She gets in touch with Braynan, pays for all his medical bills, even though his parents are richer. Braynan no longer stays at his parents’ hotels because he is now in a wheelchair and stays in his parents’ home. Jazan has his brother Galan help with work so he can often stay home to take care of and repair his relationship with his son. Cala starts visiting often as well, shocked at almost losing her only biological son and realizes she actually cares. Lustor comes over when possible as well. Basically the entire story is balance between work and family and biological family vs adopted family and they realize all family is important, so in the end, they all live as one big happy family. Oh, and Alissa and Cala start dating in the end as well (they’re about the same age).

Misc: Note that my story takes place in the future. First of all, my character is a teenager yet I mentioned him drinking. The drinking age becomes 16 in the future, so he’s legal. Secondly, I never mentioned my character going to school. School is online so he can physically be anywhere he wants and has no classmates to talk to. I’m barely writing about his school life, but he is a good student. Thirdly, the parents are actually two men, thus the need for a surrogate. Bartering Your Soul: The Plight of Indentured Servants

Fifteen-year-old Giles Burdett entered into an agreement in 1750 “…not to contract mattremony or to frequent ordinaries or tipling houses gameing houses nor absent himself from his masters service but all his secrets keep and behave himself as a faithful servant” in order to become a tailor’s apprentice. Not only would he learn the trade, but as specified in his indentured contract, he would also become literate and have food, clothing, and lodging. Indentured contracts fueled Virginia’s labor in the 1600s as the colony transitioned to enslaved African and racial labor by the late 1600s and early 1700s. Indentured contracts came in many forms and flavors and what better way to study than by meeting the actual servants and employers?

First, we need to discuss indentured servitude. When people first arrived in the colonies in the early 1600s, many quickly died from disease leaving Virginia with a labor force shortage. The introduction of marketable and extremely profitable tobacco demanded labor and indentured contracts met that need. Men and women agreed to work for a specified amount of time receiving basic necessities with the promise of resources at the end of the indenture – “freedom dues”. In 1618, the Virginia Company of London instituted the headright system, which promised planters and merchants additional land in exchange for transporting immigrants to Virginia. This quickly blossomed and the General Assembly acted to regulate behavior, treatment, and terms of service. However, indentured servitude was not slavery. As people stopped dying so quickly from disease and assaults, Virginia experienced the opposite problem – too many people wanting land with the patriarchy not eager to share. Over the course of the 1600s, we can watch court cases and laws enacted, which slowly changed the labor system to racial slavery by 1705.

Indentured servants faced several challenges depending upon the person who owned their contract. Merchants could sell contracts to planters and the General Assembly enacted measures to control and protect (in theory) the servant. It was very possible the contract could extend much longer than arranged and the servant could face abhorrent treatment. Public indentured contracts generally followed certain rules such as specifying contract length for men and women, while privately negotiated contracts were left unregulated by the Assembly. However, the Assembly enacted laws punishing women for “ffornication” and other offences, protecting the planters. If a female servant became pregnant with the planter’s child, the servant would be sold to the church for two years upon completion of her indenture, outright assuming her pregnancy was a ploy to avoid work and abandon the child to the planter. Indentured servants ranged from convicted criminals to skilled laborers and owned/kept nothing beside what might be specified in their contract. Planters could also be very motivated to extend contracts as hiring new servants translated to some upheaval and loss of profit as the potential inexperienced replaced the experienced.

Time to delve into the more detailed contracts! In Prince William County, many of the indentures came in the form of apprenticed orphan children learning the trades of cooper, blacksmith, tailor, joiner, house carpenter, and shoemaker. As noted above, PWC also encountered more complicated contracts.

On 03/14/1756, the “poor child John Crupper” became indentured until his twenty-first birthday based upon the following conditions, “…during which the said apprentice his said master shall and well and faithfully serve, his secrets keep his lawfull commands everywhere gladly do, hurt to this said master he shall not do nor wilingly suffer to be done by others but the same to his power shall let or fourth with give notice to his said master, the goods of his said master he shall not imbazel or waste nor lend them to any body without his consent to any at cards or dice or any other unlawfull games he shall not play taverns or ale houses he shall not haunt or frequent Fornification he shall not commit matrimony he shall not contract from the service of his said master he shall not at any time depart or absent himself without his said masters leave” to become a house carpenter.

On 11/27/1759, Churchwardens Henry Lee and Lewis Reno arranged an indenture “…in the said act mentioned it is therein enacted that where any female mullattto or Indian by law obliged to serve to the age of thirty one years hath been or shall be delivered of any child during the time of servitude every such child shall serve the master or mistress of such mullatto or Indian until shall attain the same age the mother of such child was by law obliged to serve unto and whereas Hester Lucas a mulatto woman who was and is obliged by law to serve to the age of thirty one years was in the time of her servitude to Howson Hooe and before she was of the age of thirty one years delivered of a bastard child on the twenty fourth day of October…bind the said bastard child named Phillip as servant unto Howson Hooe his heirs or assigns until he the said Mulatto Bastard Phillip shall arrive to and be of the age of 31 years to serve and do any lawfull work…” with a promise of “freedom dues” at the end of the service.

