A little more than 15 years ago, Fred A. Cunningham and a few employees started the operation of San Antonio's newest potato chip and corn chip manufacturing company.
One truck handled the firm's entire production at the beginning and today, because of the progressive and dynamic leadership of Fred Cunningham, the firm's president, the company now operates more than 50 trucks.  Originally, Facs Co. covered part o san Antonio with its products, but today its products serve San Antonio, Corpus Christi, Lubbock, the Rio Grande valley, Laredo and other intermediate towns.
Initials Form Name
The problem of a name for the firm was solved by using the initials of its originator -FAC.  Today millions of packages of Facs products are enjoyed every month.  And the word "Facs" has become a joy for children and adults who appreciate outstanding food products.  
The Facs company started its operation in a very small area, but today manufactures its products in a large modern plant.  Many of the of the machines for making its various food products were originated and developed by Cunningham.  
The firm has scored many "firsts" in the potato chip industry and is recognized throughout the industry for its pioneering spirit and research capacity.
Recognizing the need for chips that do not break to be used with dips, Cunningham spent thousands of hours with key members of his staff to find an answer to this need.  During 1958, the efforts of the research project came to successful completion with the manufacturing of th nation's first corn chip.  Facs new product was a large size corn chip with sufficcient strongness, yet tender, to be used as a dip.  Since that time, other firms throughout the country have attempted to copy this product.
Five years ago, Facs Co.'s ever growing popularity for its products necessitated a move which tripled its space facilities for manufacturing.  Increasing business and expanding territories have again caused the need for additional space for expansion.  Soon the company because of continued customer satisfaction will be forced to build a new plant to keep up with the demand for its products.  Accirding to W.B. Brown, first vice president of the Facs Co., if sales keep increasing at the rate they are now increasing, a 24 hour operation will be required.

In addition to operating an expanding business, Cunningham is active in civic and community work.  He is a member of the Rotary Club, a good supporter and director of th San Antonio Livestock exposition and first vice prsident of the san Antonio Manufacturers assn.

on April 24, 1991:
Fred A. Cunningham , the founder of FACS Potato and Corn Chips Company was an unforgettable man with a mischievous sense of humor who kept all around him laughing even between his last breaths.  He died April 21, 1991 at a local hospital of cancer at the age of 76.  It was while driving for a rval chip company that Fred became determined that he could make a better chip.  So in the early 1940's he began making chips in his garage and the company was born.  He christened it FACS by combining his three initials.    As this once small company grew and flourished the problems of marketing did also.  So FAC's together with Knowlton, Pioneer Flour and Roe___ came together to form Advertising & Marketing Services.  They became known locally as the Big Four.  In 1969 Fred sold FACS company to Pet Milk and the chips became known as Dentler-FACS.  They are now under the Borden name.

Paul Fulton, a food industry veteran of more than 20 years has been named general manager of the Facs-Dentler Snacks Operation in San Antonio. An extensive enlarging and modernization of the San Antonio Facs plant is now under way.  Ultra modern equipment featuring science's latest achievements in food manufacturing,handling and packaging are now being installed in the San Antonio plant.  
Prior to coming to San Antonio, Fulton was associated with the Dentler Snack Food Division in Houston.  Pet Inc. purchased Dentler in 1965.  
The Facs Co. of San Antonio was acquired by Pet, Inc. in 1969.  A consolidation of the two divisions is being contemplated during the middle of 1970.   The Facs-Dentler Snacks Divisions are part  of the Snack Foods Division of Pet, Inc. which is headquartered in Anaheim, Calif.  The Texas operation is responsible to Larry Youngblood who is a division vice president.

It was a historic occasion for the South Texas town of Pearsall when officials broke ground in 2004 on what would become one of the country’s largest immigration detention centers.
Not only would it help improve border security, U.S. Sen. John Cornyn said then, it would also bring employment to the small rural community, about 60 miles from San Antonio. Hundreds of good jobs for a region that desperately needed them.
But now, as the coronavirus pandemic continues to spread inside immigration detention centers, local leaders here in an extraordinary move have called on the company that runs the center, the GEO Group, to publicly explain itself. They say the company has not been transparent, and has failed to respond to emails and letters seeking answers to a simple question: What is the GEO Group doing to prevent the virus outbreak inside the privately owned facility from creeping into their community?
