“Fuck the Mage” – a look at the politics of Carry On’s most and least popular characters
I’ve written this not to try and make anyone feel bad about liking Baz, or Fiona, or Natasha, or any of Baz’s family (I like Baz and Baz’s family). I haven’t even written it to try and make it OK to like the Mage, or to stop it being OK not to like him. (It’s OK to not like him – he’s a bad guy.)
But we’re coming up to another general election. Today is actually the day of the Conservative party manifesto launch! And I said I would write this to @basic-banshee, who I like and admire, and who was right to say Baz is a Tory earlier in the week.
It feels like the right time.
I should also say now that I don’t closely follow politics. This isn’t my specialist subject. I’m just British and I live with a hardcore socialist.
I also think I said all of these things in The Mage’s Heir already, so if you want you can read that instead. It has vampire sex too, which this doesn’t.

"One will come to end us; and one will bring his fall” - the narrative drive of the Chosen One story
It is a truth universally acknowledged that ‘Carry On’ is based on ‘Harry Potter’. More than that, though, it’s specifically a challenge to the kind of book that Potter is – in which a hero is chosen and fulfils his destiny defeating the big bad. It purposefully subverts the expectations of readers familiar with that sort of story.
That means that, where the villain in ‘Harry Potter’ is a racial supremacist who is obviously and actively evil, the supposed big-bad villain in ‘Carry On’ doesn’t really exist. The Humdrum is just an echo of Simon, who by the end of the book identifies himself as the villain as well as the hero. This is a neat twist on the format. It isn’t supposed to be an argument that all heroes are actually the causes of their own destruction, although you could read it that way.
The real villain is the Mage. Who in classic Dumbledore fashion left Simon to be raised in horrible conditions and never gave him enough information to make his own choices. He also murders Ebb, locks Baz in a coffin in inhumane conditions, and let vampires into Watford – an event that directly or indirectly led to the death of Natasha Grimm-Pitch.
This is again a twist on the format. The Mage fills the role of the wise mentor and we find out as early as ‘Fangirl’ that he’s Simon’s father. Even though there’s a strong movement that argues that Dumbledore is a manipulative dick who used to date a Nazi, I don’t think anyone would call him the villain of Potter. He’s still far more good than bad and he’s still absolutely necessary in helping Harry work out how to defeat Voldemort.
That’s why the Mage has to be the villain – it’s because you wouldn’t expect it of the person in his narrative role or with his political views. (I’d guess it’s not supposed to be a statement about all wise mentors, though it could be. Or even all socialist reformers.) It’s also because the kinds of things that Dumbledore did to Harry are worse when viewed through the more personal lens of YA romance, rather than the more traditional school-story fantasy of Potter.
Fandom is essentially united in its absolute condemnation of the Mage as a character.
He’s almost always written as an abusive father in fic. (This is particularly noticeable for me in non-magic AUs where he often physically and mentally hurts Simon outside of the fantasy genre where sending a child to take on a dragon is loosely acceptable.)
Penny tells us that he’s sexist (although Agatha – who also doesn’t like the Mage – points out that it’s possible the Mage just hates everyone). Penny tells us that anyone can call themselves the ‘Great Reformer’ and she’s right. The Mage’s Men are actively equated to Nazis through their raids, which is backed up by other familiar emotive language like ‘banned books, banned phrases’.
But the thing is, the Mage really was a great reformer. And Baz’s family really were a bunch of privileged, self-centred assholes who deserved not to be in charge, no matter how much we like them. We don’t talk about it much, beyond how Malcolm’s (very standardly conservative) homophobia affects Baz on a personal level, because the emotions of the story lead us down a different path.
Baz is the romantic hero, Natasha Pitch is his dead and wronged mother, and the Mage is the villain. Not because he’s a Nazi (he isn’t). Not even because he killed Ebb or imprisoned Baz.
It’s primarily because, unlike Natasha, he isn’t a good parent.
Which is fine. It makes sense for all the reasons above, and the Mage is a bad parent
But the problem with ‘Carry On’ being an inversion of the tropes of traditional narratives is that we end up with a canon that (even though it’s full of POC characters and gay characters and disabled characters) almost asks us to be OK with the politics of Baz’s family and class, because we like Baz and we don’t like the Mage.
And they’re not really OK.
“Not one of ours” – the Old Families as Conservatives
I’ll talk more about the Mage later, but he exists as a reaction to the Pitches, so let’s talk about their political leanings first. Specifically, I’m going to talk about Loyalty, The Other, Vampires, and Taxes.
Ban wrote a nice and also brief description of what Conservatives/Tories are to start you off, if you didn’t read it. Later an anon (sorry if this was you!) said that Rainbow would never have really meant for Baz to be read as a Tory.
But I’m pretty sure she did and I respect how much she didn’t shy away from it.
In fact, the only way I can imagine Baz and his family not voting Conservative/Tory is if they just didn’t vote at all, because they thought Normal politics were unimportant. Which is also a highly privileged position to take as it assumes that none of them will ever need to take advantage of Normal public services and that it’s no concern of theirs what happens to everyone else in the country i.e. this is the one situation where not voting Tory is actually the most Tory thing you could ever do.
1. Loyalty
Now obviously Baz’s family do care – passionately – about the people they care about. This is one of their most appealing characteristics as characters. It’s very likeable and understandable. Rainbow has suggested Baz is a Hufflepuff. Hardworking – and (this is the key) loyal. I see it, although I think he would have turned out very differently if he’d been told from the age of eleven that this is who he was, rather than being essentially told he was a Slytherin. But that’s a detour.
The problem with being loyal is that there are people you aren’t loyal to, and you can see this clearly in the Pitches. The people they love must be protected, even at the expense of everyone else. Its barely a choice. Although the Pitches would never betray each other, they’re famous betrayers.
I adore Fiona, she’s one of my favourite characters. But she is also – as Rainbow stated recently – ‘a dangerous lunatic’. She is hardly bothered when the specific action that she insights Baz (a child) to take against Simon (a child who hasn’t done anything to her) causes Philippa Stainton (another child who really hasn’t done anything to her) to be permanently disabled.
Baz is almost unable to comment on how this event makes him feel even in his POV - probably because he’s loyal and he doesn’t want to criticise Fiona. Although we know it causes him to stop trying to kill Simon, so I’d guess that it troubled him, even if it didn’t trouble Fiona. (We’ll come back to Baz as part of his family later.)
2. The Other
If Natasha were still in charge of Watford, Trixie wouldn’t be allowed to attend. Gareth wouldn’t be allowed to attend. Simon wouldn’t be allowed to attend. The Minotaur worked on the grounds, since ‘creatures weren’t allowed on the staff’ (which is horrifically racist language, even if it’s true.)
Oddly, Simon is able to voice this within the text (probably because he’s been hanging around with the Mage so much), although his opinion is disregarded because it sounds naïve and because even he tell us that he doesn’t understand what’s going on.
“I still don’t think it’s a war,” Agatha insists. “It’s just politics, just like in the Normal world. The Mage has power, and the Old Families want it back. They’ll bitch and moan and cut deals and throw parties---” “It’s not just politics.” Simon leans towards her, pointing. “It’s right and wrong.” Agatha rolls her eyes. “But that’s what the other side says, too.” … “It’s not just politics,” he says again. “It’s right. And wrong. It’s our lives. If the Old Families had their way, I wouldn’t even be here. They wouldn’t have let me into Watford.” “But that wasn’t personal, Simon,” Agatha says. “It’s because you’re a Normal.”
Firstly – it probably was personal, let’s face it. But secondly – even if it wasn’t personal-personal, it’s still an example of a prejudice that echoes the distain people like the Malfoys have for ‘Mudbloods’. Just because Simon could be the first Normal to gain magic, doesn’t mean he shouldn’t be allowed to join Watford. The Mage shouldn’t have to give him a title and a sword just to get him in.
Simon’s right, even if he doesn’t mean it this way. Politics affects people’s lives.
“Ask Natasha Grimm-Pitch about suicide rates among low-magicians,” the Mage tells Mitali Bunce – who is right that killing people isn’t the answer, but also not nearly as progressive as she thinks she is. “Ask your Coven what they’re doing to fight pixie sticks and every other magickal disease that doesn’t affect their own sons and daughters.
3. Vampires as a specific example of the Other
Natasha and the Old Families were in charge when Nicodemus Petty joined the vampires. It wasn’t the Mage who struck Nicodemus’s name from the book and pulled out his fangs. Which we’re told is fine, actually, because it’s against Mage Law. Even though the idea of this happening to Baz is horrific and unthinkable, and even though we have no evidence that Nicky ever killed anyone. Just that he wasn’t human.
If you’ve read ‘The Mage’s Heir’ you’ll know I think Nicky is a very interesting character to bring into this space. He’s powerful and he’s innovative, inventing spells Baz has never heard of even after he has his magic taken away from him. He’s like the Mage, and like the Mage (who is from Wales, which is traditionally a very poor area of the UK), he’s clearly from a low-class family. The accent that both he and Ebb have is East-End London, which means they’re poor. Even though they’re powerful magicians and therefore theoretically as valid as the Pitches in the Pitch-world order.
Yes, he chose to become a vampire and Baz didn’t but partly he’s punished for being poor and trying to become more powerful in a way that the Pitches don’t understand. He wasn’t necessarily going to kill anyone.
Are vampires even bad?
Because Baz isn’t bad – or not just because he’s a vampire, anyway. We see Simon wrestling with this in ‘Wayward Son’ and he struggles because of his personal hatred for Lamb.
Even (and perhaps especially) under the Mage, the World of Mages just uniformly accepts that a whole group is evil. I think ‘Wayward Son’ begins to trouble this, even as Lamb betrays Baz and vampires are the enemy. But we find Baz actually thinking: “I’m not used to thinking of vampires as fellow victims.”
What he means is that he’s not used to thinking of them as people.
It’s completely appalling to keep Baz in a coffin – I’m sure we all agree with that. If it was another vampire, would the Old Families and the rest of the World of Mages feel the same way, or would they think that was a proportionate response?
When we talk about the death of Natasha Pitch we talk about the Humdrum having killed her, or the Mage having killed her. The vampires are presented as a random instrument of death (which if they had been taken over the Humdrum they would have been), rather than people who were paid by the Mage to do something.
The way the situation is presented to us in the Record, by Natasha herself, and by popular memory is that monsters broke into the nursery and would have killed Baz and Natasha if she hadn’t responded as she did.
However, Nicky says to Baz: “For what it’s worth, I don’t think he meant for your mum to die – but I don’t think he minded much. Made everything a lot easier.”
So it’s at least worth contemplating a reality where this is what happened:
The Mage paid vampires to break into Watford and cause a disturbance. He didn’t think anyone would die.
One of the vampires bit Baz but didn’t intend to either kill or Turn him, which we know is now a possibility but which nobody in the World of Mages had ever bothered to find out.
Even if the vampires did intend to Turn Baz, it could easily be a political statement – an opportunity to show that even a Pitch could be a vampire and that the World of Mages might like to reappraise its choices.
When Natasha arrived, she saw her son being threatened, acted on her prejudices and didn’t ask questions. She murdered a large group of people who had broken into her school, but who otherwise hadn’t necessarily done anything wrong.
I don’t say this is what happened, just that it’s a possibility.
Even if these vampires are evil and this was a terrorist attack (a phrase I’m using deliberately) the fact that presumably most of the others aren’t evil is still relevant. We barely scratch the surface of what this means for the World of Mages even in ‘Wayward Son’.
One of the things I think that’s most interesting about the Mage’s rise to power is that he does using the same hateful speech that the Old Families use, just exclusively directed against the Dark Creatures, rather than all creatures and low-powered magicians. It probably made it easier for him to gain support because these are views that everyone holds, but it’s completely at odds with his whole stated reason for being in charge.
Definitely not ideal. We do deserve better.
4. Taxes
Baz also tells us that his family are against the idea of taxation, which the Mage has introduced largely to benefit people who aren’t like Baz.
‘Taxes to cover all the Mage’s initiatives; most notably to pay for every faun bastard and centaur cousin, and every pathetic excuse for a magician in the Realm to attend Watford. The World of Mages never had taxes before. Taxes were for Normals, we had standards instead.’
