‘The World’s top NewLaw Companies – 2022 edition’
Thanks to Zohar Fisher and the team at lawflex, ‘NewLaw’ – a term/phrase my good friend Eric Chin has a claim to fame over – now has a comprehensive list of world-wide top companies (see: ‘The World’s top NewLaw Companies – 2022 edition‘). Have to be honest and say that I’m old enough to remember when asking (in RFPs/RFTs) if your law firm worked with Legal Processing Outsourcing (LPO) companies…

You wanna write about the Holocaust?
So, I got this wild idea while watching documentaries about the Holocaust tonight. Which, if you’ve been following for awhile, you’ve probably realized that Salome’s author (that would be me, lol) is a Holocaust historian. And you also probably know that I get very testy about portrayals of that narrative that romanticize the suffering of human beings (having lost my family in Stutthof and Majdanek, perhaps that’s equally unsurprising.)
This all lead me to an idea: make a post full of resources that benefit people trying to write a Holocaust narrative for legitimate purposes. If you’re are trying to have a kissypoo love story set in Auschwitz, though, please for the love of everything excuse yourself out of my post.
If you’re here because you are writing a character who has historical ties to that event, for one reason or another, or is the descendant of survivors? Well friend, YOU GON’ LEARN TODAY. And I mean, some of this is recycled from my list on Judaism-based resources, but I’m gonna get specific as fuck for y’all.
First off, let’s get a couple important bits out of the way.
UPDATED: 3/13/2017
You don’t know about Judaism at all and don’t know where to start?
The Jewish People: A Story of Survival (F)

Living Judaism: The Complete Guide to Jewish Belief, Tradition, and Practice, Wayne D. Dosick
Judaism as a Civilization, Mordecai M. Kaplan

This may also be relevant to what you’re writing, if you’re writing descendants of survivors:

Queer Jews, David Shneer
Yentl’s Revenge: The Next Wave of Jewish Feminism, Danya Ruttenberg

The Jews of Islam, Bernard Lewis
The Jews of Arab Lands in Modern Times, Norman A. Stillman
The Kaifeng Stone Inscriptions: The Legacy of the Jewish Community in Ancient China, Tiberiu Weisz
Are you going to explore the idea of how the Nazis used scientific racism against the Jews in your work? Well, it started way before the Nazis, who imported it from the Americans and Europeans so get studyin’:
Scientific Racism: The Eugenics of Social Darwinism (F)
The Human Zoo: Science’s Dirty Secret (F)
Tomorrow's Children (F; 1934 film considered immoral in its time for protesting the eugenics movement in America)
Eugenics in History (F)

Then there’s the memoirs:
Night, Elie Wiesel

There Once Was a World: A 900-Year Chronicle of the Shtetl of Eishyshok, Yaffa Eliach
Are you still thinking about making a love story or some other asinine plot set in the Holocaust narrative? Do you know that distorts the memory of my people’s worst atrocity? Maybe you should learn why pushing fictional stories that minimize the suffering endured by its victims is an horrendously bad idea:
The End of the Holocaust, Alvin H. Rosenfeld
Imaginary Witness: Hollywood and the Holocaust (F)

