I don’t talk about real world issues often but like…
I don’t like tiktok but I still think banning it in the us is a terrible idea. Because it gives the government the power to ban other social media sites that they claim are a “national security threat”. And with how the bill seems to be worded that seems to be exactly what their going to do if this bill does get passed in 9 months.

Welcome to my latest summary of recent ecommerce news, resources & studies including search, analytics, content marketing, social media & Etsy! This covers articles, podcasts, videos and infographics I came across since the late July report, although some may be older than that.
Please note I am taking the next week off, starting tomorrow (Aug. 19), so I might be a little slow in replying to any comments. 
TOP NEWS & ARTICLES 
USPS has become the focus of investigations due to reported mail slowdowns. Some small businesses who rely on USPS to deliver are suffering. “The longer the policy has been in effect, the worse the backlog gets.” As of today (August 18), the postmaster says they will rollback the changes until after the election in November. This is a rapidly-moving story in part due to the push for voting by mail, and should concern anyone who ships to US customers using regular mail (as opposed to couriers). Meanwhile, they plan to temporarily raise commercial rates during the holiday shopping season, but retail rates will not change. 
Ecommerce sales are still up year over year. "Before Covid-19 hit the US in March, e-commerce made up roughly 12% of retail sales in the country. That figure grew as states issued shelter-in-place orders that shut stores and kept shoppers at home, creating tailwinds for a company like Amazon. But even as states have begun to reopen, e-commerce has remained elevated, according to Bank of America data."..."The Economist used Google search traffic for hints of how lifestyles are changing and found users are still searching terms related to cooking, crafts, and exercise above pre-pandemic rates. There has been a noticeable spike in interest around such products as gardening supplies, baking flour, and Crocs." The UK is still seeing a good increase despite the ease in reduction in lockdown restrictions. The growth is slowing a bit in the US, though. 
Half of US small businesses fail in the first year (and other stats on small business). 
It’s been second quarter report season, covering company performance from April to June 2020.  Here are results for major companies involved in ecommerce in some way (comparisons are year-over-year):
Amazon US: sales up 40%
eBay: sales up 26%
Etsy: sales up $146% [click the link to read my summary]
Facebook: revenue up 11%
Google: revenue down 2%
PayPal: revenue up 22%
Pinterest: revenue up 4%; active users up 39%
Shopify: revenue up 97%
Walmart [2nd quarter ran May to July]: ecommerce sales up 97%, same-store sales up 9.3%
ETSY NEWS 
Admin are now posting a monthly update thread, in case you fear you have missed anything. This is how they chose to announce that non-seller accounts can no longer post in the forum. Since those account owners can still read the forum, that doesn’t mean you can call out your customers now. 
Sadly, there wasn’t much media coverage of Etsy’s nearly-annual billing screw up, but this one did get some attention. 
Etsy continues to get good media coverage for masks, including masks for your dolls. They also apparently got a decent slice of Google ranking for various pandemic-related searches in May [scroll down to the “Protection and Prevention” section]. 
However, Etsy is getting some bad press (along with Amazon), for allowing QAnon merchandise, because “the FBI has warned of the movement's potential to incite domestic terrorism.” Etsy replied to a request for comment saying that “that product listings associated with certain movements are allowed as long as they don't violate the company's seller or prohibited items policies, which ban items that promote hate or that could incite violence. The company said it is continually reviewing items on the site and could remove items in the future if they're found to violate Etsy's policies.”
More search trends on Etsy, this time kids’ items. I love how they think tie-dye was a ‘90s thing and not a ‘60-70s thing LOL. “a 318% increase in searches for kids tie-dye items...71% increase in searches for dinosaur wall art or decor*, and a 37% increase in searches for school of fish items….we’ve seen kid-friendly crafts spike in popularity, with searches for DIY kits for kids up 336%.”
Also, the holiday trends guide is out. “With the holidays approaching, and most shopping happening online, more shoppers will be looking for your help to make the season feel special.” The report is lengthy, covering Halloween to New Year’s, and most listing categories, while pointing out the possible pandemic changes to the usual trends. There is also an accompanying podcast with transcript. 
Speaking of the holiday season, here are Etsy’s tips for shops. Note that it is a bit late, as businesses need to have their holiday items posted no later than July if they want to be eligible for most fall media coverage. Almost every point refers to an Etsy tool or feature, some of them costing you money, so use this as a very broad guideline & be careful to read between the lines. 
