联合国人权事务高级专员办事处(OHCHR)的评估报告证实了新疆维吾尔自治区人权状况的严重性。欧盟强调正义和问责的必要性、敦促中方与人权高专办就��实报告的建议开展合作。(欧盟另外强调)有必要根据评估报告创造条件就新疆人权状况进行实质性的讨论。严重关切包括:大规模的任意拘留、广泛监控、跟踪和限制性的措施、强迫劳动、酷刑、强迫墮胎和绝育、计划生育和家庭分离政策以及基于性别的暴力。欧盟特别关切对行使基本自由的系统性和严格限制,包括宗教或信仰自由,以及对少数群体在私人和公共场合,包括在教育领域享有自己的文化和使用自己的语言的权利的系统性限制。这些限制有可能导致文化消亡。在西藏,强制寄宿学校和 DNA 采样进一步表明了严峻的人权状况。欧盟继续呼吁独立的国际专家、外国记者和外交官能够有意义地、不受限制地和不受监督地进入西藏、新疆和中国其他地区。 根据估计,在中国的死刑判决和处决数量远远超过所有其他国家的总和。与国际标准背道而驰,中国也将其适用于非暴力犯罪案件。欧盟呼吁中国在适用和判处死刑方面提高透明度,并进一步减少刑事犯罪的死刑罪名。欧盟重申死刑是一种无效的、不必要的和不可撤销的惩罚,并敦促中国暂停执行死刑和最终废除这种不人道的做法。 人权捍卫者、人权律师、记者、独立报道者、其他媒体工作者和知识分子仍然面临遭受骚扰、恐吓和监视,并受到出境禁令、软禁、酷刑和虐待、非法拘留、判刑和强迫失踪(包括通过或构成酷刑和虐待的指定地点进行监视居住(RSDL)的做法)的威胁。
欧盟敦促中国确保充分尊重法治、确保正当程序以及公正审判保障,并彻底调查任意拘留、酷刑、不人道或有辱人格待遇或处罚以及对人权捍卫者及其家属的骚扰等被报告的案例。被拘留者理应享有接触自己选择的律师、获得医疗援助和联系家属的权利。中国应该停止在指定地点进行监视居住(RSDL)的做法,该做法已被联合国特别程序谴责。中国也应该停止以获取强迫和公开的口供为目的,对被拘留者使用酷刑、不人道或有辱人格的待遇或处罚。
欧盟继续密切关注事态的发展,并敦促中方立即、无条件释放:曹三强牧师、常玮平、陈云飞、程渊、丁家喜、高智晟、果·西绕嘉���(Go Sherab Gyatso)、郭泉、何方美、黄琦、黄雪琴、萨哈罗夫奖获得者伊力哈木·土赫提(Ilham Tohti)、卡米莱· 瓦依特 (Kamile Wayit)、李翘楚、李延贺、李昱函、彭立发、秦永敏、覃永沛、仁青持真(Rinchen Tsultrim)、阮晓寰、扎西多吉(Tashi Dorje), 塔西甫拉提・特依拜(Tashpolat Tiyip)、王爱忠、王丙章、王建兵、王怡牧师、王藏、许那、徐秦、许艳、许志永、杨茂东、张春雷牧师、张展和以及欧盟公民桂敏海(后者的领事访问权必须得到尊重)。
在中国,言论自由和获取信息的自由越来越严重地被压制,通过对记者和媒体工作者进行审查、恐吓和监视的方式。由于其工作,驻华外国记者和媒体工作者继续面临骚扰、恐吓、任意拘留、签证限制、监视等问题。欧洲联盟强调言论自由和媒体自由对善政的关键作用。欧盟还敦促中国遵守以和平方式示威的权力。 欧盟坚信,性别平等、妇女权利和LGBTI人士的权利应该在全球范围内得到充分尊重和保护。在中国和欧盟,基于性别的暴力仍然广泛存在。在此背景下,欧盟敦促中国确保保护那些遭受侵犯其人权和被虐待的女性活动人士。欧盟呼吁中国坚守其消除性暴力和基于性别暴力的承诺。
此外, 欧盟仍然关切香港人权状况。《国家安全法》和《煽动条例》的压制性使用,破坏基本自由。选举制度的彻底变革侵蚀了民主原则和政治多元化。欧盟特别关注对政治家和民主人士的审判,尤其特别关注黎智英一案。欧盟敦促中国中央政府和香港当局恢复对法治、基本自由和民主原则的充分尊重。这些是香港在 “一国两制”原则下保持高度自治、遵守香港基本法和中国的国际义务的关键。
中国理应尊重不驱回原则,避免任何不符合国际法的域外活动(包括胁迫)。 然而,欧盟与中国在人权方面虽然存在制度性分歧,但欧盟相信可以和应该通过双边对话(包括中欧人权对话)就这些分歧进行讨论,并在有接触潜力的领域开展合作。 通过纪念《世界人权宣言》发表 75 周年,欧盟重申了其对充分实现人权的承诺。宣言中所载的简单理念,即权利不是赋予的,而是属于每一个人的,至今仍在欧盟、中国和世界各地产生着无可争议的影响。