How do you do event marketing after GDPR?, Claire Trévien
Tumblr media
There is a lot of confusion around still on how GDPR will affect B2B companies big and small, and what steps marketers can take towards making their data more compliant. This is something I have been particularly thinking about ahead of an event we are co-organizing with Kingpin next month, titled Digital Privacy in the B2B Landscape.
Events in a pre-GDPR world often involved these scenarios:
Get your data sold to all sorts of vendors and affiliates of the organiser, whether you’re attending or exhibiting at said event. I am still receiving spam from events we exhibited at two years ago (and in spite of multiple emails asking not to be spammed further).
Get landed with the business cards your sales team have collected and told to add them to the mailing list, regardless of whether the mailing list’s content is relevant or not.
Yes, events were (and still are) goldmines, for filling up the top of the funnel, but as Maria Heckel reported at the #CIMDigital summit last September, tactics like this led 51% of consumers to feel their data has been misused, with 57% not trusting brands to use data responsibly.
As opt-in is key, I think we will see an increase in:
Gated content, where visitors will have to opt in to sharing their details in order to view slides, videos, reports, etc. These will probably feature an unticked checkbox giving permission to be added to a mailing list.
Pop ups inviting visitors to add themselves to the mailing list on event-related content, such as blog posts.
Physical sign ups at events, or tablet/laptop stations with staff inviting visitors to enter their details for mailing list purposes
In all those cases, double opt-in should be applied to make sure the email wasn’t entered erroneously. This means that the visitors who have signed up, will receive a confirmation email, and be asked to confirm their subscription.
Educate your sales team to favour social selling techniques over dumping new contacts into a mailing list. Buy them a copy of Tim Hughes and Matt Reynolds’ Social Sellingfor practical tips. Essentially, they should get into the good habit of connecting with prospects on social media, and creating and sharing content that develops them as a brand.
Start auditing your mailing list now, particularly those for whom you don’t have traceable opt-in proof. Now is a great time to send them an email inviting them to confirm their subscription. This is often a positive way to renew contact with your prospects and clients.
It might even be worth starting afresh to a new mailing system and list – a terrifying prospect for some, but one guaranteed to ensure your list only features engaged and interested readers.
Is this the end of the world?
No, in fact I think this is a really positive step towards focusing on quality rather than quantity. Do this right and you will improve your relationship with your prospects immeasurably. Here’s a few things you should start focusing on now (if you aren’t already):
Create great content – by which I mean content that is actually valuable and useful to your audience. Think of every aspect of the event that will be of interest to them, and cover it in a variety of media and angles.
Put some of this content on a gated page – slides and videos of the event in particular work well, but also reports from the event.
Add pop ups to your non-gated content inviting readers to join your mailing list
Create hyper-focused mailing lists, rather than one-size fits all. I.e if you are doing an event on cyber security, have a specific mailing list for cyber security content, rather than dumping them in a manufacturing mailing list.

Privity and Near Privity in a Professional Malpractice Setting
On Lam v Arnold Montag Architect  2019 NY Slip Op 30712(U)  March 13, 2019 Supreme Court, Kings County Docket Number: 522413/2017 Judge: Pamela L. Fisher discusses the relationship between plaintiffs and sub-contractors of their architects and other professionals, and the requirement of privity in a breach of contract case.
“On March 4, 2013, BTE entered into a contract with nonparty JNE Development (JNE) to provide architectural and engineering services for the construction of a two-family duplex located at 1582A Pacific Street in Brooklyn (property). Subsequently, on May 7, 2014, Montag Architects entered into a written agreement with nonparties Yaniv Zohar and GHIB, LLC (collectively, developers) to perform services in connection with the Preparation of Architectural Plans & Expediting to Supercede Previous Applicant” for the property (see Montag Architects moving papers, exhibit C, affidavit of Arnold Montag [Montag affidavit] at ¶ 2 and exhibit C-1, Montag Architects contract with the nonparty developers at 1).
In November 2014, plaintiffs purchased the real property. Plaintiffs contend that the purchased property has numerous design and construction defects. Plaintiffs further contend that the work performed by defendants BTE and later Montag Architects was defective, and, as a result of BTE’s and Montag Architects’ negligence and malpractice, plaintiffs have incurred $2,000,000 damages.”
“Based on the contracts submitted, Montag Architects and BTE have established that the plaintiffs were not in privity of contract with either defendant. However, plaintiffs do not even allege that they were in contract with either Montag Architects or BTE. Instead, plaintiffs allege that they are intended beneficiaries under the agreement between Montag Architects and the developers. To establish that they were intended third-party beneficiaries, plaintiffs must establish
“(1) the existence of a valid and binding contract between other parties, (2) that the contract was intended for his/her benefit and (3) that the benefit to him/her is sufficiently immediate, rather than incidental, to indicate the assumption by the contracting parties of a duty to compensate him if the benefit is lost” (State of California Public Employees’ Retirement System v Sherman & Sterling, 95 NY2d 427, 435 [2000] ; Burns Jackson Miller Summit & Spitzer v Lindner, 59 NY2d 314, 336 [1983];Cahill v Lazarski,.226 AD2d 572, 573 [2d Dept 1996]).
“Under this analysis, a professional may be held liable for negligence or malpractice even when they are not retained by plaintiff if a relationship exists between the parties that is so close as to approach privity (see Ossining Union Free School Dist. v Anderson LaRocca Anderson, 73 NY2d 417, 425 [I989]). To establish such a relationship, there must be a showing that (1) the professional was aware that their work would be used for a particular purpose, (2) upon which a known party was intended to rely, and (3) that there was some conduct on the part of the professional linking them to the plaintiff (see Caprer v Nussbaum, 36 AD3d 176, 196 [2d Dept, 2006])”
“Although plaintiffs allege that they are intended beneficiaries, they fail to allege facts sufficient to establish a relationship approaching privity. Plaintiffs were neither parties to, nor express third-party beneficiaries of, either contract at issue. In fact, the contract between Montag Architects and the nonparty developers specifically excludes the creation of a contractual relationship with third parties (see Dormitory Auth. of the State of N.Y. v Samson Constr. Co., 30 NY3d 704, 710 [2018]; Fourth Ocean Putnam Corp. v Interstate Wrecking Co., 66 NY2d 38, 44 [1985]). Plaintiffs rely on a telephone call conducted with defendant Montag; however this conversation alone is insufficient to establish a relationship approaching privity”

