I just returned from running an errand in Dystopia, Grants Pass Oregon.
I went to:
Walgreen’s
As I left my home, the pressure from the local terror cells was in place, and running a “Save The Princess” terror play, but it was somewhat a reversed version of that standardized murder play, it did not work, however.
The grey Toyota Camry from the Myers terror family cell roled down the road as I was at my gate. It’s typical that the terrorists have to drive a car past my front driveway at the time that I leave my home, and 90% of the time that I do take my car somewhere, there will be one of the terror neighbors driving by while I am at my gate. They use the listening devices they placed around my home to know when I have opened my front door, and can hear where I am with other listening devices, and also they have a variety of cameras pointed at my driveway from the Former Monroe terror cell.
So that grey Camry appears to have dropped off Lorena Chapman in front of teh Clyde Baum terror cell, at 333, where there are more cameras positioned on the roadway, disguised as a driveway night-light.
The idea was to use Lorena Chapman, or someone who looks just like her, to do some kind of “Save the Princess“ after I started to go down the road on my way to the Walgreen’s.
The “Good Samaritan” who was also set into motion as part of the attack plan, was someone driving the Rick Manning Red Honda Station Wagon. Who came down the road in the opposite direction just after I passed the Chapman look-a-like that was on foot in front of the Baum terror cell.
Other items associated with the attack plan included that a door was left open in three places along the route to the Freeway. One at Chartrand 376 was the back door to the shell of one of his pick-up trucks. Another was the door of a passing school bus, the driver of the bus was driving with the school bus doors open. And another open door was at the I-5 Freeway exit 66 in the empty lot there where the terror watchdogs sit in their cars while doing surveillance of the people who drive into, or out of, the Hugo Oregon area. That person there was playing the role of the “sleepy, road weary driver who pulled over to take a nap in the backseat with the door open”.
The idea was that they terror bastards needed to get a recording of my voice saying “the door is open” or some other mention of a door. “The Door Is a Jar”, #SAGClubMed terror play, specific for those victims who are on the way to a pharmacy. “The Door is a Jar” comm items, and communication, is all done in such a way that any and all passing terror soldiers in the area, will see the visual clues, read the comm the items are put there for, and in that way, are able to step-in, to provide support services for the attacking terror cell. No words are spoken about the attack, the visual items and other activity is enough, that all of the terror cells already know how to behave, and how to assist with the murder.
The implant in my jaw broadcasts everything that I say, all of the time, and has done so since 2011. The implant is a microphone inside of my jaw. I cannot turn it off, or remove it, it broadcasts all of the time, and the recordings that are created in that trailer at the Former Monroe terror cell are edited, word by word, and fed to public safety people who are killed also, by the terror cells, as a result of their own foolishness.
So, that attempt failed. The words I used were: “Looks like Chartrand has his foot in the door” as a I passed by, and saw the truck with shell door open. I encountered two more attempts to get me to say “the door is open” just in passing, and while not speaking to anyone.
They may have been trying to use such a statement live, to fool someone that I am giving permission to enter my home, or car, as I passed by the walking Chapman look-a-like on the roadway when I was leaving.
The typical debit card malfunction occurred at the Walgreen’s. The debit card readers at ALL of the places I make purchases, always, 99% of the time, malfunction in some way while I am using the debit machine. The “Malfunctioning debit card reader, is part of the murder scenario at the point of purchase at ALL of the places that items are sold, everywhere. That malfunction makes certain that the intended victim is per-occupied with the distraction that is provided by the malfunctioning debit card reader. The Marked Victim focuses all of their attention onto that small, digital, card reader at that time, and that is a good time for the terror assassins to make the hit on the Victim, while the Victim has the debit card in their hand.
There is some kind of a billing terror play happening with the items I purchased at the Walgreen’s. The price of the items I purchase is almost never the same as it was the previous time I purchased the same exact items. The price should be consistent, but is not. One of the items I purchased today had a price of $0.00. No charge. It was that way the last visit last month also.
What is going on, is there is a duplicate person in the Screen Actor Guild, who si receiving what is known as “MAX” prescription medicine. That person fills a whole bunch of meds, and those are the meds I used to get, before the terror took over. Someone is receiving the medicine that I could benefit from, and I am only receiving sort of a “Token” of what I should be getting at a pharmacy. What’s more, is the persons receiving my prescriptions are also getting more than my history, and beneficial requirements warrant. The terrorist doctor gave those people the “MAX” allotment of meds. All of that happens, I get blamed, and the public safety people who come to investigate, are killed by the people who are perpetuating the “MAX” allotment. As a result, I get far less of the medicine that would benefit me, and has benefited me in the past for many years, and the meds improved my quality of life. Now, all I get is the “token” appeasement meds, some Rock Star gets my medicine.
On the way home, I observed three Impostor Police cars. Two near the Southbound I-5 had pulled someone over, and another Imposter State Police was at the exit 66 that I need to use, with lights flashing. They are trying to make me “Run” out of “fear” because I had to kill Jay Inslee yesterday in defense while at the terror controlled doctor office.
