美国人告诉你为什么状告CNN是很蠢的事
作者:思项羽 说道美国的法律诉讼,很多中国人似乎有一种天然倾向,想在美国这是一件非常容易的事情,似乎是花几十美元就可以轻易搞定的。 前几天看到一个在美国堪萨斯州居住的中国学生,在网上公开呼吁5000个中国人,每个人花50美元,到地方法院告CNN。按照这个天真的中国年轻人的想法,如果每个人花50美元的话,那么5000个官司,即便中国人赢的机会很小,但如此庞大,犹如汪洋大海一般的诉讼的“人民战争”,可能仅仅律师费一项,就足够让CNN吃不了兜着走。不死,也得脱一层皮.   但实际上,这样的想法暴露出对美国司法体系和运作方式的浅薄无知,是何等的惊人. 美国的司法审判类别:分为“刑事诉讼”(Criminal)和“民事诉讼” (Civil)两大类。前者的起诉人,一定是由国家的公诉人,也就是检察官担任。而后者则相反,起诉者不是个人,便是私人团体,国家权力机构不能涉入。虽然美国的这两类司法审判,程序非常雷同,都有所谓的预审,听证,证人传唤,交叉质询等内容,甚至都还可能动用陪审团参与。但是这两类审判的结果,却完全是相反的。在刑事审判中,被定罪的一方可以完全不支付任何金钱赔偿,但是却一定要接受某种程度的身体刑罚,包括,社区服务,在家监禁,或坐牢。。等等。但是民事诉讼的败诉一方,则完全没有任何类似的“肉体刑罚”而完全是以“金钱赔偿”做代价.简单的说法就是“破财消灾”. 正因为“民事诉讼”是以“个人告个人”为手段,以“金钱赔偿”为最终结果。因此民事诉讼几乎包罗万象,涵盖广泛。从修车,租房,车祸,到智慧产权,商标专利,精神伤害….几乎所有的事情都可以成为诉讼的内容.赔偿的金额,也从几百美刀到上亿美元不等.但是,虽然这样的诉讼在美国的各级大小法庭中,几乎每时每刻都在上演,可这并不表示,这些诉讼,可以像吃饭做爱那样“随心所欲”的.我们必须明白的一点是:西方的法治有上千年的历史,而中国的法治,则几乎刚刚起步.   譬如,到目前为止,在我所看到的所有那些由中国人所提起的,针对CNN的民事诉讼,或建议,就没有一个不是笑话的.   首先,以那个堪萨斯的中国学生的为例:这个起诉方,无疑觉得��己非常高明,因此他在自己的呼吁信中自吹是一个“高智商”的人。他从“纸上谈兵”的理论角度,推演出如果美国的地方法院,真的可以受理5000个中国人零星而又密集的小型民事诉讼的话,那么CNN就非常有可能破财,或破产。 我相信这个堪萨斯的中国小学生,大概完全不知道美国的民事诉讼,又分为“大额”和“小额”两类。所谓的“小额诉讼” (SmallClaim),指的是索赔金额在5000美刀之下的诉讼。美国各地都设有专门的“小额诉讼法庭”(SmallClaimCourt),来审理这一类型的案件.说穿了,就是为了方便美国民众打官司而设立的。它的好处是手续简便,(到法院填一个半开大小的诉讼申请即可),审理快捷(只有法官,没有律师,没有陪审团,30天内开庭),费用低廉。(30美元法庭申请费,20美元诉讼状投递费)但也正因为“小额法庭”有这些“短,平,快”的特点,因此它对所审理的案件,也有特别严格的限制-并不是所有索赔低于5000美元之下的民事诉讼案,都会被小额法院受理。 当这个中国学生说他只要花50美刀就可以起诉CNN的时候,内行人马上就可以知道:他是奔“小额法庭”去了(只有小额法庭,才有如此低廉的诉讼成本)但便宜固然是便宜矣,可人家小额法庭规定得很明白:审理过程不准许有律师陪伴出庭。这是第一个限制,无论原告还是被告,都必须同样遵守. 换句话说,即便有机会告人家CNN,但他的第一个如意算盘–以“高额的律师费”来拖垮CNN的设想,却马上要被证明是一个“意淫之谈”.   但第二个限制才是更致命的:小额法庭受理的一律是具体的“经济纠纷”案件。原告与被告之间,必须存在一个的实际的“争执金额”提交给法庭来判决。譬如,一个顾客花了$1000美元修车,结果修车厂却没有将车子修好;一个房客退租之后,房东借故将他的600美元押金没收;一个店主,卖给顾客 2000的货物,但是顾客认为东西只值1000元;或一个老板,答应付给一个员工1500薪水,但结果却跳了票。。。。