Apesar de ser curioso, o artigo 301 do Código Penal brasileiro garante que qualquer cidadão tem este poder contra uma pessoa que esteja cometendo um flagrante delito; no entanto, não é tão simples. Uma audiência na 4ª Vara do Trabalho de Diadema/SP, ocorrida no dia 2 de julho, voltou a repercutir nesta semana. Na ocasião, o advogado Rafael Dellova deu voz de prisão à juíza Alessandra de Cássia Fonseca Tourinho, alegando suposto abuso de autoridade. Apesar de ser curioso, o artigo 301 do Código Penal brasileiro garante que qualquer cidadão tem este poder contra uma pessoa que esteja cometendo um flagrante delito; no entanto, não é tão simples. O QUE OCORREU? O advogado acompanhava sua cliente que é parte reclamante em um processo trabalhista. Durante o depoimento dela, ele a interrompeu. Nesse momento, a juíza determinou que a audiência seguisse, dando a palavra à defesa da parte reclamada e orientando que continuasse fazendo as perguntas, enquanto a cliente de Rafael respondesse às perguntas. Em defesa também, a Associação dos Magistrados da Justiça do Trabalho da 2ª Região (AMATRA-2) classificou como em “completo arrepio da legislação”, sobre as ações do advogado. Confira a nota da AMB “A Associação dos Magistrados Brasileiros (AMB) expressa apoio e solidariedade à juíza Alessandra de Cássia Fonseca Tourinho, que foi alvo de intimidações e ameaças no exercício da função por um advogado inconformado com o andamento do processo. A AMB é uma defensora intransigente da independência judicial — garantia constitucional que permite aos magistrados julgar com isenção e imparcialidade, livres de quaisquer pressões, com base tão somente nas leis e nas provas. Condutas desrespeitosas, além de violar o devido processo legal, em nada contribuem para os reais e legítimos interesses dos cidadãos que, por meio de seus advogados, estão em busca de justiça.” Advogado Rafael Dellova e a juíza Alessandra de Cássia Fonseca Tourinho | FOTO: Reprodução Confira a nota da AMATRA “A AMATRA-2, acompanhada pela ANAMATRA e as demais AMATRA’s do país, entidades que reúnem mais de 4 mil magistrados do trabalho em todo o Brasil, vêm, por meio desta, demonstrar seu irrestrito apoio à Juíza Alessandra de Cássia Fonseca Tourinho, associada da AMATRA-2, diante dos fatos ocorridos no dia 02 de julho de 2024, envolvendo o Advogado Rafael Dellova, OAB 371.005/SP. Na referida data, em audiência realizada na 4ª Vara do Trabalho de Diadema/SP, durante o depoimento pessoal da reclamante, seu Advogado, Rafael Dellova, interrompeu o depoimento, e, após ser determinado pela Magistrada que a patrona da reclamada continuasse fazendo as perguntas que a autora respondesse, o causídico permaneceu insistindo e afirmando que faria outras interrupções se assim continuasse a instrução. No exercício do poder de polícia garantido pelos artigos 765 da CLT e 360 do CPC, a Magistrada decidiu redesignar a audiência. Inconformado com a condução da audiência recém-encerrada, o Advogado da Reclamante levantou-se exaltado e acusou a Magistrada de ter cometido crime de abuso de autoridade, dando-lhe voz de prisão, ao completo arrepio da legislação, causando tumulto na unidade judiciária. A conduta do Advogado, além de contrariar os artigos 5º, 6º e 361, parágrafo único, do CPC, viola também o art. 33, II, da LOMAN (Lei Complementar 35/79), que confere ao magistrado a prerrogativa de “não ser preso senão por ordem escrita do Tribunal ou do Órgão Especial competente para o julgamento, salvo em flagrante de crime inafiançável, caso em que a autoridade fará imediata comunicação e apresentação do magistrado ao Presidente do Tribunal a que esteja vinculado”. Note-se que a suposta infração alegada pelo advogado não consubstancia crime inafiançável, tampouco conduta tipificada da Lei 13.869/2019, cujo artigo 1º, § 1º exige caracterização de dolo específico. Ainda, conforme o art. 7º-B da Lei 8.906/94, suposta violação ao art. 7º, VI, b e X, da mesma lei não configura crime de abuso de autoridade. Portanto, completamente desarrazoada e carente de amparo jurídico a conduta do patrono. Assim, exercendo as suas funções jurisdicionais, notadamente com o objetivo de presidir a sessão, não pode a Magistratura tolerar condutas que advoguem contra literal disposição de lei, com o intuito de desrespeitar magistrados e magistradas, criar tumulto e/ou obter cliques em redes sociais, em flagrante ameaça à integridade do Poder Judiciário. Salienta-se que todos os fatos foram registrados em vídeo, tanto pela unidade judiciária como testemunhas do ocorrido, no qual é possível notar inclusive a reprodução de padrões inconscientes e involuntários discriminatórios de gênero, já que decisões mais firmes tomadas pelo Estado-juiz na figura de uma mulher muitas vezes são interpretadas por parte machista da sociedade como agressividade e abuso, quando, em verdade, são estas Magistradas que sofrem uma enviesada violência de gênero, com intimidações, ameaças e ofensas. Caso tal como o de tantas outras juízas, que sofreram e sofrem, em termos estatísticos, como expressiva maioria dos episódios de desrespeito e ofensa ao exercício da Judicatura. Não é demais lembrar que a ofensa a uma Magistrada significa ofensa a toda a classe, sendo imperativo da democracia que condutas abusivas dessa natureza encontrem exemplar resposta do Poder Judiciário. A democracia se enfraquece quando são perpetrados ataques depreciativos ao Estado-juiz, sobretudo na figura de uma mulher, e ao se intimidar e dar voz de prisão à Presidente da audiência, sem qualquer respaldo legal, inclusive ao tentar impedir sua livre locomoção, como estratégia para desqualificar o exercício da função, afeta a própria importância do Poder Judiciário. É imprescindível que todos os participantes do processo judicial, incluindo a advocacia, função essencial à justiça, estejam atentos e vigilantes à correta aplicação das leis e à urbanidade. Dessa maneira, todas as Associações de Magistrados do Trabalho abaixo identificadas vêm, por meio desta, apoiar a Juíza Alessandra de Cássia Fonseca Tourinho e todas as outras que sofreram violências semelhantes nos últimos tempos. "States of Waking." From the Varaha Upanishad, "The Exploration of the Mysteries of the Wild Boar."

