Threads - Twitter’s Meta Rival - and Musk’s Idea Theft Concerns: Breaking down Intellectual Property Law

Meta, spearheaded by Mark Zuckerberg, launched its Twitter-adjacent app ‘Threads’ earlier this month on July 6th. Since then, the app has gained traction and shot up within social media circles across the globe, finding itself inviting a ton of traffic with Zuckerberg reporting 70 million users having signed up by Friday morning (July 7th). Not only this, but also within the first week of its launch, Threads was able to find itself at the receiving end of a potentially developing copyright lawsuit, with Twitter attorney, Alex Spiro, sending Zuckerberg a letter accusing Threads of ‘systematic, willful, and unlawful misappropriation of Twitter's trade secrets and other intellectual property’[1]. Referring to this letter, Twitter owner Elon Musk followed up by using his social media platform to send out the message: ‘Competition is fine, cheating is not’ [2]. To understand the reason behind this, it is necessary to understand that Threads’ app interface presents and operates quite similarly to Twitter - in that there are buttons available for every thread, with options to like, reply, repost and quote it. Due to this, it has been speculated that ex-Twitter staff was hired by Meta to reveal trade secrets that helped create Threads. Meta spokesperson Andy Stone created a Threads post on Thursday to deny these claims, stating that no employee under their engineering team is an ex-Twitter employee. With this as well as the simultaneous fact that the app also differs from Twitter in the sense that it does not offer features such as hashtags, direct messaging, or a similar feed structure, it seems the claim Twitter lays against Meta is that of stealing their original concept of a primarily text-based platform.

With the potential for this to develop into a larger lawsuit, the question about intellectual property law arises with regard to the extent towards which it can be legitimately applied, and where its jurisdiction lies - Do Musk’s accusations hold weight, and can Meta be found guilty in court? This article breaks this down.

Intellectual property law in the US deals with protecting and enforcing the rights of the owners and creators of all works, from music to computer software. It includes patents, copyrights, trade secrets and trademarks that work in conjunction with each other as well as separately to ensure innovations are secure from unauthorized use by other individuals. US Code 17, Section 102 on the subject matter of copyright states that copyright protection subsists in original works of authorship fixed in ‘any tangible medium of expression’ from which they could be ’perceived, reproduced, or otherwise communicated, either directly or with the aid of a machine or device’ [3]. Note: the key word here is ‘tangible medium of expression.’ According to Musk, Meta finds itself guilty of being a copycat version of Twitter. However, here, it becomes necessary to differentiate between an idea and a tangible medium of expression. Section 102(b) of the Copyright Act covers this, clarifying that: ‘In no case does copyright protection extend to ‘any idea, procedure, process, system, method of operation, concept, principle, or discovery, regardless of the form in which it is described, explained, illustrated, or embodied in such work’[4]. Even if Meta is found to have ‘cheated’, as Musk claims, off the concept of Twitter, an idea in itself is not protectable by the law. The intention of creating a text based social media platform is perceived to be a general and open-ended idea for a social media platform, and quite an ‘obvious one’ as Jacob Noti-Victor, associate professor at Yeshiva University’s Cardozo Law School who specializes in intellectual property law, notes [5]. If Meta, on the other hand, were found to be guilty of having copied specific source codes or the text of Twitter in specific through unauthorized means as the letter claims, then copyright protection laws could find Musk’s claims viable. Noti-Victor follows this by declaring that he does not see this to be the case reproduced in Threads, so the stand-alone claim of idea theft remains [6]. It is also notable how all social media platforms are separated by what is only a couple of degrees, within the context of which Twitter has faced a host of challenges from other similar blogging platforms such as Truth Social, which are essentially clones of its interface but vary to enough of an extent that Musk cannot charge them for it. Social media users within this entirely changing technological era have also been witnesses to an exchange of ideas traveling from one social media platform to another over recent years - with Instagram openly borrowing the idea of stories from Snapchat before Meta acquired both applications, as well as creating Reels based off of Tiktok’s platform. In this sense, it is evident that an idea or concept cannot be copyrighted even if it is one that is original; only a tangible and specific expression of that original concept can be copyrighted. What seems to be the problem Musk is grappling with is that while there have been many copycat versions of the platform he owns, none of them have attracted as much traffic or attention as Meta’s Threads. Due to it having tapped into Instagram’s pre-existing 2 billion monthly users and upending the social media landscape, it in turn poses a real threat to Twitter which had to build the same number of users from scratch, over the course of four years.

Since this lawsuit is still one that is developing, it is possible for more information to come to light that could potentially favour Twitter. Although, it is interesting to bring to the discussion CNBC’s report [7] about Zuckerberg having had similar experiences with creating copycat applications in the past . In the past as is now, he has ensured that while an idea may be imitated, it still maintains enough separation and difference from the original concept to insulate itself from any lawsuits. In this context, Meta seems to maintain confidence about its current stance, as Twitter pursues legal claims in the absence of idea theft laws.

Art Déco en Miami: explore lo mejor de este lugar

¿Un edificio lo puede llevar a los años más glamurosos? ¡Por supuesto! Como ejemplo ponemos al Hotel Leslie, ícono del Art Déco en Miami. Es amarillo, como sacado de una película vieja. Su fachada está llena de figuras geométricas y al verlo, el visitante se siente como en otra época.

Se encuentra en el distrito Art Déco, que tiene construcciones similares como las del hotel. De hecho, Miami es la urbe en el mundo que más edificios de este estilo conserva en sus calles, (Caballero, 2019).

En este artículo lo invitamos a adentrarse en esa arquitectura que fusiona el clima tropical y lo que en el pasado se entendía por futurismo.

Conozca el distrito de Art Déco en Miami

Situado en el extremo sur de South Beach, es muy probable que el distrito Art Déco en Miami sea uno de los lugares de la ciudad que más ha aparecido en el cine. Ejemplos hay muchos.