Jay inslee had a kidnapped child with him at the terror doctor, and the people there shot me with a small caliber gun in the waiting area. I returned the favor by turning the shooters gun around, in the lobby, and shooting the shooter with his own gun as he was holding it. I never had to take the gun from the shooter that shot me there.
StoneMan unscathed.
That shooter was there for Jay Inslee, who had the kidnapped child, and they had planned on blaming the kidnapping on me, after they killed me.
A lot happened at the terror doctor yesterday. I already reported hwat was important. Jay Inslee is a piece of shit, and he received exactly what he bargained for, is presumed dead due to severe Corona Virus Bleeding from the head.
Also, I had to defend against a 450 lb nurse at the terror doctor yesterday. That nurse is presumed to be permanently paralyzed  at the arms and shoulders, having suffered a spinal cord injury during the fighting in the back office at the terrorist #SAGClubMed Doctors Office.
That is all of the terror reporting that I want to write about  today. I want to say that I am doing whatever helpful things that I can do, to help the people that are held captive at Boeing Seattle. Whenever opportunity presents itself, I take the chance of retaliation from the people who hijacked Boeing, and I try to get helpful people to go there. and set the engineers  and others free from their captivity at Boeing Seattle.
Yesterday. opportunity to kill Jay Inslee presented itself in the form of a kidnapped child that Inslee had with him. I was able to free the child, as O have done at other times at the terrorists #SAGClubMed doctor that I have been going to fir about five years. I don’t know if teh child was able to leave the building safely, he was about eight years old, I killed Jay Inslee, and escorted him to an exam room there before he actually died. While doing that, the child said: “That man is not my dad. He is NOT my dad”, so, I looked at the boy and said:
“I believe you, run away, go on... go, runaway now, all of the adults around here are terrorists, so, stay away from the adults, don’t let them catch you. Go. Run away now”
The boy ran out from the back office area at the terror doctor. I presume the terror bastards caught him again by now though.

House Report Condemns Boeing and F.A.A. in 737 Max Disasters
What would you do if previous Boeing employees had identified five broad problems with the MAX’s plane's design, construction and certification. First, the race to compete with the European rival Airbus and its new A320neo led Boeing to make production goals and cost-cutting a higher priority than safety, the Democrats argued. Second, the company made deadly assumptions about software known as MCAS, which was blamed for sending the planes into nose dives. Third, Boeing withheld critical information from the F.A.A. The two crashes that killed 346 people aboard Boeing’s 737 Max and led to the worldwide grounding of the plane were the “horrific culmination” of engineering flaws, mismanagement and a severe lack of federal oversight, the Democratic majority on the House Transportation and Infrastructure Committee said in a report on Wednesday.
The report, which condemns both Boeing and the Federal Aviation Administration for safety failures, concludes an 18-month investigation based on interviews with two dozen Boeing and agency employees and an estimated 600,000 pages of records. The report argues that Boeing emphasized profits over safety and that the agency granted the company too much sway over its own oversight.
“This is a tragedy that never should have happened,” said Representative Peter A. DeFazio of Oregon, the committee chairman. “It could have been prevented, and we’re going to take steps in our legislation to see that it never happens again.”
Republicans on the committee, without issuing their own report, also called for safety improvements. But Representative Sam Graves of Missouri, the committee’s top Republican, said that while change was needed, congressional action should be based on expert recommendations, “not a partisan investigative report.”
The report was issued as the F.A.A. appeared close to lifting its March 2019 grounding order for the Max after evaluating data from test flights this summer and proposing changes to the jet. F.A.A. clearance could lead aviation authorities elsewhere to follow suit and allow the plane to fly again as soon as this winter.
Even as it strives to get the Max back into service, Boeing is contending with other challenges, including the deep downturn in air travel because of the coronavirus pandemic, and quality concerns about its 787 Dreamliner.

The findings are largely in line with an abundance of information uncovered by federal investigators, news reporters and the committee’s preliminary work after the crashes in Indonesia in October 2018 and Ethiopia in March 2019.
Those crashes were caused in part by the MCAS system. Because the engines are larger and placed higher than those on the plane’s predecessor, they can cause the jet’s nose to push upward. MCAS was designed to push the nose back down. In both crashes, the software was activated by faulty sensors, sending the planes toward the ground as the pilots struggled to pull them back up.
The deaths could have been avoided if not for a series of safety lapses at Boeing and “grossly insufficient” oversight at the F.A.A., the Democrats argued. Internal communications at Boeing showed that several employees raised concerns about MCAS over the years, but their concerns were either dismissed or inadequately addressed, the House report said. It also accused Boeing of intentionally misleading the F.A.A., echoing a July report from the Transportation Department’s inspector general.
That report found that Boeing had failed to share critical information with regulators about important changes to MCAS and had been slow to share a formal safety risk assessment with the agency. The inspector general also said that Boeing had chosen to portray the MCAS software as a modification to an existing system rather than a new one, in part to ease the certification process, a decision that an authorized F.A.A. representative at the company agreed with, according to the congressional report.
