Zack: I always like how it was explained to me, and how I explain it when I am on panels. Whether you are a creator or someone who is passionate about something, you are a curator of content that you believe in.
It’s almost like creating a museum of my personal passions. When you go to my blog it’s about my dog, really tasty food or comics and animation. It encompasses process… And what I mean by process is how to make an illustration or something move. The platform really goes into that well... as that backend look at how things are made.
To really boil it down, it’s my own museum of what I like.
Amanda: The way we frame it from the marketing side, is that Tumblr is a place to share your passion. And you can be passionate about a TV show, about food, about dogs… But this is where you go to meet the people who share your interests. And really dive into the community of people who love the thing as much as you do.

And to compare it to something like Pinterest… When I think of someone who is using Pinterest, it’s usually a mom looking for a recipe or someone looking for a workout, or someone looking for wedding stuff. Here on Tumblr, it is more like that fandom activity where people are looking for TV show gifs or the latest Honey post. You might find that on meme site, or FB, but Tumblr is where people get a little weird and shout out their deepest weird feelings about the thing that they love.
Zack: To add to that… I think it is about creating content to have a conversation. Which adds another layer and what I find fascinating (and we talk about this in our metrics panels) is that people are sharing feelings and posting entire conversations in tags or gifs. And driving this sense of unity... because “I feel that too”… I feel that same thing via this fandom or this thing happening in the world. Let’s connect and join together and have a community of friends strictly on the platform.
It’s almost like it’s own visual language with emoticons and the memes. You can really have a whole conversation.
Zack: I can pull conversations, and they are just all GIFs. We are just responding to each other based on reactions from our favorite types of media. It’s such a fascinating cultural thing that we have gotten ourselves into.

Apple just installed a feature where can pull GIFs directly into your responses and making that more accessible. Seeing that trend being baked into other products and how Tumblr contributed to that, is a cool accomplishment.
Amanda: If you are thinking about a GIF as language, there is a really good talk by Kenyatta Cheese on how they have come to define language. And how it evolved both with the internet and as a file format.
Zack: He dressed as an internet meme… that blew my mind.
Amanda: The culture has involved so much. I just got back from a cat convention. While I was there I presented a talk on the history of cats on the internet.
We started 1998 with the first use of emoticon cats in Japan, then we go through Long Cat, Nyan Cat, LOL Cat and Pusheen. And in the back row of this event, there were these women with gray hair and they all had they all had their flat Instagram cats.

At the end, I asked everyone who had participated in this sort of thing to send their URL and posted them on screen. Most people had 10-20k followers on Instagram, including these older women who you wouldn’t think of as someone who is very active on social media, but here they are… Coming to a convention to meet people their “cat crew”… with the flat cats. They are really owning their identity on social media. And this very heavy image focused community of cats. It was a weird time.
Zack: I am so jealous…
I understand because I am crazy dog owner. My fiance runs a Groot, my dog, Instagram blog. It’s as if it’s him talking and enjoying the world.
She has created a persona of him where he is writing the blog and his followers have been increasing by 10-15 each week. That is pretty good because it is just a back-burner project. One post a day kind of thing. It’s just funny to see how it is contributing to that dog community. Other dog blogs follow him… which is like surreal to me. People doing the same exact thing with their dogs. And I find that awesome.

