Self-addressing of minor male characters in Ace Attorney (Gyakuten Saiban) / Personal pronouns
We've talked about the main male and female characters, but we shouldn't forget about the minor male characters who accompany us throughout at least each part of the Ace Attorney (GKS) series
The first man who accompanies us throughout the first trilogy is Itonokogiri Keisuke (Richard/Dick Gumshoe)
And here's an interesting point. His pronoun is "jibun" (自分)

自分は、刑事課の イトノコギリという者ッス。
Jibun wa, keiji ka no Itonokogiri to iu mono ~tssu.
I'm from the Criminal Affairs Division. My name is Itonokogiri.
This is a rather rarely used pronoun; it literally translates as "self", although it has the meaning "I/me".
Jibun is used by about only 14% of men and 1% of women. This fact makes the pronoun gender-neutral, but predominantly masculine.
Compared to other first-person pronouns, the nuance of 自分 is introspective, and it's often associated with the military or athletic community, which have strong hierarchies. This suits Itonoko's personality very well, considering that he is a subordinate of the prosecutor and rarely thinks for himself.
Also, "jibun" can be an indicator of the Kansai dialect (Osaka), where it is used to denote both the first and second person. But, since Itonoko's speech was not noted to have any dialect (there are other features), and he was born and raised in the same city (and the city is from the Kanto region), this option is out of the question.
Interestingly, even after Itonoko realized that detectives should do their own investigations rather than rely on directions from prosecutors, and began making decisions on his own, his self-address did not change. Probably a matter of habit.
自分は、何をしたらいいッスか・・・・

Next is our dear friend's father, Mitsurugi Shin (Gregory Edgeworth)
His speech is very formal (like his son's), and he uses the formal personal pronoun "watashi" written in kanji.

私は弁護士の御剣信と申します。
Watashi wa bengoshi no Mitsurugi Shin to mōshi masu.
My name is Shin Mitsurugi, a lawyer.

Let's not forget about Mitsurugi assistant - Shigaraki Tateyuki (Eddie Fender, almost wrote Raymond Shields)
Most of his dialogues take place with Mitsurugi and young Yatagarasu, and he stubbornly continues to call himself "uncle". (オジサン - ojisan)

オジサン、アトでここの館長に 文句言っとくから。寒すぎだって。
Ojisan, ato de koko no kanchō ni monku I~tsu toku kara. Samu sugi datte .
Uncle going to complain to the director of this place later. It's too cold.
It was not easy to catch his personal self-addressing with other people, but not impossible.
In dialogues with others, Shigaraki-san uses the polite male pronoun "boku" (like Naruhodō/Wright)

ぼく、その・・・・! がんばって助けますからッ!
Boku, sono! Ganbatte tasuke masu kara ~Tsu !
I, well...! I'll do my best to help you!

The new generation is first represented by rock star and hard-working prosecutor - Garyu Kyoya (Klavier Gavin)
Despite his prominent image as a musician and rock star, Kyouya uses the polite masculine pronoun "boku" (the same one used by Naruhodō/Wright).

ぼくも楽しみにしているんだ。
boku mo tanoshimini shite iru nda.
I'm looking forward to it too.
His speech is generally polite, and in the original he uses various English phrases in his speech, written either in Latin or Katakana. These phrases, by the way, are often used at concerts of musical groups whose first language is not English. (In the localization, as you know, German was used as a substitute).

オーケイ、ベイビー!

Okay, baby!

Mr. Garyu Kirihito (Kristoph Gavin) uses the personal pronoun "watashi", which is written in kanji, indicating formal speech and an adult character.

