. Aberdeen knew how to poach eggs, and he’d rather pay zero dollars for Aberdeen’s homemade poached eggs than $20 for poached eggs at some restaurant.
The team had won 5-4 against the Detroit Red Wings last night, but it had been a tight game – tighter than Rasmus would have liked, but they got the win regardless. It was Halloween night at Scotiabank Arena too, and though the team had their own Halloween party earlier in October, it was nice to see some fans, especially kids, get festive. He couldn’t even keep track of how many Auston-style moustaches he saw on the kids pressed up against the glass during warmups.
Lusine had gone out last night to a Halloween party with Bianca and her friends. He’d checked his phone after the game only to see a series of five pictures Lusine had sent him of her in a skin-tight Catwoman costume. He almost didn’t make it home. He had half the mind to ditch his car at Scotiabank Arena and scour every club in Toronto to see if she was there, much like he did in Robarts. But instead, he kept his cool. And he kept looking at the photos until he dozed off and his phone dropped on his face.
She was texting him now, as he was sitting at the table, complaining about her hangover. He tried not to seem too preoccupied with his phone, but the attempt was meaningless. “How’s your secret girlfriend?” William asked as he sat down in his seat, cup of coffee in his hand.
“I don’t have a secret girlfriend,” he mumbled, typing out a message to Lusine about Advil and Gatorade.
“Will you stop with that?” Aberdeen chastised her boyfriend as she put Rasmus’s plate full of food in front of him. “Rasmus, do you want more coffee?”
“Is that who you’re texting now? Your secret girlfriend?” Willy pushed.
“William, will you sto—”
“—She can’t be my girlfriend yet if we haven’t even kissed,” Rasmus blurted out without thinking.
The entire apartment went silent. Rasmus’s heart dropped into the pit of his stomach once he’d realized what he’d said. He shot his head up to look at Aberdeen and Willy. Aberdeen’s jaw was on the floor. William’s eyes were bulging out of their sockets. Within a few seconds, William had banged his fist down on the table. “I KNEW IT!!!!!” he screamed.
“Will—” Rasmus tried to say, in Swedish, but it was no use.
“VIIIIINDICAAATIOOOOOOOOOONNN!!!” William screamed at the top of his lungs. “I WAS RIIIIIGHT!”
“You have a girlfriend?” Aberdeen was exasperated, her jaw still on the floor from the shock. “How? When? Who? What?!”
Rasmus facepalmed with both his hands. It wasn’t supposed to happen like this. Not like this. “Guys, please…” he pleaded.
“Who is she? What’s her name?” William asked. “Give me all the details now, Sandy.”
There was no use trying to hide it any longer. He was caught. He framed himself for that matter. He’d never forgive himself for this. Trying to look for a silver lining, he guessed that if any two people found out first, he was happy that it was his best friend and his girlfriend. “Her name is Lusine,” he revealed.
“Lusine what?”
“Lusine Forrester. She goes to U of T.”
“Oh!” Aberdeen exclaimed. “You got yourself a university girl! I already like her. What’s she studying?”
“History major.”
“This seems promising. What year?”
“Second.”
“Is she from Toronto?” William asked.
“She grew up in like a small town or something outside of Toronto, but like…yeah, she’s from here,” Rasmus said. “She moved to Toronto to go to university. She’s living in an apartment in the Annex right now with a roommate.”
“What’s she look like?”
There was zero percent chance Rasmus was going to show them the pictures she’d sent of herself from last night, so he gave them her Instagram handle instead. Aberdeen typed it in on her phone and William leaned into her to check the profile. “Are you dating a model?” she asked, exasperated, hoping that Rasmus wasn’t turning into another Kasperi. “She’s stunning, Sandy. How on earth did you even meet her?”
“She’s not a model,” he corrected Aberdeen.
“She’s not?”
He shook his head. “I was in a coffee shop and overheard a disaster date she was on and I, like, went up to her pretending to know her to help get her out of it.”
Aberdeen leaned back in her chair dramatically. “Oh my God, Rasmus! Are you kidding me?!”
“Wait,” William said dramatically. “Have you invited her to a game yet?”
