CJ court watch
SCt decided two important cases today.
J. Alito wrote for the majority in Percoco v. United States, 598 U. S. __ (2023). J.J. Thomas & Gorsuch concurred. There was no dissent.
Joseph Percoco was basically a fixer in Gov Cuomo's administration. He resigned in April 2014 to run Cuomo's reelection campaign. While he was not employed by the state, he took 35k from a real estate developer in exchange for lobbying the state gov't to cut the developer a break.
The feds charged Percoco with honest-services wire fraud based on his own duty of honest services to the public while he was not a public employee.
we reject the argument that a person nominally outside public employment can never have the necessary fiduciary duty to the public. Without becoming a government employee, individuals not formally employed by a government entity may enter into agreements that make them actual agents of the government. An “agent owes a fiduciary obligation to the principal,” see, e.g., 1 Restatement (Third) of Agency §1.01, Comment e, p. 23 (2005), and therefore an agent of the government has a fiduciary duty to the government and thus to the public it serves. In this Court, Percoco has agreed that individuals who are “delegated authority to act on behalf ” of a public official and to perform government duties have a duty to provide honest services****
[The lower courts and the the jury instructions did not] define “the intangible right of honest services” “ ‘with sufficient definiteness that ordinary people can understand what conduct is prohibited,’” or “‘in a manner that does not encourage arbitrary and discriminatory enforcement.’”
the jury was not told that it was necessary to find that “relevant government personnel” “acquiesce[d]” in Percoco’s exercise of government functions.***
SCt reversed the conviction.

Ciminelli v. United States, 598 U. S. __ (2023) was another unanimous reversal in a white collar case.
NY planned to devote billions to real estate development in Buffalo. The money would be funneled through "Fort Schuyler Management Corporation, a nonprofit affiliated with the State University of New York (SUNY) and the SUNY Research Foundation."
Louis Ciminelli was a developer. Alain Kaloyeros and Todd Howe were politically connected operators in NY. Kaloyeros was a director of Fort Schuler Management.
Ciminelli paid Kaloyeros to rig the requests for proposals so that his company would win big contracts. "With that status in hand, LPCiminelli secured the marquee $750 million “Riverbend project” in Buffalo."
The Government prosecuted "solely on the theory that the scheme “defrauded Fort Schuyler of its right to control its assets.”"
SCt reviewed the history of federal wire and mail fraud statutes and how they are aimed solely at schemes that deprive victims of tangible property.
The right-to-control theory cannot be squared with the text of the federal fraud statutes, which are “limited in scope to the protection of property rights.”***
The right-to-control theory is also inconsistent with the structure and history of the federal fraud statutes.***
Finally, the right-to-control theory vastly expands federal jurisdiction without statutory authorization. Because the theory treats mere information as the protected interest, almost any deceptive act could be criminal.*** The right-to-control theory thus criminalizes traditionally civil matters and federalizes traditionally state matters.***
In sum, the wire fraud statute reaches only traditional property interests. The right to valuable economic information needed to make discretionary economic decisions is not a traditional property interest. Accordingly, the right to-control theory cannot form the basis for a conviction under the federal fraud statutes.***
SCt reversed the conviction.

summary: Draco Malfoy is a pureblood wizard. Magic runs through his veins and has been since his birth. You're a Wiccan No-Maj; a non-magical being with ordinary blood through your veins, but practices what you call magick. And this very practice upsets your neighbor.