The second prosecutor from the new generation is a master of psychological manipulation, Yugami Jin (Simon Blackquill)
To be honest, his image as a samurai somewhat clouded my eyes, and I expected some self-addresses inherent in this category (for example, "yo")
But no, Yugami-kun uses the crude male pronoun "ore" (like Odoroki/Apollo)

それと、俺は検事ってェ立場上、 おめえさんに手は貸さねェからな。
soreto, ore wa kenji tte ~e tachiba-jō, o-me e-san ni te wa kasa nēkara na.
Also, because I'm a prosecutor, I won't help you.
We don't know when he started using this designation (there are no monologues from him before his arrest), but judging by his characterization from other characters, he behaved very noble and politely, so perhaps he could change the personal pronoun to a more rude one to maintain the image of a "cruel criminal".
His manner of speech is, in principle, extremely interesting, and, I think, worthy of a separate post. In short - he speaks in a dialect + uses obsolete words + he has a special way of addressing other characters

The third prosecutor from the new generation, who is also a monk from the kingdom of Khurain - Sahdmadhi Nahyuta (his name was not localized, thank you)
But this young man has an extremely interesting way of addressing himself.
"Sesso" (拙僧) literally means "inept monk".
This is a VERY modest form of address that was used by Buddhist monks.

拙僧がこの事件の担当に ふさわしくないと・・・・?
sessō ga kono jiken no tantō ni fusawashikunai to?
Are you saying I'm not fit to take charge of this case...?
But, this is very different from his speech. Canonically, he is a foreigner, so he does not know all the features of the language in which the hearings are held. Therefore, Nahyuta uses, either unknowingly or intentionally, quite rude vocabulary and manner of speech (at the first hearing with him as a prosecutor, the judge, Odoroki and Kizuki were shocked). Even a native speaker, whose walkthrough I watched, was surprised and commented on this moment.

Is the death note 2015 drama good?
I’d say yeah, actually. It really was! 8, maybe 8.5 out /10.
i have to be real, I seriously loved watching this series, particularly the second half. I’ll do a spoiler free review first, but I do think I need to make it clear that I did not watch this in the conventional way let’s just say. My sibling and I watched this through a nearly 200 video long playlist of 2 minute clips on YouTube, in Japanese (duh) with Portuguese subtitles- note that neither of us speak Portuguese, nor Japanese, and are only vaguely competent in Spanish and French respectively, so my experience of the series may be a little skewed to how it may come off in its original or properly subbed versions. I cannot speak on how the writing was for the dialogue, for example, but I can talk about the plot, characterisation, etc.
if you want to watch any live action adaptation (that’s not the musical, because GO WATCH THAT) it had better be this one.
SPOILER FREE REVIEW STARTS HERE
first off, the changes. Boy were there changes. Practically the entire plot takes a hard left right from the start, and it keeps on going from there. Vague outlines, like Yotsuba and misa and Mikami and yellow box warehouse remain, but the circumstances are all vastly different. i adored the changes to both Watari and L’s relationship, and both of theirs with near and… Mello. I don’t think it really spoils much for me to say that for some reason known by only the writers of that series and god, Mello is made an alter of Near’s that is represented by a ventriloquist dummy. i also will never be the same after this version of soichiro and Light’s relationship. The fact they seem closer yet more distant, and the parentification of light drives a wedge and brings them together at the same time. As much as I LOVE the original version of them, there is something just more utterly devastating about these two here. The mock execution for example ends with light clinging onto his father while they both sob, and I’m not even joking when I say that it brought me to tears.
speaking of parentification, the reason for that is Dead Mom Trauma. Yeah they killed off Sachiko (which I’m not counting as a spoiler because it’s revealed within the first episode and has no plot relevance other than giving light MORE motive). I’m not too sure why this was necessary, and it’s this type of slightly contrived writing that drops its rating a bit for me. This didn’t need to happen
on the topic of light, he is a VERY different character in this. He’s messier, a nervous wreck half the time, smart but not so infallible as anime or manga light. He panics with raye penber, panics with light, IS A MISA MISA FAN and has a job. He has a best friend and a bully. He’s more average, and knows loss, and his decline is less of a sharp drop off than it is a slow painful descent into utter madness and evil. He’s a babygirl until suddenly you see a flashback and realise he’s not that guy anymore
Ryuk is great. An annoying bastard who watches on through the end.
Misa is also pretty good. She’s pretty similar to the source material tbh, but has a little more agency, and has Mikami as her lawyer, or at least the lawyer who told her her parents murderer was going free, which is interesting
speaking of Mikami, he is a secondary character pretty much the whole way through, and we get to see his build up of resentment towards the criminals who go free despite his efforts, which I very much enjoyed. I always felt like he came out of nowhere a bit in the anime, so this was a welcome change.
before I completely move on from light and miss, btw, light and his friend genuinely go to about 5 SEPARATE ICHIGO BERRY CONCERTS OVER THE SPAN OF LIKE 4 EPISODES?? Ichigo berry is misa’s group in this, and I find it hilarious that light was a fan before even the death note showed up
aaaaand for L. He’s really damn good. His characterisation is widely different from the anime, he’s more optimistic and suave in a way, he smiles and lounges in his chair instead of crouching, and wears white button down shirts and trousers and hands Watari clearly empty pieces of paper to which Watari declares ‘another wilful request!’ And goes on to do some task for him. He has a screensaver on every computer in this hotel room designed as task force hq that changes at night to a nighttime version. He's hot. He’s gay. He’s autistic. He’s totally different to the L we all know and love but at the same time is recognisable as L and loveable in his own way. overall, the plot was pretty good although it was very messy to begin with, raye penber is like,, a main antagonist, for the first 3 eps??? The Shinigami cgi is awful, the fashion is painfully mid 2010s and the characters are very clearly not the same as in the original. if you go into it expecting a perfect 1-1 of the anime, just LA, you’re bound to come back disappointed. If you go into it looking forward to seeing an alternate take on the world of death note, another universe where everything is a little to the left, you’ll thoroughly enjoy it. The emotional beats hit hard, and given it’s a tv drama, the story focuses far more on the characters and their emotions than the mind fuckery we’re used to. What does remain, however, is the Lawlight, to such an extreme degree where I find it plausible that they knew what they were doing. They knew that their relationship could come off as romantic, and played it up. now onto the spoilers!