“No.”
“Oh, but she has to come!” Aberdeen said. “Invite her on Saturday. Hockey Night in Canada. I promise to take care of her. Me and Bee, anyway.”
Rasmus loved Bee, so the thought of Aberdeen and Bee being with her at the game calmed him down a little bit. If he and Lusine were going to be doing this, coming to a game was a logical next step. He just wondered if it would be too much for her too soon. He didn’t want to jeopardize anything. “Yeah. Okay. Maybe. We’ll see.”
William shook his head, grabbing his knife and fork to finally dig into his brunch. “I’m never letting you live this down,” he told Rasmus before stabbing his poached egg with the knife.

in the name of love:
connie enjoying her name being on the office door
lmao zoe telling max to leave some space between their arrivals
“she who is now me”
connie having meetings with everyone now that she’s clinical lead
ethan being in the middle of treating a patient when he’s meant to have his meeting so connie goes with him to watch
“right, you were with that patient for over 18 minutes, what’s your diagnosis?” and then he takes ages saying what his diagnosis actually is sjskfkf
“dr hardy you have the most breaches of the 4 hour target of any doctor in the hospital” “right. i’m guessing that’s not good?” “no, not in the ed. if you want to run thousands of tests become a rheumatologist not an ed physician” “i’m hoping that’s sarcasm and not a recommendation?” “correct. you’re gonna burn yourself out not to mention my budget.”
then he exhales after connie walks off and lofty pats him on the back sjskdkfjdjd
jeff saying his wife’s away in peru and “it’s complicated” so you’re not gonna tell her exactly how it’s complicated because it sounds like you’re tryna cheat😭😭
LMAO lofty going “what’s up, sherlock?” to ethan
he’s got a patient with a chest infection and he thinks it’s probably just a normal one but he wants to know which pathogen caused it but then connie walks past and he’s like “though, that’s not something we will necessarily work out now in the ed”
lofty going “you’re going to look up chest microbiology in your break aren’t you?” and ethan goes “probably” SJDKFKFK nerd (affectionate)
lofty robyn and max selling sweets and chocolates
“ah lofty, i’ve been hearing tales of illicit confectionary”
lmaoo ash finding robyn and lofty selling out of a store cupboard
oop cal’s turn and connie is not happy “dr knight.” “hey” “hey?” “sorry i missed our appointment i got stuck with a patient” “no according to the records you never get stuck, you have the fastest turnover of patients there is” “thank you very much” “no it wasn’t a compliment. my office. your notes are very sketchy. CN2 12 intact? that doesn’t tell me you’ve done a full neuro examination” “yeah but that was just shorthand, i always do every step” “if your patient walks out of here and dies i would not be able to defend you in a coroner’s court, be more thorough dr knight, in you go”
i love how cal has the exact opposite problem to ethan. and i love how different connie’s demeanour is with them skskfkfkf ig bc cal didn’t tell her that he couldn’t make the appointment and then was so cocky and dismissive whereas ethan actually listened to what she told him
patient’s dad asking louise if she knows what these pills are and her saying “sorry i’m not a medic” interesting…
the patient who was flirting with jeff is on some “friends of holby trust” committee with connie and they raised money for an echo machine. connie saying she normally goes private so they have to show her the very best of the nhs
“ten years ago ct scans in the ed were unheard of. if i get my way, you’ll be training in echo, and a lot more besides” and zoe rolling her eyes sjskfkfkfk
connie letting ethan use the new echo as a reward🥺
i love how the patient’s literally awake here like it must be so disconcerting to be aware of a consultant actively training a junior doctor using you, even if it’s just a scan
i hate that i now can’t watch this scene without thinking of that bloody london episode. honestly fuck whoever thought up that kiss😭
connie and zoe walking towards the door as they watch ethan with the echo “he’s in his element” “mhm” “i hired a few good ones in my time” “yeah, you did” i love how he can absolutely still hear them like they didn’t even leave the room just walked like a metre further away from him sjdkdkfkf
robyn and lofty trying to sell lily some chocolate. unsuccessfully of course
aww ethan telling cal “mrs beauchamp let me do an echo on the guy who collapsed in the car park!” and cal replies sarcastically “wow. that is impressive.” and zoe’s sighs like “oh, give your brother his moment of glory for once” and cal really over exaggerates and pats his shoulder and goes “well done”
lmaoo max asking zoe if she and connie have finally called a truce and she’s like “i’m not that petty. anymore”
rita saying she feels like she’s walking on fletch’s grave by applying for his old job skskdkfkfk you can literally see him again in like a few weeks
jeff going to visit the woman who was flirting with him and she’s wearing heels despite having a cast on her leg???? girl…

Genshin Impact Idol AU ideas
So we all know the groups Veechu made with 4nemo, DCKZ, L/yue and, TVT DREAM however, I thought it was a crime the actual idol Barbara wasn’t in a group so, I made my own! I do not have the skills to draw this so, I will be including concept photos by actual groups(older and newer as well as the time in those examples i think suits them just for an example bts run era - dope era for a boy group) for the general vibe. Click on their names for a link to the kpop wiki about them. I also won’t include Lumine because many fans have made their own headcanons for that I like.
