I was struck by an uninsured driver on 02-10-11. Because the driver who struck me was uninsured I was forced to file a claim with my insurance company(Omni Insurance). The car was towed to CJ's collision at 6128 n beechwood Philadelphia, pa ,19138 on 02-11-11. Phone number 215-848-2836. On 02-14-11 Omni insurance sent out an appraiser to evaluate the vehicle. They then faxed an estimate on 02-15-11 totaling $5300 to CJ's collision shop. I went to the collision shop on 02-15-11 to sign paperwork giving them permission to work on my car. They then began the repairs. On 02-18-11 the insurance company then deemed my car a total loss. The vehicle is a 2005 Nissan Altima SL with 96,477 miles. The NADA value for the vehicle is 10,995. According to Omni insurance a car is deemed a total loss when the repairs reach 70% of the value of the vehicle. Omni insurance valued my car at 7,415. They then proposed a settlement offer of 5826.40. They deducted 975.00 in prior damages(which I disagree with) and 1000.00 my deductible. The settlement offer included 386.40 in sales tax. After negotiating on 02-28-11 they proposed an offer of 7835.30. The value they gave my car was 9255. Again 975.00 was deducted and my 1000.00 deductible. They including sales tax and tags/registration fee in the offer. I accepted the offer out of desperation because they also stopped paying for the rental car I was driving on 02-28-11. I work, attend school and have a child my schedule requires that I have a car so I paid out of pocket for a rental car until 03-07-11, expecting the payment to be issued to my lien holder by then so I could purchase another car. I contacted them on 03-07-11 inquiring about my payment and was informed they did not pick the vehicle up from the collision shop therefore they were not issuing a payment. The collision shop gave them a bill of 1750.00 for the repairs they did and the storage fees. The insurance company disagrees with this and refuses to pick the vehicle up and issue my payment. They have also stated this may come out of my settlement offer. The insurance company already has the title to the car and all the necessary paperwork to the vehicle but refuses to issue a payment. It has been a month since I filed my claim and I can no longer afford to pay for a rental especially since it seems I will have to purchase a new vehicle. The insurance company is low balling me and also forcing me to pay for repairs they approved then backed out of.""

A: You need to have legal counsel prepare a deed for you as well as your ex to sign. That will probably cost in the scope of $250.00, plus or minus. In summary, this can be a pretty big deal and you will need an attorney to allow you to get through it.

The following question is if any of your aunts or uncles or your dad survived the living grandparent or if they all pre both grandparents. The property would have passed to all those survivors, unless there clearly was a Will which gives otherwise, if any lived. Estates would have to be opened for all of these. The cycle then repeats itself. If there were Wills, they'd have to be followed. If there were not, the property would pass to your siblings, you and any cousins that are children of survivors. This really is a time consuming and quite expensive process and you'll need certainly to consult a lawyer to get through it. There'll be taxes estate prices and legal fees.

Q: If you have potential buyers for a home before signing with a realtor, can they be excluded from the listing contract?

A: A Will cannot override a title. Yet, either joint owner can file an action for partition to divide the possession of the property. The consequence of that could be to convert the property from a joint tenancy into a tenancy in common. At that point a sale could be ordered by a court. Further, she's eligible for let at half the the reasonable rental value, and each one of you is in charge of half the taxes and costs of repairs and public utilities, etc. You'll need a lawyer to sort this through.

Q: How do you remove someone of a house deed who has never paid for, or lived in the property in question?

My grandmother owns her home, but her daughter is on the deed. Has been for many years, and it is still unclear as to how she ended up on the deed. I would like some help on what steps we need to make to take her name off the deed. Lawyer Answer Dr Kenneth V Zichi J.D.

A: Without seeing the paperwork it is impossible to say for sure what should be done here. Is this 'joint' ownership? 'tenants in common'? a 'ladybird' deed? Each results in a different answer of what to do next, and it is not always OBVIOUS what the form of 'having her name on it' things are without reviewing the whole deed. I'd strongly urge your grandmother to seek out a local real estate lawyer to review things, and explain to her what needs to be done to change things. WORST case scenario may be her daughter needs to sign off on the deed. She really does need to seek out a local lawyer to review this!