I LOVE THIS DAMN SHOW ICL
Light killing his bully and trying to erase the names??? Otoharada almost killing Soichiro??? THE CAMERAS STILL BEING THERE WHEN MISA ARRIVES???!!?!!
gahhh where do I even start. I’ve got FEELINGS about L’s death and Soichiro’s, FEELINGS about the dad friendship of Watari and Soichiro, FEELINGS about the lawlight of it all.
My sibling and I are both staunch supporters of both the Good Dad soichiro and Good Dad Watari perspectives, and we were FED. I scrumpt many screams at just how fed we were getting, that’s how good it was. i guess I’ll start with that. The conversation between soichiro and Watari about their ‘kids’ was genuinely moving, and it was adorable to hear them both talk about how much they love their children.
that made it all the more heartbreaking when soichiro died. At that point, L was dead (which I will get to) and near/Mello was on the run, which left Watari utterly alone. The only person using hq at that point was light, who was fully Evil and he knew it. I screamed so loud it started everyone around me when soichiro said Light’s name while he was monologuing. That is EXACTLY how I wanted a confrontation between them to go down. Soichiro seeing through lights acting and lies and being so distraught that it was true, his son was Kira, and it was obvious the whole time when you knew where to be looking. The way he never took his eyes off of him after L’s death, and the way that that allowed him to see all the little glances and ‘that Kira face you make’ as Ryuk put it. He saw under the mask, and was disgusted by what he saw. When he screamed lights name as he tried to weasel his way out of it like he had done for L’s death, I’d like to think it was the first ounce of fear he’d felt since L had died. And of course he denied denied denied right up until Soichiro tried to burn the note, and THAT was when he screamed and fought and begged, not when his father was writing his own name in the note which he had sworn was a fake. He let his father die, but drew the line at the book being burned.