Feel free to use the ideas I added to this in fanworks just please credit me for the idea of the groups I made myself if you do. All will be under the read more so mobile users don’t break their fingers trying to scroll past. Wiki links are included for each real world inspiration. If looking for a specific character use ctrl+f on PC to search for them to make your life easier.
Note: their stories can be changed if you would like to make it different for your art/writing/whatever. I just think a bit of drama makes them feel more real. None of the stories are 100% based on any real group even their inspirations aren’t direct copies. As new characters are released/shown in stories I will be adding onto existing groups I made up or, making new ones so if you like my ideas save this and come back to it.
7evelUp! [pronounced Level Up!]
A rookie girl group created from the top seven trainees(voted by judges & public vote) in a survival show that quickly gained international fame from their debut single and, performance. No one doubts their talents however, some question how legitimate the voting/ranking was in the show. No one blames the girls themselves for this and, there is no real evidence to prove this. All of the members believe the show to be real due to their own experiences too although, a few of them due to their low self-esteem believe other trainees would’ve been better suited in the group even if they are thankful for the support. It will take a while for all of them to adjust and, have it all feel real. Will they rise to super stardom or, crack under the immense pressure?
- Members
Amber (leader, main dancer) 3rd place(got the leader position because she is the one who brought every team she was in together to usually win the challenges showing her leadership skills not from ranking)
Barbara (main vocalist,maknae,center) 1st place
Noelle (lead dancer,visual) 6th place
Sucrose (lead vocalist) 7th place
Xiangling (lead dancer, lead rapper) 5th place

SYZYGY
An unconventional girl group with a unique sound. Despite their enormous amount of talent/skill , they haven’t been as successful as their small company had hoped. However, they continue to invest everything they can into this group much to the displeasure of the other idols under the company. Will their burning hot passion find success with the masses or, will they disband early leaving their company in complete ruin?

1NB (Stalker era - Once again, Winter era)
1MP@CT [prounced Impact]
A previously underrated boy group that seemingly appeared out of thin air on the #1 spots of all major top music charts. Most attribute their overnight success to their newest song going viral on social media but, some who work within their company secretly wonder if it has anything to do with the CEO’s private life and, the new anonymous investors. Regardless, they have made a name for themselves. They have a work ethic like no other and, will do whatever necessary to rise to the top. Even though fans are starting to worry their agency is pushing them too far. Will they become legendary performers the kind that future generations remember by name or, will their boss’ dirty little secrets make them guilty by association to the press when/if the time comes?

DoDoCo
A junior girl group for kids/tweens made(and managed) by Alice to promote her daughter Klee and, have her gain experience for her dream of being a real idol. Although they perform, act, model and, release music similar older groups they still are children so, their concepts are always wholesome feel-good things to appeal to kid’s even younger their age or, younger. They also don’t have the same restrictions or, work hours due to their age. This group is very popular with Elementary schoolers and, sometimes even their families but, can be annoying to anyone older due to how cheesy it all is.
