If you’ve rented an apartment in the US in the past several years, you may have had the sense that the game was rigged: Prices creep up not only at your building but at others throughout the city, seemingly in lockstep. A new civil lawsuit brought by the US Department of Justice today alleges that in many cases it’s not just in your head—and that a single company’s algorithm is to blame.
That company is RealPage, a Texas-based firm that provides commercial revenue management software for landlords. In other words, it helps set the prices of apartments. But it does so, the DOJ alleges in its lawsuit, by effectively helping its clients cheat; landlords feed rental rate and lease terms into the system, and the RealPage algorithm in turn spits out a suggested price that enables coordination and hinders competition.
“By feeding sensitive data into a sophisticated algorithm powered by artificial intelligence, RealPage has found a modern way to violate a century-old law through systematic coordination of rental housing prices,” deputy attorney general Lisa Monaco said in a statement.
RealPage’s reach is broad. It controls 80 percent of the market for software of its kind, which in turn is used to set prices of around 3 million units across the country, according to the DOJ. It already faces multiple lawsuits, including one from the state of Arizona and another in Washington, DC, where RealPage software is allegedly used to price more than 90 percent of units in large apartment buildings. RealPage’s algorithmic pricing first gained broader attention when a 2022 ProPublica investigation detailed how the company’s YieldStar software works.
The DOJ civil lawsuit, which was joined by the attorneys general of eight states, is a significant escalation in legal action against the company. It’s also a first for the DOJ, according to officials speaking on background during a call to discuss the complaint. While the government had previously filed criminal charges against an Amazon seller for algorithm-enabled price-fixing, this is the first civil action in which the algorithm itself, the Justice Department official says, was effectively the means of the violation.
The complaint itself quotes RealPage executives allegedly acknowledging anticompetitive aspects of its product. “There is greater good in everybody succeeding versus essentially trying to compete against one another in a way that actually keeps the entire industry down,” one RealPage executive allegedly wrote.
RealPage has repeatedly denied any allegations of antitrust violations, going so far as to publish a six-page digital pamphlet that claims to tell “the Real Story” about its products, along with an extensive FAQ page on a dedicated public policy website. The company did not immediately respond to a request for comment. “Attacks on the industry’s revenue management are based on demonstrably false information,” one section of that site reads. “RealPage revenue management software benefits both housing providers and residents.”
“We are disappointed that, after multiple years of education and cooperation on the antitrust matters concerning RealPage, the DOJ has chosen this moment to pursue a lawsuit that seeks to scapegoat pro-competitive technology that has been used responsibly for years,” said Jennifer Bowcock, senior vice president of communications and creative at RealPage, in an emailed statement. “RealPage’s revenue management software is purposely built to be legally compliant, and we have a long history of working constructively with the DOJ to show that."
The DOJ disagrees. “Algorithms don’t exist in a law-free zone,” said Monaco in a press conference to discuss the case. “Training a machine to break the law is still breaking the law.”
In this case, the complaint alleges that those algorithms consistently drove rental prices upward. “RealPage’s software tends to maximize price increases, minimize price decreases, and maximize landlords’ pricing power,” said the DOJ in a press release. RealPage also doesn’t just recommend prices; in many cases, it actively sets them.
“RealPage actively polices landlords’ compliance with those recommendations,” said US attorney general Merrick Garland in today’s press conference. “A large number of landlords effectively agree to outsource their pricing decisions to RealPage by using an ‘auto-accept’ setting that effectively permits RealPage to determine the price a renter will pay.”
The DOJ also claims RealPage has created a “self-reinforcing feedback loop” with its data intake and pricing recommendations structure that also gives it an alleged monopoly in the apartment revenue management software industry. Any competitor who plays by the rules, the DOJ claims, is at a distinct disadvantage.
The Justice Department has spent the past several years staffing up with technologists and data scientists, better enabling them to “interrogate the code,” as multiple officials described the investigative process. While this is the first major algorithmic collusion case, DOJ officials suggested it would be far from the last.

