Understanding Personal Injury Claims: A Comprehensive Guide | RG Injury Law
Personal injury claims are a legal process by which an individual seeks compensation for damages sustained due to someone else’s negligence. Personal injuries can occur in various situations, including car accidents, slips, falls, dog bites, medical malpractice, etc. If you have been injured in an accident, it is essential to understand the personal injury claims process and your legal rights. This guide will explain the personal injury claims process in detail.
Step 1: Seek Medical Attention
The first and most important step after an accident is to seek medical attention. Even if you feel fine, it is crucial to have a medical professional evaluate you for any hidden injuries or underlying conditions that may not be visible to the naked eye. This medical report will also be essential evidence for your personal injury claim.
Step 2: Gather Evidence
The next step is to gather evidence. That includes taking photos of the accident scene, including any damage to vehicles or property, and collecting contact information for any witnesses. Keep track of any medical bills, lost wages, and other expenses related to your injury.
Step 3: Contact an Attorney
It is always best to consult with an experienced personal injury attorney to determine if you have a viable claim. A personal injury attorney can provide guidance on the legal process, negotiate with insurance companies, and represent you in court if necessary.
Step 4: File a Claim
Once you have decided to pursue a personal injury claim, your attorney will file a claim with the insurance company of the at-fault party. The insurance company will investigate the claim and determine whether to accept or deny liability.
Step 5: Negotiate a Settlement
If the insurance company accepts liability, your attorney will negotiate a settlement. This settlement should cover all your medical expenses, lost wages, and other damages related to your injury. Your attorney may recommend taking the case to court if a settlement cannot be reached.
Step 6: Litigation
If your case goes to court, your attorney will represent you and present evidence to support your claim. The court will then decide whether to award you damages and the award amount.
Types of Damages
There are two types of damages that may be awarded in a personal injury claim: economic and non-economic.
Economic damages such as medical bills, lost wages, and property damage are easily quantifiable. These damages can be proven with invoices, receipts, and other documentation.
Non-economic damages are more subjective and include pain and suffering, emotional distress, and loss of enjoyment of life. These damages are more difficult to quantify but can still be awarded in a personal injury claim.
Statute of Limitations
It is important to note that there is a statute of limitations on personal injury claims. This means that there is a specific deadline by which you must file a claim. In most cases, the statute of limitations is two to three years from the date of the accident, but this can vary depending on the state and the type of claim.
Conclusion
Personal injury claims can be complex and require the expertise of an experienced attorney. If you have been injured in an accident, seeking medical attention, gathering evidence, and consulting with a personal injury lawyer as soon as possible is essential. An attorney can guide you through the legal process, negotiate with insurance companies, and represent you in court if necessary. Remember that there is a statute of limitations on personal injury claims, so acting quickly to protect your legal rights is essential.

Thousands of doctors across major cities in India, including the capital, New Delhi, on Tuesday, joined in on protests sparked by the alleged rape and murder of a trainee last week.
A 31-year-old female medical trainee was found dead at one of the largest government hospitals in the eastern city of Kolkata on Friday. Her body sustained multiple injuries and an autopsy report described evidence of sexual violence.
After the incident, doctors walked off their jobs at government hospitals, demanding better security and safety measures for health workers. The chief of the institution involved, RG Kar Medical College and Hospital, resigned on Monday.
Protests flare as doctors demand better safety
Protests picked up across government-run facilities in the eastern state of West Bengal, home to Kolkata, on Monday — with doctors saying they would suspend emergency services as well until at least Tuesday.
"As resident doctors, we are on the frontline and deal with lots of patients, which makes us quite vulnerable to these attacks," Doctor Rajat Sharma, vice president of India's Federation of Resident Doctors Association (FORDA), told DW.
"It's a scary situation which we see working on a daily basis. Doctors in West Bengal are protesting for their rights. We want to have better security for our resident doctors."
Around 75% of doctors in India have faced some form of violence, according to a survey by the Indian Medical Association.
