Don’t get distracted. Don’t get overwhelmed. Don’t get paralyzed and pulled into the chaos that President Trump and his allies are purposely creating with the volume and speed of executive orders; the effort to dismantle the federal government; the performative attacks on immigrants, transgender people and the very concept of diversity itself; the demands that other countries accept Americans as their new overlords; and the dizzying sense that the White House could do or say anything at any moment. All of this is intended to keep the country on its back heel so President Trump can blaze ahead in his drive for maximum executive power, so no one can stop the audacious, ill-conceived and frequently illegal agenda being advanced by his administration. For goodness sake, don’t tune out.
The actions of this presidency need to be tracked, and when they cross moral or legal lines, they need to be challenged, boldly and thoughtfully, with the confidence that the nation’s system of checks and balances will prove up to the task. There are reasons for concern on that front, of course. The Republican-led Congress has so far abdicated its role as a coequal branch of government, from allowing its laws and spending directives to be systematically cast aside to fearfully assenting to the president stocking his cabinet with erratic, unqualified loyalists. Much of civil society — from the business community, to higher education, to parts of the corporate media — has been disturbingly quiet, even acquiescent.
But there are encouraging signs as well. The courts, the most important check on a president who aims to expand his legally authorized powers and remove any guardrails, so far have held, blocking a number of Mr. Trump’s initiatives. States have also taken action, with several Democratic attorneys general suing over Mr. Trump’s attempts to freeze federal grant funding and end birthright citizenship and vowing to fight Elon Musk’s team’s access to federal payment systems containing personal information. State or local officials are also defending their laws in the face of federal immigration raids and fighting Mr. Trump’s executive order barring gender-affirming medical care for transgender children. And independent-minded journalism organizations have continued excellent reporting on the fire hose of excesses of these early days, bringing essential information to the public.
None of this is to say that Mr. Trump shouldn’t have the opportunity to govern. Seventy-seven million Americans cast ballots to put Mr. Trump back in the White House, and the Republican Party, now fully remade in service of the MAGA movement, holds majorities in both houses of Congress. Elections, it is often noted, have consequences. But is this unconstitutional overhaul of the American government — far more sweeping, haphazard and cruel than anything he campaigned on — really what those voters signed up for? To put America’s system of checks and balances, its alliances and its national security at risk? Because, beyond the bluster, that is what Mr. Trump, Mr. Musk and their supporters are doing.
Three weeks into the second Trump term, here are a handful of the places where Americans can’t afford to turn away:
Elon Musk’s Executive Takeover. The problem is not that Mr. Musk is unelected, it’s that he is breaking the law. Not even a full-time government employee, he is trying to unilaterally shut down or dismantle entire federal agencies and departments, ignoring congressional mandates — this is prohibited by the Constitution. He and his team are behind the announced buyout offers to millions of civil servants — including the entire C.I.A. work force— and have effectively forced out top officials whom he has no power to fire. He is on a mission to rampage through the government’s confidential payment systems with an anarchist’s glee, deciding on his own which aspects of federal spending are legitimate, and substituting his instinctual embrace of conspiracy theories for any effort to understand the government functions he’s undermining.Both the president and Mr. Musk seem to relish that most of their actions are plainly illegal, daring the courts to step in and stop them, on the theory that these laws are flawed to begin with. At the same time, you have the richest man in the world leading this effort, still holding interests in his private companies, which do billions of dollars in business with and are regulated by the federal government. It’s a level of conflict of interest unlike anything we’ve seen in the modern era.
The Administration vs. Public Officials (a.k.a. Trump’s Enemies). Along with terminating more than a dozen members of the U.S. Attorneys Office in Washington who’d worked on cases involving the Jan. 6, 2021, riot, the Trump administration began collecting the names of thousands of F.B.I. personnel who helped to investigate crimes associated with the attack on the Capitol. Several top-ranking officials at the agency have already been fired. The move offered an early glimpse at how Mr. Trump and his nominee to run the F.B.I., Kash Patel — who published a literal enemies list of “Executive Branch Deep State” members — might use federal law enforcement against the president’s political opponents. In perhaps the most disturbing warning to those who might think to question or defy him, Mr. Trump stripped several of his former advisers of security protection that was deemed necessary given credible threats by the Iranian government to assassinate them for actions they took under his direct order.