I’m writing this post in November 2019, about a week after the Labour manifesto has dropped. It has this to say about taxes:
Universal public services, collectively provided through general taxation and free at the point of use for all, are how we guarantee the right to a good life. Public services do more than make sure everyone has the basics. They create shared experiences and strengthen social bonds. They make our lives richer and more fulfilling. A decade of Tory cuts has pushed our public services to breaking point. Labour offers real change – we will make Britain’s public services the best and most extensive in the world. We will pay for this by creating a fairer taxation system, asking for a little more from those with the broadest shoulders, and making sure that everyone pays what they owe. We will reverse some of the Tories’ cuts to corporation tax while keeping rates lower than in 2010. We’ll ask those who earn more than £80,000 a year to pay a little more income tax, while freezing National Insurance and income tax rates for everyone else. We will end the unfairness that sees income from wealth taxed at lower rates than income from work. VAT is a regressive tax that hits the poorest hardest and we guarantee no increases in VAT.
The Conservatives have launched a rival site called https://www.labourmanifesto.co.uk/ It has this to say about taxes:
“Hardworking taxpayers would have to pay an extra £2,400 each year in tax on average to cover Jeremy Corbyn’s reckless spending.”
The language of the Conservative party is about how higher taxes will negatively affect you the voter, rather than benefit the whole country. It’s also about tradition and how brilliant it is.
We Will Put You First Getting Brexit done. Investing in our public services and infrastructure. Supporting workers and families. Strengthening the Union. Unleashing Britain’s potential. The future is there for us to grasp. Not a future in which we endlessly refight the battles of Brexit and the Scottish independence referendum, or in which Jeremy Corbyn and John McDonnell – propped up by Nicola Sturgeon – lead a Government which rejects everything that has made the UK great.
I’m not saying traditions aren’t important (unless they’re bad traditions – like imperialism, which made the UK great, for sure), but they’re definitely less important than helping large groups of people through public service. Also Brexit sucks and is incredibly bad for the economy the Tories claim is so important to them.
If you aren’t from the UK (as I’d assume most readers aren’t), it may not be so cripplingly obvious that Baz’s family are rich therefore Conservative. But they’re also conservative – and therefore Conservative.
“a Tory vampire” – Baz’s own politics
Baz is a version of Draco Malfoy, who calls Hermione a ‘Mudblood’ and supports Umbridge and then Voldemort, although he later regrets it.
I haven’t really read any Harry/Draco (I was in Wolfstar), but I’m guessing that a lot of the fic builds on the fact that Draco cries in a bathroom, is unable to go through with murdering Dumbledore and Harry, and that his family ultimately decide to leave the Final Battle rather than support Voldemort. I’d guess that we argue that he was young and stupid, didn’t understand the full impact of what he was doing until it was too late, and then had to stay with the Death Eaters because he was afraid for his life and the lives of his family.
Baz, I am arguing, comes from a similar upbringing and has similar beliefs, even if he never got to the murdering Mudbloods stage. (He’s given an out in a way by never being in power when we see him.)
I’d also argue – because I really like Baz and I don’t want him to be ‘racist and speciest’ – that his actions and beliefs are, like Draco’s, massively affected by situational factors outside of his control. And that he, too, was young and stupid. I find it almost impossible that he could arrive at Watford with any other ideology – and I say this as an ex-Remus/Sirius shipper, who clearly found it totally reasonable that Sirius would hate his family and side immediately with a bunch of do-gooding Gryffindors.
The key there, though, is that Sirius hates his family; whereas Baz and Draco love their families and are (see above) incredibly loyal to them. One of the reason it’s easy for me to sit here and say ‘voting Conservative isn’t a thing I would ever do’ is that my family are hardcore ‘Not Conservative’ voters. If I ultimately decided I didn’t agree with them, I could do that, but I started out thinking they were probably right. This is the case with Baz and Draco – they have further to go than someone like Penny who was raised by Mitali and still tells Shepard that imagining being a Normal is like imagining being a frog.
I think Baz is a more sympathetic character than Draco Malfoy by a long way, but Draco has a strong justification for being more evil in that Voldemort will literally murder him if he doesn’t perform hateful actions. Baz merely worries that the Mage will “drive his whole family out of magic”��if he doesn’t fight Simon, which is a bit of a weak argument when you think about it.
What has the Mage actually done? He’s forced the Old Families off the Coven – of course he did. They would have voted against his reforms. He’s raided their houses for dark objects that they do actually have. He doesn’t let them meet in large groups – which is an edict that they’re clearly ignoring given that the Club (so Tory) exists and also that the Old Families do actually have a Consortium that meets to try and work out how to seize power through potentially illegal means.
Are these actions designed to win the love of the Old Families? Of course not. Could there have been better, less repressive strategies? Yes, absolutely.
But how empty are Baz’s coffers really? They still have at least two massive houses that we know about. They’re not exactly on the streets.
All that aside though, Baz does have a very good reason for acting the way he does, much better than Malfoy. His entire life that has been warped around his mother’s death.
The fact that she’s dead, and that she died in (arguably) heroic circumstances, makes it very difficult for Baz to think of her as anything other than completely perfect and right about everything. Even when he thinks about how she’d probably kill him for being a vampire, even though he knows that he’s never hurt anyone and therefore does not deserve to die, even then he still thinks that she must be right and that he is a monster who deserves to die. Fiona has exactly the same reaction.
Because he thinks his mother was perfect and because everyone around him tells him what a good headmistress she was (and because the Mage is presumably very bad at this part of his job), he also has to regret the fact that she isn’t in charge of the school anymore. Education is important to him.
And the timing of Natasha’s death is also specifically and strongly linked to the loss of power, and the two are inextricably bound together. If Baz is to love and honour his mother, to regret her loss, he must also regret the loss of the things that she stood for.
Now the Mage isn’t in power anymore, and Baz’s mother is at peace, he probably can start to think differently about the way the society is structured.
I believe that ‘Wayward Son’ – in which I don’t think Baz thinks a single racist thing, and instead queries the idea of going to America given the ‘current political climate’ – shows that he’s already starting to consider his view on the world differently.
Part of this is because of who he is personally. He’s gay – and of course he’s a vampire, both of which wouldn’t normally be acceptable to his family. (Although you can be gay and a powerful Conservative, of course. It’s much less unacceptable than being poor.) (Incidentally, I know you didn’t ask, but I don’t think the Mage would care if Simon was gay. He’s a liberal. He’d want to be OK with it, even if he wasn’t. But he’d care that Simon was dating a Tory and would definitely try and forbid it.)
Baz has more reason than any other Pitch to reassess his family’s politics, because they negatively affect him personally.
The trick will be to see if he can look outwards from himself, and care about things that don’t help him at all. Which I think he can.
“He’s still more good than bad, I think” – the Mage and his poor decisions
OK, here we go. The most controversial part.
So, the Mage is the villain and is also a bad guy who left Simon in a home, tortured Baz, killed people, and incited hate against vampires. As I said right at the beginning, I’m not going to argue that you should forgive or even like him because ultimately I can’t if eighth year plays out as it does in canon.
But Lucy tells us that we shouldn’t take him as a straight-forward villain and if we’re willing to give the Pitches the benefit of the doubt over some things, I think we should at least give it a try for the Mage.
Here’s what I’ve got.
1. The political situation at the start of ‘Carry On’
In a story where the Mage was the hero, the book would have finished where he got into power. We’ve defeated the evil oppressive empire and now it’s a chance for reforms, hurrah! Everything will probably be good.
What we actually find at the beginning of Simon’s eighth year is that the Mage has been fighting the Old Families solidly for the last twelve years. They’ve resisted absolutely everything he’s tried to do, and far from being powerless now they’re not in charge, they’re actively and effectively using extreme wealth to obstruct the process of normal government:
“Half of Wales has stopped tithing. The Pitches are paying three members of the Coven to stay away from meetings, so we don’t have quorum. And there have been skirmishes up and down the road to London all summer long.” “Skirmishes?” “Traps, tussles. Tests – they’re all tests, Simon. You know the Old Families would seize the reins if they thought for a moment I was distracted. They’d roll back everything we’ve accomplished.” “Do they think they can fight the Humdrum without us?” “I think they’re so shortsighted,” he says, looking over at me “that they don’t care.”
Now, obviously, this is the Mage’s viewpoint on what is happening and so can’t be trusted in terms of the Old Families motivations. We also can’t ask them because we only hear from Baz (and once, briefly, from Fiona) who has his own view of the world which is coloured massively by his relationship with Simon and his mother.
Shockingly Simon again said it best: “That’s the problem with all the Pitches and their allies – it’s impossible to tell when they’re up to something and when they’re just being people.”
I sort of expect that the Mage is right, though, based on everything I know and feel about the Old Families. The Humdrum hasn’t directly affected them – or it doesn’t until the hole in Hampshire – meanwhile the Mage “will drive them out of magic.” (Will he though? Or will taxing people who earn over £80k a year not actually affect their lifestyle all that much?)
To be fair, I think the Mage probably thinks that the Old Families are the greater threat as well - they were the threat that he summoned the Greatest Mage to fight – although it’s the threat of the Humdrum that drives him to try and take Ebb’s magic.
I’m not saying that if they cooperated the Mage would have been able to work out what to do about the Humdrum, but their refusal to acknowledge that fighting the threat is important is probably infuriating.
2. He’s alone, overworked, and doesn’t trust anyone
The Mage has the two most important jobs in the World of Mages. It’s strongly implied that these were held by separate people before he took them both. And the reason he took them both is that I doubt he thought anyone else could be trusted, because until he became a political figure, only one person had ever treated him as anything other than a complete lunatic. After that, he gets people like Premal and the Mage’s Men (and Simon and Lucy) who obsessively and unquestioningly follow him, which also can’t be good for him.
He probably wasn’t very old when he worked out how to summon the Greatest Mage, probably 22-23. He doesn’t go to university and took power before he was 30, well before most Normal politicians. (Natasha, obviously, also wasn’t very old, so take that as you will.)
He’s doing two incredibly difficult jobs at a time when there’s a world-level threat (that admittedly he caused, but by accident) as well as a constant political threat. Of course he’s shit at both of them. Of course he didn’t think he could take care of a child on his own while this was happening.
He doesn’t have Dumbledore’s excuse of ‘Old Magic’ keeping Simon safe during the holidays, but I think he probably thinks it’s for the best and doesn’t see many other options when he’s so time-poor himself.
He doesn’t have any friends and never has done, because he’s never valued the personal over the global. He doesn’t have time for friends and family; finds it impossible to forgive the lightest of slights, like Mitali valuing tradition as well as wanting change; and even if he did have time for friends and found someone to be friends with, he wouldn’t be willing to spend time enjoying himself while what he perceived to be injustice was going on. People have headcanon-ed Simon as autistic before; if he is, it’s not impossible he got it from his father.
By the time we see him in ‘Carry On’, I assume the Mage is exhausted and angry and making the worst decisions of his life in an attempt to try and stop the Humdrum from destroying the world.
That doesn’t justify any of them, but I think it puts them into perspective. And for me – it means he is redeemable in an AU if you avert Baz’s kidnapping, which is unforgiveable even if you assume he didn’t know how the numpties would treat him.
It doesn’t mean he will have been a better father to Simon, though. Simon will still have had to have grown up scared and hungry and alone, for the greater good.
So it depends what you think makes a villain.
The end:
This essay was a lot longer than I thought it was going to be. It took me some time to write, and presumably longer for you to read than you might have expected, so thank you for getting to this point.