What I find interesting about what you just said, Amanda, is that there is a history to the cats on the internet. It seems you are trying to give credit to people who created these images. There are so many floating around without regard for ownership... People taking things and appropriating ideas.
Zack: And that’s my department. I am a trust and safety agent and a community representative in terms of trust and safety. Part of the job is moderating anything that infringes on copyright, DCMA, and that inlcudes GIFs. Technically there has been no legal precedence over how a sense of ownership goes over a GIF.
Because they are almost transformative…
Zack:They are transformative enough to be your own content, so we are actually going to honor people’s ownership. We have certain policies and procedures that can prove that you created the GIF first. We all have that metadata, that is not user-facing. People often come back with “that is from a movie, how can they have ownership over a GIF.” One, there is no legal precedence and two, it is transformative enough by law to be considered fair use and their property.
It’s like sampling in music.
Zack: Yeah… It’s a very interesting case. For one, most people do not understand copyright law… like just the general public… Which is a challenge in itself. We can’t educate users because that will put us in a gray area if they misinterpret what we say. We can only point them in the right direction. So often we will be like “now is a good time to read about copyright law, here’s a link.” We give them more of an informed direction.
Need a Nap
There’s a lot of interesting things going on with people who are creating their own content on Tumblr in how we define that sense of ownership and who owns what. There was a famous court case where (and we love to tell this story at our panels at Comic-Con) a guy was traveling overseas and a monkey took his camera. The monkey took a bunch of pictures with his camera. Eventually, he got his camera back and posted the photos online. A bunch of outlets took the photo and posted it. He felt it was copyright infringement, but a judge ruled that because he didn’t take the pictures, it wasn’t. The monkey took the pictures and the monkey owned the copyright. And that’s it. You have to be the one to create the visual aspect. And that’s an interesting aspect to how we distribute content. Especially when it comes to photos.
And then there are certain parameters when it comes to the more dark web stuff… like privacy infringement. California specifically has changed privacy laws in response to the internet. We are generally heavy-handed when addressing privacy because we don’t want to be in the position of potentially breaking any laws. And that isn’t just photos. It’s phone numbers and other information that would not be public.
I could chew your ear off on policy all day…
How does a privacy policy work with memes?
Amanda: It’s so hard. I have been doing meme work now since 2011. We have shifted from “Oh, these are random images floating around the internet”, like Nyan Cat and Long cat. All of the old cat memes… No one knows the names of those cats or who owns those cats. It’s very hard to track down the information because someone just put it online on Funny Junk or some other site. People think that it can’t be traced back to me, because no one should know who I am on the internet.
Then as Facebook rolled out and the internet became more prevalent in our daily lives, things shifted. That’s when people became like “Oh, I have ownership of my internet content.” And that shift into “I own this and this is my copyright, and you can’t steal it.” has started happening. And we saw that as YouTube rose and the appearances of “Grumpy Cat”. That’s when the owners were like “This is my cat, this is my content I am making about my cat.” They got this micro-fame where they were able to turn it into money. You saw this with YouTubers like Tyler Oakley, who was able to build a brand on his internet content.
This was about the time when Fuck Jerry started to become popular. Fuck Jerry started on Tumblr as a meme repost site and Instagram account that steals everything from everywhere, and isn’t concerned with copyright. "It’s out there and now it’s mine". He has built a whole empire and made tons of money. His empire is built on stealing.
Haters Gonna Hate
There was also copyright issues around the dress. The dress that broke the internet. The girl who posted the photo did not take the picture and did not own the photo.
Zack: I remember that day because I was called down and asked: “Do you see this?” And I thought I was going crazy. I saw “blue/black”.
Amanda: I saw both… my eyes kept flipping back and forth… I really thought I was dying.
And the trend now is private facebook groups where people are making and sharing content. Then if it gets out and becomes a really big thing, do you want to admit that you made this thing in a secret FB group? The copyright thing gets blurry. Some people want to say “I own this thing and I am going to shout to the ends of the earth” and some are like “hmmm… I guess I made that. I am just going to step away from it and let the internet have it.”
Zack: There really are those two polar opposites. Working directly with it, there are people who understand the copyright laws and procedures. You swear an oath when you file a DMCA claim so we (Tumblr) are not liable. It’s a dispute between the two parties. But doing that scares a lot of people and that’s legitimate. There are people who say “I made this content” but I am not comfortable swearing an oath. Or I don’t have any proof of where it came from. There’s nothing we can do and it’s at the offending parties digression to remove the content.
Brain Freeze
The trend that I’ve been seeing, and you will see this in a lot of GIFs, people have their specific kind of signature. You’ll have these translucent tags to their blog or a copyright watermark symbol.
That trend has become more and more apparent because creators want that sense of ownership. It’s really a part of meme and GIF culture. We ask “How did you create this or make it look that way?” so we can confirm it is transformative. And then they can add a signature to it.
When we speak with artists, such as comic artists at our Comic-Con panels, we tell them “That’s the biggest thing you should do.” To prevent people from reposting or taking credit for your content, just add your name so it can’t be easily removed from the images or cropped out. It’s evolved to the point where people feel they need to protect what they create. Which is fair.
Protecting your ideas is important but there’s great benefit to people getting their stuff out there as well.
Zack: Certainly. Exposure is nice. If you are a creator and you want your content to be seen, you should put up as much as you can. If it ever comes to protecting your work, you do have that right.
I hear people say, “I don’t use Tumblr because my content is always reposted.” My response is that there is a team working around the clock to protect your content. You don’t have to file any type of government papers, as long as you are 100% sure that it’s your content, it’s safe. If that is someone’s reservation, what’s stopping you?
Every company legally has to have a team to protect from infringement and misattribution. Regardless.