"They want... me?"
Draco Malfoy sat across his supervisor in his office at St. Mungos. His eyes widened at the offer he was given.
"Well Mr. Malfoy, you've certainly shown us around here that you do well at your job. If I must say so myself, I believe you're ready for the job," his boss has explained. Draco had recently finished his Fellowship and became a remarkable Healer. So much so that the Santa Marie Hospital for Maj Persons in Buffalo, New York contacted his supervisor to offer him a position as Head Healer. It was an incredible opportunity, one that a person could only dream of.
Draco sat still in his chair, shocked that of all Healers from his department, Santa Marie wanted him. After the Battle of Hogwarts, Draco was determined to change the views people had of him. He was no longer the prejudice prat that he was at school. Draco Lucius Malfoy is now a matured, capable young man. He worked hard and was proud that he did everything on his own. No help from daddy dearest, no pressure of the Malfoy name. It was all him.
"I would love to take this job. When would I start?"
Draco finished filing his paperwork at the Ministry of Magic that was to be sent to the Magical Congress of the United States containing his work permit and all the necessary identification. Walking around London, he grew excited about it. It was a feeling he hadn't felt since he got his letter for Hogwarts.
The next thing he has left to do was to find housing. There was an office located in Diagon Alley that specialized in international real estate. Draco walked into the brightly lit office. Much to his surprise, Daphne Greengrass stood at the reception desk.
"Well, well. Long time no see, Malfoy," she said with a smile on her lips. He was quite relieved to see a familiar face. "Good to see you too, Daph. I'm checking in to see Ms. Moreau. I'm moving to America soon." Daphne was both shocked and impressed that Draco would be making such a big move. They chatted momentarily about the reason for him moving and she congratulated him. Soon enough, the real estate agent walked out and called Draco into her office.
She sat at her desk and gestured for him to take the seat opposite her. "It's a pleasure to meet you, Mr. Malfoy."
"The feeling is mutual, Ms. Moreau," Draco had slightly bowed his head.
"Please, call me Gwen," she smiled as she reached to shake his hand, "I see from your paperwork that you're moving to America, correct?" he nodded his head in response. "Fantastic! Now, looking at the locations for Buffalo, we have quite a bit of selections from houses to flats. Of course, in America they're called 'apartments'. With your budget, you would be able to get this nice house that is just a 10 minute drive to the Apparition office to Santa Marie's." She showed Draco pictures of the house. It was quaint. An all white, one story house that had three bedrooms, a lifted porch, small kitchen, two bathrooms, trimmed green grass in front and a dark stained wooden fence that went around the house. Draco nearly fell in love with it. Its contrast to the Malfoy Manor was warm and inviting.
Gwen had shown him pictures of the other places she had gathered for him, but none of them peeked his interest as the first house did. It was quite silly as he thought about it. Most likely, he would be working long hours at the hospital to even be able to appreciate the home. It made more sense to get an apartment as he would most likely just use the space to sleep and eat. But the house was begging for him to live there. After about an hour long session, Draco made his final decision on the small house.
"Excellent choice, I had hoped you'd love it. Now, before I contact the sellers about your offer, I must let you know this before you sign anything," Draco shifted in his seat. Of course there had to be a catch. A house this perfect needed one thing to go wrong. Was it busted windows? A terrible neighborhood? Shitty pipelines? He nodded for her to continue.
"This is an integrated neighborhood. Both muggles and wizards live around and you might not know which are which for a while." Muggles. He sat in silence, staring down at the photos of the house. Did he really want a muggle neighbor? No, you're past this Draco thought. The old Draco wouldn't even give the place a second thought. But he wasn't him anymore. "I don't care. I'll take it."

You woke up in the morning, stretching your arms and legs out of the thick blanket. It was currently 8:47 am, your alarm clock beside you still had 13 minutes to alert you to wake up. Deciding to just get a head start on the day, you walked into the your bathroom and started your shower. The water was at the hottest you took and you went about your daily routine. You said your repeated incantations in the shower as you lathered yourself with soap:
Water, water, wash away. Water, water, cleanse today.
Walking out your shower, you grabbed your towel and recited the next spell as you dried yourself:
By the earth in the soap,
by the air in the steam,
by the fire that heats the water,
by the water that cleanses,
I am cleansed, clean, and ready for the day.
When you were 12 years old, you used to watch your grandmother perform Wicca in her bedroom. Your mother didn't particularly join in on the belief, but also didn't oppose to you starting alongside your grandmother when you turned 18. Now, you were almost 26 and still kept on the same practices.
On the contrary to people's interpretation or views of witchcraft, you called yourself a White Witch; someone who performs good magick upon selfless reasons. You never hexed anyone nor wished any ill fate. The Laws of Nature was surely watching at all times and if you did, expect to get the same fate but in threefold. Not that you even had any reason to do such things, anyways.
After getting ready, you grabbed your bag, keys — which held a protection charm — and went on your way to work. Your cat sat in her tower located in your living room and she watched you walk out. Getting into your car, you noticed movement next door. A big, moving truck was parked and a crew of movers carried furniture into the house. Finally, someone new you thought.
Feeling nosy, you sat patiently to figure out who it was moving next door. Was it a family? An elderly couple? Maybe newlyweds. Right when you were about to pull out of your driveway, a handsome blond stepped out of the house guiding the movers where things were going to be placed. You couldn't hear his voice, but could tell from the distance that it had to be attractive.
He looked around the street and caught you starting from your car. You hesitantly raised your hand to wave at him but was cut off by a man walking up to him with a clipboard gesturing where to sign. You looked at the time on your watch and nearly panicked at how the time passed, leaving you with only 15 minutes to get to work. Hauling ass, your car let a screech out as your foot punched the gas pedal. You'll be able to introduce yourself later, Y/N.