(Note: I don’t personally agree with kids being idols irl especially some I’ve seen that look like older teen/adult idols it’s scary. However, since it is a thing that exists and, this is a fictional head canon let’s pretend this is a world where none of them get hurt and can live pretty normal lives during & after their time as idols if they choose to do so. I just didn’t want to leave a playable character/important story character out of the AU entirely. Also, Sayu would be here but since she’s not officially released yet and, we don’t know any story about her I think it’s best for her to join later.)

RE:KIDS ANGEL (Ocean era) note: also their only era so far it seems but, apparently RE:KIDS is a larger thing with many other kids kpop groups so I assume others would have a similar concept.
CutieL (Debut era - Jungle Journey era)
Dandelion
A girl group that has stayed at the top for the past 7 years known for their elegant concepts although, they have had other concepts in the past(sexy, cute, etc.). Not only is Dandelion super famous but, each member has their own solo careers just as successful. Outside of the group Jean is known for her solo albums and, charity work. Lisa is known for her modelling career and, secretly is a successful author under a pen name. Eula is known for her many wins on dancing contest shows and, the many important roles she plays in dramas. Since this year marks the dreaded 7 year curse fans worry they might disband or, go on a permanent hiatus. Before this year they seemed inseparable to fans but, something happened during their last tour. Jean and, Lisa who were known to be best friends suddenly won’t even sit next to each other. Eula who was usually more reserved during interviews is having to do most of the work since they’re just awkwardly sitting on the opposite sides of her. Eula has never been the best at public speaking and, her blunt responses are causing antis to go on huge smear campaigns on social media. Jean who previously wanted to renew her contract is thinking about starting her own company. Lisa who previously wanted to renew her contract now wants to leave and, join a modelling agency. Eula still wants to renew her contract but, she doesn’t want to be solo yet. She is trying her hardest to get the group back together but, her harsh personality is only making the problem worse she feels. Will they stay together or, will they split? And if they stay together, will it be the same Dandelion fans fell in love with or, are some bridges burned forever?

- Ayaka
From a wealthy Inazuman family Kamisato Ayaka (known as Ayaka) shocked the entire nation when she decided to stop pursuing traditional dance(which she had earned many honors and, was famous for since she was a small child) and, instead go overseas to become an idol. Due to her connections it wasn’t long after becoming a trainee that she was put on the same survival show that formed 7evelUp!. However, her good luck ran out when after filming she got into an accident in her company’s car on the way to her company’s trainee dorms. Thankfully, no one was seriously injured but, she sustained an injury to her ankle that made her unable to perform for the rest of the show and, therefore was disqualified. She was a fan favorite and, everyone was heartbroken that she couldn’t compete. Due to her popularity, her company decided that if she could prove she was able to work after being healed they would let her have a solo debut. She far surpassed their expectations being even better than she was before, resulting in her debuting the same time 7evelUp! did. She doesn’t have any negative feelings towards those girls but, she views them as her rivals. She is quickly gaining popularity for her insane talent in singing, dancing, acting, modelling and, song-writing. She is known to the media as “The Idol Princess” for her family’s wealth, her talent and, her graceful demeanor. Don’t put her into a box though, she can pull off any concept with ease. The question is though, will her company allow her the freedom to express herself to the fullest?
- Real World Inspirations
Note: I am not saying she would be super similar to these artist’s work but, I am saying she has the range and, the potential to reach this level of fame. Since I can’t pinpoint a single solo artist that has what I think she would do I’ll put the ones I think have the insane talent and fame I think she would have as well as a similar feeling although it will take a while for her to get to their level

That was all of the Genshin Impact characters that I know enough about currently to feel comfortable making headcanons for them! Let me know what you think and if you make fanfic of or fanart of these ideas please credit me for these specifically and veechu for the idea of the idol au in general! Feel free to spread this post around if you want to or repost it too with credit. I also would love it if you tagged me if it’s on here or would be kind enough to send me a link to your work/work you find of it.