Apparently, At-At, and Bad: Here is a rollercoaster ride for you to read. Last week I went out of town on a driving adventure, I was gone for 6ish days and saw a bunch of national parks. My farthest east point was Niagara Falls. My basic path was almost straight their and then around the Great Lakes on the way back. One of the better experiences I have had recently. I came back to a decent week at work and a bunch of Chaos. Woke up Wednesday to find I could hear a beeping like the trash truck but from the wrong side of the house. Wondering what that could of been going on at at 7am and I went to investigate only to find that my new Jeep was halfway up on a tow-truck. I had parked on the road that day because I was drying out my tent in my garage. Of course I wanted to know what was going on. Turns out that the owner who sold it to the dealer I had purchased it from, had a lean out on it and never paid it off or told the dealer. (don't ask me how that chain of events worked, I am still not sure) Apparently the bill just went to collections and no one told anyone that the car was mine now. I was able to talk the tow-truck driver out of taking my car by producing my new title, and saying I would call the cops. Breathing deep I let it go, and tried to have a good day. As I was talking to a friend of mine Thursday, I found out that their cats went missing. Getting me to worry a about that person and their cat. They have been a pretty good friend to me lately (despite that I suck at texting or messaging on a regular) and I know they have been goin thru some stress unrelated to this. Of course this sticks to the back of my brain, in a "how can I help" kind of way, but also in a "I hope that my friend is doing okay." I have grown to care a great deal about this person over the last few years and I hate to see my friends in distress, as we all do. [If you read this my friend, I am still thinking about it. Let me know if I can help.] Continuing the ups and downs. I was at the movies yesterday evening (don't worries, no spoilers) and had my large bowl of popcorn and a soda. About half way threw the movie I noticed that the large, young, boy sitting to my right had reached into my popcorn container and took a big handful and put it on the nacho plate he was using. A bit upset by a stranger taking my popcorn, I ignored it at first and moved the popcorn to the other side. Few mins later I was so engrossed in the movie I had reach into the bucked to find that my popcorn is now wet (and not with nacho cheese, like you might expect... and it wasn't butter, I don't use butter on my popcorn), so l put it on the floor under my chair... So ten mins later he reaches under me and grabs the popcorn; I give him a "WTF" look and say "excuse me, this is my popcorn;" He didn't say anything back. Instead of starting some shit I walked out of the screening leaving he bucket with him. Talked to a employee about the problem. When the employee went back into the screening room the large man was no-longer in his place and I didn't see him. Figuring the problem solved I happily went back to the movie. Little did I know, I upset a *insert your bad word of choice* As the movie ended and I wasn't paying attending to who was around me, the credits pulled up and the man; who was a few rOws up apparently; came by and dumped a near full soda over my head and ran. So I breath deep, do what I can in the bathroom and leave. So I arrive home around midnight and found that one of my roommates had let Mordecai out of the house (he is a indoor cat). Immediately causing me to flip out. I start calling his name for about 10 mins outside, and thank whatever power was listening, he just walked over to me from wherever he was laying, watching me look for him, and did his "give me food, human" meow.. So I breath deep and feed the monster black cat. Took a shower and went to bed More ups and downs.. My chronic insomnia kept me up, or perhaps a adrenaline. I guess that was a bit of good luck. Another friend of mine really need a chat about the things stressing them out and I was able to help. Or at least listen. [Assuming they read this sorry your work environment sucks.] I slept in late and woke up from a nightmare about the events of the last couple of years (not uncommon). When I went downstairs to shake it off, I found all my fish except one is dead. I checked PH, nitrites, hardness and carbonate yesterday and they were fine... Not so good any more on account of the dead fish.. I went in my living room and found that Mordecai had killed two of my plants by pulling them down and dragging them all about the first floor. I guess the call of the wild is strong. Breath deep and move along today. Heading to another doctors appointment today (I hope they can get this figured out). Then I work tonight and all weekend (as usual in the summer). I am really looking forward to GoT, I know the cinematic battle that we expect might be long, but I am looking forward to the dragon/white- walker/royal house fun.. That gives you power.
THE BASICS
Disclaimer 1: I am not getting into the issue of fanworks and the interplay of original works/derivative works. This post is just sticking with the basics: you, an artist, created an artistic work through your own effort, which you own the copyright for, and someone has reposted it in its entirety without your permission to their own website or social media account.
Disclaimer 2: For simplicity’s sake, this post is just talking about copyright. Issues like moral rights and Creative Commons won’t come into this, those are whole subjects in themselves, and this post is long enough as it is.