The President’s Imperial Bluster and Attacks on Allies. Mr. Trump has spent weeks coyly suggesting the United States is on the verge of illegally seizing territory on three continents, leaving all levels of consternation in his wake. Then there are his long-planned, seemingly legal — even if extremely ill advised — tariffs. All the threats and insults have gained Mr. Trump some short-term concessions, but none are likely to make America’s economy stronger or make America safer in the world. Running roughshod over centuries-old alliances will hurt the targeted countries, but it also could compromise national security, raise the price of goods, disrupt global commerce, benefit adversaries like China and Russia that are eager to fill the void of an increasingly distrusted America.
Public Health Imperiled. Robert F. Kennedy Jr., a vocal vaccine skeptic, has not been confirmed as Mr. Trump’s health and human services secretary yet. But the administration is already taking steps to weaken and wreck public and global health protections. On Thursday, The Times reported that the administration plans to reduce the staff of more than 10,000 Americans at the U.S. Agency for International Development to only about 300 people, and cancel nearly 800 awards and contracts the agency administered. The president — much less Mr. Musk — cannot shut down a federal agency without a vote by Congress. To do so is also illegal under the Constitution. More than half of U.S.A.I.D.’s spending in 2023 went to health programs intended to stop the spread of diseases, such as polio, Ebola, tuberculosis, H.I.V./AIDS and malaria or to humanitarian assistance to respond to emergencies and help stabilize war-torn regions. If you care about preventing the next pandemic or the pressures of global migration, U.S.A.I.D. is an investment you should want the United States to make.
The President’s Anti-Civil Rights Blitz. Mr. Trump has issued a flurry of executive orders and pronouncements that set back decades of progress on civil rights and often openly defy the Constitution. He has especially targeted transgender Americans and has threatened federal funding for public schools that do not adhere to right-wing ideology about how history and race should be discussed. He has also found nearly daily excuses to rail against diversity, equity and inclusion policies, even blaming D.E.I. for the Jan. 29 air crash in Washington and strongly implying that any air traffic controller who is a woman or not white is inferior and has been given a job for the wrong reasons. And the new attorney general, Pam Bondi, announced on Wednesday that private companies that choose to maintain their own diversity and inclusion policies could be targeted for “criminal investigations.”
America faces a new reality, and it demands wisdom, endurance and courage. The United States is now led by a president who appears willing to stampede over any person, law, congressional statute or country that stands in his way. He is driven by impulse and is disinterested in rules, history or reality.
How Americans and the world handle such a president will determine much about the next four years, and it will ask much from all of us. We must meet the moment. Mr. Trump won the election fair and square, but his position is that of president, not king or god-emperor. Every time Congress allows him to exceed his constitutional role, it encourages more anti-democratic behavior and weakens the legislature’s ability to check further erosion of the norms and values that have helped make this nation the freest, richest and strongest in the world.

N.Y. AG Letitia James Holds Press Conference With Gov. Hochul: 'We Are Prepared To Fight Back'

In a contentious post-election press conference on Wednesday, Democrat New York Governor Kathy Hochul and state Attorney General Letitia James continued to portray President-elect Donald Trump as an evil adversary.
A disgruntled Hochul declared that she has established a “Empire State Freedom Initiative” in order to get ready to combat “policy and regulatory threats” from the incoming Trump administration.
Even though the governor claimed that she is now prepared to work with the new President-elect, Hochul still spent most of her time speaking about preparing herself for possible political and legal warfare, ironically, the same kind of “lawfare” that Trump himself has faced in New York from those who wished to see him lose the election.
“You try to harm New Yorkers or roll back their rights, I will fight you every step of the way,” Hochul told reporters.
She further mentioned possible disagreements with Trump and his administration about illegal immigration, labor, LGBTQ+ matters, abortion, and environmental policies.
James, who has worked tirelessly to put Trump behind bars, also noted that her office has now been “getting ready” for a possible second Trump presidency.
“I am ready to do everything in my power to ensure our state and nation do not go backwards,” James said in a statement. “Together with Governor Hochul, our partners in state and local government, and my colleague attorneys general from throughout the nation, we will work each and every day to defend Americans, no matter what this new administration throws at us. We are ready to fight back again.”
The Democrat attorney general’s attendance at the news conference was eye-opening and demonstrated that the two top Democrat leaders in New York are getting ready to engage Trump in a combative, warlike manner.
After accusing Trump of misrepresenting his net worth by billions of dollars to obtain better loan and insurance terms, James was awarded a $454 million civil fraud judgment against the business mogul.