without a single ounce of a joke, that was my favourite scene in the series. One of my favourites in DN as a whole. As I said in the non-spoiler section, this contrasted with the mock-execution scene is just so devastating, yotsuba!light loved his dad so damn much, and Kira just watched him kill himself, knowing full well he could stop it.
In tandem, L’s death was so underpinned by the friendship between L and Light as well. They don’t just pretend not the despise each other, they genuinely tolerate, or even get along. Of course I could point out the obvious, like the shower scene or ‘I wish we could have met another way’ ‘this is the only way we could have met’ but i actually want to bring up some smaller points. First off, that moment where Matsuda asks him why he still calls L Ryuga instead of L or Ryuzaki, and he tells him that it’s because he’d rather have Ryuga the friend than L the detective. And even just prior to the ‘I wish we could have met…’ scene, when light thinks he’s about to kill L he sobs as he tells him that all he wanted is to show L his new world, and that he wants to be his friend forever (‘friend’ yeah ok dude). He screams and kisses(?) his head when he does die, and rocks him as he lies there, and holds him close until he’s taken away. And L’s final posthumous video. The one where he says, even though he admits the chance that he was wrong and this video needs to be shown is slim, that he was sorry for doubting Light and that he’s glad to be his friend, and that he would be good enough to come and work with him and Near someday. And Light never gets to see that video.
the scene where L comforts near/Mello after his death is so tragic it hurts. Watari is crying, and he hugs near despite the fact that they seemed pretty detached from each other prior. They’ve lost family, and even Wammy’s in this version are allowed to let emotion overcome them.
somethings I wasn’t too big a fan of included:
raye penber being SUCH A MAJOR ANTAGONIST?? why was he a bigger threat than L for so long. Why was his real name actually Mark Dwellam or something. Why didn’t Naomi exist (well I know we got Himura/Lidner but still) why did light take such a big risk instructing him to write the names IN A CAFE?? He almost killed Light. He figured it out before anyone else really, and it’s so ridiculous that this man really did All That.
also, Yostuba was anticlimactic. The whole arc lasted barely an episode and a half, if that, and I really loved this version of mind wiped light and Misa, so that was a real shame. They figured out about Higuchi so quickly it was hilarious. The CGI when light was pricking his finger to write with was glaring obvious and bad, and duh I didn’t expect the actor to actually do it but it broke immersion a bit when this blob of blood looks so clearly edited in. You can really tell he just pressed the side of the needle into his finger and that made me laugh a bit. The good thing about the bad things is at least they’re funny and not just frustrating.
my final major grievance was just with the pacing. I feel like they hit the sweet spot between episodes 8-10 and then fell flat in the last one a bit. It feels pretty rushed but also like it dragged somehow. The first few eps definitely dragged, while the middle section flew by. also, ichigo berry performs the same song every time.
To conclude, this is a totally different show to the original and the characters reflect that. Light is a nervous wreck far longer than he’s the psychopathic god of the new world, and L is a cool guy who eats fruit pouches(?) and tbh they should kiss cos of that. Light as a clearly gay-coded make up designer slayed. Goodnight all.