Being employed to make art is NOT the same as being commissioned as a freelancer to make art: if you are commissioned as a freelancer to make art, at default what you create will be copyright to you, and your client gets a permission to use that art for the purpose they commissioned it. If the client wants to own the copyright, they’ll need a written document signed by you that transfers copyright from you to them. And yes, professional artists do charge more for that transfer.
Is my copyright recognised in other countries? Yes, provided your country and the other country are members of the Berne Convention for the Protection of Literary and Artistic Works. Under this treaty, all signatory countries agree to recognise copyrights from other signatory countries. Since the Berne Convention currently has 172 signatory countries, in the vast majority of cases when someone else uses your work online, they’re doing so from a country where your copyright is recognised and can be enforced in that country’s legal system.
What does it mean to have a copyright? As a copyright owner, you have exclusive rights to deal with your work. The precise rights may vary depending on the type of work and what jurisdiction you’re in, but fundamentally in the context of reposting they are:
the right to make reproductions of your art (ie., make copies); and
the right to communicate your art (eg., transmit it to or through a website).
These rights are exclusive to you meaning you are the only person who can copy and transmit your art. Anyone who wants to make copies of your art or upload it to a website will need your permission to do so (and you’d be within your rights to charge money for that permission if you wanted), otherwise they risk infringing your copyright. Which brings us to the next part.
PERMISSION VS. INFRINGEMENT
What’s a licence? A licence is a permission from you to another party that lets that other party use your art. For example, if you upload your art to Tumblr/Twitter/Facebook, you have granted Tumblr/Twitter/Facebook a licence to reproduce, display, and host your art within the Tumblr/Twitter/Facebook system. (Want to know the exact wording of that licence? It’s set out in the terms and conditions you agreed to when creating your Tumblr/Twitter/Facebook account).
That permission does not extend to every person, mutant, and unicorn to use your art. If you upload art to Tumblr/Twitter/FB to display, you’ve given a permission to that website, and no one else. Now, Tumblr/Twitter/FB allows other Tumblr/Twitter/FB users to share/reblog/retweet things from your page to their page, and that’s fine, they can do that because it’s a function of the website’s system which you’ve agreed to operate in. That is completely different to a person downloading your art from your page and reuploading it to their own account either on the same website or a completely different website for hits and likes, ie., reposting, ie., likely copyright infringement.
What is copyright infringement? Copyright infringement is when someone uses (eg., copies) all or a substantial part of your art without your permission, and when no copyright exception applies.
Internet defence myth: “The artist put their art on the internet, that’s permission for anyone to use it!” – NO. The artist put their art on a particular place on the internet (ie., their own website, own Tumblr, own Pixv) on their terms. That is not permission for anyone on the internet to download and use their art. If you find some art online that you really like and want to use, contact the artist and ask them.
Internet defence myth: “I changed 10% therefore it’s okay!” – NO. “Substantial part” does not work like that, it’s not about how much you’ve copied, it’s about what. If what you’ve copied is the key, distinct, or essential part of the work, that will be a substantial part even if it’s only 1% of the whole picture. Think of “The Scream” by Edvard Munch: the screaming face is, proportionally, a very small part of the larger picture, but it is the most recognisable and distinctive part. Now, what is and is not a substantial part gets very subjective, but in the context of reposting where a user reposts a whole picture, or crops the edges to remove a watermark/copyright notice/artist credit but keep the pretty art that caught their eye in the first place? That is clearly a substantial part amounting to copyright infringement (and in some jurisdictions, an infringement of laws regarding artist attribution and/or metadata).
What’s a copyright exception? An exception to copyright is a situation where the use of your art meets certain criteria that the law says using art without permission is allowed.
Internet defence myth: “It’s fair use!” – Are you in the United States/South Korea/Israel/other fair use country? If so, then sure, let’s talk fair use. If you’re not in a country with fair use, then you do not get to claim fair use. No fair use for you, do not pass go, do not collect $200.
The majority of jurisdictions in the world do not have fair use. I’m not going to go into every country’s variation, but many (e.g., the U.K., Canada, Australia) will have fair dealing which is a very different creature to fair use. Basically with fair dealing, in order to not be an infringement of copyright, the use of an artwork without the copyright owner’s permission must be for a specific purpose, such as parody or satire, or criticism or review, as well as be fair. If the use of an artwork is not for that specific purpose, it is an infringement of copyright. Reposting art for hits and likes or aesthetics without any serious attempt at comment? Definitely not going to get the fair dealing exception.
For those in the U.S.A.: yes, you get fair use, but it’s a defence against copyright infringement, not a get out of jail free card. The number of times I see people slapping “this is fair use!” on things that are clearly not going to pass the test is ridiculous, and there’s a line of thinking around the internet that just invoking the words “fair use” summons a magic shield to ward off any legal action. It doesn’t do that. Yes, you can claim that what you’ve done with copyright material is fair use, but a copyright owner is free to disagree with your claim and, if they think they have a case, take legal action against you at which point the fair use argument will be tested in court (as the Star Trek Axanar guys found out the hard way – spoiler, judge said no fair use). Now, the fair use debate is huge and ongoing, and this is not the place for it, I’m just focusing on reposting. And in the vast majority of cases where art is reposted in its entirety for hits and likes with zero attempt at critique or parody, it’s likely that fair use won’t apply.