等等这些具体的金钱纠纷,就可以经由小额法庭的判决,得到解决。   因着“小额法庭”的这种特性,它不可能,也无法受理类似控告CNN这样没有具体经济纠纷的“民事诉讼”。在美国的民事诉讼体系中,所有与“毁谤,中伤”有关的“精神伤害”诉讼(PersonalInjury),都不是由小额法庭审理的,而必须经��一般的法律诉讼途径–也就是说,一个要远比小额法庭复杂昂贵得的多的,高级法院的诉讼程序来进行.事实上,这类“诽谤或中伤”(DeformationOrSlander)的审理案件,律师在接受你的案件之前,通常都会收取委托人至少5000美元的“首期费用”(Retainer).在美国这样的一个专门的律师,即便是初出茅庐的,每小时的收费标准也在 250-270美元之间.   现在,我们可以非常容易地想象到一个这样的情景:这个住在堪萨斯的中国同学,兴冲冲地跑到地方小额法庭的窗口,激动万分地递交上那个请求起诉 CNN的表格.而里面的那个法庭服务员(CourtClerk),看了一眼他表格上的“诉讼理由”之后,却耸耸肩,摇摇头,一副万分同情的样子对他说 “Sorry”,然后将他的50美刀支票,连同诉讼状一起,从窗口里面退了出来。告诉他说:嘿,你应该去找一个律师嘛.--我相信,这肯定就是最有可能遇到的一个结局。   另一个对CNN的主诉人,纽约华人梁美容师,和她的代表律师张海明同志,看上去比这位“堪萨斯华生”,有更为精明的生意算盘。他们不走“小额法院”这一条便捷的近路。而是直接就入禀到了纽约高等法院去了。这就是说,他们找到了一个控告CNN“诽谤,中伤”罪名的“正确途径”。而且他们要的钱,也不是 500美刀,而是上亿美元的“大额”。   张海明律师同志那位学生对比,毕竟是一个从Bar里面考出来的有照律师。他是否真有美国法庭Litigation(庭审)的经验,我不知道。起码,他对美国法律的“书本”知识,也还是应该有一点地。我的疑问是:当他提交这个诉讼状的时候,在他的心里,究竟有多少的把握,自己所代表的这个官司有任何取胜的机会呢?或者,他不过是打算做一件类似“斗风车”这样无谓的英雄之举?律师接一宗案子,“赚钱”是主因。如果他明明知道自己的这个诉讼,极其有可能连 “起诉”的机会都没有,就无疾而终的话,那么,他大费周章地搞这种“土法炼钢”式的诉讼究竟是为什么?   我断言他的这个诉讼,将连在高院“立案”的机会都不存在,基于3个非常明显可见的理由:   第一:关于“歧视性言论”和“道德批评言论”之间的区别。在美国,一个节目主持人必须为自己的“种族歧视性”言论承担法律责任,而却可以完全不必为任何“道德评判性”的语言承担类似的法律责任。这是人所共知。美国的法律保障言论自由,同时也保障公民免予被歧视的自由。这里关键的区别在于什么是 “种族歧视性”语言,什么是“道德评判语言”。如果张律师真的可以证明CNN的卡佛利使用了“歧视性语言”的话,那么我真要恭喜他,恭喜全体参讼的中国人:他们很可能真的就要大发了。 但是我们只要稍稍上网查一下,就可以发现美国法庭,针对“歧视”的判例有很多。根据这些判例,我们立刻就可以明白在美国的法律界,有哪些语言是法律一致公认的,属于明显带有“歧视”色彩的。美国的法庭,在这个问题上,实际上已经积累了非常丰富的经验,对于“歧视”的定义,也是非常明确的,不含糊的。-即这些词汇必须明显涉及对方的年龄,肤色,性别,长相,族裔特征,或宗教信仰。。等等。譬如说,如果卡佛利骂中国人是“黄皮肤的蠢货”,或“长着一双裂缝眼的亚洲佬“(SliceEye),那么非常明显,他就可以被控使用“歧视性语言”。   非常不幸,卡佛利没有这么骂。他是属于那种“杀人不见血”的高级道德评判家,类似中国的鲁迅与柏杨。当然他不会,也不屑于使用那些低俗的,下层人使用的骂街语言。他所使用的,引起广泛争议的那俩词汇,虽然鞭辟入里,却和“族裔特征”没有丝毫关系。这一点,哪怕我们的张律师再蠢,也不可能同意 “GoonsAndThugs”是和黄种人的生理特征联系在一起的。