Q: Is there any strategy to get rid of a restricted life estate clause from a title minus the individual consenting to take it out?

My boyfriend and that I purchased our house from my boyfriend's parents. Just MY name is around the Mortgage. Before the sale, we discussed them living in the house with us. We spoke to some lawyer (who also owned the title business doing the closing), he explained he was planning to draft papers concerning the terms of them dwelling with us. Yet, during closing, the title representative didn't bring any additional papers, she "hand wrote in" a small life estate clause into the deed. She never clarified what it meant for us or what the risks were. After the closing, we questioned why it had been done this manner, and all she said was "do not worry it can always be taken out after". She said we needed to sign the next copy at the same time, which we did and then retyped the title. It's now two years after, our living arrangement is not working out and we'd like to be aware of whether there is any way to really have it "taken out" like the title representative said, without his parents needing to agree? Attorney Answer Mark Scoblionko

A: It makes no sense that the title would be in the names of both you and your boyfriend even though it's not useful for your question, but the mortgage is only in your name. For a mortgage to be valid, it has to be performed by everyone whose names are about the title. It is possible for the note that accompanied the mortgage to be entirely in your name, even if both names are contained by the mortgage, if you were the lone borrower for the trade. Perhaps the note and mortgage are confusing. With respect to your question, it may be replied if the record is really reviewed by a lawyer. Yet, as a broad proposal, unless the deed provides that the life estate is revocable, you'd require the approval and participation of your boyfriend's parents to revoke it.

Q: If a horse boarder invests a large amount of money into building tack lockers in a barn, do they must be left for legal reasons?

The tack lockers were constructed, and fastened into the wall in a boarding facility with the verbal understanding that the owner of the house would pay for stuff. Of course now he maintains he never said that. He maintains that if they try to take them down when leaving which they are now section of the property, and he will be calling the state police. Hi, I am interested in people's views of the following: A friends daughter is 17 and last Friday passed her driving test to much family celebration. She went out driving to see her friends, grandparents, and to get some experience. No-one was seriously hurt but there are some stiff necks, bumps and bruises. She rolled the car after losing control over a hump back bridge. No other vehicles were involved but her own car is written off. The Police were called and paramedics. She is still on Provisional Insurance as the call hadn't been made to change the insurance, mum and dad were just moving money about so they can pay. The Police say she wasn't speeding just lacked experience and was taken by surprise on the road in question in the rain. So the questions for them are: 1. What is the legal position? Neither parent is concerned about making an insurance claim or anything like that. It was one of those awful moments in life and they are not interested in the value of the car just the welfare of the girls. 2. What does she have to present to the Police - I think they said that she would have to present her licence? 3. Do the parents have to tell the insurance company if they don't intend to claim? They are very honest people but don't want to do anything that would unnecessarily impact their daughters ability to move forward. 4. What should they do going forward with her? I am in the process of getting my own health insurance (can't be a dependent anymore) and I've been searching all morning for a plan that covers Medical, Dental, and Vision all in one. I can't seem to find any plans that offer that but I definitely need all of them. Hi I live in CA i just bought a new 2012 hyundai and went to get insurance through Freeway Insurance and I signed up for a 12 month premium with Farmers they did not tell me anything about a broker fee until after i signed all the paperwork. I am 20yrs old and paying $220 a month for full coverage. They charged me a $275 Broker fee I just want to no if this is even legal or if they ripped me off! I walked out spending $560.00 Are they allowed to charge such high fees I will call my credit card and have them refund it immediately if they ripped me off. Please help. Insurance company policy?

I was hit in a wreck. They're insurance company quoted me $400 and wrote me a check for it which I did not accept. All they did was look at the external damages. Then I took it to a dealer collision center and they quoted me $1100 and they guessed more damage was done but couldn't say unless they took apart my bumper. I'm not wanting to get it fixed in a shop since my father can fix it for me, but $400 is not going to cover the cost of fixing it. so my question is...