Por citar uno, tal vez recuerde la escena del extraño gel para el cabello que Cameron Díaz se unta en la película There’s Someting About Mary (en algunos países la tradujeron Loco por Mary). Se grabó en el conocido Hotel Cardozo, que también está en este distrito.

Estos edificios se construyeron a partir de los años 30, después de la gran depresión. Tuvo auge esta escena artística porque los estadounidenses buscaron una arquitectura que ayudara a levantar el ánimo de la población y en el Art Déco encontraron la solución.

Por ese motivo, en la ciudad comenzaron a construirse edificios coloridos y representativos de esta corriente, pero con algunas diferencias a la original. Las líneas rectas y figuras geométricas se mezclaron con las palmeras y las luces de neón. Así fue como se creó un sello único (Caballero, 2019). ¿Sabía que este distrito es uno de los más importantes de la ciudad junto con el Miami Desing District y Little Havana?

Se trata de un fin de semana donde el distrito revive el esplendor de los años 20 (Agress, 2019). Por cierto, si quiere ir a este evento, no olvide llevar sus mejores galas y alistar sus más llamativos pasos de swing. Un viaje a un pasado fascinante lo espera.

Residente conmueve con nueva versión de su tema “René”

El artista boricua provocó sentimientos entre sus seguidores y hasta en él mismo en esta versión de "René".

San Juan.- El rapero puertorriqueño Residente afloró emociones el martes en la noche, cuando aprovechó nuevamente el aislamiento social provocado por el Covid-19, para interpretar y colgar en sus redes sociales su sencillo más novel, "René". Acompañado de 30 músicos esparcidos por distintos países y las participaciones interpretativas de su madre, Flor Joglar, y el cantante panameño Rubén Blades, el artista boricua provocó sentimientos entre sus seguidores y hasta en él mismo en esta versión de "René". "Acá les dejo esta versión de 'René'. No veo a mi mamá ni a mi hijo desde que surgió todo esto pero los siento cerca todos los días", expresó René Pérez, nombre verdadero del cantante urbano. Residente también agradeció a la treintena de músicos "que nos abrazaron con su arte", a su "maestro eterno", Rubén Blades, y "al gran" músico argentino Leo Genovese por hacer posible dicho trabajo musical. En la interpretación de Flor Jogla, a ésta se le vio llorando, mientras que Residente también lloró al terminar el tema de sobre siete minutos de duración. Al momento, la nueva versión ha sido vista más de 788.000 veces en la plataforma de YouTube. Oficialmente, Residente lanzó el tema y video musical de "René" el 27 de febrero pasado. Residente confiesa que esta canción, además de ser el tema más importante en su vida personal, componerlo le ayudó en un momento muy difícil hace unos años atrás. "Esta canción me ayudó a salir de un lugar en donde no quería estar. Necesitaba volver a mi pueblo, a mi casa, a encontrarme con mis amigos, necesitaba volver a ser yo", dijo el cantante en aquel entonces. El sencillo viene acompañado de un video muy emotivo dirigido por el propio artista. En él se deja ver con transparencia y sin armaduras. El mismo fue rodado en su pueblo natal de Trujillo Alto y en el que hace un repaso de su vida hasta el presente. Residente también ha aprovechado el aislamiento social para interpretar en directo algunos temas, como "Latinoamérica", uno de sus temas más emblemáticos, y "Apocalíptico", que grabó en China para su primer disco en solitario durante un viaje que recorrió varios países y que hizo a raíz de una prueba de ADN. "Latinoamérica", una canción que presentó cuando formaba parte de Calle 13, comienza con unas palabras en lenguaje quechua y es considerada un himno contra la pobreza y por la identidad latinoamericana. Además de interpretar algunos de sus temas en directo en este tiempo, Residente también ha tenido charlas con varios líderes políticos latinos, como el presidente de El Salvador, Nayib Bukele; el expresidente de Uruguay José "Pepe" Mujica, y la congresista estadounidense demócrata de origen boricua Alexandria Ocasio-Cortez. El acto estuvo encabezado por el Jefe, Comisario Mayor Luis Aguiar, a quien acompañó la Senadora Provincial Nancy Miranda, el Vicepresidente Municipal, Rubén Wetzel, y el Diputado Nacional Jorge Lacoste, entre otros. Ante la formación de funcionarios de la policía departamental de Federal, en la tarde de este viernes se desarrolló el acto de entrega de insignias a oficiales, suboficiales y agentes recientemente ascendidos.

Tras la entonación del himno nacional y la marcha de Entre Ríos, y tras la lectura de un mensaje que hiciera llegar el Jefe de la Policía de Entre Ríos, Comisario General Gustavo Maslein, relacionado con el Día de la Policía de Entre Ríos; se comenzó con la ceremonia de entrega de insignias al personal ascendido.

En la oportunidad, y en la antesala del Día Internacional de la Mujer, se hizo un especial reconocimiento a ellas. También se reconoció el desempeño de funcionarios recientemente retirado, y especialmente a quien recientemente dejara la Sub Jefatura en Federal, la oficial Miriam Cabello del Campo, quien pasó a desempeñarse como Jefe de la Departamental de Policía del Departamento San Salvador.

Además de las autoridades enunciadas, estuvieron también en el acto el presidente municipal de Sauce de Luna, Pedro Pablo Soreira, autoridades judiciales, eclesiásticas y de la Sección Federal de Gendarmería Nacional, concejales de los bloques que integran el HCD local, la Directora del Hospital J. J. de Urquiza, Daniela Silva, y el Director Departamental de Escuelas, Santiago Krenz, entre otros funcionarios departamentales y de la plana mayor de la fuerza policial.