Jubilate Agno
Jubilate Agno is a religious poem written by Christopher Smart between 1759 and 1763, while hospitalized in London for lunacy (a very 12th house experience). Christopher Smart was born with Jupiter in Sagittarius. Note all the animals in the excerpt below.
Tumblr media
(cover art from the Jubilate Agno reprint from Factory Hollow Press)
Let Elizur rejoice with the Partridge, who is a prisoner of state and is proud of his keepers. For I am not without authority in my jeopardy, which I derive inevitably from the glory of the name of the Lord. Let Shedeur rejoice with Pyrausta, who dwelleth in a medium of fire, which God hath adapted for him. For I bless God whose name is Jealous—and there is a zeal to deliver us from everlasting burnings. Let Shelumiel rejoice with Olor, who is of a goodly savour, and the very look of him harmonizes the mind. For my existimation is good even amongst the slanderers and my memory shall arise for a sweet savour unto the Lord. Let Jael rejoice with the Plover, who whistles for his live, and foils the marksmen and their guns. For I bless the prince of peace and pray that all the guns may be nail’d up, save such [as] are for the rejoicing days. Let Raguel rejoice with the Cock of Portugal—God send good Angels to the allies of England! For I have abstained from the blood of the grape and that even at the Lord’s table. Let Hobab rejoice with Necydalus, who is the Greek of a Grub. For I have glorified God in greek and latin, the consecrated languages spoken by the Lord on earth. Let Zurishaddai with the Polish Cock rejoice—The Lord restore peace to Europe. For I meditate the peace of Europe amongst family bickerings and domestic jars. Let Zuar rejoice with the Guinea Hen—The Lord add to his mercies in the west! For the host is in the west—the Lord make us thankful unto salvation. Let Chesed rejoice with Strepsiceros, whose weapons are the ornaments of his peace. For I preach the very gospel of christ without comment and with this weapon shall I slay envy. Let Hagar rejoice with Gnesion, who is the right sort of eagle, and towers the highest. For I bless God in the rising generation, which is on my side. Let Libni rejoice with the Redshank, who migrates not but is translated to the upper regions. For I have translated in the charity, which makes things better and I shall be translated myself at the last. Let Nahshon rejoice with the Seabreese, the Lord give the sailors of his Spirit. For he that walked upon the sea, hath prepared the floods with the Gospel of peace. Let Helon rejoice with the Woodpecker—the Lord encourage the propagation of trees! For the merciful man is merciful to his beast, and to the trees that give them shelter. Let Amos rejoice with the Coote—prepare to meet thy God, O Israel. For he hath turned the shadow of death into the morning, the Lord is his name. Let Ephah rejoice with Buprestis, the Lord endue us with temperance and humanity, till every cow can have her mate! For I am come home again, but there is nobody to kill the calf or to pay the musick. Let Sarah rejoice with the Redwing, whose harvest is in the frost and snow. For the hour of my felicity, like the womb of Sarah, shall come at the latter end. Let Rebekah rejoice with Iynx, who holds his head on one side to deceive the adversary. For I shou’d have avail’d myself of waggery, had not malice been multitudinous. Let Shuah rejoice with Boa, which is the vocal serpent. For there are still serpents that can speak—God bless my head, my heart and my heel. Let Ehud rejoice with Onocrotalus, whose braying is for the glory of God, because he makes the best musick in his power. For I bless God that I am of the same seed as Ehud, Mutius Scœ vola, and Colonel Draper. Let Shamgar rejoice with Otis, who looks about him for the glory of God, and sees the horizon compleat at once. For the word of God is a sword on my side—no matter what other weapon a stick or a straw. Let Bohan rejoice with the Scythian Stag—he is beef and breeches against want and nakedness. For I have adventured myself in the name of the Lord, and he hath mark’d me for his own. Let Achsah rejoice with the Pigeon who is an antidote to malignity and will carry a letter. For I bless God for the Postmaster general and all conveyancers of letters under his care, especially Allen and Shelvock. Let Tohu rejoice with the Grouse—the Lord further the cultivating of heaths and the peopling of deserts. For my grounds in New Canaan shall infinitely compensate for the flats and maynes of Staindrop Moor. Let Hillel rejoice with Ammodytes, whose colour is deceitful and he plots against the pilgrim’s