It was Lara’s great-grandfather who established The Westies gang back in Corpus Christi, Texas in the beginning of the last century upon his arrival from Ireland. Ever since then the well-known gang has ruled Texas with its members being infiltrated in police, government, universities, hospitals.. you name it. Some called Westies mafia, some called Westies family.. to Lara the gang was certainly the latter. Yasmine’s fingers gripped the pen in her hand tighter than usual as she signed her full name, the date, the time of her arrival and the time of her appointment on the clipboard the receptionist handed to her. She hadn’t seen Dr. Rhodes since before she’d learned of her pregnancy and debated whether or not she was making a mistake as she retrieved her wallet for her ID and insurance card. Yas, like so many other unbeknownst patients, had a clandestine deal with Doctor Elias Rhodes that included committing insurance fraud by allowing him to bill each patient additionally under the table. Stressed suburban soccer moms would often find themselves picking up a prescription of Adderall or Ativan from him -- anything to take a little off the edge or kick it up a notch. She’d received his number from a friend of a friend and had been getting opiates unnecessarily prescribed to her for a few months now. Her husband knew nothing of their arrangement or her ‘substance problem’, though she was certain she had it under control. If he could polish off several bottles of vodka a week, why couldn’t she pop her little favorite blue pill every once in a while?
Because you’re pregnant, you selfish bitch, she thought. Not for long, Yasmine reaffirmed to herself. She couldn’t have this baby. Adrian and her were hardly in a place in their marriage where they could have another child, especially so soon after Josiah’s passing. She hadn’t been to see the baby itself on a sonogram, only confirmed what several drug-store tests had already told her by requesting her OBGYN to order a blood screen. There was no doubt about it… at that very moment, a small collection of cells were forming within her to eventually create a baby she hadn’t decided she really wanted yet or not. She had an appointment to see if it was even viable or had a heartbeat yet that she kept putting off. Yasmine would keep putting it off until she had her little blue bill in her first.

The wad was a little more padded than usual, as she’d arrived with the intention to get him to raise her prescription and add another to the lineup for her ‘anxiety’. Yasmine cleared her throat, sliding out of her coat as she held her hand out to shake his. “Doctor Rhodes. I hope you enjoyed your holidays.” She wasted no time peeling her YSL wallet open before removing the money from its sleeve and setting it on the examining table. “I was hoping we could discuss an increase in both the dosage and the quantity. I believe we discussed having a little wiggle room to prescribe me Alprazolam after our last visit. As promised, here’s the payment in full for both.”

Prichard Family
Beginning with Lev H. Prichard, Sr., the Prichard family of Oklahoma has long been associated with the oil industry, as well as with religious and philanthropic causes throughout Oklahoma and Texas.
Lev H. Prichard, Sr. was born in 1883 to a devout farm family in rural Mississippi. He grew up working in the fields, while attending a one-room schoolhouse four months out of the year. Prichard earned a bachelor’s degree from Mississippi College in 1906 and a law degree from Millsaps the following year. A country lawyer, Prichard relocated to Oklahoma City in 1909,where he developed a growing interested in the booming oil industry there. In 1919 he co-founded the Anderson-Prichard Oil Corporation, which soon had successful oil claims in Texas, Louisiana and Oklahoma, along with a refinery in Cyril. Prichard bought out his partner in 1945 for $7.75 million, then took the company public. He died from cancer in 1949.
Prichard’s widow, Louise Melton Prichard, continued to oversee Anderson-Prichard as a board member and major stockholder until the company assets were sold for $123.3 million in 1960. The Prichards were longtime members of First Baptist Church, Oklahoma City; and after Lev’s death, Louise provided major support to religious institutions in the state, donating the chapel that bears her name at First Baptist Church of Oklahoma City. On her death in 1966, she left her estate to Oklahoma Baptist University to establish a permanent endowment for ministerial students, the largest gift in the school’s history.
Lev H. Prichard, Jr., a graduate of the University of Oklahoma, joined the family company after graduation. In World War II he served as an officer and flight instructor in the U.S. Army, returning to Anderson-Prichard briefly after the war before moving to San Antonio in 1948 and forming Prichard Oil Company. He served briefly on the Anderson-Prichard board before his untimely death in a plane crash in 1950.
His only son Lev H. Prichard III graduated from Penn State University, with additional agricultural studies at Texas Christian University. He moved to Corpus Christi, Texas in 1961, establishing himself in the travel business before forming Prichard Oil Company and going into partnership with Ralph Storm in 1975. In 1995 he formed Apco Minerals LLP to manage family legacy mineral rights. Active in Corpus Christi civic life, he was a generous supporter of local charities, First Baptist Church and Baylor University. In 1998 and his wife, Ella Wall Prichard, created the Prichard Family Foundation to promote the community, religious and educational values reflected through the generations by his family.
After Prichard’s death in 2009, Ella assumed the presidency of Prichard Oil Company, along with management responsibilities for other family entities. A published author, her memoir, Reclaiming Joy: A Primer for Widows, was published by 1845 Books, an imprint of the Baylor University Press, in 2018.
Their children, Lev Prichard IV and Margaret Prichard Fagan, continue the family philanthrophic legacy as directors of the Prichard Family Foundation.