Blatantly Partisan Party Review II (WA 2025): Shooters, Fishers, and Farmers
Prior reviews: federal 2013, VIC 2014, federal 2016, VIC 2018, NSW 2019, federal 2019, federal 2022, VIC 2022, NSW 2023, plus my friend’s b_auspol review for WA 2021
What I said before: “I’m from a rural family, I know the value of a rifle on a farm, and I know this party is full of shit.” (NSW 2023)
What I think this year: These gun-obsessed drongos are running a “put Labor last” campaign and that should not be surprising, because last year the Cook government passed new firearms legislation that has been touted (not least by Labor itself) as the strictest gun control in Australia. Among other things, this legislation imposed a limit on how many guns an individual can own. Of course this has raised the ire of Shooters, Fishers, and Farmers (SFF, or as they clunkily abbreviate themselves in this state, SFFPWA). They believe that restricting legal gun ownership will not reduce illegal gun ownership, which is about as silly as saying that we don’t need laws against murder because people kill other people anyway.
What else? They are mad about the ban on live exports of sheep, which will come into effect on 1 May 2028, but that ban is a federal law so there’s nothing any SFF members of the WA state parliament could do about it. They pin this ban on “a Labor political backroom deal with the AJP”, a bizarre claim when the Animal Justice Party has never held a seat federally. Something on which an SFF member of the state parliament could contribute is state taxation, and here the party’s lack of vision and inadequate policymaking nous is evident. SFF wants to get rid of state land tax, payroll tax, and stamp duty without giving any detail of the “fairer broad based tax regime” they would introduce instead. The quote is literally all they say about their alternative; this is not a serious tax policy.
Also, personally, I would try to avoid my party’s state election page returning “lorem ipsum” placeholder text on Google:
The other odd thing about SFF’s website is that, at the time of writing, the only member of their Legislative Council ticket who has a bio blurb is the second listed person, Karrie Louden (who seems quite concerned about persuading people that her profession as a criminal defence lawyer isn’t about helping crooks walk free). Lead candidate Stuart Ostle has nothing, and he is the only person on their ticket with a chance of winning a seat—Louden would need SFF to at least triple their vote from 2021 to get in. Of their lower house candidates, none of whom are likely to win a seat or even come second, 9 of 26 have bios.
Recommendation: Give the Shooters, Fishers, and Farmers a weak or no preference.