I’m also turning over a thing in my head where Natasha is still alive, which will almost certainly be a lot gentler than this, because I barely talk here about the good things about Natasha and the Pitches of which there are many. But which will show a lot of the above playing out – like Penny’s roommate just won’t be Trixie anymore.
I hope ‘Any Way the Wind Blows’ has something to say about politics that isn’t just tied to the Mage!
I think it’ll be easier to tell what’s really going on without him being there.
And please, if you live in the UK - even if you want to vote Conservative - register to vote before the 26th of November.
But also - consider not voting Conservative.

Over the last few years I've been posting more and more of my actual views, which I'm not exactly ashamed of but realise they're not so much unpopular opinions as downright rejected ones. I pretty much know why I have them, I'm aware of my biases and make every effort to restrict them to words, not allowing them to affect my relationships or treatment of others, restricting the hyperbole and rants to this blog and my long suffering partner. Unfortunately I seem to attract the worst kind of women in real life, which is not at all helping. Every time I reveal something I worry about being rejected, told I'm a monster, a failure, a disgrace, an embarrassment, but each and every time I've gotten nothing but acceptance. I am greatly honoured by your support thus far, for tolerating my increasingly frustrated outbursts and hope I won't push you away with this, but it's been all consuming for almost my whole life, and part of “cleaning up my room” is putting all that baggage out there to be scrutinised and hopefully understood, sometimes all that is needed is a willing ear, suppression only breeding resentment and isolation.
All the bullshit feminism has caused, from protesting the male pill and shutting down shared parenting efforts to the Duluth model and erasing men who are raped by women or by counting them under "violence against women" stats to boost the female victim numbers. Mary Koss, the progenitor of the 1 in 5/4/3/-69/ π r2 stat claiming that it's "inappropriate" to consider male victims of forceful envelopment by women as they are merely ambivalent about their own desires. Lobbying for laws that regard mutually drunk sexual encounters as automatically rape by men, underage consensually sexually active couples (even if they're months away from age of consent or the girl is older) as child rape on the part of the boy, guilty until proven innocent, accusation is the evidence, kangaroo courts, sentencing discounts on top of the preexisting bias which causes a 63% disparity and difference in treatment to the point where if you take every step of the justice system into account the crime rate is pretty damned even (with women often using proxy violence so they have plausible deniability, and avoid responsibility/physical risk). Treating women as the definitive victims of prostitution no matter which side of the transaction they're on. Banning men from charity fundraising events, transpeople only allowed if they provide evidence that they are biologically female. Having the NHS class women choosing to have genital piercings as being victims of female genital mutilation, while male genital mutilation performed at birth is not so much as frowned upon let alone illegal by any single country on the entire twatting planet. In fact you can buy some baby foreskins if you want to, or rub them on your face, the target market being protected from the very process that brought them their anti-ageing face cream, complaining that it costs more than men's moisturiser.
The innate gynocentrism of humanity has always led to women being their top priority, now even above children, it tries to pander, and acquiesce to their every demand while being told it hates them. The cases like the woman who filmed herself raping her own baby and getting the oh so harsh sentence of community bloody service and house arrest. The "poor, neglected" woman whose husband had become distant from her (wonder why) so she raped her son's friend, whose punishment was being banned from his school, which she considered too harsh as she missed her son's graduation. An audience of hundreds of normal regular women cheering and celebrating a man being drugged by his wife, who then cut off his penis and threw it in the "garbage disposal" permanently destroying it, just for asking for a divorce (can't think why he'd want to leave), despite no further context it was declared "fabulous" to the ecstatic jubilation of the empathetic sex. There's the idea that men commit the vast majority of rapes while calling female teachers "seducing" their students mere trysts, shameful liaisons that do not deserve prison, female prison guards committing the overwhelming majority of rape of male children and youths in juvenile detention (89%), among other women who rape men and boys (my own mother being one of them), this in addition to the rape rate among female prisoners being 3 times that of male ones, not a single damned thing is done about the propagation of the bullshit narrative. Somehow the fact that female rapists tend to target children is irrelevant because male ones target adult women, and "you don't see women going around raping adult men" (even though the stats are still around 50/50 because it's a human problem, unless those women are exhibiting toxic masculinity or something). There's the 10,000 men and boys slaughtered in their schools by Boko Haram while girls were released and allowed to go home, the boys being set on fire, their throats slit, or shot if trying to escape, no one giving the slightest hint of the merest ghost of a toss, until they realised that they weren't getting the attention they craved so they kidnapped girls, causing an international outcry and the media/celebrities changing their motivation from "eradicate western education" to "oppress women and stop them getting an education". There's the refusal by both the left and the right to look beyond the plight of women when it comes to Islam, they not only ignore the laws which oppress men, but declare those men the "real" misogynist patriarchal oppressors and innately sociopathic rapists. There's the refusal to recognise that women are a part of society and have far more influence than anyone wants to admit. There's Muslim men's obligation towards women, the segregation in Saudi where they have many public places from which men are banned unless accompanied by a female family member, where they'll be arrested for accompanying a woman to whom he is not related while the woman is merely sent home, where men face potentially fatal consequences for the same "crimes". Where homeless boys in Pakistan are pretty much guaranteed to be repeatedly raped day after day.
Then in my own life, being 6 or 7 years old, my sister 8 or 9 and told to stay put as our Reliant Robin went up in flames, having to be pulled out by a stranger, a man, because we were more afraid of disobeying than of burning to death, mother not even sparing us a glance as she grieved the loss of her car, later keeping it in the garden like some sort of shrine. Around the same year, at an LRP event (Lorien Trust's The Gathering), being left in the tent alone late at night and going to look for her, finding her on top of an unconscious man, she at least picked up on the fact that I was revelling in her severe hangover the next morning. Sneaking downstairs one night to see the aftermath of one of her "encounters", the man was broken, so started my extreme protectiveness of men and distrust of women, to the point of being called a gender traitor for the first time at around 7 years old by my 60+ year old year 1 teacher (who also wouldn't allow me to use left handed scissors or to write left handed, unwittingly making me ambidextrous. Being left with a violent babysitter who made me sleep under the table, or on the floor beside her bed (despite having 4 bloody beds), who wouldn't let me eat since burning the toast, beat me for asking for a glass of water and wouldn't even allow me to drink out of the tap, she once threw me in a wheely bin and poured dishwater over me, mother was in the garden just a few doors down, yet did nothing. She’d always try and get her boyfriends to beat us but they always just laughed it off (they’d put up with abuse themselves but never lasted long after she started bringing us into it), one in particular was into BDSM and later got mother a job as a dominatrix (she was disappointed by our complete lack of surprise), and even he had to draw the line at demonstrating how sexual intercourse works to his girlfriend’s 6 and 8 year old daughters.
