Apple Faces $1.8 Billion App Store Lawsuit in Landmark UK Class Action Against Tech Giants
Apple is accused of exploiting its dominant position by charging app developers a 30% commission on App Store purchases, allegedly costing UK consumers up to ÂŁ1.5 billion ($1.8 billion). A mass lawsuit representing 20 million iPhone and iPad users is underway at London's Competition Appeal Tribunal.
Rachael Kent, the academic leading the case, argues that Apple has created a monopoly, restricting competition and imposing excessive fees that ultimately affect consumers.
Apple denies the allegations, stating that the lawsuit ignores the benefits of its secure iOS ecosystem and highlights that 85% of developers pay no commission.
This is the first major UK class-action-style case against a tech giant, with similar lawsuits against Google, Meta, and Amazon also in progress.

🎯 OpenAI defeats news outlets' copyright lawsuit over AI training, for now
On November 7, a federal judge in New York dismissed a lawsuit filed against OpenAI, alleging that the company improperly used articles from news sources Raw Story and AlterNet to train its language models. U.S. District Judge Colleen McMahon ruled that the plaintiffs had not demonstrated sufficient harm to justify the lawsuit. However, she left room for the outlets to submit a revised complaint, although she expressed doubt about their ability to "allege a cognizable injury."
The owners of Raw Story purchased AlterNet in 2018. Matt Topic, an attorney from Loevy + Loevy representing Raw Story, stated that the outlets are "confident we can address the court's concerns through an amended complaint." OpenAI's representatives and legal team did not immediately respond to requests for comment on the ruling. Raw Story and AlterNet initiated the lawsuit in February, claiming that thousands of their articles were used without authorization to train OpenAI's chatbot, ChatGPT, which they allege reproduces their copyrighted content when prompted.
This case is among a series of lawsuits filed by authors, visual artists, music publishers, and other copyright holders against OpenAI and similar tech firms regarding the data used to train their generative AI models. The New York Times initiated the first lawsuit by a media organization against OpenAI in December. Unlike other cases, the complaint from Raw Story and AlterNet alleged that OpenAI unlawfully removed copyright management information (CMI) from their articles rather than directly claiming copyright infringement. Judge McMahon sided with OpenAI, agreeing that the claims should be dismissed.
“Let’s clarify what is actually at issue here,” McMahon stated. “The real grievance the plaintiffs aim to address isn’t the removal of CMI, but rather the unlicensed use of their articles to train ChatGPT without compensation.” McMahon noted that the alleged harm doesn’t meet the threshold required to sustain the lawsuit. “Whether another statute or legal argument might elevate this type of harm is an open question,” she added, “but that matter is not currently before the Court.”

🎯 Oracle sues payment software company Procore over trade secrets
On October 28, Oracle, the major software company, filed a lawsuit against Procore Technologies, a provider of software for the construction industry, in a federal court in California. The suit accuses Procore of misappropriating confidential information to advance its business. According to Oracle’s claims, former Oracle employee Mark Mariano allegedly took "thousands" of trade secrets with him when he joined Procore, aiding the development of a competing software platform for managing construction payments.
Representatives for Procore, along with Oracle’s attorneys and spokespeople, did not immediately respond to requests for comment on Monday regarding the complaint. Efforts to reach Mariano for comment were also unsuccessful. Oracle, headquartered in Austin, Texas, stated that Mariano previously worked at Textura Payment Management, a construction invoicing and payment services company acquired by Oracle in 2016. The lawsuit claims that Mariano led a team at Oracle responsible for integrating third-party software with Oracle’s payment management platform.
The complaint states that Procore, headquartered in Carpinteria, California, recruited Mariano from Oracle in 2021. Oracle alleges that Mariano brought with him thousands of its files, including source code, customer data, and strategic research plans, which reportedly helped the "struggling" Procore reshape its business. According to Oracle, "soon after Mariano joined Procore with Oracle's confidential documents," Procore launched its own competing platform and swiftly introduced integrations similar to those that Oracle had previously developed while Mariano was involved in those projects.

🎯 Apple Wins $250 US Jury Verdict in Patent Case Over Masimo Smartwatches
On Friday, a federal jury sided with Apple, finding that earlier versions of Masimo's smartwatches infringed on two of Apple’s design patents, as part of an ongoing intellectual property dispute between the two companies.
The jury in Delaware agreed that Masimo's previous W1 and Freedom watch models, along with their chargers, willfully violated Apple’s smartwatch design patents.
Despite Apple’s market valuation of roughly $3.5 trillion, the jury awarded the company just $250 in damages—the statutory minimum for patent infringement in the U.S.
Apple's attorneys emphasized that the lawsuit’s main goal was not monetary compensation but securing an injunction to halt sales of Masimo’s smartwatches following the infringement finding.
However, the jury also concluded that Masimo’s current watch models do not infringe on Apple patents related to the inventions Apple alleged were copied.
Masimo expressed appreciation for the jury's verdict, stating it favored Masimo "on nearly all issues" and clarified that the decision applied only to "a discontinued module and charger."
"Apple primarily sought an injunction against Masimo's current products, and the jury's verdict is a victory for Masimo on that issue," the company added.
Apple, in response, said it was "glad the jury's decision today will protect the innovations we advance on behalf of our customers."
Masimo, based in Irvine, California, previously accused Apple of poaching its employees and misappropriating its pulse oximetry technology after the two companies discussed a potential collaboration.
Last year, Masimo persuaded the U.S. International Trade Commission to block imports of Apple’s Series 9 and Ultra 2 smartwatches after the commission determined their blood oxygen monitoring technology infringed Masimo’s patents.
