What is the Importance of “Statement of Working” for the Patenting system in India?

Before understanding the importance of Statement of working, we need to gather knowledge of the basic terms in relation to the patenting system in India. A patent is an exclusive right given to the inventor for his invention that he has invented. That person is called a patentee, who has to make disclosure in the form of a statement of work to the Indian Patent office regarding the commercial exploitation of a patent in India.
Brief explanation of Statement of Working
The patentee or licensee has to submit a statement of work to the Indian patent office annually stating its commercial use or exploitation in India. It also verifies that whether the patent meets the reasonable requirements of the public besides stating the commercial exploitation of a patent registration. 
I ensure that if the patent did not come into execution for 3 years from the date of grant or reasonable requirement of the public is not met then third parties will be given an opportunity. 
Legal provisions of statement of working
According to section 146(2) and Rule 131 of Indian Patents Act, Statement of working needs to be submitted with the Indian Patent Office (IPO). The act defines Statement of working as, “In India, “Statement of Working '' needs to be filed with the authority on an annual basis. This statement gives disclosure regarding the extent up to which the patent has been worked on the commercial scale. The due date of filing such a statement is 31st March of every calendar year. For this, Form-27 is required to be filed each year within the period of 3 months from the end of the calendar year which can be filed online by the patentee/licensee/ patent agent/ attorney. If the patentee is not in India then the application can be filed by contacting an Indian patent agent/ attorney.”

If the inventio is worked then the value of the patent manufactured in India, or the value of the ptnet imported from the other country.

Compulsory License
At the time of providing or granting compulsory license, details mentioned in the statement of working are used. IPAB (Intellectual Property Appellate Board) takes decisions while granting compulsory licenses. The decision has been taken by IPAB in the case of Bayer Corporation Vs Natco Pharma Ltd.
Penalty Provisions in case of Non-compliance
The legal status of the patent is not affected by the non-filing of the statement of working or filing of the “Not worked '' statement thus it is not deemed as abandoned or cancelled.
However it may attract criminal penalties in case of non filing of working statements or knowingly furnishing incorrect statements. The penalty provisions are described under section 122(1)(b), if the patentee or licensee fails to submit information under section 146, then the fine of Rs. 10 Lakhs may be imposed.
In case wrong information is furnished by the licensee or the patentee then imprisonment for six months may be imposed. According to section 85 of Indian Patent Act, a patent can also be revoked on the ground of not working on a patent invention.
Patent litigation
At the time of infringement suit, working or non-working of of atent is seen as an important factor. As per section 108 of Indian patent act, the patentee can claim for damages and injunction and for an account of profit as relief in case of suits relating to patent infringement. 
The court considers the statement of works in order to estimate the actual damages claimed.

Statement of working is very important to give in order to give insights regarding the effectiveness of the patenting system in India. Statement of working is available on the website of India patent office. The statement of working is being submitted by the patentee in the preceding year.

CDSCO Import License for Medical Devices
Applicable when we have to import medical devices from other countries to India. However they need to be classified according to CDSCO notified devices list. CDSCO has complete procedure for granting license for medical device imported in the countries.
Application for grant of import license
An authorized agent (who must have wholesale license for local distribution) having license to manufacture for sale or distribution or wholesale license for sale or distribution under these rules, shall make an application for grant of import license for medical device to the Central Licensing Authority through an identified online portal of the Ministry of Health and Family Welfare in the Central Government in Form MD-14 for obtaining a license.
Where the Central Licensing Authority, has reason to believe that the quality of the medical device is compromised, and decides to subject to its evaluation, tests or evaluation, test or examination, to the testing laboratory as specified by the Central Licensing Authority.
After examining the documents along with the application on the basis of the inspection report, if the inspection has been done by the Central Licensing Authority can be satisfied, grant license in Form MD-15 may reject this application for this reasons shall be recorded in writing within the time of nine months from the date of the application.
In the process of rejection the applicant can make an appeal to the Central Government within the time of forty five days and that the Government, may after the enquiry in this matter pass order in relation there within the time of ninety days from the date of appeal.

Selection procedure:
Candidates are shortlisted for an interview based on their performance in the National Entrance Test and/or academic performance. The selection is based on the performance in the interview (in some of the departments, an aptitude test/preliminary interview will precede the interview/final interview).
Note:
Candidates called for the interview held in June 2020 in any one of the departments mentioned above are also eligible to apply again. And the cut-off remains the same as fixed for August 2020 admissions.
Reservation/concession/relaxations for EWS/ OBC/ SC/ ST/ Persons with disability (PwD) and Kashmiri-Migrants (KM), including Kashmiri Pandits/Kashmiri Hindu Families: As per the Government of India rules.
The minimum class prescribed in the qualifying examination is relaxed to a “Pass Class” for SC/ST candidates.
Note: Candidates who had applied for August 2020 admissions and later exercised an option (on the admission portal in June 2020 ) for the deferred interview in the next admission cycle need not apply again. These candidates can access their filled application form by logging onto https://admissions.iisc.ac.in/ using existing credentials.