My sister and I as little more than toddlers, mother putting our onesies on backwards so we couldn't take them off, having to go to the loo with them still on. Having the door handles put on upside down so that we couldn't reach up enough to open it to get to the loo so we ended up pissing ourselves. Having a daily diet of four slices of bread and the cheapest of generic vegetable spread as we weren't allowed mother's butter, being starved as punishment or just because she felt like it (having won custody of us only to spite dad), leading to malabsorption and osteoarthritis at the grand old age of twenty bloody six (3 years ago now), once a week we got an actual meal. Being around 8 or 9, visiting my auntie who was in hospital after having a stroke, having already had MS she was left paralysed, just 23 years old, granddad put together a system for her to speak by grouping letters and having her blink once for the stated grouping or letter or twice for basically undo. I gave her my only teddy which I carried everywhere, a stuffed donkey I got from Spain, she kept it. Staying in her house, continuing my habit of accidentally setting fire to the toaster, being left alone most of the night and going to look for mother in the village pub, finding her in one of her drinking competitions, walking in and vagblocking her, much to her frustration and anger. Being treated like a replacement husband, even trying to talk me into having a sex change despite only mild dysphoria, which was later greatly lessened by having an implant which stopped periods, eliminating most of the feeling of wrong (most cases of sex change regret are people who were abused, either treated like shit for their biological sex, treated as if they are opposite sex, or sexual abuse). Hearing about how the only way she'd get any when she was with dad was when he was asleep. Why did he end up dying a slow, agonising death while she gets to carry on regardless? Asking me about who I liked, later discovering exactly why she wanted to know, a man I care about was raped because I didn’t pick up on her ulterior motives. Having mother and her friends try to teach me to manipulate men, get them to pay for me, trying to turn me into a gold digger, only making me hate them even more. Coming of age (16), no longer eligible for child benefit, mother having been visiting friends more and more often until she didn't come back, only finding out that she'd been gradually moving out when we got the eviction order.
I'd been training myself to eventually join the army from the age of 5, once when I was 6 mother had asked me to go to the supermarket to get a bag of potatoes, she usually got a 20kg sack, must have taken me an hour to get it home, a man helping me carry it some of the way. When I finally enlisted I had to stop taking codeine for the malabsorption, it wasn't as much of a problem if I was eating every day (I usually forget as my body had been conditioned by neglect, not even bothering to remind me to eat any more), my hips had always made crunching and cracking sounds when I move, but as my body adjusted to the lack of codiene the pain became unbearable, upon being diagnosed with osteoarthritis I had to give up any hope of ever being a soldier, I've lost my purpose, and have nothing to replace it with, couldn't even work a whole shift when I got a factory job, humiliating, I'd informed the woman of my condition and she'd assured me that it was just a machinist job. It wasn't. It was everything you shouldn't do if you have any sort of hip problems. I'd never felt such agony and I'd fractured my bloody skull (at an LRP event). The woman was such a nasty bitch about it, she went from compassionate and understanding to mocking me for being upset that I was so damned useless now. I offered to forfeit my pay but her colleague, who also had arthritis and could no longer work the floor, was obviously far more genuinely empathetic than the woman, my brief boss was also sympathetic and even paid for a taxi to take me home after I refused an ambulance. The pain didn't subside for days.
I've never had a female friend who hasn't betrayed me, my "best friend" in school found it hilarious to punch me in the back in the middle of class, causing me to yell inadvertently as the air was knocked out of me. In year 8 the other kids stepped up their game and went from throwing stones to a house brick, when I got back to school she asked where the stitches were, just so she could punch me and reopen the wound. I was never allowed to retaliate, it would always be me who would be threatened with expulsion even if I only snapped after years of beatings which everyone knew was happening. Every birthday the other kids would falsely accuse me of something so I'd have to spend break times stood outside the headmaster's office, the equivalent of the stocks. Whether it was asperger's making me so unlikeable or if I genuinely am just a massive thundercunt, I never found out what I did to provoke them. Every time I put my trust in a woman it gets thrown in my face. My neighbour decided she was my best friend for life and would call at all hours of the day and night to get me to pick up her bloody methadone twice a bloody week, go to the chippy at 11 o'bloody clock at night, she's always trying to get me to take the pills she buys off a disabled neighbour. There are three things I refuse to take, hormones, anti-depressants, and sleeping tablets and she's always trying to get me to take them. The last straw was when her husband, who I got on very well with and whom she abused constantly, died, I told her to be careful what she wished for. When I finally called her out on using me she leapt immediately to the "after all I've done for you" bollocks.
Time after bloody time it's the same damned story, even regular everyday normal women will talk about things that would get a man arrested or at least publicly lambasted, that erections equal consent, that MGM is not at all a violation of the right to bodily autonomy, that it's absolutely fine and dandy to hit your male partner only to call the police if he defends himself, that female paedophiles shouldn't be punished because boys always want sex no matter what age they are but girls mature younger, right the way back to "We should have the vote but not have to pay with our lives as men had to in their millions while we shamed men and even underage boys into doing the same". What terrified me as a child was women's ability to completely turn off their empathy, the "woman scorned" is seen as karmic justice, there are people defending even the most brutal crimes: assault, murder, rape, mutilation, over something as minor as rejection, or an accidental drive by fart, or just the crime of being a man who wanted a divorce. Empathetic sex my absolute arse.
A fellow MRA publicly humiliated Adam on a livestream when we went to the men's day march and conference, we were staying in an air B&B, Adam and Will Styles still riding the high of giving their first speeches, only for the woman to dredge up shit that was no one's bloody business and ruin the whole mood for no bloody reason, she also attacked 6oodfella on one of the hangouts. Another one was giving private information, with a vicious twist, poisoning the community against one of our group, Paul Elam didn't want to get involved and Janice Fiamengo immediately cut ties, treating him like a bloody criminal, what the hell did the woman say to her? I could see the Woolly Bumblebee thing coming a mile off, I worry whenever youtubers I like get girlfriends because they seem to either completely change or disappear, like Spino and Bread and Circuses respectively. I'm suspicious of female MRAs, I don't want to be but often even the sane ones are just tradcons. If it weren't for the Honeybadgers and you lot I'd have no hope at all.
The constant stream of "toxic masculinity", oppression, patriarchy, of women complaining that their air conditioned (which is also bloody sexist somehow), seated jobs at a till are paid less than the men (and women but they're not going to mention that) carrying heavy boxes, driving forklifts, working in a cold warehouse, and risking serious injury or death infinitely more than they ever will. The selfishness, solipsism, and sociopathy is too much. Throughout history women have never cared about men aside from ones they have a bond with, have never appreciated a damned thing men have done yet they demand that men prioritise them. Why should they?
I’ve seen and experienced the worst examples of female nature in action, “toxic femininity” if you will, and the difference in reaction to it, never being believed as a child no matter how many times I begged other family members and even strangers to please let me live with them instead, I’ll sleep in a tent, look I brought it with me. Pathetic, but you’d have thought someone would have cottoned on. I'm not going down the anti-women route as my sister has, given her own treatment of her partners and her own admission, she’s not so much pro male as anti-female, but it’s increasingly difficult not to resent them even if everything has a biological explanation. I still defend women if the facts bear it out, even if I don’t necessarily agree on a personal level, reals over feels, the people I agree with most also being female has definitely helped me not fall over the edge, one of whom feels very much as I do to the point where she doesn’t consider herself to be a woman due to her own observations and experiences. But the longer this goes on, the more laws are changed, media is poisoned, speech is suppressed, how the hell do I stop myself from just giving up entirely? How on earth can I stop myself from becoming an all out misogynist? Because it is women, not just feminists. It’s female nature being allowed to go unchecked, even when the same happens with male nature women are still prioritised. There are exceptions on both sides but it’s not enough to change the overall trend. There’s never been a balance, and because of human nature there never will be, which is where the problem lies. I know there’s no hope, that it’s utterly futile, completely pointless, and it’s driving me more towards extremism. I completely understand why we’ve lost so many MRAs to suicide. But I’m still going, even if the only way to make even the slightest change is to appeal to female self interest I’ll still do it. Everything I’ve been passionate about throughout my life is a pointless endeavour, I can’t stop myself from caring or change my fundamental character, it’s a downward spiral and there doesn’t seem to be anything I can do about it.