A few days passed and Draco was headed for the Apparition office to his new workplace. He had leased a new car to drive there. According to the Magical Congress, wizards and witches that lived in integrated neighborhoods must check in at Apparition offices to not raise suspicions from No-Maj. Seemed quite silly at first, but it really wasn't that big of a deal. He remembers the first time he went to Diagon Alley with his father through the Leaky Cauldron, finding it hidden with a wall that required taps against it. Behind it, a magical alley hidden from muggles.
He pulled into the office building lot with ease. It was clean on the outside and had a sign on top that only read MCA Co,. At the front door, there was a pin pad with numbers on it that kept it locked. Draco pulled the paper from his pocket and dialed the number. The door made a clicking noise which signaled that it was unlocked.
In the front was a young man sat at a reception desk typing away onto a computer. It was a strange sight for Draco as he's never seen one before. He walked up to the desk and waited for the person to acknowledge him.
"Hello, sir. Welcome to the Magical Congress' Apparition Office. May I see your ID pass, please?"!the accent was unfamiliar to Draco, but he nonetheless reached for the pass clipped to his trousers and gave it to the receptionist. He scanned the pass, handed it back to Draco and raised up from his chair to guide Draco to the door which had a direct line to the hospital. "Have a good day, sir!" were his last words before he went back to his desk.
Draco looked at the address once more before appariting into Santa Marie's. Here goes nothing.

It was a long day at the office. Setting up appointments with new clients, greeting all the new people he'd be working with, and a surprise welcome party to end it. Everyone he met had different variations of American accents. Some from Chicago, some from California, and some from the native state of New York.
A man by the name of Ian Parker helped Draco navigate around the building. Draco was quite relieved to hear that Ian had lived close by, just two blocks and a turn away. They had lunch together and talked about just simple things about each other. It felt nice to meet somebody and they not know who you are and things you've done in the past.
Once he got home, the first thing Draco did was start to run the shower, gathering his sleepwear as the water heated up. Not meaning to, Draco noticed how his bedroom window had perfect view of yours. To him, it was extremely odd.
You had faux vines that curled around your four-poster bed, a couple of plants that hung against the wall and posters of movies that Draco knows for a fact he's never seen in his life. You walked into your room and went up to a small drawer and dug through it. After a few seconds, you grabbed out some incense sticks, lit them and stood them on the stand that laid on your dresser. Afterwards, you sat on the floor with your legs crossed and started taking deep breaths.
Draco caught himself staring for too long and was about to head into the shower until he saw movement from the corner of his eye. There you sat, but this time, you held items in your hands. One held what Draco thought to be just some colorful rocks. The other hand held a bundle of herbs on fire at the tips. Your lips moved and it had Draco curious. Your hand with the herbs moved in a specific pattern, creating smoke around you. Once you finished, you set the rocks and herbs down at a table and left the room. That was odd. Draco thought. He passed it off and went on about his night.

"It was the weirdest thing I've ever seen. And trust me when I say that Hogwarts has its fair shares of odd moments," Draco sat in the break room with Ian and two other people, Ashley and Blaine. They laughed at the description Draco had of you and settled after Ian began his explanation.
"It seems that your No-Maj neighbor is considered a Wiccan." What in Merlin's name is that?
"Pardon? What's do you mean?"
"It's what they call witchcraft," Ashley added, "it became a popular thing after the Salem Witch Trials. Of course, there's no real magic to it like what we can do, but they nonetheless believe it works."
Draco couldn't believe what he was hearing. Muggles are trying to be witches? This was probably the last thing he ever thought he would hear. Inside, a familiar feeling had ignited. A feeling he had, or he supposed still had, for a certain species. He didn't like it but to find out that what he is had become a fantasy to be was upsetting. He was born into this life, not them. Not you.