Mitchell Annotate this Case 218 S.E.2d 332 (1975) 288 N.C. 360 STATE of North Carolina v. Pinkney Thomas MITCHELL, Jr., and Wallace Charles Lanford, Jr. No. 7. Supreme Court of North Carolina. October 7, 1975. *335 Atty. Gen. Rufus L. Edmisten by Associate Attorney Robert W. Kaylor, Raleigh, for the State. Robert H. Forbes, Gastonia, for Pinkney Thomas Mitchell, Jr. and Robert E. Gaines, Gastonia, for Wallace Charles Lanford, Jr., representing defendant appellants. COPELAND, Justice. Defendants were represented by separate counsel and filed separate appeals. Some of the assignments of error are the same and some relate only to one defendant. Our Court has held that where there are two indictments in which both defendants are charged with the same crimes, then they may be consolidated for trial in the discretion of the court. State v. Combs, 200 N.C. 671, 674, 158 S.E. 252, 254 (1931). "The Court is expressly authorized by statute in this state to order the consolidation for trial of two or more indictments in which the defendant or defendants are charged with crimes of the same class, which are so connected in time or place as that evidence at the trial of one of the indictments will be competent and admissible *336 at the trial of the others. [Citations omitted.]" Id. at 674, 158 S.E. at 254. G.S. 15-152; State v. Dawson, 281 N.C. 645, 190 S.E.2d 196 (1972); State v. White, 256 N.C. 244, 123 S.E.2d 483 (1962). Defendant Mitchell contends the consolidation was prejudicial to him because of the testimony of William Richard Stewart, the brother-in-law of defendant Lanford. A careful examination of the record indicates that Stewart testified as to substantially similar incriminating statements made by each defendant in the presence of one another. In essence, Mitchell adopted Lanford's admissions to Stewart. Defendant Lanford contends that the consolidation was prejudicial against him because defendant Mitchell testified in his own behalf at the trial and attempted to mitigate the killing and reduce it to second-degree murder because of his use of drugs and intoxicants. Lanford contends that this especially hurt his case since he elected not to testify in his own behalf. There is absolutely nothing in the record to indicate that the trial judge in making his ruling on consolidation knew that Mitchell would take the witness stand. In any event, Mitchell had a right to testify if he wished and Lanford could cross-examine him. Moreover, it is difficult to understand how Lanford can contend that he was prejudiced by Mitchell testifying when in fact Mitchell admitted the killing and the burning of the vehicle and attempted by his testimony to exonerate Lanford in every way. It was proper and appropriate for the two defendants to be tried together and there is no merit to this assignment of error. Defendants Lanford and Mitchell next contend that the court should have dismissed the cases against them as of nonsuit and for mistrial for the charges of first-degree murder at the close of the State's evidence and at the close of all the evidence. Lanford makes a similar contention with respect to the charge of felonious burning of personal property. Upon a motion for nonsuit, the trial court must consider the evidence in the light most favorable to the State. The trial court is not concerned with the weight of the testimony, but only with whether the evidence, be it direct or circumstantial, supports sending the case to the jury. State v. McNeil, 280 N.C. 159, 185 S.E.2d 156 (1971); State v. Goines, 273 N.C. 509, 160 S.E.2d 469 (1968). Conflicts and discrepancies in the evidence should be resolved in the State's favor. State v. Cooper, 286 N.C. 549, 213 S.E.2d 305 (1975); State v. McNeil, supra; State v. Cutler, 271 N.C. 379, 156 S.E.2d 679 (1967). In order to convict the defendant of first-degree murder, the State must satisfy the jury beyond a reasonable doubt of all the elements thereof, to wit, an unlawful killing of a human being with malice and with a specific intent to kill and committed after premeditation and deliberation. "Of course, ordinarily, it is not possible to prove premeditation and deliberation by direct evidence. Therefore, these elements of first degree murder must be established by proof of circumstances from which they may be inferred. [Citations omitted.] Among the circumstances to be considered by the jury in determining whether a killing was with premeditation and deliberation are: want of provocation on the part of the deceased; the conduct of the defendant before and after the killing; the use of grossly excessive force; or the dealing of lethal blows after the deceased has been felled. [Citations omitted.]" State v. Buchanan, 287 N.C. 408, 420-21, 215 S.E.2d 80, 87-88 (1975); State v. Van Landingham, 283 N.C. 589, 197 S.E.2d 539 (1973); State v. Hamby and State v. Chandler, 276 N.C. 674, 174 S.E.2d 385 (1970); State v. Sanders, 276 N.C. 598, 174 S.E.2d 487 (1970); State v. Walters, 