Internet defence myth: “Reposting is okay because it gives the artist publicity/exposure!” – NO. “Giving publicity/exposure” is not an exception for copyright infringement, and helpful as publicity/exposure is, it doesn’t pay the bills. Creating art is work, and just as I get paid to do my work, so should professional artists get paid for their work. There are plenty of think pieces and articles and comics on how harmful it is for the creative sector to be expected to produce high quality work “for exposure”. And when reposting is done without attribution or credit or a link back to the original artist/source, then the exposure “argument” is utterly worthless (and may also be an infringement of moral rights where applicable).
Internet defence myth: “I credited the artist therefore it’s okay!” - NO. Some artists may be all right if you repost with credit. Other artists are not okay with it. Check the artist’s website/statement/permissions, don’t just assume that they’re going to be okay with credit. As far as law goes, the fact that you credited the artists means nothing: you reposted the art without permission where no copyright exception applies, therefore you infringed copyright and the artist copyright owner can act on that.
Internet defence myth: “I’m not making any money I didn’t mean any harm therefore it’s ok!” - NO. As far as liability for infringement goes, none of that matters: you reposted art without permission where no exception applies, you infringed copyright. The fact that no money was made may be taken into account in terms of damages or remedies, but at the end of the day, copyright was infringed, and the artist can hold you liable for it.
WHAT CAN I DO WHEN SOMEONE REPOSTS MY ART?
You can take legal action, which yes, comes with costs, time, effort, and stress. That being said, as a copyright owner, you do have that legal right, and if your art is being infringed in a way that’s earning money for the infringer, court action would be worth considering. Get legal advice first.
In the majority of cases where you don’t want to get a lawyer but do want a repost of your art taken down, you have two options: contact the reposter and get them to take it down, or contact the website hosting the reposted art and get the website to take it down.
Contacting the reposter: A lot of artists seem to take the gentle, friendly, almost apologetic “could you please?” approach to this. That’s up to you, but I will suggest that although you should certainly be polite and courteous, you shouldn’t be afraid to be firm. (Do NOT be aggressive/insulting/rant in all-caps). You’re the copyright owner, you’re the one with the exclusive rights, you’re the one who can hold the reposter legally liable for the infringement. Send a calm, professionally-toned message/email stating that:
you are the artist,
you own copyright in the named images (provide link to images on your official website/blog);
that you did not give permission for the person to reproduce the image and reupload it (list specific HTML links to where the infringing images are located);
that you request that the images be immediately deleted, and/or a new repost be made with credit, and/or an apology;
that if no action is taken or you don’t receive a response, you reserve your rights to further legal action.
Most decent people would, in response to such a letter especially from an artist they admire, respond and apologise and do as requested, hopefully having learned a good lesson. But let’s say you’re dealing with someone who doesn’t care, who sends back a ranty message with <insert>Internet Defence Myth</insert> and that you should be grateful that they like your work. What do you do then?
Contact the hosting website:Almost every social networking and filehosting site, certainly all the big-name ones like Facebook/YouTube/Tumblr/Twitter/Instagram/etc., have notice and takedownmprocedures built into their systems. These are methods by which copyright owners can send a notice to the website telling them that someone on their site is infringing their copyright, and the website will remove that infringing material.
The exact procedures used by Facebook/Tumblr/Twitter/etc., and places like RedBubble/Society6/Etsy/etc., vary. Some make you click through and fill in a whole bunch of form fields, some ask you to send an email to a specific address. Whatever procedure, the majority of these websites are based in the U.S., meaning that the procedure meets the requirements of the U.S. Digital Millennium Copyright Act (DMCA). Essentially, the DMCA grants websites immunity under U.S. law from infringement actions provided that they have and act on certain procedures regarding infringements on their website. The notice and takedown procedure is part of this procedure.
Even if you yourself and/or the reposter are not in the U.S., if you want the website to take down the repost you will have to go through the DMCA form. Importantly, when you go through the process there will not be someone at the website’s offices making a legal judgment on whether or not a repost infringes copyright; all that matters is that you, the copyright owner, have sent in a correctly filled form/letter stating that the website is hosting material that infringes your copyright.
Second important point: whether you file a notice through a website’s reporting form or send in an email, that notice/email will very likely be shared with the reposter. As the DMCA process requires that you include your full name and contact details, this means your personal details will likely be given to the reposter. If you’re comfortable with doing this you should do so, however some artists understandably don’t want that personal information sent to a disrespectful reposter. While I certainly don’t advise making up completely false ID information to file legal notices (amongst other things, it’ll give the infringing reposter reason to file a counter-notice, see below), it may be worth using instead of your full legal name, the online handle your art is known by, your secondary email, a P.O. Box address, or try generalising your address to a city, state/province and country. If this approach is rejected by the form, you’ll just have to fill in your contact details properly. If you’re a professional artist with an agent or lawyer or other authorised representative, that’s easier: you can name your representative as a contact instead.