It had been a really nice day at work. People had been kind and you sold out of a new oil you made. As you entered your home, your cat ran up to your legs and purred against you. You smile down at her and made your way to prepare your dinners.
She nibbled away at her bowl and you watched in content.
Outside, you heard a car pulling in. It's probably him. You peaked out the window in the living room and your guess was correct. He stepped out of a black car and walked to his door. You tried catching his attention by waving your arms about, hoping he glanced your way. When he did, you waved excitedly to him.
He stared at you with a straight face, no hint of any feeling. It was odd, people usually like you and wave back but this guy was just looking at you. Not doing anything. You looked around to see if there was something behind you, only to look back and see that he was gone. Ooo...kay?
You grabbed your sweater and decided to introduce yourself to your new neighbor. It had been almost a week and it seemed that he still hadn't acquainted himself to anyone on the street. The cool, spring breeze sent a pleasant chill down your spine as you walked on the sidewalk.
Once you stepped in front his door, you knocked three times. No answer. Three more times. No answer. The lights that were on had turned off and curtains had been shut in almost a blink of an eye. He had made it clear that he was not in a mood to talk to anyone. It slightly hurt your feelings, but you told yourself to not dwell on it. He's just tired from work. Just then, an idea popped in your mind as you headed back home.

"Stupid fucking muggle clock," Draco cursed as he was running around his bedroom getting dressed. He overslept by an hour and had 10 minutes to be in the Apparition office to go to work. Damn American laws.
He grabbed an apple, not his usual sour green one but a sweet red one this time, grabbed his bag and ran for the front door. Something taped to the door caught his attention and he halted his movements. It seemed to have been a note someone left. He unfolded the paper and read it to himself;
Hello! My name's Y/N and I wanted to welcome you to the neighborhood! I hope we can become good friends~ if there's anything you need or if you'd ever like to get acquainted over coffee, please feel free to knock on my door! It'd be nice to get to know you :)
At the bottom of the note was a small drawing of a witches pointed hat and Draco immediately knew who left the note. Almost on instinct, the note caught on fire in his hands and the ashes fell to the ground. He dusted his hand off and went to work. As if we would ever become friends.