OM is object/witness/measurement, the summation of all that God makes up to and including intelligence.

The stages of engagement with intelligence are explained as follows:

Their Avasthas “states” are four: waking, dreaming, dreamless sleeping and Turya (fourth).

the Essence of Creation.

He who is in (or the entity that identifies itself with) the waking state in the gross Amsa (essence) of Akara is named Vishva “the creation”;

In the subtle essence, he is termed Taijasa “passionate” ;

In the Bija “the seed” essence, he is termed Prajna “wise” ; and in the Sakshi essence “witness”, he is termed Turya “tuned up”.

During the awakened state is when one's passions, experiences, judgements and self-realization come together to create a harmonious contiguous union with reality. It is a state of that is undeniably free of delusion by its very essence.

We like pretend the opposite- that if this book says reality is thus, not that, but this never works. What is perceived during the waking state, that's how she blows.

2. The Essence of Dreaming.

He who is in the dreaming state (or the entity which identifies itself with the dreaming state) in the gross essence of Ukara is Vishva;

in the subtle essence, he is termed Taijasa;

in the Bija essence, is termed Prajna;

And in the Sakshi essence, he is termed Turya.

Without an embodied soul, dreaming and imaginings are not possible, and we need them to live. Harmful delusions we do not need.

Apprehension of how the mind dreams and behaves when reality is absent is the hallmark of success at yoga.

Affixed to reality, one who is fully aware of what is real and what is not is still able to try on different clothes, relationships, jobs, what to eat next, how to spend one's time given the choice and take the risks willingly without hysteria.

3. The Essence of Deep Sleep.

He who is in the Sushupti “deep sleep” state in the gross essence of Makara is termed Vishva;

In the subtle essence, Taijasa; in the Bija essence,

he is termed Prajna; and in the Sakshi essence, he is termed Turya.

During meditation one searches inner space for the same blank stage upon which the mind will instantly sprawl once the senses are unleashed upon creation. If this cannot be achieved one must sit and sit until a complete understanding of what is taking place in this stage is achieved. This is a must.

4. The Finely Tuned State.

He who is in Turya State in the gross essence of Ardha-Matra "half-measured" is termed Turya-Vishva "full power of creation."

In the subtle, He is termed Taijasa; "passionate".

In the Bija essence "seed", He is termed Prajna; "knowing".

and in the Sakshi "witness" essence, he is termed Turya-Turya "all powerful".