Dear Diary: About Jimin’s disappearance from Twitter and more...
So many things have been happening around Jimin lately. Thought i write a little diary to keep tabs on things, and to help future and current fans to learn about what is happening during certain time period. I’ll touch on his change in twitter posts / social media behaviour, death threats, and Fan Cam being reported and views disappearing from MNet’s official fan cam video.
Where to begin... let’s start from Fake Love promo period and Jimin’s twts I guess, since this is the first time I witnessed the hate towards Jimin directly in front of my eyes (that and i’m a new fan only started watching their stuff around October 2017?)
So on Jun 7, 2018 Jimin posted a twt from MNet’s backstage with a picture of the boys name on the wall. However, he forgot to put down V’s name, right after he discovered his mistake he quickly apologized and twt’ed two or three more tweets saying that he made a mistake and he loves V and next time he’ll make up for his mistake, something along those lines (dear readers you can go check those twts for yourself). However, when you look down on the comments it was filled with mostly “certain types of solo stans” (and yes I did go into those account to see what type of people is saying these mean things and going through their past twts) saying that Jimin is fake, and that he did it on purpose and other accusations towards Jimin. BTW a lot of those hateful comments were also the most popular ones so you can see them right away underneath his twt i think one or two of them even have 1k likes and couple hundred retweets. The hashtag JiminYouFakerKeepGoing was also showing up under Jimin’s name as the top searches associated to him in twitter. If you search for that hashtag now you can still see traces of it and people taking screenshots of those comments. Fans quickly responded by reporting these hateful comments towards Jimin to cleanse the comment section and also trended JiminYouNiceKeepGoing hashtag.
Now on Jun 10, 2018 after the mess on twitter, JM posted pictures featuring himself, JK and V with a hashtag that read something along the lines of IToldThemI’mGoingToPostThis in Korean. Now you can interpret it in different ways but if you’re a into Jikook or into shipping then I think you’ll read it like how I’ve read it, if you don’t know what shipping is my advice for you is stay away cause it’ll cause you so much grief, but all the situation will make so much more sense in terms of the events that are happening around Jimin.
Moving onto Jun 21, 2018 ... the last twt from Jimin on Twitter that felt more personal and not because he did it because he had to. The reason i’m saying this is, BTS tends to twt before they fly and before or after they go on stage or do some sort of performance. You’ll see alot of the members will post something. Now Jimin here though he’s the type to post random things other than the formal etiquette posts that everyone does. So he’ll shower us with videos of himself, selcas, picture with members, just really random little things to let the fans see him. But since Jun 21.. we got a twt for cosmetic product (according to older fans he’s never advertise in any of his twts before not to mention whoever posted didn’t know how to tag in twitter), and then we got a flying to Taipei twt and a thank you for attending the concert backstage twt. Etiquette posts... Now this boy ... usually twts every 3 or 4 days sometimes you’ll get multiple twts within a day, and even when they’re super busy he’ll still post something maybe within a two week period. you can go through their twitter by using #Jimin to see the pattern yourself. I remember when i first followed BTS on their twitter, i was like... wow Jimin likes to post so much he should stop posting and lay off on social media a little bit (this was back in December 2017), but now i miss him so much T_______T Please feed us Jimin!!!!!!!
Now, I know that from Jun 21, 2018- to Mid July he has posted on Fan Cafe, so he didn’t really entirely disappear from the fans’ sight. He answered fans’ question one of them was what’s the best BTS song, which Jimin replied Serendipity and another question was which song do you want to sing now the most, Jimin replied House of Cards. He also posted message for the 5th year anniversary for Army but so did everyone else, another etiquette post, I think he also posted something a day after the 5th year anniversary something on the lines of I was too tired and fell asleep and missed the day but happy Army Day. All of these posts can be found on BTS Fancafe translation twitter account. Back onto topic, to see posts from BTS on Fan Cafe you need to create an account, they’re not public like twitter where u can have hassle free access to feel connected to BTS. Also the Fan Cafe is regulated by moderators so any form of harassment posts are banned violation of cafe rules will also result in permanent ban too. Also, this is speculation here, I think the Fan Cafe has lesser I-army presence since to create an account everything appears in Korean, so it’s a lot more work to try to sign up for something, and people will have to go out of their way to make accounts to have access into website. I for one gave up on it, for now, but maybe in the future I’ll try to make an account there if Jimin decides to never return to Twitter and decided to post a lot on Fan Cafe. Ah and we also have to mention how they have different membership level so depending on what level you’re at you have restricted access to contents.. yeah that’s a lot of work for someone who can’t read any Korean at all Q.Q (life long goal: learn Korean so you can have full access to BTS contents)
I mentioned I-army specifically because.. all three death threats aimed at Jimin has been coming from the international side. First death threat was around WINGS Tour, the other two were during LY: Tour announcement. Can’t remember which concert they targeted but all three were planned for concerts in USA. Now you might think why international fans it could be fans from Korea too? Aren’t you being a bit extreme in your assumptions? But here’s my reasoning I could be wrong cause no one ever announced who gave out the threats. But let’s say for WINGS Tour. They went to several countries South America, Japan, USA but only the threat was given out for their location in the states. Same thing for the LY: Tour both death threats were targeted for the states once again. Combined with all the mass shooting news we hear, it doesn’t seem hard reason that it is relatively easier to obtain weaponaries in the US. Since you can have access to it if one of your family member possesses them, also the fact that firearms are legally sold. Maybe they targeted the US Tour due to ease of access to firearms? Also all the hate comment directed at JM on twitter. Most of them speak coherent English and also twt in English. I’ve also looked around at some K-army blog who can speak and post in English it seems to me that Jimin in S.Korea is well received by the public and by the fandom, and fans in general aren’t that toxic towards each other as well, minus those antis. That’s why I think most of the hate and death threats for Jimin actually comes from the International side. If someone has evidence or information that says otherwise please let me know, because I don’t want to misrepresent.
Ah yes, JHope also got a death threat. Someone target him in the Seoul Concert for their LY:Tour. That twt was in English though and later on the person said it was all in jest and prank after they got reported. Honestly what is going through people’s mind these days? Death threat as pranks and jokes?
Now what’s really interesting is his 2nd death threat. I remember the post specifically stated that Jimin is “always in the way and that he’s been around for too long”. Now always in the way of what? In the way of your favorite K-pop group? The western artists? in the way of your life? or the way of your ship? I don’t know if Jimin alone is powerful enough to take down an entire K-Pop idol group on his own, or take over the western music theme, or get into your life if you’ve never come across K-pop in your life. As much as i like Jimin, even I have to admit I don’t think he can be in the way that much. I’ll leave the shipping part to people who knows what’s going on...
Now let’s talk about the Fan cam. I think as a fandom we all know that Jimin, V and Jungkook usually gets a lot of views on their fan cam. Who can you blame they look good and they have a lot of fans who likes them a bit more than the rest of the other members. But here’s the problem. Why are the fan cams for Jimin which has millions of views started to get reported and taken down?

So I checked on the Fake Love fan cam posted by M2, MNet’s official fancam... Jimin’s view dropped down to 22 mil now and JK’s view dropped down to 18 mil. Seriously what is going on? Is this from Youtube’s bot checking alogrithm? or is it purposefully being done by malicioius people?
Now if every other member’s fan cam are met with the same fate, I got nothing to say, but that’s not the story only Jimin’s fan cam are coming across with problem. Why is he getting so much hate? BTW those are big fan cam accounts too. You’re now not only targeting the idol himself but his fan site as well? like wth? Could these be the works from other fandoms? or is it the work from antis within our own fandom? or just antis of Jimin?
Could these be the works of BTS- anti or Jimin only-anti? If it’s BTS anti shouldn’t they focus on the whole group? how come it’s only Jimin who got affected? the M2′s Fake Love view decrease, I can see that could be a mix of various Jimin-hater because it’s uploaded on official broadcast network’s Youtube channel and he overtook another idol’s top spot, but really who would go search for Pied Piper fan cam or other specific performances. Anyway it just baffles me, and honestly if you read all the way til here I think you know what i wanted to say.
Could the fans themselves stop hating on other members just because you like another member more? Idols are humans too and they don’t deserve these hates nor do the fan site masters sharing footage for the rest of the fandom who did not have a chance to see them perform deserve their dedication and hard work to be taken away.
Sometimes I’m happy that people have complained about BH is not trying to push BTS as hard in terms of promo into the West. Because if what i speculate is true and that all of this hate is coming from the International side and all these sabotaging is from the fans themselves. I rather BTS and BH just stay in Korea where they have better protection and control because people don’t deserve them.
That being said I do wish they can become international legends for years to come.. o the dilemma.