Sharma's FORDA colleague Sarvesh Pandey told Indian media that doctors' demands included a specialized law protecting healthcare workers from violence on the job.
"There should be stringent security measures in hospitals and CCTV cameras should be installed," he said.
Students at universities in Kolkata also joined in on protests, demanding better safety measures for women in particular.
Sexual violence against women is a big problem in India.
The National Crimes Records Bureau reported that in 2021, an average of 86 rape cases were registered every day and 49 cases of crime against women lodged every single hour.
Protests spread to major cities, some services hampered
The incident has struck a nerve in the medical community who have repeatedly said they face threats from angry family members, especially in the case of bad news involving medical issues.
In the western Maharashtra state, home to financial capital Mumbai, around 8,000 doctors at government hospitals walked off their jobs on Tuesday.
In New Delhi, junior doctors wearing white coats held banners that read "Doctors are not punching bags" as they sat outside a big government hospital to demand an investigation into the incident.
Protests hampered medical services in the city of Lucknow in the most populous state of Uttar Pradesh, as well as in the popular tourist state of Goa.
How have Indian authorities responded?
The Calcutta High Court on Tuesday ordered the case to be transferred over to a federal agency, meaning that Kolkata police will have to submit all case documents to the agency.
Kolkata police initially set up a special investigative team and arrested a man in connection with the case.
City police chief Vineet Kumar Goyal told reporters a case had been registered against the suspect under provisions of the law relating to rape and murder.
The National Human Rights Commission on Tuesday sent notices to the director general of police and the chief secretary of West Bengal state, asking for a detailed report within two weeks.
West Bengal Chief Minister Mamata Banerjee met the family of the victim on Monday, telling reporters later that police were "giving utmost importance to the investigation."

Even moar Rat coon
This time I have less quotes and more just some misc info about the au.
~~~
Inko is alive in this AU, and he doesn’t stray far from cannon. In this au, Izuku’s parents are divorced and Hisashi pays for child support. Her boyfriend/husband(haven’t decided) are actually really good for each other, the only issue is that her partner convinced Izuku that Inko wanted him gone after a heated argument the two of them got in. Said argument was further fueled by Izuku challenging him to a fight, in which he lost because maybe an eight year old throwing hands with an adult with a quirk and several years of martial arts training isn’t the best idea. Inko had zero knowledge of this.(Yes, so m ay b e it’s toshinori, maybe not.)
Katsuki also had zero knowledge of this, but he knew that the quirkless hero loving kid with his extra fingers wouldn’t just disappear, right? He ends up spending a lot more time with “Auntie Inko” when his mother takes him with her on regular visits. Everyone honestly thinks that he just ran away or something happened, a missing persons case is posted but gets buried in police files and goes cold.
~~~
During the fight with Muscular, Izuku makes Kota run to get help saying that if he sticks around he’ll die just like his parents and never be able to make sure they didn’t die in vain. Because despite Kota’s best attempts to push everyone away, the quirkless boy who shares the same look and knows what it’s like to feel abandoned by his family, he becomes friends with the older snarky wild child that ended up shouting “BE YOUR OWN HERO” with him at the top of his lungs. So Kota runs like he never ran before.
The only reason Izuku doesn’t die during the battle is because Muscular severely underestimates this feral child who is faster and lighter than him powered up. And even with several broken bones, he manages to wear out the massive cyborg wanna be, and get away to where Aizawa finds him bloodied, limping, and looking like he’s having the time of his life.
Izuku sees the tired man he considers his parent, manages to somewhat run to Aizawa before collapsing.
~~~
Okay, time for some lighter stuff. After/during the sports festival it's revealed that Inko has been looking for her son for years at this point, so when she tries to get Izuku to come back home he goes fucking ape shit and is like "DON"T TELL ME YOU REGRET WANTING ME GONE, YOU WERE SO ATTACHED TO HIM THAT YOU BOTH PRACTICALLY SHARED A MIND!" and she's like "wait what-" and the two end up channeling the terrifying feral bakugou family energy as they get in an argument and have some mother-son bonding over the entire thing. After, they compromise and agree to an arrangement where they have dinner once or twice a week.