AP EAMCET 2020: All You Need to Know about the Counselling Process
The results for the Andhra Pradesh Engineering Agriculture and Medical Common Entrance Test (AP EAMCET 2020) have been declared on the official website on Saturday, October 10. Those aspirants who have made the cut will soon be eligible to apply for the counselling process. The results are announced on the official website at sche.ap.gov.in.
Here are a few things that one should keep in mind for the AP EAMCET 2020 counselling process:
The AP EAMCET counselling 2020, will be held only in online mode. Only those aspirants who qualify in the entrance exam will be eligible for the AP EAMCET 2020 counselling process.
Those candidates who make the cut will also have to ensure that they make online payment of counselling fees, registration for counselling, document verification at designated reporting centres, choice filling and locking and allotment of seats.
The AP EAMCET 2020 seat allotment will be done only on the basis of marks that a candidate is able to score in AP EAMCET through the counselling process.
Once the process of seat allotment for AP EAMCET 2020 is done, the selected candidates will have to report to the institute that is allotted to them. Those who fail to report, their admission will be cancelled.
The Andhra Pradesh Engineering Agriculture and Medical Common Entrance Test 2020 was conducted from September 17 to September 23. The exam was carried out in two shifts, the first one was from 9 AM and to 12 PM and the second one was from 3 PM and to 6 PM.
The number of slots for AP EAMCET 2020 had been increased by the authorities in view of the novel coronavirus. Along with this apt measures like thorough sanitation of the exam centre, checking temperature of each person through contactless thermometer was also ensured.
After clearing the entrance examintion, candidates can take admission in various courses offered by the universities and institutions in the State. The courses offered are as follows : B. Pharmacy, Pharma. D., B Tech (Agr. Engg.), engineering, bio-technology, B.Sc. (Ag)/ B.Sc. (Hort)/ B.V.Sc. & A.H/B.F.Sc, B.Tech (dairy technology) and B Tech (Food Science and Technology)

Government Classifies Medical Devices As Drugs To Improve Quality And Price Control
In a notification released on 11th February, 2020, the Central Government in consultation with the Drugs Technical Advisory Board(DTAB) classified medical devices as drugs w.e.f 1st April, 2020.

The definition of devices to be classified as drugs covers all existing medical devices being sold in the market, ranging from disposable syringes to MRI and CT Scan equipment.
Prior to this notification, only 23 medical devices were classified as drugs and were required to undergo the deliberate registration and analysis procedure.
The devices shall also be registered in CDSCO's online registration system from now. However, using the online registration system will be voluntary for a period of 18 months and mandatory thereafter.
What’s Good?
While the drug license registration process is a very detailed and comprehensive application procedure, involving months of careful analysis, trials and approvals. Medical devices(mainly low and medium risk) enjoyed a more lenient process of registration and control.
Devices such as disposable syringes, disinfectants, surgical gloves classified as Class A or B were either not required to obtain a registration or the regulation was not very strict. This often resulted in sub-standard and forfeited products on the market which lacked quality and were probable of causing harm to the safety of the user.
Bringing medical devices under the category of drugs will ensure that better and high quality manufacturing procedures are followed. Resulting in more refined and better quality products being sold in the market.
This would also prevent duplicacy of products and will offer manufacturers a healthy and competitive market.
What’s Bad?
Classifying medical devices as drugs will result in more stringent approval and inspection procedures. That may greatly affect small and medium businesses manufacturing low risk Class A or B devices like masks or gloves. Not every manufacturer can bear the expenses of the drug licensing process. Especially if he/she manufactures multiple devices.
Important Considerations
Even being a groundbreaking event, this reclassification is neither unexpected nor immediate. The authorities have been pondering over this matter for more than an year and have outlooked every possible aspect.
These new rules are not immediate in effect. Since Class A&B medical devices have been exempted from compliance for a period of 30 months from 1st April, 2020. Whereas Class C & D devices have been provided relaxation for a period of 42 months.
India is the fourth largest medical device market in Asia. While the sale of medical devices covers 30% of the total Indian pharma market.
With that said, this reclassification will ensure that the quality of medical devices sold in India is up to the mark and comparable to global standards.
