Love knows no bounds, and for couples in the bustling metropolis of Delhi-NCR, the path to marriage often involves navigating a straightforward yet essential legal process known as court marriage. Whether you’re drawn to the simplicity of it all or wish to bypass the pomp and grandeur of traditional weddings, here’s a comprehensive guide on how to embark on your journey of union through court marriage in the heart of North
1. The Starting Point:
Notice of Intended Marriage (NIM): Your journey begins by filing a Notice of Intended Marriage at the local marriage registration office. This pivotal step should be taken at least 30 days before your desired wedding date. You and your partner will need to pay a visit to the office in person to initiate the process, bringing along your identity proofs, address verification documents, passport-sized photographs, and proof of the venue where the marriage will take place.
2. Document Verification:
Once you’ve submitted your Notice of Intended Marriage, the authorities will meticulously verify the documents provided. This verification includes checking your age, identity, and address proofs to ensure they meet the legal requirements.
3. The Public Announcement – Publication of Notice:-
The Marriage Officer will publish a notice of your intended marriage at the registration office for a duration of 30 days. During this time, anyone with objections to the union may voice their concerns.
4. Dealing with Objections:
If objections are raised during the notice period, the Marriage Officer will conduct a thorough investigation and make a determination based on the merits of the case. However, if all issues are resolved, or no objections are raised, your marriage can proceed as planned.
5. The Day of Union – Marriage Registration:-
After the notice period concludes without any hindrances, it’s time to solemnize your marriage. Both you and your partner, accompanied by three witnesses, must be present at the Marriage Registration Office on the designated wedding day.
The Marriage Officer will preside over the ceremony, marking the official commencement of your marital journey. You’ll receive a marriage certificate as proof of your wedded status. Requirements for Court Marriage:
Age: For males, the legal minimum age for marriage is 21 years, and for females, it’s 18 years.

Special Marriage Act, 1954 provides for the provision of court marriages in India. The Act provides validity of the marriages between persons belonging to different castes, religion, place of birth, race, etc without any discrimination. A court marriage could be understood as a marriage solemnised according to the procedure provided by the law. The parties interested to marry through court can apply for the same to the marriage registrar of their area so as to obtain a marriage certificate. The procedure as well as the documents required for the Court Marriage In Patna has been enlisted below.
Eligibility for the court marriage-
The bride is required to be at least 18 years old at the minimum, while the groom must be 21 years old or more.
The parties shall be of sound mind.
The parties to the court marriage must be able to provide their valid consent at the time of marriage.
The parties must not be suffering from any insanity or mental disorder.
The parties should not fall within the degrees of prohibited relationship.
Documents required for the court marriage-
The application form is required to be duly signed and filled by the parties to the court marriage.
Proof for the date of birth of the parties.
Residential proof of the parties
Two passport sized photos of the parties to the court marriage
Death certificate of the previous partner if either of the parties is a widow/er
Decree of divorce by the court when either of the parties is a divorcee.
Receipt of payment of fees submitted for the application form in the respective District Court.
Affirmation by the parties to the court marriage that they do not fall within the degrees of prohibited relationship as has been provided under the Act.
Process of Court Marriage
Notice of marriage- the parties will have to give a notice to the marriage officer, as per the provisions of the Act, under whose jurisdiction either of the parties have been living for a period not less than 30 days. The parties are required to provide the notice of the intended marriage in writing and in the form as prescribed under the Second Schedule of the Act.
Publish the notice- the marriage officer will then publish the notice for marriage by affixing it in some inconspicuous part of his office so as it is visible to the general public. The notice is required to be published for a period of 30 days from the day such notice was submitted, so that an objection against such a court marriage application could be raised within this period.
Objection- as has been mentioned under Section 7 of the Act, an objection to a court marriage application could be raised on the basis of the grounds provided under Section 4 of the Act and not on a personal basis but on the legal grounds. The marriage officer, as provided under Section 8 of the Act, must enquire about the validity of such objection raised within a period of 30 days from the day the objection was filed. If the objection so raised is found to be invalid, the marriage officer would then solemnise the marriage.
Parties and the witnesses are to be present on the date of marriage- three witnesses as required shall be present in the court marriage. Signature and declaration provided under Third Schedule of the Act, the parties and the witnesses would then sign the documents in the presence of the Marriage officer.
Certificate of Marriage- after the above mentioned steps have been completed, the parties will be issued the marriage certificate. The certificate is required to be signed by the parties and the witnesses. The certificate so issued is conclusive evidence of the court marriage.