~~~
Often, Izuku is used in various villain simulations, and the class has actually lost to their local feral man more times than they’ve managed to capture/defeat him.
~~~
The only reason Aizawa ever captured Rat Coon and succeeded was because the dumbass ran face first into a wall and knocked himself out. Only the gods know how he didn't end up with a concussion.
He then proceeded to cause even more problems once in police custody, including but not limited to, flipping off any onlookers, being loud and obnoxious, somehow getting his legs onto the interrogation table, stealing his file, contemplating eating it or yeeting it(he did neither), and securing his fate as the responsibility of Aizawa. Nezu had part in the last bit.
Not to forget challenging Tsukauchi about the laws.
~~~
It took class 1-A two weeks to finally catch Midoriya during hero training time and home room. All Might and Aizawa decided to use it as a lesson plan and hopefully keep Izuku from going bonkers due to being stuck on UA grounds.
~~~
Izuku is used to having a large area to run around, and is used to having to scavenge to survive, so when he's first released to freely run around the school grounds, it's a massive world shift.
~~~
Sometimes Izuku thinks he's back on the streets, his first few years were really rough on him. !!!DO NOT SURROUND OR LEAVE HIM WITHOUT ANY SURE FIRE MEANS OF SELF DEFENSE!!!
Because of several broken bones that didn't heal correctly, even with the help of RG's quirk, he sometimes has a hard time with hand to hand combat. Because some of his bones are crooked and jagged from breakage and improper healing, it doesn't take much to put him out of commission if you know where to hit.
His best friends are weapons, knives, bats, anything blunt that can do massive damage quickly. He doesn't like to draw out fights, as the longer they go on, the greater risk of injury.

Jess, Relax and Rest
Concussions. Something that I know very much about. Throughout my collegiate basketball career, I had four confirmed concussions. At one time, I had more concussions than anyone on the football team at the time at UC. The more concussions you get, the easier it is to get another one. So unfortunately my number of concussions didn’t stop at four.
I got my 5th concussion February 2016, and was out of work for quite a while.
I got my 6th concussion March 19 during a missionaries vs. kids basketball game. I couldn’t see for about an hour. Everything was a big blur to me.
Concussions. What do you do when you get one? Darkness, rest, no stimulation (no movies, reading, no music, etc.) and repeat. Not a lot of visitors because a lot of stimulation will eventually make your head hurt worse. Sounds fun right? It can be very lonely, and honestly depressing.
How do you feel? Constant headache, nausea here and there, sensitivity to light, noise bothers you like no other, focusing on a conversation is tougher than you think, and remembering or concentrating on any sort of thing is a struggle. Even writing this, I am having to take many breaks because my head is starting to hurt from staring at the computer screen, and just thinking.
Concussions. The most annoying and frustrating injury I have ever come across. It affects more than just playing the game you love. It affects my thinking, and being able to understand simple things. It affects my memory, what I did the day before to what I did last week. It eventually comes, but takes a while, and everything pretty much seems like a blur. I’ve dealt with other injuries as far as knee surgery or ankle surgery after a lot of sprained ankles, and those are injuries that you can clearly see that there’s something wrong. It’s my mind that it affects. My brain so people can’t obviously see how much you’re hurting. During an ankle injury, you can maybe do somethings where you don’t use your ankle too much, but this--it affects your everyday life. Me being an active person, I try to hide a lot of my symptoms or try not to show that much of how I am truly feeling.
Concussions can lead to depression, and I know very much about that. It wasn’t until after my 5th concussion that I was taught about Post Concussion Syndrome, which deals with a lot of depression, memory, concentrating, etc., which helped explain to me about why I have been struggling with different things for the past couple years.