275 N.C. 615, 170 S.E.2d 484 (1969); State v. Faust, 254 N.C. 101, 118 S.E.2d 769 (1961). An analysis of the facts of the case in relation to these factors reveals a want *337 of provocation by the deceaseda sixteen-year-old girl. The conduct of defendants before and after the killing supported an inference of premeditation and deliberation as well as the other elements of the crimes charged. The State's evidence permits the following reasonable inferences: defendants abducted the victim and had sexual relations with her; defendants told Stewart that they had killed the victim; defendants later departed in the victim's automobile and burned it in order to destroy any evidence; and defendants secured another vehicle in which to leave Gaston County. The use of grossly excessive force was indicated when the deceased was found tied to a tree, gagged, and stabbed numerous times in vital areas of the body. In summation, there was plenary evidence as to both defendants from which to show premeditation and deliberation as well as the other elements of the crimes involved. This assignment of error is without merit and is overruled. Defendant Mitchell contends that the trial court committed error in the charge to the jury. Counsel for Mitchell, with commendable frankness, states that none of the exceptions, in his opinion, would entitle Mitchell to a new trial. Counsel requests the court to review the charge. This has been done and we conclude that there was no error. Defendant Mitchell contends the court erred in permitting the witness Shellnut to change his description of the defendants on voir dire. There was no voir dire of Shellnut and he did not identify defendants. There is no merit in this argument. Defendant Mitchell also contends that it was improper for the court to receive evidence concerning the home life of the deceased, photographs of the area in which she lived and where she was seen with the defendants, and photographs of the deceased, the automobile, and its contents. In connection with these assignments of error, counsel for the defendant concedes that none of these individually would entitle the defendant to a new trial, but should be considered reversible error when considered as a whole. All of this evidence, save that of the home life of the victim, was competent and relevant to establish the identification of the victim, the ownership of the Volkswagen, and the identification of the general area where the crimes had their inception. The photographic evidence was introduced with limiting instructions for the purpose of illustrating the testimony of the witnesses. State v. Atkinson, 275 N.C. 288, 167 S.E.2d 241 (1969). If the evidence pertaining to the home life of the deceased was error, then it was clearly harmless beyond a reasonable doubt. State v. Jones, 280 N.C. 322, 185 S.E.2d 858 (1972); Chapman v. California, 386 U.S. 18, 87 S. Ct. 824, 17 L. Ed. 2d 705 (1967). These assignments of error are overruled. Defendant Mitchell also contends that admission of the testimony of the witness Stewart was prejudicial error. As stated earlier in the discussion on consolidation, there is no merit in this related contention for the reasons there stated. A further contention of Mitchell is that the failure of Lanford to testify caused the jury to have grave doubts concerning Mitchell's defense. This argument has no merit. The record indicates that Mitchell by his own testimony admitted the killing and the burning of the Volkswagen and attempted to excuse himself of murder in the first degree because of the use of drugs and intoxicating beverages. Defendant Mitchell contends that he did not have sufficient mental capacity to form the necessary premeditation and deliberation. In this connection, the trial court properly charged the jury on the law relative to voluntary intoxication and voluntary use of drugs. It was properly left for the jury to determine whether Mitchell's mental condition was so affected by intoxication or drugs that he was rendered incapable of forming a deliberate and premeditated purpose to kill. State v. Propst, *338 274 N.C. 62, 161 S.E.2d 560 (1968). This assignment of error is overruled. Both defendants contend that the court erred by refusing to set the verdict aside as being against the greater weight of the evidence and refusing to declare a mistrial. These motions were addressed to the discretion of the trial court. That discretion was not abused. 3 Strong, N.C. Index 2d, Criminal Law, §§ 128, 132. As a matter of fact, we have fully considered this in the discussion on the motions for nonsuit. These assignments are without merit and are overruled. The defendants have had a fair trial free from prejudicial error. Kathy was sent to her death in a vicious manner by these defendants. The case was ably prepared and presented by the district attorney and carefully and fairly tried by Judge Grist. In the trial we find No error. North Carolina Supreme Court opinions.