Death During a Texas Divorce
Spring TX Divorce Lawyer: Having written about death during a Texas divorce no too long ago one of my first questions was “did his client have a will?” the answer was no unfortunately. In my December 2016 blog post “Texas Estate Planning, Divorce and Protecting Assets” I covered why you want to make sure you have an updated will for situations just like this one.
However, in my friend’s fact pattern I still had hope that his deceased clients wish would be carried out in regards to his estate. That summer I had attended the Texas Advanced Family Law and in the conference I remember a similar case being discussed. I couldn’t remember for sure but I believed that a Mediated Settlement Agreement was still enforceable after the death of one of the spouses.
I told my friend I would review the cases and see if I could locate the information and let him know. After talking with him I did just that. One I found was:
> The death of a party to a pending divorce proceeding abates the divorce action because a divorce action is a purely personal matter. Dohrn v. Delgado,941 S.W.2d 244, 248 (Tex.App.-Corpus Christi 1996, no writ). The proper procedural disposition of a divorce action when one of the parties dies is dismissal.
> If the parties to a pending divorce have entered into a Mediation Settlement Agreement and one party dies before entry of the final divorce decree, the Mediated Settlement Agreement is immediately binding and will be enforced under section 154.071 of the Texas Civil Practice and Remedies code and Rule 11 of the Texas Rules of Civil Procedure. See Spiegel. v. KLRU Endowment Fund, 228 S.W.3d 237 (Tex. App.–Austin 2007) review denied (Sept. 28, 2007) rehearing of petition for review denied (Feb. 15, 2008).
Texas Civil Practice and Remedies Code Section 154.071 states that “EFFECT OF WRITTEN SETTLEMENT AGREEMENT”
> If the parties reach a settlement and execute a written agreement disposing of the dispute, the agreement is enforceable in the same manner as any other written contract.
> The court in its discretion may incorporate the terms of the agreement in the court's final decree disposing of the case.
> A settlement agreement does not affect an outstanding court order unless the terms of the agreement are incorporated into a subsequent decree.
Divorce Pending at Death
A divorce may be pending in the probate court at the time of the death of one of the parties. In In Re Graham, 971 S.W. 2d 56 (Tex. 1998), the Texas Supreme Court approved the transfer of a divorce action from a district court to a probate court where one of the spouses was incapacitated and the subject of a guardianship administration in the probate court under the Section 608 transfer power.
Other case law has also provided that if a suit is filed in the family court or other district court after the death of a party to a divorce decree relating to obligations thereunder, the probate court in which the decedent’s estate is pending may transfer such suit to the probate court is the claim would affect the assets of the estate.
