The Part I'm Whole In: Christmas Day 2018 Edition
The Part I’m Whole In: Christmas Day 2018 Edition
I wrote this about three years ago  (during my 31 Days of A Sense of Place challenge):
I grew up primarily in three suburban neighbourhoods. What I remember most, as far as landscape that felt like home, were the wooded places and fields, behind our house in two places, nearby in another. Not deep woods, not real wilderness by any means, but a green place to escape, without humans. Particularly…

Prita and Mac’s wedding at Twin Lake Village
It was only natural that Prita and Mac host their wedding at Twin Lake Village, as the 100-year old breathtaking lakefront property in New Hampshire overlooking Little Lake Sunapee was developed by the bride’s extended family. The couple invited their friends and family to share in the love, along with the rustic scenery, lake home accommodations and tennis, boating shuffle board and hiking. The lawn ceremony and white tent reception were coordinated by Naturally Elegant Designs. Stunning florals and greenery by Emily Herzig Floral dressed every detail including a ceremony arch and a suspended escort card display. Lucky for us, Kelsey Combe Photography was on hand and captured all the breezy beauty and airy details of the lakeshore event in these beautiful images.
What made the wedding special and unique?
Our wedding took place over Labor Day Weekend at Twin Lake Village (or TLV as we like to call it!). It was developed by my extended family and has been in business for over 100 years. It is a beautiful property located in New Hampshire overlooking Little Lake Sunapee, and is home to a gorgeous hotel, houses scattered across the property that can house anywhere from 6-14 people, a par-3 9 hole golf course, boat house, tennis courts, shuffle board and amazing hiking trails! We both love the outdoors and wanted a place where family and friends could relax over the holiday weekend and partake in fun activities. My Dad grew up on the property before college, and my parents (bride’s parents!) got married there, as did many of my cousins, so it felt right and special to have it there too!
Tell us about the gown and where/how you found it!
We were living in Connecticut at the time and one of my girlfriends who had gotten married the year before spoke highly about a small boutique a mile down the street from where I lived. It was started by a woman who left her job in investment banking in New York City to pursue her passion and start the bridal boutique. I thought that was so badass so naturally I went!! It was the 2nd or 3rd dress I found and I never looked back. I loved the boutique because of how down to earth and kind everyone was and how cozy and private the space felt. The dress is made by Spanish designer Pronovias and has been seen on so many different brides – and it doesn’t surprise me because it has a special way of conforming to a woman’s body and making anyone feel beautiful.
What were some touches added to make the wedding personal?
Mac (short for Macpherson) is of Scottish descent (specifically, the “MacPherson” clan for all you Scottish history buffs), so all the groomsmen wore ties that featured the MacPherson clan tartan.
We wanted our ceremony to be personal so we had a very close family friend officiate, Mac and I wrote our own vows and we asked close family to prepare readings (of their choosing!).
My mother is Indonesian and I was fortunate enough to spend my childhood there. She wanted to bring some Indonesia to the party so she and my aunts wore traditional Indonesian formal wear (Kebaya).
Having the wedding at TLV was personal and special as well because everyone stayed on site and the entire property was walkable, which was fantastic for bonding and partaking in activities. We had a party on the beach the day before the wedding and hosted a golf tournament. Everyone attended a BBQ the night before the wedding on the lawn.
What was the most memorable part of the day?
Oh man this is such a hard one! So many. Walking down the aisle was pretty surreal. I was so nervous! I think the most memorable part of the day was the dancing we did. The band was INCREDIBLE. We were all so sweaty by the end of the night that we all jumped in the lake!
Tell us how you met and became engaged.
Mac and I met in college, but didn’t start dating until junior year! We had been dating for seven years when Mac proposed on the top of Mt. Lafayette, a 5,240 ft. mountain in New Hampshire that we had hiked up. We were with two very good friends of ours who had no idea. My girlfriend had sprained both her knees on the hike and we had to move slowly so she didn’t injure herself more! When we got to the summit of the mountain, the sun was setting, and we were an hour late. Little did we know, Mac had hiked up for the past 7 hours with a bottle of champagne and an entire charcuterie board ON HIS BACK!! We laughed and cried and proceeded to hike down to the hut we were staying in, in the dark.