God is "amatra" without measure. He can be only "half-measured" during a human lifetime. If one meditates, screens the mind of all hysteria, has complete appreciation for the gift of a soul, a body, and a world such as this upon which to play, then even this "half a dose" comes to seem like quite a lot.

The term vishva referred to above means "fullness". To have such an experience of fullness during a life lived within an hourglass that is emptying out is the goal of all intelligent persons.

I hear about this every day here in Washington, DC where I live from all the Latin and African Americans that live around me- how they want to juice life like an orange. But all we get in response to this from the government reflects of the whining and pining of the fuckin' Mormons and Evangelicals who want the right to tell us all we have to turn the lights and the sound down.

This is not the essence of waking life on the planet earth it is not a way of life we can appreciate or fall in love with, no one ever has.

Time-traveling mission is complicated than it sounds. Now you need to stop a killer in country wedding with Jason

He signed. "Y/n..come on its just a suit. Why can't you just wear it?? " You look at yourself on the mirror. The suit fits perfectly. Giggled softly and dashed next to Jason.

"Hey! You are impatient. Look I'm ready. " Jason's eyes wandered on your body. From the top of your head to your feet.

He smacked your ass and moved to reactors room. Checking if everything is okay.

Today was special. Because there is an extraordinary mission. Actually Batman would not let you guys to do this but.. You know he just can not resist when two of you looks so eager for next task. Oh yes, what's the mission? It's time travelling.

So basically Jason and you need to visit a wedding and preventing the bad incidents in this beautiful day.

You walked into the machines room and waited for Jason. When he came you smiled, trying to hide your quick heartbeats. He squint at you. Held your hand like there is nothing to worry about.

"Angel, what can happen worse? " You closed your eyes and thought the possible scenarios. Your eyes widened.

"We can mess up everything and inadvertently change the future.." He looked at you and blinked a few times. "Y/n, shut up. "

" Okay.. "

After several deep breaths he drag you into the time machine. And everything begins.

Its nice, sunny day. Only difference is its just 47 years ago. Not that past but still it's already felt like nostalgic.

When you feel wind brushes on your legs, you look down to your feet. You were wearing a dress. An off-shoulder white dress. It has little flowers on it. You smiled and turn to Jason with excitement.

He was waiting few steps behind you. Also his clothes was changed with today's fashion. He is wearing a shirt and casual short. He look over you and pulled you closer. One hand on your waist and one hand grabbing your face. He smiles with ease.

"You see my angel. We are here with no trouble and you look absolutely perfect." states while kissing your nose.

In this wholesome moment, you hear a bicycle ring, it was coming full fling. Jason made a quick movement and turned both of you and moved out from the way.

"O-oh that was close, huh?" He nodded and wandered his eyes through the surrounding buildings.

"Okay, now we are in 78. Peter st., and where we need to go?"

You turned to the enormous street behind you. "To Amatra st. which near to Big Amatra farm." He hold your hand. "Well it means we'll going to join a country wedding." and he adds. "..I hope they have cold beers or drinks." You laughed. "They better have! "

You noticed bicycle rent workshop while walking down to street. Excitedly show it.

"We can rent a bicycle maybe." He thought it would be the best way possible for reaching there at the time. "Say less. " He ruffles your hair and smiles. While he rents bicycles you observe the people walking around. They are just humans. Not much not less, like you and Jason. You think if any of them knows what you guys are doing, what would be the consequences? But it would be really complicated to explain time-traveling and other stuff so you didn't dwell too long on this thought.

When you checked, Jason was coming with a bicycle. Wind was messing his hair and licking his cheeks. One of the best views. You immediately shuffle your little backpack and find the old fashioned photo camera. The ones which called analog cameras. When you take the photo, you can have the little version of the photo on a little paper.

"Hey Jason!" You said. "Wait there." And took a photo of him. Took the paper from the device and shook it a little. "Okayy, you can come now. "

When he came, he take the paper between your fingers. "Wow, look how handsome he is." Throwed his hair back. "What a lucky lady you are." And patted your cheeks.

"Yes, but he likes to brag about himself. " and take the paper and carefully placing it in your little bag. You noticed there is only one bicycle.

"Baby why there is just one? " you wonder.

"Because.. " he said while placing himself on the front seat. "I'll drive for us." You chuckled. "What a gentleman you are. " Kissed him before taking your place next behind him.

It wasn't long way. Half of the way, you drive the bicycle.

"Hey, watch the way!!" Jason hold your hand which is on the bike handle. And gave a direction.