Note that it requires a Twitter account, and you have to be logged into Twitter to file a notice, so the notice will be linked to your account. Note also that Twitter says that they will send a copy of all DMCA notices to Lumen for transparency (with your contact information redacted).
Tell us about yourself: Click I am the copyright owner. This opens more form fields below.
Contact information: fill this all in.
About platform of infringing material: Click Twitter/Vine/Periscope as appropriate.
About your copyrighted work: Give the title of your original work and a link to your official website/blog where the original image can be viewed.
About the infringing material: Click Tweet/Moment/Profile image as appropriate. This will open another form field for you to give the direct link to the infringing Tweet/Moment/Profile. There is also a form field for you to describe how your image is being infringed (you can say “[username]’s Tweet has reproduced my copyright image without my permission” or something to that effect).
Required statements: Click both boxes, type in the exact statement as required by the form, and type your name (try your online handle?) otherwise Twitter won’t let you submit.
Hit Submit.
Instagram: Copyright Report Form. Form-fill notice, that is almost exactly the same as Facebook’s notice form. Does not require an Instagram account to file.
Click Continue with your copyright report then I found content that may violate my copyright then Please click here to continue with your copyright report.
Contact information. Fill in all the fields, and include direct links to the infringing material on Instagram, as well as a link to the image as it appears on your official website/blog.
Click Yes at the bottom then enter your name before hitting Send.
Tumblr: DCMA Copyright Notifications. Form-fill, but less detailed than the ones previous. Note that Tumblr explicitly says that the form is for external content that has been reposted on Tumblr without your permission (eg., it was taken from your website/Facebook/other non-Tumblr site and someone posted it to Tumblr). (They have a separate form for stuff you posted to your Tumblr account and another Tumblr user has reposted without attributing you.)
URL of infringing work or material: give the exact HTML link to the infringing image file on Tumblr.
Source URL for work (optional): I’m actually not sure what this is referring to (Tumblr, you and your inexact drafting, why) but it’s an optional field, so it’s not necessary to fill it in.
Add more exact URLs to other infringing works if necessary.
Description of work claimed to be infringed: Give the title of your copyrighted work, maybe the year you created it, and a link to where it may be viewed on your official website/blog.
Contact information: as usual.
Click all three of the click-boxes, and your full name (I’m not sure if typing your online handle as a pseudonym will suffice?) and hit Submit Notification.
As you can see, while the exact boxes and click throughs may vary, each website is asking for the same DMCA requirements: contact details, link to infringing material, link to your original material, legal declarations, and electronic signature. Etsy also has a form system, but other websites (eg., RedBubble, Society6, eBay) require you to send an email to their designated email address. This email has to fit the requirements of the DMCA, and a simple Google search for “DMCA sample notice” will turn up plenty of examples with wording you can use.
NB: The DMCA notice is a notice under U.S. law, and thus should only be used with websites subject to U.S. jurisdiction. If you send a notice saying “this is official notification under section 512(c) of the DMCA to remove infringing material” to, say, WeChat, or the website of the local community of artists in Canada or Singapore or France, you’llaccomplish nothing except maybe giving a lawyer a good laugh.
What happens when you file a notice: The website should take down the infringing image file you have notified them about. How quick this is depends on how well the website is managed, although the big social media sites are fairly prompt and will typically take down infringing material in 24-48 hours.
Counter-notices: When infringing material is removed, the reposter who put it up would be sent a notice saying that it has been removed, and why. Under a typical website’s DMCA notice and takedown procedure, the reposter may, at that point, send in a counter-notice saying that the original takedown notice is incorrect (eg., that the person claiming to be the if they truly believe they were not infringing copyright (ie., that they had permission from you to upload the image, or their upload comes under a copyright exception). If that happens, the website will forward the counter-notice to you and give you a 10-14 days to come back to them with a legal document saying that you have commenced legal action for copyright infringement against the reposter, or a court order that prohibits the website from reinstating the material. If you don’t get back to the website with such a document, the website will put the material back online.
In theory, this means that even though you have successfully filed a notice to have an infringing repost taken down, the reposter can, if determined or malicious enough, get it put back up. I have no idea how often counter-notices are used, although I’ve seen some commentary that counter-notices aren’t as common as often as people think, particularly when it’s clear that the infringer is infringing copyright. If you do get a counter-notice, your only option to get the infringing material taken down again and stay down is to deal with the reposter and potentially commence legal action. Sometimes this may be worth it, particularly if you have a good case for infringement and the reposter has maliciously sent the counter-notice when they have clearly infringed copyright, because the reposter may have then exposed themselves to extra penalties in a lawsuit. Sometimes it might not be worth it. This, however, is for you yourself to decide, and maybe get private legal advice about.
FINAL NOTE
Reposting is incredibly frustrating for artists, especially when artists don’t even ask people to pay them for the privilege (even though artists have every right to if they so wished), they just want a credit or link back. Do the right thing: if you want to repost, ask permission from the artist, make sure you include full credits to them and links to where people who like the art can contact the artist. It costs hardly any effort to do that, the artist will be grateful and likely create more art for you to enjoy – and you won’t be exposing yourself to any potential legal action.
Artists, it’s your art, you own the copyright in it. Don’t hesitate to use that power where necessary.

