Agnipath Scheme: ‘The scheme is not arbitrary,’ says Supreme Court

Today, the Supreme Court of India dismissed the appeals challenging the Delhi High Court’s order upholding the Agnipath Scheme. The rejected petitions seek directions to complete the recruitment processes which were discontinued after the announcement of the Agnipath Scheme in 2022. According to this scheme, only those who are between 17-and-a-half and 23 years of age were eligible to apply for the armed forces for a tenure of four years. While rejecting the petitions, the bench headed by Chief Justice of India DY Chandrachud stated that “the scheme is not arbitrary” and candidates selected before the introduction of the Agnipath Scheme were not vested right to appointment.

AGNIPATH SCHEME – CONSCRIPTION AND SHORT-TERM SERVICES IN THE MILITARY
The launch of the new Agnipath scheme has ignited the flame of controversy about the selection and recruitment process of the Indian armed forces. Does short-term recruitment affect the effectiveness of the armed forces? Do these short-term recruits have the same kind of motivation and determination as to their counterparts? Are we the first ones to come up with this kind of recruitment model?
Conscription is a term connected with such short-term recruitment for military service. Conscription is the state-mandated enlistment of people in a national service, mainly military service. Conscription has been existing for a long time, and it continues present day under various names.
There are multiple benefits to such short services with the military. In addition, to keep a reserve of people for defending the country at any point in time, the participants will be benefited from the better discipline of military training, and improvement in their personality. They will secure much positive outlook, physical fitness, and get opportunity to learn new skills, in addition to earning some money in the short term. The flip side can be the loss of a few years in their career and the problems of adjusting before and after such short-term service.
Here is an overview of similar short-term recruitment schemes or the existence of Conscription in a few well-known countries per the market research data.
Russia’s Hybrid Model
Following a mix of the contract-conscript models in the armed forces, Russia enforces a 12- month mandatory service. Though these conscripts are not deployed into critical battle positions like the contract soldiers they serve as drivers, and cool and maintenance personnel. Avoiding these compulsory drafts is punishable by up to 2 years of imprisonment.
Law to Register – United States
With a selective service system that is enforced by the law where all male citizens between the ages of 18 and 25 are required to register. This serves as an important element when the country needs its services. Joining for four years plus four years reserve duty, option for full service which gives them the eligibility for pension and benefits after serving for 20 years.
Selective Compulsory Military Service – China
Those who are between 18–22 years of age can enter this selective compulsory military service, with a 24-month service obligation. But this rule is not very much in common as the country produces more than the required volunteers for its military.
Israel Defence Forces (IDF- Compulsory for Men and Women
The Israel Defence Forces (IDF) has compulsory service for both men and women. They need to serve for 32 months and 24 months respectively as a regular conscript service. Option to build a career with full wage and pension benefits too. The ones who opt out of permanent service are put under reserve forces and if when needed must serve for up to one month every three years.
Pakistan volunteers
Though the country’s Constitution has conscription in a state of war. Due to a high number of volunteers, this rule is not in practice. Volunteers between 17-25 years are selected through a professional process, and successful candidates are commissioned into the forces after training. The country also maintains a small force of reserve, who are not eligible for the same pension and retirement benefits as regular servicemen.
In the light of the above, the Agnipath scheme is NOT something newly invented but has been part of society for a long time. Agnipath scheme will definitely give opportunities for a greater number of young people to get trained by the Indian Army. It will give them the opportunity to enter the defense service as well as be prepared to take on new challenges in case they miss the further entry option. With this entry of a greater number of youths into the Army, the average age of Indian army soldier soldiers will fall down to 24 years in about 8-10 years from the current age band of 32-33 years.
To a country that holds the title of the world’s largest democratic nation, the words like compulsory-mandatory and conscription sound contradictory. India has always allowed its citizen to join its armed forces of their own will and this applies to the new scheme as well. It gives us an opportunity to serve and experience the life of an army man rather than a means of earning.
On one hand, the government needs to promote this to serve the nation rather than as a mode of employment and budget cut. On the other hand, it gives the opportunity to the youth to get trained to take up more challenges later in life. As of now, it is in the infant stage and can expect further fine-tuning as it progresses.

Under the Agnipath Scheme 2022, the Central Government is conducting recruitment encouraging various job opportunities for young population (17.5 to 23 years) in the three professional uniformed services of the Indian Armed Forces: Indian Army, Indian Navy, and Indian Air Force.
The candidates will be enrolled as Agniveers under Army Act 1950 for service duration of four years which includes the training period.