"Why there was a rabbit on the way Jason?! " you shouted. Jason replied with same tone of yours "How can I know y/n?! " he stopped by the road sign.

"You okay?" He asked worried but tires to hide it. You nodded and rested your head on his chest. "Let's just switch.." You sighned. Jason agreed easily, he would drive miles for his princess. But he wouldn't admit if he doesn't have to.

With a breathtaking sunset your ride ends. Jason helps you to get down from bike and holds your hand. "Lead the way my angel." You giggle and after a second be dead serious and pull Jason closer. "Hey, baby. Look this guests.. Which one was the killer and which one died 47 years ago? "

Jason placed his one arm around your waist and he bent his head closer to yours. "Amber Cooper. The victim. Which now wears a blue jacket and her hair looks... Interesting I guess. " he pointed the middle-aged woman next to bride. And continues "Robert Davies. The murderer. He killed Amber Cooper at midnight and.." He looks around. Gives you a confused look. Also you search with your rash eyes. Where were he?

"Let's have a closer look Jason. Come on. "

As couple you guys enter the wedding with no question. But something was unusual. The amount of guests was higher than your expect. But in records you can easily say there was just 80-100 people. In this crowd finding Robert was impossible. All you see was people in vivid colors, interesting hair models and a big yellow-black flowered wedding cake. And in this confusion you see Jason, he was on the dance floor.

He's dancing with his soul. Every move he make was an art for you. He's definitely a party guy, you thought. But why he is dancing a time like this. You made your way to him. To be honest it was hard to come near him because all the crowed watching him. When he saw you, he pulled you into his arms and turned you around yourself. You feel the pure enjoyment with this move. His fluffy hair and red cheeks.. It was all for you. After a couple motion he firmly hold you against his skin. You are feeling his fast pounding heart beats. His hands gripping your hip.

"Jason.. " you said breathlessly. Jason smirked down to you. "I'm all ears y/n."

"We have a mission.." You hardly exclaimed. Jason nodded. "I know baby, it's just second matters and Robert will be here." You checked people around you with frustrated cheeks. Jason was right. You saw Robert, he is just entering the wedding with a confident face. Not knowing he'll be arrested before the midnight.

After couple minutes, your dance over and go back to business. You guys sat a table for two. Jason freely puts his gun on the table. You weren't expecting something like this, so you quickly take the gun to under table.

"Hey! What are ya doing?" Jason rested his head. "Relax angel, everybody doing their own business. This gun is yours. Use it wisely, it has just one bullet in it."

You slightly leaned back to see under the table. Checked the gun, it really has just one bullet. You smiled.

"Thanks." And send him a kiss.

In later that night some guests already left the wedding. The clock was hitting 11. You fidgeted restlessly. Jason got up and winked with a smile. "You got this angel. " and he made his way to Robert. With this move also you got up take your place behind Roberts table.

You carefully watched his actions. He also had a gun in his belt. When Robert saw Jason coming towards him he threaded his gun. You jumped over him. Two of you felt on the ground and struggled for a while. Until you thread your gun, Robert took a knife and threw at you. You lithely avoided the knife but it cutted your left arm. It wasn't a deep cut but hurted tho. And the next thing you saw was Jason. He was beating the shit out of Robert. The punches coming down to Roberts face endlesslly. Rest of the guests were watching this scene with terrified eyes. You run to Jason and pulled him from the top of Robert.

"Hey, hey, hey..." You said while caressing his hair and face. Sometimes he looses the control and you need to brake him. While doing this you also checked Robert if he is still alive or tries to run. But he was on the ground.

"Hey, you! Call the ambulance. " you especially ordered someone who makes an eye contact with you. She nodded and called.

After a hour. It was passing the midnight. You and Jason were sitting under a big tree. His head was on your lap and while you are playing with his hair, he was playing with your other hand fingers.

"We did such a great job. " you said with a bright smile. Jason smiled. "Yeah.. Oh and how about your arm? " you look at your left arm. After cops arrested Robert, Jason threated your cut and now it was okay.

"Better than ever!" You said. You paused for a second. "Jason.. " he lift his head and made an eye contact. "What's wrong angel? "

You looked at him with doubt. "I hope our wedding won't end like this. " He raise a big laugh. You slightly hit his arm. "Dont laugh, it was such a scandal county wedding! "

He replies with teary eyes which come from laugh. "I promise it won't. " and he took your face between his hands. Gives you a kiss under the star-filled sky.

Future could wait for two of you.