RIGHTS OF PRISONERS IN ISLAM
It goes without saying that Islam caters for the physical and the psychological fitness of prisoners. In Islam, prisoners, like all other members of society, have their rights. They should be treated with care and get the due educational and religious courses that help them improve psychologically and be good citizens after they get out of the prison. While in prison, they are not to be tortured or the like.
Focusing more on this issue, here is the fatwa issued by Sheikh Muhammad Saleh Al-Munajjid, a prominent Saudi Muslim scholar and lecturer: “Islam pays great attention to the matter of prisons and the circumstances of prisoners. It is rare to find anything similar to this in any place or time. The jurists discussed in their books the rulings pertaining to prisoners, their circumstances and how they should be treated. This concern stems from the Islamic concern for the protection of man and respect for his humanity.
To make the matter easier to understand and to make the rulings more clear, the scholars divided the subject-matter into two parts: the rulings pertaining to the personal health of prisoners, and the rulings pertaining to health care in the place that is used as a prison.
Rulings pertaining to the personal health of prisoners
1.The jurists discussed the matter of imprisoning a person who is sick in the first place. Do the authorities have the right to imprison a sick person? The answer is that this is a matter of ijtihad (legal reasoning), and the final decision rests with the judge who must weigh up the reason why this person is to be imprisoned, the seriousness of his disease, and the possibility of taking care of him in jail.
If sufficient health care is available for this sick person in prison, and he is not suffering a serious illness that could kill him if he is detained, it is permissible to imprison him. If such care is not available, the judge may hand him over to someone who can treat him and guard him, without releasing him completely, until it is possible to imprison him again.
2.If a prisoner becomes sick while in jail and it is possible to treat him there, then he must be treated without bringing him out. Doctors and servants should not be prevented from going in to see him, treat him and serve him. If lack of treatment leads to his death, criminal charges are to be laid against those who were the cause of that, and they are to be punished.
The Prophet (SallAllahu ‘alaihi wa Sallam) passed by a prisoner who was in chains, and he called out, “O Muhammad, O Muhammad!” He came to him and said, “What is the matter?” He said, “I am hungry, feed me. I am thirsty, give me water.” The Prophet (SallAllahu ‘alaihi wa Sallam) commanded that his needs should be met. (Narrated by Muslim).
And no doubt medical treatment is what the sick person needs. But if it is not possible to treat him inside the prison, he must be taken out to a place where it is possible to treat him, under the supervision of the jail or whoever is delegated to the task of watching and guarding him.
With regard to these rulings, the jurists do not differentiate between physical illness and psychological illness (true psychological illness, that is, as opposed to the made-up psychological illness or the regular psychological illness which many lawyers use as a means of getting criminals let off).
Hence the jurists (Rahimullahu ‘alaihim) stated that it is not permissible to lock the door on the prisoner—so long as there is the certainty that he will not run away—or to put him in a dark room, or to harm him in any way or to do anything that will make him terrified. His relatives should not be prevented from visiting him, because this will have an effect on his health and psychology.
3.It is prescribed for the authorities or their representative to set up a special medical wing in the prison to take care of the prisoners’ health needs. This will spare them the need to take them out to public hospitals and expose them to possible insult and humiliation.
4.Prisoners should be allowed to see their spouses and to have intimate relations with them, if there is a suitable place for that in the jail, as a protection for them and their spouses.
5.The jurists stated that it is obligatory to enable prisoners to do ablution and purify themselves, which is undoubtedly an important protective precaution against sickness.
Rulings pertaining to health care in the prison
The place that is used as a prison should be spacious, clean, well-ventilated, lit by natural sunlight, and furnished with the necessary facilities such as washrooms, etc. It is not permissible to gather such a large number of prisoners in one place that they will not be able to do ablution and pray.
Prohibitions in disciplining or dealing with prisoners
1.Mutilating. It is not permitted to punish a prisoner by cutting off any part of his body or breaking any of his bones. The Prophet (peace and blessings be upon him) forbade mutilation of prisoners of war and said, “Do not mutilate.” (Narrated by Muslim).
2.Hitting the face, et cetera. This is prohibited because of the humiliation involved. By the same token, it is not permitted to put chains on prisoners’ necks or to lay them on the ground to whip them, even if this is the hadd (Islamic punishment) prescribed for them, because this involves humiliation and harms their health and bodies.
3.Punishment by fire, strangulation or holding a prisoner’s head under water. The exception is in cases of qisaas (retaliation) and where the punishment needs to fit the crime. For example, if a person has committed aggression against another by burning him, it is permissible to exact retribution against him in the same manner.
4.Starving prisoners or exposing them to cold, or feeding them harmful things, or preventing them from wearing clothes. If a prisoner dies because of such things, his jailer may be executed in retribution qisaas or be required to pay diyah (blood money).
5.Removing prisoners’ clothing. This is prohibited because it uncovers their `awrah (private parts) and exposes them to physical and psychological illness.
6.Preventing them from relieving themselves, doing ablution and praying. It is obvious that this is harmful to the prisoners’ health. Examples of Muslims’ concern for prisoners The Hadith mentioned above shows how the Prophet (SallAllahu ‘alaihi wa Sallam) issued commands that prisoners should be cared for and their needs for food and drink met.
The Prophet (SallAllahu ‘alaihi wa Sallam) often used to hand prisoners over to his Companions and urge them to treat them well.
The Rightly-Guided Caliph `Ali ibn Abi Talib (RadiyAllah ‘anhu) used to inspect the prisons, meet the prisoners in them, and inquire about their circumstances.
`Umar ibn `Abdul-`Aziz, the fifth Rightly-Guided Caliph, used to write to his employees, telling them to see how the prisoners were and to take care of the sick among them.
Caliph Al-Mu`tadid (RadiyAllah ‘anhu) allocated 1500 dinars of the monthly budget to be spent on the needs and medical treatment of prisoners.
When the Abbasid Caliph Al-Muqtadir (RadiyAllah ‘anhu) imprisoned one of his ministers, Ibn Muqlah, and the minister got sick. So the caliph sent the famous doctor Thabit ibn Sinan ibn Thabit ibn Qurrah to treat him in jail, and he urged him to treat him well. The doctor used to feed him with his own hand and treated him very kindly.
At the time of the Caliph Al-Muqtadir (RadiyAllah ‘anhu), the minister `Ali ibn `Isa Al-Jarrah wrote to the head of the hospitals of Iraq at that time: “I have been thinking, may Allah (Subhanahu wa Ta’ala) grant you long life, about those who are in prison. With their large numbers and rough accommodation, they are not free from disease. They are prevented from doing things which will benefit them and meeting with doctors whom they can consult about the sicknesses they are exposed to.
So you have to appoint doctors for them who will go in and see them every day and take them medicine and drinks, and who will go around to all the jails and treat the sick in them and prescribe medicine for them.” This care lasted throughout the reign of al-Muqtadir, al-Qahir, al-Radi and al-Muttaqi.”