Under federal law, the agency is allowed to delegate some oversight to manufacturers, but that practice backfired at Boeing, the congressional report found.
In 2012, for example, a Boeing test pilot took more than 10 seconds to reverse an MCAS activation, a response time that he later described as “catastrophic.” Boeing cited that finding several times over the years in internal documents, but the House report found no evidence that any of the four F.A.A. representatives at the company who knew of the finding ever passed it on to the agency. Sharing the information was not required, but the failure to do so was “inconceivable and inexcusable,” the report said.
F.A.A. management came in for severe criticism over its response to the crashes. In December, the report said, Ali Bahrami, the F.A.A.’s associate administrator for aviation safety, told committee staff members that he was unaware of an internal assessment produced after the first crash that had predicted 15 more over the lifetime of the Max fleet if MCAS was not fixed.
The report also said the agency was “inexplicably slow” in turning over records.
“The F.A.A. was actually more frustrating” than Boeing, Mr. DeFazio said on a call with reporters. “I’m not sure that we ever got all of the email chains we wanted. They claimed to have a very primitive old computer system.”
The report faulted Boeing for a lack of transparency, driven in part by a desire to play down the need for simulator training for pilots. Under a 2011 contract with Southwest Airlines, for example, Boeing had promised to discount each of the 200 planes in the airline’s order by $1 million if the F.A.A. required such simulator training for pilots moving from an earlier version of the aircraft, the 737NG, to the Max. That, the committee argued, created an incentive for Boeing to withhold critical safety information from the agency.
“This report lays bare the lie that Boeing cares about safety or the hundreds of lives they have ruined,” said Yalena Lopez-Lewis, whose husband, Army Capt. Antoine Lewis, died in the Ethiopian Airlines crash. “Boeing cut corners, lied to regulators, and simply considers this the cost of doing business.”
Democrats declined to provide details of prospective legislation, but said they were working on bipartisan reforms that could be passed before the end of the year.
“We are working closely with Republicans in the hope of coming to an agreement on a reform proposal in the very near future,” Representative Rick Larsen of Washington, the chairman of the aviation subcommittee, told reporters.
In a statement, Boeing said it had learned lessons from the crashes and had started to act on the recommendations of experts and government authorities.
“Boeing cooperated fully and extensively with the committee’s inquiry since it began in early 2019,” the company said. “We have been hard at work strengthening our safety culture and rebuilding trust with our customers, regulators and the flying public.”
The revised Max design has received extensive review, the company said, arguing that once the plane is ready to fly again, “it will be one of the most thoroughly scrutinized aircraft in history.”
The F.A.A. said in a statement that it would work with the committee to carry out any recommended changes and was already making some of its own.
“These initiatives are focused on advancing overall aviation safety by improving our organization, processes and culture,” it said.
Last month, the agency announced plans to require a number of design changes to the Max before it can fly again, including updating MCAS and rerouting some internal wiring. The proposed rule is open for public comment until next week. Barring major obstacles, the agency could lift its grounding order on the plane in the weeks or months to come, allowing Boeing to prepare the planes to fly as soon as this winter.
While hundreds of orders for the jet have been canceled, several thousand remain. In some cases, customers cannot break contracts or are otherwise deeply entwined with Boeing. Many also still want to add the Max to their fleet. A new plane can last a generation and typically requires little maintenance in the first few years of use. The Max promises substantial fuel savings, too, which can add up over several decades.
Still, Boeing warned in January that the grounding would cost more than $18 billion. And that was before the severe downturn in travel caused by the pandemic. Last month, Boeing said it would expand the 10 percent cut to its work force announced in April. And the company said last week that deliveries of its 787 Dreamliner, a large twin-aisle jet used for long-distance flights, had been slowed by new quality concerns.

Internal communications at Boeing showed that several employees raised concerns about MCAS over the years, but their concerns were either dismissed or inadequately addressed, the House report said. It also accused Boeing of intentionally misleading the F.A.A., echoing a July report from the Transportation Department’s inspector general.
That report found that Boeing had failed to share critical information with regulators about important changes to MCAS and had been slow to share a formal safety risk assessment with the agency. The inspector general also said that Boeing had chosen to portray the MCAS software as a modification to an existing system rather than a new one, in part to ease the certification process, a decision that an authorized F.A.A. representative at the company agreed with, according to the congressional report.
Under federal law, the agency is allowed to delegate some oversight to manufacturers, but that practice backfired at Boeing, the congressional report found.
In 2012, for example, a Boeing test pilot took more than 10 seconds to reverse an MCAS activation, a response time that he later described as “catastrophic.” Boeing cited that finding several times over the years in internal documents, but the House report found no evidence that any of the four F.A.A. representatives at the company who knew of the finding ever passed it on to the agency. Sharing the information was not required, but the failure to do so was “inconceivable and inexcusable,” the report said.