The leaders have invited company officials to attend the Frio County commissioners meeting Monday and sent a list of 20 detailed questions, ranging from what safeguards are in place to protect employees and detainees to how it can make the information more readily available to the community.

“We did our part, we financed their construction. Now it’s time to hold them accountable, to help us,” said Jose Asuncion, a recently elected county commissioner who over the years has been pushing for more transparency in the for-profit detention industry.
“For many of us, this could be a matter of life and death,” a group of nine area elected officials and a candidate, including Asuncion, wrote in the open letter to the GEO Group on May 5.
The letter was drafted before the number of confirmed cases inside the South Texas ICE Processing Center jumped from seven to 31 detainees, as of Friday. Seven employees have also been infected.
ICE said there were 900 detainees in custody in Pearsall last week.
Outside the center, Frio County, with a population of about 19,000, reports only two confirmed COVID-19 cases.
“This is an example of how things can quickly get out of hand if the virus gets transported into our community,” Frio County Attorney Joseph Sindon said. “We were at zero cases two weeks ago.”
The GEO Group says that it has been in communication with local leaders, although it didn’t specify who, and that it has taken steps to mitigate the risks. “We take our responsibility to ensure the health and safety of all those in our care and our employees with the utmost seriousness,” the company said in a statement Friday, adding that it would continue to work with the federal government and local officials to develop COVID-19 emergency plans and testing policies and to procure supplies for staff and detainees.
Nationwide, there are nearly 800 confirmed cases inside immigration detention centers. More than 1 in 4 of those cases are in Texas.
But the number is likely higher as Immigration and Customs Enforcement has tested only about 5% of its detained population. More than half of those have tested positive.
Most detained migrants are held in privately owned facilities, which have come under fire for allegations of poor treatment and conditions. Among those owners is Florida-based GEO Group, which generated $2.4 billion in revenue in 2019 and has been a big donor to federal, state and local candidates, primarily Republicans, and GOP political action committees, records show.
In response to the pandemic, ICE says it’s taking steps to minimize the spread of the virus. It has limited some arrests, suspended social visits and released more than 900 detainees since March who might be vulnerable.
Transfers between immigration facilities and from local jails, many dealing with their own outbreaks, continue, though, contrary to CDC recommendations. Between March 1 and April 25, ICE reported more than 3,300 immigrants arrested by local law enforcement were then turned over to the federal agency, including some sent to Pearsall, according to detainees and lawyers.
Advocates, elected officials and medical professionals say what ICE is doing hasn’t been enough, and cite the agency’s poor track record containing infectious disease. They continue to call for the release of migrants in custody, especially those with underlying health conditions.
The first death due to COVID-19 inside an immigration detention center was reported Wednesday. The victim was a 57-year-old Salvadoran man held at the Otay Mesa Detention Center in California, where 139 detainees have so far tested positive, by far the largest cluster across the country.
Asuncion said he decided to make the letter to GEO public in response to constituents’ concerns that the county government was not giving them answers.
He expected to be the only leader to sign the letter, Asuncion said last week. “By the time I emailed the draft of the letter, everybody had a sense that the situation was only going to get worse, and they didn’t want to seem like they didn’t do or say anything early on.”
“We can no longer sit back and wait for tragedy to occur, action must be taken now! What we want is simple answers and to be proactive as a whole,” Ramiro Treviño, a candidate for the Frio County Commissioners Court, posted on Facebook May 6 after learning of 15 additional cases inside the center. “Please pray for each and every individual affected by this.”
His post was followed by an “Amen,” from Davina Treviño Rodriguez, a Pearsall City Council member, who offered her own prayer.
One of the Better Employers
When GEO’s predecessor, the Correctional Services Corporation, got the contract for the Pearsall center in 2004, officials sold it as a way to bring jobs. The 230,000-square-foot facility built on a former farm field would employ 300 people and have an annual payroll of about $6.2 million.
A prospective applicant needed only to be at least 21 and have a high school diploma or GED and no serious criminal record. Entry-level security wages would be in the $12-an-hour range, they said.
The center would also generate hundreds of thousands of tax dollars for the school district. Frio County issued a $49 million bond to finance construction, reported the local newspaper, the Frio-Nueces Current.