What is Prop B?
In May 2021, Austin voters will decide on whether or not to reinstate The Camping Ban, which would make it illegal to camp in public spaces, to sit/lie down in some outdoor spaces, and to panhandle at night.
The language is:
“Shall an ordinance be adopted that would create a criminal offense and a penalty for sitting or lying down on a public sidewalk or sleeping outdoors in and near the Downtown area and the area around the University of Texas campus; create a criminal offense and penalty for solicitation, defined as requesting money or another thing of value, at specific hours and locations or for solicitation in a public area that is deemed aggressive in manner; create a criminal offense and penalty for camping in any public area not designated by the Parks and Recreation Department?”
This essentially means it would be a criminal offense to camp, sleep/lie down, and/or panhandle in certain places and times in Austin.
For many of our unhoused neighbors, there are simply no options for shelter or income in the city and many are forced to live on the street.
With nowhere else to go and no hopes of other income, Prop B would make it illegal to be a person experiencing homelessness in large parts of the city.
Affected Areas
Prop B would make it a criminal offense to camp in public, sit/lie in public, and panhandle at night in the areas within the red square.
Via KUT
This area runs from 38th street south to Cesar Chavez and from N. Lamar east to I-35. It also goes around Oakwood Cemetary, and to Chicon street from E. 7th Street to E. Cesar Chavez.
History of the Camping Ban
note: it has been fairly difficult to dig up old articles to research and provide context. this history is a summary of what I could find but isn’t a full or complete telling of events.
The Camping Ban was first instated on January 25th, 1996. This ordinance made it class C misdemeanor to sleep, store personal belongings, cook, or start fires in public areas. There were an estimated 6,000 houseless people on the streets in 1996 with a population of 548,000. (For context, there were an estimated 2,506 houseless people in Austin in 2020 with a population of 1,000,000.) Additionally, there was only one free houseless facility at this time, with just 128 beds and strict limitations on using the facility. ARCH didn’t open until 2004.
Mayor Bruce Todd first introduced the ordinance and it eventually passed with a 4-1 vote, with one council member abstaining and one council member absent. The council member who voted against the measure was Jackie Goodman, who stayed firm in this position throughout all her years on council. As were the rules, council had to pass this ordinance three times before it became law, January 25th, 1995 being the third time.
In talks about whether or not to pass the measure, council member Gus Garcia stated in 1995 that “This ordinance is probably not the answer. This ordinance is not going to fix the problem. But we have to begin somewhere.”
When it was officially passed in 1996, it was met with a 200 person protest. The loudest people in opposition of the ban were the houseless, the police, and local activists. Many people stated it was unconstitutional, a violation of houseless people’s rights, and unethical to displace people without somewhere for them to go.
Originally, the Austin Police opposed the ban because they didn't have the resources to enforce it and didn’t see it as a solution to the fundamental issue of houselessness. Lieutenant Michael Urubeck who was in charge of enforcing the ban stated “it’s not going to work in the long run.”
Additionally, The Downtown Austin Alliance, who represented downtown businesses and supported the ordinance, boldly acknowledged in 1997 that "The purpose of the ordinance was to protect our public properties and as a preventative measure against public disorder, not the separate issue of the homeless." - Downtown Austin Alliance 1997
When it was first passed, city council also called for a review on it’s effectiveness. In 1997, they found that the camping ban "provided a tool for immediate relief of unwanted situations, but has failed to provide an effective deterrent or any permanent solution to the transient issue." (they called people experiencing homelessness “transients” back then.)
In 1997, there’s a couple articles showing that city council had plans to rescind the camping ban that year, however I was unable to find what actually happened after their plans. I skimmed through the July & August council meeting minutes but have not been able to find anything about repealing the ban. I think it’s safe to say that while talks were promising, the city elected to keep the ban. Additionally, there was lots of talks of building “homeless campuses” at this time but I have been unable to find whether or not they were actually built. Also I want to note that these campuses were often seen as separative and ways to push the houseless community somewhere else, aka not solutions.
Anyways...
Since then, talks of repealing the camping ban have arisen time and time again, each time following very similar arguments:
1. The camping ban doesn’t work in medicating the issue of houselessness in Austin
2. The camping ban is morally bankrupt and borderline unconstitutional without giving people a place to go
3. The camping ban seeks to protect property, not people
Among advocates for rescinding the camping ban is Richard Troxell, who has been fiercely and loudly against the camping ban since the beginning in 1995. He regularly attended council meetings for years on end to speak up about it and has continued advocating against it to this day.
Why are we talking about this 27 years later?
Despite wish-washy support for the ban in it's inception in the 90s, the ban remained in place from 1996-2019. In July 2019, City Council voted 9-2 to repeal the camping ban with council members Alison Alter (D10) and Kathie Tovo (D9) voting against. Basically, this allowed unhoused people to legally sleep in public again.
Three months later in October 2019, city council voted to partially reinstate the camping ban. This measure further defined where camping would not be allowed, like within 15 feet of a residence or business or near ARCH/other shelters. With this partial ban, camping is still allowed outside of those areas.
In August 2020, an organization called Save Austin Now led by Travis County GOP chair Matt Mackowiak, submitted a petition to allow the public to vote to reinstate the camping ban. Initially, it was thrown out by the city clerk because it lacked the necessary number of signatures to be put on the ballot. 20,000 signatures are needed. They submitted 24,598 signatures (the lowest number of any recently filed citizen-led petition), but only 19,122 could be verified so the petition was thrown out.
However, in February 2021, Save Austin Now tried again and received the required 20,000 signatures to put the ban on the ballot. It has been widely stated that canvassers for Save Austin Now collected signatures using purposefully vague language, stating that their petition was one to "help the homeless" without providing signers the truthful information that the petition sought to reinstate the camping ban. Hundreds of signers were able to have their signatures removed after hearing about the manipulative cavassing, but not enough to keep the ban from the ballot.
Public Safety
Supporters of the camping ban say the ban is needed to protect public safety. How are the camping ban and public safety related?

She also calls him for advice, and often times, when he catches wind of her getting into trouble, offers helpful advice, like this one tacked onto the end of many lengthier pieces: “… But most importantly: don’t punch anyone in the dick, or where they would have one if they’re female.”
The humour helps her get over her natural distrust of authority, seeing as that’s what caused and enforced the Isle, and Maleficent’s guards aren’t saints themselves, or follow much of a “code of honour.” Claudine often timescalls him when she can to ask him to tell a joke. One of them isthis:
“One day, a nunliving in a convent in a forest comes across a hunter trying to bagsome deer. As she gathers herbs and berries, she watches as thehunter nocks his bow, takes aim, and misses.
“’Goddammit, Imissed!’ the hunter cries as his prey gets away.
“’Oh mygoodness, what foul language!’ the nun says to herself. ‘God,please give this man the strength, so he may never take Your name invain ever again.’
“Later, the nun isgetting some water from the river, and she sees the hunter trying tobag some deer again. Again, he nocks his bow, takes aim, and misses.
“’Goddammit, Imissed!’ he cries as his prey gets away yet again.
“’Oh mygoodness, what a horrible man!’ the nun says to herself. ‘God,please show this man why you do not take Your name in vain!’
Suddenly, the skydarkens, clouds roll in, and a bolt of lightning comes shooting downfrom above, striking the ground just beside the hunter!
Then, they hear adeep, rumbling voice echoing all throughout the forest:
“Me-dammit, Imissed!’”

Will New Yorkers Get Desperate Enough To Vote for Trump?
With elderly Caucasian Joe Biden as the Democratic candidate, November 3 will be less about the rise of progressive politics than the noise of the last four years would have you believe. But while the shine of AOC and her ilk winds down, progressive thought will find at least a petri dish to fester in during a Biden administration, and perhaps even a second media wind if Trump wins.
Since it’s not going away, seeing what would happen if progressives escape the lab and go viral is important. For that case study, we’ll look to COVID-laced New York.
COVID is supposed to be, finally, Trump’s white whale, the thing that will bring him down after he wriggled out from under the Russians and the Ukrainians and Stormy Daniels. Not enough ventilators! Not enough tests! Mass graves in Central Park! And it is all Trump’s fault. (See the headline: “Donald Trump is the Most Successful Bio-Terrorist in Human History.”) That set the stage for Governor Andrew Cuomo and Mayor Bill de Blasio to craft a response far more political than medical. New York today is a laboratory for what happens when progressive ideology displaces reality.
But first a quick reality check: For every death in this global epidemic, it is critical to remember the virus did not strike masses down in the streets like the Black Plague, and did not create hideous sores like the AIDS epidemic of the 1980s that tore through this city. It is unlikely to infect a third of the world’s population like the Spanish Flu. An overwhelming number of those infected today never even know they have COVID, surprised by an antibody test months later. Most infected people do not pass on the virus. On July 12, New York had zero virus deaths for the first time since the pandemic started. But keeping the emphasis on “cases” and not conclusions keeps the fear alive.
But enough of reality; we’re talking progressivism here. Lockdown has left New York economically devastated, mired in “the worst economic calamity since the 1970s, when it nearly went bankrupt,” according to the New York Times. The unemployment rate nears 20 percent, a figure not seen since the Great Depression (during the 2008 recession it was about 10 percent). The newly unemployed strain food banks and soup kitchens. Policy described as a “pause” in March morphed into a semi-permanent state to keep things bad ahead of the election. While de Blasio authorized nail salons to reopen, he’s kept the city’s core sectors, the stuff that symbolizes New York—Broadway, tourism, conventions, restaurants, hotels, and museums—shut, sacrifices to The Cause. Look what Trump wrought!
So people are leaving. More than 10,000 Manhattan apartments were listed for rent in June, an 85 percent increase over last year. The super wealthy neighborhoods have seen 40 percent migration out, the biggest outward migration from the once economically strongest neighborhoods in midtown and the Upper East Side. Enough rich New Yorkers have left that it is affecting the census. The situation mirrors the outflow of the 1970s which decimated the tax base and led to landlords torching buildings to collect the insurance because they could not collect rent.
So it matters that 25 percent of New York tenants have not paid their rent since March. Those overdue payments left 39 percent of landlords unable to pay property taxes. A new NY law prohibiting landlords from evicting tenants facing pandemic-related financial hardships may help on the micro level while contributing to the destruction of the greater economy, which of course will eventually devastate everyone. Progressive zeal created an economic tide to sink all boats.
The mayor who threw his city out of work also banned large gatherings through September. He did however say Black Lives Matter protests would be allowed, claiming “the demonstrators’ calls for social justice were too important to stop.” The mayor himself, maskless, took time off to help paint “Black Lives Matter” on Fifth Avenue in front of Trump Tower. The central thoroughfare in Manhattan was then closed to traffic to let the paint dry. Some are more equal than others; the mayor criticized Trump for putting politics first in his coronavirus response.
De Blasio is also allowing an “occupation” to continue at City Hall, where a mix of activists and homeless (attracted by donated food) live in makeshift tents. It stinks, a throbbing health-hazard island of human feces and drugs and food scraps even before you get to the COVID part. The city allows them even as, until recently, it sent goons to chase unwoke citizens in twos and threes from playgrounds. A woman at the occupation asked my preferred pronouns while behind her a half-naked homeless man screamed. A few cops stood in front of a graffitied courthouse and laughed. Maybe they just like graffiti; it too is back across New York.
So what else are the cops up to? A former police commissioner criticized city and state leaders for abandoning the police (de Blasio pushed through a $1.5 billion cut to the NYPD on BLM demand) and for helping create a “crime virus” to go along with the coronavirus. Amid defunding elite NYPD units in spite of a 205 percent rise in shootings this year (one of the most recent shootings was a one-year-old caught in gang crossfire), so many NYPD officers are seeking retirement the department has been forced to slow-walk applications to get out. The state legislature meanwhile is proposing a new law to hold cops (not the city, as it is now) personally liable for events on duty even as New York City made the use of certain restraints by cops a criminal act.
De Blasio and Cuomo found ways to put more criminals on the streets. New York state recently eliminated bail for many crimes, claiming alongside BLM it was unfair to POC without resources to pay. Adding to the criminal population, Mayor de Blasio supported the release of some 2,500 prisoners due to concerns over the spread of the coronavirus. At least 250 of those released have been re-arrested 450 times, meaning some have been re-arrested more than once. Since they cannot be held for bail, most are returned to the street under Governor Cuomo’s fairness policy.
The next battleground will be the schools. With only weeks to go in summer, the mayor announced the nation’s largest public school system will reopen with an unspecified mix of in-person and online classes. Teachers say crucial questions about how schools will stay clean, keep students healthy, and run active shooter drills while maintaining social distancing have not been answered. There have been no directives on how to handle online classes, no published best practices, not much of anything. Quality of education, like quality of life, is not on the agenda.
One certainty is New York’s students will have fewer options—26 Catholic schools will not reopen due to low enrollment and financial issues. That affects more than religion. Many of those schools represent the only neighborhood alternative to the failing public system. Closures will drive middle class flight.
And there’s always something more. With indoor restaurant dining prohibited, many places are setting up sidewalk tents. In addition to adding to the Hooverville atmosphere, all that food has brought out the rats, who are attacking patrons.
There is no sense we will ever end this. It’s easy to criticize places that have moved too fast, but they had the right underlying idea: we can’t live like this forever. People need to work, not just for money (though they need the money) but to have purpose. So much of what has been done in the name of justice feels more like punishment—suck on this bigots—racial score-settling under the guise of progressive social justice.
A lot of us are just sitting around like the Joad family, waiting for something to happen. The thing is, we’re not sure what we are waiting for. The lockdown was, we were told, to flatten the virus curve. We did that. COVID hospitalizations and actual deaths in NYC are at their lowest levels since March. But the lockdown is still here and nobody seems to know when to declare victory—is the end point zero new cases before we can re-open Broadway? A vaccine? We just wait, the days violent, hot, and liquid. De Blasio and Cuomo are waiting, too, but for November 3 to free us. No need for a continuing crisis after Biden wins.
But maybe the New York case study will serve as a different turning point in the election. Imagine enough purple voters who look at New York and become frightened of what the Left will do with power in Washington. They want to work. They want their kids in school. They might just vote for Trump.