Throughout our journey with Voyage, the one thing we have learned over and over is that hidden within every challenge is a blessing or opportunity. It’s up to us to determine whether a challenge we face will be a step back or the catalyst for a step forward.
We had the honor of connecting with some of the city’s brightest leaders and role models and we asked them our question of the month: What is the best advice you have for someone who feels like they are facing insurmountable odds.

The best advice I could give for someone who is facing insurmountable odds is to stay calm, and stay focused. It sounds easier said than done, but even the smallest steps count. One thing that I’ve done to remain grounded at a time like that is keep a small notebook with me to help organize my thoughts. Even just writing out a checklist helps significantly. Take things day by day, one step at a time, and before you know it, the odds will be in your favor.

To answer this question, I say nothing is too impossible to conquer nor is it too great to overcome. You can achieve anything you put your mind to because you’re in control. Those odds you are facing can make you doubt yourself, make you feel like you won’t amount to anything, and make you lose all motivation for what you want to do. But, you should face these odds head on and set out to do what you want, find your purpose, and find your passion. You’ll feel like you can conquer anything once you do this. Motivate yourself, surround yourself with positive energy, and those that support you in all that you do. I figured this out by the obstacles I went through this past year. I have dealt with failure, adversity, heartbreak, the closest people around me bringing me down, and even losing friends. I know you may have gone through the same things because it’s life. We all face at least one or all of these obstacles. I gave these examples to express the fact that those insurmountable odds were hindering me from moving forward. You may feel the same. In the midst of my hardships I found myself and my passion: music. I became a DJ and I am now venturing into music production. I have networked with amazing people, gotten noticed for my craft, and my business is booming! I can’t seem to catch a break during the weekends and I love every bit of it. Also, I recently graduated with my Bachelor’s Degree in Logistics and Supply Chain Management from UNT Dallas at the age of 20. I beat the odds. Anything is possible.

From my own experience, I would say that God does not give us battles that we cannot combat , so we must rely on the adversities of life and see each disappointment as an experience and learn from it. Always think positive to bring light and love where you need it most. Your mindset shapes your life, and if you choose to see obstacles you will see only obstacles, but if you focus on a solution a clear path will present itself.
And remember that in the end everything will be fine and if it is not, it is because the end has not come yet.