For the company, it meant annual revenues of about $21.7 million, according to news reports.
The center opened in 2005 with a capacity of about 1,000 men and women. A year later, it added 884 detainees and another $11.3 million annually in operating revenue.
Under a 2011 contract, GEO expected annual revenue of $45 million with a 75% occupancy guarantee from ICE, a news release from the company said.
Frio County is about 80% Hispanic and has a median household income of $42,000, about 30% below the national median, according to the U.S. Census. About 1 in 5 people live below the poverty level. Very few have a college degree. The economy revolves mostly around agribusiness, oil and hunting.
The South Texas ICE Processing Center became one of the better employers in the community, said Sindon, the Frio County attorney.
“You can hardly find a family that doesn’t have someone that works there,” he said.
Frio County, like many communities in Texas, is the type of place where prisons are seen as the solution “to most, if not all of our problems,” said Asuncion, 39, who lives in Dilley. That town also has a large detention center, run by CoreCivic, another giant in the for-profit detention business.
“We look at them for safety, we look at them as economic saviors,” he said.
Asuncion was raised in Chicago and lived in Los Angeles before moving to Dilley to take care of his grandmother eight years ago. Immediately he became interested in the for-profit detention center visible from his home and started asking questions. He even did a short stint as a local reporter, and said he was stonewalled in his efforts to get information.
He said he’s tried reaching out to officials at the Pearsall facility directly about the outbreak, leaving messages and sending emails to the addresses he has. “But at a certain point you say I shouldn’t be chasing these guys down in this situation, I’m a commissioner.”
Other large ICE detention centers in the country are operated by LaSalle Corrections, Management & Training Corp. and Immigration Centers of America. Nine of the 10 facilities in Texas with positive cases of COVID-19 are owned by one of these corporations.
The GEO Group grew from a division of a private security firm to an international giant operating detention centers in several countries, including 67 in the United States with about 75,000 beds.
Over the years, these for-profit companies have given millions to candidates and groups that support them.
The GEO Group spent over $1.5 million on lobbying in 2019, according to lobbying disclosures. About a quarter of their business went to Ballard Partners, which continues to lobby the White House and the Department of Homeland Security on GEO’s behalf to promote the use of private prison and detention centers.
So far in the 2020 election cycle, the GEO Group’s PAC has given $100,000 to Trump Victory, a joint fundraising committee for the Trump campaign and other Republicans. Prior to the coronavirus outbreak, the number of immigrants in detention had reached an all-time high under President Donald Trump, who ran on an anti-immigration platform.
Texas politicians are also among the beneficiaries. During the current cycle, the GEO Group’s PAC has given $5,000 to Sen. Cornyn, a Texas Republican, and $9,700 to U.S. Rep. Henry Cuellar, a Democrat from Laredo.
While its last inspection in February by an ICE contractor found it to be in compliance, as with other detention centers across the country, the South Texas ICE Processing Center has had a checkered history.
Detainees have complained and sued after claiming that staff repeatedly placed them into isolation. Human rights reports have documented allegations of sexual abuse and cited the facility in reports documenting the high number of recent deaths inside ICE detention facilities.
On its website, the GEO Group emphasizes one of the company’s core values is that “every human being should be treated with dignity and that his or her basic human rights should be respected and preserved at all times.”
Hunger Strikes by Detainees. Confrontations with Guards.
As the coronavirus pandemic spread in March, so did confrontations between detainees and guards.
Inside the South Texas ICE Processing Center in Pearsall, migrants clashed with guards over what they called unsafe conditions, demanding to be released. The unrest led to a standoff in which guards shot pepper spray at the detainees. Nine immigrants were held on disciplinary charges.
There weren’t any reported COVID-19 cases then, but soon they started trickling in and the more positives were reported inside the detention centers, the more detainees feared they would be next.
Over the last couple of months, half a dozen asylum seekers have told ProPublica/Texas Tribune about not having enough cleaning supplies, masks and gloves, their inability to stay the recommended six feet apart, holding those who test positive together in rooms with poor ventilation and hygiene they say have helped spread the virus.
Kathrine Russell, an attorney with the immigrant legal services group RAICES, said GEO has recently started to take additional steps at the South Texas center, including issuing detainees masks. “Measures that they should have taken from the beginning,” she said. “If they had, we might not be in the situation we are now.”