feet. For the praise of God can give to a mute fish the notes of a nightingale. Let Eli rejoice with Leucon—he is an honest fellow, which is a rarity. For I have seen the White Raven and Thomas Hall of Willingham and am myself a greater curiosity than both. Let Jemuel rejoice with Charadrius, who is from the height and the sight of him is good for the jaundice. For I look up to heaven which is my prospect to escape envy by surmounting it. Let Pharaoh rejoice with Anataria, whom God permits to prey upon the ducks to check their increase. For if Pharaoh had known Joseph, he would have blessed God and me for the illumination of the people. Let Lotan rejoice with Sauterelle. Blessed be the name of the Lord from the Lote-tree to the Palm. For I pray God to bless improvements in gardening until London be a city of palm-trees. Let Dishon rejoice with the Landrail, God give his grace to the society for preserving the game. For I pray to give his grace to the poor of England, that Charity be not offended and that benevolence may increase. Let Hushim rejoice with the King’s Fisher, who is of royal beauty, tho’ plebeian size. For in my nature I quested for beauty, but God, God hath sent me to sea for pearls. Let Machir rejoice with Convolvulus, from him to the ring of Saturn, which is the girth of Job; to the signet of God from Job and his daughters blessed be jesus. For there is a blessing from the stone of jesus which is founded upon hell to the precious jewell on the right hand of God. Let Atad bless with Eleos, the nightly Memorialist ελεησον κϮ..ριε. For the nightly Visitor is at the window of the impenitent, while I sing a psalm of my own composing. Let Mibzar rejoice with the Cadess, as is their number, so are their names, blessed be the Lord Jesus for them all. For the names and number of animals are as the names and number of the stars. Let Jubal rejoice with Cœcilia, the woman and the slow-worm praise the name of the Lord. For I pray the Lord Jesus to translate my magnificat into verse and represent it. Let Arodi rejoice with the Royston Crow, there is a society of them at Trumpington and Cambridge. For I bless the Lord Jesus from the bottom of Royston Cave to the top of King’s Chapel. Scientists Can't Explain Odd Behavior of Sharks Massing Off Israeli Coast, But Bible Can
“And it shall come to pass that fishers shall stand by it from En-gedi even unto En-eglaim; there shall be a place for the spreading of nets; their fish shall be after their kinds as the fish of the Great Sea exceeding many.” Ezekiel 47:10 (The Israel Bible™)image: https://www.breakingisraelnews.com/wp-content/uploads/2017/01/sharks.pngSharks are massing off the coast of Hadera in Israel. (Video screenshot)Dozens of sandbar and dusky sharks have appeared this week off the coast of the Israeli city of Hadera in a strange phenomenon that scientists are hard-pressed to explain – but the Bible may have an answer. It is thought that the large group of sharks, called a frenzy, are attracted to the warm water output of the electric power plant in Hadera, but in a trend that experts do not fully understand, sharks are gathering in this spot in ever-increasing numbers each winter. There many be another, simpler explanation: This could be the marine phenomenon described in Chapter 38 of Ezekiel that accompanies the war of Gog and Magog, ushering in Messiah.Surely in that day there shall be a great shaking in the land of Yisrael; so that the fishes of the sea and the fowls of the heaven and the beasts of the field and all creeping things that creep upon the ground and all the men that are upon the face of the earth shall shake at My presence. Ezekiel 38:20The Tikunei Zohar (Tinyanya Tikkun 43), an esoteric book attributed to Rabbi Shimon bar Yochai in the first century, explains that this increase of fish signifies a specific stage of the Messianic process, in which the the Messiah from the House of Joseph and the Messiah of the house of David, two separate stages, join together.Sharks Mass on Israeli CoastThe Messiah from the house of Joseph is a practical building up of the land that precedes a miraculous period, Messiah from the House of David, which includes the building of the Temple. The period ushered in by the appearance of fish is described as a period of hamtakat hadinim (sweetening of the judgements), symbolized by the fish’s ability to make seawater palatable.Fish play a prominent role in End-of-Days prophecy. http://beforeitsnews.com/alternative/2017/01/scientists-cant-explain-odd-behavior-of-sharks-massing-off-israeli-coast-but-bible-can-3468824.html?utm_source=dlvr.it&utm_medium=tumblr