As my future brother-in-law says, “Put on your muddin boots because it’s about to get deep.” (Hayden aka cat woman) One of my biggest insecurities is that people who don’t really get where I have come from, or what I have been through, is that me forgetting something, or not understanding a simple joke or card game--reflects my intelligence. People may tell me something, and I have no recollection of them saying that to me. Now this doesn’t happen all the time, but it happens more and more every concussion. That is frustrating, and I am sure it is for the person telling me something for the millionth time. I am very insecure about that, because I do get confused easily about directions; I do repeat things often to people because I don’t remember them telling me that; It is hard for me to truly grasp a card game if it is new to me; it is hard for me to remember new words that I have learned, or even things that I have learned in college. Life is a blur throughout these concussions.
It is hard to explain the struggle honestly, and no one really gets it unless they have went through it, and that’s okay--I get that. Having said all this, I am not telling you all of this back story for everyone to feel sorry for me to have been down this path, and currently going down it again. I don’t want that at all, and I ask please don’t. The reason of me mentioning this is because this is my life. This is what is happening right now. Life is hard sometimes. Yes, I am in my favorite place in the whole world, but it isn’t always sunshine and rainbows. My life isn’t so picture perfect as everyone may think on Instagram or Facebook. No matter what filter I use, I have hard times here, and I don’t always post my struggle to the max, but here it is one that I am currently on. I can’t explain how frustrating or sad it is to be able to have a passion for something, and not even being able to fulfill it or participate in it. I can’t explain how annoying it is to not to be able to do something super fun that is on my Bucket List with my friends, because I have to think about my head and how easily it is for me to get another concussion. Sometimes I feel like I have to live in this bubble, and even people tell me that I need to do that. But that isn’t me. I love to live life; I love to go places; I love to feel that adrenaline going through my body when I am doing something I have never done before or always wanted to do; I love to go on crazy and wild adventures, and constantly--I have to think about if my head can handle it.
Being isolated from people I love, things I love to do, activities, learning new things, going on different adventures--those are some things that I am missing out on right now. I am temporarily out of teaching Bible Truths and P.E. I am temporarily out of coaching basketball training. I am temporarily out of going on adventures with my friends here to Gulu or Chobe. This is hard for me, because I love this place. I love what I do here, and seeing the kids everyday. I love what God has called me to do here.
And you wanna know my first thought or fear after I got this concussion? I just committed to staying for another two months. How am I going to get these funds? I am not exactly supposed to be on technology; honestly, I am not supposed to think. “Jess, just relax and rest.” I have heard this statement so much throughout dealing with this injury. I had fears creeping in that I wasn’t going to be able to raise the funds that is needed to live here, and at the time, I didn’t hear anything at all from any of the letters that I sent out or from the blog post that I shared. The more and more I thought about it, the more and more my headache worsened.
Jesus spoke, “Child, oh where is your faith?”
The very next morning, after I got my concussion, and all these doubts and fears were creeping in my head--I woke up to an e-mail from one of my 7th grade teachers. She informed me that she read my blog post, and shared it with people from the church. The church agreed to donate, and people from her family and church family, donated more to the fund.
The very next day, I got an e-mail from another teacher that I had in 6th grade, and he has been a family friend for years. He informed me that his wife was giving money to my Mom for towards my fund.
The very next day after that, I got another e-mail from someone from my home church in Stanford. She said that she was praying for me, and that people from their Sunday School class were talking about helping supporting the funds that I needed to stay.
---WOW---
Like I have tears in my eyes because of that. You know why? Because my God is greater. My God is greater than any fear that I have over fundraising, because guess what???? I am not getting this money, He is providing it for me. My God is greater than any insecurity that I have. My God is greater than any symptom that I have. My God is greater than concussions, sadness, or depression. My God is greater than playing the sport of basketball or football (soccer). My God is greater than going on random adventures. My God is greater than my bucket list.
