How to Survive a DUI Arrest Without Celebrity Status

Unfortunately, in North Carolina the crime of driving while impaired is taken much more seriously than where these celebrities live. The penalty will be longer than three hours in jail, the punishment more severe than a slap on the wrist while your PR team spins the scandal into yesteryear. In real life--in North Carolina especially--the government spends a lot of time and money catching and prosecuting drunk drivers. The laws are complicated and the punishment is among the toughest in the country.��

All a police officer needs to stop your vehicle is reasonable suspicion that a crime has been committed. Speeding, crossing the yellow line, failing to stop fully at a stop sign, brake lights out—these are just a few of a number of minor reasons a police officer can pull you over. You can even be stopped when you have done nothing wrong at a pre-arranged license checkpoint. 

Once you have been stopped by a police officer you may be asked to perform what is called a field sobriety test. You could be asked to follow a moving object with your eyes only, or perform the heel to toe walking test, or the balance on one leg test. These tests are difficult to do when sober but almost impossible to pass if you have been drinking. You are not required do any of these tests and if you have been drinking you may want to respectfully refuse to participate. 

You will also be asked to take a Breathalyzer test. You DON"T have to take the Breathalyzer test either. However, refusing to do so can be used against you in a trial and will also lead to your license being revoked even if you win the trial. Remember, if you blow a .08 or higher you are presumed to be impaired. 

If you are convicted, the judge must look at factors such as these to determine if you should be put in jail or given probation:

1. You have a prior DWI conviction in this or any other State in the last 7 years 

2. You had someone under the age of 18 in the car at the time of your arrest 

If any of the above factors apply you must serve an active jail sentence even if it's your first driving while impaired conviction. 

Your lawyer will want to provide Mitigating Factors to the Court to try and offset any Grossly Aggravating or Aggravating Factors. Even if you don’t go to jail, you will have to perform community service, pay fines and costs. Your license will be suspended for one year. You may be able to get a limited privilege to allow you to drive to and from work. 

Like Justin Bieber, for those who lack legal status, a driving while impaired conviction can also be detrimental to your chances of getting legal status. A conviction could land you in immigration court fighting to keep from being deported from this country. 

The best advice I can give you is DON’T DRINK AND DRIVE. However, if you are charged with driving while impaired you should see an attorney immediately so that any defenses can be explored. You should look for an attorney who is experienced in defending drunk driving cases. The consequences are too high for you to wait. Take action now.