Etsy has banned gift certificates/cards sold by individual shops, as of Sept 15. Only Etsy Gift Cards are now allowed. The second quarter report press release says they plan on selling Etsy Gift Cards through third parties, but no official word on how and when yet.
Many Amazon Handmade sellers were unable to list new items after a site update on July 31 [post by me on LinkedIn]. While Amazon told sellers to apply for an exemption from the Product ID requirement, some report that is not working, or that they do not have the option to apply for one.
Reminder that Canadian Etsy shops will be charged a 1.15% Regulatory Operating fee on the item price and shipping cost as of August 15. [I’ve set a bunch of things to expire. If Etsy isn’t profitable enough to pay its taxes, maybe they should consider cutting executive pay instead of squeezing microbusinesses even more.]
ETSY NEWS
Etsy has updated its Privacy Policy, to take effect August 31. Changes include mention of biometric data. Note that some parts of the policy are screenshots, and therefore not easily searchable nor accessible to screen readers - I am not sure how they can get away with that. I used the Wayback Machine to do a comparison of the parts that software can actually read. There’s also a new US regional privacy policy, which currently covers laws in several states.
Etsy is promoting a Labour Day sale August 21-September 2, and has already set up the "Cyber Savings Sale" (November 18-December 3) for Cyber Week. You can schedule the official sales through links in the announcement.
Forbes covered Etsy’s sex toy ban [soft paywall; not safe for work photos]. To no one's surprise, plenty of the banned items are still found on site, including toys and vintage Playboy magazines.
Etsy is accused of allowing shops based in “illegal Israeli settlements in the occupied Palestinian territory” and profiting off of them. Etsy’s response: "[W]e have shared this information internally with the appropriate teams for review."
Etsy's promised program for buyers - Etsy Insider - will be rolling out as invite-only beta in September. It's a paid membership for US buyers and includes:

A birthday bonus
Limited edition annual gift, designed by an Etsy seller
First access to special discounts and select merchandise
While some of the "special discounts" are paid by sellers, that is a voluntary program shops can sign up for here. That form also allows you to sign up to offer new items to Etsy Insiders first - “drops” - which does not involve offering discounts. Etsy has done these sorts of "offers" in the past, and I believe they have already reached out to sellers for the first round of offers in September (based on some emails I have received from shop owners).
You can now sign up for “Etsy Up”, the virtual sellers conference scheduled for September 10. However, despite saying they have announced “our agenda”, all that is provided is a vague set of topics (other than the fact they will be announcing the Etsy Design Awards Finalists). It makes me wonder if there are official Etsy announcements coming soon that they don’t want to reveal too early by posting the real agenda. If yes, around August 15 is a good bet, given that Etsy’s Search Analytics will end that day, and many new policies kick in on September 15, just one month later.
The Etsy app is showing rectangular listing images in search for some visitors, but it appears to be a test [Reddit thread with screenshot]. I wouldn’t change anything at this time.

Amazon’s second quarter revenue was below expectations, and the company predicts nothing better in the third quarter.
In a surprising change, Amazon has decided to cancel overage fees for Fulfillment by Amazon (FBA) inventory storage, retroactive to July 1.
Canadian Amazon sellers will be subject to a new digital services fee as of October 1. This is due to Canada’s new digital services tax.
In a case that may have an impact on other larger ecommerce sites, a court ruled that Amazon is responsible for recalls of products sold through Amazon, including through “Fulfilled By Amazon”.
US Amazon shoppers can now link their Pinterest and TikTok accounts to Amazon to be able to buy directly from Amazon ads on social media. This is already available on Facebook, Instagram and Snap.
Amazon is changing its refund policy for Fulfillment by Amazon (FBA) users: if sellers do not receive an automatic reimbursement for loss, damage and returns, they will now only have 60 days to apply for one. A lot of ecommerce experts think Amazon is making a mistake in setting up a China to US section on the site.
eBay
eBay second quarter revenue and profit was higher than expected, but the third quarter projections are low.
The eBay app has taken a lot of flack for inserting ads between each item in a purchase history.
Poshmark
As marketplaces popular for pre-owned items compete for the best new stock, Poshmark is offering “rewards” for listing at least 1 item a week.
Shopify
Shopify had a better-than-expected second quarter, and expects a decent third quarter as well. Getting larger businesses to use Shopify has helped the tech company, but I still wonder how that affects the small and micro businesses who used to be the target market.
Walmart
The Walmart Marketplace has added Chile as its fourth country, after the US, Canada and Mexico.
All Other Marketplaces
Hundreds of business owners who sell on Temu held a protest at the marketplace headquarters on July 29. Fines for returns are one cited issue.
Payment Processing
Credit cards issued by Chase in the US will no longer allow third-party buy-now-pay-later purchases, as of October 10. Conveniently, they offer their own option, Chase Pay Over Time. PayPal has expanded the quicker checkout solution Fastlane to all US businesses, which fills in customer information without a log in.