RIGHTS OF PRISONERS IN ISLAM
It goes without saying that Islam caters for the physical and the psychological fitness of prisoners. In Islam, prisoners, like all other members of society, have their rights. They should be treated with care and get the due educational and religious courses that help them improve psychologically and be good citizens after they get out of the prison. While in prison, they are not to be tortured or the like.
Focusing more on this issue, here is the fatwa issued by Sheikh Muhammad Saleh Al-Munajjid, a prominent Saudi Muslim scholar and lecturer: “Islam pays great attention to the matter of prisons and the circumstances of prisoners. It is rare to find anything similar to this in any place or time. The jurists discussed in their books the rulings pertaining to prisoners, their circumstances and how they should be treated. This concern stems from the Islamic concern for the protection of man and respect for his humanity.
To make the matter easier to understand and to make the rulings more clear, the scholars divided the subject-matter into two parts: the rulings pertaining to the personal health of prisoners, and the rulings pertaining to health care in the place that is used as a prison.
Rulings pertaining to the personal health of prisoners
1.The jurists discussed the matter of imprisoning a person who is sick in the first place. Do the authorities have the right to imprison a sick person? The answer is that this is a matter of ijtihad (legal reasoning), and the final decision rests with the judge who must weigh up the reason why this person is to be imprisoned, the seriousness of his disease, and the possibility of taking care of him in jail.
If sufficient health care is available for this sick person in prison, and he is not suffering a serious illness that could kill him if he is detained, it is permissible to imprison him. If such care is not available, the judge may hand him over to someone who can treat him and guard him, without releasing him completely, until it is possible to imprison him again.
2.If a prisoner becomes sick while in jail and it is possible to treat him there, then he must be treated without bringing him out. Doctors and servants should not be prevented from going in to see him, treat him and serve him. If lack of treatment leads to his death, criminal charges are to be laid against those who were the cause of that, and they are to be punished.
The Prophet (SallAllahu ‘alaihi wa Sallam) passed by a prisoner who was in chains, and he called out, “O Muhammad, O Muhammad!” He came to him and said, “What is the matter?” He said, “I am hungry, feed me. I am thirsty, give me water.” The Prophet (SallAllahu ‘alaihi wa Sallam) commanded that his needs should be met. (Narrated by Muslim).
And no doubt medical treatment is what the sick person needs. But if it is not possible to treat him inside the prison, he must be taken out to a place where it is possible to treat him, under the supervision of the jail or whoever is delegated to the task of watching and guarding him.
With regard to these rulings, the jurists do not differentiate between physical illness and psychological illness (true psychological illness, that is, as opposed to the made-up psychological illness or the regular psychological illness which many lawyers use as a means of getting criminals let off).
Hence the jurists (Rahimullahu ‘alaihim) stated that it is not permissible to lock the door on the prisoner—so long as there is the certainty that he will not run away—or to put him in a dark room, or to harm him in any way or to do anything that will make him terrified. His relatives should not be prevented from visiting him, because this will have an effect on his health and psychology.
3.It is prescribed for the authorities or their representative to set up a special medical wing in the prison to take care of the prisoners’ health needs. This will spare them the need to take them out to public hospitals and expose them to possible insult and humiliation.