相反,这两个词汇有很强的道德评判色彩,专指那些不讲道理,横蛮,蔑视法则秩序,一味相信拳头和暴力的蒙昧人。可以适用于任何一个没有道德文明,没有进化完全的个人或群体。既可以是黄种人,黑种人,也可以是白种人。我们迄今为止,还没有看到哪一个美国的新闻媒体,曾经因为使用这样的“道德批评”语言而被法院处罚,没有,一个先例都没有。   所以,CNN和卡佛利肯定都不可能开这个先例。美国的言论自由,是法律中的法律,而且是在法律之上的法律。如果法院真的要为此审批CNN的话,那么我们可以这么说吧:被告就绝对不是一个卡佛利,也不是一个CNN.。而是整个美国的传媒。从这点来说,卡佛利的命运,不是他一个人的命运,而是美国媒体的整体命运。张海明律师,何不将整个美国的媒体,乃至于整个美国言论自由的制度,都一并告到法庭上去呢?   第二:张海明同志和梁美容师,按他们自己所说,是代表13亿中国人起诉CNN。这很不得了,须知这可是全���界有史以来,从未有过的,最庞大的 “集体民事诉讼案件”。(ClassLawsuit)。一个空前绝后的诉讼,完全有资格进入“吉尼斯世界记录大全”的。上网查一下美国的司法历史就知道,几十个人,上百个人,或上万个人集体控告某个公司的民事诉讼,都不算罕见。然而,13亿人集体状告一人,一个公司,就我所知,这要的机会简直比宇宙大爆炸的机率都还要低。主审法官是那位我不知道,但我担心他拿到们这个张律师的起诉状之后,第一个反应很可能不是心肌梗塞,便是脑溢血。我在美国数十年,记得大概有2-3次,也曾经有经历过被��请加入“集体诉讼”行列的故事。最后的一次,偶还收到一个律师楼寄给我的邀请函,他代表上百个客户控告一个股票投资公司,索赔上亿。而我恰恰好也是这个股票上市公司的一个“股票持有人”,所以,人家就同样邀请我加入到他们免费的诉讼大军里面去。也正因为有这样的经历,我才对美国集体诉讼的法律程序略知一二。起码,我知道律师楼必须将起诉书和邀请信送给每一个可能的原告人,在得到他们签名的授权之后,才可以正经八百地告诉法官:他代表张三,李四,王五,马六。。。等等诸多原告人,控告某某人或某某公司。当然这个过程并不十分复杂,可我不明白的是,这13亿人的签名授权程序,难道我们这个张律师已经搞定不成?他是如何搞定的?   第三:既然民事诉讼以获得金钱为最高目的,因此在美国,有个几乎是家喻户晓的金科玉律,是哪怕一个法律的外行人都明白的道理,叫做“不受痛楚,不得赔偿”(Nopain,NoGain)。这个法则非常明白的告诉原告:在民事诉讼中,你必须证明自己有“切实的伤害”,(PainOrInjury)并且还要进一步证明,因这样的伤害,导致了你蒙受了一定数目的经济损失(FinancialLossOrDamage)。你能够证明这两个条件,你才有合法的依据,向被告要求金钱上的赔偿。   这就是说:首先这位张海明律师,必须向法官证明这13亿人,都因为卡佛利的一句而受到“心理创伤”。这几乎已经和登月的难度不相上下了。接下来,他还要进一步证明:13亿人都因为这样的“心理创伤”,而蒙受某些不可弥补的金钱方面的损失,这个,我想大概,和揪着自己的头发要离开地面的难度有得一比了吧?不知道,到时候这位张律师会以什么样的说辞来糊弄我们的主审法官呢?   好了,如果将上面这三方面的分析总括起来的话,我几乎立刻就可以预料:到这个13亿人,13亿美元的“世纪大案”,它的结局究竟会怎么样。姑且不要说赢得诉讼,这样案件如果真能通过法官初期审核的阶段,被同意开庭审理话,就已然是一个了不起的伟大胜利。 至于其他对CNN的诉讼事件,我觉得不提也罢。前几天好像看到有报道说,北京或西安那里的几个中国律师,也开始联手告CNN了,而且动辄也是好几亿美元的说。当时我一看就乐了:敢情这些家伙的律师执照,都不是真刀真枪地考出来的吧?不是吃来,买来,那就一定是睡出来的,否则怎么连“司法领域”这样的基本法律常识都没有呢?如果卡佛利此时在中国,他们提起诉讼,那么起码于理上还说得过去。可人家现在在美国,莫不成,中国人民共和国的法律,还可以管辖到美利坚合众国的领土上来?