The best advice I would give to someone who feels like they are facing insurmountable odds would be to never forget your value and how much you have to contribute. Don’t compare yourself. Most of my battles with growing as a photographer have come from comparing myself to other creators and creatives. Rely not just on yourself, but on those closest to you that you trust. Insurmountable odds seem less daunting when you have a team of friends cheering you on that believe in you. Another piece of advice I would give is to be aware of your mindset. Instead of thinking, “I don’t know if I can do this”, think “I can do this. It’s going to be rough and I might fail once or twice, but I’m going to put in the work necessary to do this”. My favorite quote of all time is “You did not wake up today to be mediocre”. I’m also a believer that your dreams are only as crazy as the work you’re willing to put in to achieve them. All of this to say, when you feel like odds are stacked against you, take a look at your mindset and the people you trust the most. It just might change your perspective.

Go all out, if you tell yourself you can’t do it then how will you ever persevere and get stronger. There will always be obstacles and negatives, surround yourself with people who believe in you and will be there through all odds, through all situations. When I had to withdraw from college I was nearly homeless and stuck in Pennsylvania, 1,500 miles away from home, a friend let me stay at his home while I tried to get everything back on track. The right group of people can turn any negative odds positive, no matter how slightly they may turn.

So even against all odds you will achieve what you think is the impossible. You must take any negative energy and turn it into positivity to believe in yourself. I have faced insurmountable odds more than I’d like to admit. There is a lot of pressure that comes with being a photographer in an oversaturated environment. Over time, I have learned to work well under pressure, but that wasn’t always the case. A quote I like to think about from time to time is “who you are is defined by what you’re willing to struggle for.” If you choose your battles wisely and learn from your mistakes consciously, you may find that the odds you face become less and less insurmountable. When you’re stressed out, under pressure, or feeling like you’re not good enough, take a moment to look yourself in the mirror and say, “you got this.” When I tell myself this I tend to forget about the problems I’m facing and go into the situation more confident and energized than before.

As for the advice, I would say to break down those odds into smaller so they are more manageable to handle and focus on one at a time as to not overwhelm yourself.

Alright, so the best advice I can give. I have a few things to share; First things first I have to state its all a mind game at the end of the day. Knowing that information, you have to attack it internally. Even though all the destruction is happening externally in your physical reality.
Tip #1: Don’t take it personal. I know when you’re going through something you can feel all alone and personally attacked, but thats not the case at all. As people we are really good at masking our pain. It might look like someone has it all together and all the answers but that could be a facade. Pretty much we are all in the same boat at the end of the day. We all have something we’re trying to overcome. You’re not alone in the struggle.
Tip #2: Don’t take it to heart and let it encrypt your spirit. You never want your heart to grow weary and heavy. You need to keep your heart pure at all times. Once something has taken ahold there it’s pretty much solidified. I don’t consider myself religious, just more spiritual but a good proverb to keep close- “Guard your heart with all diligence, then from it flow springs of life.” You don’t want to accept the odds – as fact in your heart because you could possibly open the door to more crisis within your realm.
Tip# 3: Take a look back and see all that you’ve overcome in your past and let that give you the confidence to pull through. This too shall past type of vibe. Life is all about overcoming. We’ve been overcoming odds since we were children. Try to think back to a situation that you were able to grow from and remember the steps you took to make it out. Thats what I do. When the climb to the top is getting too grimy for me I look back at all the things I’ve managed to pull through and I tell myself if I can make it to where I am now I can get to where I’m trying to go.
Tip #4: Have a “Light At The End Of The Tunnel” mentality. Pretty much you’re in this dark tunnel, you wanna always have your mind set to I’m going to make it to the light. I know there is light at the end of this tunnel type of thinking. You have to KNOW that you’re going to make it to the light regardless what is going on. No matter what darkness is surrounding you. You have to DESIRE the light. If you don’t have that deep seated belief you’re going to be stuck in the tunnel. Its your decision. Be stuck in that darkness or get to the light no matter what.
Tip #5: Go out and have fun! Take your mind off all the heavy stuff. Go out with your friends or if you have no one go out alone. Try to enjoy the moment while you’re out. Forget all that you gotta deal with for a few hours and just enjoy being. Try to put into perspective the grand scheme of things which is we don’t have control of a lot of the things we go through and understand life didn’t come with a blueprint – knowing that, try to let go and just be for a while until the solution comes. Remember within your being that the answer WILL come.

No matter how many people say no, no matter what the odds are, if you have something you’re passionate about and you believe in it, never ever give up. I would advise that person that you have to take it day by day because you only live once and life’s too short to not enjoy it.