F.A.A. management came in for severe criticism over its response to the crashes. In December, the report said, Ali Bahrami, the F.A.A.’s associate administrator for aviation safety, told committee staff members that he was unaware of an internal assessment produced after the first crash that had predicted 15 more over the lifetime of the Max fleet if MCAS was not fixed.
The report also said the agency was “inexplicably slow” in turning over records.
“The F.A.A. was actually more frustrating” than Boeing, Mr. DeFazio said on a call with reporters. “I’m not sure that we ever got all of the email chains we wanted. They claimed to have a very primitive old computer system.”
The report faulted Boeing for a lack of transparency, driven in part by a desire to play down the need for simulator training for pilots. Under a 2011 contract with Southwest Airlines, for example, Boeing had promised to discount each of the 200 planes in the airline’s order by $1 million if the F.A.A. required such simulator training for pilots moving from an earlier version of the aircraft, the 737NG, to the Max. That, the committee argued, created an incentive for Boeing to withhold critical safety information from the agency.
“This report lays bare the lie that Boeing cares about safety or the hundreds of lives they have ruined,” said Yalena Lopez-Lewis, whose husband, Army Capt. Antoine Lewis, died in the Ethiopian Airlines crash. “Boeing cut corners, lied to regulators, and simply considers this the cost of doing business.”
Democrats declined to provide details of prospective legislation, but said they were working on bipartisan reforms that could be passed before the end of the year.
“We are working closely with Republicans in the hope of coming to an agreement on a reform proposal in the very near future,” Representative Rick Larsen of Washington, the chairman of the aviation subcommittee, told reporters.
In a statement, Boeing said it had learned lessons from the crashes and had started to act on the recommendations of experts and government authorities.
“Boeing cooperated fully and extensively with the committee’s inquiry since it began in early 2019,” the company said. “We have been hard at work strengthening our safety culture and rebuilding trust with our customers, regulators and the flying public.”
The revised Max design has received extensive review, the company said, arguing that once the plane is ready to fly again, “it will be one of the most thoroughly scrutinized aircraft in history.”
The F.A.A. said in a statement that it would work with the committee to carry out any recommended changes and was already making some of its own.
“These initiatives are focused on advancing overall aviation safety by improving our organization, processes and culture,” it said.
Last month, the agency announced plans to require a number of design changes to the Max before it can fly again, including updating MCAS and rerouting some internal wiring. The proposed rule is open for public comment until next week. Barring major obstacles, the agency could lift its grounding order on the plane in the weeks or months to come, allowing Boeing to prepare the planes to fly as soon as this winter.
While hundreds of orders for the jet have been canceled, several thousand remain. In some cases, customers cannot break contracts or are otherwise deeply entwined with Boeing. Many also still want to add the Max to their fleet. A new plane can last a generation and typically requires little maintenance in the first few years of use. The Max promises substantial fuel savings, too, which can add up over several decades.
Still, Boeing warned in January that the grounding would cost more than $18 billion. And that was before the severe downturn in travel caused by the pandemic. Last month, Boeing said it would expand the 10 percent cut to its work force announced in April. And the company said last week that deliveries of its 787 Dreamliner, a large twin-aisle jet used for long-distance flights, had been slowed by new quality concerns.

So, when that happens, the knife fumbler cannot do dishes, says: “Jesus...sisusussus” and is the secret knowledge behind Jesus Face Toast, comes from the Blender with upside down Ibuprofen Union Cute Face Outlet, has to go to the hospital for electrocution damage, the ensuing fire could also burn the wet handed butter knife fumbler... lots of problems could happen just because the outlet looks cute.
At the hospital.... the outlets were installed correctly for a long time, because there is a difference between “Class A” and Residential Union Workers of the Ibuprofen Electrical Workers Union. Over time, the “Class A” electricians were replaced with Jesus was a Carpenter kind of Electricians, everything turned upside down even when it was right side up. because the Building & Safety Inspectors, who are SAG, took over at the county offices, inspect the work, say “Turn those outlets the way they are supposed to be” ... but, those people are all actors, just reading their lines at the hospital inspection.
The cute face on the electrical outlet is the 0-G router bit, Electrician Grade, makes special “Ohh Gee, look at that nasty wound you have there, must have been a real shock”, that leads to the hospital, fire department, some lawyers could show up, insurance premium could increase, need some kitchen remodel work after the smoke clears.... lots of problems with Electrician Grade 0-G Router Bit, is for routing to riches, for terror.

Ramos v. Louisiana and the Jim Crow Origins of Nonunanimous Juries
Ramos v. Louisiana, decided by the U.S. Supreme Court last Monday and summarized here, holds that the Sixth Amendment impartial jury guarantee gives defendants a right to a unanimous jury verdict in state trials. The case is making waves for reasons tangential to the dispute between the parties: in a dizzyingly split opinion, the justices argue more over the meaning of stare decisis (the court’s obligation to follow its prior holdings) than whether defendants in state courts may be convicted by a less-than-unanimous jury. This aspect of the opinion has been widely discussed (see analysis here, here, here, and here), and foreshadows the justices’ likely battle over an upcoming reproductive rights case. Since the divergent perspectives on stare decisis have been covered elsewhere, I will consider another issue that split the justices: the legal relevance of the nonunanimous jury law’s Jim Crow origins.

