"Delhi High Court Upholds Parents' Responsibility for School AC Charges: Dismisses PIL."
The Delhi High Court refused to entertain a public interest litigation filed by the Petitioner (Parent) Manish Goel. The Court observed that the parents must bear the costs of AC services provided to the children in the School as it is a facility provided to the children and is no different from the other charges such as lab fee and smart class fee levied.
The PIL is seeking direction from the Court to the Department of Education for directing the school management to meet the charges of the AC facility provided in the classrooms from its funds and resources. The son of the Petitioner is studying in class IX at Maharaja Agrasen School, a Cambridge International School.
The School has charged Rs. 2000/- towards providing an AC facility to the ward of the Petitioner.
The Counsel for the Department of Education apprised the Court that they have received complaints and they are examining the issue. A show cause notice has also been issued to the School.
After hearing the Counsel of both sides the Court observed that the Fee Receipt issued by the School for the session 2023-24 displays the entry of charges for air-conditioner. The incorporation of AC charges in the Fee Receipt makes us presume that the said charges have been raised after communicating the DoE of the fee and charge schedule.
While dismissing the PIL the Court observed that it is the task cast upon the parents, while selecting the School to be mindful of the facilities and the cost of the facilities provided to the #children in the School. The financial burden of providing such facilities cannot be fastened on the school management alone.