But I have found that it dovetails really nicely with my own personal journalistic instincts because I'm really sick and tired of the stories that the recipe, which usually revolves around Putin and his evil doings. Uh, but it, it doesn't explain this country. And so the monitor has encouraged me to go out and do stuff. I've done all kinds of things from the North Cox's, from Siberia. You know, this is a huge diverse country that very, very little of it ever gets covered.

And it sounds reassuring.

first the health care system. I mean, I've been, I've done a lot of stories in Russian hospitals and there appear now and, and you know, the healthcare system was dismal at different points and I don't know what it's like today, but there's some dim stories coming out of high school.

Doctors are locked inside sick themselves trying to combat this in an underfunded and really desperate healthcare system. Yeah, I think, I think that's true, especially in the provinces. Um, and it's also true in like half a dozen other countries. So Russia is not alone in this. Um, I don't think they've done anything exceptionally bad. Um, uh, but they, you, what is it? Red man once said, you go to war with the army, you have, so anyway, Russia has got, the healthcare system has, it's been severely reformed, reformed with quotation marks in the past 10 years or so. So all of those local Soviet hospitals and clinics across the country were closed down and they did invest in big regional hospitals, specialized hospitals. This was actually Western advice on how to remodel your healthcare system. And a lot of people are saying now that the Soviet healthcare system would have worked much better because it's localized, it doesn't, it means that most of these Corolla virus cases can be handled by those, could have been handled by these Soviet clinics with paramedics. The most people don't require, uh, like intensive care. Um, so they would have really limited the movement of people in regions in these big hospitals as they have everywhere becoming vectors of transmission, spread it far in life. Um, they also don't have this system of, of, uh, nursing homes in Russia. It's very underdeveloped. And that's another thing that has seemingly become like critical hotspots and other countries. Um, but not so far. I mean, it's hard to know. They're, they're still on the upswing.

You wrote about small business and a that it's about 20% of the economy. They are under huge pressure. Are they not? I mean, because I know some businessmen in Moscow who say that they are barely surviving and probably considering going out of business,

it's a nightmare for them. Uh, they, first of all, they're, they're a new phenomenon in this country. Well, you don't have any well-established small businesses here and uh, they are never at the top of anybody's priority list. And they often like small businesses do everywhere live very close to the ground. You, you know, you've got your street traffic, you've got, if you're a cafe or a restaurant or something, you've got certain things you depend on and if that stops, you're gone. And uh, government aid has not really stepped in. It's, it's rhetorical at this point. They did promise wage subsidies for workers in small businesses and they're supposed to get a zero interest loans. But the banks don't distribute this. I mean, it's clear the banks give priority to big business and larger established businesses. And as always, short shift goes to the small businessmen. So yeah, it is quite possible that when this thing lifts, um, that infrastructure of small businesses, small businesses, and it was just starting to really appear like Moscow in the past decade or so has really transformed. It has all kinds of restaurants, cafeterias, all many levels of consumer services that could all be gone.

We're in the fifth week a bit now and we just got our grocery delivery and everything was there. So, uh, I think it's, it's better to have people out of the city. It's always better to be in the countryside and the weather is mostly good now. Uh, and, and, and you can do social distancing better out here. And you have to admit, if you're sitting in my chair and having to analyze this stuff every day, that Russia has survived the past six years with that double whammy, low oil prices, Western sanctions, they not only have survived, but they built up their state finances, balanced the budget. They've done a lot of defensive things. So they're not in a bad position to handle this, but if it goes on, you know, just there's just no, no country's going to survive as it as it was. Uh, if this is another six months or something,

Do we work with the credit card companies to try to verify [users]? How do we get around not violating COPPA regulations?,” says Bhaumik.
“The problem is super complex, and I don’t think anyone involved has solved that yet,” she adds.
One solution could be forcing parents to sign up their kids and add a credit card, which would remain uncharged unless kids broke the rules.
That could dampen user growth to some extent — locking out the under-banked, those hesitant to use their credit cards online and those just generally distrustful of gaming companies and unwanted charges. It would mean kids couldn’t just download the app and play.
But Roblox has the momentum and scale now to lock things down. There’s enough demand for the game that it could create more of a barrier to entry if it chose to, in an effort to better protect users. After all, if players knew they’d be fined (or their parents would be), it would be less attractive to break the rules.