There have been at least five hunger strikes inside the Pearsall facility, detainees say — some to demand more information, others to call for more testing as migrants in their units came down with the virus.
In a city besieged, undocumented New Yorkers have been left outside public measures to help those impacted by the spread of the coronavirus. Instead, they weigh impossible choices: medical help and exposure, safety or sustenance.
A man who was transferred from the Bexar County jail said he believed the outbreak at Pearsall began with someone who had been taken there from the jail. More than 300 inmates and 55 staff members there have contracted the virus since March.
“My question to the officers is why did they keep bringing people from Bexar if they knew they were infected?” said one detainee, who asked that his name not be used fearing retaliation. Between March 1 and April 25, 174 people were transferred from Bexar County to ICE facilities.
Detainees in Pearsall said they at times were given false information about positive cases. On one occasion, staff had said they had nothing to worry about, before returning days later to confirm that one of the men in their unit had tested positive.
In an April earnings release, GEO’s CEO, George Zoley, said that his company has worked to procure safety supplies, do temperature checks and follow Centers for Disease Control and Prevention guidelines, and that all of its facilities have “access to regular hand-washing with clean water and soap, round-the-clock healthcare, and typically have approximately double the number of healthcare staff, compared to state correctional facilities.”
But this is contrary to what multiple detainees and their advocates from facilities across the country continue to report, including in lawsuits and complaints.
“It’s been horrible,” said Yanet Cabrera, whose 54-year-old mother was recently transferred from Pearsall to another detention center in Laredo. “I can’t stop thinking that she can get sick, that I can lose her in there and I have no way of helping her.”
There are no known cases in the center where her mother is now, but Cabrera said she wasn’t tested before leaving the South Texas facility.
Disappointment. Fear. Concern.
Even with claims of precautions in place, Pearsall and Frio County officials and residents say they remain concerned.
“Anybody following this and listening to experts knows large groups of people in close proximity creates the possibility for a firestorm of cases,” said Sindon, the county attorney.
He sighs when asked about the latest number of confirmed cases inside the Pearsall facility. He feels “disappointment, fear, concern for our community,” he said. “The detainees can’t leave, but the guards certainly can. We have to hope GEO is taking appropriate steps.”
The entire county only has three ventilators and 48 hospital beds. A model from researchers in the U.S. and Canada, including Traci Green, an epidemiologist at Brandeis University, estimated that the South Texas ICE Processing Center could have up to 1,345 detainees contract the virus over 90 days under the most optimistic scenario. In a yet to be published article in the Journal of Urban Health, a peer-reviewed publication that focuses on urban health and epidemiology, the group’s model projected that between 72% and nearly 100% of ICE detainees could contract the virus in a 90-day period given conditions inside the centers and average populations.
“The real challenge is that once it starts in a closed space, it’s likely to spread very quickly,” Green said, “and will advance where a certain portion of the population will need hospitalization and ICU admissions,” a local community hospital will need to accommodate.
The other county and city leaders who signed the letter didn’t return calls, emails or requests for comment via social media, including the mayor of Pearsall, where the center is located.
Frio County Judge Arnulfo Luna also wrote a letter to the GEO Group administrator who runs the Pearsall facility “to implore” him to keep workers and detainees safe, especially given the county’s inability to regulate the center’s employees and contractors.
“As you know the employees and contractors who work at your facility live in the surrounding Frio County communities of Pearsall, Dilley, Moore and Derby,” Luna wrote. “The citizens that make up these communities are increasingly concerned that the high risk of exposure to those inside of your facility will lead to an outbreak outside of it, and our communities will be put at greater risk.” As of Friday, county officials said they had not received a response.
GEO Group said it will provide a “comprehensive response to the county detailing the steps we have taken in response to the COVID-19 pandemic. As a responsible community partner, we make ourselves available to provide information to the communities we serve.”
“This is the first time I really ever noticed the city and county taking a critical view of the detention center,” said Russell, the attorney with clients in Pearsall. “Which I think in some ways is probably good.”