4.Prisoners should be allowed to see their spouses and to have intimate relations with them, if there is a suitable place for that in the jail, as a protection for them and their spouses.
5.The jurists stated that it is obligatory to enable prisoners to do ablution and purify themselves, which is undoubtedly an important protective precaution against sickness.
Rulings pertaining to health care in the prison
The place that is used as a prison should be spacious, clean, well-ventilated, lit by natural sunlight, and furnished with the necessary facilities such as washrooms, etc. It is not permissible to gather such a large number of prisoners in one place that they will not be able to do ablution and pray.
Prohibitions in disciplining or dealing with prisoners
1.Mutilating. It is not permitted to punish a prisoner by cutting off any part of his body or breaking any of his bones. The Prophet (peace and blessings be upon him) forbade mutilation of prisoners of war and said, “Do not mutilate.” (Narrated by Muslim).
2.Hitting the face, et cetera. This is prohibited because of the humiliation involved. By the same token, it is not permitted to put chains on prisoners’ necks or to lay them on the ground to whip them, even if this is the hadd (Islamic punishment) prescribed for them, because this involves humiliation and harms their health and bodies.
3.Punishment by fire, strangulation or holding a prisoner’s head under water. The exception is in cases of qisaas (retaliation) and where the punishment needs to fit the crime. For example, if a person has committed aggression against another by burning him, it is permissible to exact retribution against him in the same manner.
4.Starving prisoners or exposing them to cold, or feeding them harmful things, or preventing them from wearing clothes. If a prisoner dies because of such things, his jailer may be executed in retribution qisaas or be required to pay diyah (blood money).
5.Removing prisoners’ clothing. This is prohibited because it uncovers their `awrah (private parts) and exposes them to physical and psychological illness.
6.Preventing them from relieving themselves, doing ablution and praying. It is obvious that this is harmful to the prisoners’ health. Examples of Muslims’ concern for prisoners The Hadith mentioned above shows how the Prophet (SallAllahu ‘alaihi wa Sallam) issued commands that prisoners should be cared for and their needs for food and drink met.
The Prophet (SallAllahu ‘alaihi wa Sallam) often used to hand prisoners over to his Companions and urge them to treat them well.
The Rightly-Guided Caliph `Ali ibn Abi Talib (RadiyAllah ‘anhu) used to inspect the prisons, meet the prisoners in them, and inquire about their circumstances.
`Umar ibn `Abdul-`Aziz, the fifth Rightly-Guided Caliph, used to write to his employees, telling them to see how the prisoners were and to take care of the sick among them.
Caliph Al-Mu`tadid (RadiyAllah ‘anhu) allocated 1500 dinars of the monthly budget to be spent on the needs and medical treatment of prisoners.
When the Abbasid Caliph Al-Muqtadir (RadiyAllah ‘anhu) imprisoned one of his ministers, Ibn Muqlah, and the minister got sick. So the caliph sent the famous doctor Thabit ibn Sinan ibn Thabit ibn Qurrah to treat him in jail, and he urged him to treat him well. The doctor used to feed him with his own hand and treated him very kindly.
At the time of the Caliph Al-Muqtadir (RadiyAllah ‘anhu), the minister `Ali ibn `Isa Al-Jarrah wrote to the head of the hospitals of Iraq at that time: “I have been thinking, may Allah (Subhanahu wa Ta’ala) grant you long life, about those who are in prison. With their large numbers and rough accommodation, they are not free from disease. They are prevented from doing things which will benefit them and meeting with doctors whom they can consult about the sicknesses they are exposed to.
So you have to appoint doctors for them who will go in and see them every day and take them medicine and drinks, and who will go around to all the jails and treat the sick in them and prescribe medicine for them.” This care lasted throughout the reign of al-Muqtadir, al-Qahir, al-Radi and al-Muttaqi.”