3. The lawsuit: Unsurprisingly, Brummer sued Wey and Wey’s companies for defamation, as he had every right to do. (The lawsuit was filed in April 2015, before Brummer’s CFTC nomination, but the allegations have been updated in light of later posts.)
The normal course of such a lawsuit would be for there to be a trial, in which the fact-finder would determine whether particular factual statements about Brummer were false (and were said with the requisite mental state, but we’ll set aside here), defamatory, and made by Wey or Wey’s agents. If they were, then Brummer would get compensatory damages and possibly presumed or punitive damages (if the statements were said knowing they were false or likely false). And in many states, Brummer would be able to get an injunction requiring that Wey remove the particular statements found to be false and defamatory, and barring their repetition. See, e.g., Balboa Island Inn, Inc. v. Lemen (Cal. 2007); Hill v. Petrotech Resources Corp. (Ky. 2010).
4. The Injunction: But this lawsuit didn’t play out this way. Instead, the judge issued a preliminary injunction that banned defendants “from posting any articles about the Plaintiff to The Blot for the duration of this action,” and that they “remove from TheBlot all the articles they have posted about or concerning Plaintiff.” The injunction by its terms lasts until trial, which could be many months away, and the plaintiffs asked that the injunction be made permanent after that trial.
This is not at all limited to false and defamatory factual accusations; it covers even constitutionally protected true statements, or constitutionally protected opinions. Under the injunction, the Blot can’t post anything faulting Brummer for seeking and getting this injunction. It can’t post anything saying that Brummer’s nomination was rightly withdrawn. If Brummer is renominated, it can’t post anything criticizing the nomination. It can’t post accurate statements about what Brummer did (e.g., that he participated in handing down the Harris/Scholander decision), or opinions about Brummer (e.g., that he is an “Uncle Tom” for participating in that decision).
What’s more, the injunction comes before any trial on whether the statements are false; it is issued based on a likelihood of success on the merits, not based on any conclusion that Brummer should win on the merits. The injunction makes no specific findings that any specific allegations are false; it labels the items on the Blot as “offensive articles,” and says that they are “capable of injuring [plaintiff’s] standing and reputation,” but that would not be enough for a libel judgment even if such findings were entered after a full trial.
Preliminary injunctions in libel cases entered before any trial on the merits are generally treated as unconstitutional “prior restraints.” To quote the Kentucky Supreme Court’s decision in Hill, “an injunction against false, defamatory speech” is allowed “only upon a final judicial determination that the speech is false. … Until such determination of falsity, however, [the Kentucky Constitution’s analog to the Free Speech Clause] is best interpreted as proscribing a preliminary restraint upon the alleged defamatory speech. … Neither a restraining order … nor a temporary injunction … may be used to enjoin allegedly defamatory speech.” Likewise, as the California Supreme Court held in Balboa Island Village Inn (quoting a concurrence in an earlier case), “A preliminary injunction poses a danger that permanent injunctive relief does not; that potentially protected speech will be enjoined prior to an adjudication on the merits of the speaker’s or publisher’s First Amendment claims.”
Some New York intermediate appellate cases do seem to authorize preliminary injunctions against libel, though the dominant view throughout the country — and, I think, the correct view — is that any such preliminary injunctions are not allowed. But whatever one thinks about the preliminary/permanent injunction distinction, either kind of injunction against all speech by defendants about Brummer is clearly unconstitutional.
Indeed, in many ways this case is a reprise of the injunction in Near v. Minnesota (1931), the very first case in which the Supreme Court struck down government action on freedom-of-the-press grounds. Near was the publisher of a scandal sheet (the Saturday Press) that repeatedly attacked several government officials, often using anti-Semitic allegations. The trial court concluded that various editions of the newspaper were “chiefly devoted to malicious, scandalous and defamatory articles,” and therefore permanently enjoined the defendants from producing “any publication whatsoever which is a malicious, scandalous or defamatory newspaper” and in particular from publishing the Saturday Press.
In Brummer, as in Near, the judge apparently concluded that the defendants had engaged in repeated libels in the past, and tried to prevent their recurrence by banning a wide range of speech (rather than just banning future libelous factual claims). Yet the Supreme Court in Near rejected the injunction. Though specific libelous statements could lead to civil liability and even to criminal punishment (criminal libel prosecutions were more common back then than they are today), an injunction against a wide range of future statements could not be constitutional.
I should note that the Near injunction covered all “malicious” or “scandalous” publications about anyone, while the Brummer injunctions all publications about Brummer in particular. But if a court may ban speech about one target of a newspaper (as the judge did in Brummer), then the judge could equally ban speech about all of the newspaper’s targets, so long as each of the targets sues. And though the Near injunction was permanent and the Brummer injunction was just pending trial, suppressing speech even for months remains unconstitutional, as later cases have made clear (e.g., Vance v. Universal Amusement Co. (1980)).
Indeed, in the decades since then, the court has continued to stress that any injunctions against speech with a particular content must be limited to speech that is actually constitutionally unprotected (such as obscenity, or commercial advertising proposing illegal transactions, or perhaps libel). They cannot prophylactically aim at a wide range of speech, simply because some instances of that speech are unprotected.
5. The “Incitement”/Threat Theory: Though the court order seemed to primarily focus on the material being defamatory or “offensive,” Brummer’s motion in support of the order also alleged that the material was threatening and inciting of violence:
For two years, Defendants have been publishing objectively false and reprehensible stories designed to stimulate outrage against Professor Brummer. Defendants recently added photographs of lynching victims beside pictures of Professor Brummer, his counsel and at least one regulator, along with a “comment” suggesting that Professor Brummer should be shot.
The lynching and gunfire espoused by Defendants are the last pieces of the proverbial puzzle. Infused with these overtures to deadly violence, the entire content of the Defendants’ websites relating to Professor Brummer constitutes a classic and serious threat of physical harm. The Court has full authority to enjoin these threats of physical harm and inducements to violence. Pending the entry of final judgment, the Court should exercise that authority to protect Professor Brummer and others from the menacing activity and personal risk to which Defendants are unlawfully subjecting them. Specifically, the Court should order immediate removal from the websites of Defendants of the lynching photographs and all “stories” about Professor Brummer ….
But I don’t think that’s right. First, the lynching pictures were pretty clearly claims that Brummer was figuratively the lyncher, not threats to lynch Brummer. The picture labels Brummer, Robert Colby and Darin Garcia as “FINRA RACISTS,” and is accompanied (at the start of the second paragraphs below it) by a supposed quote from Harris saying, “FINRA deliberately picked Chris Brummer, an unqualified moron to lynch us by the tree.”
Brummer’s reply points to “the deadly significance of the lynching imagery to him as an African-American who grew up in the deep South,” and cites Brummer’s affidavit that states, “As an African-American from the deep South, I recognize that the lynching victims portrayed in the images could well be my own ancestors, and that these escalating attacks are meant to incite others and terrorize me.” But an accusation, however hyperbolic, that someone is guilty of lynching isn’t itself tantamount to a threat to lynch (just as accusing me of being a Nazi, for instance, for being complicit as an Israel-supporting Jew in supposed crimes against Palestinians, wouldn’t itself be a constitutionally unprotected threat of violence — despite the atrocities that Nazis had committed against Jews — and couldn’t be suppressed by a court).
As to the shooting comment, it read “These FINRA motherf–––––s ruin lives! F––– them or shoot them? Both perhaps.” But its author, “Bill,” remains unidentified; plaintiffs suggest that defendants posted that comment themselves, but there seems to be no solid evidence of that. And in any case, even if the comment were viewed as a constitutionally unprotected true threat of violence, this comment cannot justify an injunction “order[ing] immediate removal from the websites of Defendants of the lynching photographs and all ‘stories’ about Professor Brummer,”
Brummer’s incitement theory is also legally unsound. To be punishable incitement, speech must be intended to and likely to produce imminent criminal conduct — i.e., conduct within the coming hours or maybe days, rather than conduct at an unspecified future time. See Brandenburg v. Ohio (1969); Hess v. Indiana (1973). The motion doesn’t even cite Brandenburg, Hess, or any other incitement cases, or explain why this extremely demanding standard for punishable incitement is satisfied.
6. The Attempt to Persuade Google to Remove “Racial Hate Speech”: Even before the injunction was issued (the day before, as it happens), Brummer’s lawyers asked Google to deindex material about Brummer — in large part on the grounds that the material included “racial hate speech and slurs.”
To the best of my knowledge, Google has not acted on this request, and is not about to start suppressing criticism simply because it contains alleged “hate speech,” “lynching iconography,” or “racial slurs.” Google is free to deindex materials as it likes, and people are free to ask Google to do so; but the perils of Google getting into the business of deciding which criticisms — again, of prominent decision-makers who had even recently been presidential nominees to high office — seem quite clear, and seem to be very good reasons for Google to stay out of this business. This is the first time that I’ve seen a prominent plaintiff and a prominent law firm even ask Google to deindex material partly on the grounds that it consists of “racial hate speech and slurs.”
7. The Current State of the Litigation: Wey’s lawyers are appealing the injunction, and have indeed gotten a temporary stay “pending an expedited hearing on the motion [for a stay] by a full bench of this Court.” The basis for the stay is that it is not clear that Wey was indeed the author of the allegedly defamatory posts:
Shiamili v Real Estate of Group of New York (17 NY3d 281 [2011]) and the Communications Decency Act (47 U.S.C. § 230©) bar restraints against interactive computer service providers (that is, entities that merely provide an internet platform for material posted by third-party users), as opposed to information content providers (that is, entities that actually generate and post statements on the internet). In a federal court matter in 2015, defendant Benjamin Wey gave sworn testimony stating that he was, in fact, the author of the posts appearing on TheBlot.com. This matter, however, presents issues of fact regarding whether any defendant, including Wey, is still acting as an information content provider, as opposed to acting as an interactive computer service provider.
And I hope that the appellate court will ultimately vacate the injunction for good, preferably by making clear that such an injunction violates the First Amendment and not just on § 230 grounds.

As readers may gather, I don’t find the posts on the Blot to be at all credible. I sympathize with Brummer’s anger at seeing them there. I think he may have an eminently sound libel damages claim, and maybe even the basis for a permanent injunctions ordering the removal of posts that had been found to be libelous.
But here we have someone whom a president had recently nominated for a high federal government position — someone who is still being discussed as a possible future nominee — someone who even independently of that appointment has wielded considerable power within a self-regulated industry, over people’s livelihoods and over investor complaints. And we have a court ordering a publisher (however lacking in credibility the publisher might be) to just stop saying anything at all about this person: anything false, anything true, any expression of opinion, anything whatsoever. That is remarkable, and in my view unjustifiable.

Court orders online tabloid not to post ‘any articles about’ former Obama nominee to the federal CFTC
1. Chris Brummer: Chris Brummer is an expert in banking and finance law at Georgetown University Law Center, and to my knowledge a highly regarded scholar. Indeed, in March 2016, Brummer was also nominated by President Barack Obama to serve on the Commodities & Futures Trading Commission; his nomination was withdrawn in March of this year. And even before the nomination, Brummer held a prominent position, as an adjudicator on the Financial Industry Regulatory Authority (FINRA) National Adjudicatory Council (NAC). In his words,
As a not-for-profit organization empowered by Congress to regulate broker-dealers and exchanges, FINRA brings disciplinary actions against those believed to have violated key rules, like committing fraud or market abuse. The NAC is FINRA’s appellate body for reviewing any disciplinary decisions members would like to contest. … As a member of the NAC, I am one of 14 individuals who rotate on occasion to hear varying cases on appeal.
The NAC is a private body, but it plays an important role in a government-authorized self-regulatory system, and indeed its decisions are subject to appeal to a government body, the Securities and Exchange Commission. Whether or not that role makes Brummer a “public figure” for the purposes of determining when libel law damages are available to him, Brummer’s actions as an NAC adjudicator were certainly matters of public concern. And his nomination by the president certainly made him tantamount to a public figure or a public official during the time the nomination was pending.
2. The Blot: In December 2014, Brummer participated in an NAC decision that upheld the permanent ban on two stockbrokers, Talman Harris and William Scholander, from associating with any FINRA-regulated firm. The stockbrokers are both black, and so is Brummer (you’ll shortly see how that has affected events). Harris has since been convicted of fraud and Scholander has pled guilty to fraud.
As a result, Brummer drew the attention of the Blot, which I think can be fairly described as an online tabloid that’s big on insults and leaps of inference (at the very least). The Blot is run by Benjamin Wey, a rich financier who is now under indictment for securities fraud, though some important evidence against him was recently thrown out on Fourth Amendment grounds. Wey also recently lost a high-profile sexual harassment and defamation lawsuit, Bouveng v. Wey, which also involved statements posted on the Blot.
The Blot began to run articles such as this (I should stress that I have no reason to believe the truth of any of the accusations in the article; I’m passing this along just so you could see some of the material that forms the basis of the lawsuit):
Other posts likewise, in the words of the trial court decision, “continuously refer to [Brummer] as a ‘phony law firm dropout, imbecile, being caught up in fraud, an Uncle Tom,’ and asserts that Plaintiff had sexual affairs and engaged in lewd conduct including being a ‘suspect in a rape case.’”
Some of the articles were posted before Brummer was nominated to the CFTC; others (such as this one) were posted after that. Brummer’s lawyers suggest the statements were posted by Wey himself (under a pseudonym) or at Wey’s behest, and suspect that they stem from Wey’s having been in business in the past with Harris and Scholander.