Being An Actress
I remember the moment I decided I wanted to be an actress. I was walking across the parking lot of my high school after an undoubtedly stellar performance as Portia in an all-girl production of The Merchant of Venice when my father turned to me and said, "Do you think you might want to do this for a living?" At the time I remembered feeling a little insulted. My grades were excellent. Didn't my father think I could be a lawyer or a veterinarian or a psychologist? It wasn't that I didn't love to act, but everyone I knew who wanted to be an actress was either egotistical or unstable. Not that one was mutually exclusive of the other. What did this say about me? No one in my family acted, although my Grandmother often hinted of an unsubstantiated family connection to Hermoine Gingold. Occasionally my parents would take us to see a play or listen to a concert, but only to help make us well-rounded individuals. When someone would go on about the Sound of Music my father would roll his eyes and say, “How can I take a nun singing on hilltops seriously?” And I found myself admitting that he had a point.
When I was four I appeared on Romper Room for an unprecedented two weeks. At the time my best friend, Mary Lou, had been selected for the local cable network but her incredibly shy demeanor had her mother worried.
“She’s gonna sit there like a sack of potatoes.” Mrs. Dean told my Mother who quickly suggested that I accompany Mary Lou for moral support.
“What do I have to do?” I asked my mother as she was tucking me into bed.
“Just be yourself,” she replied. My mother knew exactly what that meant. Naturally loquacious I kept things hopping on the set by constantly commenting on the camera man kissing the teacher. When asked what my father had in his garage, I remarked that it was presumptuous to even assume we had one. There was some discussion about a third week, but Miss Dawson put her foot down and said I was stealing the show.
Soon I was taking dance classes and skating lessons. My first stage appearance was as a rabbit in the famous ballet, Bugs Bunny's Birthday Party. I was excited because we second tiered rabbits were going to eat sandwiches on stage. Then disaster struck. The sandwiches were going to be peanut butter and I hated peanut butter. Teary eyed I complained to my mother who told me to grin and bear it. “That’s acting,” she said.
In grade four I wrote a play about a pair of motorcycle lovers and sang Baby Driver while they straddled their desks and rode off into the sunset.
“Hit the road and I’m gone.
What’s your number?
I wonder how your engine feels?”
“Okay,” Mrs. Orcutt interrupted, “I think that’s all the time we have for that today.”
After my father gave me his blessing to pursue a career on the stage, I decided to explore all of my options. I auditioned for an amateur theatre company and played bird #4 in Aristophanes’ The Birds, and a milk maid in Galt MacDermot’s musical adaptation of Shakespeare’s Two Gentlemen of Verona. Not exactly earth-shattering roles, but I knew there was a pecking order (no pun intended) and that dues must be paid. In Niagara Falls, where I lived as a teenager, there were two amateur companies. The youth group that took over the Firehall Theatre in the summer months of July and August, and the adult group that staked their claim the rest of the year. The youth company was run entirely by a handful of 18 to 20-year-olds who took themselves very seriously. We stretched ourselves artistically, which is really just another way of saying that were out of our depth. I remember as Bertha in Pippin I had to say, "Men raise flags when they can't get anything else up." At the time I had no idea what that meant but I certainly enjoyed the response I got every time I said it.
The amateur theatre company in the neighbouring city of St. Catharines were doing large scale musicals with professional directors and a cast of a thousand. Even I could tell the difference between Garden City’s production of West Side Story and the Niagara Falls Music Theatre Production of A Shadow Box. We told ourselves that we were doing something significant for the five or six audience members who sat in the dark to watch us perform. “At least they can appreciate art.” we told ourselves, ignoring the occasional snore beyond the footlights. When someone who had seen our production complained in the paper that “…smut didn’t belong on stage.” I was devasted. “Some people just don’t know a good thing when they see it,” I ranted, “It’s a Pulitzer award winning play.” I forgot that we weren’t Tony award winning actors.
Anxious to spread my wings and get a taste of the real thing, I auditioned for a one-act play festival at the nearby University and managed to get the part of an uptight bible thumper in an original musical called A Hundred Bucks a Week. It was the story of a topless shampoo parlourist who castrates a guy with her teeth. Did I mention that it was narrated by a cat? I still remember singing:
“We all must be as babies in the garden.
Smiling with our mouths all bright and new.
Innocently smelling lovely roses.
Not prying with our fingers in dog doo.”
