a) Devoid of any distinctive character i.e. not capable of differentiating the goods and
services of one from those of others.
b) The marks or indications which are used exclusively, keeping in mind the quality,
type, quality, value, geographical origins, or at the time when the goods were.

goods or services.
c) Those exclusive marks or indications which have become customary in the
prevailing language or the established practice of trade.
As per section 9(2), these marks cannot be registered.

b) Matters that are likely to hurt religious sentiments.
c) Usage of words that are prohibited under the Emblems and Names (Prevention of
    Improper Use) Act, 1950
d) consists of scurrilous or obscene things
As per section 9(3), these marks cannot be registered.
a) The shape of the good as a result of the nature of the goods
b) The Shape of the goods is required to procure a technical result
c) The Shape of the goods through which substantial value is acquired
Relative Grounds (Section 11):
Under section 11 of the Trademark Act, 1999, the trademark is likely to create confusion due to the similarity of the mark with an existing trademark on the part of the public. In short, a trademark that is similar to the mark which already exists cannot be registered.
Exception to Section 11-Concurrent Use
Among all the relative grounds of refusal, the Trademarks Act, 1999 allows one exception in Section 12. According to Section 12, in the case of honest concurrent use, or any other special circumstances which make it proper to do so, the Registrar may permit the registration of trademarks which are identical or similar in respect of the same or similar goods or services, irrespective of the fact that such Trademark is already registered or not.