My God is greater than my highs and lows, and because of that, I know that He is going to use something great out of this situation. I don’t know what it is, nor do I even come close to understanding what it may be, but it is greater than what I can even fathom.
So right now, I am relaxing and resting, and trusting in Him. I know that I will be okay, because My God is the Almighty Healer. I will be back in action soon as far as teaching goes, and probably sticking to just reffing the games. My God is greater, so in the mean time, I am just relaxing and resting in His arms.
PRAISES:
-The people that God used to bring in $700 in one week towards my extended stay. Praise God!
-My Uncle Wade & Aunt Jeanie arrived safely to RG, and it has already been a huge blessing to have them here. Along with my cousin, Dagan. He will be staying 3 months, and I am so excited to have him here. He is my big buddy!
-Communion that we have been having once a month in one of the pod homes. Will share more about that next blog. :)
-For the healing that the Lord has been doing on my recovery.
PRAYER NEEDS:
-Recovery for my brain.
-Mission teams coming in and out of RG.
-Funds to continue to come in towards extending my stay at RG.
-Other personal prayer requests

Application for Patent on an Improved Method of Lifting Vessels over Shoals [1]
March 10, 1849 To the Commissioner of Patents. [2]
The Petition of Abraham Lincoln, of Springfield in the county of Sangamon & State of Illinois
Respectfully represents.
That your petitioner has invented a new and improved manner of combining adjustable buoyant chambers with steam boats or other vessels which has not, as he verily believes been heretofore used or known, and that he is desirous that Letters Patent of the United States may be granted to him therefor, securing to him and to his legal representatives, the exclusive right of making and using, and of vending to others the privilege to make or use, the same, agreeably to the provisions of the Acts of Congress in that case made and provided, he having paid thirty dollars into the Treasury of the United States, and complied with other provisions of the said Acts.
And he hereby authorises and empowers his Agent and Attorney, Z. C. ROBBINS, to alter or modify the within specification and claim as he may deem expedient, and to receive his patent; and Page 33 also to receive back any moneys which he may be entitled to withdraw, and to receipt for the same. A. LINCOLN.
County of Washington District of Columbia SS.
On this 10th. day of March 1849 before the subscriber, a Jus Peace in and for the said county personally appeared the within named Abraham Lincoln and made solemn oath according to law, that he believes himself to be the original and first inventor of the within described improved manner of combining buoyant chambers with steam boats or other vessels and that he does not know or believe that the same has been before used or known; and that he is a citizen of the United States. I L. SMITH, JP
To all whom it may concern:
Be it known that I, Abraham Lincoln, of Springfield, in the county of Sangamon, in the state of Illinois, have invented a new and improved manner of combining adjustable buoyant air chambers with a steam boat or other vessel for the purpose of enabling their draught of water to be readily lessened to enable them to pass over bars, or through shallow water, without discharging their cargoes; and I do hereby declare the following to be a full, clear, and exact description thereof, reference being had to the accompanying drawings making a part of this specification. Similar letters indicate like parts in all the figures.
The buoyant chambers A. A. which I employ, are constructed in such a manner that they can be expanded so as to hold a large volume of air when required for use, and can be contracted, into a very small space and safely secured as soon as their services can be dispensed with.
Fig. 1. is a side elevation of a vessel with the buoyant chambers combined therewith, expanded;
Fig. 2. is a transverse section of the same with the buoyant chambers contracted.
Fig. 3. is a longitud[i]nal vertical section through the centre of one of the buoyant chambers, and the box B. for receiving it when contracted, which is secured to the lower guard of the vessel.
The top g, and bottom h, of each buoyant chamber, is composed of plank or metal, of suitable strength and stiffness, and the flexible sides and ends of the chambers, are composed of india-rubber cloth, or other suitable water proof fabric, securely united to the edges and ends of the top and bottom of the chambers.