Michael C. Cooper, Convicted in Tax Scam, Dies a Prisoner at 66

For decades Michael C. Cooper ran small-time investment and marketing scams in Topeka, Kan., repeatedly clashing with securities and consumer protection agencies. He mocked their actions as inconsequential and ineffective.Then, in 1997, as Senate hearings in Washington were dramatizing supposed abuses of taxpayers by the Internal Revenue Service, Mr. Cooper saw an opportunity to profit from public resentment of the tax system — and to move up from a local flimflam artist to a national one.He launched Renaissance/The Tax People, a tax-avoidance business that ultimately ensnared about 50,000 Americans — until a Kansas state judge shut the firm down in 2001, ruling that it was an illegal pyramid scheme of a “fundamentally deceptive nature” that had cost customers and investors at least $84 million.Tried, convicted and sentenced to 25 years to life in prison, Mr. Cooper never got out. He died on Friday, the Federal Bureau of Prisons confirmed without stating a cause. He had been held at the United States Penitentiary at Leavenworth, Kan., before being moved to a nearby hospital three months ago for bypass surgery, which did not go well, according to a social media post by his daughter, Crissy Moussa.Mr. Cooper, who had been scheduled for release in August, was 66.Mr. Cooper’s business involved soliciting investors who would pay up to $1,200 plus $100 a month for each “package” of tax-avoidance methods they received, with promises that their income tax obligations would shrivel.The Tax People was the subject of a front-page article in The New York Times in September 2000, part of a series on tax schemes that was awarded a Pulitzer Prize.That article examined Mr. Cooper’s claims that “golf, hunting, fishing and even vacations with your family” could become tax-deductible expenses for those who bought the company’s system. The Tax People boasted that its “Tax Dream Team” included former I.R.S. officials who were such powerful advocates for the Cooper system that I.R.S. auditors had wilted before them. One team member was Jesse A. Cota, a former I.R.S. district director in California.In an interview in his San Diego hotel suite in 2000, Mr. Cooper told a reporter that dropping a business card in a fishbowl at a restaurant’s cash register made the meal, parking and mileage to and from the establishment tax-deductible. Asked by The Times to identify a statute, regulation or court case authorizing such deductions, Mr. Cooper said the answer was in his company’s promotional materials. Advised that no authority was cited in those materials, Mr. Cooper said the right to such deductions was common knowledge. He then said that one of his “Tax Dream Team” experts would explain. When asked which team member should be queried, Mr. Cooper stood up and walked out of the room.Carla Stovall, the Kansas attorney general at the time, asked a state court in 2001 to shut down the business. At a civil court hearing, Charles W. King, a professor of marketing at the University of Illinois at Chicago, testified that The Tax People was a legitimate marketing firm.Professor King’s testimony came after Mr. Cota had admitted in court that the firm’s claim to have signed up thousands of tax professionals was false, and that the real number was 541.Mr. Cooper’s firm also told investors that it had won every tax audit. Mr. Cota admitted that this had not been true for 59 percent of the audits.Mr. Cooper and his team, court papers showed, falsely asserted that “every strategy contained in the Tax Relief System is absolutely sound, unassailable and proven over the past 40 years,” and that the system “was approved for continuing education credit for C.P.A.s in all 50 states.”Richard D. Anderson, a Kansas state court judge, ordered the firm closed and directed Mr. Cooper to forfeit his assets.“At its core,” the judge wrote, “the Renaissance marketing plan is a clever scheme to extract money from consumers through the use of misrepresented facts, exaggerated claims and projections, undisclosed material facts and false promotions.”Judge Anderson jailed Mr. Cooper for contempt of court and ordered him to forfeit $13.6 million, but freed him 13 days later on Mr. Cooper’s promise to travel to Mexico to recover $2 million that he said belonged to him. When Mr. Cooper failed to return, Judge Anderson ordered his home in Topeka, 80 acres of land and other property seized.A raid on the company headquarters — in the Fleming Mansion, one of Topeka’s most notable homes — yielded 240 Australian gold coins, 310 Canadian gold coins, a Mercedes-Benz, a Dodge Viper luxury sports car and a 2.37-carat diamond ring.I.R.S. agents, postal inspectors and state authorities also found more than $8 million in cash and records of bank accounts holding millions more.In late 2004, Mr. Cooper was arrested while crossing into the United States from Mexico at Laredo, Texas. His Topeka lawyer, Jerry Berger, said at the time that Mr. Cooper was unaware