I’m Kelsey Gibson and I’m a partner in the real estate team of MacRoberts solicitors in Glasgow. Where is the office located and why did they pick this location?
The office I work from is located in the financial district of Glasgow city center close to the river and we moved here around 10 years ago. We choose this location because it is handy for clients and staff and comprises modern, open-plan office space with fantastic views over the River Clyde. We must have one of the best views of Glasgow and the Clyde in Glasgow. We also have offices in Edinburgh and Dundee.

We have been particularly well known as specialising in construction in Scotland and are one of the top firms in Scotland providing advice in contentious and non –contentious construction law. As a result of that we have many clients in the construction industry and our other teams including real estate (or property law) have expanded from that. If you take my example, I act for property developers who develop land for both commercial and residential developments and the fact that we have such expertise in construction law is a great advantage.

Do you find any advantages to being in Glasgow?
Yes as I live within commuting distance but also I have always loved working in Glasgow as it is a vibrant, friendly city with lots of energy and I studied at Glasgow University and have loved the city since then. Many of our clients’ offices are close by as are other firms of solicitors so meetings can easily be arranged.
What made you decide to become a lawyer?
I couldn’t think what else to do and I didn’t want to be a teacher (no patience) or any job with blood, guts or smells so I drifted into law. I think I saw myself as someone who would help the underdog but when I started training (due to a period of recession in 1984) I ended up specialising in property law and after I qualified I started to enjoy dealing with commercial property and enjoyed being involved in deal negotiation and the cut and thrust of that. I believe that when you leave school most people don’t know what they want to do and I surprised myself by enjoying the area of work I specialise in now. It also helps that you do a lot of work on a repeat basis with the same clients and their professional team so you have a working relationship with your clients and their team over a number of years.  Having such personal relationships is very rewarding.
How did you become a lawyer? (Where did you study, first job, etc.)
I studied law at Glasgow University and then did my training in a large Ayrshire firm in Ayr. My training was primarily in property law. I then went to work in Glasgow at a small firm and I was the only property lawyer. Sometimes I was sent down to the court and that was tricky as I didn’t do much court work but I found that there was a lot of hanging about and it was fairly tedious. Also, the district court was awful –even the lawyers’ room stunk of smoke and was very sexist. I quickly realised that I wanted to pursue a career in property law  and in particular commercial real estate but I decided I needed to work in a larger firm where I could learn more about that area of law and gain good experience. My boss then was quite assertive so I learned very quickly! I worked there for about 19 years and then moved to my current firm MacRoberts
When did you start to work here? 
January 2008. I was approached by MacRoberts to join them then and I was drawn to working in MacRoberts because they had experts in every field and that was a real learning curve for me and I learned a lot from specialists such as in tax law, construction etc. I’d like to think they learned a lot from me in Real Estate law!
What aspects of law do you specialise in here? (explain a bit about your job)
Commercial real estate which involved dealing with the property aspects of developments, acting for property investors who lease property for rent and we negotiate leases and agreements for lease and acting for occupiers acquiring property for their business.
What are your favorite and least favorite parts about your job?
My favorite parts are working with clients and their professional teams and negotiating the contracts for them with the lawyers on the other side. It is a great feeling when the transaction completes and everyone is happy with the outcome. We often have to work to very tight timetables and often the other side wants a different outcome from your clients so when we complete it is a fantastic feeling.  The stress levels are often quite high…
I don’t like dealing with the regulatory matters that our profession (like other professions)  now face such as dealing with compliance with anti-money laundering regulations and similar regulations. Some lawyers spend more time filling in forms and ticking boxes than carrying out fee earning work but unfortunately, we must comply with government requirements and policing.
On the other hand it is much easier to do research and check documents due to the advances in computer technology. There was no internet when I started and very few computers. The internet has made it far easier for us to research the law and to negotiate contracts with lawyers who are hundreds of miles away. When I started we dusted down old books in the library which could have been out of date and we had to handwrite amendments to contracts and fax them to the other side… I would not want to return to those days but we need to reduce form filling.
What are you favorite parts about working for this company?
I like the camaraderie of  working in an open-plan office and I enjoy the challenging but rewarding work knowing that we have specialists in all relevant areas which can give me support where required. We won Uk Real Estate team of the year in 2018 and we were up against the largest firms in the Uk. The project we used as an example was a large regeneration project in Clydebank and we were able to show that we pulled in many specialists areas in the firm such as real estate, construction, procurement and projects, planning, banking, tax, corporate, environmental law, property litigation, etc. Having that sort of support is really reassuring and rewarding.
What advice would you give someone who wants to become a lawyer?
Think hard about why you want to do that. It is important that you are a people person and that you are willing to work hard at a computer for long hours. It is rewarding but you need to be really focused.
Why do you think law has a higher percentage of women in comparison with other professions?
We are brainier! Although that was a joke it is no secret that the academic requirements for studying a degree in law are very high and at the school leaving age there is a higher percentage of females with good grades. Also, the job requires a lot of focus on detail and that tends to suit females. That said there are so many varieties of jobs in the legal profession that there are opportunities for everyone and you can find what area best suits your qualities.
Is there anything you find challenging about the job?
Dealing with admin as mentioned above and also being able to manage a team of people in a sensitive and diplomatic manner.