They are still rolling out Etsy Payments to more countries: Morocco & Israel are the most recent. Note that Etsy Payments is not yet compulsory in these new countries. 
Etsy Ads once again has graphs. Do you find them useful? (I haven’t run ads at all this year, so I can’t check.)
Sendle is the latest shipping company to have a label integration with Etsy shops. 
Etsy asked US sellers to lobby their reps for more support for small business and other initiatives in the pandemic aid package.
SEO: GOOGLE & OTHER SEARCH ENGINES 
Google has stated that content on tabs is indexed and contributes to ranking as if it were on the page instead, but yet another test demonstrates that tabs may limit you. 
Due to the pandemic, Google has delayed finalizing mobile-first indexing until March 2021. (They originally announced it would be finished this September.) That means you have more time to update your website’s mobile version, ideally with responsive design. 
Site speed does matter to SEO, and Google is now asking some searchers how fast certain sites loaded for them. 
User comments on your products, blog posts and website can help you improve your SEO. The article suggests ways of getting that feedback, and ways to use it. [I’ve even had buyers give me new keywords to describe my items, in their messages and reviews.]
Getting links back to your site is important to SEO, but don’t annoy people while doing it. [sort of humour & sort of a rant, but does give some useful background on why backlinks matter.] Internal links also matter. 
There are some special tricks for food/recipe SEO, including structured data and even a WordPress plugin. 
Another WordPress plugin: submit any new or updated pages to Bing to be automatically re/indexed.
Do your keyword research before setting up your website’s sections and sub-sections, as they should serve the buyer experience, not your perception of it. Same with choosing which pages link to each other. 
SEOs are still trying to work out what happened with recent Google algorithm changes. Search Engine Journal claims that the May update was at least in part about demoting sites that had out-of-date or inaccurate information, so they suggest getting rid of the bad content on your site, or at least updating it. “Content pruning” has some advocates, but I wouldn’t worry about investing tons of time in this unless you have tons of time to spend. Just get rid of the blog posts that were wildly wrong, and the out-of-date filler. If you have a lot of sold out products, redirect those to relevant active pages. 
Meanwhile, a “glitch” on August 10 led people to think there was a massive Google algorithm update happening, but it all got fixed in less than a day.

(CONTENT) MARKETING & SOCIAL MEDIA (includes blogging & emails) 
It’s tough to get started in social media if you don’t know the terminology, so here’s a list of the basic definitions you can consult if you get lost when reading.  
Don’t know how to blog? There are formulas you can use; here are eight options, nicely laid out, with downloadable templates. Don’t forget to figure out what your audience wants to read. And make sure you avoid these common blogging mistakes. 
If you have an email list but do not know how to take advantage of all the bells & whistles the companies (MailChimp, Constant Contact etc.) offer you, here are 4 ways to segment your lists. You can then send different offers or newsletters to different segments.

By the time you read this, the TikTok mess will likely have changed again, but here is an article on Trump’s order to prohibit US companies from doing business with TikTok owner ByteDance if the platform is not sold by September 15. 
Instagram has released its TikTok challenger, Reels, in more countries. 
Instagram is now offering a fundraising option, although it is a slow launch with some beta testing in the US, UK & Ireland to start.

Pinterest says that searches around self-care & wellness have spiked during the pandemic lockdowns. “Pinterest has recently seen the highest searches ever around mental wellness ideas including meditation (+44%), gratitude (+60%) and positivity (+42%) that jumped from February to May….Pinterest says that searches for ‘starting a new business’ are up 35% on average, as are searches for ‘future life goals’ (2x), ‘life bucket list’ (+65%), ‘family goals future’ (+30%) and ‘future house goals’ (+78%).” There were also some searches clearly about spending more time at home: “Productive morning routine (up 6x), Exercise routine at home (up 12x), Self care night routine (up 7x)”

Spotify is now doing “video podcasts”. Apparently a lot of their podcasters already did a video version of the Spotify podcasts, but had to publish it elsewhere up until now. 
Twitter now admits it is considering offering subscriptions to shore up its revenue numbers. “Shares of Twitter rose 4% in early trading Thursday following the earnings results....Twitter's growth plans are under close scrutiny as many advertisers pull back due to the pandemic. On Thursday, Twitter reported second-quarter ad revenues of $562 million, a 23% decrease compared to the same quarter a year ago. The company has also been hit by advertisers participating in an ad boycott of social media, linked to the nationwide racial justice protests.” Also, the recent hack is not helping them. 