of a sealed 148-count federal indictment against him and his “Dream Team.” Mr. Cooper had been living in Puerto Vallarta with his wife, Mary Cooper, and two children, Mr. Berger said.Eric Melgren, the United States attorney for the Kansas district at the time, said that Mr. Cooper and his confederates had been “selling something that was too good to be true,” and that it was just “bad advice, wrapped up in glossy packages and false promises.”Mr. Cooper went to trial. Other members of his team pleaded guilty to money laundering, conspiring to defraud the federal government and other charges and were given much lighter sentences.Mr. Cota was sentenced to two years in prison. His experience as a former I.R.S. executive had been central to Mr. Cooper’s marketing claim that the Renaissance system was endorsed by the I.R.S. Mr. Cota was paid more than $300,000. He was fined $250,000.Among those who paid to join Renaissance/The Tax People was Marcy Szarama, the owner of a construction management firm in Southern California. She said a police officer had recommended the system as a legal way to reduce income taxes.“The Tax People were encouraging you to start your own business, just so you could have a tax write-off, but there was no other real intention other than tax deductions,” Ms. Szarama said in a phone interview, adding that she had grown suspicious after joining because the tax-avoidance strategies seemed vague. She said she had lost about $4,000 and received no restitution.Steve Kassel, a tax preparer in South San Francisco, said he now regretted working with Mr. Cooper and Mr. Cota. He withdrew, he said, after being alarmed by some of the company’s marketing claims, but acknowledged that he had left too late to avoid disciplinary action. For five years he lost his authorization to represent clients in I.R.S. proceedings.“I should have listened to my wife when she told me to avoid it,” Mr. Kassel said of the Cooper organization in a recent phone interview.(The Senate hearings that had inspired Mr. Cooper elicited testimony that I.R.S. auditors, collections officers and criminal agents had run roughshod over taxpayers. Subsequent investigations by The Times, Tax Notes magazine, the newspaper The Virginian-Pilot and other publications showed that virtually all of the testimony had been incomplete, misleading, unverifiable or contradicted by public records. DHS OIG Finds Troubling Conditions At Several ICE Detention Facilities
INTRODUCTION
On December 11, 2017, the Department of Homeland Security (DHS) Office of Inspector General (OIG) released an interesting and troubling report titled “Concerns about ICE Detainee Treatment and Care at Detention Facilities.” The DHS OIG report “identified problems that undermine the protection of detainees' rights, their humane treatment, and the provision of a safe and healthy environment” at four detention facilities during unannounced inspections. In this post, we will detail the DHS OIG findings and examine the corrective action that the U.S. Immigration and Customs Enforcement (ICE) has begun to undertake.

ORIGINS AND METHOD OF INVESTIGATION (PAGES 1-3)
The DHS OIG was prompted to investigate conditions at detention facilities “[i]n response to concerns raised by immigrant rights groups and complaints to the [DHS OIG] Hotline about conditions for detainees held in [ICE] custody…” On page two of its report, DHS OIG explained that the ICE Enforcement and Removal Operations (ERO) “oversees the confinement of detainees in nearly 250 detention facilities that it manages in conjunction with private contractors or state or local governments…” The DHS OIG chose six facilities for unannounced inspections based on its “professional judgment,” identifying those of particular concern “based on [OIG] complaints, reports from non-governmental organizations, and open-source reporting.” The DHS OIG made unannounced visits to the following six detention facilities:
Hudson County Jail (mixed gender) [PDF version];
Laredo Processing Center (female-only) [PDF version];
Otero County Processing Center (male-only) [PDF version];
Santa Ana City Jail (mixed gender);
Stewart Detention Center (male-only) [PDF version]; and
Theo Lacy Facility (male-only) [PDF version].
Of the six, only the Laredo Processing Center, Otero County Processing Center, and Stewart Detention Center are dedicated Intergovernmental Service Agreement (IGSA) facilities. IGSA facilities are state and local facilities operating under an agreement with ICE that hold only ICE detainees.
It is worth noting that DHS OIG released a management alert on the Theo Lacy Facility on March 6, 2017 [PDF version]. You may read that report to learn about serious problems unearthed at that facility. Because DHS OIG had already addressed its findings at the Theo Lacy Facility in detail, this new report focused only on its findings at the other five facilities. Accordingly, this is why we will refer to “five facilities” inspected instead of “six” for the rest of the article.