Needless to say, my father was a little shocked when an actress appeared on stage topless while I sang my heart out in a futile effort to convert her. This time as he walked me across the parking lot to the car he suggested that perhaps I should seriously consider journalism at Carleton. “Impossible!” I stated dramatically, “I’m an actress.” And I actually believed it.
I arrived at University wearing vintage clothes with frizzy hair and John Lennon glasses. I couldn’t decide if I wanted to be Doris Finsecker from Fame or Janice Joplin. My dorm room-mate was an engineering student who was the first to know of a kegger and had never seen a play in her life. She often returned to our room late at night reeking of booze and sludge water after spontaneous dips in the Detroit River.
At theatre school I was told I couldn’t dance, I couldn’t sing, I had speech impediments and a wandering left eye that would completely destroy any hopes of a career in film “Too bad you didn’t have it looked at when you were a kid,”one professor told me, “It’s easily treatable if caught when you are young.” At the age of five I was a frequent visitor to Sick Kids Hospital for my eye and wore a patch over my glasses for a year. It didn’t cure me. So much for trusting the knowledge of my professors. Strike one!
I began to sink under the pressure of looks and expectations. While the rest of the women in my class wasted away proclaiming to have eaten nothing but broccoli over Thanksgiving, I gained seven pounds over a new found love of peanut butter and developed a bad attitude towards anyone who encouraged me to “feel space”. When my teacher overheard me mutter under my breath one day that I hated improve she called a class meeting to discuss why I hated her. Everyone stared at me shocked and disappointed. Why was I resisting the pu-pu platter of techniques spread out before me? “You’re a very stubborn actress,” the teacher announced, “but I’m going to break you.” That was strike two.
At my first semester tutorial I was told that I had talent, but I wasn’t tall, thin or pretty enough. “You have the face of Sally Field,” the department head told me, “but the body of Kathy Bates.” Strike three. I went home for Christmas and announced to my father that I was dropping out to focus, instead, on getting into a proper theatre school in New York. After all, I reasoned, it’s where I really wanted to be anyway.
There is probably nothing quite as depressing as returning to your hometown in the middle of winter when all of your friends are away at school having the time of their lives. The overall perception is that you have failed. It didn’t help to think that I had willfully brought myself to this point in time. The phrase, “small fish in a big pond” kept going around in my head. While my best friends were acing all of their classes and dating interesting freshmen, I was eating cookies, and counting the days until everyone would return to amuse me. In the meantime, I moped around the apartment, wrote letters to theatre schools and read a lot of plays.
“You have to get a job.” My father announced and for the first time I was forced to slog my way through the want ads in a half assed attempt to find work at either a wax museum or a fudge shop. Completely unqualified for anything except theatre, I was forced to become a chamber maid at a tacky little hotel near Clifton Hill. Picking up after the kind of clientele that honeymoon in tacky hotels in Niagara Falls is enough to get one thinking seriously about their life choices. Maybe Dad had been right. A career in the theatre wasn’t looking so good anymore. Something had been tarnished from University and I couldn’t pretend that my trajectory to success was going to be one clear straight line to the top. I’d hit rock bottom and was picking up the condom rappers and dirty Kleenex to show it.
There have been many times in my career when I’ve been very close to throwing in the towel and becoming a real-estate agent or a tour guide. At each one of those moments of genuine universal surrender something miraculous always happens. That year it was a letter of acceptance from the Neighborhood Playhouse in New York. By now my father, less convinced that I could make a go of it, made me a deal. If I could find a place to live in Manhattan within a week, he would allow me to go. So, I boarded the train in Buffalo and headed for the Big Apple.
I arrived in New York at around 2:00 PM on a very, very hot day in August. I walked straight to the library, took out the Village Voice, circled an advertisement seeking a room-mate for a four-bedroom brownstone on the Upper West Side, was interviewed at 7:00 PM and secured my living accommodations within twenty-four hours. It didn’t matter to me that I had no idea who the three men I’d be living with were. The place was nice and the price was right. I think I heard my father drop the phone when I called to tell him that I had accomplished the impossible. Studying in New York proved to be the best and possibly the worst thing that ever happened to me. I developed a philosophy of acting that has served me in every way, but it also created a high standard that hasn’t always been easy to live up to.