That said, it is still possible to market using Twitter, and here are some of the basics. 
YouTube is no longer sending email updates when a channel you follow posts new content. 
ONLINE ADVERTISING (SEARCH ENGINES, SOCIAL MEDIA, & OTHERS) 
Ad spend has increased again as lockdowns end, in some cases beating last year by a decent margin. 
The Buy on Google program is ending its commission fees. Participants will also be able to integrate their PayPal and/or Shopify payment options. As often is the case, they are starting with the US first, but plan on rolling it out to more countries in the future. There are more details here, and a review here (with some of the drawbacks). 
Google Product Ads are now showing the item’s “material” on the listing card (before you click). If you are doing your own feed for your website, you may have the ability to add the attributes needed for the details to show up.  
If you find Google Ads too expensive, consider buying search ads on Bing. 
eBay is experimenting with showing ads mixed in with unpaid listings; placement would depend on the same algorithm.

STATS, DATA, OTHER TRACKING 
Bing has launched a new version of Webmaster Tools. 
There are ways to reduce the amount of traffic that Google Analytics designates as “direct traffic”; here are 15 of them. 
Currently in closed beta testing, the Google Search Console now has an “Insights” function, just like Google Analytics. I’ve found the GA one useful for telling me things I don’t always look at, so crossing my fingers that they release this to everyone soon. 
 ECOMMERCE NEWS, IDEAS, TRENDS 
Shopify helped many businesses stay open during pandemic lockdowns, giving it the boost to start competing with the likes of Amazon in ecommerce. “Shopify merchants that had previously or entirely relied on brick-and-mortar sales would later report they were able revive nearly 95% of that revenue online.”
eBay started rolling out its Managed Payments system to more sellers worldwide on July 20th. Things seem to be going slowly, with some confusion. 
But eBay is also having a 25th anniversary party for sellers on September 25th; don’t forget to register. 
Walmart is still delaying its new subscription model to challenge Amazon Prime, Walmart+. 
Amazon in the UK has launched a “Face mask store” part of the website. I haven’t seen this on other versions of Amazon. They’ve also increased some fees for some UK sellers, based on the new UK digital tax. And they are launching a site & presence in Sweden. 
The Competition Bureau of Canada has launched an investigation of Amazon’s treatment of third-party sellers. “The bureau is asking any person or business that has conducted sales via Amazon.ca to contact them if they have any insights into the issues it is investigating.“
Amazon Prime Day has been postponed to later dates this year, starting with India on August 6-7. The remaining countries will apparently be announced soon. 
If you use WooCommerce, here are a bunch of free plugins, with brief descriptions. 
BUSINESS & CONSUMER STUDIES, STATS & REPORTS; SOCIOLOGY & PSYCHOLOGY, CUSTOMER SERVICE 
Buyers do not all make purchase decisions the same way; Google uses its massive collection of data and some new studies to provide some examples. “Worldwide, search interest for “best” has far outpaced search interest for “cheap.”
It’s cheaper to keep repeat buyers than it is to find new ones; here are 16 ways to do that. One of my favourites is “���proactively providing information on how to avoid problems or get more out of your product” creates a 32% average lift to repurchase or recommend.”
It seems that researchers can never produce enough marketing guides on Gen Z and millennials. 
MISCELLANEOUS (including humour) 
I see a lot of new sellers, and some older sellers, confused about the idea of a business plan. HubSpot not only explains them, but also provides a downloadable template. 
If you are thinking of changing careers, or just want to add skills to better run your current business, Google has many different courses, some of which they offer for free. 
There are ways you can increase your productivity without (usually) working more hours. “A study published by John Pencavel of Standford University found that how much employees get done takes a sharp drop after 50 hours of work in a week, and even more drastically after 55 hours. The study found that employees working 70 hours per week actually produce nothing more in those extra 15 hours...taking a power nap in the middle of the day can help you process new information and even learn new skills.”

Pornhub’s Content Purge Has Left Fetish Creators Wondering What’s Next
Before the purge that disappeared more than 75 percent of content on the platform, Pornhub hosted a lot of videos and photos that weren’t humans having sex. There were full-length movies, memes, and video game playthroughs that you might see on a non-adult site like Twitch, but there was also a ton of animation, 3D renderings, audio erotica, music videos, fanfic from furries and bronies, and stop-motion animation like LEGO minifigs fucking. 