On 09/05/1763, Foushee Tebbs and William Bennitt, churchwardens of Dettingen Parish arranged with John Hooe of the parish, “…Whereas Christian Gregorey a white servant woman belonging to the said John Hooe was on the twenty first day of Sept last delivered of a mulatto Bastard child in the said John Hooes Familey and house in the parish and county and which child by the law of the Colony is to srve tell it shall attain the age of thirty one years…bind the said mulatto bastard child belonging and called by the name of Thoms Grigory a sarvant unto the said John Hooe to sarve him or his heirs or have occasion to employ him…”

In 1763, Lewis Reno and William Carr arranged an indenture with Nicholas Brown for “…by an order of the court to them directed bareing date seventh day of May 1764 hath and by these presents doth bind Elizabeth Mason a negro apprentice and sarvant into the said Nicholas Brown and to his heirs untell she shall arrive to the age of eighteen years and to sarve the said Nicholas Brown & his heirs in all lawfull command…to larn hir to read, spinn knit and sew and also provide for lodging and all other necessaries…”

Prince William County patriarchs were not shy about their feelings. William Carr, agent for London merchant James Russell, consistently complained over the health, knowledge, and experience of immigrants. He judged one group of servants to be “troublesome and expensive” with plans to sell them as quickly as possible. Servants also ran away leading to intriguing runaway notices. In 09/1775, Baker Fullam ran away from Thomas Blackburn with Blackburn noting he had scars on his cheeks “…which he received from one of the many villainies he has committed during his servitude.” Although identified as a servant, Fullam indicated previous escapes and “…believed to be harbored by free mulattoes or negroes or probably he may offer his servitude to lord Dunmore, who, I am told, does not object to the colour or condition of any…” While some people noted the smell of ships as an identifying cause, others specified more personal issues such as runaway Swedish immigrant John Ecton. According to Richard Graham in 1775, “One of his testicles was swelled which he says was occasioned by a kick he got on board the Justitia Capt. Kidd”. John Smart noted he wanted an iron collar placed around Anne Marr’s neck upon her capture in 1754.

This is just a very small sample of indentured contracts. We could potentially follow the life of some while others are lost to us as they disappear from court records. Did the children enjoy the chosen trade? Did they keep the secrets as they swore to do so? Were the servants identified by race eventually enslaved or forced to leave Virginia once their “contract” expired? As always, history keeps its secrets locked tight as we desperately search for any keys or tools in our quest to pick the lock.

In the realm of information-heavy databases, highlights range from an index of searchable records that sheds light on New York’s ties to slavery to the Digital Panopticon’s descriptions of 75,688 Victorian-era convicts’ tattoos and the Getty’s archive of 6,000 photos from the waning days of the Ottoman Empire. Troves of digitized documents, meanwhile, run the gamut from historic Mexican cookbooks to a 15th-century British manners book that warns children against picking “thyne errys” and “thy nostrellys,” 155 Persian language texts spanning nearly 1,000 years, one million pages of 16th- through 20th-century content formerly deemed obscene, and the famed Dead Sea Scrolls.

Those hoping to read more personal narratives can check out photographs, prints and papers related to Queen Victoria’s husband, Prince Albert; the only surviving Arabic slave narrative written in the U.S.; and papers penned by such prominent politicians as Theodore Roosevelt, Woodrow Wilson, Warren G. Harding, Benjamin Franklin and Alexander Hamilton. Other public figures whose private lives endure in the digital sphere include civil rights activist Rosa Parks, baseball star Babe Ruth, landscape architect Frederick Law Olmsted, and explorer David Livingstone (as recorded in the diary of his chief attendant, Jacob Wainwright).

In recent years, museums have increasingly turned to digitization as a tool for widening access to their collections. Among the major cultural institutions with digitized—and often open access—offerings are the Smithsonian, which released 2.8 million images into the public domain earlier this year; Paris Musées, which oversees 14 major museums in France’s capital; nonprofit organization Art U.K.; the Art Institute of Chicago; Taiwan’s National Palace Museum; the Metropolitan Museum of the Art; the National Gallery of Art in Washington, D.C.; the Getty; the Wellcome Library; the Museum of New Zealand; and the Uffizi Galleries. Examples of artworks, artifacts and texts available for download include British psychiatric institutions’ 18th- through 20th-century records, Vincent van Gogh’s The Bedroom and Han dynasty jades.