At each of the six facilities, DHS OIG examined the following:
Medical units;
Medical modular housing;
Kitchen, including food preparation, food storage, and equipment cleaning areas;
Intake and outtake processing areas;
Special Management Units (segregation); and
Modular housing units, including individual cells.
In addition, the DHS OIG “analyzed grievance procedures and evaluated staff-detainee communication practices.”
DHS OIG FINDINGS
On page 3 of the report, DHS OIG set forth its findings. Of the five facilities inspected, DHS OIG stated that only the Laredo Processing Center modeled quality operations. DHS OIG “identified significant issues at the four other facilities.” In the foregoing subsections, we will examine some of the problems found at these four facilities (note, some of the facilities exhibited some of the problems but not others).
INTAKE ISSUES (PAGES 2-3)
First, DHS OIG identified intake issues at several facilities. It explained that, under ICE policy, incoming detainees are supposed to be classified according to their crimes. Based on “verifiable and documented information,” a detainee may be classified as high- or low-risk. The purpose of this classification system is to separate high- and low-risk detainees in the facility. 
DHS OIG found that the Stewart Detention Center had misclassified incoming detainees with high-risk criminal convictions as low-risk, thus placing them with low-risk detainees. These errors were due to staff at the facility assigning some incoming detainees without having received their criminal history reports.
DHS OIG also found that Stewart Detention Center, a male-only facility, did not have enough male personnel to pat down detainees. The staff attempted to compensate by using alternative measures, “such as a magnetometer wand.” However, DHS OIG noted that these alternative measures would not suffice for identifying non-metallic items, drugs, or other contraband.
DHS OIG found that the Santa Ana City Jail had a policy of performing strip searches on all incoming detainees. Furthermore, the staff did not document the strip searches in detainee files. DHS OIG noted two concerns. First, a uniform strip search policy for all detainees contravenes ICE policy, which permits strip searches only in limited cases where there is “reasonable suspicion” based on “specific and articulable facts that would lead a reasonable officer to believe that a specific detainee is in possession of contraband.” Second, because the staff did not document the strip searches, there is no way to determine which searches were justified based on standing ICE policy.
LANGUAGE BARRIERS (PAGES 3-5)
DHS OIG encountered several failures in providing language assistance to non-English speaking detainees at facilities it visited.
First, under ICE policy, detainees are supposed to receive the ICE National Detainee Handbook and a local handbook for the facility. At three of the four problem facilities, DHS OIG found that detainees were not always provided with handbooks in a language they could understand. These handbooks contain important information, “such as the grievance system, services and programs, medical care, and access to legal counsel.” 
DHS OIG noted that this interpretation failure “could prevent detainees from fully comprehending basic facility rules and procedures.”DHS OIG noted that language barriers at the procedures also prevented detainees from understanding medical staff. It found that medical staff did not always use language translation services when dealing with detainees who did not speak English. Furthermore, “[s]ome medical consent forms were not always available in Spanish, and staff did not always explain the English forms to non-English speaking detainees.”
GRIEVANCE SYSTEM (PAGE 5)
The ICE has procedures in place for detainees to file formal grievances. The DHS OIG explained that the resolution of grievances “depends on facility staff properly handling and addressing grievances without deterrents…” Unfortunately, DHS OIG identified deterrents at several of the facilities it inspected. Some detainees interviewed by DHS OIG “reported that staff obstructed or delayed their grievances or intimidated them, through fear of retaliation, into not complaining.”
DHS OIG provided a couple of specific examples of issues it identified. At the Stewart Detention Center, it “found an inconsistent and insufficiently documented grievance resolution process.” This made it difficult, if not impossible in some cases, to ascertain if grievances had actually been investigated and whether they had been properly resolved.
DHS OIG explained that detainees are supposed to have access to telephones to make free calls to the DHS OIG. However, the Otero County Processing Center had non-working telephones in the detainee processing areas. When investigators at the Stewart Detention Center tried to call the DHS OIG Hotline, they “received a message that the number was restricted.”