Pornhub became a dumping ground and safe harbor for a lot of stuff, and a lot of these creators didn't necessarily want to upload a photo of themselves to a huge porn corporation's database in order to get verified. They were just throwing things on the site for fun, to share with others in their respective communities, and the wider world. Compared to a site like Milovana (an adult message board and the birthplace of Cock Hero, videos of which are mostly gone from Pornhub now) or the furry fan art forum e621, Pornhub was a way to reach a more mainstream audience. With last week’s action, a lot of that stuff is now gone.
For victims of abusive imagery and non-consensual porn, as well as anyone who's had to deal filing takedown requests for pirated content uploaded to Pornhub, the removal of unverified content is a positive: between Pornhub's new policy for only allowing content partners and performers in the model program to upload and download, and the retroactive suspension of all this content pending review, the platform seems to be making long-overdue changes that sex workers and victim advocates alike have asked for. But by applying a blanket solution to a complex problem, it's caught small, independent creators from niche communities in its net. 
Several creators told me that Pornhub's damage-control scramble has created issues for verified users, locked many unverified creators out of their own content, and left many more wondering whether there's even a future for indie and fetish works on the site.
“It was a betrayal”
In a month when sex on the internet is being attacked from all sides—from Instagram's new terms of service, to TikTok kicking sex workers off the platform, to payment processors leaving Pornhub—some creators are concerned that losing one of the most popular porn sites in the world as a platform is another blow against fetish and outside-the-mainstream content on the internet as a whole. 
For a lot of creators, Pornhub's melting pot was a source of inspiration for artists, Lifty and Sylox, hosts of the Furry Frequencies podcast, told me in an email. "Many of the videos that were uploaded onto Pornhub from the furry community were sexual videos of furries partaking in sexual acts in fursuit," they said—which could include videos of furries in fullsuit with “strategically-placed holes” performing solo or with one or more partners. "Some furries perform with just their fursuit head, handpaws, and feetpaws to provide better nude content. An unverified, but significant amount of this content catered to specific fetishes of the furry community, such as feet fetishism or watersports." 
"Furries won't abandon PornHub immediately," Lifty and Sylox said, noting that more creators will likely migrate to Onlyfans or communities like Furaffinity to post content. "Changes like this tend to take time before the effects can be measured… PornHub's status as a repository for one-stop furry porn content will eventually diminish significantly." 
It's not just illustrators and furries who have lost Pornhub as a platform in the last week. Audio erotica creator Goddess By Night told me that she lost all of her content—about 40 videos. She's been making audio erotica for five years, and in the last two she'd made a business out of it. She makes Gentle Female Dominant and Dominant Mommy-themed stories, as well as Futanari role play and other kink-related fantasies.
"Most of my work is a niche within the adult entertainment industry, and Pornhub allowed me to reach a broader audience, so it’s a pretty significant loss," she said. "However, my community has been incredibly supportive and intend to follow me to the next platform(s) I choose. I don’t plan on returning to Pornhub because of this. It was a betrayal, especially to the loads of creators they explicitly welcomed after Tumblr’s ban two years ago. I know some creators who lost work that they may never get back because Pornhub didn’t offer a grace period."
Each of the creators I talked to, whether they were verified or unverified, said that they weren't given any warning before Pornhub's content suspension took place. Pornhub used the word "suspension," not "deletion," and told Motherboard at the time of the suspension announcement that this meant content would be "removed pending verification and review." 
Creators whose content was removed saw a message in place of their uploads that explained the video was "flagged for verification" and invited them to apply for the Model Program or Content Partner Program in order to re-enable the videos, or wait for the new verification process to start in 2021.

They were locked out of their own content at that point and were unable to even download it from the platform.
When Tumblr removed all NSFW content from its platform in December 2018—similarly for allegations it hosted child sexual abuse imagery, but also to appease Apple—the social media platform gave creators about two weeks of notice to get their stuff off the site. Pornhub's announcement came at 7 a.m. EST on a Monday and went into effect immediately. By the time most people saw the news, the suspensions were underway, and more than 10 million uploads were gone by 9 a.m.