Winter Sports Injury Liability in New England
New England is known for a number of outdoor attractions throughout the year, such as fishing in the spring, scenic beaches and hiking trails in summer, foliage in the autumn and snow sports in the winter.
With snowboarders and skiers coming from around the U.S. to popular mountains such as Mount Sunapee and Mount Snow, two topics always find their way into headlines – the rising cost of lift tickets and the inherent risk for injury with these activities.
Over the past 10 years, an average of 41 people have died from skiing or snowboarding-related accidents on an annual basis, according to the National Ski Areas Association. Serious injuries such as paralysis and head injuries make up about 44 of those incidents each year. The NSAA says this equals about 1 serious injury per 1 million skier or snowboarder visits to a mountain.
“Skiing and snowboarding enjoy an excellent safety record. Skiing and snowboarding are less dangerous than other high-energy participation sports, and less so than some common activities,” the NSAA said. “However, skiing and snowboarding are still challenging and require physical skills that are only learned over time with practice. The sports involve some inherent risk, but in some measure, it is the thrill that entices most skiers and riders to pursue the sports. Even with the attendant risks, the health and fitness benefits of skiing and snowboarding are enjoyed by people of all ages across the slopes each season.”
Winter Sports and Personal Injury Liability
Most New England states have laws regulating lawsuits and personal injury claims against ski resorts except in the cases of obvious negligence. The risk of the sport has been taken into consideration by the lawmakers.
For example, the Massachusetts law expects that “a skier who boards a recreational tramway shall be presumed to have sufficient abilities to use the same, and shall follow any written or oral instruction given regarding its use and no skier shall embark on a recreational tramway without authority of the operator.”
In clear language, Massachusetts assumes the skier or snowboarder has the skills needed to be on the mountain, and they can’t hold the facility liable if they get hurt. This also applies to interacting with other skiers and snowboarders on the hill.
“A skier skiing down hill shall have the duty to avoid any collision with any other skier, person or object on the hill below him, and … the responsibility for collisions by any skier with any other skier or person shall be solely that of the skier or person involved and not that of the operator, and the responsibility for the collision with any obstruction, man-made or otherwise, shall be solely that of the skier and not that of the operator, provided that such obstruction is properly marked pursuant to the regulations promulgated by the board.”
In the scenario where someone executes a jump over a skier and makes contact with them, the law states that the facility is not liable – as it was the responsibility of both skiers to keep themselves safe.
Similarly, in Vermont, the law says that skiers are liable for rescue expenses, and attorney fees and costs with the ski area operators being exempt from liability in response to rescue situations except under gross negligence.
  Taking Action Against a Resort
While skiers are assigned with the majority of the responsibility because of the assumed inherent dangers of the sport, facility owners don’t get carte blanche. The law says they must still make sure to maintain the facility, equipment and provide appropriate signage. This also includes “trail maintenance and emergency vehicles, including snowmobiles” that must have flashing or rotating lights. When marking trails for danger or closure, it must be “in a manner to afford skiers reasonable notice.”
There is, however, the added difficulty of witnesses and a short window of time in which to bring an action forward against the facility. Section 71P of the law says that no action shall be brought against the ski area operator for injury unless the area was notified within 90 days of the incident.
The only exception to this is if the “court finds under the circumstances of the particular case that such ski area operator had actual knowledge of said injury or had reasonable opportunity to learn of said injury within said ninety-day period.”
So, even though the dangers of the sport are often touted, when compared to other sports, skiing and snowboarding pose significantly less danger. However, when accidents do occur, unless the facility can be found grossly negligent or failed to notify the individual of significant dangers, the burden of cost and injury fall on the skier or snowboarder.
From us here at Kiley Law Group, be safe out there.

My Summer Story - Catch A Fish - Kinda
Let It GOOOOOO.
Ya - that is what I did. I let the silly fish go, by accident. It must have been my awesome Frozen fishing pole that Tony got me.
Let me start from the beginning. The truth is I should have just put “Go fishing” not - “Catch A Fish”. Those who know me, know that staying still for a long period of time, while being quiet, just isn’t my thing. But I liked the idea of exploring with my boyfriend and trying something brand new.  Sure, I fished with my Grandpa, once upon a time, and with my little Mickey Mouse fishing pole. I am sure I caught some stuff at Lake Sunapee, with his help - but besides that, fishing just wasn’t an Amanda activity. But this summer I was determined to make it one!
Tony and I decided to both take a day off of work and go to Bigelow Hallow to explore and fish. The night before we did some prep work. We packed a little meal, got some stuff together to hike through the brush, and of course we bought me my own fishing pole.  We went to WalMart and picked up some tackle and some other fish stuff (I wasn’t really paying attention) and then I saw it - the meca - the only thing I needed in my life - a Disney Frozen fishing pole.
All I had to do was look at Tony and start singing “Let It Go” and he was ready to say “Fine, I will get it for you as long as you stop singing” (my true superpower).  Once I had that pole I was truly ready for the day to come.
Bigelow Hollow was beautiful. We walked in and got to see some underage kids get busted for alcohol - which is always amusing - and then we picked a path and started to go go go. I would be lying if I said I enjoyed all the hiking. It was a bit too much for my liking, but Tony loved it and that makes me happy.
We found a cute little spot that Tony was convinced we could walk out to and after failing to dig up worms we decided to fish with the meat from the soup (we are regular adventure men) and out we went.
Well, needless to say, it was NOT easy to walk out to the rock, and the meat from the soup did nothing for us. It was not a success. But it was beautiful, I got a great picture and we laughed a whole lot. The closest I got to actually catching a fish was watching Tony catch one and then I did something stupid which made him accidentally let it go. Whoops.
We tried so hard.
Then, a couple weeks later we went to Vermont on a trip with Tony’s family and we gave fishing one more try.
Nada.
Less than nada.
I did not catch a fish this summer.
But - I did get a Frozen fishing pole.
I’m satisfied.

A free series of fall foliage hikes is planned across New Hampshire in the coming weeks
Following the leaves as they turn color from north to south in New Hampshire, the Five Easy Hikes series will catch the early reds of turning maples in Bethlehem, take in a full-moon hike near Lake Sunapee, catch the breathtaking views over Lake Winnipesaukee in Alton, explore a less-traveled trail on Mount Monadnock in Jaffrey and end with a pre-Halloween visit to a property some believe to be…