The facts and procedural history of the case
Evangelisto Ramos was charged with a second-degree murder in New Orleans in 2014. He maintained his innocence and invoked his right to a jury trial. At the conclusion of the trial, ten jurors found Mr. Ramos guilty and two jurors found him not guilty. In the 48 states (including North Carolina) and federal court where all jurors must agree on a guilty verdict to convict a defendant, this would have resulted in a hung jury and a mistrial. Instead, because he was tried in Louisiana (before voters repealed the nonunanimous jury provision in 2019), Mr. Ramos was convicted and sentenced to life in prison without the possibility of parole. Appellate courts in Louisiana affirmed the conviction, relying on Apodaca v. Oregon, 406 U.S. 404 (1972), which had declined to extend the Sixth Amendment right to a unanimous jury to the states under the Fourteenth Amendment. The Supreme Court granted certiorari and reversed Mr. Ramos’s conviction.
Mr. Ramos’s Sixth Amendment challenge
Mr. Ramos asserted that the nonunanimous jury verdict violated his Sixth Amendment right to a unanimous jury. His argument rested on the historical and continued meaning of the Sixth Amendment right to a trial by an impartial jury, which provides that “[i]n all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury[.]” He argued that the impartial jury guarantee, at the time the Sixth Amendment was adopted in 1789, included the right to a unanimous jury verdict. Neither party disputed that the right to a unanimous jury verdict was central to the jury trial right at common law, dating back to 1367. See Douglas G. Smith, The Historical and Constitutional Contexts of Jury Reform, 25 Hofstra L. Rev. 377, 397 (1996). The U.S. Supreme Court has referenced that history on several occasions, at one point describing the common law right to a unanimous jury as so widely known that “[n]o authorities are needed to sustain this proposition.” Am. Publ’g Co. v. Fisher, 166 U.S. 464, 468 (1897). And the Supreme Court had already agreed that the purpose and effect of the impartial jury guarantee of the Sixth Amendment was to codify the common law meaning of the jury right, including the right to a unanimous verdict. See, e.g., Patton v. United States, 281 U. S. 276, 288 (1930). The only question before the Ramos court was the applicability of that aspect of the right to the states—whether the right was incorporated under the Fourteenth Amendment to bind states as well as the federal government. The biggest hurdle for Mr. Ramos to overcome was that the earlier decision, Apodaca, already answered this question in the negative.
Nonunanimous jury verdicts sound race-neutral: what’s race got to do with it?
Justice Gorsuch begins his opinion, in a portion joined by a narrow majority of the justices (Justices Breyer, Ginsburg, Sotomayor, and Kavanaugh), with a history lesson not on the Sixth Amendment but on nonunanimous juries in Louisiana. It is an ugly history, revealing a white supremacist backlash to the growing rights and political power of black people at the end of the nineteenth century. The move away from unanimous juries in Louisiana emerged in response to constitutional, statutory, and judicial efforts to secure the rights of black people to serve on juries through the adoption of the Fourteenth Amendment in 1868, the Civil Rights Act of 1875, and the U.S. Supreme Court’s decision in Strauder v. West Virginia, 100 U.S. 303 (1880) (holding that racial discrimination in jury selection compromises the right of trial by jury and violates the Equal Protection Clause). Justice Gorsuch explains that the nonunanimous jury provision originated in Louisiana’s 1898 constitutional convention, the purpose of which, according to one committee chairman, was to “establish the supremacy of the white race.” Ramos v. Louisiana, Slip. Op. at 2. Alongside other Jim Crow provisions intended to disenfranchise black people, including a poll tax and combined literacy and property ownership test, the nonunanimous jury provision targeted black people without explicitly naming this intent in its text. “With a careful eye on racial demographics, the convention delegates sculpted a facially race-neutral rule permitting 10-to-2 verdicts in order to ensure that African-American juror service would be meaningless.” Slip Op. at 2 (internal quotations omitted).
Justice Kavanaugh explains why nonunanimous jury provisions limit the influence of black jurors on the outcome of criminal trials:
Then and now, non-unanimous juries can silence the voices and negate the votes of black jurors, especially in cases with black defendants or black victims, and only one or two black jurors. The 10 jurors “can simply ignore the views of their fellow panel members of a different race or class.” Johnson v. Louisiana, 406 U. S. 356, 397 (1972) (Stewart, J., dissenting). That reality—and the resulting perception of unfairness and racial bias—can undermine confidence in and respect for the criminal justice system. The non-unanimous jury operates much the same as the unfettered peremptory challenge, a practice that for many decades likewise functioned as an engine of discrimination against black defendants, victims, and jurors. In effect, the non-unanimous jury allows backdoor and unreviewable peremptory strikes against up to 2 of the 12 jurors.