This is especially bitter news for creators who, in 2018, took Pornhub up on its invitation to move to the platform from Tumblr.

"Amusingly [Pornhub was] very happy to take advantage of the Tumblr refugees back when all that went down, inviting us to upload all our galleries there," adult content illustrator IzzyBSides told me in a Twitter message. "I think most of us on Twitter know we're living on borrowed time, people have backup accounts set up and occasionally plug them to their followers letting them know to follow it in case their main account randomly disappears overnight."
Because the mass suspensions were meant as a broad solution to get unlawful, abusive content on the site under control, allowing users to download their content would miss the point of stopping the spread of any abusive imagery. But the move also meant that a lot of content that wasn’t abusive and fell well within Pornhub's terms of service was removed in the process. People didn't have the chance to choose whether they wanted to pack their bags and go elsewhere. If they want to recover their own content, they'll have to play by Pornhub's verification rules, which have yet to be announced and won't start until sometime early next year.
One animator who asked to remain anonymous told me that they lost about 20 videos, "including story animations, which I loved very much …This was sad for me as the videos were deleted without warning," they said, but added that they luckily had a backup of their videos saved to their hard drives. "However, I didn't have any income from Pornhub, so it's okay, the videos are saved and I'll just move them to another site." 
That illustrator wasn't verified, but even being a verified user didn't save some people from the purge. Pornhub's policy changes were intended to skip over verified accounts, but some users still saw their verified content taken down.
“Sex workers are under attack everywhere”
Another confusing aspect of Pornhub's cleaning spree is the effect it has had on verified creators and performers. Many have reported on Twitter that some of their verified content has been disappeared, seemingly at random, even while other uploads have stayed online. Others in the comments of Pornhub's own verification policy page say that they were verified, but now they aren't. From the outside, there seems to be no consistent reasoning for this. 
Before the policy changes, there were three types of verification, according to Pornhub: Content partners, users in the model program, and verified users. The last category is now gone, and only uploads by models and content partners remain. The users reporting verification issues were likely in that last category—verified based on the old standards Pornhub used, which involved sending Pornhub a selfie with your face and holding up a sheet of paper with your name written on it. Those users are all now unverified. But inconsistencies remain.
Riley Cyriis, a performer who's been verified on Pornhub for more than a year, told me that most of her free videos and around 40 of 120 paid videos were removed, along with 20 videos she had set to private, only viewable by her. 
"My best guess would be certain tags, like 'teen' or 'daddy,' but it's really just a guess," she said. "The majority of flagged videos were my most successful ones ranging from 200k to 700k views, so maybe it's just how they came up? My profile is pretty obviously made by a real person and I listed my age publicly."
She wasn't using Pornhub as a main income source (although many performers do), so she's planning to focus more on other platforms like Onlyfans and Manyvids. 
Pornhub has said that it will restart the verification with new requirements in 2021. But the gap is a long time to wait if you're losing an audience and relied on the site for income. Many performers have already lost significant income due to Mastercard and Visa's decision to drop Pornhub. Performer Mary Moody said in a video about the payment processing news that she was making enough money from Modelhub to cover rent each month.   
And the verification process, which still hasn't been clarified publicly by Pornhub, could bring up new issues for anyone who wants to get their content back. IzzyBSides said that they'd received verification rejections before Pornhub's content purge, because their avatar—a fire sprite—obviously doesn't match their real-life face. The reason Pornhub gave for their rejection the last time, before the content suspensions, was that their avatar didn't match their verification photo. "We need to see your face to confirm," Pornhub's customer service email to them said. According to Pornhub, this method of verification is now outdated.
It's unclear how verification will work in the future, but Pornhub has said that identification of some kind will be part of the process. There are obviously many reasons that not everyone would want to use their real face as their avatar on a porn website.
"I'm not sure how I'm supposed to get verified with those sorts of requirements," IzzyBSides said, adding that performers who wear masks or keep their faces cropped out of videos would be excluded from verification on these terms. "It would force anyone experimenting out of the closet."
I asked performer Dylan Thomas how a verification system with even more strict requirements for identity could impact trans, non-binary, and gender non-conforming content creators and performers. He said Pornhub could avoid excluding these groups by consulting with, and hiring, them to help create the new system. 
"Some of us with intersectional experience in both creative strategy, the digital space and sex work would like nothing more than to serve our community and get everyone back online, generating income and having an enjoyable, safe and sexy time," he said. 
