HYDERABAD: Three persons including a couple and their daughter died in a car crashed into a water body in India’s Karimnagar district which was the third accident reported within a week.
The incident took place in Sarnenigudem village in Yadadri Bhongir district was followed by the death of a man while his wife surviving in the accident which occurred at Mid Minair in Karimnagar on February 16.
According to reports, Sarnenigudem village sarpanch Rani’s husband Madhu, son Matsyagiri and their car driver Sridhar Reddy were the deceased ones in the latest accident in Sarnenigudem village in Yadadri Bhongir district on Friday night.
Reports said that the father and son went to a nearby village on Friday evening and did not return till late in the night. The family has also lodged a complaint regarding the incident with police late in the night.
The CCTV footage showed the car getting on the Ellanki lake bund but not crossing. Later, the vehicle was retrieved from the water body on Saturday morning.
It may be mentioned that ruling Telangana Rashtra Samithi (TRS) Party legislator D Manohar’s sister Radha, her husband Satyanarayana Reddy and their daughter Vinaya Sri were found in a decomposed state in their car in Kakatiya canal on February 17 which went missing on January 27.
On February 16, a car in which a couple was moving towards a temple fell in Mid Manair without a railing. The husband died and the woman survived with injuries. A constable, who was watching the accident from the bridge, fell off to death.

via Today Bharat The police have file the case on six members including YSRCP MLA Daadishetti Raja alleging in them to be the accused in the Andhra Jyothi Journalist Satyanarayana's murder. The scribe was stabbed to death on the Tuesday evening while he was coming from Venkatapuram to Annavaram in Kakinada after completion of his duties. The police have launched the prove and the suspects are taken into custody. With this all the opposition parties are taking a dig at the government for the political vendetta behind the murder. However, chief minister Jagan Mohan Reddy ruled all the allegations and asked the police officials to find the culprit.

Is it permissible to draw inference of guilt of illegal gratification in case of death of complainant? Larger bench to decide
Supreme Court: Stating that it has some reservation in respect of the observation and findings recorded by the 3-judge bench of former CJ HL Dattu, V Gopala Gowda and Amitava Roy, JJ in P. Satyanarayana Murthy v. District Inspector of Police, State of Andhra Pradesh (2015) 10 SCC 152, the bench of R. Banumathi and R. Subhash Reddy, JJ has referred the following to a larger bench:
“The question whether in the absence of evidence of complainant/direct or primary evidence of demand of illegal gratification, is it not permissible to draw inferential deduction of culpability/guilt of a public servant under Section 7 and Section 13(1)(d) read with Section 13(2) of Prevention of Corruption Act, 1988 based on other evidence adduced by the prosecution.”
Satyanarayana Ruling:
In the said judgment, the court proceeded under the footing that failure of the prosecution to prove the demand for illegal gratification due to the death of complainant would be fatal to the prosecution case and recovery of the amount from the accused would not entail his conviction. The Court, in the said case, held:
“to hold on the basis of the evidence on record that the culpability of the appellant under Sections 7 and 13(1)( d )(i ) and ( ii) has been proved, would be an inferential deduction which is impermissible in law.”
Appellant’s contention based on the Satyanarayana ruling:
Mere proof of receipt of money by the accused in the absence of proof of demand of illegal gratification is not sufficient to prove the guilt of the accused.
“when the complainant passed away, primary evidence of demand is not forthcoming and when the prosecution could not establish the demand by such primary evidence, the conviction of the appellant cannot be sustained.”
State’s contention against the Satyanarayana Ruling:
In Satyanarayana, the court did not notice the line of judgments and the consistent view taken by this Court in various decisions that demand can be proved either by direct evidence or by drawing inference from other evidence like evidence of panch witness and the circumstances.
Court’s observation:
After referring to a number of judgments where accused was convicted even when the evidence of complainant was not available either due to death of complainant or where the complainant had turned hostile, the Court showed reservations on the judgment. It said:
“The direct or primary evidence of demand may not be available at least in three instances:- (i) where the complainant is dead and could not be examined; (ii) complainant turned hostile; and (iii) complainant could not be examined either due to non-availability or other reasons. Direct proof of demand may not be available in all the above instances but from the evidence of panch witness, acceptance of money was proved by Phenolphthalein Test and by raising presumption under Section 20 of the Act, it is permissible to draw inference to prove the demand.”
The matter was, hence, referred to a larger bench.

Man asks parents to get married his wife to her lover, hangs self

A 24-year-old man killed himself in Hyderabad Wednesday as he was allegedly depressed over his wife's extramarital affair. Nonetheless, before making the extraordinary step, K Acharya asked for his parents to get his wife wedded to her lover. Acharya was a resident of Shameerpet. His wife was having affair with their neighbour Chinnam Srikanth. Srikanth's last wish was to see his wife wedded to her lover. Achary had sent a message on his dad K Satyanarayana Wednesday morning saying that he was taking his own life. He additionally told his dad that Srikanth was the reason behind it. Satyanarayana rushed to Achary's home yet found him hanging from a roof fan in his residence. He promptly informed the police following which a group of cops went to research the death. Shameerpet inspector D Bhaskar Reddy said that his group has found a suicide note."I am sorry mom and dad. I failed to be a good son and no parents should have a son like me. Do not scold Usha (wife) and get her married to Srikanth. Consider it as my last wish and my in-laws do not have anything do with this," the suicide note read. Reddy said that it is obvious that Achary was depressed about his wife's extramarital affair. The cops are as of now investigating the incident. Achary, a native of Alair Mandal in Yadadri-Bhuvanagiri region in the Indian territory of Telangana, had married Usha Rani two years back.