In addition to digitizing broader collections, many museums have curated archives dedicated to specific topics: The Kunsthaus Zürich has an extensive trove of Dada documents that defy the movement’s long-held association with ephemerality, while the Delaware Art Museum has a portal of papers associated with the Pre-Raphaelite Brotherhood. Illinois State University’s Milner Library offers a digital collection dedicated to the history of circus. The San Francisco-based Letterform Archive has a digital archive of typographical artifacts. And Chicago’s Newberry Library provides online access to more than 200,000 images documenting the history of early America and westward expansion, including watercolors and colored pencil drawings by 19th- and 20th-century Lakota children.

The former offers experiences covering 3,000 years of fashion, Pieter Bruegel the Elder’s unseen masterpieces, Latino culture in the U.S., Banksy’s most famous murals, Vermeer’s surviving paintings, armor through the ages, Easter Island and many more topics. The latter has, among others, collections of rare children’s books, Taiwanese watercolors and Chinese texts, braille sheet music, travel posters, presidential portraits, baseball cards, and images of cats and dogs. The open-access Biodiversity Heritage Library, for instance, highlights more than 150,000 illustrations ranging from animal sketches to historical diagrams and botanical studies; the Watercolor World, a portal created to serve as a “visual record of a pre-photography planet,” showcases more than 80,000 paintings of landscapes, seascapes, buildings, animals, plants, ordinary people and historical events.

A Civil Contract: Same sex relationships and marriage

In April 1954 when the proposed Special Marriage Bill was being debated in Rajya Sabha a Congress MP from Bihar, Tajamul Hussain, raised the question of how the law might deal with sex change. According to the report in the Times of India (ToI) Hussain asked “if the husband changed into a woman and the wife into a man what should happen to such a marriage? Would it become void?” Hussain’s query was brushed off as irrelevant at that time, but it is not irrelevant today. With easier availability of medical services for transitioning and greater visibility and acceptance of transgender people, their marriages too are now happening. Some involve transmen and transwomen marrying each other, as with Tista Das and Dipan Chakraborty, who married in Kolkata last year after meeting in a trans legal clinic. Others are cases like that of Lalit Salve, who transitioned from being Lalita while employed as a police constable in Maharashtra. This February Salve’s marriage to his wife Seema was announced in Aurangabad.

It is no surprise that something once considered not even worth discussing is now quietly taking place in India. Marriage matters in India, as we are reminded incessantly by films and TV, by the wedding industry’s excesses, by print and online matrimonial ads, by the way even perfect strangers, leave alone family members, feel able to ask questions about our marital status. And then there is the quiet courage of those who brave the horrific risks of caste and community outrage to marry those they love.

Even those who choose to walk away from marriage, like certain unmarried spiritual leaders and politicians, subtly reinforce the importance of marriage with the implication that they are sacrificing the fulfilment that, apparently, only marriage can bring, in service to some larger cause.

So when Ayushmann Khurrana, whose recently released film Shubh Mangal Zyada Savdhan deals with both same sex relationships and marriage, was interviewed earlier this year it probably seemed just obvious to say he was proud that same sex marriages had been legalised in India. Khurrana quickly corrected himself with a tweet saying he wished it would soon happen, but it does suggest he managed to make the whole film assuming that the Supreme Court’s decriminalisation of homosexuality in 2018, which features in the film’s climax, automatically allowed same sex marriage.

Because what would be the point of being able to be openly gay or lesbian in a society like India which puts such a huge value on marriage and still be unable to get married to the partner of your choice? Nikesh Usha Pushkaran and Sonu MS, who both live in Kerala, certainly thought that way. This was why in July 2018, even before the Supreme Court had finished its hearings, they had gone to Guruvayur Temple and quietly exchanged rings to mark their commitment to each other. But they knew, when the verdict came in September that year, that while it was welcome it did nothing to make their marriage legal. And since a religiously sanctified and legal marriage did not seem remotely possible at the moment, they opted for the solution that has been available, in some form, for Indians since 1872 – a civil marriage under the Special Marriage Act.

For all that marriage is held to be a key component of society, its formal recognition by the state is a relatively new institution. Through much of history, in India and across the world, marriage has just involved some kind of declaration before witnesses, or decisions by community elders or local authorities, to recognise the union. It has been argued by scholars like James Boswell that these unions sometimes included same sex ones. The need for state recognition of marriage began, in Europe, with opposition to the authority of the Catholic church. Protestant preachers like John Calvin in the 16th century suggested the need and the anticlerical French revolution made it imperative in 1792.

A few decades earlier, in 1753, the UK Parliament made it obligatory for marriages to be registered by the state sponsored church – but only in England and Wales. Till as recently as 1940 Scotland recognised marriages made before general witnesses, which lead to many elopements to Gretna Green, the first Scottish town beyond the border with England, where marriages were often witnessed by the local blacksmith.