A few years ago, I was invited to direct a production of Blue Stockings at the same University I had so unceremoniously departed from those many years ago. Parallel universes collided as images of my past kept imposing themselves on the present. There was the quad I had been initiated in. There was the building where I’d slept and laughed and cried. There was my window with the view of the cemetery and McDonalds. There was the library where I looked up the address of every theatre school in New York. I didn’t need someone to tell me what I wasn’t or couldn’t be. If only we could teach students the value of tenacity and resilience.
I enjoyed directing that class. I hope I encouraged and inspired them. I was happy when they came to rehearsals in sweats and tee shirts, less concerned about how they looked than we had been. More confident in their choices. More involved. On Opening night after the cheers and flowers and the congratulations, it felt good to climb into the car and head for home. I’m not cut out for institutions. I don’t like the brick and the neon and the bureaucracy. Still, it was good to make my peace with that time in my life. On the four-hour drive to Niagara I was thinking about the young people I had just worked with making the transition from student to actor. Maybe some of them will end up in New York. Maybe not. The thing about acting is it can take you anywhere…from Romper Room to the stars with a few tacky hotels in between.

Copley Depot and Caboose

In 1974, when the old railroad depot on Sawmill Road at Cleveland-Massillon Road in Copley, OH, was threatened with demolition, a number of citizens banded together for its preservation and in the process formed the Copley Township Historical Society. The depot was moved to its present site at 3770 Copley Road (SR 162) just west of the cemetery. The restored depot and its adjacent also-restored caboose now serve as the center for the Society with about 50 members who meet the third Monday of every month at 7 p.m. at Copley Town Hall. The Copley Depot and Caboose are open on the second Saturday of the month from April to October from 1 p.m. until 4 p.m.
Built in 1891 or 1892 by the Pittsburgh, Akron, and Western Railroad, the Depot is a marvelous example of Stick/Eastlake architectural style of the Late Victorian Era common in communities during the end of the 19th century. It was important to the community during that time period because it opened up Copley to the rest of the nation. The railroad provided a reliable form of transportation because roads were muddy and impassable several months of the year. The Depot celebrated its 125th birthday in 2016
Copley began as a small farm community that was known for its rich loamy soils that were deposited by the receding of the glaciers. Residents raised vegetables, corn, and wheat and fruit trees were indigenous to the region. Copley also had an abundance of marshy, swampy areas and those yielded wild cranberries, huckleberries, blueberries, raspberries, and blackberries. Hunting and trapping were labors but supplied meat, animal skins, and furs, and the ponds in the area afforded excellent sporting grounds for fishermen. The railway not only helped improve business operations, it provided convenient passenger access to Akron, Medina, and other desirable points, and also increased the general value of the Township's real estate.
Through the years as times changed, and the Akron, Canton, & Youngstown Railroad (AC&Y) took over the railway. The railroad decided to demolish the Depot in 1974. It was offered to the last AC&Y Agent William "Hank" Gromann for $1 if he would move it from its original Sawmill Road location. Mr. Gromann alone did not have the means to move the station but after learning of the depot's impending demise a group of local residents organized to save the historic structure, thus forming the Copley Historical Society. Mr. Gromann was one of the original Historical Society's contributors. The Depot was moved to its present location by the railroad tracks on Copley Road in 1974.
Alongside the Historic Depot sits the AC&Y Caboose. It was built in 1947 by the International Railway Car Company, Buffalo, New York, and is one of only six believed to still remain from that production year. In 1984 the caboose was slated for retirement but when the Copley Historical Society found out they asked AC&Y if they could have it and AC&Y graciously gifted it to them. This caboose actually ran the rails through Copley Township so it had special significance to the community. It was fitting to place it next to the Historic Depot and the tracks it had traversed many times. In 2009 a restoration project of the exterior was performed. The AC&Y Historical Society was contacted to enlist their expertise to ensure the correct paint schemes and lettering were used to create an accurate depiction of what the caboose would look like when it was in service. It is open for visitors when the Depot is open.
The Copley Depot was added to the Federal Register of Historic Places on May 31, 2001. Located on Copley Road the Historic Copley Depot and Akron Canton & Youngstown (AC&Y) Caboose are wonderfully preserved connections to Copley's past. They are truly two of Copley's historic gems.