Slip Op. at 35 (Kavanaugh, J., concurring in part).
In 1974, Louisiana readopted its nonunanimous jury provision. Why? The justices don’t seem sure. Justice Gorsuch briefly concludes that “it’s hard to say why these laws persist”; Justice Kavanaugh speculates that the continued reliance on nonunanimous juries “may have been motivated by neutral principles (or just by inertia)”; and Justice Alito notes that the stated purpose of the nonunanimous jury provision in 1974 was judicial efficiency and, in the debate, “no mention was made of race.” Slip Op. at 3 (Alito, J., dissenting). But Justice Sotomayor observes that when it comes to old laws originally motivated by racial animus, it is often the case that “States’ legislatures never truly grapple[] with the laws’ sordid history in reenacting them.” Slip Op. at 33 (Sotomayor, J., concurring in part). She finds that Louisiana’s only effort to do so came not in 1974 but just last year, when Louisiana voters approved a 2019 referendum repealing the nonunanimous jury provision. The campaign for a unanimous jury right focused in part on the racist origins and continuing racially disparate outcomes of the nonunanimous jury law.
Raise your hand if you think that the Jim Crow origins of Louisiana’s nonunanimous jury provision is important to consider in this case
Not all nine justices think we should consider this history. Only five do. Four justices share Justice Gorsuch’s perspective that the racist history of Louisiana’s nonunanimous jury verdict law matters here. Concurring in most of Justice Gorsuch’s opinion, Justice Sotomayor writes separately to stress how important the Jim Crow history is to the invalidity of nonunanimous juries. Justice Kavanaugh also spends part of his lengthy concurrence discussing the significance of the racism that gave rise to nonunanimous juries. Justice Thomas ignores the Jim Crow history altogether, and Justice Alito, joined by Justice Kagan and Chief Justice Roberts, seems more offended by the majority’s audacity to observe that racism underpinned the nonunanimous jury provision than by the racism itself. Slip Op. at 62-66 (Alito, J., dissenting).
It may sound unremarkable that five justices in this case examine the racist history underlying Louisiana’s nonunanimous jury provision. In reviewing the constitutionality of a provision arising out of a white supremacist state constitutional convention, wouldn’t the Court have to reckon with that history? Certainly, if Mr. Ramos had raised an equal protection challenge to his nonunanimous jury verdict, the Court would have been squarely presented with the legal question of whether the nonunanimous jury provision was unlawful because it was motivated by a discriminatory purpose and had a discriminatory effect. But outside the equal protection context, the U.S. Supreme Court has marginalized the relevance of racist intent when such a consideration is not an essential element of a defendant’s legal claim, for example, when a traffic stop is challenged as racially motivated in violation of the Fourth Amendment. See, e.g., Whren v. United States, 517 U.S. 806, 813 (1996) (“[T]he Constitution prohibits selective enforcement of the law based on considerations such as race. But the constitutional basis for objecting to intentionally discriminatory application of laws is the Equal Protection Clause, not the Fourth Amendment. Subjective intentions play no role in ordinary, probable-cause Fourth Amendment analysis.”).
Why did a majority of the Court look so closely at this history in Ramos, and what exactly did they do with it? It is easy enough to note that five justices think that the racist origins of the law matter here and four justices apparently think they don’t. The more difficult question is how and why that history matters. How, if at all, does Jim Crow history influence the justices’ resolution of the legal questions before them in Ramos?
The answer is elusive. Justice Gorsuch highlights the racist origins of the law and criticizes the Apodaca plurality for ignoring that history, but in a footnote concedes that his discussion of Louisiana’s white supremacist constitutional convention is dicta, as nonunanimous juries would violate the Sixth Amendment impartial jury guarantee whether or not they were designed to diminish the influence of black jurors. Justice Sotomayor emphasizes that “the racially biased origins of the Louisiana and Oregon laws uniquely matter here,” but what does it mean legally to “matter”? Does the history matter because it serves as important context; because the Court has an ethical obligation to acknowledge painful aspects of our history (a “never again” perspective); or does it somehow factor into the resolution of the questions before the Court? She does not detail how the Jim Crow origins of Louisiana’s nonunanimous juries affect the Court’s analysis of the legal issues. She implies that an equal protection claim may have succeeded here, referencing the analogous case of United States v. Fordice, 505 U. S. 717, 729 (1992), which held that policies “‘traceable’ to a State’s de jure racial segregation and that still ‘have discriminatory effects’ offend the Equal Protection Clause.”
Justice Kavanaugh alone specifies how the origins of Louisiana’s nonunanimous juries influence the resolution of this case. He concludes that, once the court has determined that the correct resolution of the issues conflicts with a prior court holding (here, the Apodaca ruling), the court is more justified in departing from precedent when it has caused “significant negative jurisprudential or real-world consequences.” Slip Op. at 42 (Kavanaugh, J., concurring in part). The nonunanimous jury provision “tolerates and reinforces a practice that is thoroughly racist in its origins and has continuing racially discriminatory effects,” a significant negative consequence. This framework brings the Jim Crow history into the stare decisis analysis, not the determination of the scope of the Sixth Amendment right to a unanimous jury, or whether, under the Fourteenth Amendment, this right binds the states.