However, Trump has appealed the ruling.
“I am NOT fearful of Donald Trump. I have not been fearful of Donald Trump,” James asserted to reporters.
Trump won both the national electoral and popular vote, and he did better in blue New York than he did in 2020. Hochul viewed Trump’s victory as a funeral.
“New Yorkers WILL persevere over the next four years!” she voiced.
Trump’s allies in New York denounced Hochul’s press conference as immature, inappropriate and detrimental to New Yorkers.
“Hochul is out of her mind,” said state Republican Party chairman Ed Cox. “This does not help New Yorkers. It’s dumb and bizarre.”
Additionally, the House GOP Conference chairwoman, Representative Elise Stefanik, made remarks as well.
“President Trump performed better in New York than any Republican presidential candidate since Ronald Reagan. Kathy Hochul has the worst approval ratings for any New York governor in history.” “One of the many reasons why Trump over-performed in New York and across the country was Tish James’ desperate witch hunt and weaponization of the NY AG’s office and the Manhattan district attorney to illegally target Joe Biden and Kamala Harris’ political opponents. And he soundly defeated them at the ballot box across the country. I was proud to lead the effort in New York State to fight back against their illegal lawfare,” she added.

Last night, Senate majority leader Chuck Schumer (D-NY), House speaker Mike Johnson (R-LA), and House minority leader Hakeem Jeffries (D-NY) announced they have agreed to another continuing resolution that will fund the government until March 1 and March 8. Schumer said he will begin the process of passing the continuing resolution when the Senate reconvenes tomorrow. 
The first part of the current continuing resolution that funds the government will run out Friday, and Schumer warned that “[t]o avoid a shutdown, it will take bipartisan cooperation in the Senate and the House to quickly pass the CR and send it to the President's desk before Friday's funding deadline.” 
Schumer is sending a message to the House, since far-right Republican extremists there threw former House speaker Kevin McCarthy (R-CA) out of the speakership for adhering to the budget spending agreement he made with President Joe Biden in June 2023. Now Johnson has agreed to what is essentially the same deal.
It is unclear what actions the funding measure will prompt in the House. According to Marianna Sotomayor and Leigh Ann Caldwell in the Washington Post yesterday, extremist Republicans remain angry enough at their inability to dictate terms to the government that they are, once again, threatening to halt the House’s business in protest, to challenge Johnson’s speakership, and/or to shut down the government. At the same time, other Republicans are angry that Johnson appears to be caving to the extremists, who have made the House a bit of a laughingstock as they made it almost impossible last year for the House to get anything done. More obstruction, another speakership fight, or a government shutdown would hurt the Republicans’ image even more.
Jake Sherman of Punchbowl News reported that Johnson told the House conference that with Kentucky representative Hal Rogers hospitalized after a car accident on Wednesday, and Louisiana representative Steve Scalise out of Congress until February for a stem cell transplant to treat his blood cancer, the Republican majority is so slim there isn’t time for anything other than a continuing resolution. 
Perhaps to appease the extremists, on the same call, Sherman reported, Johnson told the conference that the bipartisan immigration measure being negotiated in the Senate was “DOA in House.” House Republicans have insisted they will not pass additional funding for Ukraine, Israel, and Taiwan without a measure addressing the border. At the same time, they have also refused Biden’s offer to negotiate, clearly trying to preserve the immigration issue to whip up voters before the 2024 election. Johnson told his conference that Congress “can’t solve [the] border until Trump is elected or a Republican is back in the White House.” In Iowa, Trump promised: “As soon as I take the oath of office, I’ll…begin the largest deportation operation in American history.” 
We got a taste of what those policies will look like over the weekend when on Friday a woman and two children drowned in the Rio Grande and two other migrants were in distress after Texas soldiers prevented Border Patrol officers from entering Shelby Park, the area where the migrants were crossing. A lawyer for the Department of Health and Human Services wrote to Texas attorney general Ken Paxton on Sunday, demanding that Texas stop blocking Border Patrol officers. 
Meanwhile, the image of the migrant woman and children drowning is so damaging that Texas troops claim they didn’t see any distressed migrants and Texas governor Greg Abbott today insisted that the migrants were already dead when his troops stopped the Border Patrol from helping, although that claim does not address the fact that the Texas troops had blocked the Border Patrol’s normal surveillance of the river and had assumed responsibility for it. Abbott tried to argue that the deaths were not his fault but rather Biden’s because, he said, Biden’s policies encouraged migrants to attempt the crossing.   