Talk to me about a political issue you feel strongly about.
An agreement called the Kyoto Protocol was implemented a few years ago, when many nations met to discuss how to save the world from [greenhouse] gas emissions and other pollutants. Unfortunately, the Republican Party [Bush Administration] has decided to no longer contribute to it in any positive or negative way. Problems with the environment aren’t going to go away; they’re on a downward spiral and are only getting worse. The U.S. is the biggest contributing polluter, and if we do not decide to curb output, the Protocol won’t make as much sense as if we did. Other countries have agreed to be consistent with gas emissions, but we’re no longer participating; it’s disastrous. I imagine a world where animals are not in danger, where people respect the planet. I’m not attacking the president; one man is not the seed of the problem. In fact, both Democrats and Republicans are a part of the same machine, the same economy, the same world.
You seem well-versed in world events for a 20-year-old.
I never really had to think about politics before, but it’s our era. There’s a tendency to forget about it and go on with your life. People don’t always take the time to learn about what’s going on, but I want to know what’s happening. I don’t want to be happy in my ignorance and accept that other people are making all the decisions. At this time in my life, it’s critical to have a better understanding of the politics that rule and regulate the world. I was watching the [Grammy] Awards and remember hearing Bono say something like, ‘You have to read. You have to look. You have to search and formulate your own opinions about the world around you. You can’t just regurgitate and accept.’ He’s right.
How is acting different from modeling?
Acting is a new thing for me; I’ve just started getting into it. While I’m a veteran model, which probably sounds ridiculous, now I’m going [to] castings, meeting people and starting all over again in a new field. Acting is about listening and staying present in the moment—really believing it and trying to maintain the natural process that is life. The more organic it is, the more convincing, because it’s mimicking what truly is. It’s important to be consistent with your own ideas and the collaboration process, because everyone on the set is such a vital part of the whole pie. It’s great to be involved with something so much bigger than myself.
You filmed 2 Fast 2 Furious in Miami. How do you like the city?
I love South Beach, and lived at The Shore Club for three months. What a great hotel! They were so nice to me.
How does Nobu compare with Benihana?
Benihana has been around for 40 years. It’s the best restaurant, and people who don’t think that don’t understand the experience.
Was there a time you didn’t like sushi?
Yeah, when I was younger I wouldn’t touch the stuff. You can’t ask a kid to eat uni [sea urchin]—that would be a little weird. I started with California rolls and grew to have a greater appreciation for sushi from there. It’s funny, I just went to Benihana with Tyrese and Ludacris the other day, and Tyrese ordered a fried chicken roll with ketchup! That sort of thing sounded more normal to me when I was little, but now I’m so used to eating traditional dishes. When he asked for that, I said, ‘Are you serious?’
Was your model-to-actress transition intentional?
I was never one of those people who know what they want to do from day one; I was always confused. I can’t see myself being a model when I’m 50, but I don’t have everything mapped out. There’s no blueprint of how I want things to go. So many different things present themselves to me, and it’s just about making decisions and going with what feels right. It’s like Robert Frost said: ‘Two roads diverged in a wood, and I—I took the one less traveled by, And that has made all the difference.’ It’s about going one way and staying confident about your decisions regardless of the outcome. And anyway, who cares about the outcome? It’s all about the experience. You’re here on this planet, so you might as well take everything as it comes—really breathe it all in and make it your own.
Tell me what you’re doing besides the acting and modeling.
My father just got remarried and I felt like it was time to leave the nest. I’m living at the Trump Hotel for the time being, but I’m house-hunting, which is like a wild goose chase. Real estate agents keep showing me these really commercial buildings and high skyscrapers, but I just want something cute. I think I’d like something small—wait, not small. Definitely not small. But it’s hard to say. Do I want a two-bedroom with a marble bathroom? I don’t know. I have to just see it. I’m also working on a clothing line, a film-production company and a record label. But my dad always says to walk 10 steps in one direction as opposed to 10 steps in 10 different directions, so I need to focus.
Are you Daddy’s little girl?
Oh, yeah. That’s a big thing for me. I want to impress my father and follow in his footsteps. He’s so incredible. And I can say the same thing about my mother. She’s a survivor whose character inspires me.
Do guys get nervous meeting your dad?
Well, it’s not like I have a bunch of guys I’m bringing over. My dad does play a part in my life in every way.
You probably meet guys who are much older. What’s your dating age limit?
What is age, anyway? I used to think there was a list of things I’d need in a boyfriend, but the truth is, I just want to be comfortable and trust the person. I don’t care how old or young the person is. Actually, there is a limit on how young. I wouldn’t want to date anyone younger than me; it would be weird if he was still in high school or something. But I’ve seen couples where the guy is 70, the girl is 30 and people are scratching their heads; they don’t get it. But what is there to get? Who cares what other people are doing? Just concern yourself with yourself.
People do seem to care about what you’re doing. Have you seen ‘Devolution,’ a Devon Aoki fan website?
No, I haven’t seen it. But it’s cool.
I heard you were freaked out by a fan who tattooed your face on his arm.
That was a lie! Can I please set the record straight for once in my life? It was the worst thing, ever. After reading that article, I got so upset. A publication had asked me about my ‘craziest fan encounter,’ and I interpreted ‘crazy’ as ‘great crazy,’ or ‘weird but insane in a good and positive way crazy.’ I was so hurt when I read that they had changed my words from ‘craziest’ to ‘worst.’ Not only was it a bad reflection on me, but it would break my heart to think I had hurt anyone’s feelings.
Who got the tattoo?
A guy who went to school with my sister.
You didn’t think it was psycho?
No, not at all! I happen to think that someone inking my face onto his body is the highest form of flattery. I’m honored that people out there are interested in me; I appreciate that. I’m not scared of people who come up to me and ask me for my autograph. I’m not scared of my fans. It shows everything I’ve done is not in vain, and that there are people who see me, recognize me and support me. It’s a beautiful thing.
How would you characterize your style?
I’ve been wearing sneakers a lot. I used to be so into wearing heels and never went for comfort, but Jay-Z has a line of Reebok sneakers and they’re really cool. I also have [Cesare] Paciotti shoes, Adidas and some Puma. I’m really into sneakers these days, whether I’m going to the gym or not. Overall, I like to mix it up. I’m usually the last person to wear one designer top-to-bottom. I’ll wear an outfit that’s made up of vintage pieces, stuff from my mom, and things I’ve been given in the fashion industry.
What’s the best free thing anyone has ever given you?
Probably a couture Chanel coat that I wore on the runway, so it fit me perfectly. It is such a great piece. I get a lot of beautiful things, and try to wear pieces by newer designers, too.
Which up-and-coming designers do you like?
Benjamin Cho and Zac Posen.
What handbag are you carrying right now?
I just carry a little Chanel; it’s the greatest. You can look terrible, but if you’re carrying a nice bag that’s all that matters. It somehow makes everything so much better.
Tell me about your craziest fashion moment.
I wore a gorilla costume during a Thierry Mugler fashion show. Once I reached the middle of the runway, I ripped it off to reveal my hair and this beautiful silk dress. It was like a scene from a movie! This was probably one of the best fashion experiences I ever had on the runway. The designer came up to me and basically told me I could act because of what I did during that show.

Former NFL star and Florida Gator Percy Harvin is saying “later” to his Windermere, FL, home. The retired wide receiver bought the lakefront estate in 2013 for $2.6 million, according to property records. It’s now listed for $2.75 million.
“The flow of the property is really, really nice,” says listing agent Mauro Costa of Premier Realty Partners. “It used to be a much smaller home.”
The previous owners purchased the place in 2007 for $1.45 million and expanded the layout from 3,000 square feet to 8,464, according to Costa.