Why does the Jim Crow discussion feature so prominently? Is it easier for justices to confront vestiges of racism (a la Ramos) than to confront contemporary allegations of more widespread racial bias (a la Whren)? Or perhaps the justices are more likely to consider racism as relevant when ruling on Sixth Amendment challenges involving the right to a jury trial? Recently, in Pena-Rodriguez v. Colorado, 137 S. Ct. 855, 867 (2017), the U.S. Supreme Court held that in cases involving evidence of racial bias in juror deliberations, the rule preventing the court from hearing juror testimony about statements made during deliberations must yield so that the court may consider whether the alleged racial bias violated the defendant’s Sixth Amendment right to a fair trial. That was not an equal protection case, but a case concerning the right to a fair and impartial jury, and the Court’s decision rested (as Justice Kavanaugh explains in Ramos) on a recognition of “the imperative to purge racial prejudice from the administration of justice generally and from the jury system in particular.” Id. at 13–14 (quoting Pena-Rodriguez and collecting cases). So, a working theory: when a defendant asserts a Fourth Amendment right, racial bias generally doesn’t matter, but when asserting a Sixth Amendment right, it might? Or maybe, as my colleague Shea Denning has considered and Justice Ginsburg has suggested, Whren was wrongly decided?
The bottom line here is that a majority of the court concluded that it is important to consider Jim Crow history when ruling on whether the unanimous verdict aspect of the Sixth Amendment right to a jury trial applies to the states. Although the justices in the majority do not agree on how this history factors into the analysis, the decision suggests that Jim Crow origins may support the invalidation of laws even outside of equal protection challenges.
What does this mean in states like North Carolina where jury unanimity was already guaranteed?
The holding in Ramos does not have immediate implications for North Carolina, where people accused of crimes already had a right to a unanimous jury. However, it raises interesting questions about the possibility that Jim Crow laws may have evolved into current law without careful examination or reconsideration. Kavanaugh asserts that the “nonunanimous jury is today the last of Louisiana’s Jim Crow laws.” (Slip. Op. Kavanaugh, J., concurring, at 48.) Assuming that this is true, what about in other states? What about here?
In 1898, the year of Louisiana’s constitutional convention, North Carolina saw similar white supremacist political activity, propaganda, and related violence, including the only successful political coup in United States history, in which white supremacists overthrew the city government of Wilmington, killing numerous black residents, forcing the resignation of the mayor, police chief, and aldermen, and burning down the headquarters of a black newspaper. Caleb Crain, City Limits: What a white-supremacist coup looks like, The New Yorker, April 27, 2020. As in Louisiana, “white supremacists went on to alter state law so as to disenfranchise black people[;]” while there were “more than a hundred and twenty-five thousand registered black voters in North Carolina in 1896 . . . only six thousand or so were still on the books by 1902.” Id. at 67. See also Thomas W. Frampton, The Jim Crow Jury, 71 Vanderbilt Law Review 1593, 1613-14 fns 118, 123, 124 (2019) (quoting articles published in 1898 and 1899 in the Semi-Weekly Messenger, a Wilmington newspaper, making white supremacist appeals for nonunanimous juries, one of which suggests that nonunanimous jury verdicts will reduce the need for lynchings). Are any of the laws passed in this era and motivated by this campaign of white supremacy still on the books?
The answer, almost certainly, is yes. Consider the North Carolina law making it a felony to vote when ineligible, even if the voter is unaware that he or she is ineligible to vote. This law dates back nearly unaltered to this same political effort to disenfranchise black voters around the turn of the twentieth century. Are there others? Some aspects of jury selection, including the use of peremptory strikes, have been historically entangled with discrimination. See April Anderson, Peremptory Challenges at the Turn of the Nineteenth Century: Development of Modern Jury Selection Strategies as Seen in Practitioners’ Trial Manuals 16 Stan. J. C.R. & C.L. 1 (2020). Historians at UNC are working on documenting North Carolina’s Jim Crow Laws, which may help identify others still in operation.
Justice Sotomayor’s concurrence in Ramos cautions that we may be governed by dated laws, in North Carolina and elsewhere, that have been reenacted or maintained without meaningful consideration of their Jim Crow origins and purpose. At least some of our legal architecture is built on the same troubling historical foundations described in Ramos. The splintered Ramos opinion does not provide a roadmap for resolving legal challenges related to Jim Crow laws—outside the usual equal protection approach—but a majority of the justices insist that this history cannot be ignored.

Voting on Your Phone: New Elections App Ignites Security Debate
For more than a decade, it has been an elusive dream for election officials: a smartphone app that would let swaths of voters cast their ballots from their living rooms. It has also been a nightmare for cyberexperts, who argue that no technology is secure enough to trust with the very basis of American democracy.
