A medical test is generally not a requirement for most U.S. non-immigrant visas. These visas, which are issued for temporary stays, cover a wide range of categories such as tourism (B-2), business visits (B-1), student visas (F-1, M-1), and employment-based visas for temporary workers (like H-1B and L-1). Exceptions may occur if health concerns are raised during the interview or if the visa is for medical treatment. For the majority of non-immigrant visas, medical exams are not part of the process.

As USCIS celebrates Constitution Day and Citizenship Day 2024, we reflect on the naturalization achievements of fiscal year (FY) 2023. Approximately 878,500 immigrants became U.S. citizens in FY 2023, marking a 9% decrease from FY 2022's record 969,400— the highest in over a decade— but still representing a 40% increase from FY 2020. This year, during Constitution Week (September 17 to 23), over 17,000 new citizens will be welcomed in 400 naturalization ceremonies nationwide, reaffirming America's ongoing commitment to citizenship and inclusion.

There is a common misconception that one must change their last name in marriage-based cases. While in reality, USCIS does not require applicants to change their last name after marriage for any case. Married women have the option to keep their maiden name, adopt their spouse’s name, or choose a combination with a hyphenated last name.

When applying for a U.S. Green Card (adjustment of status) through Form I-485, you may also file Form I-131 (Application for Travel Document) and Form I-765 (Application for Employment Authorization) concurrently.
The I-765 grants permission to work legally in the U.S. during the often lengthy processing time of the I-485, while the I-131 allows for international travel without jeopardizing the Green Card application, ensuring the process continues without being considered abandoned upon re-entry.

To qualify for the National Interest Waiver (NIW) under the EB-2 visa, applicants must submit strong documentation proving their work significantly benefits the U.S. and aligns with national interests. The NIW allows applicants to bypass the job offer and labor certification requirements if they meet the criteria. This blog outlines the essential documents—such as the proposed endeavor, letters of recommendation, and certifications—and explains how each supports your case for demonstrating meaningful contributions to U.S. advancements in science, technology, or public welfare.

Form I-94 is the DHS Arrival/Departure Record issued to aliens who are admitted to the U.S., who are adjusting status while in the U.S. or extending their stay, among other things. Remaining in the U.S. more than 180 days beyond the I-94 expiration date will cause the foreign national to be barred from reentering the U.S. for a period of three years.