How Pornhub’s new verification policies and process will unfold in practice is yet to be seen, but by including the voices of people who use the site, it could avoid future mistakes—just as it could have avoided this month’s backlash—and listen to the sex workers and content creators who've been asking for things to change for a long time.
"Pornhub was blatant about their disregard to what appeared on the site. But sex workers are under attack everywhere," Cyriis said. "Aside from the payout issues caused by Visa/MC, YouTubers and celebrities are flicking onto our platforms and basically doing whatever they want with no real financial repercussions. The consequences fall squarely on the shoulders of sex workers who built these platforms."

The new order is the latest in Trump’s escalating crackdown on the Chinese-owned app over alleged national security concerns.
President Trump issued an executive order on Thursday night that will effectively ban any US company or individual from making transactions with ByteDance, the Chinese parent company of the TikTok app, after 45 days.
While this conditional ban on TikTok’s US business operations will likely face serious legal challenges, and it’s unclear how immediately enforceable it is, the order creates a serious challenge for TikTok, a wildly popular video streaming app with some 100 million US users.
For months, Trump and other bipartisan politicians have periodically raised concerns about TikTok as a potential national security threat, worrying that the app’s Chinese parent company could censor content in the US or access American users’ sensitive data at the behest of the Chinese Communist Party.
The executive order states that TikTok “automatically captures vast swaths of information from its users,” and that this “threatens to allow the Chinese Communist Party access to Americans’ personal and proprietary information — potentially allowing China to track the locations of Federal employees and contractors, build dossiers of personal information for blackmail, and conduct corporate espionage.”
The company has vehemently denied these accusations, saying repeatedly that it does not share user data with the Chinese government. But reports last year showed a lack of TikTok content about subjects controversial with the Chinese government — such as videos of the Hong Kong protests. These reports have fueled US government suspicions that the company is influenced by the Chinese government, particularly as China has been expanding its surveillance state in recent years and US-China diplomatic relations have become more strained.
Trump has gone back and forth about how he planned to take action on TikTok. As recently as last Friday, he warned of an eminent executive ban on TikTok. On Monday though, Trump seemed to reverse his stance and said in a White House press briefing that instead of banning it, he would allow a US-based company to purchase the app.
“I don’t mind if — whether it is Microsoft or someone else — a big company, a secure company, a very American company, buys it,” said Trump about TikTok. Trump also warned that TikTok will be “out of business in the United States” by September 15 if the company doesn’t reach a deal to sell by then. Now, the executive order has established timeline of 45 days from Thursday (which would be September 20) for the sale to happen before TikTok will no longer be able to conduct business as usual in the US.
Though TikTok, which is owned by the Chinese company ByteDance, is best known as a place where teens share short, often lighthearted musical videos, it has become the center of geopolitical controversy between the US and China over technological power.
But getting rid of an app used by some 100 million Americans isn’t easy, even if you’re the president. According to a New York Times report on Sunday, after Trump’s advisers convinced him that an executive action to ban TikTok would face severe legal and political consequences, Trump decided he would allow the tech giant Microsoft to continue its previous talks to buy the app, which had reportedly been in the works for weeks. Since Microsoft is a US-based company, the idea is that if Microsoft took control, it would ensure all of TikTok’s user data is stored in the US, secure from the potentially prying eyes of the Chinese government. Microsoft CEO Satya Nadella talked to Trump about it over the weekend, according to a Microsoft blog post published on Saturday evening, and has agreed to work out a deal — or not — by September 15.
Here’s a rundown of the recent controversy surrounding TikTok and what’s expected to happen next:
TikTok’s political troubles
TikTok has faced intense political scrutiny for months leading up to Trump’s executive order.
Republicans escalated their attacks on TikTok this summer, with some bipartisan support from Democrats as well. Last Thursday, Sens. Richard Blumenthal (D-CT) and Josh Hawley (R-MO) sent a letter to the Justice Department demanding that the agency open an investigation into TikTok and Zoom over reported violations of “Americans’ civil liberties” and national security concerns about relationships between these companies and China. This followed statements in July from Trump and Secretary of State Mike Pompeo, who both said the Trump administration was considering banning TikTok altogether.
For the past year, it’s been thought that the app has been under government review for national security reasons. Treasury Secretary Steven Mnuchin confirmed this last week, and said he’s expecting the review to conclude soon. The government committee in charge of this review, the Committee on Foreign Investment in the United States (CFIUS), has the power to recommend the president force TikTok to sell to a US company.