Wallace Lanford and Pinkney Mitchell were convicted and received life sentences in Smiley's killing, and both have since died in a state prison.

CANTLON: UCONN WINS FIRST PLAYOFF GAME
BY: Gerry Cantlon, Howlings HARTFORD, CT - UCONN punched their ticket to the Hockey East semifinals with their first-ever playoff win in Hockey East, 3-1 over the #16 ranked Boston University Terriers on Saturday. The win gave the Huskies 19 on the season (19-15, overall) and established a school record for the most wins in a single season in school history. The win also ended an 0-9 record in post-season play. UCONN take on Northeastern, who were 3-2 winners over Boston College after another stellar Devon Levi performance. The game will be on Friday at 4:00 PM. Levi stopped 100-of-103 UCONN shots two weeks ago in a two-game series. CAVANAUGH EXCITED As the seconds ticked off the XL Center scoreboard, Huskies Head Coach Mike Cavanaugh turned around and, with both fists, slammed the glass behind the UCONN bench. Ten years of emotion poured out and let out a primal scream joining the frenzied scene at the UCONN bench. “It was raw emotion. When I came to UCONN, my goal was I wanted to build a blue-chip program, not a dot com (one with a transitory presence). Not win a few years and go back down again. A program that got better and better. Face it, we as a program hadn’t won a playoff game. We had great efforts, but we still hadn’t done it yet. So, when we finally did, it was raw emotion (that) came out.” THE FINAL SAVE A grad transfer from Union College, Darion Hanson, came to the Huskies with the second most playoff experience (19 junior A games) behind Jarrod Gourley (23 and a championship with Spruce Grove - AJHL) faced just one shot in the final 1:53. “It felt like more,” Cavanaugh said with a laugh. With the extra attacker on the ice for the Terriers, the last save for Hanson came off a left-wing circle face-off win by BU’s William Skoog. He got it back to Domenick Fensore at the left point and launched his fourth shot on the net. Hanson Hanson found the puck through a maze of players to make the save. “They won the face-off. So it’s my job as a goalie to follow the puck at their point. I saw the release from the point. I didn’t see it a little bit and lost it. It came through some skates, then it hit something, deflected and it hit me in the hip. I was down on the ice, on my hands, and looked over and saw it there. The rebound was there for anybody to take,” Hanson said, recounting the scene. “I didn’t see anything for a second, but then I saw (teammate) Marc Gatcomb came in and swept it away,” Hanson added. “When that happened I knew it was over. That’s something I’m not gonna forget for awhile.” Hanson set a school record for Division-1 wins (19). He made 38 saves, with 19 of them coming in the third period as BU put pressure on. BRADLEY BACK Chase Bradley missed the last six games with an injury. He had a sure goal late in the first period that rolled off his stick, but he would capitalize later with an empty-net tally to secure the win. He tugged his jersey as he skated around the BU net. The UCONN bench and the fans erupted in spontaneous joy at the win. “We missed him for six games and we were two-and-four without him. Having him and Nick Capone back in our lineup tonight created momentum for us. He’s a strong player, strong on the puck. He’s a strong presence for us.” GAME-WINNING GOAL Jonny Evans ended an eight-game goal-scoring drought with what proved to be the game-winner for UCONN. It was the game’s second goal and came off a strong play by Ryan Wheeler. Evans’ shot went off BU goaltender Drew Commesso. The rebound went to Wheeler after hitting BU defenseman Domenick Fensore. The puck caromed to Marc Gatcomb, who calmly corralled the loose puck and set it on the backdoor to Evans, who went to the forehand and buried his sixth of the season past Commesso at 10:26. Evans had no nervousness being around the semi-open net. “Honestly, I didn’t think about it. I just wanted to get it over his pad. It was a slight angle, but we got a good bounce.” Cavanaugh was very pleased with Evans. “His compete level was high and he was making plays in front of the net. He could have had a couple of goals and did all the little things to be successful.” Getting two, but especially