Corporate greed is outta control and antitrust action is the best reason to vote for Biden this fall.
It’s time to declare the debate over. In 2021, the total corporate profit increase was $730bn, or a little over $2,100 a person. That’s a large chunk of the inflationary increase in costs. Moreover, the price-fixing in the oil industry, which contributed roughly $200bn of that, isn’t an anomaly.
Take post-Covid rent hikes. One software and consulting pricing firm for landlords, RealPage, specialized in telling its clients to hike rents more than they otherwise might. As of December of 2020, RealPage had nearly 32,000 clients, including “10 largest multifamily property management companies in the United States”. There are multiple antitrust suits accusing the private equity-owned firm of organizing a massive price-fixing conspiracy to inflate rents across the board.
Beyond rent, the Biden administration or private plaintiffs now have credible antitrust claims against firms engaged in price-fixing in meat, hotels and large online sellers like Amazon. Corporations in a range of industries have made comments similar to those of Sheffield.
Alex Cisneros, an executive for Red Roof Inn, told a trade outlet that Red Roof Inn was using a software package called STR from CoStar to systematically hike prices across the hotel industry. “Red Roof’s franchisees for the most part are making more money with less occupancy,” Hotel News Now explained. “Red Roof is now providing more data to franchisees to educate and get them comfortable commanding higher rates.”
According to a lawsuit, an unnamed executive at Smithfield, a pork processor, summarized the advice he got from Agri Stats, a consulting firm that coordinates production in the industry, as: “Just raise your price.”
Rent, meat, oil and hotels are big sectors, so criminal activity in the form of price-fixing to boost profits should bust through the illusions economists have about how our markets really work. There are also a number of concrete steps policymakers can take to respond to this price-fixing.
The first is to arrest or sue the offending executives for criminal activity.
The second is to strengthen price-fixing and merger laws, allow more private class-action suits, force judges to speed up cases and increase the budget of antitrust enforcers to make collusion more difficult.
The third is to reform the Federal Reserve so policymakers there stop using macro-economic models that avoid considerations of profits and price-fixing.
And the fourth is, frankly, political. One key reason there is action on these schemes is because Biden has prioritized antitrust enforcement. He hasn’t put enough into antitrust, and he doesn’t talk about it very often. But he should, or else Americans are likely to fall into the trap of thinking that what is good for big business is good for their pocketbooks, when the opposite is so often the case.

Making your own Home Assistant (theorising)
Disclaimer: This is all theory and speculation. I have not tested anything or made my own home assistant yet, I just looked around for libraries and hardware that are likely compatible. I have not fully tested the compatibility or quality of these, this is simply the first iteration of an idea I have.
I just got news that Amazon Alexa has lost 10 billion dollars because their business model failed. This makes me happy, and has also made me realise that you can make your own home assistant.

If you have it set up correctly, you should be able to run both the STT and TTS in realtime (see https://github.com/coqui-ai/TTS/discussions/904).
After all of them are set up, the only thing to do is bridge it all together with software. There are bindings to Rust for both Coqui libraries (https://github.com/tazz4843/coqui-stt and https://github.com/rowan-sl/coqui-rs), and all that's left to do is implement parsing.
The libraries can also be swapped out for different ones if you like. If you can find and implement a DECtalk library that works for the Raspberry Pi, you can use that.
If I ever figure out how to manifest this idea, I will likely make the project modular so that you can use whatever library you want. You can even fork the project and include your own library of choice (if you can bind it to Rust).