Even if Trump can’t enforce a full-on ban, a government decision that forces TikTok’s parent company to sell it off would be a game changer for the social media industry, and would threaten to disrupt the app’s extraordinary popularity. And for established social media giants Facebook and Google, the decision could significantly weaken their fiercest new competitor.
A forced sale of TikTok could have negative consequences beyond the people running TikTok, too. The move threatens to jeopardize the success of an app that’s had a meteoric rise from a relative underdog to one of the most downloaded apps in the world. And since TikTok is one of the only recent social media startups to compete with tech giants like Facebook, weakening TikTok could further concentrate power among a few tech giants in the US.
“While we do not comment on rumors or speculation, we are confident in the long-term success of TikTok,” a spokesperson for TikTok told Recode on Friday, adding the company is “committed to protecting their privacy and safety as we continue working to bring joy to families and meaningful careers to those who create on our platform.”
How a sale would work
You may be asking how Trump can force a company as popular as TikTok to sell itself, or go so far as to try to ban it. The answer is complicated and bureaucratic.
To force a sale, Trump could issue an order for ByteDance to divest from TikTok through CFIUS, an interagency committee that reviews foreign acquisitions and investments in US businesses that can threaten national security. The committee, chaired by Mnuchin, has the power to block or reverse mergers and acquisitions involving US and foreign companies.
Increasingly, the agency has been exercising its authority over foreign-owned tech companies operating in the US. Last year, CFIUS helped block one of the biggest deals in tech history, after Trump followed its recommendations to stop Singapore-based Broadcom from acquiring the US semiconductor company Qualcomm. The committee also forced Chinese owners to divest from the dating app Grindr and the health startup PatientsLikeMe.
But as Brookings Institution fellow Geoffrey Gertz has written, tech companies weren’t always the target of CFIUS. In the past, the committee “tended to focus on companies with military or intelligence connections,” but more recently, personal data and high-tech intellectual property have become a bigger focus for the committee.
Last year, CFIUS started investigating ByteDance, which had purchased the Chinese-owned lip-sync video platform Musical.ly in 2017 and then rebranded and launched a similar app in the US under the name TikTok. When that investigation comes to a close, the committee’s recommendations will reportedly lead to Trump’s order for ByteDance to sell TikTok or divest its US operations.
It’s unclear how CFIUS would enforce a potential unwinding of ByteDance and TikTok, but last year, the committee issued a $1 million fine to an undisclosed company for not following through on a mitigation agreement, its first penalty of that kind. It could also fine TikTok — or Trump could just continue to dangle the threat of banning TikTok altogether, no matter how legally or politically contentious that would be.
In a press briefing on Monday, Trump said that whoever ends up owning TikTok should pay the Treasury department of the US government a “substantial amount of money” as part of the deal. As some have pointed out, including Axios’s Dan Primack, Trump’s comments could be “skating very close to announcing extortion.” It’s not immediately clear how Trump would try to ensure the US government gets a cut of the sale or whether it’s even legal to do that.
What comes next
If Microsoft or another major US company does purchase TikTok, it’s likely that TikTok as we know it would remain largely unchanged.
TikTok is a valuable brand in a lucrative industry with a massive, devoted user base — so for Microsoft, buying TikTok would be an opportunity to seriously compete with other major tech companies like Facebook and Google in the social media space.
Microsoft also has experience when it comes to purchasing already successful companies and allowing them to retain their independence — as it did when it acquired the platform for software developers, GitHub, in 2018, and the video game Minecraft in 2014.
Depending on how Microsoft chooses to run TikTok — if it acquires it — the app could continue to grow, and with the backing of a major US tech company, it might more seriously take on other social media companies, including Facebook. Microsoft isn’t the only potential buyer — other firms could try to buy TikTok or share ownership. Reportedly, Microsoft may invite outside investors to join them in the deal, according to the Wall Street Journal.
It’s too soon to say what impact a sale would have on the app’s popularity and growth. But in the meantime, there are plenty of Clippy jokes to make.
On Monday, a spokesperson for TikTok told Recode in a statement that the company is “committed to continuing to bring joy to families and meaningful careers to those who create on our platform as we build TikTok for the long term. TikTok will be here for many years to come.”