The debate, long a sideshow at academic conferences and state election offices, is now taking on new urgency. A start-up called Voatz says it has developed an app that would allow users to vote securely from anywhere in the world — the electoral version of a moonshot. Thousands are set to use the app in this year’s elections, a small but growing experiment that could pave the way for a wider acceptance of mobile voting.
But where optimists see a more engaged electorate, critics are warning that the move is dangerously irresponsible. In a new report shared with The New York Times ahead of its publication on Thursday, researchers at the Massachusetts Institute of Technology say the app is so riddled with security issues that no one should be using it.
In response to the report, the Department of Homeland Security organized a series of briefings in recent weeks for state and local officials who are planning to use Voatz’s technology.
“The choice here is not about turnout,” the report says, “but about an adversary controlling the election result and a loss of voter privacy.”
With security already a dominant theme of the 2020 elections, last week’s debacle at the Democratic caucuses in Iowa — an app used to report results failed to, well, report results — has raised new questions about the role technology should play in American elections and prompted calls for it to be scaled back.
While a return to the analog days of punch cards and hanging chads is unlikely, there is growing unease about how far state and local governments should go in modernizing election infrastructure — from registration databases and electronic poll books to the voting machines themselves.
At the far edge of that debate are systems that let users cast their ballots over the internet, including the platform built by Voatz, the only voting app on the market.
An initial experiment with wide-scale online voting took place in Washington a decade ago. It was called off after researchers hacked into the system, electing HAL 9000 — the computer from “2001: A Space Odyssey” — as mayor and making the University of Michigan fight song play every time a ballot was cast.
Since then, some states have allowed online voting through web portals, emails or digital faxes, despite the security risks. But they have restricted it to groups of people who cannot make it to the polls, mostly overseas military personnel.
Voatz says its technology has overcome the security problems through biometrics and other measures built into newer smartphones, as well as a back-end system that records and stores votes on a blockchain, the technology underpinning Bitcoin. It also says its platform creates a paper trail for election officials and the voters using the app.
Since its debut in 2018, Voatz has run several pilot projects aimed largely at deployed service members, tallying about 600 votes across federal elections in Denver, West Virginia and five counties in Oregon, Utah and Washington State. Now, it is poised to expand its reach in the presidential election as a number of additional states consider whether to use it for some categories of absentee voters.
West Virginia, for instance, is planning to use the app to meet new requirements that it find a way to make sure the disabled and infirm can participate, a move that is likely to add thousands of voters this year.
Until now, security experts have focused criticism on what they described as Voatz’s opaque systems, which make it impossible to verify its security claims.
Beneath that criticism, there is also some very real animus — many in the tightly knit cybersecurity community blame Voatz for helping spur an F.B.I. investigation of a University of Michigan graduate student who tried to breach the company’s systems in 2018. The student says he was conducting research.
In the new paper, the M.I.T. researchers, Michael A. Specter, James Koppel and Daniel J. Weitzner, go beyond speculation and detail how they found serious security issues by reverse-engineering Voatz’s app and recreating what they could of the company’s server from publicly available information.
Flaws in the app, the report says, would let attackers monitor votes being cast — and might even allow them to change ballots or block them without users’ knowledge.
Perhaps the biggest risk, according to the researchers, is that the attacks could create a tainted paper trail, making a reliable audit impossible.
They pointed to the problems in Iowa caucuses as an instructive example. Though those problems were caused by technical faults, not a security breach, officials in Iowa have had to tally votes through paper backups, some of which are not complete. More than a week later, a definitive result has yet to emerge.
“Imagine that on a national scale,” Mr. Specter said in an interview.
The researchers took their findings to the Department of Homeland Security in January, setting off a process through which Voatz was made aware of the research and election officials who use the platform were briefed.
In a statement, Homeland Security said that while no one was known to have exploited the flaws found by the researchers, “we will continue to work with our partners to deepen understanding of the risk.”
Voatz, which has reviewed the report, strenuously objected to the researchers’ claims, saying in a statement that the researchers acted in bad faith, used an outdated version of the app and “fabricated an imagined version” of the servers.
The company said that its nine previous elections had gone off without incident, and argued that its pilot projects had pushed “innovation forward in a responsible, transparent way.”
The company’s work is backed by Bradley Tusk, a venture capitalist whose philanthropy has provided financial support to help governments use Voatz. In an interview last year with Harvard Business Review, he also brushed aside security concerns. “It’s not that cybersecurity people are bad people per se,” he said. “It’s that they are solving for one situation, and I am solving for another.”
Caught in the back-and-forth between Voatz and the researchers are election officials who must soon make a decision on whether to use the app this year. At least one Voatz client, Mason County, Wash., has already pulled out, citing fear of media blowback.
Others say they are pressing ahead with plans to use Voatz.
The app “is not perfect — nothing is — and security is always a concern for us,” said Donald Kersey, a senior election official in West Virginia. “But this is about using new technologies that give us a way to make sure people who maybe can’t always vote have that opportunity.”