IMPROPER TREATMENT OF DETAINEES (PAGE 6)
In general, detainees at the Laredo Processing Center “were generally positive about staff treating them with respect.” However, detainees at the other four facilities “alleged poor treatment…”
DHS OIG was able to corroborate detainee complaints at the Santa Ana City Jail concerning an incident when a guard yelled at detainees for several minutes and threatened to lock the detainees down. Several detainees at the Stewart Detention Center “reported that staff sometimes interrupted or delayed Muslim prayer times.”
POTENTIAL MISUSE OF SEGREGATION (PAGE 6-7)
Staff at detention facilities may separate detainees from the general population and place them in either disciplinary segregation or administrative segregation. This may be done for a number of reasons, “including violations of facility rules, risk of violence, or to protect them from other detainees.” DHS OIG reported that most, but not all, of the cases it examined involved administrative segregation.
DHS OIG found that the Otero County Processing Center, Stewart Detention Center, and Santa Ana Jail had violated policies regarding segregation and lock-down of detainees. Among the issues, DHS OIG found that staff at these facilities “did not always tell detainees why they were being segregated, nor did they always communicate detainees' rights in writing or provide appeal forms for those put in punitive lock-down or segregation.” The DHS OIG found that these facilities, in some instances, put detainees in segregation or lock-down “without adequate documentation in the detainee's file to justify the disciplinary action.” In one troubling report, it found that a detainee was locked down in his cell for multiple days “for sharing coffee with another detainee.” Several detainees were held in administrative segregation without required periodic reviews.
Finally, DHS OIG found that documentation of daily medical visits and meal records for detainees held in segregation was often missing or incomplete.
While DHS OIG noted that some of these issues may be the result of mere inadequate documentation, it added that “they could also indicate more serious problems with potential misuse of segregation.”
MEDICAL CARE ISSUES (PAGE 7)
DHS OIG noted that all five facilities provided health care services, as required. However, “some detainees at the Santa Ana City Jail and the Stewart Detention Center reported long waits for the provision of medical care, including instances of detainees with painful conditions…” Furthermore, DHS OIG found that “not all medical requests detainees claimed they submitted or the outcomes were documented in detainee files or facility medical files.”
LACK OF CLEANLINESS AND LIMITED HYGIENIC SUPPLIES (PAGE 7)
DHS OIG found that detainee bathrooms at the Otero County Processing Center and Stewart Detention Center were in poor condition. Additionally, “detainees reported water leaks in some housing areas.”
Detainees at the Hudson County Jail and Stewart Detention Center complained about the lack of basic hygienic supplies, “such as toilet paper, shampoo, soap, lotion, and toothpaste…” One detainee stated that when they used up their internal supply of certain personal items, they were advised to purchase more at the facility commissary. Under ICE policy, personal hygiene items are required to be replenished as needed.
POTENTIALLY UNSAFE FOOD HANDLING (PAGE 8)
The DHS OIG identified several problems with food handling and food safety at four of the facilities. Among these problems, they “observed spoiled, wilted, and moldy produce and other food in kitchen refrigerators, as well as food past its expiration date.”
RECOMMENDATIONS AND ICE RESPONSE (PAGE 8-14)
DHS OIG recommended that ICE “ensure that [ERO] field offices that oversee the detention facilities covered in this report develop a process for ICE field offices to conduct specific reviews of these areas of operations: detainee classification, use of language services, use of segregation and disciplinary actions, compliance with grievance procedures, and detainee care including facility conditions.”
ICE concurred with the report recommendations. DHS OIG found that ICE's response “addresses the intent of the recommendation.” ICE has stated that it has begun taking corrective actions. DHS OIG will leave the recommendation open “until ICE provides evidence it has integrated special assessments of the operational areas identified as concerns.”
In an interesting note, ICE discontinued its contract with the Santa Ana Jail in early 2017. Accordingly, detainees are no longer housed at the Santa Ana Jail.
CONCLUSION
ICE has the responsibility of protecting the rights of detainees and ensuring that they are treated humanely when they are in immigration detention. The report described troubling examples of violations of detainee rights and inhumane treatment at four of five facilities examined. It is certainly encouraging to see that ICE responded favorably to the report's findings and recommendations. However, it will be important to monitor going forward whether ICE, and ERO specifically, take the necessary corrective action to ensure that the mistreatment of detainees found at several of their detention facilities is not repeated or on-going elsewhere.