getting that first past, Commesso was important. “We came out strong and that was a point of emphasis getting one by him. Sometimes you do all that work and have nothing to show for it. We got that goal and felt pretty good about ourselves going into the second period,” remarked Cavanaugh of an 18-shot first period. GOALS AND DEFENSE Vladislav Firstov circled back in the offensive, made a perfect tip of Jake Flynn’s shot from the right point for the first UCONN goal. The UCONN team defense limited Fensore and William Skoog to four shots apiece for the game and the lethal Luke Tuch to none. “I’m glad for us. We practiced this all week and that we had a game like this, this the way it’s gonna be like (in the semifinals) the further you go the greater it will be.” Fensore’s goal for BU (19-13-3) at 13:01 of the third period caused a tightening of UCONN’s neck collars. Fensore blasted a Jay O’Brien pass from the left-wing corner in the lower face-off circle. It would be the only puck to evade Hanson in the game. HANSON STRONG IN THE THIRD PERIOD Entering the third leading by two goals, Hanson was calm, cool, and collected as he evoked memories of another Connecticut goalie, Jeff Malcolm, who now finds himself just across the hallway as the goalie coach for the Hartford’s Wolf Pack (AHL). Malcolm led Yale to a national title in 2012. Malcolm also was calm, measured, and deliberate about facing that pressure heading into the third. “To be honest, it’s nothing noteworthy. A big piece of being successful in the playoffs is you just try to block out the noise. It’s the third period. We’ve got the lead. It’s not like something we haven’t seen before. They are playing great and I have trust in these guys. We just went out and were shaving off minutes, one by one.” Cavanaugh paid his goalie the props he deserved. “He made that big-time save at 2-1, and he’s been doing that all year long for us. He’s been steady as a rock and he’s a super kid. He’s better off the ice, than on if you can believe that, and glad he is in our goal.” Cavanaugh also didn’t shy away from the matchup of Jachym Kondelik, the conference’s Defensive Player of the Year, and BU’s Alex Vlasic. It’s a clash between two giant-sized players as Kondelik is 6’6 and Vlasic is 6’7. “I think they were matching Vlasic on him, not the other way around,” Cavanaugh said with a wry smile. Kondelik was double-shifted in the third period. “He was named as the best defensive forward for a reason. He’s a strong player, and wins puck battles. The thing I’m most proud of with Jachym is how he has grown into it and become a real leader for this team.” LINES Gatcomb-Evans-Turnbull Firstov-Kondelik-O’Neil Schandor-Schlaine-Tverberg Bradley-Capone-Veilleux Kinal-Spetz Wheeler-Rees Flynn-Gourley Berger Hanson Terness SCRATCHES Sasha Telguine John Wojciechowski Aidan Metcalfe Gavin Puskar Matt Pasquale Cassidy Bowes NOTES Somewhere in the heart of Kansas City, where defenseman Miles Gendron, the former Huskies captain, plies his trade professionally in the ECHL, saw his declaration from over three years ago come true for this group of Huskies. 354-430 AD-St Augustine believed that faith comes by hearing and that deafness is a hindrance to faith. However, he believed that Deaf people can learn and thus are able to receive faith and salvation. Augustine refers to bodily movements, signs, and gestures, and believed that these modes were capable of transmitting thought and belief. He implies that it is equal to spoken language.

1591-Alberti, a German physician, published the first book of any kind specifically regarding deafness: Discourse on Deafness and Speechlessness. He stated that hearing and speech were separate functions. Alberti believed that Deaf people were rational, capable of thought, even though they lacked speech. He showed that the Deaf can read lips, understand speech, and read, without the ability to hear.
1614-1684-John Bulwer was a British physician who studied gestures and published Philocopus, also known as the Deaf and Dumbe Man’s Friend in 1648 and Chirologia, also known as the Naturall Language of the Hand in 1644. These were the first English books on deaf education and language.
1620-Earliest records of Deaf Education occurs in Spain. Melchor de Yebra and Juan Pablo de Bonet are prominent during this era.