South Lanarkshire Sees Average Property Prices Rise
There were 674 residential property sales in South Lanarkshire during June 2017, placing the local authority in the top five in Scotland in terms of sales volumes. The other top five places were taken by Glasgow City (1,224 sales), the City of Edinburgh (1,216 sales), Fife (704 sales) and North Lanarkshire (561 sales).
These figures were revealed in the latest monthly UK House Price Index (UK HPI), which also found that the average price of a property in Scotland in August 2017 was £146,354. This is an increase of 3.9% on August in the previous year and a decrease of 0.7% when compared to the previous month.
  House prices in South Lanarkshire have risen by an average of 7.9% over the year, from £115,626 in August 2016 to £124,757 in August this year.
  The City of Glasgow experienced a slightly smaller rise, with house prices rising by an average of 5.7%, from £118,911 in August last year, to an average of £125,634 this year.
  The biggest price increase was seen in the City of Edinburgh, where the average price increased by 10.4% to £246,611.
  Across Scotland, all property types, with the exception of detached properties, showed an increase in average price in August 2017 when compared with the same month in the previous year. Flatted properties showed the biggest increase, rising by 8.4% to £108,772. The average price of detached properties decreased by 1.9% to £240,241.
  “Average prices in Scotland also continued their upward trend in August with an increase of 3.9 per cent when compared to August 2016,” commented Registers of Scotland registration and transformation director Charles Keegan. “Average prices have been steadily increasing each month since March 2016, when compared with the same month of the previous year.”

An Accredited Paralegal Tale
Janet Rieu-Clarke, our in-house Accredited Paralegal, explains the path that led her to new role at the Society and the rationale behind the new accredited paralegal status.
On 6 August 2017 over 400 Law Society of Scotland Registered Paralegals, myself included, logged off our computers and made our ways home; only to return to work on Monday 7th August 2017 and, as if by magic, we were now all Law Society of Scotland Accredited Paralegals.
The reason for this amazing transformation was that both paralegals and the Law Society felt that the term Registered Paralegal no longer adequately reflected the paralegals’ position in the legal industry. So after much consideration, a decision was made to change the name to something which would reflect the quality and professionalism of the person using it, and also act as a gold standard for non-solicitor services – and here the marque of the Accredited Paralegal was introduced.
So who am I and what is my role in all of this? Well, 15 years ago, fresh from university and clutching my law degree, I returned to the Isle of Bute, where I grew up, to work out what I really wanted to do until I could legitimately retire or win the lottery! It was here that I started my career as a paralegal and was introduced to the wonderful world of conveyancing, and it wasn’t what it is now!
It was a time of cupboards full of musty, often smelly, handstitched and handwritten sasine titles which required a magnifying glass, a lot of patience and often a dark room to lie down in afterwards. Those of you who have dealt with this type of title will know that feeling of relief when you receive your first land certificate to examine.  
During my time in private practice, I worked as both a residential and commercial property paralegal in Scotland and for a short period, England.  Over the years my role as a paralegal has changed depending on the type of firm I was working for. I have typed up dictation due to staff shortages, covered reception duties and attended the opening of the salmon fishing season on the River Tay and all of this while maintaining my own caseload.
These things have helped shape the paralegal I have become.  I have worked for large organisations with offices all over the UK and most recently for a smaller firm based in Edinburgh with less than 30 members of staff, (and plenty of others sizes and shapes of firms in-between).
For me the secret to a good workplace is the people you work with, and I have been very lucky to work with a lot of good people over the years, many of whom I still meet up with for a chat and a large glass of sauvignon blanc.
In my 15 years in private practice, I have seen the role of the paralegal evolve from being a somewhat rare and unusual position held by a few people, to now being a role which is seen as being an integral part of the Scottish legal system. The introduction of a quality standard through accreditation - which is regulated by the Law Society of Scotland can only be good for paralegals and the legal sector as a whole.
In May I was successful in applying for a position with the Law Society‘s Professional Practice team in a completely new role as an Accredited Paralegal. Part of the attraction of the role was the opportunity to help shape the future of the paralegal status and to be part of the Society for such an important milestone. To be able to promote something which I am proud to be a part of and which I want others to be proud of was also an important factor.     
In the Professional Practice team we provide guidance to members on both ethical issues and matters of practice. Beyond that I will be engaging with paralegals, both accredited and non-accredited, and the firms they work for to promote the new Accredited Paralegal status and the benefits of joining.  I will be attending events to promote the new status and hosting some networking events to get to know you all and find out what we can do to help you in the future. 
So while the days of musty titles may be long gone,  I have to admit that I miss the client facing side of private practice (I even miss some of my more demanding clients).  But I am thoroughly enjoying this new challenge and relishing the opportunity to view the legal profession from a different perspective.  And now my fellow paralegals are my customers and it’s great to be able to offer you some guidance and advice when required, as well helping to promote and build the Accredited Paralegal Status to reflect your true expertise.