The sides of the chambers may be stayed and supported centrally by a frame k,---as shown in Fig. 3,---or as many stays may be Page 34 combined with them as may be necessary to give them the requisite fullness and strength when expanded.
The buoyant chambers are suspended and operated as follows: a suitable number of vertical shafts or spars D.D. are combined with each of the chambers, as represented in Fig. 1, 2 & 3; to wit: the shafts work freely in apertures formed in the upper sides of the chambers, and their lower ends are permanently secured to the under sides of the chambers: the vertical shafts or spars (D.D.) pass up through the top of the boxes B.B. on the lower guards of the vessel, and then through its upper guards, or some other suitable support, to keep them in a vertical position.
The vertical shaft (D.D.) are connected to the main shaft C, which passes longitudinally through the centre of the vessel---just below its upper deck,---by endless ropes f. f. as represented in Fig 2: the said ropes f.f. being wound several times around the main shaft C, then passing outwards over sheaves or rollers attached to the upper deck or guards of the vessel, from which they descend along the inner sides of the vertical shafts or spars D. D. to sheaves or rollers connected to the boxes B. B. and thence rise to the main shaft (C,) again.
The ropes f.f. are connected to the vertical shafts at i.i. as shown in Figs. 1. & 2. It will therefore be perceived, that by turning the main shaft C. in one direction, the buoyant chambers will be expanded into the position shown in Fig. 1; and by turning the shaft in an opposite direction, the chamber will be contracted into the position shown in Fig. 2.
In Fig. 3. e,e, are check ropes made fast to the tops of the boxes B, B, and to the upper sides of the buoyant chambers; which ropes catch and retain the upper sides of the chambers when their lower sides are forced down, and cause the chambers to be expanded to their full capacity. By varying the length of the check ropes, the depth of immersion of the buoyant chambers can be governed. A suitable number of openings m, m, are formed in the upper sides of the buoyant chambers, for the admission and emission of air when the chambers are expanded and contracted.
The ropes f.f. that connect the main shaft C, with the shafts or spars D. D. (rising from the buoyant chambers,) may be passed from one to the other in any direction that may be deemed best, and that will least incommode the deck of the vessel; or other mechanical means may be employed as the medium of communication between the main shaft and the buoyant chambers, if it should be found expedient. I shall generally make the main shaft C. in as many parts as there are corresponding pairs of buoyant chambers, so that by coupling the sections of the shaft together, the whole of
Page 35 From Nicolay and Hay, Abraham Lincoln: A History
the chambers can be expanded at the same time, and by disconnecting them, either pair of chambers can be expanded, separately from the others as circumstances may require.
The buoyant chambers may be operated by the power of the steam engine applied to the main shaft C, in any convenient manner, or by man power.
Where the guards of a vessel are very high above the water, the boxes B. B. for the reception of the buoyant chambers when contracted, may be dispenced with, and the chambers be contracted by drawing them against the under side of the guards. Or, protecting cases may be secured to the under sides of the guards for the reception of the buoyant chambers when contracted.
When it is desired to combine my expansible buoyant chambers with vessels which have no projecting guards; shelves or cases must be strongly fastened to their sides for the reception of the buoyant chambers.
I wish it to be distinctly understood, that I do not intend to limit myself to any particular mechanical arrangement, in combining expansible buoyant chambers with a vessel, but shall vary the same as I may deem expedient, whilst I attain the same end by substantially the same means. What I claim as my invention and desire to secure by letters patent, is the combination of expansible buoyant chambers placed at the sides of a vessel, with the main shaft or shafts C, by means of the sliding spars, or shafts D, which pass down through the buoyant chambers and are made fast to their bottoms, and the series of ropes and pullies, or their equivalents, in such a manner that by turning the main shaft or shafts in one direction, the buoyant chambers will be forced downwards into the water and at the same time expanded and filled with air for buoying up the vessel by the displacement of water; and by turning the shaft in an opposite direction, the buoyant chambers will be contracted into a small space and secured against injury.