For their part, Senate Republican negotiators pushed back on the news that Johnson was preemptively tanking the immigration measure, saying that rumors about what’s in it are inaccurate and that Republicans should withhold judgment until they see it. Members of the Senate are eager to pass aid to Ukraine, Israel, and Taiwan. 
Today, Nahal Toosi explored in Politico how the domestic political infighting in the United States is undermining faith in American democracy around the world. Toosi explained that current and former diplomats pointed to concerns that U.S. foreign policy will change based on the demands of a radical base, and they pointed to Trump’s abrupt exit in 2018 from the 2015 Joint Comprehensive Plan of Action, more popularly known as the Iran nuclear agreement, that significantly restricted Iran’s nuclear development. In the wake of that withdrawal, Iran resumed the previously prohibited uranium enrichment. 
“Foreign relations is very much based on trust, and when you know that the person that is in front of you may not be there or might be followed by somebody that feels exactly the opposite way, what is your incentive to do long-term deals?” a former Latin American diplomat asked of Toosi. A former Mexican ambassador told Toosi that if a Republican takes the White House in 2024, countries will not be able to trust the U.S. as a partner but will instead operate transactionally.
“The world does not have time for the U.S. to rebound back,” a former Asian ambassador told Toosi. “We’ve gone from a unipolar world that we’re familiar with from the 1990s into a multipolar world, but the key pole is still the United States. And if that key pole is not playing the role that we want the U.S. to do, you’ll see alternative forces coming up.” Toosi noted that Russian diplomats were “among those delighting in the U.S. chaos (and fanning it).”

President-elect Donald J. Trump announced on Saturday that he would name Charles Kushner, the wealthy real estate executive and father of his son-in-law, Jared Kushner, to serve as ambassador to France, handing one of his earliest and most high-profile ambassador appointments to a close family associate.
The announcement was the latest step in a long-running exchange of political support between the two men. Mr. Kushner received a pardon from Mr. Trump in the final days of his first term for a variety of violations and then emerged as a major donor to Mr. Trump’s 2024 campaign.
“I am pleased to nominate Charles Kushner, of New Jersey, to serve as the U.S. Ambassador to France,” Mr. Trump wrote in a social media post announcing his choice. “He is a tremendous business leader, philanthropist, & dealmaker, who will be a strong advocate representing our Country & its interests.”
Mr. Kushner, 70, pleaded guilty in 2004 to 16 counts of tax evasion, a single count of retaliating against a federal witness and one of lying to the Federal Election Commission in a case that became a lasting source of embarrassment for the family. As part of the plea, Mr. Kushner admitted to hiring a prostitute to seduce his brother-in-law, a witness in a federal campaign finance investigation, and sending a videotape of the encounter to his sister.
Mr. Trump granted Mr. Kushner clemency as part of a wave of 26 pardons he issued with roughly a month left in his first term, along with other close associates including Paul Manafort, his 2016 campaign chairman, and Roger J. Stone Jr., a longtime ally and informal adviser.
In addition to securing a pardon for himself, Mr. Kushner was instrumental in helping others seeking clemency elevate their cases, relying on his son as a bridge to help get applications in front of Mr. Trump.
The case against Mr. Kushner was prosecuted by Chris Christie, the former New Jersey governor who was then a U.S. attorney. Mr. Christie has since become a vocal critic of Mr. Trump’s and continued to describe Mr. Kushner’s transgressions as severe.
Mr. Kushner served two years in prison before his release in 2006.
While widely seen as one of the most prized ambassador positions, the role Mr. Kushner will be nominated for could be complicated by the at times standoffish position Mr. Trump took toward President Emmanuel Macron of France during his first term.
As president, Mr. Trump also expressed support for Mr. Macron’s far-right challenger in the 2017 French presidential election, Marine Le Pen, whose hard-line stance against immigration Mr. Trump praised.
Mr. Macron, who has been a staunch supporter of both the North Atlantic Treaty Organization and Ukraine, will serve until mid-2027. Mr. Trump has repeatedly questioned the value of Western support for Ukraine in its fight against Russia’s invasion, and has also publicly sparred with Mr. Macron over other contentious policy disagreements, including trade issues and the U.S. withdrawal from a nuclear deal with Iran.