Agniveer Army Recruitment Rally 2022
The Agniveer Army Recruitment Rally 2022 is being held for enrolment of Agniveer General Duty (All Arms), Agniveer Technical ( All Arms), Agniveer (Technical) (Aviation & Ammunition Examiner) (All Arms), Agniveer Clerk/ Store Keeper (All Arms), Agniveer Tradesman (10th pass) (All Arms), and Agniveer Tradesman (8th pass) (All Arms).

Agnipath Scheme Details- Latest Updates
Recruitment Details- For IAF, Online Registration has been started from 24th June 2022 onwards. The candidates interested to join India Air Force as an Agniveer can submit their application form for Indian Air Force Recruitment 2022 by
05th July 2022 (5 pm).
The Online Exam to start on 24th July 2022, the first batch of Agniveers to be induced in IAF in December 2022 and training to start from 30th December 2022 onwards.
For the Indian Navy, the complete calendar will be released on 25th June 2022, detailed notification will be released on 09th July 2022 and online registration to begin on 15th July 2022.
For Indian Army, Registration to start in July 2022, the first batch of Agniveers to be shortlisted for Indian Army troops in December 2022 and training to start from 30th December 2022 onwards.

10% vacancies in CAPF: The Ministry of Home Affairs (MHA) said it has decided to reserve 10 per cent vacancies for recruitment in CAPFs and Assam Rifles for Agniveers.
Incentives- The ministries of home affairs and defence announced concessions and incentives that will assist Agniveers in their further employment. Union Minister Hardeep Singh Puri said the PSUs under his housing and petroleum ministries are working on hiring 'Agniveers' after their four-year service in the armed forces.
Revised Age Limit- The upper age limit for Agniveers has been revised to 23 years.
Reservation- The government has announced a 10% reservation for ‘Agniveers’ in central police forces & Assam Rifles with upper age relaxation. Defence Ministry also came up with a 10% quota which will cover the Coast Guard, defence civilian posts and 16 defence PSUs, which include major ones like Hindustan Aeronautics, Bharat Electronics, as well as four shipyards and 41 ordnance factories.
Training- As per, Army Chief General Manoj Pande, the training of first agniveers will begin this December (in 2022) at the centres.

Agneepath Scheme Notification
Agneepath Scheme for Indian Army Recruitment 2022 Notification has been released on 20th June 2022 for entrance into the Indian Army. Around 83 recruitment rallies across the country are expected to be carried out. Indian Navy will be releasing the Indian Navy Agneepath Notification on 21st June 2022. The Indian Air Force Agneepath Recruitment 2022 notification has been released in PDF format on 20th June 2022.
Agneepath Scheme Details
Agnipath or Agneepath is a recruitment scheme for the Indian youth who wish to join the Armed Forces. Agnipath scheme, a recruitment process for individuals below the rank of officer, with the goal of deploying fitter, younger troops on the front lines, many of whom will be on four-year contracts. It's a game-changing project that will give the Indian Army, Indian Navy, and Indian Air Force a young image.
What is Agniveer?
The youth selected under the Agneepath scheme will be categorised as Agniveers. Agniveers will be offered an opportunity to apply for permanent enrolment in the Armed Forces after a period of 4 years. The youths falling in the age group of 17.5 years to 23 years (revised upper age limit) who favour patriotism, teamwork, enhancement of physical fitness, ingrained loyalty to the country and availability of trained personnel to boost national security in times of external threats, internal threats and natural disasters can apply through Agneepath Yojna to become Agniveers.

The broad objectives of the Agnipath/Agneepath Scheme are-

3. To provide abilities and qualities such as discipline, motivation, dynamism, and work skills so that youth remains as an asset.

Agneepath Scheme Vacancy 2022
Through Agneepath Scheme around 46,000 soldiers are to be recruited for the Indian Army, Indian Navy and India Air Force. The detailed and elaborated vacancy distribution will be released shortly by the Indian Army. The recruitment of women under the Agneepath scheme will depend on the needs of the respective services.

The candidates who are under the age group of 17.5 years to 23 years (revised) are eligible to have an advantage of the Agneepath Scheme for the Agniveer batch in the Indian Army, Indian Air Force, and Indian Navy.
Agneepath Yojna Agniveer Salary
The salary for Agniveers in the 1st year will be around Rs. 4.76 lakh per annum which increases to Rs. 6.92 lakh per annum for the final year. Agneepath Scheme Protests
Thousands of youngsters, who are staging protests in parts of Bihar, UP, Uttarakhand and Haryana, are demanding an immediate rollback of the scheme. Protests against the Centre's Agnipath recruitment scheme continued in several parts of the country for the third day on Friday. The protests are carried as the radical scheme to recruit the bulk of soldiers for only four years will hit the professionalism, regimental ethos and fighting spirit of the Army.