The Scottish legal scholar Henry Maine must have been well aware of the complexities of attitudes towards marriage when he accepted the job of legal advisor to the Viceroy of India in 1862. And this might explain his unexpected receptivity to a petition he received from a faction of the Brahmo Samaj in 1868 asking for a new law to recognise marriages that did not subject them to the demands of traditional religious authorities.

It is quite possible that the petition had more to do with the long battle of parts of the Brahmo Samaj to be recognised as a community distinct from Hindus, but Maine saw a larger potential in it. As a legal scholar he would become famous for enunciating a theory of how laws in society move from the conventions of status in traditional society to the autonomy of individuals who then create laws based on contracts.

As Perveez Mody notes in The Intimate State, her study of how the concept of love marriage has evolved in India, “the fact that the Brahmos were seeking to repudiate their ‘status’ (in this case, caste community) and intermarry through ‘reformed rite’ in the presence of a Brahmo authorised not by religious authority but by the state was, in a sense, in keeping with Maine’s theory of progress from caste ‘status’ to civil marriage ‘contract’.” Much to the surprise of everyone, possibly including the Brahmos, Maine came out with a Native Marriage Act that created a non-religious marriage for everyone willing to take that route. Initially it required formal rejection of religion (and also didn’t apply to Christians) as a neat way to step around the principle followed since the Rising of 1857 that the British would not meddle with Indian religious traditions.

Maine was drafting the law in Calcutta, then the most cosmopolitan part of India and this influenced his view of an India beyond the structures of the traditionalists. Mody notes how he cited the register of students of Calcutta University “in which, under the records of the religions of students, ‘Theist, Vedaist, Pantheist and Spiritualist are among the commonest…’” This helped him, and his like-minded successor James Fitzjames Stephens (an uncle of Virginia Woolf) to withstand the immense fury and pressure that traditionalists brought against the Act. They had to agree to modifications (like dropping the exception for Christians) and, even after it passed in 1872, very few couples actually went on to marry under it.

But it did set a template for the Special Marriages Act of 1954 that would come to replace it. This law enacted by independent India simplified the idea first set forth by Maine, creating a broad law for state recognised marriage (and divorce) that did not involve religion. Again, opposition from traditionalists did result in inclusion of clearly patriarchal clauses like different age requirements for men and women, of 21 and 18 respectively. As it happens, the current government has suggested that this specific anomaly of ages needs to be corrected – yet it is an example of the reasons cited in Nikesh and Sonu’s petition for the Act being discriminatory against them. Much of the language of the Act is gender neutral, but in a few key places like this issue about ages there are specific references to different genders. The Kerala petition explains that, with religious marriage impossible, Nikesh and Sonu decided to go the Special Marriages route, only to find “to petitioners utter shock” that these references to opposite sex couples seemed to prevent them using the law. The petition details the insult they felt at this and “thus highly aggrieved by this unjust and unequal treatment and gross discrimination meted out by the unjust provisions of the Special Marriages Act, 1954, the Petitioners are approaching this Hon’ble Court for appropriate remedies.”

Lest anyone feel inclined to dismiss their personal feelings, the petitioners also note the considerable practical problems they face by not being allowed to marry: “Being married carries along with it the right of maintenance, right of inheritance, a right to own joint bank accounts, lockers; nominate each other as nominee in insurance, pension, gratuity papers, etc.” Numerous other problems could be cited – not least the cases of same sex partners who have not been allowed hospital visitation rights to their partners of many years. And all this really is the crux of the marriage debate from Maine’s Act of 1872 till today. Opponents to the Special Marriages Acts have alleged, in often the most lurid way, that it will lead to immorality and promotion of lusts, when those who want to marry simply want the regular, mundane rights to live like any other married couple in India.

This week in Kerala High Court Justice Anu Sivaraman directed the Centre to provide an answer to the petition, postponing the matter by a month for this purpose. It is to be hoped that when this comes the response will not indulge in the moralism that opponents to the Special Marriages Acts have wasted their time in, but look at the practical issues that the petition raises and what solutions could be found.

This is a question other countries have faced, and many are still dealing with it. In Mexico, for example, it has been left to individual states, leading to a truly confusing situation where same sex couples have rights in parts of the country and not others. In Israel religious authorities have blocked civil marriages for both heterosexuals and homosexuals. This has led to a truly jugaad solution where couples are allowed to go abroad and marry and then those marriages are recognised in Israel. It is hard to see who this benefits other than travel agents.

There is also the interim step that countries like France have taken of offering most of the benefits of marriage under civil partnerships, but not actual marriage itself. But as France recognised, this is a somewhat meaningless distinction, and it is discriminatory too. The simplest solution, as proponents of the Special Marriages Act have always recognised, is civil marriage for all.
